Time Flies When You’re Having Fun

A

busy March and April just flew by at AAOC and fortunately (or unfortunately) for me, my beloved UCLA Bruins were nowhere to be found in March Madness and so I had plenty of time to dedicate to my next favorite pastime: the apartment association. Between our record setting trade show that drew more than 1,200 attendees and our fly-in visit to meet with State legislators in Sacramento, we

Copeland, Brianna Macias, Gissel Cuevas and Debbie DiBernardo did a world-class job in orchestrating our 45th annual tradeshow. The speakers were exceptional, the exhibitors were best-in-class and the atmosphere was electric. Walking the tradeshow floor, I was stopped several times by members and vendors who complimented us on the success of the event. Well folks, it’s all a result of our wonderful staff ’s

were able to fundraise and advocate for our association with force. Forming new relationships and reinforcing those already in place with members, vendors, legislators and their staffs helps us to continuously perform at a level superior to other associations. We’ve got a solid bunch in Sacramento and are the envy of many other associations who aren’t as close with their elected officials. We are fortunate to have allies who are pro-business, pro-property rights and interested in our cause. What’s more, our legislators understand our dual roles as business owners and housing providers. Being able to meet with elected officials like Young Kim, Travis Allen, Bob Huff, Janet Nguyen, Ling Ling Chang, Tom Daly, John Moorlach and others, asking for their support on bills or issues while knowing that they are willing to go to bat for our cause is

crucial to our success. Come November, be sure to look out for and support the candidates who support us. I

f it is spring time, then it is the time of year when the Apartment Association of Orange County and its Legislative Committee head north to Sacramento. And that was the case, this past month when I had the pleasure of leading our association delegation in our Annual Sacramento Legislator Fly-In, held at the California State Capitol. So much of our multi-family housing industry is affected by laws and regulations coming out of the offices of our State Assembly member and Senators. This year’s agenda reflects that reality. With the help of Apartment Association of Orange County and Lobby Team of Jon Smock and Ron

in economic activity. That economic footprint supports an estimated 950,000 Orange County jobs. The organized meetings took us through 18 legislators’ offices and we offered our detailed and thoughtful opinions of the bills at hand. The face to face sit down between rental housing industry partners and elected lawmakers of the state legislature, literally in the state Capitol in Sacramento has value, and I believe our collective voice was heard. Orange County California is truly a political mosaic and always results in robust debate, fierce campaigns, and sometimes, even compromise.

Kingston, whose monthly column appears here in Apartment News Magazine, we were able to meet with 18 members of the State Assembly and State Senate from Southern California. In addition, we had added support with the attendance of our sister organizations though our affiliation with the California Rental Housing Association (CalRHA) and the National Apartment Association (NAA). Both organizations send emissaries to assist us in Sacramento. Our legislative team offered the reminder: the Apartment Industry in the OC remains a vital component to the overall economy: there are over 545,000 apartment homes in Orange County which translates into $38 billion

The policy issues selected by the group for discussion included three bills of significant detriment to the rental housing industry that were culled from a longer list of other bills

of concern. And another two bills that deal favorably with unlawful detainer reform were added to the mix. The limited time legislators make available for this activity in Sacramento is constrained by many other responsibilities involving committee membership and ongoing hearings on their own bills. Hence, a few minutes with each legislator to hit the high points on a few bills is about all one can expect. Legislators meet regularly with a variety of constituent groups to discuss many diverse issues throughout the year. We commend all of our legislators and their staffs for being gracious with their time and attention to the positions articulated by the group. Why these particular bills? On the positive side, the unlawful detainer process has deteriorated from expeditious recovery of possession to a costly and ugly extortionate slugfest. Reform of some kind is overdue. For the negative bills, it is a choice of picking in relative terms a few really, really awful bills from among several other bad bills that affect the housing industry. The order of magnitude or severity of interest is subject to debate. Pick your poison. There also is the issue of scope, that is, are rental housing providers targeted alone or just swept up in a larger universe? And, if we are the targets, how pervasive is the circumstance? Also, can our position be explained and easily understood without lengthy commentary? With these characteristics in mind, consider the Smock/Kingston — continued on page 10

