Who gets your property, your money and all your belongings when you die? Who takes care of your children when you die? Who makes health care decisions for you if you can’t? Who has the authority to handle your financial and other affairs if you become incapacitated? Reasons to have a will If you die without a will, your belongings will be distributed according to state law. A judge will determine who should handle your estate, including who might take care of your minor children. In a will, you make the decisions that will best protect your family and your property. You can take steps to minimize tax consequences and keep costs and fees down. In most cases, it pays to plan ahead with a qualified professional. As hard as end of life planning can be, it may be harder for your family after you have gone – at the time of their loss, and without your help and guidance. Plan now to help limit the hardship for others at the time of your death. Reasons to have a Health Care Proxy and/or Living Will Who do you want talking to doctors on your behalf if you can’t? You can designate someone you trust and give directions of what care you want. Reasons to have a Power of Attorney If you are incapacitated, you need someone to take certain actions to protect your assets and property. Without a properly prepared Power of Attorney, your family might have to resort to an expensive guardianship proceeding to take care of your financial dealings – bank accounts, insurance, car or house problems or other financial issues.
