PRESIDENT’S MESSAGE

Are You Up for the Challenge?

T

he years of continued legislative attacks on private property rights, combined with the recent turmoil caused by the COVID19 pandemic, along with the media’s generally negative portrayal of rental housing providers, is enough for many of us to want to throw up our hands and quit the business. But that is not who we are as individuals, as an industry, and certainly not as members of the Apartment Association of Orange County. Instead, we must continue to fight even harder and with greater conviction, with the AAOC leading the way, to protect and preserve our rights as property and small business owners. It’s not easy. In fact, it’s becoming increasingly difficult and costly to continue the fight, but we do so because our livelihoods and the fruits of our labor and sacrifices remain under constant assault by our “progressive” state legislators. Against the odds, and with the continued support of its members, the AAOC has scored some victories this year at both the local and state levels, in defense of its members and the greater rental-housing industry.

Keeping Local Rent Control at Bay

Orange County remains free of local rent control ordinances despite the ever-present threat that such a proposal represents. While there is occasionally rent control chatter among tenant activists and others, none of the 34 cities in Orange County have taken steps to

actively discuss and advance such a radical, anti-business, anti-property rights policy measure. This is due in large part to AAOC’s efforts, as part of a coalition of Orange County housing associations, to remain actively engaged with our local city council members and other officials, in order to prevent discussions of rent control from gaining traction inside our city halls. The most recent case was in Santa Ana, earlier this summer, where tenant activists were again signaling their desire and intention to have a proposed rent control ordinance placed on the city council agenda for discussion. Thanks to the efforts of AAOC and its coalition partners, this effort fell on deaf ears at city hall and such as discussion was never agendized.

Recent Victories in Sacramento

AAOC also scored some recent victories in Sacramento, having played an instrumental role in helping stop some of the increasingly invasive and prohibitive legislation affecting rental property owners and operators. Here are just a few of the bills that AAOC recently helped defeat. AB 854 — This bill sought to prevent rental property owners from taking their units off the market, in addition to imposing other requirements and conditions upon owner(s) who sought such an action. AB 854 died in committee. AB 889 — This bill would have mandated rental housing providers to

submit ownership information to the Secretary of State. AB 889 failed to muster the necessary votes to pass out of committee. AB 1188 — This bill would have required every city and county to create and maintain a publicly accessible rental registry with specific information on the rental units located in the jurisdiction. AB 1188 died in committee. As California’s legislative majority continues moving to further restrict rental-housing providers’ ability to conduct business in a free and open market, we must remain unified, committed, and focused on the threats and the fights before us. The AAOC legislative team does an excellent job representing our interests, but our direct involvement as members also makes a significant difference when it comes time for our state legislators to cast their votes on bills that impact our industry. We need to make our voices heard by calling and emailing our legislators, keeping the pressure on them to reject the bills that threaten us and our industry. When we engage as members, we have a fighting chance to defeat at least some of these bills, as illustrated above. AAOC’s Technological Evolution Continues

T

o say that technology played a critical role in keeping society moving during the COVID-19 pandemic would be an understatement of epic proportions. Certainly, for the Apartment Association of Orange County (AAOC), our investments in communications and information technology upgrades, and our quick adoption of video conferencing and webinars in the early days of the pandemic shutdown allowed us to keep the association’s business operations and member services running smoothly and seamlessly. While the pandemic resulted in AAOC fast-tracking its adoption of certain technologies and platforms, these steps were part of a “technological evolution” that had actually begun preCOVID, as part of a larger association modernization plan aimed at enhancing service delivery to members, achieving previously unrealized operational efficiencies, and establishing business continuity to ensure association resiliency in the event of an unforeseen disruption in operations. As we all got settled into online meetings, education classes, and other member programs and services, the

next phase in AAOC’s technological evolution quickly came into focus. It was time for a new website and a more functional, reliable, and user-friendly association management system that would provide an enhanced online experience for our members. AAOC launched its new website and member database last month and members have been encouraged to visit the website, create their new login credentials, and get familiar with their Member Compass. The Member Compass allows you to maintain your account, register for events, make secure online payments that process immediately and are reflected on your account in real time, and so much more. To get started, you will need to create a new account login and password. Your previous username and password will not work on the new website. Member account numbers have also been discontinued. Additionally, other individuals who are affiliated with your member account will need to create their own account profiles using their email address. Duplicate email addresses cannot be used for multiple accounts and profiles. Once you have logged into your account and accessed the Member Compass, your Dashboard will show your membership status, upcoming event registrations, and any outstanding invoices, plus your profile information, account history, current and past event registrations, and transactional history. Members will also be able to