five primary measures targeted for discussion this year. Assembly Bill 2003 and Assembly Bill 2312 enjoy widespread industry support for at least raising before the Legislature the obvious deterioration of the court process for recovery of possession in “non-pay” unlawful detainer cases. Both deal with forms and procedures designed to assist the courts and parties in more expedient and transparent resolution. AB 2003 would require early disclosure of more detailed information regarding habitability claims if raised in defense and permit lessor entry to the premises to correct any alleged habitability issues. It also would prohibit the parties from requesting a change of venue if the court selected for trial is nearest the location of the property in dispute. Also, it would require modification of appropriate Judicial Council forms to reflect these changes. (The bill was

defeated at its first hearing before the Assembly Judiciary Committee on April 5, 2016.) AB 2312 would require, in UD non-pay cases where the defendant is represented by an attorney, periodic confirmation by the attorney that future rent obligations as they may become due are or had been placed in the defense attorney’s trust account as a condition for contesting by jury trial a typical nonpayment UD case. (The bill at this writing is pending hearing in the Assembly Judiciary Committee.) Assembly Bill 2502 (Mullin) would authorize local governments to establish price controls on new developments, as a condition of development, which require the provision of residential units affordable to, and occupied by, owners or tenants whose incomes do not exceed the limits for lower income, very low income, or extremely low income households as specified in the Health and Safety Code. The bill seeks to validate below-market housing set-asides and nullify the effect of the

seminal Palmer decision that successfully challenged the efforts of the City of Los Angeles to impose these adverse conditions. (The US Supreme Court denied hearing on an unsuccessful facial challenge to a similar San Jose ordinance dealing with on-site belowmarket set-asides for low-income persons in for-sale residential developments.) The operational effect of longterm (e.g., 55 years) price controls via “inclusionary housing” is viewed by many as even worse than rent control. (The bill at this writing is pending hearing in the Assembly Local Government Committee, with a hearing scheduled for April 13.) Senate Bill 1053 would require all rental property owners to participate in the federal government’s voluntary Section 8 voucher program. The federal Section 8 housing program provides financial assistance to qualified lowincome tenants through a voluntary contract mechanism that provides direct payment to owners of a portion

of the rental obligation. The bill would alter the definition of “source of income” so as to encompass the voluntary Section 8 voucher program as well as any other public or private assistance program for low income tenants. The practical effect of this measure is to mandate contracting with third parties under a variety of different circumstances and different programs. Enforcement of the mandate is through CalFEHA, the principal anti-discrimination statutory scheme. It is opposed by virtually all private housing providers. (The bill was approved by the Senate Judiciary Committee at its first hearing on March 29, and sent to the Senate Appropriations Committee.) Assembly Bill 2819 would modify the “60-day masking rule” dealing with closing public access to court actions involving unlawful detainer (eviction) cases. The measure would provide that UD court records remain closed to public access indefinitely thereafter unless the property owner prevails and presents the appropriate paperwork to close the case by judgment or stipulation of all parties. The bill would hide from public view and keep from owners and other credit providers important information regarding fiscal management of applicants for credit. (The bill is pending hearing in the Assembly Judiciary Committee, with a hearing scheduled for April 12.) These are the most prominent bills of interest that have surfaced in this session and about which much will be written and discussed, including a need for active member involvement in and timely responsiveness to RED ALERTS as they are promulgated.

