Dog Parks to Close for Maintenance

The City of Concord’s two dog parks are scheduled to be closed for annual turf renovation and maintenance.

Newhall Dog Park will be closed from February 6 to March 13, 2023. Baldwin Dog Park will be closed from March 14 to April 17, 2023. The renovations will consist of the aeration, reseeding, and fertilizing of the park’s natural turf. The City’s consistent turf maintenance and renovations help maintain the quality of the parks for Concord residents and their canine companions.

Signs will be posted at the two facilities to inform and remind the community of the closures. Concord also has its “Rain Information” hotline at 925-671-3479 that will be updated with any future changes.

Be Safe this Holiday Season

With the season of gift-giving right around the corner, more shoppers will be visiting stores in the hopes of finding special presents for their loved ones. These busier times of year can be hectic, so please take note of these tips to ensure safe holiday shopping:

1. Be aware of your surroundings. It’s important to be alert and know what’s going on around you.

2. Keep your personal belongings with you. Leaving a purse or wallet in a shopping cart or unattended can make it more vulnerable to theft.

3. Avoid carrying cash. Cash can make you a more visible target, whereas a credit card is more compact and harder to steal. Most cards also have a form of fraud protection.

4. Put purchases in your trunk or where they won’t be visible. Storing purchases out of sight, whether in the car trunk or covered, will help prevent theft. It is good to park in well-lit areas and keep doors locked for your safety as well.

The City of Concord is preparing an update of its Local Hazard Mitigation Plan. The goal of this plan is to identify projects that can reduce damages from future hazards. Homeless Strategic Plan to Launch in Early 2023

One of the many things the City is doing to reduce homelessness in Concord is developing a Homeless Strategic Plan—this is a top priority project for the Concord City Council. The strategic plan is intended to guide future City efforts and investments to effec tively respond to the impacts from and the needs of Concord’s unsheltered population, using data and fact-based information.

On Dec. 13, the City Council will consider forming a working group to assist with the creation and oversight of the strategic plan. Additionally, the City is in the process of bringing a consulting team with experience developing homeless strategic plans on board by the end of January.

Once the working group is established and the con sulting team is on-boarded, work on the plan will begin. The plan will be developed under Council’s direction, through a public process, and will incorporate:

• Strong community engagement including residents, businesses, individuals with lived experience, service providers, faith-based groups, and other system partners

• A Council-appointed working group to assist staff and the consulting team in the development of a draft plan

• A comprehensive background report that maps the current system and community services; identifies unmet needs and system gaps; and assesses federal/state/regional data, roles, funding and strategies

• The development of a vision, goals, and objectives with measurable performance targets

• The development of an implementation plan for the defined objectives, including recommendations for investment of the money Council has set aside to respond to the impacts from and needs of Concord’s unsheltered population

To date, the City Council has set aside $5.4 million to be put toward activities established in the Homeless Strategic Plan. This is in addition to the $556,000 that the City has dedicated to funding various service organizations in FY 2022-23.

To help keep the community updated about the various programs, services and resources available to unhoused residents, the City maintains a Homeless Services web page, cityofconcord.org/homelessser vices. The page features monthly data related to Concord’s Coordinated Outreach, Referral, and Engagement (CORE) team; for example, CORE aided 1,173 individuals over the last 7 months, which has led to 65 stable exits out of homelessness.

Also located on this web page is a newly updated fact sheet that features a funding list showing partner organizations that receive City funding to provide critical services.

Legal Limitations of Addressing Encampments on Public Property

Residents often ask why public property can’t be kept clear of encampments at all times. In a 2018 federal court ruling known as Martin v. City of Boise, the court found that a City may not impose “criminal penalties for sitting, sleeping, or lying outside on public property for homeless individuals who cannot obtain shelter.”

The bottom line is that the City cannot forcibly remove encampments because alternative shelter is not always available. The City does take action when public health and safety issues make it permissible. The limited availability of shelter will be addressed in Concord’s homeless strategic plan.

Council to Consider Term Sheet for Base Reuse Project

The next step in the planning for development of the former Concord Naval Weapons Station is the City Council’s consideration of Concord First Partners’ proposed Term Sheet.