register for meetings, education programs, and other association events, make updates to their profile information, view and pay invoices, securely store payment information, and many other functions. Additionally, if you are the Primary Contact or Billing Contact on the account, or you have been granted management access for your company, you will be able to update most company information, including adding and updating staff members and their contact information. The launch of the new website and member database is an exciting and significant step forward in AAOC’s technological evolution and modernization efforts, and there is more to come in the months ahead. If you have already created your new account login and password, you have hopefully also explored your Member Compass, made updates to your profile and other account information, and checked out the new website with its improved functionality, features, and content. AAOC Helps Kill AB 889 in Committee

O

n July 12, 2021, the Senate Judiciary Committee, on a lop-sided vote, refused passage of AB 889 (Gipson). AAOC was a key witness in opposition to the bill. AB 889 would have set in motion a requirement that was incredibly invasive in the operation of rental housing businesses. The bill would have required landlords who are incorporated or who own rental property in a limited liability company to report everyone who has an ownership share in the property to the California Secretary of State. Just a few weeks before the bill was heard in the Judiciary Committee, the bill proposed to require grocery stores— yes grocery stores—to as soon as possible, but no later than 60-to-180 days, depending on the size of the store, to provide written notice to the California Department of Social Services (CDSS), the city and county in which the store is located, and the local workforce development board of a planned closure. It

also proposed to require the notice include specific information about the closure plan. Sound like a landlord and tenant bill to you? Of course not! The author, with the urging of the sponsors, California YIMBY (Yes In My Back Yard) and the California Reinvestment Coalition, gutted the “grocery store” bill and decided to instead target the rental industry. Did they reach out to us? Did they truly justify the massive change? Did they argue the bill was necessary to increase transparency…decrease fraudulent conduct…clamp down on slumlords…slow—if not stop—bank mergers …expose rental property owners who “hide” behind current law…that beneficial ownership is only discovered during litigation? The answer is…of course they did! Now, let’s look at existing law. Current law requires owners of rental property to: • Be transparent to government, applicants for tenancy and tenants. Owners/agents must disclose the name, telephone number and street address at which personal service may be affected of each person that manages the premises and each person who is an owner of the premises or a person who is authorized to act for and on behalf of the owner for the purpose of service of process and for the purpose of receiving and receipting for all notices and demands. The disclosure must also include the name, telephone number

and address of the person to whom rent shall be made. • LLC’s corporations or other similar entities are to register information about their beneficial owners with the Financial Crimes Enforcement Network of the Department of the Treasury starting in 2023. The beneficial owner includes: the person exercising substantial control, the person who owns 25 percent or more of the equity interest of a qualified entity, and the person who receives substantial economic benefit from the assets of the qualified entity. AB 889, as amended would have required corporations or LLCs that own residential rental property to report the beneficial owner to the California Secretary of State. Only minor children, a person acting as an intermediary or custodian of another, a person acting solely as an employee of a qualified entity, a person whose only interest in a qualified entity is through the right of inheritance and a creditor would have been exempt. Every other person or entity would have been required to report to the state. The bill is modeled after several unsuccessful attempts to achieve the same purpose by Assembly Member Buffy Wicks. Earlier this year, Ms. Wicks proposed to have the state compile a dossier on rental property owners. She even amended her bill to have the appearance of not being so demanding


about the owners of rental property owners. The Assembly turned down her efforts. We still don’t understand why California YIMBY supported the bill. In fact, we argued before the committee that the bill would have made it far more difficult to own, convey and manage rental property. For that matter, it would have done nothing to promote interest in rental property…particularly affordable housing! Representing the California Reinvestment Coalition was a professor from Georgetown University Law Center. Among other things, the professor argued the state would only require a “small change to” the state’s registration forms. The Secretary of State and the committee argued quite the contrary. The Secretary of State concluded that “AB 889 is inconsistent with the current Secretary of State (SOS) operational and fiscal procedures and presents multiple implementation challenges.” Our key issue was there is no immediate need for the bill…the bill is intrusive…and the sponsors are wrongly arguing that institutional investors are stockpiling cash in an apparent attempt to buy up another large swath of rental property in our state. In fact, investors would not be prevented from buying up rental property. With the Senate Judiciary Committee’s rejection of AB 889, this bill is now dead for the year. Unfortunately, dead legislation is often revived, dusted off, and reintroduced as a new bill. Will this be the case for AB 889? Only time will tell. ORANGE COUNTY LEGISLATIVE WATCH

