Who does OSHA look to first when multiple contractors are at work on a job site where safety is called into question? If your company has any control over the work process, the agency’s Multi-Employer Worksite Policy specifies that the responsibility likely falls on you. Have you done everything you could to prevent an accident? OSHA uses the policy to assess responsibility on a construction site where there are likely many different companies at many different contract levels. The four employer categories are creating contractor, exposing CEG CORRESPONDENT
contractor, fixing contractor and controlling contractor. As the name implies, the creating contractor creates a hazard resulting in an incident or accident. The exposing contractor puts his or her employees in harm’s way whether they created the hazard or not. The fixing contractor, who may or may not be the creating contractor, is responsible for fixing the safety violation. Finally, the controlling contractor holds contracts with and has authority over the contractors on site. “An exception may come when a creating contractor has already demobilized from the site, and the correction see OSHA page 16

Officials cut the ribbon to officially open the I-25 University Avenue Project. The approximately $34 million project is designed to improve safety and traffic flow at one of the city’s busiest traffic interchanges.
Prior to purchasing its first XL trailer, Global Asphalt Solutions faced struggles in transporting all necessary equipment to job sites in one trip. Global’s day-to-day operations needed a new solution to help improve productivity.

New Mexico Dept. of Transportation Celebrates Completion of I-25 Project
The approximately $34 million project, which has been under construction since January 2020, is designed to improve safety and traffic flow at one of the city’s busiest traffic interchanges.
The New Mexico Department of Transportation (NMDOT), distinguished guests and community members cut the ribbon to officially open the I-25 University Avenue Project. The approximately $34 million project, which has been under construction since January 2020, is designed to improve safety and traffic flow at one of the city’s busiest traffic interchanges. Jerry Paz, chief operations officer of Molzen Corbin, the lead designer on the project, said the project set a new standard for sustainability by recycling demolition materials for use in backfill and construction of mechanically stabilized earth (MSE) retaining walls, use of high-efficiency LED lighting to reduce light scatter and multi-modal enhancement through improvements to the multi-use trail system in the area as well as accommodations on University Avenue for bicyclists and pedestrians. Trent Doolittle, a Las Cruces native and the district engineer of the NMDOT District One office, said he was very happy to see the project completed. “Before COVID, more than 35,000 vehicles traveled this stretch of I-25 every day. With traffic continuing to ramp back up, this is the perfect time to provide better and safer traffic flow and better connectons to this area of the city.” Lt. Gov. Howie Morales, who kicked off the ribbon cutting, praised the project as an example of a true partnership between the NMDOT, the city of Las Cruces and New Mexico State University. Cindy Vigue, division administrator of the Federal Highway Administration, New Mexico Division, said the project helps ensure the roadway is safe, will continue to support economic growth in Las Cruces, and is also a model for sustainability.

He gives as an example a steel erection company which has left the site with perimeter cables in poor condition but a concrete company has been contractually obligated to maintain the cables. “The controlling contractor is the one that needs attention here,” said Braun. “If they are not exerting enough control over their contractors, OSHA can and most likely will cite them for their inaction.” How much control is enough is certainly up for interpretation, he said. “Control is one of the most hotly contested points of clarification I’ve seen in expert-witness cases.” What is the Multi-Employer Worksite Policy? Did the general contractor or construction manager perform enough inspections? Did they provide any training or, at the very least, ensure that proper training had been conducted? Did they clearly communicate expectations? Did they even do any prequalification of their contractors? “Questions like these will be considered when determining how responsible the controlling contractor is. You need to be asking yourself if you are responsible, what can you do to ensure your contractors’ safety is up to par,” continued Braun. While creating, exposing and correcting employers may have clear responsibilities to prevent hazards, the standards for controlling employers are more confusing, said Stan Liang, health and safety consultant of Tetra Tech. “But controlling employers also carry a higher responsibility for compliance, so it’s important to understand what a controlling employer’s obligations are.” To determine whether a control-
ling employer is subject to citations under OSHA’s MECP, it must be determined if the actions of the employer were enough to meet its obligations. OSHA expects controlling employers to exercise “reasonable care” to prevent hazards, including inspections of the work site, noted Liang. “How often the employer should be inspecting the workplace is determined by many factors: the nature of the work being performed, the scale of the project, what the employer knows about the potential hazards and what the employer knows about the safety practices of the other employers at the site,” he said. “For example, if a subcontractor is known to have a history of frequent safety violations, it is expected that the controlling employer will perform more frequent worksite inspections.” Failing to exercise reasonable care to prevent safety violations could cause the controlling employer to receive an OSHA violation, even if they did not directly cause the hazard, he stressed. Ask the Right Questions When it comes to best practices, it matters not which category of responsibility you fall under on the job site. Regardless of whether you are the general contractor or a subcontractor, there are steps you can take to improve your safety program. As Braun sees it, managing contractors is “exponentially more straightforward” if you hire contractors with a solid track record for safety. That starts at the prequalification stage. Requiring a contractor’s health and safety plan, OSHA logs and experience modification rate is a good approach to the prequalification process, said Braun. “In addition, you can check OSHA’s website to see if the con-