Proper tenant screening starts with a completed application, not one you buy at the stationery store, but the one provided by your apartment association. Identity theft has been a growing problem for years. Landlords have increasingly been victimized by prospects posing as someone else, using false

or fraudulent information. Often, these thieves take advantage of a desperate landlord, eager to fill a vacancy, or a newbie landlord who hasn’t gone through the school of hard knocks yet. Completed and signed applications by all adults are a must. Verify the information provided. Personally inspect some form of U.S. government issued photo identification. Make a photo copy of the ID and keep it secured with your file. Verify that the social security or the tax ID number provided by the prospect is actually his number, and is valid. Contact your apartment association and request that they run a credit report and eviction history report. Understand that the data in these reports is not

Know that these are merely tools that you must utilize, just know their limitations. If practical, go outside to the prospect’s vehicle, and verify that the license number on the car he just drove matches the license number he just wrote down on the rental application. Many ‘hands on’ owners will actually visit the prospect’s current residence unannounced, prior to approval to ensure the prospect actually lives there, and doesn’t just sleep on the couch. You’d be amazed at what you’ll learn by a simple visit. A visit about dinner time is generally the most productive, you get to see the prospect with all his friends, family, buddies, a real snapshot of how he’ll act in your building. The car parked on the lawn will be parked on your lawn if he’s approved. If no one is home, talk to the neighbors, they

will certainly share their opinions! Inform all prospective applicants that you have a policy of taking a picture of all residents. Follow through with this policy, and when you meet to sign the rental agreement, actually take a picture of all proposed occupants and keep the picture in your tenancy files. This is one of the simplest and most effective tools that keep the drug dealers, identity thieves and gang bangers out of your building. Bad guys don’t want their picture taken, and will not want to live in your building. They won’t even submit the application. When verifying employment and residency, ask for a description of the person, and compare the description with the person who filled out the application. Don’t trust the phone numbers provided by the applicant; independently verify them through the internet, or phone book. Don’t be afraid to inquire as to whether or not they have a pet, or if they smoke. You may not get an answer, but you won’t

know until you ask. Ask for original bank statements, utility bills, electric, telephone, cell phone, cable, anything with the prospect’s name. Ensure that you establish minimum tenancy criteria, and apply your criteria consistently to all. 1) verifiable and positive credit history, 2) verifiable and positive tenancy history, 3) sufficient and verifiable income to ensure that the prospect can meet his future financial obligations, and 4) not pose a threat to persons or property should be required of all successful applicants. Contrary to the fair housing advocates, you don’t have to rent to undocumented persons, or others that don’t have verifiable identification or a verifiable social security or tax identification number. Q&A — continued from page 14 market, it’s tempting to relax standards, to rent to those that really cannot be ‘properly screened.’ Many landlords have looked the other way, in favor of the quick rental, the cash payments, the full building, the reduced confrontation; many have taken the easy way out. Landlords have been wary of lawsuits claiming discrimination, and have believed the bullying taunts and threats from the tenant and immigrant rights activists, and have taken the easier and less confrontational course. We blame our government for not addressing the illegal immigration issue; one side of the aisle wanting cheap labor, the other wanting cheap votes. We blame employers for hiring, and our ‘welfare state’ for creating the magnet that keeps drawing. Landlords are part of the problem as well. By succumbing to the short term temptation of the quick rental to the unverified, the undocumented, we

Federal Focus — The NAA Connection BY GR EG BROWN

N

early 50 years ago, President Lyndon Johnson signed into law the Civil Rights Act of 1968. Title VIII of the Act contains what we commonly refer to as the Fair Housing Act. This law, along with amendments passed in 1988 and 1990, protects individuals from housing discrimination based on race, color, religion, sex, national origin, disability or familial status. As a result of this

Court decision in Texas Department of Housing and Community Affairs v. The Inclusive Communities Project, Inc. confirmed this concept as a legitimate extension of fair housing and paved the way for expanded investigative activity. One of the highest priority areas for these investigations is resident screening, especially criminal background checks. Events this April illustrate exactly how fine a point has been

