O

k, stop me if you’ve heard this one before. And no, this isn’t a reprint. But nearly two months ago I wrote an op ed for the Orange County Register sharing my general discontent with the real estate media and the reporters covering our industry, for their laziness and inability to look at a complete set of data in order to put the real story together. If you think about it, the nature of real estate reporting is so fragmented that unless reporters

collaborate, we the public are deprived of a complete story. We get financing, development, brokerage and economic updates, but the data comes piecemeal and incomplete. Rarely does a reporter possess the industry awareness and savvy to put it all together.

Public Service or Public Disservice?

That is, to look at housing data both from the rental and for sale markets, the lack of new development that has

plagued Orange and Los Angeles counties for decades, the difficulties experienced by an array of would-be borrowers, the tremendous population growth that has occurred here since the 1980’s in order to say the obvious “more people, less suitable affordable housing options, a higher barrier to entry in the for sale market equals higher occupancy in the rental market.” Instead, headlines such as “Renters Priced Out” and “Orange County Homes Reach Highest

First and Goal

Putting it all together takes insight, expertise and a feel. Almost like a veteran quarterback approaching the line, reading the defense and calling a play or knowing how and when to roll out of the pocket. And this is similar to what is occurring in our business and our economy right now because people and specifically the public are perplexed by the market, but those who get it are throwing for the end zone on each and every play. The equation is simple, folks. Greater population growth plus limited inventory plus lack of new development plus lack of reasonable financing options for would-be homebuyers equals more renters and higher housing costs (for rent and for sale).

Sense Don’t Sell

It’s not a sensational story and truly not one that evokes the greedy “monopoly man” image often wrongfully affixed to apartment owners. Instead, it’s one that makes sense. During the course of writing this column, Facebook Memories reminded me that it was just 7 years ago in July of 2009 that I had written about our record vacancy rate (then at a 22 year high). Fortunately for us, we have made significant progress since then. See how history and the facts don’t necessarily fit with the media’s portrayal of our industry? Greed, although it manipulates the market, doesn’t drive the economy and the economy and its recovery is powering what is going on in the real estate market today. The media may want us to apologize for our industry’s success, but I’d rather be grateful and look for the next opportunity to help and serve.

ecently, the Apartment Association staff and I attended the National Apartment Association 2016 Education Conference and Exposition held in San Francisco. The size and scope in growth of the contemporary multi-family housing nationwide is truly staggering. And the maturity and evolution of the industry continues. The NAA Education Conference and Exposition is the premier event in the rental housing industry…a record set-

ting 12,000 attendees from all over the United States and the UK attended, over 40 education sessions and keynote speakers were featured, and more than 400 exhibitors were present. Top ten thoughts on this year’s convention: There isn’t a crane swinging in San Francisco that is not building multifamily housing. Which brings into question why San Francisco is still a rent control city. At what point does a

changing at a rapid rate. Most of the trade show booths have evolved to little more than a number of kiosks with mounted tablet and software. The human condition is alive and well: booths that offer treats have more foot traffic than booths that don’t offer treats. According to industry experts: “42% of Multifamily leads receive no response.” Every piece of bread in San Francisco tastes fantastic. A convention held in San Francisco would not be the time to start a “No Carb” lifestyle. I spotted this trend last year and it continues: the evolution of our industry to a software, data based model…in all capacities…leasing, property management, utility management, key management, pet grounds management. current form and approved by the Governor, the measure will have broad impact on the worthiness of normal credit reporting on rental applicants for want of meaningful and verifiable information on past defaults in their financial and rental payment history. Existing law requires masking of UD actions for 60 days from the date of filing, and permanently thereafter if the defendant prevails within that period. The law encourages prompt action and settlement. AB 2819 shifts the burden to the plaintiff owner not only to prevail within or beyond the 60-day period, but also to carry the case to judgment by trial or stipulation. Getting the keys back is not enough under this bill. Here are several reasons why we continue to oppose AB 2819. • AB 2819 will unfairly keep a majority of all UD actions hidden from public view. Most property owners who get possession of their properties before a UD proceeding concludes do not go back to court for a judgment. They’ve already lost rent, and they’ve paid court and attorney fees to file the UD action. Because judgments will not be sought, thousands upon thousands of rent default records will remain hidden from public view. • Requiring property owners to obtain a judgment in order to unmask a UD proceeding only serves to promote more delays and frivolous claims. UDs are supposed to be expeditious proceedings, and one of the few

