Having asked her of her interests, she states: “My interest is in simplification. As a lawyer we have the art of complicating things – but what has gotten us consumer confidence is simplifying the complex. People / corporations come to us with varied types of problems – but what I like is that they come to us having lost all their resources to depend on us for a solution. It is not just legal but our clients come over to discuss structures on overall understanding and conducting business with the right rules of the game. Preserving a free press and insuring that social media and ‘fake news’ does not subvert fact, evidence, and democratic institutions - Defending a free press has long been a mission for lawyers. She states, “Social media has broadened that ongoing challenge. For many, social media is their ‘news’ source-- an ‘alternative press’ that lacks authenticity filters and can ‘go viral’ in minutes – diluting the core essence of the subject.” Social media is rapidly eclipsing traditional media, providing a global platform for ‘alternative facts,’ propaganda, and misinformation masquerading as ‘news’. She states that; “being a journalist herself, she makes sure that Mallyas is cognisant of the fact and does not allow the fact-agnostic court of public opinion to marginalize the judicial process”.

From the early stage of the incorporation of the firm, Shamita’s focus was not just on the application of the legal knowledge but augmenting the same with a perfectly curated process and project management framework, which stood out amongst the others. In an environment where the clients remained unaware of the future of the case, she was able to articulate the future of the case with her approach. This came as a huge respite to the clients, especially the corporate clients that the firm continues to consult.

Ensuring adherence to ethical standards - Law is big business - but is also a profession governed by ethical standards. More often they are exposed to old and new ethical challenges—client pressure to ‘push the envelope,’ economics, and the ‘ethics of technology’ to mention but a few. But the firm’s constant focus is to adhere to ethical standards to protect the rule of law and to ensure that the dual role of law as a profession and a business is preserved. It is imperative that lawyers utilize available tools to provide greater access, collaboration, and alignment of interest with clients; that is their ethical duty to individual clients and to society.

The other area that Shamita emphasised was on understanding technology’s applications and to optimally utilise the same on the delivery of legal services (e.g. e-discovery, cyber-security, contract management, legal research, etc.). She states “these terms were unheard of ten years ago, when she started the practise.” One of the most important aspects that has brought the firm to this position is that they concentrate a lot on emotional intelligence or ’people skills’ - which is widely overlooked as a critical legal skill. Shamita’s belief is that lawyers with high intellect (IQ) and people skills (EQ) will always thrive, no matter how pervasive technology becomes in legal delivery – and Mallyas & Co. is unmatched as far as this balance is considered.

Lastly it is their overall responsibility to streamline the judicial process, utilizing technology and process to make it more accessible, agile, faster, and cost-effective than the outdated court systems. Challenges Conquered Mallyas and Co. is a first generation legal firm and doesn’t have any legacy; like in any other dominant field, the life of young Indian lawyer is really tough, especially for those who don’t have a godfather. The field of law is a closed sphere, complete with its own esoteric rules and rituals which are completely unfamiliar to an outsider. They need to examine everything from court rules to regular court hours; financial forms to fines and fees. It’s important to determine if the assumptions, biases, practices, procedures, and traditions degrade justice-seekers, or worse yet, deny justice.

She states; “While a few months of internships or reading law books and commentaries just doesn’t cut it – it’s important for aspiring lawyers to understand that too much of a cushion in the form of internship also hampers independence of thoughts and it’s important to balance this act carefully while taking practical lessons”. With globalization and the trend of India’s emergence on the international fora, shortcomings have come to light which immediately needs attention and address. Immense strides made, there is still enormous room for evolution and development of the legal profession. “What is needed is a vision based on philosophy,” as stated by Shamita.

“The bottom line: It’s imperative that there is an emergence of a judicial system where the best building blocks of the system survive and the vestiges that no longer offer any value are abandoned. This transformation will instill a renewed sense of trust and confidence.” Shamita Mallya

Some of the other common issues that lawyers continuously face is changes made in the law of a particular state or country. It is extremely important for them to be up to date with frequently changing laws which sometimes involves a lot of research on the subject and is indeed time consuming. However, a summation of analysis, understanding and application of the research material is a testimony to the fact that a fair research on the subject has been conducted. A lawyer’s understanding and analysis of a case starts by identifying the relevant facts and determining the legal issues that need to be researched. However, one should not forget that the right conclusion depends upon the researcher’s ability to analyze the matter found during the research process.