The Term Sheet establishes the development guide lines and community benefits to be included in the future Specific Plan; studied in the Environmental Impact Report; and memorialized in a Disposition & Development Agreement – documents that must be finalized before development begins or land transfers.

The City Council will hold a special meeting on Saturday, Jan. 7, 2023 at 9 a.m. at the Concord Senior

Center (2727 Parkside Circle) to consider the term sheet. This meeting will be held in-person and may be viewed on Concord TV (Comcast 28, Astound 1026, and U-verse 99) and through the City’s website. Prior to this meeting, City staff and developer Concord First Partners will hold community meetings to describe the current progress on the plans and answer questions. These meetings will be held in person on Thursday, Dec. 1 and Thursday, Dec. 15 at 6 p.m. at the Concord Senior Center. For more information, please visit www.concordreuseproject.org

Federal Recovery Funds to be Invested Locally

In an effort to assist individuals, businesses, nonprofits, and state and local governments in dealing with the public health and economic impacts from the COVID-19 pandemic, Congress passed the American Rescue Plan Act of 2021 (ARPA), which provided $1 trillion in one-time recovery funds.

The City of Concord received $27 million in federal ARPA dollars; $8 million was spent on pandemic recovery efforts. In September, the City Council determined how to allocate the remaining $19 million:

• $7 million: City Projects, Infrastructure, Public Safety and Special Events

• $7 million: Support for Nonprofit Organizations

• $3 million: Support for the Unhoused

• $2 million: Support for Small Businesses

At press time, Council was scheduled to make allocations to nonprofit organizations on Dec. 13, 2022, following a grant application process. More than 70 agencies with a combined $34 million in funding requests applied for the $7 million of available funds. Each grant is expected to be awarded in amounts between $50,000 and $2 million.

The funding for small businesses will be distributed in two rounds – one in fall 2022 and one in spring 2023. The $5,000 grants will be offered to businesses with 25 or fewer employees and can be used to reimburse select operating costs such as rent, utilities, and payroll. The $3 million in funding for the unhoused will be added to the $2.4 million that Council previously allocated in spring 2022, for a total of $5.4 million, and will be used for funding projects and priorities following the completion of the City's strategic plan on addressing homelessness, which will commence in early 2023. The funding for City projects, infrastructure, public safety and special events will be more specifically allocated following a Jan. 10, 2023 report to Council with staff recommendations on funding priorities.

City Improvement Construction Projects Abound

Concord residents may have noticed the uptick in improvement projects throughout the City. Thanks to Concord voters approving Measure V, the City of Concord secured much-needed funding to improve roadways and infrastructure, invest in addressing homelessness and public safety, all while continuing to provide essential services to the community.

Measure V, which generates about $30 million annually, is a one-cent use and transaction tax intended to maintain a reliable source of local funding that cannot be taken by the State.

Concord leveraged the funding and borrowed $114 million at a very low interest rate of 1.88% to make an immediate investment in roads—this money must be spent over five years from 2021 to 2026.

As a result, in June 2022, Concord passed the largest two-year Capital Improvement Program budget and Five-Year Capital Improvement Plan in the City’s history. You can review both documents on the City’s website at cityofconcord.org/CIP.

Major projects that are now under construction include:

Grant and East Street Pavement Rehabilitation: Pavement rehabilitation of Grant Street, from Solano Way to High School Avenue, and East Street, from High School Avenue to Salvio Street, including installation of bike lanes, fiber optic installation to improve traffic signal connectivity, and new roadway striping and signage.

Monument Blvd. Class 1 Pathway: Construction of a bicycle and pedestrian path that is separated from vehicles, connecting the Downtown Concord BART Station to the Monument Corridor; the path is parallel to, Monument Blvd and Cowell Road, and the project includes signalized intersection improvements for safety.

Hillcrest Park Green Infrastructure: Installation of large underground trash capture devices and detention chambers for storm water runoff from 1,014 nearby acres, repaving of the park's east and west parking lots, electrical lighting upgrades to improve parking lot visibility, and replacement of aging irrigation mains.

Willow Pass Road Signal Upgrades: Installation of fiber optic conduit connecting 13 signalized intersections along Willow Pass Road, from Galindo Street to Landana Drive, and Galindo Street, from Willow Pass Road to the Police Department, in order to improve traffic signal management, public safety and traffic flow.