New AAOC Legislative Scorecard — Voting in our Best Interests

T

his summer the Legislative Committee of the Apartment Association of Orange County (AAOC) is working on a scorecard that will evaluate and rank how our state legislative representatives and local city council members have voted on key issues to the rental housing industry. The scorecard, which will be released this fall, will help to ensure AAOC members have as much information as possible regarding their elected officials before filling out their ballots in the next election. The AAOC Legislative Scorecard will be released annually at the conclusion of each year’s state legislative session, in both election and nonelection years. The AAOC Legislative Committee already publishes a list of endorsed candidates each election year prior to the November General Election, but this new legislative scorecard will be designed to help hold our elected officials accountable for their votes on rental-housing industry issues every

year. To be fair, we will let our elected officials know our positions on key legislation and policy proposals before they vote. Both AAOC and our state organization, the California Rental Housing Association (CalRHA), already take positions on state legislation that affects our industry. We send letters of support or opposition to our legislative representatives, depending on the position AAOC takes on the bill, and we do the same with our city council representatives as local issues arise. The AAOC Legislative Scorecard will be heavy on state legislation, as we are fortunate that major issues that directly affect our members are rare in the cities that AAOC represents. That said, when it comes to the association endorsing local candidates, we do require them to complete a candidate questionnaire, so we can gain insight into their personal positions on the issues that matter most to our members and the rental-housing industry. Issues can often be vague, and it is sometimes difficult for our members to stay up-to-date on their local state representatives’ or city council members’ voting behavior, so AAOC will try to make it easy to see where these officials stand. There may also be certain elections where the AAOC recommends a candidate who may be the better of two less than optimal candidates in a specific race. All politics is local, but all local politics is not the same in every city AAOC represents. We will endeavor to

keep explanations as simple as possible for the elected official and for our members. Finally, the U.S. Census Bureau is set to release its in-depth 2020 Census demographic statistics by August 16, which will be used to redraw legislative voting districts at all levels of government. This is good news for California and for Orange and Riverside Counties because it will allow enough time for the California Citizens Redistricting to release the preliminary new legislative district maps in early December. Candidates in Orange and Riverside Counties for the June 2022 California Primary Election will need to start declaring their candidacies by early next year, and the AAOC Legislative Committee will be ready and eager to begin evaluating these candidates and making sure our association members are kept well-informed. A Housing Provider’s Guide to Compliance with AB 832 COVID-19 Tenant Relief Act Extension and Rental Housing Recovery Act

J

ust when we were getting used to the mandates of The Tenant Protection Act of 2019, AB 1482, which brought us Just Cause Eviction and Rent Controls throughout California, AB 3088, the COVID-19 Tenant Relief Act of 2020, SB 91, titled simply the COVID-19 Tenant Relief Act, which extended the mandates of AB 3088, we have another extension, AB 832. Signed into law on June 28, 2021, the new law took effect immediately. As did AB 1482, AB 3088, and SB 91, AB 832 will continue to wreak havoc on us as housing providers, making it ever more difficult to continue to provide housing to our fellow Californians.

What does it do? • AB 832, like AB 3088 and SB 91 before it, continues to limit a housing provider’s ability to evict a resident for non-payment of rent or other financial obligations (“COVID-19 Rental Debt”) that came due or will come due between March 1, 2020 and September, 2021, the “Covered Time Period.” Although it is intended to protect those residents who have experienced “COVID-19 related financial distress,” there are few if any safeguards that would prevent the abuse of these new protections. The new laws created two time periods within the Covered Time Period and establish different

rules for each: i) March 1, 2020 through August 31, 2020, is the “Protected Time Period,” and ii) September 1, 2020 through September 30, 2021, is the “Transition Time Period.” • AB 832 establishes a third time period, the “COVID-19 Recovery Period,” and defines rental debt that will come, or came due between October 1, 2021 and March 31, 2022, as “COVID-19 Recovery Period Rental Debt.” • Establishes strict criteria, procedures to follow, new notices to include, new forms to be created, and declarations by the Lessor that you submitted an application for rental assistance and the application was denied prior to filing an unlawful detainer action after October 1, 2021. • Additionally, AB 832 expands and clarifies, sort of, the procedures for rental assistance and funds to be allocated to tenants and housing providers. Potential Rent Assistance available to housing providers has been increased from a maximum of 80%, to 100%. • AB 832 extends penalties for retaliatory actions, interrupting or disconnecting utilities with intent to terminate tenancy if a tenant has provided a Declaration of COVID19 Related Financial Distress.

