Rail trail bridge work set to begin: Here’s how to navigate around it

BETHLEHEM — A monthslong project to replace the rail trail bridge over New Scotland Road in Bethlehem is set to start next month, along with closures and detours for both drivers and trail users.

The $3.28 million project, which starts March 6, will replace the entirety of the bridge as well as alter the road, sidewalks and drainage underneath, Albany County Executive Dan McCoy said Friday.

Intermittent lane closures will be in place for about three weeks for tree removal, before both lanes close from Monday tentatively through May 1, after which it will switch to one-lane traffic, he said. Overall, the project is scheduled to last until Oct. 31.

The county project has been planned since about 2019, with factors like the COVID-19 pandemic delaying it, McCoy said. Litigation with former telecommunication company Sprint over laying communication lines has since been resolved, with the company instead laying the lines to the side of the trail, he said.

One sidewalk under the bridge will be closed in order to expand both the roadway and the opposite sidewalk, but a major improvement will be raising the bridge so it will be less at risk of being hit by trucks, McCoy said. The bridge has been hit at least four times since 2011, the latest occurring in October when a truck attempted to pass under it.

McCoy said improvements are also planned for the Albany County Rail Trail that crosses the bridge. Starting March 6, its users will also be detoured.

“It’s going to be an inconvenience, but when it’s done it’s going to make the rail trail a lot better,” McCoy said. He said project dates could change, and advised residents to check the county website for updates.

Crossgates reflects changing face of retail

An inside look: Mall must rely on incentives, cheap rents to survive

GUILDERLAND — Owning a regional shopping mall these days is a pretty tough business.

Gone are boom days of the 1980s and 1990s when going to the mall was one of the best, and often only, ways to shop for anything from music and movies to video games, toys, clothes and home furnishings.

The formula was fairly simple. Attract a few brand-name departments stores — like Macy’s, Boscovs, JCPenney or Sears — fill in a variety of clothing, jewelry, sporting goods and pop culture stores, along with a food court and a movie theater, and you had an extremely solid business model that produced stable rental income that could be measured in decades.

Both Colonie Center — one of the original indoor malls to be built in the Capital Region — and Crossgates Mall, which eventually became the region’s largest and most dominant mall after it opened in the 1980s, thrived under this model.

But things are different today. The explosion of reliable, fast and cheap online shopping, along with changing tastes and attitudes toward the indoor mall shopping experience, began slowly chipping away at malls more than a decade ago.

And when the pandemic hit in early 2020, the mall sector was hit even harder. State governments all across the country ordered large indoor malls like Crossgates and Colonie Center closed until further notice.

Tenants stopped paying rent, yet the malls still had to maintain their hulking buildings, which get regular upgrades and adhere to strict maintenance schedules.

The pandemic hit Crossgates, which has about 200 tenants and 1.7 million square feet of space, particularly hard, even after malls were allowed to open up

later in 2020. The mall’s rents dried up and its tenants that didn’t end up going out of business required huge discounts on rent, and sometimes deferrals, in order to remain.

Rental revenue at Crossgates went from $47 million in 2018 to $30 million in 2020.

Pyramid Management, the Syracuse-based owner of Crossgates, saw the mall’s net operating income, a key indicator of the health of the business, cut in half from $30 million in 2018 to $16 million in 2020.

Typically the public would never get an inside look into the finances and operations of a privately held business like Cross-gates Mall, but in an effort to substantially reduce its expenses, Pyramid has focused on trying to lower the mall’s local property tax bill, which amounts to $7 million a year, most of which goes to the Guilder-land school district.

Pyramid’s strategy has been to challenge the town’s property assessment of Crossgates, which is an estimation of the value of the mall’s real estate and is used to calculate local property tax bills. The town currently assesses Crossgates at $234 million, and Pyramid sued the town in 2021 in state Supreme Court in Albany to have the assessment dropped to $109 million, less than half.

That case, still pending, has opened up hundreds of pages of financial statements, rent rolls and appraisal documents to the public. The documents, filed as evidence with the court and available online, reveal the behind-the-scenes financial reality of Crossgates and how its managers and leasing agents have to compromise and get creative to scratch and claw for revenue that dried up nearly overnight in early 2020 and isn’t coming back.

The documents also show how with the demise of the typical anchor department stores — retailers like Macy’s and JCPenney that went through bankruptcies before the pandemic — the mall has had to rely on other tenants to draw customers.

There is perhaps no tenant at Crossgates more important to the mall’s survival than the Apple store, which had $53 million in sales in 2021, accounting for 26 percent of all the sales at stores at Crossgates.

Only the Best Buy store has higher annual sales, at $75 million.

“They (Apple) are a destination, in and of themselves, and they have an incredible sales performance,” Robert Utter, the chief financial officer at Pyramid testified this past fall in a four-day non-jury trial held in the Guilder-land assessment case, which is awaiting the judge’s decision.

But as much as Apple brings in shoppers, it doesn’t provide Crossgates with much direct income. Apple, which leases 8,100 square feet at Crossgates, pays around $375,000 in annual rent, which is less than 1 percent of its annual sales, making it the cheapest lease arrangement at the mall.

Best Buy, which leases 50,000 square feet of space, paid about $1 million in rent in 2021, which is second only to the Regal Cinemas theater complex, which paid about $2.5 million in rent that year.

