Records reveal disbelief, deceit DA’s documents show how investigation progressed after Schoharie disaster

forcement colleagues were in the early stages of their investigation of a catastrophe that had killed 18 people in Hussain’s stretch limo and two people standing in the parking lot of the Apple Barrel Country Store in the town of Schoharie. The investigators were gathering the first pieces of evidence that would lead a few days later to the limo operator’s arrest in one of the worst U.S. highway disasters in decades. Details of the phone call and other revelations about Hussain and his limousine were included in a seven-page court filing submitted Tuesday in Schoharie County Court. They also revealed for the first time that a state inspector

By: LARRY RULISON

SCHOHARIE - Nauman Hussain first thought he was the victim of a crank call when State Police Investigator Erika Hock called his cellphone on Oct. 6 to tell him one of his limousines had just been involved in a crash. Hock wanted to know who the driver was, and where he had been going. “His name is Scott,” Hussain replied. “Is he OK? Is this a prank?” It wasn’t: Hock and dozens of her law en-

had warned Hussain as early as January 2018 -- nine months before the crash -- that the limo was not certified to carry passengers. The documents, first reported by NewsChannel 13, were compiled by District Attorney Susan Mallery, who is prosecuting Hussain on 40 counts of criminally negligent homicide and manslaughter for his alleged role in the crash as the operator of his father’s business, Prestige Limousine. The court documents, obtained by the Times Union on Thursday, show how Hussain reacted when he first learned about the crash. involved. According to the home improvement resource HomeAdvisor, more than one-third of homeowners do not understand what hiring a professional will cost, and then cannot successfully budget and secure financing once they have set their sights on a renovation project. HomeAdvisor says that some of the more popular projects, such as remodeling a kitchen or bathroom or building a deck, can cost, on average, $19,920, $9,274 and $6,919, respectively. Homeowners may find that the more expensive renovations require them to secure some type of financing. Those who have never before sought such financing may want to consider these options. 1. Cash-out refinancing: With cash-out refinancing, a person will begin the mortgage process anew with the intention of paying off the current mortgage balance, and then taking out additional funds for other purposes. Cash-out refinancing is a way to tap into a home’s existing equity for use on improvements or other expenses, such as college tuition. 2. Home equity line of credit: The financial experts at Bankrate indicate that a HELOC works like a credit card, with the house as collateral. There is a credit limit, and borrowers can spend up to that limit. The interest rate may or may not be fixed. However, the interest may be tax-deductible if the financing is used to improve, buy or build a home. 3. Home equity loan: Individuals also can borrow against equity in their homes with a fixed interest rate through a home equity loan. Most lenders will calculate 80 percent of the home value and subtract a homeowner’s mortgage balance to figure out how much can be borrowed, according to the financial advisory site The Simple Dollar. 4. Personal loan: Homeowners can shop around at various financial institutions for competitive personal loans to be used for home improvement purposes. Funds may be approved within one business day, which can be ideal

for those who want to begin their improvements soon. 5. Personal line of credit: A personal line of credit allows borrowers to borrow only the money needed at the time, and offers a variable interest rate that is generally lower than fixed loan rates. Again, like a credit card, PLOC gives a person a maximum borrowing amount and is ideal for ongoing purchases. 6. Credit cards: In a pinch, credit cards can be used to finance improvements, but they do come with the cost of very high interest rates if the balance is not paid in full by the time the bill comes due. However, for funding smaller projects and maximizing rewards points through home improvement retailers or specific credit card company promotions, credit cards can be a way to earn various perks in addition to the benefit of improving a home. Lawn and garden enthusiasts often must address unforeseen issues when tending to their lawns. Weeds can be a blight, and drought can compromise the look and integrity of a lawn. Another, more deceptive potential adversary is moles. After a spring and summer spent tending to their gardens, no homeowner wants to have their hard work compromised by moles. “The Old Farmer’s Almanac” says that moles are grounddwelling insectivores that feast on insects in the soil. Moles grow to be roughly six to eight inches long and 2019 Hazardous Waste Drop-Off Days have gray or black, velvety fur. There are various ways to address mole problems in a lawn or garden. Some professionals may recommend fumigants, home remedies and repellents. Using insecticides can rid the lawn of some of the foods that moles dine upon, ultimately discouraging them from coming onto a property. How lawns benefit from aeration Compacted soil can have a dramatic effect on grass. Compacted soil blocks oxygen, water and nutrients from reaching the root systems of the turf. That creates a lawn with weak roots, which make grass more vulnerable to disease and compromising its ability to withstand harsh weather, such as summer heat. The buildup of thatch, which is a matted layer of grass