Way Forward: Shamita states, “When we started we were a bunch of few aspiring lawyers – who came ahead and wanted to carve out a niche for themselves.” Idea was to capture the market place which was less dominated by the biggies and segments were strong legal support was lacking. They started concentrating in the SME segment – which was their Blue Ocean. “In this segment people wanted to pay the right price for the services and we were bang on to partner them. The zeal was to do quality stuff and we knew once we have their confidence, money would follow. Our journey was fulfilling – so to say we accomplished our goals, big – small together – to that extent we haven’t lost any of our relations. The ratio of our employee and client retention has been the same. I have seen a lot of big firms losing the balance there, and I think to that extent we have been successful.”

Shamita suggests that for an effective research to be conducted the need for accurate and current data has emerged as a key concern, thus asking the researchers to acquire new skills for them to keep pace with the ongoing changes. Research is a critical skill all practicing lawyers must acquire, however attorneys who are hard pressed for time and cannot devote time to research can now outsource research projects to legal support services provider based in India. The benefit of outsourcing such projects shall save on cost and shall be delivered with the same output as these offshore vendors support a team of well qualified lawyers who are experts in doing research projects. The team at Mallyas does a lot of work around legal research and some of the leading firms utilise their services in this segment.

The Team: Success can’t be enjoyed if you do not have the people associated with it along with you. Our strength lies in togetherness and that’s the biggest achievements. Today Mallyas are a decade old firm, comfortably positioned to strike the next target. Their next leap would be towards consumer empowerism. I strongly believe that we (Lawyers) are limited and its important that this limitation doesn’t become a hindrance for the right and timely justice. So our focus would be to curate something which would use technology to the optimum to offer solutions at finger tips. This would be a mix of legal and compliance guidance – so that less people fall in the cracks due to ignorance and people who require support – have something readily available with them as basics such that they can at least have some first level recourse and than depend on legal assistance. To that extent we are redesigning our web platform to make it consumer friendly.

As a practising lawyer Shamita also feels that judges and administrators must take even greater steps to innovate the way that justice is dispensed. However, to innovate, lawyers need to better understand the public’s expectations regarding access points to justice and how they can address their legal needs. The

services across nations and continents. It’s a time of great opportunity for future lawyers to bring millions of new customers into the marketplace—for the benefit of all.”

Law and Technology Shamita has always worked keeping in view the future and she believes that technology has and will play an important role in disrupting the services sector and legal profession will not have an escape. She states; that, the Millennials are already impacting the legal buy/sell dynamics by introducing new, technology and process enabled, agile legal delivery models – which in her opinion is a welcome move, especially when a significant portion of society lacks meaningful access to legal representation.

Influencing Lives – In Their Own Way Shamita states that while D&I is a new-aged wave, but for Mallyas as a firm, this was one of her core focus areas and she & her firm has always been directly / indirectly supportive of the same. Mallyas & Co. has one of their batch of associates comprising of our associates who have been traditionally Domestic Helps and is a completely ladies batch. These group is with minimum educational qualification and the concentration is to get them get to the next level.

Law has a distribution problem; on one hand there are too many unemployed and under-employed attorneys while on the other hand millions of potential clients go unrepresented because they cannot afford counsel at current rates. Technology, process, project management can refashion the legal delivery system.

Interested associates are offered help & assistance in taking up advance courses in their desired field and not just Law. This offers them self-confidence a sense of accomplishment and above all dignity of labour.

The Subtle Scream of the Glitches in THE INDIAN JUDICIARY SYSTEM One of the oldest legal systems in the world, the Indian Judiciary System is still highly influenced by the features of the British law that were incorporated centuries ago while India was still under the colonial rule. The framework provided by the supreme law of the country, the Indian constitution and the judicial system flaunt a history of the glorious independence era. It abides by the common law system that couples with regulatory and statutory laws. We also follow the adversarial system which happens to be of high importance for its unbiased perspective to present both sides of the story to present neutral to the judge, who further proved the judgment based on the evidence provided and the arguments made. But like every system with amendments, the Indian Judicial Systems comes with its own set of flaws that reflects upon its weaknesses and defects and should immediately be reformed and accountable. Here are a few major problems that are faced;

Corruption

time we have come to understand that Right to Information (RTI) act has not proven to be enough organized and hence the issues like trust on law, quality, and liability of justice keep popping up among the citizens.

Corruption is deep-rooted in a lot of institutions of the government in India and so is in the legal as well. The number of scams, rapes, murders, and atrocities that take place have highly put the legal system, judiciary, functioning process, ignorance to truth, in a negative light. The culpability is under the constant scanner, there have been cases of bribes being given to a number of high profile lawyers, judges etc. there is a dire need for immediate repairing of this culture.