What do Housing Providers need to do now?

On or before July 31, 2021, you must serve a specific form notice to any resident who, as of July 1, 2021, has not paid one or more rental payments that came due or will come due during the Covered Time Period, March 1, 2020 through September, 2021. The required form, “Notice To Tenants Who Have Not Paid One Or More Rental Payments That Came Due From March 1, 2020 Through September 30, 2021” is available to members of AAOC (www. AAOC.com). It can be served by regular US Mail or as you would other legal notices. Be sure to complete a

Declaration of Service noting the date and manner of service, and keep it in your tenancy files.

How do I handle rent that came due during the Protected Time Period (March 1 through August 31, 2020)?

If a resident owes rent that came due during the Protected Time Period, you are required to use the current Fifteen-Day Notice to Pay Rent or Surrender Possession form. The form temporarily replaces the old Three-Day Notice to Pay Rent or Surrender Possession. Note that the fifteen days do not include Saturdays, Sundays, or other judicial holidays. The new form, of course, is available from the AAOC. Note that this new form is only to be used for rent that came due during the Protected Time Period. If the resident owes other financial obligations, monetary sums other than base rent, i.e. utility charges, garage rent, late fees, etc., you would proceed as stated above, preparing a separate notice for each Time Period, however you would use the new Fifteen-Day Notice to Perform Conditions and/or Covenants or Surrender Possession form. Just as you are required to use different forms for each Time Period as described above, there is a different form for each Time Period to demand other financial obligations, one unique form for the Protected Time Period and another for the Transition Time Period. These forms can be served concurrently with the Notice(s) to Pay Rent or Surrender Possession as appropriate.

How do I handle a resident who is in breach of the lease or is causing a Nuisance?

served a Three-Day Notice to Perform Conditions and/or Covenants or Quit for a material breach of a covenant contained in your lease (other than rent or financial obligations), i.e. sublet without consent, maintaining a pet without consent, altered the Premises without consent, etc. If appropriate, once the Three-Day Notice to Perform expires, and the resident has not cured, a ThreeDay Notice to Surrender Possession could then be served to terminate the tenancy. Alternatively, in the event the resident is engaged in illegal conduct, is committing waste or is a Nuisance, you may have grounds for the service of a Three-Day Notice to Surrender Possession based on such conduct without the necessity of service of a notice to perform or quit first.

Can a Housing Provider evict for At Fault or No Fault Just Cause?

Between now and October 1, 2021, all residential properties, with some very limited exceptions, are subject to the Just Cause requirements of AB 1482. That means even single-family residences, which were previously exempt, are now temporarily covered and require Just Cause prior to termination of the tenancy. • Termination for At Fault Just Cause, i.e. rent default, breach of a material term, nuisance, waste, refusal to renew a fixed term lease, refusal to allow entry, or failure to vacate after tenant provided notice, are all grounds that are still allowed. Termination for No Fault Just Cause, i.e. withdrawal of the rental property from the rental market, intent to occupy by the owner, spouse, parent, grandparent, child or grandchild, is permitted, but make sure the termination is not because the resident is not paying rent. • Termination because the Lessor desires to substantially remodel or repair the Premises must now relate to maintaining the habitability of Legal Q&A — continued on page 18

Fixed term lease expiration, notices of non-renewal, and 30- or 60-day notices that previously did not require just cause, are no longer grounds for termination and will not support the filing of a new eviction. Note that for terminations to allow occupancy of a qualified family member, if the lease was entered into on or after July 1, 2020, specific language must be included in the lease. Also note, if the Premises are exempt pursuant to AB 1482, then you must serve the requisite notice of exemption prior to termination of the tenancy.

Any other new laws a Housing Provider should be aware of?

As if the above is not complicated enough, the federal government has chimed in again. The Centers for Disease Control and Prevention (the “CDC”) issued an Order on June 24, 2021 extending the nationwide eviction moratorium that was set to terminate on June 30, 2021, to now terminate on July 31, 2021. The language is vague, only applies to residential rent default cases, arguably doesn’t even apply in California, however some Los Angeles judges are invoking the Order and staying lockouts to occur on or after August 1, 2021. The rules and interpretation vary not only by county, but also by the assigned judge or commissioner. Attorneys are already preparing to file civil actions against housing providers and counsel for violation of the CDC Order. Beware!