clippings and other organic debris that collects on the top of the soil, is one indicator that a lawn could benefit from aeration, a process in which the surface of the lawn is perforated to break up compacted soil and allow oxygen, water and nutrients to reach root systems. Other signs that aeration may be necessary include patches of thin grass, brown spots and a high concentration of clay in the soil. When faced with a lawn that could benefit from aeration, homeowners may wonder if such as task lends itself to DIY or if it’s best left to professional landscapers. Aer-

ating a lawn is not always easy, and typically it involves the use of one of three types of aerators: • Core aerator: A core aerator uses hollow tines to pull plugs of soil from the lawn. The plugs are left on the surface of the lawn. Homeowners can pick up the plugs or, according to the grass seed experts at Pennington, even leave them in the yard and allow them to break down. • Spike aerator: The experts at Pennington note that spike aerators employ solid, spike-like tines to poke holes in the soil. These aerators leave the spikes in the soil. Some people wear spiked aeration shoes while walking around the yard to mimic the effects of spike aerators. • Slicing aerator: According to Pennington, slicing aerators employ rotating blades that slice through thatch and down into the soil. These aerators leave the soil in the ground. Aerators can be operated manually, though professionals tend to use motorized aerators. The machines are often heavy, so homeowners should consider their health and physical ability before deciding to aerate on their own. Hiring a professional landscaper who has experience aerating may the quickest and most effective way to restore a lawn to full health.

Did you know? Oxygen is essential for the roots of grass to breathe and grow strong enough to support healthy lawns. But according to the Center for Agriculture, Food and the Environment at the University of Massachusetts Amherst, compacted soil can produce a decrease in oxygen content that can make it hard for roots to thrive. Soil compaction can result from a number of activities, including walking on grass or driving or parking vehicles on grass. When soil is compacted, it breaks into small particles that reduce the amount of pore space in the soil. That makes it hard for water, oxygen and nutrients to get through, threatening the strength of the roots and putting the grass in jeopardy. Aerating a lawn can help homeowners foster strong root growth and healthy grass. When to aerate may be contingent upon local climate, so homeowners who suspect the soil in their yards is compact should consult with a local landscaping professional to determine the best time to aerate their lawns.

Restore rusty tools Many people may be tempted to discard rusty tools that have gone unused and sat in a garage or shed for a significant period of time. But tools encrusted with rust do not need to be relegated to the trash bin, nor do gardeners have to toil for hours scraping and sanding off the rust. There’s a much easier way to restore rusty tools that relies

on a common household ingredient: vinegar. Pour vinegar into a deep enough vessel to submerge the metal part of the tool. Soak the tool overnight. The next day, use a scouring pad to rub off the rust. If the tool is too big to fit into a can or bucket, simply wrap it with a vinegar-soaked rag and cover the whole tool with a tightly secured plastic bag. Follow the same procedure the next day. After all the rust is gone, rinse the tool in cool water and dry thoroughly. Then return it to regular usage.