placed on this aspect of the rental housing application process. The Lawyers Committee for Civil Rights Under Law, according to an April 4 news release, has “…opened a nationwide inquiry into owners who impose blanket bans upon applicants who have had contact with the criminal justice system.” Thirteen housing providers across 12 states have been targeted in particular by the Committee in this “phase 1” action for allegedly using screening policies that bar anyone with a criminal history from obtaining housing. The Committee is a nonpartisan, nonprofit entity formed in 1963 at the request of President John F. Kennedy. The second and perhaps more significant event in April related to fair housing and resident screening is new guidance issued by HUD’s Office of General Counsel entitled, Application of Fair Housing Act Standards to the Use of Criminal Records by Providers of Housing and Real Estate-Related Transactions. This guidance places specific parameters around how housing providers can utilize criminal histories in their resident screening processes. NAA, along with our partners at the National Multifamily Housing Council, will issue explanatory material in the coming weeks to help owners and operators navigate the guidance.

ing of how an apartment owner and operator should design their processes to comply with fair housing rules is not isolated to resident screening. Preconceived ideas are being challenged in the areas of familial status, occupancy standards, source of income and many others. NAA, our affiliated associations and our members are all grappling with these changes and trying to draw a clear picture of this new world. I suspect it will be some time before that clarity emerges. In general, the HUD guidance seeks to end blanket exclusions of prospective residents based on criminal history in favor of a more individualized approach. Specifically, it prohibits the use of arrest records alone to deny residency and denials based on convictions must consider the nature and severity of the incident. Evaluation of resident screening policies will follow the “burdenshifting” test HUD created in its 2013 Final Rule on the “Implementation of the Fair Housing Act’s Discriminatory Effects Standard.” Not surprisingly, the HUD guidance raises a number of questions about how apartment owners and operators will be able to maintain the critical balance between meeting the goals of fair housing and adequately protecting their residents, employees and property from criminal activity. This is especially complex in light of state and local laws which in some cases create strong disincentives for owners to rent to those with criminal histories. Moreover, while the guidance establish general parameters, it does is not specific about which policies will pass muster and which will not. This leaves owners and operators in the position of trying to thread a very fine needle to stay on the right side of fair housing law. Changes to long-held understand-

ear Maintenance Men: I have a hundred gallon waterheater serving seven units. The residents are complaining about a lack of hot water and sand coming out of the faucets and shower heads. The heater seems to be working normally. What would cause sand to come out of the lines? Johan

— Turn off the gas supply.

Dear Johan: Your water-heater probably needs the calcium build-up removed from inside the tank. If your 100-gallon water heater is a commercial unit, you should find a clean out port at the bottom of the tank. Determine the tank manufacturer and purchase a new gasket for this port. Most plumbing supply outlets will have these in stock.

— Turn off the water supply to the tank — Drain the water heater completely. — Remove the clean out port. Some have a series of bolts, others have only one big nut to remove. Once you gain entry into the interior of the tank, you may see white or yellow sediment on the bottom of the tank. If the tank has not been cleaned out regularly, the build-up may be significant. A hammer and chisel may be necessary to remove the more stubborn areas. This is also a good time to check the anode rod and dip tube (note: if your dip tube is damaged it can prevent the cold incoming water from reaching the bottom of the tank and being heated.) If either is damaged or eroded, check with your plumbing

After completing the tank clean out, be sure to check all the faucet spout screens and shower heads to remove any acummulated debris. After all the work is completed, reinstall the port opening and always use a new rubber gasket. Your tank should work much more efficiently and cost less money to run

while supplying more hot water. This clean out procedure should be done at least once a year.

Dear Michael: Water is a funny thing and tracking down leaks sometimes takes a bit of detective work. The first thing we would check is the roof. As you stated, the roof is new, but sometimes the odd flashing does not get caulked and the water finds its way down the side of a pipe, valley or junction area. Have your roofer, double check all the flashings. Another issue to look at, is water pooling around the foundation. If you have cracks in the foundation, water will find its way in. Be sure to clear any debris, dirt and leaves from around your building or anything that will cause a water dam effect. Overgrown or old landscaping can contribute to leaks by trapping water or redirecting water to the building instead of away from it. Inspect the building’s stucco for cracks. We have seen small cracks in the stucco suck in large amounts of water. Pay close attention to the stucco between floors or on the edge of balconies. Balconies shed a lot of water which may cascade over the edge and flow back into the stucco where a hidden crack will allow the water to enter. If you have aluminum windows, check the weep holes that allow water to drain out of the window tracks.

