STAGE ONE: REMEDIATION NOTICE AND FIRE ASSESSMENT (EWS1 RATING)

- An update stating your building is required to be assessed for remediation.

- A document stating your building’s fire rating , determining if remediation work is required or not.

• What happens during this stage?

We will request your EWS1 Form from your building’s Responsible Entity to determine if remediation works are required. If they do not have this form, we will assign a fire assessor to your building to conduct a PAS9980‘fire risk’ assessment so they can determine your ‘EWS1 rating’. Once this is complete, they will provide us with a PAS9980which indicates if work is required to your building.

• What will the fire assessor do?

The fire assessor will review the building drawings, and the fire risk associated documents (e.g., escape plans) and conduct a physical survey of the building. This process can sometimes require them to inspect within your building’s walls and throughout the entire site.

• What is an EWS1?

An EWS1 form allows insurers, valuers and lenders to see that an external wall system (EWS) on a residential building or attachments, such as a balcony, has been assessed by a suitable expert. The form clarifies what, if any, remediation is needed to address fire safety risks. An EWS1 certificate can only be issued once a qualified fire safety assessor has examined the building and produced a report on the findings.

What do the ratings mean?

As part of the Building Safety Pledge, the ratings inform levels of fire risk. Any rating of B1 or better does not require remediation work.

• How long will this take?

This process can take approximately six months, depending on the complexity of inspection required.

STAGE TWO: AGREEMENT OF WORKS AND HEAD OF TERMS DOCUMENT

- Head of Terms document outlining the work required to remediate your building to the PAS9980 standard and estimated timeline.

STAGE THREE: PLANNING AND BUILDING CONTROL APPROVAL

- Designing and submitting a Government Gateway application to the Building Safety Regulator for buildings 18M or above in height

- Updates on Building Control (and progress of the Building Safety Regulator if your building is over 18M).

STAGE FOUR: REMEDIATION SCOPE CONTRACT AND SITE SCHEDULING

- Updates on progress of your building’s remediation scope contract.

- An update to confirm your building’s remediation scope contract has been signed by your RE.

• What does the document include?

An outline scope of works, a PAS9980/ Fire Risk Appraisal of External Walls, as evidence for the scope and a Head of Terms document which gains agreement to progress to the next stage. This document also includes an estimated start and finish dates for the remediation works.

• Who signs the document?

Your building’s Responsible Entity (RE) signs the document on your behalf.

• What happens if there isn’t an agreement on the work to be completed?

Telford Homes will work with your RE to come to an agreement on works required. It is within everyone’s best interest to make sure we reach an agreement. However, your RE has the right to refuse remediation and Telford Homes will be discharged from our responsibility within the Self Remediation Contract.

• What are Telford Homes doing?

We are putting together detailed designs including drawings, specifications and materials selection. This information will be used to start the first stage of the tender process.

• How long will this take?

This is assessed on a case by case basis and depends on the complexity of your building and the materials required.

• Will we be consulted during this process?

We will develop the best solution for your building which will be shared with your RE for agreement.

• Why does planning need to happen?

The need for planning approval is determined by your local planning authority. Not all buildings require this, it usually depends upon the extent of change to the appearance of your building.

• How long will planning take?

The planning process is determined by your local planning authority. The timeframe will be confirmed on the submission of the application.

• What is Building Control?

Building Control review and approve our proposals to ensure the work will comply with minimum building regulations. All buildings require Building Control approval. There are two ways this happens dependant on the height of your building;

• If your building is over 18 metres:

The Building Safety Act 2022 names HSE as the new Building Safety Regulator in England. Learn more about the HSE and their role as the Building Safety Regulator here.

• If your building is under 18 metres:

Telford Homes will appoint an approved Building Control inspector to undertake this service.

• How long will this take?

The building Safety Regulator process can take a minimum 12 weeks and up to 16 weeks as determined by the HSE.

• What is the remediation scope contract?

It is a contract that details the agreed works which will be delivered by Telford Homes to remediate your building. This is agreed between Telford Homes and the RE for your building.

• Has a contractor been appointed?

At this stage, our tender will be complete and in line with our submission to the BSR/ Building Control. We complete the tender at this stage to receive the most accurate forecast of costs and to determine a contractor to appoint to your building.

• Who decides this?

Telford Homes will appoint a contractor unless otherwise agreed with your RE.

• Why does this need to happen?

The remediation scope contract is the formal agreement that confirms the full detail and method of the remediation agreed between Telford and your RE. This will include a full programme of works, including a phased schedule and timeline.

• How long will this take?

This will depend on the length of time required to negotiate and produce the legal document between Telford and your RE. Most commercial terms should be agreed in principle by this stage; however, it is important that both parties move forward feeling confident in what has been formally agreed.

• When will my building site works begin?

We will aim to have contractors lined up ready to commence works following gateway approval. There may sometimes be some lead in time required for more specialist or in-demand trades and materials.