policies that encourage resolution is the masking law. Because proceedings become unmasked at the 60-day mark, parties are encouraged to settle or complete trial within that period. This bill removes the incentive to settle quickly, while encouraging the practice of lodging baseless and meritless claims to further delay proceedings. • Property owners use a tenant applicant’s credit history to be fully apprised of a prospective tenant’s fiscal responsibility. • Property owners have the right to know whether a prospective tenant is a serial rent defaulter or vexatious litigant. AB 2819 unfairly keeps rental property owners in the dark and from knowing the truth about prospective tenants. AB 551, the bed bug bill that has similarly been discussed repeatedly in these pages, was removed from the Senate Inactive File on the final day of the session before the July break. It is now poised for amendment on the opening days of August in a form that has not yet been completely vetted. Discussions with the author’s staff and supporters continue regarding the role of the PCO (licensed pest control operator) and the continued reference to a private association’s remediation standards that can be accessed only by its membership, i.e., you have to become a member of the association in order to get access to the full Monte. There are several other issues of continuing con-

cern that may be ameliorated by further negotiation on this measure before it is taken up on the Senate Floor. SB 7, the latest iteration of the water submeter bill, has been on the front, middle, back and front burners over the past several years. AAOC and others have been engaged with its subject for several legislative sessions. It was last formally considered on September 8, 2015, in the closing days of that session and defeated by a close 29 to 28 Assembly floor vote. A motion for Reconsideration was routinely granted as a courtesy and that is where the matter now stands. Various proposals for amendment have been floated recently and are under active discussion by many different parties. AAOC and others remain opposed but hopeful that several hurtful provisions can be eliminated from the bill. AB 2502, dealing with local authorization for inclusionary housing ordinances, has taken an unorthodox path to remain viable for consideration at its next step (whatever that may be) despite missing several deadlines for Assembly action to move it to the Senate. We continue to monitor it closely for its precedent setting application to the multifamily housing industry. I do the best I can, I fix most stuff myself, and contract out some, but it seems like some of my tenants are sabotaging the apartments. I’ve replaced the smoke detectors in one of my rentals three times in the last year. I know something’s up, what do I do?

operations and maintenance plan when managing and maintaining your rentals. Not only is it just good business sense to maintain your rentals properly, but also the law mandates your prompt response to complaints of serious habitability defects. It is critical to identify tenants who engage in damaging and destructive conduct. Q&A — continued from 10 damaged by the tenant. Several pieces of legislation have been enacted to crack down on the small minority of landlords who fail to properly maintain their buildings. Depending upon the severity of the defect, and providing that it is not tenant caused, a landlord may be cited by one of several governing agencies and given a period of time, ten to thirty five days to make the repairs. If the repair is not completed as required, there are provisions that would allow the governing agency to make the repair, and add the fees and costs of correction as a lien against the property. Additionally, legislation eliminates the tax benefits to the owner during the period of non-compliance, and in extreme circumstances, precludes an offending owner from demanding or accepting rent. Now more than ever before, it is critical that you document your repairs and identify the residents who are engaged in sabotage or other destructive conduct. My new tenants just moved in a month and a half ago. The lease requires that the tenant pays for all utilities, and must put the utilities in their own name prior to moving in. Well, I just received the electric bill, and it’s still in my name. I’m thinking about not

paying it, just letting it get shut off. Maybe when the lights go out, they’ll take care of it. Can I do that?

No, can’t let the utilities be shut off. Your tenant’s actions are a breach of the rental agreement, and must be addressed in compliance with California law. You should immediately prepare and serve a Notice to Perform or Quit- Breach of Covenant notice. The notice should identify the specific breaches, the failure to place the electric utility in their own name, and their failure to pay the utility charges incurred since taking possession. The notice should be specific as to how they must cure the breach, namely, they must put the utilities in their name, and reimburse you for the amount of utility changes that have been billed and incurred post tenancy. Note that some jurisdictions may require that you include a statement identifying a witness who observed the breach, as well as the date and time of the breach. In such jurisdiction, you or your manager would suffice as the witness, and the breach would be considered ‘ongoing’ as it continues to occur. In the event of noncompliance, you would be entitled to file an unlawful detain action to recover possession of the premises. Rarely though is that necessary, as the vast majority of residents will immediately comply.