Ok, how do I get some of that financial assistance?

Go to http://housingiskey.com or call 833.430.2122. Rent Assistance has been increased to 100%. It is imperative that all housing providers assist their residents in their attempts to qualify for assistance. Most programs will allow

housing providers to apply directly, and the resident must then verify the information provided, and submit necessary documentation to establish that the resident is qualified.

Scenario #1

Tenant is current on rent, is performing as required, no defaults, and you want to keep the tenant. • Maintain course, nothing needed unless there is a default. Thank the tenant for his cooperation. Go buy a lottery ticket.

Scenario #2

Tenant has not paid rent for one or more periods during the Protected Period, but is otherwise performing as agreed. • Prepare and serve the “Notice To Tenants Who Have Not Paid One or More Rental Payments That Came Due from March 1, 2020 through September 30, 2021;” • Prepare and serve the AAOC form “15 Day Pay or Quit — Protected Period” and/or the 15 day “Notice to Perform or Quit- Protected Period” if other financial obligations are due. Note that with very few exceptions, you cannot include rent or other monetary sums that came due more than one year before you serve the notice; • If the tenant returns the Declaration, then stop, you cannot pursue eviction based on the Protected Period monetary default. You will need to pursue your claim in small claims or civil court after November 1, 2021 if you are unable to negotiate a voluntary payment plan; • If the tenant fails to return the declaration, you may file the eviction, however that may not be wise. If appropriate, prepare and serve a 30- or 60-Day Notice of Termination, whichever is applicable, use the existing AAOC form, make sure that you state the permitted Just Cause reason as required, relocation fees may be required if the Premises are no exempt (may be offset if rent unpaid). If Premises are exempt under AB 1482, then make sure that the required notice of exemption has already been served. If not, serve it concurrently with the termination notice. During the recent rains, my building started leaking. I was surprised, as I had just installed a new roof. The odd thing about the leak is that it is only affecting the downstairs units. What is going on and how do I solve this? Michael

Dear Michael:

Water is a funny thing and tracking down leaks sometimes takes a bit of detective work. The first thing we would check is the roof. As you stated, the roof is new, but sometimes the old flashing does not get caulked and the water finds its way down the side of a pipe, valley, or junction area. Have your roofer double check all the flashings. Another issue to look at is water pooling around the foundation. If you have cracks in the foundation, water will find its way in. Be sure to clear any debris, dirt and leaves from around your building or anything that will cause a water dam effect.

Overgrown or old landscaping can contribute to leaks by trapping water or redirecting water to the building instead of away from it. Inspect the building’s stucco for cracks. We have seen small cracks in the stucco suck in large amounts of water. Pay close attention to the stucco between floors, or on the edge of balconies. Balconies shed a lot of water which may cascade over the edge and flow back into the stucco where a hidden crack will allow the water to enter. If you have aluminum windows, check the weep holes that allow water to drain out of the window tracks.

I am having a plumbing issue that is causing hot water to cross into the cold water lines. Sometimes it takes a good five minutes to get cold water from the faucet or spout. The issue seems to be worse early in the morning. Any help in tracking this down

The problem is most likely in your shower or tub. This issue often happens with single handle shower valves. The rubber seals in the valves harden or crack and cause the hot water to seep into the cold water lines. The reason the problem is worse in the morning is because the water system is sitting without use all night. The simplest solution is to replace all your shower valve cartridges at the same time. We suggest you do all the valves, as it is hard to determine which valves are bleeding over into the cold water system. If you have single handle kitchen or bath sink faucets, you may want to consider replacing those cartridges as well. This is a precursor to valve body damage, and if the symptoms return, the valve bodies will need to be replaced as well.

The grab-bars must be able to support a dead weight pull of 250 pounds. The preferred method is to bolt directly into the wall studs. This is not always practical, as the stud might not line up

where they are needed. Grab-bars can be mounted vertically or at an angle to match wall stud spacing. Horizontal installation can be difficult because stud spacing, and bar sizes do not always match. If finding studs becomes a problem, alternate installation methods are available. If your walls are in good condition, you may use large toggle bolts or if you have access to the backside of the shower or bath walls, insert a backer plate or add a new stud for an anchor

point. Safety grab bars can be located at any local hardware store. It is advisable that you check ADA requirements with local, state, and federal agencies for regulations governing height, distance, and angle of the bars.