tractor has incurred any fines and citations from OSHA.” Make sure this information is reviewed by someone who knows what to look for, he said, adding “not all incidents and citations are created equally.” The reviewer should know the difference between a de minimus and a serious violation, should check the frequency and severity of a company’s incident record in relation to its safety performance, for instance. “In addition, if you know other companies who have used these contractors in the past, ask about them,” said Braun. Did they perform safely? How was management support for the safety program? Did the company seem to have a safety culture? Did they use well-kept equipment or old, beat-up stuff? “Try to get a big-picture overview of the company rather than a one-off experience.” Next, make sure the contractors and subs you work with know what you expect from them. Even before work commences there are opportunities to spell it out, said
Braun. Bid documents should make clear what you want how they expect to meet safety responsibilities. This will give the subcontractor ample time to price necessary equipment and staff to perform work properly on your job, he added. “Once you’ve decided to award the bid to a company, the contract should also include what you expect their safety responsibilities to be. This goes beyond just saying that they must meet OSHA requirements,” said Braun. Are there areas in the job site where going above and beyond OSHA will be necessary? Are there disciplinary policies that they need to know? What are the drug and alcohol screening requirements for the job? “None of this should come as a surprise to your contractor,” said Braun. “But if it does and you had it in the documents, then that’s on them.” Finally, you should explicitly require all certification and training documentation relevant to the project. For instance, will they be oper-
ating aerial lifts? Get training records. Forklifts? Get their licenses. Working on excavation sites? Do they have excavation training? “Also, have your contractor name — in writing — who their competent person will be and justify that designation by submitting that person’s background to you,” he said. “To think that this information will then make it down to the boots on the ground is optimistic at best,” he stressed. “Before the workers step foot on-site, you should ensure that they go through an orientation that clearly lays out what you expect of them.” According to Braun, that orientation should include safety requirements, disciplinary policies, drug and alcohol policies and everything else you addressed at the contract level relevant to the workforce. “Don’t hesitate to hang conspicuous signs that emphasize some more important points. If your orientation is a checklist or a speech delivered by a disinterested party, you’re squandering an opportunity to set the tone for the project.” Never Assume Anything Maintain some level of oversight. That’s not to say you have to oversee contractors and subs every minute of every day, said Braun. Periodic observation of the job site is key, he believes. Notify the contractor, in writing, of any violations and tell them when you expect them to be fixed, he suggested. Have them reply, in writing, when they are taking care of the issues and verify it. Spot check who is operating equipment and match that up to the records you have on file. Are the contractors diligent about their people being qualified to do what they are being asked to do? “The process of observing your contractors runs the length of the project,” he said. CEG

The order value, which is not disclosed, has been booked in Minerals segment’s Q3 2021 orders received. The startup of the project is scheduled for the first half of 2024. The order for the product screening and scalping application covers 12 Metso Outotec BSE Series (Banana Screen Elliptical) tandem screens and 4 MF Series screens, all equipped with 305PS screening media. MB Jaw Crusher Bucket Solves Rebar Issue for Contractors There’s always been a weak point in the demolition and redevelopment industry when it comes to processing reinforced materials. When it comes to recovering reinforced material, companies have been forced to (reluctantly) come to terms with the limitations of the machines they own. Terex Utilities Unveils Auger Tools for Digger Derricks Terex Utilities introduced two new digger derrick auger tools and a new compact equipment hydraulic drilling attachment and tool product line at The Utility Expo. “Terex Utilities partners with customers to understand their unique work conditions, designing auger tools to stand up to the most extreme conditions. We continue to expand our standard offerings to evolve with the fleet needs of customers. For special applications, Terex Utilities is able to efficiently design and build custom tooling,” said Beau Anderson, parts director. Achieving Productivity With Digger Derrick, Pressure Digger Auger Tools The Foundation High Production Auger is designed to improve drill footage in a variety of soil conditions, while the Extreme Duty Auger is designed for longer wear in soil that is mixed with rock and boulders.
