Rensselaer County Legislature Office of the Minority September meeting highlights: Environment: The Legislature unanimously passed a resolution requesting the New York State Department of Conservation (NYSDEC) to conduct monthly water sampling at the Quackenderry Creek in the City of Rensselaer after water quality issues were brought up in discussion at the August monthly Public Forum. The Minority Legislators also introduced a resolution urging New York State to ban the use of Styrofoam. The production of Styrofoam is highly toxic; it never truly breaks down; it only degrades into smaller sized particles; it takes up 30% of our landfills, to name just a few reasons. As we are facing capacity issues regarding our local landfills, it seems essential to be proactive in eliminating this toxic substance from our environment. The resolution passed unanimously with bi-partisan support. Planning: The legislature accepted a $ 250,000 grant from the NYS Dormitory Authority for the development of a waterfront multi-use trail connecting the city of Troy and Rensselaer. These funds will be used for the planning and design services of the trail. Legislature: The Rensselaer County Legislature unanimously passed a resolution opposing the proposed new mandatory $ 25 license plate fee introduced by Governor Cuomo requiring any license plate older than 10 years to be replaced, with an additional charge of $ 20 to keep the same plate number. The NYS Legislature will address this issue come January. Mental Health: Showing success in the past year, the legislature extended

a contract for clinical services at the Lansingburgh Central School District for the 2019-2020 school year, which is a source of revenue for the County. Rensselaer County Legislature Majority September Meeting Report The Rensselaer County Legislature voted unanimously to oppose Governor Cuomo’s plan to force every vehicle owner with older license plates to replace them at a cost of $25. The resolution cited the fact that the Governor’s plan has received a lot of opposition from residents and elected officials. Several county clerks, including Rensselaer County Clerk Frank Merola, have voiced their opposition to the plan. “The Rensselaer County Legislature stands with those county clerks and elected officials that oppose this unnecessary new fee on residents. The constant nickel and diming of our residents has to stop”, said Chairman Michael Stammel. “This license plate fiasco has brought both sides of the political aisle to oppose the Governor, It is rather refreshing to see”, said Majority Leader Ken Herrington, “I am a farmer and I have 25 sets of plates for my vehicles, this is just another new fee on business owners.” “This is a $75 million dollar money grab by New York State. It doesn’t cost $25 to make a set of plates, so why should the State turn a profit on the backs

of its residents”, added Legislator Chuck Peter. The Legislature also unanimously passed a resolution stating that they are “concerned about the passage of any bill or legislation, or issuance of Executive Order, which could be interpreted as infringing on the rights of the citizens of Rensselaer County to keep and bear arms or which may unduly restrict their rights to the same.” A resolution urging the DEC to conduct monthly testing of the Quackenderry Creek was also passed. The Legislature wants to make sure that no leachate or toxic run-off from the Dunn Landfill in Rensselaer enters the Hudson River. “We have to take any steps we can to protect the people of Rensselaer”, said Chairman Mike Stammel.

Hoosick Falls’ Annual Walter A. Wood Tractor Show is Back on October 5th! The Walter A. Wood Tractor and Agriculture Show is coming Saturday, October 5th! Come on over to Walter A. Making strides toward walkability East Greenbush planning to extend sidewalks along Columbia Turnpike By KENNETH C. CROWE II

The town is taking the next step in improving walkability along Columbia Turnpike by spending $550,000 to extend sidewalks to its border with the city of Rensselaer. The half-mile stretch from the city line east to Bruen Court is part of the nearly four-mile installation of sidewalks out to Hays Road that is underway along the turnpike, as Routes 9 and 20 are

known in town. “The sidewalk project is another important step in the revitalization of Columbia Turnpike. It improves connectivity and walkability. But most importantly it enhances public safety,” Supervisor Jack Conway said. The design work for the sidewalks between the Rensselaer city line and Bruen Court will be completed this winter. Construction

will begin in the spring of 2020, with work expected to be completed in the spring of 2021. “The primary project objective is to construct a new ADA (Americans with Disabilities Act) compliant sidewalk with curb and new pedestrian ramps to enhance pedestrian safety,” according to the description of the project. Marie Abraham hired as new school resource officer at Columbia High East Greenbush Central School District has hired Officer Marie Abraham from the East Greenbush Police Department to be the new school resource officer at Columbia High School. Officer Abraham, who officially started on the first day of school, succeeds Officer Jay Martyn who was recently promoted to sergeant in the police department. “I’m excited to make a difference in the lives of our students,” Officer Abraham said. “I want them to know they can come to my office at any time to talk about a problem they are having or an issue they are concerned about.” Officer Abraham started her law enforcement career in 2011 in the City of Mechanicville. She has also worked as a college campus public safety supervisor, an investigator for the NYS Justice Center, a domestic violence counselor for the Unity House in Troy and an educator for the Zone 5 Regional Law Enforcement Training Academy in Schenectady. In her new role at Columbia, Officer Abraham will ensure a safe and healthy school climate, and serve as a resource for all district schools on topics such as bullying, drug education, stranger safety and social media safety.