Dear Maintenance Men: During the recent rains, my building started leaking. I was surprised, as the roof is less than a year old. The odd thing about the leak is that it is only affecting the downstairs units. What is going on and how do I solve this? Michael

1. Most rental agreements have a check box that says the resident is responsible for the operation of the smoke alarm. The newest rental agreements now have a check box for Carbon Monoxide alarms. The smoke and Carbon Monoxide alarms should be “Officially” checked and logged, at least once a year. Typically, January is a good month for the annual check. 2. A typical 100-gallon water heater depending on the BTU rating will costs anywhere from $1,800 to over $3000.00 installed. That cost alone should be incentive to clean out your heater regularly. Normally, the clean out should be done at least once a year. If the water at your building has a high mineral content, then it should be cleaned out every nine months. Again keep a log of each clean out; it will help in remembering when to do the next cleaning.

3. If your building has forced air and heating, the filter should be checked, cleaned or replaced each October or November and each May or June. This will help keep your systems working properly and reduce strain on the components. It will also ensure proper filtration before the winter and summer workloads.

HUD Rules Against Using Arrest Records BY RYAN GREEN

T

he Department of Housing and Urban Development (HUD) issued new guidance on April 4th, 2016 that is going to require all single-family and multifamily rental professionals to revisit their policies. In a decision that is aimed at protecting the rights of “returning citizens”, HUD is limiting the use of arrest records in tenant screening nationwide for both public and private housing. While they are not discouraging the use of criminal records in the

or practice of excluding individuals because of one or more prior arrests (without any conviction) cannot satisfy its burden of showing that such policy or practice is necessary to achieve a substantial, legitimate, nondiscriminatory interest. 25 As the Supreme Court has recognized, “[t]he mere fact that a man has been arrested has very little, if any, probative value in showing that he has engaged in any

background screening process, they are requiring a conviction be reported for the record to be considered in the decision. Using an arrest record without a conviction is being viewed as discriminating against a consumer who has not been found guilty of having done anything illegal. An arrest shows nothing more than that someone probably suspected the person apprehended of an offense.” 26 Because arrest records do not constitute proof of past unlawful conduct and are often incomplete (e.g., by failing to indicate whether the individual was prosecuted, convicted, or acquitted), 27 the fact of an arrest is not a reliable basis upon which to assess the potential risk to resident safety or property posed by a particular individual. For that reason, a housing provider who denies housing to persons on the basis of arrests not resulting in conviction cannot prove that the exclusion actually assists in protecting resident safety and/or property. What does this mean? In your rental policy there should be clearly defined requirements for an applicant to be approved to live in your

The new guidance does not go so far as to make criminals a protected class so you are still completely within your right to deny applicants that violate the criteria above. However, more than ever before, you have a burden of proof requirement. In order to safely depend upon making a decision involving prior convictions, you as the housing provider, must be able to prove that your policy clearly excludes

• Violent crimes, which would include any convictions with the use of firearms, • Crimes of a sexual nature, • Crimes against property or persons (such as arson and theft), and, • Convictions of drug manufacturing or distribution. The use of ambiguous language or blanket statements such as, “a felony is an automatic denial” will get you into trouble. The new guidance clarifies this requirement as: A housing provider with a more tailored policy or practice that excludes individuals with only certain types of convictions must still prove that its policy is necessary to serve a “substantial, legitimate, nondiscriminatory interest.” To do this, a housing provider must show that its policy accurately distinguishes between criminal conduct that indicates a demonstrable risk to resident safety and/or property and criminal conduct that does not. HUD’s new requirements may seem like a big change at first, but it can be

very misconception discussed in my book, Cash In on the Myths of Real Estate, is derived from my more than 60 years as an investor, broker, and past AAOC president. I, myself, have fallen prey to many misbeliefs. However, careful study and experience have taught me a different truth. And, for every truth, I have found a way of using the knowledge

of taking advantage of one of the remaining tax breaks allowed when selling your home. This month, I am addressing a common problem for all of us — that of doing nothing. Although perhaps never before articulated as such, I have phrased this as a myth and included it in my book.