“Featuring an extended overall length and a flighting pitch that enhances material flow, the Foundation High Production Auger allows you to remove more soil out of the hole at a time. It is commonly used for drilling construction footings,” said Dale Putman, product support manager. Terex Utilities announced the addition of a new compact construction equipment product line featuring hydraulic auger drives, augers and accessories.
The Foundation High Production Auger has standard 1 in. flighting and optional extra heavy duty 1-1/2 in. flight with tooth angles that are located to improve penetration. It comes with a square drive pilot bit for up to 12 in. diameter.
“Everything about the Extreme Duty Auger is tougher and stronger. It has larger teeth and a new cutting pattern to reduce auger drag, more flighting, and a heavy-duty hex and stem design,” said Putman. When working in rocky soil, these features reduce wear and prevent flighting from becoming bent. The hex hub is available in 2-1/2, 2-5/8 or 3 in. sizes. The 1 in. flighting is solid welded to the stem, extending the full length of the stem to reduce bending. In addition, welded bars on the outside of the flighting reduces outside wear. Expanded Options for Contractors In addition, the company announced the addition of a new compact construction equipment product line featuring hydraulic auger drives, augers, and accessories. These new auger tools are ideal for use with skid steers and other compact construction equipment.
“With Terex Utilities’ expertise in auger tooling, expanding our product line to include compact auger drive and tooling provides a more comprehensive, one-stop source for utilities, contractors and municipalities, as well as general rental customers,” said Anderson. The product line includes dirt or rock augers with 4-1/2 in. up to 36 in. diameter. All tools come standard with replaceable teeth and a 2 in. hex coupling. Round coupling in 2 in. or 2.5 in. is optional, making these auger tools compatible with many types of compact equipment. Seppi M Introduces New Version of Starsoil With Powershift
Combined tillers have long been highly appreciated in the forestry sector. One model in this field is the Starsoil by Seppi M. Due to its design, several different operations are possible using the one machine, specifically, stone crushing, wood mulching and soil tilling up to a depth of 40 cm. This translates into a broad range of applications in many sectors of the forestry and agricultural industry, and also in the construction of dirt roads and forest trails, according to the manufacturer. The model has been redesigned to better satisfy user needs. The entire transmission has been reinforced and is now designed for tractors up to 310 hp. Also, new technology comes into play, the 2SPEED-POWERSHIFT transmission. This allows the operator to switch from one rotor speed to another with the machine running. In slow gear, at approximately 500 rpm, the machine is suitable for all soil works and stone crushing, according to the manufacturer. In fast gear, at about 1500 rpm, it is suitable for surface mulching. Switching occurs through the tractor ISOBUS terminal. Even the temperatures are monitored by the control unit in order to promptly intervene in case of a malfunction in the cooling circuits. The counter is now
incorporated in the standard supply, is used to monitor the operating costs. The external dimensions are an external width of 2.8 m with a working width of 2.5 m. A smaller version also is available with external width of 2.55 m and a working width 2.25 m, which also is approved for

MIS also is equipped with a complete fleet of heavy haul trucks and trailers. For a company as diverse as MIS Inc., Jas and Manik Thiara knew they needed captains in each division for each one to succeed to maximum potential. They recognized the need for strategic input from all divisions and adapted to newer marketing points. Manik is poised to continue the brand growth, adding lines, inventory and additional customer service to MIS. When Thiara passed the reins on to Manik, he urged him to lead the team. “Everyone knows you as a basketball star, use what the game taught you,” Thiara told his son. “As a point guard, he led the team and called out plays, and if someone messes up, you own it and make things right for the customer.” Manik is passionate about building relationships with customers and always treats each one the same whether they are buying one machine or five machines. His most memorable sale was when a customer came in and bought an 8500 excavator for his personal use. Volvo Trucks Announces Next Generation VNR Electric Volvo Trucks North America continues to lead in the deployment of sustainable Class 8 zero-tailpipe emission vehicles