Developer: $12M to pause project By LARRY RULISON

Like it or not, the one-million-square-foot warehouse that Amazon isbuilding on Route 9 in Schodack is likely going to be completed sometime in early 2020, when it will become Amazon’s first large-scale distribution center in upstate New York. While there’s been speculation about whether Amazon will ultimately go through with the $105 million project in the face of opposition by a neighborhood group that has also sued the town over environmental concerns, the project developer, Scannell Properties, says too much is at stake for the company for it not to move forward. $12 million to be exact. There may be some misconception with people that the Town is not building sidewalks. In fact, we are moving ahead with sidewalk construction in Sand Lake and the reconstruction of sidewalk in West Sand Lake. I attended a meeting with Creighton Manning, our sidewalk project engineers. Survey work is completed and Crieighton Manning is putting the finishing touches on the sidewalk design here in the hamlet of Sand Lake and will be submitting the plan shortly to the NYS Department of Transportation. We anticipate having a public hearing on the sidewalk project on October 30th at the Town Board Workshop Meeting. Your attendance and input will be welcomed. At our Town Board meeting on September 11, the Town Board approved a year-long trial period allowing dogs in Butler Park. Given that there are many dog lovers in our town and very few open spaces, the Board believed this was in the best interest of our community. The following conditions must be met: 1. Every dog must be on a leash. 2. A free permit must be obtained from the Town Clerk who will certify each dog is licensed and has a current rabies vaccination. 3. All dog waste must be picked up and disposed of by the walker. 4. No dogs are allowed on the playground. I attended a very enjoyable presentation recently at the Sand Lake Historical Society. Our Town Historian, Bob Moore, shared oral history presentations of three of our residents. It was fascinating to listen to the history of our town interpreted through the eyes and experiences of three of our citizens. Thanks to Bob and Jim Powers who produced these presentations. Sand Lake is a great

place to live! I am happy that we encourage public input on our policy proposals. Our Town Board is committed to transparency and openness; that is why we have a functioning website that contains our agendas and resolutions. We also broadcast all public meetings. Please know that my door is open during the day for anyone to visit me to discuss items that concern you.

The statistics of suicide attempts in this Country is alarming. Suicide affects people of all ages, including our seniors. The proposed budget of $2,136,548 passed 3 to 1. Of the 252 budget votes received, 188 voted “yes” to approve the proposed budget and 64 voted “no”. A second proposal on the ballot was the election of one position on the Library’s Board of Trustees for a five-year term, beginning January 1, 2020. Marianne Harris was elected to the Trustee position receiving 152 of the 286 votes; Camille G. Engel ran a strong campaign receiving 134 of the votes.

Painting & Poetry If you love the imagery in literature - and think it would be fun to recreate some of it - this class is for you! Local artist Muse en Lystrala will be teaching a literature-rooted art class in which the imagery of a piece of literature will be discussed, and then brought to life using Renaissance and Impressionist methods with acrylic paint as a medium. The class will be held on Monday, September 23, 5:307:30 pm at the Main Library, and repeated on Tuesday, October 15, 4:30-6:30 pm at the Lansingburgh Branch. Muse en Lystrala is a musician, artist, game developer, and literature enthusiast. She previously instructed a community art class called Dark Arts Paint, and among many other tasks creates music and art assets at her company, Queenship Game Studio. She lives and works in Troy. This project is made possible with funds from the Decentralization Program, a regrant program of the New York State Council on the Arts with the support of Governor Andrew Cuomo and the New York State Legislature and administered by The Arts Center of the Capital Region.