The Irish American Heritage Museum Father Patrick Peyton, CSC Exhibit ALBANY – The Irish American Heritage Museum is sponsoring an exhibit and series of presentations on Father Patrick Peyton, CSC. The exhibit is on loan from the Father Peyton Centre in County Mayo, Ireland where Father Peyton was born. He began his work in 1942 in Albany at Vincentian Institute and the College of St. Rose. For the next three decades his radio, film and television programming inspired families across America to pray together recognizing his slogan, “The family that prays together, stays together”. His second huge undertaking was crusades in countries around the world where he personally addressed in person over 27 million people. We can be proud to know him as Albany’s own Rosary priest and recognize that his work continues today through the Holy Cross Ministries. The Grand Opening of the Exhibit is June 9th from 2:00 pm to 5:00 pm. The panel presentations are June 12th (Personal Stories); June 19th (Status of his Cause for Sainthood); and, June 26th (Devotion to the Mother of Jesus). Presentations are at 7:00 pm. DECEIT CONTINUED FROM 3

Amsterdam had asked to book a stretch limousine through Hussain’s company for a 30th birthday celebration for his wife, Amy, at the Ommegang Brewery in Cooperstown. Between 16 to 18 people had been expected to ride in the vehicle, Hussain told Hock. The last-minute booking called for the use of Hussain’s largest vehicle: a stretch 2001 Ford Excursion that could fit up to 18 people. With a 26-foot wheel base, it was twice as long as a regular Excursion. On that initial phone call, Hock asked Hussain the particulars of the booking and how the driver, Scott Lisinicchia, was assigned to the job. “They booked the limo from 1 to 6 (p.m.),” Hussain said. “They were going to the brewery and then the guy was going to tell the driver where to stop after that.” “How did you contact the driver for the booking?,” Hock asked. “I called him to see if he could do it, then everything else was through text,” Hussain responded. The court filing reveals that state Department of Transportation investigator Chad Smith first contacted Nauman Hussain in January 2018 to inform him he was violating state law by booking passengers in the Excursion, which lacked DOT certification in part because it had not received a special DOT inspection designed for buses. The documents show that Smith confronted Hussain eight times between January and the day of the fatal crash -- both in person and over the phone -about the illegal limo. When Smith asked to get access to the Excursion, Hussain told the official he kept it parked with his other limos in a lot off Weibel Avenue in Saratoga Springs. However, when Smith asked to inspect the Excursion on Jan. 12, 2018, Hussain told him it was located at a nearby Mavis Discount Tire store, although he could go to look at the Excursion there, the court documents allege. Smith was finally able to inspect the Excursion twice before the Oct. 6 accident, on March 21 and Sept. 4. On both dates, Smith declared the vehicle unfit to be on the road due to safety violations, and affixed an out-ofservice sticker on the windshield. The court filings say Smith last contacted Hussain on Oct. 5, the day before the crash, seeking drug and alcohol testing information -- presumably regarding the drivers that Hussain used. In another previously unknown

Shahed Hussain, who had been living with his sons Nauman and Shahyer in a rented house in Loudonville, left the United States on March 20, 2018, and has been living in Pakistan, recovering from open heart surgery he had in January 2018 at Albany Medical Center. Nauman Hussain didn’t reveal his true identity to Smith until the second inspection, just a month before the accident. “Who is Nauman Hussain?” Smith asked him on Sept. 4, 2018. “It’s me,” the young man replied. “Who is Shahed Hussain, then?” Smith asked. “He is my father,” Hussain replied. A state DOT spokesman did not immediately answer questions posed by the Times Union about what prompted Smith to initially contact Hussain in January 2018 and notify him that the Excursion was in violation of state transportation law. On the day of the crash, Hussain was much more forthright about his identity. According to Tuesday’s court filing, Hock found Hussain’s phone number after she Googled “Prestige Limousine.” “Are you the owner of the limo com-