for the North American trucking industry with ongoing deliveries of its Volvo VNR Electric model to fleets across the country. The journey continues as the company announces that production of the enhanced Volvo VNR Electric model will begin in Q2 2022 and features an up to 85 percent increased range, faster charging and even more configurations for heavy-duty transport. Volvo Trucks first began taking customer orders for its first Volvo VNR Electric model in December 2020, with commercial production starting in quarter two 2021 at the company’s New River Valley manufacturing plant in Dublin, Va. Over the past year, Volvo Trucks has delivered the Volvo VNR Electric to customers in several states across the United States, collecting valuable operating data to continually improve the technology to increase the efficiency of the truck under varying operating conditions. Global Asphalt Solutions Improves Operations With XL Prior to purchasing its first XL trailer, Global Asphalt Solutions faced struggles in transporting all necessary equipment to job sites in one trip. Based out of Traverse City, Mich., and serving the entire state, Global’s day-today operations needed a new solution to help improve productivity. Looking at options, Pace Inc., its dealership in Plymouth, Mich., introduced the asphalt company to XL Specialized Trailers in 2020. Global Asphalt Solutions decided on the XL 110 Low-Profile HDG with fullwidth neck and hydraulic ramps. The full-width neck of the trailer allows for their team to transport additional attachments for machinery to the job site. Additionally, the hydraulic ramp allows for additional space on the back deck of the trailer. Now, instead of only being able to take a dozer or a mill to the job site, owner Bill Korreck and his team can take its larger equipment along with skid steer loaders and attachments. This allows the contractor to increase the time spent at the job site and overall productivity. Global Asphalt Solutions decided on the XL 110 LowProfile HDG with full-width neck and hydraulic ramps.
Korreck expressed the benefit of the trailers they introduced to their business. “We wanted the neck to be able to transport any of our additional attachments,” he explained, saying the ramps and the extra space on the neck “allows you to haul more than just a standard lowboy.” Since 2010, Global Asphalt Solutions has put the highest quality equipment at the forefront of its business model. Felling Enhances Fender Design for EZ-Tilt Trailers Felling Trailers has released an enhanced fender design for its ground-level loading, EZ-Tilt trailers. The new EZ-Tilt fender design offers a similar profile to Felling’s drop deck equipment trailer fenders, opening from the top to allow clearance for the wheels when the trailers in lowered to the loading position. The mechanism for lifting the top of the fender is the wheels/tires themselves. As the axles (rotating torsion axles) rotate, lowering the tilt bed to the ground, the wheels/tires push up against the top of the fender, lifting it and providing the needed clearance. The main body of the fender is constructed out of a heavy gauge material to maintain the structural integrity throughout the trailer’s life. Key Design Features: • Sleek Profile — The fenders’ lid/top is
attached to the fender body using a series of hinges, concealed and protected inside the fender, maintaining a sleek profile. • Dual Spring Action — Each fender is equipped with two
springs (one front and one rear) which hold the lid/top closed while the trailer is in the transport position and during transit. Additionally, these springs aid in closing the fender when returning the trailer to the transport position. • Rubber Bumpers — The lid/top of the fender rests on shock-absorbing rubber bumpers that cushion the lid/top and reduce vibration during transit. Kiewit Constructing Second of Seven Packages On Project By Irwin Rapoport CEG CORRESPONDENT
Started in October 2020, the $61 million I-80/I-680/SR 12 Interchange Project: Package 2A will be delivered in December 2022 as crews from Kiewit Infrastructure West Co. are making considerable progress on the project that will reduce congestion and improve safety at a critical interchange in Solano, Calif. Overseen by the California Department of Transportation (Caltrans), the Interstate 80, Interstate 680 and State Route 12 Interchange Project: 2A will improve and widen the eastbound SR 12 (EB SR 12) to EB I-80 connector on the I-80 corridor, as well as improve the connectivity between regionally significant destinations. “The I-80/I-680/SR 12 Interchange is a multi-year, multi-phase project located in Solano County,” said Pedro Quintana, a Caltrans public information officer of District 4. “This project includes Package 