Troy chided over court action For third time, judges reject city efforts to stop PBA arbitration hearings By KENNETH C. CROWE II

Three times this year Mayor Patrick Madden has sent the city’s labor attorneys out to stop an arbitration hearing with the Troy Police Benevolent Association. And three times, judges have tossed out the city’s arguments and ruled in the union’s favor. The latest decision Sept. 3 found Acting State Supreme Court Justice Henry F. Zwack expressing dismay that the city has continued to press this case in his court at the Rensselaer County Court House. “Here, the Court notes that it has previously ruled on these very issues between the parties, in a decision while this motion was pending, and it is simply inexplicable that the petition for a stay of arbitration has not been withdrawn based upon that ruling,” Zwack wrote. The case brought by the PBA — the city’s largest police union, representing the 131-member department’s sergeants, patrol officers and detectives — contends the city failed to make promotions to sergeant within 30 days and owed four officers back pay and benefits. The city’s attorneys, Jonathan M. Berstein of Goldberg Segalla, argued that the PBA’s grievance was untimely, the union lacked standing and the contractual clause

violated public policy. Zwack ruled that an arbitrator should hear the case, as called for in the PBA’s contract with the city. He issued a similar ruling in July in a case in which the union asserts three sergeants are owed back pay and benefits when the city didn’t promote one of them to captain within 30 days. “I wish the city would just adhere to the collective bargaining agreement that’s in place,” said Troy PBA President Nick Laviano. “I’m not saying they have to agree with all of our grievances set forth, but suing the PBA in front of Supreme Court judges to delay arbitration is not part of our grievance procedure as set forth in our contract. “This practice only wastes taxpayer dollars that could be used for more important things within the city,” Laviano said. It took just 30 minutes for a downpour to destroy Federal Street. Three inches of rain ripped up the asphalt, sidewalks and curbs, dislodging cobblestones that had been in place since the 19th century and sending debris tumbling down the hill. The street has remained closed since the Aug. 21 storm as rebuilding continues. Planners are working to prevent future storms from causing similar damage. But Troy has taken other steps, including porous pavement and sidewalks at some locations. Newer projects are also more likely to include porous pavement. The city has also installed rain gardens that absorb runoff that otherwise would overwhelm storm drains. The combined storm and sewer line that ultimately failed on Federal Street was made of brick and was “very amazing,” Wheland said. It consisted of “three layers of brick wrapped into an inverted teardrop shape,” that likely had endured since the 1800s. The line will be replaced by 160 feet of new pipe. Wheland declined to say when the work would be completed and the street reopened. “We’re going to do it right,” he said. “When we’re done, we’re done.” along grassy and paved areas next to the existing curb or paved shoulders. Scannell also says it has sunk at least $7.7 million into the project already, costs that include the $3.1 million it spent acquiring the two large parcels that make up the 115-acre site. “Scannell has already entered into a lease with Amazon for the distribution facility,” Scannell executive Timothy Elam said in an affidavit filed with the court. “The monthly net rent under that lease is $521,517.” Scannell also said that it already paid out $1.85 million in commissions to the real estate broker who executed the lease with Amazon. The admission in court was the first time that anyone associated with the Amazon project has revealed that Amazon has indeed signed a lease for the building, which had been approved by the Schodack Planning Board more than a year ago, in July 2018. Get to the bottom of elevated liver enzymes

The liver performs various functions in the body. The liver helps break down food, cleans the blood, makes proteins, and stores energy. Each of those tasks is necessary to a long, healthy life. Many people live their lives without ever experiencing issues with their livers. However, doctors may recommend a liver function test for patients who develops yellowing of the skin, low energy or even slurred speech, each of which may indicate liver problems. A liver function test will determine if liver enzymes are functioning properly. Enzymes are substances that accelerates chemical reactions within the body. According to the Mayo Clinic, elevated liver enzymes can indicate inflammation or damage in liver cells. When these cells are injured or inflamed, they can leak higher levels of enzymes into the blood. Elevated liver enzymes do not always indicate a chronic liver problem. In fact, many times elevated liver enzyme levels are a temporary byproduct of certain medications or other unique, nonpermanent situations. However, elevated enzymes also can indicate liver diseases like hepatitis. Fatty liver disease also may result in elevated liver enzymes. WebMD says that doctors may request a series of liver function tests to check for common enzymes. Some of the more frequently checked enzymes include alanine transaminase (ALT), aspartate transaminase (AST), alkaline phosphatase (ALP), and gamma-glutamyl transpeptidase (GGT). Tests are typically recommended for patients who report symptoms like dark urine, low appetite, belly swelling, and fatigue. Tests also may be required if a person has a family history of liver disease or engages in high-risk behaviors, such as heavy alcohol consumption. People who are overweight or have diabetes also may be at risk, states the Cleveland Clinic. Care and treatment for elevated liver enzymes involves finding the cause. If enzymes are elevated due to drug or alcohol use, stopping such behavior can help the liver recover. Doctors may prescribe losing weight or eating a healthier diet if they believe being overweight or obese or one’s poor eating habits are causing elevated enzyme levels. When a cause cannot be identified, a general practitioner may refer patients to doctors who specialize in liver diseases for further testing. Elevated liver enzymes are often indicative of an underlying problem. Finding the root cause can help people get on the road to recovery and feel better faster.