How do I get oil or grease stains out of concrete? I have both a concrete patio and a parking area with grease stains. Soap and water does not get them clean. Brenda

Dear Brenda:

Go to your local grocery store and pick up the cheapest brand of cat litter you can find. Spread the cat litter over the oil-stained concrete and grind it in with your shoes. Leave the litter in place for a minimum of an hour (24 hours is best) and then sweep up the litter and the stain should be gone. Cat litter is an absorbent that helps draw out the oil or grease. If you have a large area to clean, you may want to go to the hardware store or industrial supply house and purchase 50-pound bags of Absorbent. The cost is a little more than a regular sized bag of cat litter at the supermarket or pet store.

I need to replace a dishwasher for the first time and I am a little intimidated by the process. Can you walk me through the installation procedure? Mac

Dear Mac:

The installation of a dishwasher is not as complicated as it looks. Start by turning off the electricity leading to the machine, then turning off the water at the main shut-off. If your dishwasher site is not pre-plumbed with a separate water valve, remove the existing hot water angle stop valve under the sink and install a double threaded angle stop/shutoff valve. You might also be able to remove the fitting from the old dishwasher. Next, connect the drain line from the dishwasher pump motor outlet to the garbage disposer inlet. Don’t forget remove the “knockout” in the garbage disposal inlet. Be sure to use an “Air Gap” between the dishwasher and the garbage disposal. The air gap is installed next the faucet and stops the water from draining back into the dishwasher by siphon action. If you are unable to install a true air gap device, loop your drain line over the

dishwasher before hooking up to the garbage disposal. Both methods will prevent debris from sucking back into the machine. Look for a small electrical box under the dishwasher, remove the cover and pull out the wires. Connect your wires or pig tail to the machine. A “pig tail” is a wire with a plug on one end and bare wires on the other end. Be sure to hook up the green “ground” wire for safety. Carefully push your machine under the counter. Once in place, adjust the legs by turning them in or out to level the machine. There should be two tabs at the front top of the dishwasher, use these to secure the machine to the countertop with screws. Now, turn on your water and electricity and test your dishwasher and check for leaks.

NAA Sues Federal Government to Recover Industry’s Losses Under Nationwide Eviction Moratorium Special from the National Apartment Association

T

he National Apartment Association is taking legal action to recover damages housing providers suffered under the CDC’s eviction moratorium and ensure that similar measures can never again be enacted. The National Apartment Association (NAA) on July 27 filed a lawsuit in the U.S. Court of Federal Claims to recover damages on behalf of rental housing providers that have suffered severe economic losses under the U.S. Centers for Disease Control and Prevention’s (CDC) overreaching federal eviction moratorium. As NAA members and the broader industry understand all too well, the CDC’s prolonged order directly harms those who provide critically needed rental homes, jeopardizes the long-term viability of housing infrastructure and sets a dangerous precedent for future disaster-response measures. NAA is the first to take legal action seeking compensation for the CDC’s policy and to

ensure that similar “emergency measures” cannot be enacted again. The suit, NAA et al. v. The United States of America, is open to all rental housing providers who have been damaged by and are operating in a state or locality under the federal eviction moratorium. It argues that the CDC order has curbed several rights under the U.S. Constitution including: The right to access the courts, the freedom to contract with others absent government interference, the right to demand compensation when property is taken by government action and the limits of federal government power. NAA is confident that the CDC will be found to have acted illegally based on court rulings to date, including the most recent decision from the Sixth Circuit Court of Appeals affirming that the CDC’s order was unlawful. Apartment owners and operators have continued good-faith operations throughout the public health and economic crises of the COVID-19 pan-

demic and are now left to shoulder $26.6 billion in debt not covered by federal rental assistance. As a low-margin industry where just 10 cents of each rental dollar is considered “profit,” this debt is unsustainable and could devastate countless small businesses while simultaneously damaging housing affordability. Though NAA is proud of the unprecedented adaptability and flexibility of our members and the broader industry, we firmly believe that it is time to make rental housing providers and their residents whole again. Relief efforts to date have fallen short of fully supporting the rental housing industry and its residents. While the federal government has allocated roughly $47 billion in federal rent relief, it took more than nine months for Congress to do so. Further, that amount also does not cover the full and continuously growing amount of rent debt — current estimates indicate an Moratorium — continued on page 32