Crossgates, like other struggling regional malls nationwide, is in no position to demand more than that, and in many cases, the mall has to nearly give away the farm to popular retailers and entertainment venues to attract them.

“It definitely has been a shift in the business model where the tenants have been pushing a lot more of the risk to the landlord and you see this with sought-after tenants,” Utter said. “You either sign up for their deal or they are not coming to your property.”

For instance, in 2020, Crossgates announced it had landed a coveted Amazon 4-star store, one of the online retailer’s new concept stores that it would stock with popular items. Crossgates had to provide Amazon with nearly $850,000 in incentives to land the store, which opened in February 2021 but shut down in March 2022.

“They (Amazon) were undertaking, you know, their initial roll-out of the concept, to have a brickand-mortar presence,” Utter said at trial. “We were able to secure a deal in the first wave of openings that

opened at Cross-gates,” Vacant storefronts aren’t good for business.

Customers don’t like them, and neither do the mall’s other tenants. So the mall has to also offer discounted and short-term rental deals to less desirable stores, often small specialty retailers, especially around the holidays when the mall needs to look busy.

“It’s really just filling the gaps, so as the consumer walks the shopping center, you don’t see these big open vacant areas,” Utter said.

In addition to participating in federal pandemic relief programs, Crossgates was also forced in 2020 to renegotiate the terms of a $300 million, 10-year mortgage it took out on the mall in 2012.

The move allowed it to defer millions of dollars in interest and principal payments and extended the repayment deadline from May 2022 to May 2023.

The mall’s lenders also did a new appraisal of the mall, measuring its value as a real estate asset as collateral against the mortgage. Crossgates had been appraised at $470 million back in 2012 when it took out the mortgage. But the 2020 appraisal put the value at just $281 million, a drop of 40 percent.

The mortgage, which is broken into three separate loans, still has a balance of $245 million. With the repayment deadline only a few months away, the mall’s lenders flagged the loans for what’s known as “special servicing” over concerns they will go into default, according to Trepp, a commercial real estate data and research firm that tracks such loans.

“There was a significant deferral that was negotiated, effectively not paying debt service for, probably, six months, and then we also pushed out the maturity date, recognizing there would be an inability to refinance the loan.”

Like many large commercial real estate loans, the Crossgates loans were purchased by Wall Street banks and turned into commercial mortgage-backed investment securities similar to bonds that trade on the stock market.

The commercial mortgage securities that own the Crossgates loans also own mortgages on other U.S. malls that, like Cross-gates, have been having financial problems. Because of that the bonds and any news about them have become popular on Wall Street, especially among traders who seek to “short” investments, betting they will fall in value over time.

One of those investors who is shorting these mall bonds is Carl Icahn, the billionaire corporate raider who orchestrated a hostile takeover of Trans World Airlines in 1985. In 2019, Icahn bought up “billions and billions” of dollars in derivatives known as credit default swaps, which are essentially insurance policies issued against the mall bonds that make money when the loans go into default. Icahn reportedly has made $1.3 billion through the strategy.

How to Prepare for an Extended Power Outage

Planning ahead can help make adverse situations more manageable. Such is the case when storms strike and the power goes out. Extended power outages may not be pleasant, but some proactive planning can make it easier to withstand blackouts.

• Establish a local support network. Support can be just as valuable as supplies when confronting power outages. The American Red Cross urges individuals to identify people who can help them during an extended power outage. Such individuals may

help you stay at home or evacuate if the power will be out for a lengthy period of time. Support networks can include relatives who live in nearby towns, but also neighbors. A single street can be served by different substations and main power lines, so friends or neighbor across the street may keep their power when your house does not, or vice versa. When the power goes out, support networks can pool their resources in various ways, including sharing refrigerators or allowing neighbors without power to access the internet. Such support makes it easier for everyone to get through the outage with as little interruption to their lives as possible.

• Print a list of important contacts. If the power is out, it’s only a matter of time before smartphones lose their battery power. Phones can always be plugged into vehicles to get a quick power boost, but that’s not the most practical way to keep phones charged, especially if local roads are closed. A printed list of important contacts, including nearby relatives like seniors who may be incapacitated, doctors and school officials, ensures people whose phone batteries have died can still contact their loved ones and other important individuals so long as they can use a neighbor’s or a loved one’s phone.

• Learn to use your generator. Consumer Reports notes that improper operation of a generator can quickly prove deadly. If carbon monoxide concentrations are too high, individuals can lose their lives in as little as five minutes. And this is no insignificant threat, as the Consumer Product Safety Commission estimates that 95 people died from generator-associated carbon monoxide poisoning in 2017. CR recommends operating generators at least 20 feet away from the house. Individuals should familiarize themselves with their generators upon purchasing them so they aren’t forced to endure a trial by fire when the power goes out.

• Stock up on essentials. The Red Cross recommends keeping a two-week supply of nonperishable food and water in the house, making sure to date each container of water and replace it every six months. Keep some extra coolers in the house so food can be stored on ice before it spoils in the refrigerator or freezer. In addition, make sure there’s enough blankets in the house to keep everyone warm overnight, as it’s not safe to use outdoor heaters indoors. Stock up on battery-powered lights and candles to light the house at night, but make sure all candles are extinguished before going to bed. Extended power outages can be a nuisance. Planning for such outages in advance can make blackouts more manageable.