Port Chicago/Bates Avenue Pothole Base Repair: Pothole and base repair to Port Chicago Highway from Panoramic Ave to Bates Ave, and Bates Ave from Port Chicago Highway to the end, as well as installation of vehicle detection cameras for better signal operation, and new roadway striping and signage.

New State Law Aims to Reduce Plastic Waste

In an effort to reduce single-use plastics that pollute our environment, the state passed a law that requires retail food operators to only offer disposable food ware accessories, such as utensils and condiments, upon customer request.

In compliance with this state law, the Concord City Council recently passed a local ordinance that would enforce this law to help reduce plastic and garbage in our local streets, waterways and landfill. This new practice will also help businesses save money by giving out less free inventory.

Restaurants may still use dispensers of unwrapped single-use foodware accessories that are self-serve, standard condiments that are self-serve, and bulk dispensed condiments.

Organic Waste Law to Roll Out to Residents in

2023

As we first reported in the fall 2021 issue, the City of Concord and Mt. Diablo Resource Recovery (MDRR) are working together to help businesses and resi dents comply with state law SB1383, the Short-Lived Climate Pollutants Reduction Act, which is part of a statewide effort to reduce emissions of greenhouse gasses. Organic waste produces greenhouse gas emissions when it decomposes at the landfill.

This bill requires the diversion of this organic waste from the landfill to a com posting facility.

All businesses that generate organic waste are required to sign up for organics service (including food waste, food-soiled paper, and landscaping waste), and some businesses are required to donate edible food for distribution to people in need.

Residents will soon also be required to sort out food scraps and place them in their green containers.

The City and MDRR anticipate the organic waste diversion program to be fully implemented by January 2024.

Are You Prepared For a Flood in Your Neighborhood?

The City of Concord lies within the Walnut Creek and Mt. Diablo Creek drainage basins, both of which discharge north into Suisun Bay. Concord includes a number of creeks and drains (Walnut Creek, Galindo Creek, Pine Creek, Ditch No. 2, Farm Bureau Drain, Clayton Valley Drain, and Mt. Diablo Creek) that are susceptible to flooding events that could possibly pose threats to life and safety and cause significant property damage.

What should you do before a flood?

Determine if your property is located in an area subject to flooding. Certain areas have been desig nated by the Federal Emergency Management Agency (FEMA) as Special Flood Hazard Areas (SFHAs). There are currently approximately 1,500 homes that are partially or entirely located within these flood zones within the City. SFHAs are areas within the 100-year flood boundary as mapped by FEMA. A “100-year flood” refers to a flood level with a one percent chance of being equaled or exceeded in any given year. Upon request, the Engineering Division at 925-671-3425, will make free flood zone determina tions for properties within the City. FEMA maps are also available in Concord Public Library located at 2900 Salvio Street, 925-646-5455 or on the FEMA Map Service Center at msc.fema.gov/portal/home. The Engineering Division also maintains elevation certifi cates for many properties within the City which are also available for review at cityofconcord.org/ floodforms

Purchase flood insurance on your property. Flooding is not covered by a standard homeowner’s insurance policy. A separate flood insurance policy is required to cover damages incurred by flooding. Coverage is available for a building and its contents. Renters can also purchase flood insurance to cover their posses sions. The City of Concord participates in the National Flood Insurance Program (NFIP) that makes available federally backed flood insurance for all structures, whether or not they are located within the 100-year floodplain. The City also participates in the Community Rating System (CRS) program enabling property owners within the floodplain to get a discount on their flood insurance premiums.

Maintain drainage channels and pipes free of obstruction and debris. The City of Concord cleans and maintains drainage channels and pipes in City easements and rights-of-way, regularly. Residents are encouraged to assist in maintaining the drainage in their areas by removing or reporting obstructions (such as shopping carts, leaves, debris, trash, etc.). All storm drains lead directly to our creeks and eventually the bay. By way of City Ordinance, it is illegal to dump trash, leaves, landscape debris, paint, grease, or any other material into any portion of the City’s drainage system. Such dumping can have devastating impacts on water quality in addition to causing flooding. To re port illegal dumping in channels call 1-800-NO-DUMP ING (1-800-663-8674). Protect your property from the hazards of flooding. If the floor level of your property is lower than the “Base Flood Elevation” (elevation of the 100-year flood, based on the FEMA maps), consider elevating your structure, if possible. If a flood is imminent, property can be protected by sandbagging areas subject to the entry of water into living spaces. The City’s Public Works Department provides free sandbags which may be picked up at the Corporation Yard locat ed at 1455 Gasoline Alley. Valuables and furniture may also be moved to higher areas of the dwelling to mini mize damages. If requested, City staff will visit a prop erty to review its flood problem(s) and explain ways to reduce flooding potential or help to prevent flood damage. Flood protection references are also available at the Concord Public Library.