I drove by my apartment building the other day and noticed that one of my tenants put up a satellite dish antenna, not just one, but three. I just put a new roof on about a year ago. This tenant had the nerve to bolt them right through the new roofing shingles. Looks terrible. I’m concerned about water leakage, mold and possibly voiding my roof warranty. Can they do that legally?

No. Your standard apartment association rental agreement most likely includes a provision prohibiting the tenant from making modifications or alterations to the premises without the landlord’s prior written consent. The tenant is in breach of the agreement and most courts would agree that the breach is a curable one. Depending upon the extent of the damage to the roof, the tenant’s conduct may rise to the level of waste, a non-curable breach. You have at least two options. First, you may remove the satellite dish antenna from the exterior of your building and repair the damage. You would then deduct the reasonable out of pocket costs from the tenant’s security deposit. You can then demand reimbursement by serving a three-day notice to perform covenant or quit by demanding that the tenant replenish the security deposit for the amount charged. Q&A — continued from 12 serve a three-day notice to perform covenant or quit, by demanding that the tenant return the premises to their original condition by removing the satellite dish and repairing any and all damage to the building. This option is not preferable because you do not want to instruct the resident to climb on your roof and perform the roof repair himself. Under either scenario, you would be well advised to document the breach by taking pictures of the unauthorized satellite dishes and the damage that was caused by its installation. Keep in mind, California law allows tenants to maintain a satellite dish antenna on their patios and balconies, within areas exclusively for the use of the tenant. These do not, however, give the tenant the right to affix an antenna to your roof or install an antenna in the common areas. I recently purchased a small apartment

building near the beach from an older couple who had managed the building themselves for many years. Nice folks, lousy bookkeepers. The rent roll I received in escrow appears accurate, but the names on the roll and the names of the tenants in their records don’t match. I think I’ve figure out who’s where simply by talking with and asking the tenants directly, but there are two apartments with very uncooperative tenants. They refuse to give me their names or answer any questions at all. They just say, “Call my lawyer”. The first of the month came and went and everyone paid except these two units. What do I do? Can I evict if I don’t even know their name?

Sure. Since your rent roll is apparently accurate, and you know the terms of the agreement, you should immediately serve a three-day notice to pay rent or surrender possession. Simply list the names as John and Jane Does 1 through 10. The amount demanded would be the amount reflected in your rent roll as the rent due for that unit. When the

rent is not forthcoming within the three days, then the eviction may be filed. Your attorney will simply name the defendants as “Doe” defendants. You will want to serve a “prejudgment claim of right to possession” notice along with the complaint to “flush out” any and all occupants and avoid the third party claim of right to possession (the old Arietta claim). The court will generally require a complete physical description of each “Doe” defendant judgment that is entered. Your attorney’s process server takes care of that for you. The eviction itself is no different than any other ordinary eviction. If you ever do learn of the tenants’ correct names, the judgment may be emended to replace the Doe name with the defendant’s true name, which will allow you to collect the money owed. Make sure you take a picture of the soon to be ex tenants and keep it in your file. It will aid you in collecting from them when you learn Q&A — continued on page 30

t is July which means beach time and boat drinks, summer camps, lots of seared proteins and of course the 2016 Presidential Nominating Conventions. That last one was on your list, right? Maybe that is just for insidethe-beltway nerds like yours truly. Though with all of the media coverage of Donald Trump these past 12 months, one would think it was on everyone’s mind. The networks might even devote more than the usual one hour of prime

time to the conventions just in case something interesting occurs. One thing Mr. Trump seems to always deliver is something interesting. The most recent conversation around Mr. Trump is whether his particular brand of populism is made from the same formula as that which fueled the “BREXIT.” It would appear that the two flavors share at least some ingredients — anti-establishment, anti-elite and desire for more “control” of the