Exercise caution around brake dust

As cars age, certain wear and tear is to be expected. One of the realities of frequent driving, particularly for drivers who routinely drive in stop-and-go traffic, is the gradual deterioration of brake pads. Do-it-yourselfers can replace brake pads on their own, but those that do should be aware of a potential hazard when doing so.

The Mesothelioma Center says that brakes sometimes contain asbestos due to that material’s heat-resistant qualities. As brakes start to wear down over time, the asbestos can escape. The Occupational Safety and Health Administration (OSHA) says that, while many new automotive components are asbestos-free, asbestos hasn’t been eliminated entirely from the industry. That is why mechanics and do-it-yourselfers need to exercise caution when repairing or replacing brakes. Brake dust may inadvertently expose individuals to cancer-causing asbestos through inhalation or ingestion. OSHA says that exposure to asbestos, if not properly controlled, can cause mesothelioma, lung cancer and asbestosis. Symptoms may not appear for years or even decades after contact with asbestos fibers. The Mesothelioma Center estimates that asbestos is present in 30 to 80 percent of brakes and other components. The routine task of “blowing out” brake surfac-

es, which involves using an air hose to clean the surfaces of brakes and rotors, is one of the most common ways people are exposed to asbestos through brake dust. Gray-black brake dust is made up of iron particles formed by the grinding of the brake rotor by the brake pads. However, brake dust also can contain some metallic elements and other components housed in the brake pad — including asbestos. The automotive resource YourMechanic says that, while brake dust is not indicative of a poor braking system, over time brake dust can corrode the clear coat on a car and may eat into the aluminum alloy surface of the wheel. That is why so many drivers try to clean away brake dust, potentially exposing them to dangerous materials. DIYers may be better off visiting professional service centers to have brakes addressed rather than doing the job on their own. OSHA says all automotive brake and clutch repair facilities in the United States must comply with the OSHA asbestos standard. These include using negative pressure enclosure/HEPA vacuum systems and low pressure/wet cleaning methods. While asbestos is being phased out of many automotive components, it is always best to treat bakes, clutches and more with extra caution in the event that asbestos is present.

Vegetarian-friendly foods high in protein

People choose a vegetarian lifestyle for a number of reasons. Some individuals have an aversion to eating meat because they’re concerned about animal welfare, while others find that a low-calorie, vegetarian diet promotes long-term health. Vegetarianism can certainly be a healthy option, but those who eschew meat and sometimes eggs often have to find alternative sources of protein to meet dietary needs. According to the Dietary Reference Intakes, the average sedentary man should have 56 grams of protein per day, while an average sedentary woman should consume 46 grams per day. The amount of protein needed will increase if a person is more active, advises Healthline. Protein helps a person feel fuller, longer, and it is crucial for all cells in the body. Protein is used to build and maintain bones, muscles, skin, and much more. The Academy of Nutrition and Dietetics also states that protein is very important as one ages because aging men and women don’t absorb or metabolize amino acids, which are the building blocks of protein, as well as they did when they were younger. Those adhering to vegetarian diets will find there are plenty of non-meat protein sources. Meatless protein sources that offer the biggest health bang for one’s buck are “complete proteins,” which have the essential amino acids the body requires. Some complete proteins include: • eggs, • milk, • cheese, • soy, and • quinoa. Some other great protein sources may not have all of the amino acids, but they can be paired with other foods to get a fuller nutrient package. • seitan: This is a meat alternative made from wheat gluten. • lentils: Lentils pack 18 grams of protein per cooked cup. • beans: Many forms of beans contain a high amount of protein per serving. • nutritional yeast: This is a strain of yeast that has a cheesy flavor. It can be sprinkled on foods to add a protein punch. • ancient grains: Ancient grains include spelt, teff,

barley, sorghum, farro, and einkorn. These ancient grains are higher in protein than common grains. • hemp seeds: These seeds come from hemp, which is in the same family as marijuana. However, hemp will not cause a high because it only has trace amounts of the THC compound that produces that effect. Hemp seeds contain 50 percent more protein than chia seeds and flax seeds, offers Healthline. In addition to these foods, peanuts and other legumes, almonds, peas, oatmeal, spirulina, broccoli, brussel sprouts, and sweet corn also are good protein sources for