LEGACY CONTINUED FROM 3

The 30-year-old Burns has devoted more than a decade of research to unearthing the history of 9 Upper Loudon Road. What started as a quest to prove its Shaker origins evolved into a search to find someone to save it. The farmhouse is now slated for demolition, but its pieces are due to be salvaged and possibly reconstructed elsewhere thanks to Burns’ efforts. “Being a safety concern, it’s vital to dismantle this farmhouse and save it,” Burns said as he stood in the dilapidated kitchen. “This is the last structure of this entire 80 acres ... so if this could be saved and put onto another location it would be a great thing.” The rest of the property that was farmed continuously for more than 200 years faces an uncertain future amid rapid development in Colonie. The current owner said its fate is undecided. Both the town and the Shaker Heritage Society said they’re interested in the property but don’t have resources to invest in it. Burns wants to see it preserved as a conservation area. “Because of the development and everything, Colonie or the neighborhood could rise up and keep it as a tract of land where a garden could be built or the town could keep it as conservation land,” said Burns. He studied preservation carpentry, worked on five Shaker villages and is currently the project manager for residential restoration and historic preservation work with Asher Nichols & Craftsmen in Massachusetts. “The land is quite significant and it’ll be interesting to see where it goes and how it’s used in the future.” A journey through history Burns grew up in a family steeped in history. His parents took him to visit sites of the Shakers, a Christian sect that left England in search of religious tolerance and first settled near the present-day location of the Albany County Airport. Their egalitarian, celibate, pacifist and agricultural community spread and thrived in the mid1900s. While Burns was in college studying preservation carpentry in Boston, he interned at the Historic Albany Foundation and worked summers picking peppers at the 9 Upper Loudon Road farm. He had a hunch the property was Shaker because of its architecture and even discovered a Shaker-made clay pipe. In 2008, he began a journey to unravel the property’s history and prove its Shaker origins. In a book on Colonie history in his family’s library he found an 1866 map of Ireland’s Corners -- the present-day intersection of Route 9 and Old Niskayuna Road -- that showed two Shaker sites, one in the location of his neighbor’s farm. Next he headed to the Albany County Hall of Records where he found a 1921 deed proving the Shakers owned the farm. He spent hours poring over large ledgers in the State Archives in Albany, hands sheathed in protective gloves and eyes straining to decipher centuries-old handwriting, to learn more. In 2009, Burns discovered a record from the Church Family at Watervliet Shaker Village where the trustees and deacons agreed to buy the land. Four years ago, Burns found final confirmation: an 1848 newspaper advertisement for the 80-acre farm sold by farmer Michael Kemp to the Shakers. Journal entries from Shaker eldress Ann Buckingham, documented from the State Archives, reveal life at the farm. In 1849, the Shakers moved the original Dutch cottage that Burns estimates was built between 1760 and 1790 to its present site with the help of two oxen.

They grew corn and tended sheep. They planted apple, plum, peach and cherry trees. They raised a four-story barn. By the 1920s, Shaker communities were shrinking, Burns said. The Shakers sold off most of their property in Albany County as the airport moved in and they went to other villages. The Shakers sold the farm at 9 Upper Loudon Road to John H. Male in 1927. Male farmed vegetables -- tomatoes, squash, cabbage, lettuce, zucchini, peppers -- and loaded a truck with produce every week to sell at local markets, Burns said. Starting in the 1920s through the 1960s, Male sold off most of the 80 acres to neighbors who wanted to build houses, Burns said. One of the last family members to live in the house was his granddaughter Carolyn Male, a College of Saint Rose biologist famous for developing more than 100 varieties of heirloom tomatoes seeded in