nation. There are also anti-immigrant tones in both movements though the narrative driving each is different. Federal Focus — continued from 16 certainly must be some self-reflection taking place in that party as they move to select a new leader. Would the election of Donald Trump to the Presidency be the equivalent in scale to the BREXIT? It’s safe to say that because he is such an outsider and not like nearly any candidate with a 50 percent chance to win the White House, the election of Donald Trump would be a very significant event. Depending on who you are, the shock of that actually happening and the potential long-term implications are probably of equal significance to the U.K. departing the European Union. At that point are we looking at a world-wide movement? Should all elite institutions and institutional players be worried for their future? That certainly is possible. It has even been suggested that globalization itself could be on the decline. Stopping expansion of global trade is unlikely but events like the BREXIT and the

election of someone like Donald Trump to the United States Presidency could change how that trade is carried out. The referendum on Donald Trump occurs in four months, but remember that there are 535 other federal policymakers who also hold our future in their hands. Even if he wins, Mr. Trump is not sitting atop the iron throne ruling as he sees fit. He must work with the Congress to advance much of his agenda (Sidebar: if we have learned anything from the current administration, it is that the President can in fact do a lot without Congress). The House and Senate play the critical role on policymaking in this country and we need to make sure they are equipped with all of the information to make good choices. Members of the apartment industry should be thinking how and when to get some time with their member of Congress between now and Election Day. How about a property tour at one of your communities? Or, a sit-down with a small group of members just to

catch up on what’s happening in apartments in the local community? Is there a town hall meeting or other event with the member coming up? Any one of these is a perfect opportunity to educate the member of Congress on you, your business, your employees, your residents and the apartment industry overall. How do I get a fiberglass tub clean without scratching the surface? John

Dear John:

The nice thing about fiberglass tubs and showers is that no matter how dirty they get, they are fairly easy to clean up. Be careful not to use any abrasives on the fiberglass, such as scouring pads, steel wool or gritty cleaning solutions. “Soft Scrub” may be used sparingly on soap scum buildup. “Lime-Away” may be used for hard water mineral deposits, but read the directions and look for the fiberglass warning or approval statement. If you have very tough stains, moisten a cloth with clean Acetone solvent or nail polish remover. Do not let the Acetone pool as it may soften the fiberglass material. Acetone and many other cleaners have very strong vapors, so it is important to ventilate the area properly. After all the cleaning is done, the fiberglass surface may be dull. Use a fiberglass conditioner and glossing paste to bring the tub or shower back to its original condition. You can use a product called “Gel Gloss” to bring back the shine. To Train or Not to Train? This Shouldn’t Even Be a Question.

I

n my many years of Property Management, I have discovered that there are two camps with differing philosophies regarding continuing industry training. The first camp seeks out training with the belief that it is valuable and beneficial; not only for the employee, but the organization as well. The second camp believes that training is a waste of time and resources and avoids it. Unfortunately, the second camp seems to be in the majority. While most Directors of Property Management and Regional Managers fall into the first group, they often work for a member of the second group.

Costs vs. Benefits of Training

Training costs are directly measurable. For example, sending an employee through an association sponsored training program will incur tuition costs, possible travel, and time away from their site. Let’s not forget the employee’s wages while attending the course. And, perhaps overtime or additional work

load burdens for the other employees. Having a trainer come to your organization will also incur costs. The speaker will have a fee as well as material costs. Bringing everyone together will cost mileage dollars and refreshments. Not to mention closing the offices down for a few hours and the possibility of missing that cherished leasing opportunity. There is no question that training can be expensive. But with proper planning and budgeting, the cost can be reduced. The real question to ask is “What is the cost of liability if the team is not receiving training?” The benefits of training are easily measureable. For example, I have numerous clients tell me that leases increased the same afternoon as a morning leasing session, or the closing ratios improve dramatically. Customer complaints decrease after training, and employees tend to be more cautious about Fair Housing once they have proper understanding of the laws and guidelines. The right training can increase an employee’s motivation and enthusiasm.

Continued, regular training will increase productivity, team morale, selfconfidence, sense of importance, and communication skills amongst your team. In these times of economic uncertainty, when most companies have suspended salary increases or implemented staff reduction, training should be viewed as a reward for continued employee loyalty. If training is marketed correctly as an investment in the employees, your team will be excited to attend and see this as an additional benefit to them.