Doubt: A Parable will be presented at the Sand Lake Center for the Arts, 2880 NY 43, Averill Park, for one weekend only, September 20 and 21 at 8:00 pm and September 22 at 2:30. Winner of the 2005 TONY Award for Best Play and the Pulitzer Prize for Best Drama, the play by John Patrick Shanley examines the moral uncertainties of the human heart, through the

structure and example of the Catholic faith. In 1964, many changes were coming to the Catholic Church and society. A charismatic, progressive, forward-thinking priest, Father Flynn, takes an interest in a young, African American student at the local parochial school. Sister Aloysius, principal of St. Nicholas School, takes a cynical and suspicious view of Father Flynn’s interest in that young boy. She particularly dislikes Father Flynn for his open-minded, compassionate, and reformist character, as exemplified in his sermons concerning the nature of certainty and truth, in which he repeatedly uses the parables to teach his congregation. As Father Flynn states, “Doubt can be a bond as powerful and sustaining as certainty.” The nature of

moral certainty— and the actions and consequences that arise from that certainty—form the theme of the play. Director Michael McDermott states, “ Though written 15 years ago, and based in 1964, the matters this play addresses continue to have impact today, it’s as timely as ever. It is the type of play that will leave the audience thinking and debating the outcome. A work of thoughtful theater that is both nuanced and intense, both a detective story and a study of moral uncertainty. The public is invited to step into the experiences of the Cherry Hill household on the evening of May 7, 1827, when a hired hand murdered a household member. The dramatic tour will investigate the scene of the crime and the differing perspectives of those who were there on that fateful evening. Actor James Keil will appear as Jesse Strang, bringing to life the murderer whose violent act was motivated by ro-

mantic attachment to his victim’s wife. The murder resulted in two sensational trials and Albany’s last public hanging. The program will be offered at 5:30 and 7 pm on those evenings. Congratulations to Columbia High School student Bella Dupont ‘21 who completed her Girl Scout Gold Award this summer by creating murals in the school’s English Department. Amidst the lightly colored floors, walls and ceilings are now bright, colorful murals celebrating famous literary titles such as “Of Mice and Men,” “Romeo and Juliet,” and “To Kill a Mockingbird.” There are 12 different murals with each one’s title painted up the column making it appear like the spine of an enormous book on a shelf. Each one also has a graphic or a line of text from the book painted on the side of the column. “For many years the English staff has been interested in having murals created to enrich the students’ love of literature,” Ms. Dupont wrote in her Gold Award presentation. “These murals dovetail my love for art with my love for English and books.” Ms. Dupont consulted with the Reading Department Chair, who is also her mother, Melissa Dupont as well as English Department Chair Meagan Asenbauer. Each of the literary works was chosen by a member of the English Department. “Within just the first few days of school, it’s been apparent that everyone seems to notice and appreciate what the artwork adds to the atmosphere of our floor,” said Mrs. Asenbauer, who selected ‘To Kill a Mockingbird’ by Harper Lee. “It is inspiring for our students and teachers to be surrounded by reminders of these literary classics.”