greenhouses on the property. In 2002, the Male family sold the remaining 14 acres to James H. Maloy Contracting. The Maloy family rented out the land to a tenant farmer and beekeeper, but without regular residents, have struggled with trespassers, Burns said. In 2015, the Shaker-built four-story barn burned down. Burns said it was set on fire by local kids, whether by accident or not. In 2017, the Maloys’ tenant stopped farming the property. Who will save it? As Burns watched the farmhouse disintegrate and realized it couldn’t be left standing, he embarked on his next mission: finding someone to save it. In 2010, Burns approached Colonie town historian Kevin Franklin and the Shaker Heritage Society, at the time run by Starlyn D’Angelo, with his findings. D’Angelo said she doubted the property’s Shaker roots at first, but Burns provided sufficient documentation. “Billy deserves a great deal of credit for identifying and researching this property since it is an important part of our national heritage,” D’Angelo wrote in an email to the Times Union. “Unfortunately, Shaker Heritage Society lacks sufficient resources to build upon Billy’s research or to acquire the property.” She and current director Johanna Batman both said the society must focus its finite resources on preservation efforts in the Watervliet Shaker National Historic District -- the 1-square-mile area between the airport and Sand Creek Road. Burns met with Franklin and Supervisor Paula Mahan for help a year or two later, also with no luck. Sara Wiest, Colonie’s public information officer, said in an email the town is aware of the property’s history and hopes it can be saved, but cannot buy the property or the house. She said the town’s resources are committed to preserving the Pruyn House and acquiring open space. Franklin said saving historical structures is problematic. “There are a lot of structures that people would like to save or have ideas of saving but in reality how many are you going to save? Where are you going to put them? What is the cost involved?” Franklin said. “I do not have the authority to prevent anybody from tearing a building down.” So Burns devised a solution: don’t stop the demolition, but save the pieces. He connected the Maloy family with Richard Strunk, owner of Windy Hill Restorations in Montgomery County. Strunk, who has already removed the roof, flooring, stairway, windows and doors, agreed to dismantle most of the rest of the house. The owners applied for a demolition permit with the town Building Department that was approved in December. The dismantling will be before the end of summer. Strunk said he hasn’t decided whether or where he’s going to reconstruct the house. Today, one question remains unanswered: amid rapid development in Colonie, in a desirable location hemmed in by residential developments, what will happen to the historic farm property? Project manager Brian Maloy, son of the owner James Maloy, said his father doesn’t know the plan for the property yet. “Long term I don’t think there is a plan yet, we’re kind of just holding it,” Maloy told the Times Union. “I’m sure long term, it’s development, but not in the near-term horizon.” See a digital presentation of this article by Mallory Moench at www.timesunion.com.

FEEDING TREES, SHRUBS & PERENNIALS

Tools for Spring feeding.

Pounding in tree food spikes.

Poking hole to get plant food to the roots.

Pouring food into the holes.

Trench feeding method.

One project that I like to tackle early is feeding all the permanent members of my garden community: the trees, shrubs and perennials. The reason I like to get these woody and perennial plants fed early is this: the granular fertilizers and tree food spikes that I’ll use take some time to dissolve and permeate the soil. When you get the food into the soil early, it will have plenty of time and spring rain to dissolve and soak into the soil. When the plants get the warmth they need to spring into growth, the nutrients they need will already be there waiting for them. Since our garden plants have depleted a great deal of their reserve energy just surviving the winter, they need nutrients more in the early spring than at any other time of year. For trees and large shrubs, an easy way to apply nutrients is by pounding in some of those tree food spikes that are made of compressed fertilizer. When you go to the garden center, you’ll notice that there are different formulas for different plants. The spikes for evergreens and shade trees are higher in nitrogen and those for fruit tree are higher in phosphorus to enhance fruit production. You may have large, flowering shrubs like lilacs that you want to feed with spikes. The fruit tree spikes, with their higher phosphorus formula would make them appropriate for use on flowering shrubs as well. Be careful to follow the directions when using fertilizer spikes. They should be driven into the ground AWAY from the trunk or stem of the plant you’re feeding. The tiny roots that take up the nutrients are about the same distance from the trunk as the outermost branch tips. For trees, it’s easy to figure out where to place the spikes. Simply walk away from the trunk until you are standing under the outermost branch tips and pound in the spikes at that circumference. How many spikes you’ll need to use is determined by the diameter of the trunk. There are directions on the package. Follow them. More isn’t necessarily better. If you use too many spikes or place them too close to the trunk, you may do more harm than good. For smaller shrubs and perennials, you’ll want to use a gentle, granular food. I like the Espoma products. You can pound holes around small shrubs (under the outermost branch tips) and pour the appropriate amount of plant food into them. When in doubt, less is best. On the perennials, I’ll dig a shallow trench well away from the crown of the plant and apply a modest amount of gentle Espoma Flower-tone plant food. Follow the recommendations on the package. If you can get out there at the first opportunity and get your nutrients into the soil early, your landscape plants will be able to take advantage of them and have the best season possible. Thanks for the read.