The Under-Trials

The number of prisoners on under-trials is very high in India and these prisoners end up spending their entire lives in the prison waiting for their cases to come to some definite conclusion. And while at it, the agony and suffering of staying back in the prison defending themselves are far more than the actual time of sentence. These prisoners are not proven guilty unless they are convicted by the courts. On the other hand, the rich and influential people can fetch the police at the back, and they can pester or hush troublesome and the unfortunate, throughout the long trials in the courts.

Pending Cases

With the maximum number of backlog cases in the world, Indian Judicial system is running on an all-time slow with close to approximately 30 million cases. And there is no end to the constant rise of this number, the need for more judges has been discussed a lot of times but hardly much is done about the same, implementation is either insufficient or late. And while the rich can get away with tapping on expensive lawyers, it’s the mass of poor that mostly suffers the wrath. The slow pace not just delays the justice, it also keeps the prisoners awaiting in the prisons for their trials, eventually with a number of innocents spending their life behind the bars. For instance, the financial hub of India, Mumbai’s industrial development has been suffering immensely due to the pending land dispute cases for years.

Isolation of the Law

It is of utmost importance that the judicial system of a country should be of paramount essentiality and an integral part of the society. It should as well ensure that participation and communications are of the relevance of the society. There are a number of countries out there that encourage participation of the citizens for a better outlook, but on the contrary in India, there is no such activity followed, which again is something that is derived from the colonial rule times. There is a need for change after more than 60 years of independence for the officers to come on common grounds with the people.

Lack of transparency is another great barrier that holds back the better of the judicial system. Over

No matter how hard we shout of being a developing nation, the fact remains that the judicial system is out of place and need an immediate tuning with more case sensitive democratic norms and procedures that validate each and every section of the society and not just the posh. The faster we structure the judicial system the better and immediate progressive bend will intercourse the society.

They specialize in Intellectual Property Laws that includes Trademarks, Copyrights, Patents, Franchising, and Licencing, Start up and MSME Registrations, Arbitration and Company Law, Contracts, Civil and Criminal Law and Litigation. The law firm works with startups, small and large companies, as well as international clients (like Metsize). Lexclaim started with Civil and Criminal Litigation, and then extended its services to include IPR and Company Law. The firm has now established its reputation in the fields of Corporate law and IPR besides civil and criminal litigation. Also, you can ask any motivator or leader everyone has the same answer. Because when you don’t think you won’t act and if you don’t act you won’t be successful. Thinking bigger means, you are dreaming about something consciously and have the ability to visualize what you can accomplish on an audacious scale. It’s all about looking for opportunities with an open mind. If you underestimated what you can attain in the long term, it means we are disrespecting our capability. Also, don’t let other people come into your mind so that they can tell you what you should do or not. Otherwise, you don’t even think anymore. Do you want to be a guy? who just follows the boss’s instructions or you want to be a guy who is more important for the boss? It’s all up to you. If you are an entrepreneur. Well, I don’t need to explain because you know the importance of it.

How can we think bigger in work and life?

No one can measure your limit. There is the only way you can figure out by getting things done. Then why everyone keeps saying to us, “don’t dream, live in reality.” Well, because they don’t know what is your limits? We have grown in the society where we have been told us entire life. This how we live life. this is why we set limitations for ourselves. Setting limitations won’t let you think bigger. Suppose that, some people (big thinkers) get assigned the role by you. But later you find out, you are not necessarily seeing yourself in the role. Why? According to Forbes, Michael Port has explained. He said Reason could be anything like the voice of judgment, weird work environment, colleague keeps telling you why the thing does not get better, even your own internalized sound saying you something.

Set the right kind of goals As I said earlier, think bigger without someone asking. That doesn’t mean, you have to set wildly ambitious stretch goals to make yourself inspired. However, people sometimes dream unrealistic goals for their selves and in the end, they get the miserable result. While setting goals, they compare with others and set high-level goals because it makes them happy. But they always feel unsatisfied with their goals. Eventually, you what happens. My point is why are you setting goals by comparing yourself to others. The goal means the desired result envision by a person or group that can be achieved by giving effort. In order to follow goals, you should have steatites. We set unrealistic goals because we have an unrealistic expectation in this situation, you feel that you would fail. So, we should not set yourself up for disappointment by setting unrealistic huge goals. Instead set goals by being realistic.