Southern California Edison Launches Program to Install 38,000 EV Chargers

C

harge Ready is the largest utility-run electric passenger vehicle charging infrastructure program in the nation. Beginning last month, businesses, government agencies and other organizations in the Southland were able to begin signing up to participate in Southern California Edison’s (SCE) Charge Ready program, the nation’s largest electric passenger vehicle charging infrastructure program run by an investor-owned electric utility company. The $436-million program, approved by the state last year, will add about 38,000 new electric car chargers throughout SCE’s service area over the next five years. Through Charge Ready, SCE installs and maintains the supporting EV charging infrastructure while site hosts, who are non-residential SCE customers, typically own, operate and maintain qualified charging stations. “As SCE is preparing its electric grid to serve the increase in transportation electrification, more charging equip-

ment is needed to give EV drivers and fleet operators the peace of mind that they will be able to charge whenever they want,” said Carter Prescott, SCE director of eMobility and Building Electrification. “Today, we are asking our customers to join with us to ensure that an effective framework is in place for a clean air future for our communities.” The large-scale program is modeled after a much smaller pilot that ended in May, in which SCE partnered with businesses, local governments and other organizations to add more than 2,700 charge ports at nearly 150 sites. The first site to participate in the pilot was the city of Lynwood, where six chargers were installed four years ago to charge the city’s fleet of EVs, and eight more were installed in the civic center public parking lot. Lynwood City Council member José Solache was on hand to share the city’s experience with those interested in the program and give them an idea of what to expect. “Edison has always been a good

partner with the city of Lynwood, and we were definitely excited that Charge Ready helped us meet our goal of transitioning to a cleaner fleet,” said Solache, who is himself an EV owner. “At the time, it was also exciting to be able to provide our residents with one of the few public charging sites in the area.” Joining the panel with Solache was Walter Marquez, interim CEO of Fairplex, where SCE helped to install 200 ports at the 487-acre site that hosts the Los Angeles County Fair and 400 other events throughout the year. “Being an early adopter, we are now actually able to help others who are contemplating expanding their infrastructure through Charge Ready, and we appreciate that partnership with SCE,” Marquez said. “We know that electric vehicles and charging are very much a part of what California is going to be in the future and where it’s headed now.” SCE also helped the city of Long Beach install 102 ports at five sites, including the Aquarium of the Pacific, The Pike Outlets, City Place, the city’s fleet services yard and the Long Beach Police Academy. “The best part of participating in Charge Ready is being able to provide a benefit to both our public and our fleet,” said April Walker, project management officer with the city. “Transitioning fleet vehicles to zeroemission and electric is a benefit because you’re reducing the emissions that go right back into these communities.” EV Chargers — continued on page 32

Since the onset of the pandemic, NAA has aggressively advocated to protect the interests of the rental housing industry. We have called out the dangers and short-sightedness of eviction moratoria and asked for its sunset to both the 116th and 117th Congresses, in meetings with both the recent and

Secretary Alex Azar, et al. The COVID-19 pandemic was devastating, and if we do not act, the housing affordability crisis may grow into a catastrophe where the government could invoke more “emergency” remedies. With the meter on rent debt still running, political will waning and Congress moving past COVID-relief measures, NAA is putting up the greatest fight yet and asking the courts for

two things: Fair compensation for damages suffered under the unlawful CDC order and an assurance that the federal government can never do this again. The rental housing industry cannot be held solely responsible for an unfunded rent debt while the federal government trades one crisis for another. How Long is Too Long?

O

n June 28, Governor Gavin Newsom signed into law Assembly Bill 832, thus extending California’s eviction moratorium until September 30, 2021. This same legislation increases the value of the reimbursement that the state’s emergency rental assistance program provides to now cover 100 percent of past-due and prospective rent payments. But for both landlords and lowincome residents, how that assistance may be obtained and who actually qualifies under what circumstances becomes much more complex. And, like many such undertakings, as Assembly Speaker Anthony Rendon explained to CalMatters, “We’re trying to implement new processes and protections, and we’re hoping that those will be effective.” So, what does all of this mean for Orange County apartment owners? Even for those who have not had to cope with residents losing their jobs and unable to pay rent, the economic hardships have been challenging. Perhaps more strongly than anything else, the extension of the eviction moratorium signals that there are still uncertainties ahead. Certainly, the return to pre-pandemic norms is going to be a much longer process than envisioned. And, for apartment owners, regaining the cashflow levels of previous years may be an uphill struggle. With all that is happening, no matter