Meet improvement requirements. The NFIP and the City of Concord Ordinance requires that if the cost of reconstruction, additions, or other improvements to a building equals or exceeds 50% of the building’s market value, including repair of a damaged building, then the building must meet the same construction requirements as a new building and must be elevated above the base flood elevation. Please contact the Engineering Division at 925-671-3425 for more information.

All development within the City requires a permit. Always check and fulfill permitting requirements with the Building Division at 925-671-3107 and/or the Engi neering Division at 925-671-3425 before you build on, alter, fill, or re-grade any portion of your property and/ or within any easement or right-of-way. Please call to report any suspected permitting violations.

Keep an emergency supply. Non-perishable food, water, batteries, flashlights, a manual can opener, and a battery-operated radio and first aid kit should be kept available for use during an emergency in a place known to all family members. Place in the emergency kit the name, location, and contact information for an emergency point of contact. Update the emergency kit on an annual basis.

What should you do during a flood?

• In case of a major emergency, the City will notify the public of a contact number on the City website and via the media. Tune your radio to KCBS at 740 AM and your television to the local Comcast channel 28 and Wave channel 29.

• If your property is in imminent danger of flooding, please contact PG&E at 800-743-5000 to request that your power and natural gas be shut off, or for guidance on how to do it yourself.

• If dangerous flooding conditions are imminent, avoid driving a vehicle if possible. Do not attempt to drive or wade through deep pockets of water or running washes. Unstable banks should be avoided. Develop an evacuation plan for your family. Avoid low-lying areas. Seek shelter in the highest areas possible.

What should you do after a flood?

• Listen to the radio for emergency instructions.

• Avoid driving if possible.

Follow established procedures for property damage repairs:

Select a contractor who is licensed in his or her specific trade, such as an electrician, plumber, gas contractor, mechanical/HVAC contractor and building contractor for associated work. The City requires contractors to be licensed with the state and to have a City of Concord Business License, as well as liability and workman's compensation insurance.

Require your contractors to obtain the proper permits for work being performed. Permits are required for any permanent improvement (including roofing, siding, ad ditions, alterations, etc.) to a structure and for site work such as grading, filling, etc. Permits are required even if a homeowner is doing the work himself.

Recognize the natural and beneficial functions of floodplains to help reduce flooding: Floodplains are a natural component of Concord’s environment. Understanding and protecting the natural functions of floodplains helps reduce flood damage and protect resources. When flooding spreads out across the flood plain, its energy is dissipated, which results in lower flood flows downstream, and improved groundwater recharge.

Floodplains are scenic, valued wildlife habitat. Poorly planned development in floodplains can lead to streambank erosion, loss of valuable property, increased risk of flooding to downstream properties and degradation of water quality.

Your child will spend the day with highly trained and experienced teachers, doing arts & crafts, playing games, and developing fine and gross motor skills. The City of Concord Preschool program was established in 1991 and has served over 6,500 families since its establishment. Some of our teachers have been with the program for over 25 years!

Youth Classes

Youth Pickleball

Ages: 7-13 years

The game with the funny name is the fastest growing sport in the US and a great way to introduce your child to fun, athletic competition. Pickleball is the ideal first sport for kids. The game is easier to play than tennis because the racquet is shorter, the court smaller, and the ball slower. While combining elements of tennis, ping pong, and badminton, people of all ages quickly develop an appreciation for the game of pickleball. Compared to other racquet sports, pickleball allows players to have greater contact with the ball, longer rallies, and the gratification of quickly excelling at a new sport. This class emphasizes good sportsmanship and proper pickleball etiquette in a fun and lightly competitive environment. Paddles and balls will be provided. Players should bring water and sun protection.