To Train — continued from 26 a Fair Housing law suit? What is the cost of apartments sitting vacant because your staff does not understand the concept pre-leasing? How much does your Worker’s Compensation insurance increase due to injuries that could have been avoided with proper training? What is the cost of defending a sexual harassment claim, or a wrongful termination? Each one of these scenarios has the potential to cost your organization thousands and thousands of dollars. Proper staff training can save you money due to increased knowledge and professionalism; not to mention decreased staff turnover. “We don’t have time.” I hear this often enough to wonder if trainers are the only ones who have time for training! Property Management has its own monthly timeline that we all understand. Training should be scheduled after rent week, not on Monday mornings, and not on the day of month end for account-

ing. Yes we have renewals, inspections, move outs, move ins, bills to process, resident issues to address, and turnovers to complete. But each of these tasks can be scheduled around training. Try seeking input from your front-line team to determine the best time to schedule training. It is not okay to have our teams performing below standard or being assigned tasks that they do not fully understand. Taking a little time to show them the correct procedures will make their time spent on the job much more productive and therefore saving precious time. Not making time for training could prove to be costly to your organization. “We can’t afford to have our team away from the property.” Understandably, closing the office may not be realistic right now as no one wants to miss a potential lease. There are other options to employ; such as having two sessions in one day and alternating employees so the office remains open. Or, have staff participate in an on-line

course or webinar. Blended learning opportunities, (offering both live and on-line training) has proven to be very successful as employees get a global perspective of the topic. “Why do we need training when HR or a Manager can handle some teaching?” Your in-house experts are indeed valuable to your organization and they should be involved with training company policies and procedures. But what if they have not been brought up to speed with new laws? Or what if their work load is too heavy to expand into training? Even if you have an inhouse trainer, sometimes the message needs to be heard from an outsider who is not entrenched with the various personalities and histories of employees. ustomer service and customer experience is a topic of much discussion in today’s marketplace. As our marketplaces become more competitive and our rents continue to increase, the expectations from our resident — both current and future — continue to go up. Residents want their interactions with property management to be simple and easy. No one wants to do business with a “hassle brand”. From your website, to communication from and to the office and even encounters on the community grounds, your residents want less “friction” in their encounters with you.

One of the great examples of the simplification of customer experiences in Uber. The car sharing brand continues to achieve unprecedented growth due to the simple, easy to use process that is provided to customers. Three clicks of an app is all it takes. Reviews of both Uber drivers — as well as Uber customers — are easy to access. Here are 5 easy ways to reduce friction: 1. Phone: No customer wants to fall victim to the phone queue of death. Hours upon hours of “press 1 for this” and “press 2 for that” are enough to drive anyone crazy. Some apartment management companies have outsourced a call center to ensure that calls are answered by


a friendly voice. But, when dealing with the call center associate on the other side of the phone, customers may be on the receiving end of an ear who only knows the script that is in front of them.

True success comes from the person who promptly picks up the phone and has an honest conversation with their customer. Residents want to be able to call on their schedule, and want to feel like the person on the other side of the phone is listening and really, truly cares. Try answering the phone “My name is Pete — I can help you!” Easier to remember if you use your own name, but you get my point.

2. Email: The same philosophy is true when it comes to email. Customers are tired of getting the same generic email template that just has a couple of fill in the blanks created to give the sense of customization. Today’s renter is smarter than that. They

want nearly instant replies for their correspondence to you and they want the reply to be simple, clear and engaging. Remember, most of your customers are busy and communication from you should never be seen as a challenge in their otherwise complicated lives. 3. In-Person: Distractions are the enemy of the in-person connections you have with residents. The person in front of you (yes, even that “one resident”) needs to feel that they have your complete attention. Allowing them to see you taking notes about your conversation — even if you have a great memory — sends a sign that you are engaged and focused on their needs. Don’t be generic and homogenized in the service that you provide them. Prospective residents will often visit five to seven apartment communities before making a final decision. Make sure that the service you provide is

both unique and memorable, so that you are not remembered as just another apartment community. 4. Retaining Residents: So often residents feel that, once they have moved in, you have forgotten all about them. The attention that they received during the initial leasing process is replaced by an absence of interaction. They may never even hear your voice unless they call the office with a maintenance request. People would almost always rather live in a place they feel connected to. Make sure to remember the occasions that they celebrate and celebrate them. A 99-cent card signed by the office team delivered to them on a birthday, anniversary or other special day is a simple way to let them know they are remembered and valued. 5. In an age of instant gratification and digital engagement, the people who will stand out the most are the ones who follow-up the fastest and using the methods that a customer prefers. Text rules the day, with social media sites

coming in a close second. Photos and videos are available via smart phone during the tour — and as a vessel for you to make a memorable follow-up statement. In every circumstance, make sure to do what you said you would do and be timely doing it. Just this basic level of customer service is often forgotten and it is a great way to make sure your customers have less friction in their encounters.