how your rental properties are currently positioned, it is critically important that you step back and look at the bigger picture. You need to quantify not only your day-to-day needs and goals, but also the impact the new laws may or may not have upon returns and values in the future. Expenses are a major consideration. Beyond regular operational costs, prices for lumber and other construction materials have skyrocketed. Then there are the long waits for replacement items which cause delays and potentially a loss of income if preparing a unit for re-renting. Seasonal adjustments have to be taken into account, as well. Particularly this year as summer temperatures rise to record-breaking levels, putting added stress on air conditioners and compressors. Also, as noted just a few months ago in this column, deferred maintenance items are another part of this equation. Ignoring certain types of preventative upkeep can often result in even greater costs downline either in terms of the actual repairs or with a loss of value. Then, there is the question as to how you will pay for those increased expenses. Do you have sufficient savings? Unless you have set aside specific reserves, is it even in your best interest to tap into those funds? Should you be considering a rent increase? Yes, statewide rent control sets a limit on the amount, but there are also the market constraints to take into

consideration. Even for properties with more affluent residents, the pandemic carried both an economic and a lifestyle impact. No longer able to dine out and travel, a good number of residents took advantage of those savings and the still low interest rates to make the move to home ownership. Working remotely further changed where some residents felt that they need to live. At the bottom line, if you have not done so recently, you need to survey what similar properties in your area are charging. This is important information that can be invaluable in guiding you in making decisions going forward. If your rents are below those of other comparable properties, then that tells you there are opportunities. Perhaps now is not exactly the right time to institute a rent increase, but you may want to start making preparations and spend some money on exterior touchups, landscaping and common areas. Your income and expenses not only determine your cash flow, they impact value as well. Today’s income property investors are taking a hard look at the fundamentals. They want to know that a property has the potential to generate a return and they are no longer counting on big price escalations. So where do you go from here? Everyone’s situation is different. Is a Deadly Fault Lurking Underneath Orange County’s Mountains?

T

he Santa Ana Mountains are a regional treasure, providing a spectacular backdrop to Orange County. The range begins at the Whittier Fault and stretches south to the Santa Margarita River. Major summits are scattered along the ridge, the mightiest being Modjeska (5,496 feet) and Santiago (5,689 feet) — which form our beloved Saddleback landmark. They’re a large part of the culture and history of our county, more majestic than the Santa Monica Mountains, the Verdugo Mountains, Puente Hills, Coyote Hills — all of which have active faults under them. How did our Santa Ana ridgeline come to be? Did an earthquake fault cause them to rise? To answer that, let’s step back and take a look first at the small but lovely San Joaquin Hills nearby. A University of California, Irvine, researcher in the early 2000s set out to study the source of that coastal ridge, and presented evidence that it rose from the sea because of an undiscovered blind thrust fault capable of producing an earthquake up to magnitude 7.1. Lisa Grant, an expert in paleoseismology, earthquake geology, neotectonics, environmental geology and public health, determined the San Joaquin Hills fault runs northwest to southeast following the coastline near the 405 Freeway at the Santa Ana River, to the El Toro Y and then along the 5 freeway to Dana Point — snaking its way under Newport Beach, Irvine,

Aliso Viejo, Laguna Hills, Laguna Beach, San Juan Capistrano. She later turned her research to the larger Santa Ana mountains – believing those peaks, which the USGS says are growing at a rate of 3/10 of a millimeter per year — are the result of a blind thrust fault. To date, the existence of that fault has not yet been proven. “We haven’t had that earthquake to tell us exactly where it is,” she said in a UCI article on her research.

Another Puente Hills?

Don’t think the lack of proof means the fault isn’t there. Seismologists last year discovered a hidden fault in Los Angeles more dreaded than the San Andreas. A study by the University of Southern California says the Puente Hills Fault has the capacity to produce “the costliest disaster in U.S. history.” As many as 18,000 people would die, 735,000 would lose their homes, and up to 100,000 tons of debris would be generated. The total economic loss would be as high as $252 billion. Puente Hills is a blind thrust fault, the same kind Grant said the undiscovered fault under the Santa Anas would be. She based those findings on the geology of the ridge. Blind thrust faults rupture with one side of the fault pushing up and over the bottom side. It was this type of fault that set off the deadly Northridge quake of 1994. Thrust earthquakes create an accumulated strain that bends the earth’s August 2021

crust in spots, where the fault has locked up. Seismologists believe that these areas are the spots most prone to future earthquakes. Is Grant right? Is Orange County threatened by its own sleeping giant of a fault? Only time will tell.