Easy ways to clean up leaves Autumn is marked by colorful foliage and plummeting temperatures. Once those leaves reach peak color, they fall from the branches and collect on lawns, necessitating cleanup projects. For homeowners with big yards, such a project can be tiring and time-consuming. However, there are ways to make leaf cleanup easier. One of the easiest ways to clean up leaves is to reach for a lawn mower rather than a rake. The mower will cut leaves down to smaller sizes, creating an effective mulch that can add nutrients back into the lawn. Davey, a lawn and landscape solutions service, says that mowed leaves also can be collected in a mower bag and added to garden beds or compost piles. For those who prefer manual raking, select a rake with tines that will not skewer the leaves in the process. Big rakes also can make faster work of gathering leaves into piles. This is a manual device that has a rotating sweeping brush that gathers up lawn debris and leaves into an attached hopper bag. LETTERS TO THE EDITOR Memoirs of an Amnesiac: Mrs. Clitherow My parents came to Averill Park from England in 1950. Before then my mother had never seen snow or felt 90-degree heat. As a young girl, she was told by a fortune-teller that she would move to America; so she accepted the hardships. Luckily, we met an elderly English lady who lived in the area: a Mrs. Daisy Clitherow. For Mom every visit was a mini-vacation back to the Old Country. Mrs. C. lived in the hills above Hoags Corners, along a wooded lane off Greenman Hill Road. Just driving there felt like an adventure. Like many cottages in England, her place here had a name: “Summerhill”. Maybe that was because she lived here only during the warm months. She spent Winter with a grown son. She was a refined lady. But while taking tea outside on her veranda, she kept a rifle handy for picking off critters in her garden. There was a strength about her which may have come from living in England during WWII, where people faced food shortages and the constant threat of attack. She and my parents had lots of war stories to share. Mrs. Clitherow knew the secret for making a proper cup of tea. And sometimes she would tell your fortune by “reading” the loose tea leaves in your cup. At first, my brother and I were too young for that, so she’d hand us

office, which takes me to a piece of election-year political propaganda that ended up in my mailbox, wherein was claimed that Eric Wohlleber of Poestenkill is running for a seat on the Poestenkill Town Council to “ensure that town government is responsive to the residents and that we are providing the proper services to build a bright future.” As someone who has lived in this town now for seventy (70) years, and who has had contact with this same Eric Wohlleber concerning the Jacangelo Garbage Reception Station in Poestenkill that is operating as a public nuisance according to our code as written, as a resident of this town and a voter, I would step forward and challenge Mr. Wohlleber on that statement about “ensuring that town government is responsive to the residents,” because that is an empty statement and an insult to our intelligence. Mr. Wohlleber had his opportunity over these last several years as a sitting councilman to ensure that town government is responsive to the residents, and he not only failed to do that, but has gone further to ensure that the town totally ignores the residents of the residentially zoned area of the Town who are subjected to the nuisance of the Jacangelo garbage transfer station on a daily basis. Women’s hockey team looking for players, all skills welcome The Troy-based Frozen Assets women’s hockey team is looking for players and goalies of all skills. Players on the team range in age from 21 to almost 70. Some players are just learning to play hockey while others played in college. The team has two squads, one that competes recreationally and another that competes at the D-level. The team plays on Sunday evenings at Hudson Valley Community College in Troy and competes with teams in Clifton Park, Saratoga and Schenectady at various times through the week. The season runs from November to March. If you are just learning to skate, the Assets can direct you to some great programs in the area. If you already know how to skate, the Assets will teach you how to play hockey. If you are an experienced hockey player, you may play for the D-team. Such studies, which are thousands of pages, typically take months to complete at the cost of the developer, which must incorporate changes to the project to mitigate environmental impacts. After the Birchwood Association’s suit was tossed by state Supreme Court Justice Patrick McGrath earlier this year, the Birchwood Association appealed the case to the Appellate Division. Since the case won’t be heard until next month and perhaps won’t be decided until December, the group sought a temporary injunction to stop construction, which began in June after Scannell purchased the property. The Appellate Division ruled against granting the injunction in a one-sentence ruling, made on Aug. 27, that gave no reason for the denial. However, one of Scannell’s main arguments against granting the injunction was that it would cost the company millions of dollars extra to stop the project until the end of the year since that would

delay the construction of the exterior walls until the middle of the winter. As of now, they are expected to be finished by November. “Scannell has invested substantial amounts in the construction and development of the project to date,” the company said in its court filing. Neither Amazon nor Scannell responded to a request to comment on the lease of the building. In the same court filing, Scannell also requested that the Birchwood Association be required to put up a $12 million bond if the injunction were granted to protect Scannell from “damages” that it expected to incur from the delays. For its part, the Birchwood Association said that it has had to bear its own legal costs as it fights town officials they say should be representing their interests instead of Amazon, which has promised to bring 800 jobs to Schodack. “To have to fight our own town at significant cost in order to have one of the largest projects in New York state properly reviewed is disheartening,” Birchwood Association spokesman Robert Jansing told the Times Union after the injunction was rejected. “We all believe in growth and progress.

We welcome new jobs in Rensselaer County. But let’s respect the laws.” Jansing went on to say that while he was certain that Amazon could afford the extra costs that an Environmental Impact Statement would add to the project, he wasn’t sure that the town could afford the potential consequences that would be unforeseen without doing such a study. “Is it really worth the risk?” Jansing asked.