TRIPS &TOURS 2023

Day Trips & Tours

We define trips and tours that don’t require overnight stays as day trips. Day trips may include admissions to various attractions, museums, shows, and more! Pay ment must be made in full at the time of registration.

Extended Travel

Any trip or tour that requires an overnight stay is considered extended travel. Trip booklets for extended travel programs, with registration details and daily itineraries, may be picked up at the Concord Senior Center.

How To Participate

Read the description of the travel program. Determine if the mobility rating is appropriate for your physical fitness level and health. Register for a program online, in-person or over-the-phone with our registration staff at any of the Community Centers.

Transportation

Roundtrip transportation from the Concord Senior Center will be provided on a commercial motor coach. The motor coach bus will feature a restroom on board.

Travel Safely

To maintain a safe travel environment, the City will follow the latest health guidelines and protocols set by the local and state public health departments. Contact the Program Coordinator for further clarification.

Parking

Please plan to park in the east parking lot (2nd parking lot) at the Concord Senior Center for pick-up and dropoff during scheduled day trips.

Sold Out & Waitlist

If a trip is sold out, a wait list will be formed. If additional seats become available, registration staff will contact persons on the wait list with more information on a firstcome, first-served basis.

Trip Minimums

A travel program may need to be cancelled if minimums are not met up to 30 days in advance of the departure date. Help us avoid cancellations by spreading the word about upcoming trips and registering early.

Cancellations & Refunds

As a result of the passenger minimums, refunds will not be permitted within 30 days of a day trip. Refunds must be requested at least 30 days before a trip departure date. Refunds and withdrawals will be subject to a $5 cancellation fee. Trips are rain or shine.

Walking Levels

Level 1: Easy

At a leisurely pace, this trip involves minimal physical activity, such as boarding a motor coach, light walking (only up to a few city blocks), and short periods of standing. This level would likely be wheelchair, cane, and walker accessible.

Level 2: Moderate

This trip will involve extended periods of standing and walking along stairs, inclines, and uneven surfaces. This trip would likely not be accessible for wheelchairs, canes, or walkers.

Level 3: Strenuous

This trip will require substantial periods of walking and standing, sometimes on uneven terrain or stairs. This trip would not be accessible for wheelchairs, canes, or walkers.

Important information when visiting the pool…

• All swimmers are required to self-check prior to arriving for their swim. If you do not feel well, exhibit flu like symptoms, fever of 100.4 degrees or higher, cough, shortness of breath, difficulty breathing, loss of taste or smell please don’t come to the pool until symptoms have completely subsided.

• During Lap Swim times lanes maybe utilized to accommodate city programming.

• Please choose a lane that meets your needs and your swim pace.

• Always announce your presence when entering a lane that is currently occupied.

• If you are sharing a lane with another swimmer you are required to circle swim. Please swim down the right side of the lane and back up to the right side of the lane.

• NO DIVING – Please enter the pools feet first.

• Lifeguards are on duty to recognize and respond to an emergency and provide care. They are not on deck to police lanes.

• Be kind and courteous to others.

• Please continue to bring your own personal lap swim equipment.

Splash into the New Year with an icy plunge at the Meadow Homes Spray Park. Brave participants have the opportunity to participate in the New Year’s tradition of the Polar Plunge when they make a pass through the chilly waters of the Meadow Homes Spray Park. Egg-straordinary Underwater Egg Hunt

Ready, Set, Swim! Come join our City of Concord’s aquatic staff for a fun filled springtime event for the whole family. Splash around and hunt for eggs in our shallow water short course lanes. The shallow lanes will be divided into sections for the egg hunt based on swimming ability and age group. Once you have gathered all your eggs, enjoy arts and crafts and games on the grass.

American Red Cross Lifeguard Clinic

The American Red Cross Lifeguarding course teaches lifeguards the skills and knowledge needed to prevent and respond to aquatic emergencies. It provides an opportunity to complete all required certifications in one course. This course is blended learning class and has an online portion that must be completed before the first day of classes. Must be 15 by the last day of the course. Must be able to tread water 2 minutes (legs only), swim 200 yards continu ously, and retrieve a 10lb brick from a depth of 10 feet.

Refunds due to course cancellations can take up to 2 to 4 weeks to process. A credit left on a customer’s account will expire 12 months after the date of issuance.