chieving financial independence is basically a universal goal held by almost everyone. The problem is that the term is completely misunderstood. And, even fewer people know what actions are needed to achieve this goal. Most individuals believe that financial independence means not having to rely on others as their source of income. As children, many of us received an allowance doled out by our parents for chores completed. Later we took jobs where we relied on the owners or our

bosses to make sure that we got paid. At one time or another, almost every worker has wanted to be his own boss and not to have to rely on others. Those who choose to invest in real estate and, particularly in income properties, are well on their way to attaining financial independence. Yet, when pressed to define exactly what they mean by this term, very few of apartment owners can give you a specific answer. Many see their income properties as providing a tax shelter or, if they have been owners for a long time, a source of

Yet not one of these answers truly reflects the meaning, and more importantly, the value to be found in achieving financial independence. In my book, Cash In on the Myths of Real Estate, an entire chapter is devoted to the philosophy of investing. Defining financial independence is one of the principles of successful investing that I address.

8-2 People understand what it means to be financially independent. Popular Belief: Substantial net worth and/or income are the source of financial freedom. Bill’s Truth: Net worth does not necessarily translate into cash flow. On top of that, some owners become so tied to the demands of their properties that they are never able to take time to enjoy the fruits of their labor. You may want to structure your real estate holdings to provide a better cash flow and/or more leisure time. The amount of time or money differs with each individual and may change as personal circumstances change. The true measure of financial freedom is the ability to live your lifestyle (home, vacations, hobbies, schooling, etc.) to the fullest extent, while feeling completely secure about your financial position. You need to establish your goals for financial independence in very specific terms and those desires should serve as the driving force behind your financial plan. How you formulate and handle your real estate plan is very apt to play a major role in this process. Cash In: Set your goals for what you want in terms of financial freedom and make achieving those goals your passion.

Stop and Think before you Sell… How do I Prep My Building for Sale?

This is a common question that I’ve encounter over the years from owners looking to sell their apartments. In my experience be mindful of some of the financial missteps investors make. Typically, I would advise against putting money into an apartment building if you intend on selling the property. The income you are generating from the property has been taxed, if you put after-taxed money back into the property you will be taxed on the income and/or proceeds a second time at some point in the future. Nobody likes being taxed twice! Another reason why I advise clients not to put money into apartment buildings prior to sale is that you as the Seller are guessing what the Buyer will want. You may make the mistake of identifying an item to be repaired that may or may not have an impact on the buyers’ decision on purchasing the property. For example, you pay $50K for a new roof because you believe the Buyer would want a new roof. Imagine the Buyer says they could’ve bought the same roof for $30K and they only want you to pay $15K of it because they will get most of the use-life. You may realize from this example that once you start guessing you lost. You are no longer negotiating from a position of power. If you are heart-set on making repairs to your property prior to sale I do recommend that the “Major Systems” be inspected. A thorough inspection of the roof, electrical, and plumbing, as well as, inspection of “health & safety” items would be critical prior to listing your property for sale. Make repairs that will have a positive impact on rents. For example, you may decide to paint the property blue with the assumption that it will increase the value but the rents didn’t increase. I have real-world experience with a client that will overlook the new blue paint because all their buildings in their portfolio are yellow. As part of their brand they repaint new property acquisitions to meet their color scheme. You have just wasted $10k.

To maximize your property’s exposure to the most qualified buyers takes a thoughtful and unique strategy. A common misconception many owners have is that any licensed

real estate agent can sell their commercial property just by “throwing” their property on the internet or postcard and that’s sufficient enough to generate their desired results. That is simply not the case. Yes, internet marketing and postcards are a component of the process of selling a property but it’s not the only action required. How you came to own and operate the property is unique and no transaction is the same. Your Broker should be able to create a clearly defined marketing strategy tailored to your specific goals and expectations. This may include several targeted digital and print media outlets but also your broker’s relationships within the marketplace is just as important.