1 through Package 7, each to be constructed under separate contracts subject to funding availability. “Package 2A is the second of seven packages improving the distribution of three major freeway movements at this interchange by reconfiguring the ramps and access to local streets,” said Quintana, who noted that the majority of the funding is provided by Senate Bill 1 (SB1) Trade Corridor Enhancement Program (TCEP) funds, as well as money from State Transportation Improvement Program-Regional Improvement Program (STIP-RIP) and local Bay Area Toll Authority (BATA) Bridge Toll Funds. Construction Progress Kiewit crews have completed the Highway 12 widening to two lanes; built the new two-lane bridge on Highway 12 that crosses over I-80 and demolished the old one-lane bridge after the traffic switch; constructed a smaller bridge structure that will ultimately provide access from Highway 12 to eastbound I-80 and built numerous ramps and interchange ramps. “What remains to do is continue to build ramps off I-80 to Green Valley and I-80 South that will eliminate the weaving zone at these interchanges and improve public safety and also tie-in both lanes on Highway 12 that will eliminate congestion on it and make it a two-lane highway all the way into I-80,” said Zach Reilly, Kiewit’s project manager. “Highway 12 is currently one-lane eastbound. A big part of the project is to make it two lanes and part of the job is to provide additional ramps and separate traffic movement at I-80, I-680 and Highway 12 that all come together. This job will allow them to

separate the traffic movement and improve safety by eliminating weaving in that zone.” The project has many challenges, but many of them were dealt with prior to the start of construction via Construction Manager/General Contractor delivery method. “We were brought on board during the design phase to work collaboratively with the design team from Caltrans and the STA,” said Reilly. “This helped with utility conflicts, access to the work zone and staging and phasing of the work to minimize the impacts to the traveling public. We worked together to come up with six separate stages and phases to not only reduce traffic impacts, but build the new infrastructure efficiently and safely, separated from traffic as the work takes place at the intersection of three major highways. It was a team effort that allowed us to come up with a good plan.” While the crew have plenty of space in some areas, it can be tight in others, especially where the work is adjacent to a railway line and in between a railroad bridge and one for motorists. Operations are primarily via day shifts. “Although, we do work at night on critical operations such as bridge demolition and installing falsework,” said Reily, who noted that this work often involves partial lane closures. Much of the night work is focused on Highway 12 and I-80. “It is one big spread out site with most of the major work focused on drainage, utilities, structured sections of roadway, building bridges and putting in overhead sign structures,” said Reilly. ‘It’s a lot of different scopes as it is a phase-to-phase project and you need to complete the work in an area or region as much as possible while you have access to it before moving onto the next one. This has been a fun job to be part of because the owners have been some of the best part-
ners I have worked with — they are true partners and we have great relationships with Caltrans and the STA. The project is on schedule and we’ll come in under budget. “We had our challenges with the pile driving,” he added. “It didn’t go as planned initially, but the team came together and came up with great solutions, being able to mitigate the impact and move the job ahead and stay on schedule. It’s a big project and you’re going to find unknown or unique aspects that are unforeseen.” The bulk of the work is based on building new structures, including the two big concrete, cast-in-place box girder bridges, one of which was built over active traffic on I-80 that had a falsework system below it. “The bridge construction proceeded very well and we did a good job of managing it,” said Reilly. “We also have large MSE wall structures to protect the railroad infrastructure. They were up to 40 feet tall and 700 feet long and we were allowed to bank a bunch of materials adjacent to the railroad.” The demolition operations had their challenges. Origianlly, two eight-hour weekend closures were planned via the contract. “We worked collaboratively with Caltrans and the design group and proposed to do it on one weekend with a 10-hour closure,” said Reilly. “Caltrans secured us two more hours on a Saturday night/Sunday morning and we demolished the entire 500-foot long box girder bridge over I-80 and dropped the whole thing down. We placed two feet of fill on the freeway and knocked it down. We then removed it all and opened a lane by Sunday morning. It was a great success.” The goal is to build freeways with a long lifespan. “To accomplish this, the lanes have a lime treated subbase, a concrete base of 18 inches, typical AB sections and three types of asphalt — AC, gap rated and open graded,”