Withdrawals and Transfers

If you wish to drop or transfer to another session, call us at least five full working days before the start date for a refund or credit. $5.00 Withdrawal Fee applies to all cancellations. Please note: Programs with different cancellation fees are noted and only the higher fee applies, not both. No refunds for non-attendance, one-day workshops, trips or materials fees.

WAIVER AND RELEASE FROM LIABILITY / ASSUMPTION OF RISK

I, the undersigned, wish to participate in one or more activities (hereinafter collectively referred to as “the Activity”) conducted in collaboration with the City of Concord’s Parks & Recreation Department. I am aware that serious accidents and injuries occasionally occur during recreational pursuits such as the Activity. In consideration of my participation in the Activity, I knowingly and voluntarily assume all risks arising therefrom, and on behalf of myself, my heirs and assignees release the City of Concord, its officers, agents, employees and volunteers from any and all claims, liens, damages, lawsuits, or liability for property damage, injury or death, resulting from, arising out of, or in any way connected with my participation in the Activity.

I agree and acknowledge that this Waiver and Release From Liability/Assumption of Risk shall apply even in the event that I suffer death, personal injury, or property damage as the result of passive or active negligence on the part of the City of Concord, its officers, agents, employees, or volunteers of the City (with the exception of sole, active negligence, or willful misconduct). In the event that the individual participating in the Activity is a minor, I certify that I am his/her parent or legal guardian and I give my permission for him/her to participate in the Activity. I understand my signature is a legal and binding signature and will be considered original if received by fax.

USE OF PARTICIPANT PHOTOGRAPHS/VIDEO

In addition to the forgoing, I give consent to Concord Parks & Recreation Department or any other media agency authorized by the City of Concord to photograph or video me (or the minor on whose behalf I am signing this waiver), and to use such photographs/video footage in brochures, newspapers, social media, or other forms of media describing City of Concord activities. I agree to advise the City of Concord Parks & Recreation Department in writing if I do not agree to the forgoing.

COVID-19/CORONAVIRUS LIABILITY WAIVER AND RELEASE, AND INDEMNITY AGREEMENT

On behalf of myself and/or my son, daughter, or person for whom I serve as legal guardian (the “Participant”), I acknowledge with my signature that the Participant wishes to participate in a City of Concord Parks & Recreation Department activity or program (“activities or programs”).

I understand that by participating in City of Concord activities and programs there is an inherent risk of potential exposure to infectious diseases, including but not limited to COVID-19/Coronavirus. The risk of potential exposure cannot be eliminated. On behalf of myself, the Participant, my heirs and dependents, personal representatives, assigns and insurers, I now voluntarily and knowingly release and hold harmless the City of Concord, its officers, employees, volunteers, agents, successors in interest, insurers, contractors, suppliers, vendors, assigns, and any persons or entities with which/whom the City is affiliated (hereinafter collectively referred to as the “City”), from any and all liability, lawsuits, or claims for injuries, death, or property damage resulting from, arising out of, or in any way connected with Participant’s participation in the activities and programs (collectively “Claims”), including but not limited to Claims arising out of or in any way related to any emergency medical care administered, any illness or infection or disease, and COVID-19 or Coronavirus related health issue or exposure. This waiver and release shall apply even in the event that such personal injury, death, or property damage is caused or contributed to in whole or part through the passive or active negligence of the City (with the exception of sole, active negligence).

I agree to defend, hold harmless, and indemnify the City from and against any and all Claims (including attorney’s fees) arising out of, or in any way related to Participant’s participation in the activities and programs, any actual or alleged negligence of myself or Participant, any emergency medical care administered, any illness or infection or disease, and/or COVID-19 or Coronavirus related health issue or exposure.

I/WE HAVE READ THIS WAIVER AND RELEASE IN ITS ENTIRETY. I/WE FULLY UNDERSTAND IT, AND RECOGNIZE THAT THIS WAIVER AND RELEASE IS A LEGALLY BINDING DOCUMENT. I/WE UNDERSTAND THAT BY EXECUTING THIS WAIVER AND RELEASE, WE ARE VOLUNTARY ASSUMING THE RISKS DESCRIBED HEREIN, AND WAIVING OUR LEGAL RIGHTS ASSOCIATED THEREWITH.