said Reilly. “We are building very solid sections of roadway. We are expanding Highway 12 and have a bunch of new roadways of the alignment of I-80 to provide ramps and eliminate braided weaving.” The demolition had crews dealing with reinforced concrete and rebar, which was taken to local recycling centers for processing. “The material was stockpiled on-site so that it could processed down to its components and transported by haul trucks,” said Reilly. Reilly is assisted by Brandon Risso, a project manager of Kiewit. “Brandon has done a great job of managing the project in the field,” said Reilly. “Fernando Dos Santos, Caltrans resident engineer and field manager, has been an excellent partner and really allows the project to stay on track and schedule. We are lucky in that we have good crafts people here — that’s where the rubber meets the road. They have done a great job of building a quality product and knowing the project’s requirement and executing a plan that was good, but improving it. Their knowledge is invaluable and in this day and age, it is really becoming more difficult to find skilled crafts and labor that really understands it.” Kiewit stated that it has on-site mechanics and is in close proximity to its yard. “Obviously we have a lot of wear and tear on the equipment when you are digging and building and running gear,” Reilly said. “We have quick repairs from out mechanics, who are only two miles away.” Project Information The southwest project limits are near Fairfield’s Green Valley and Cordelia neighborhoods, while the northeast project limits are near Suisun City. I-80/I-680/SR 12 Interchange: Package 1 was completed in 2017 with a new Green Valley Road Interchange and westbound (WB) SR 12 Connector from WB I-80 to WB SR 12. “This section of the I-80/I-680/SR 12 Interchange project is replacing the existing single-lane EB SR 12 to EB I-80 connector with a new two-lane connector bridge structure that will be constructed and designed to accommodate future project phases,” said Quintana. “The project also is constructing a new slip ramp from EB SR 12 directly to Green Valley Road (GVR) and a new braided off-ramp from EB-I-80 to GVR and southbound I-680. Motorists and the local community wil benefit by improving travel times, reducing cut-through traffic on local streets, and enhanced safety by streamlining connections for motorists transitioning between these three major state routes linking the Bay Area, the Napa Valley, and Sacramento.” CEG

panies in the state. The following week the customer called and commended the service that was provided by Manik and brought in his boss. MIS hosted them in their conference room with a catered lunch, where the forestry group ended up purchasing $1.2 million in machinery. Manik’s first building project when he came back from Spain was the conference room. The conference room is located on the second floor, with windows overlooking the machine assembly area. Customers that are purchasing equipment are taken upstairs to the conference room. As the customer walks up the stairs there are more than 25 TVs, where the machine the customers are purchasing is displayed on each screen — at each step —until they reach upstairs. From there, MIS will host a catered luncheon for those customers and the customers can see the assembly process of their equipment. This has been received well and customers love this personal touch.
The company continues to evolve. It currently employs 60 people, but during harvest season, it increases that number due to needing more hands on deck. Manik has been working with local trade schools and is in talks with them for a simulator training program in 2022. MIS acquired a simulator from SANY and is very effective in training up and coming trade students. Award Recognition MIS has received many awards in its short time in this segment. It is one of SANY’s top service dealer in the nation. Manik also serves on the dealer council at SANY, a huge honor to be voted on the board by his peers. He is honored to have earned that respect from his peers as the youngest person on the council, a position he does not take lightly. According to Thiara, “I’ve learned so much from the other members on the dealer council, I try to just soak it all in and bring that back to MIS.” He has been an advisor to the manufacturer on how to market in the United States.