Myth 5-5 Doing nothing is an option. Popular Belief: People often believe that by not taking action, they are maintaining the status quo and enjoying greater comfort and security. Bill’s Truth: Failing to act can be more risky than taking action. Most people do not recognize that no action is an action in and of itself. On a regular basis, even though everything is proceeding smoothly, you should review your real estate plan and check that each property is achieving the objectives that you want. Even if the decision is to do nothing, the analysis process helps to get you mentally and emotionally prepared to take action when you need to do so.

My favorite coffee mug states: “Impatience is a virtue” and I drink from it daily. Be sure to watch for various trigger points within the market as well as within your own life. Trigger points represent critical times at which you should review your portfolio and take a look at all of the options. Missing an opportunity, especially at a time of market change, can be costly. Cash In: Doing nothing is an option only after you validate that doing nothing is the right option.

People like to say that “good things come to those who wait”. What they don’t tell you is that those who wait are the ones who get the leftovers.

When the market is really bad, investors often do nothing because they are caught up in the panic of the moment. They are like a deer in the headlights. Yet one of the best ways to mitigate fear is to delve into the options and quantify the possible outcomes. On the opposite side of the spectrum, when the market is good, owners become complacent. They happily focus on their current cash flow, rather than looking at the long-term consequences of not taking action. I often talk about compounding as the Eighth Wonder of the World. It certainly is one of the key tools for wealth building. Missing opportunities to take advantage of value premiums can dramatically impact the overall return on investment that an investor is able to achieve during his or her lifetime. What may be even worse is when an investor waits too long — either because of avoidance, analysis paralysis, or greed. When there is a trigger point, be it something that occurs in your own life or the result of a change in market conditions, you need to be prepared to act quickly and decisively. This can only happen by consistently knowing and quantifying your options, as well as by understanding how your choices will affect your goals. Which brings me to another very important topic — a written real estate plan. It’s so simple, why write it down? Find out next month!

kills and techniques are important in providing excellent service to customers, but they aren’t the only keys to success. Leading organizations have identified seven traits they see in their highest performing service providers. We call the seven traits The Service Mentality. These characteristics create a mindset for serving customers. Let’s look at each one. 1. Empathy is the capacity for

It’s not wildly over the top, but it is energetic, positive and openly expressed. Your enthusiasm influences your effectiveness in a service position, because the appropriate enthusiasm determines how the world sees you as able or willing to help. Enthusiastic people enjoy helping others and show it

understanding, being aware of and sensitive to the feelings, thoughts and experiences of your customers. They want to know they have been heard and understood no matter how large or small their problem. They want to know that you see the problem from their point of view. A caring, empathetic tone, more than words, allows the customer to hear your concern. Customers don’t care what you know until they know that you care.

with a positive attitude and high energy. They enjoy being proactive and going the extra mile. 3. Ownership is about having the commitment to solve a problem. It’s the opposite of the mentality that says, “That’s not my department,” and then shifts the resolution off to someone else. Ownership makes a clear connection with the customer that says, “I am your partner and own this situation with you,” which more effectively represents you and the company. It shouldn’t take two people to give good customer service. Step up and take ownership of the challenges that come your way. 4. Responsibility involves living up to commitments. This trait relates just as easily to your co-workers as to your customers. In every case, it’s critical that we live up to our commitments. Colleagues need to know they can count on each other to be on time for a scheduled shift or meeting. A co-worker who can’t be counted on disrupts everyone’s schedule. Ill will and stress is a chain reaction that can radiate outward until service mentality slips among team members. As they saying goes, “There is no I in the word team.” Follow-through and dependability demonstrate a service mentality of responsibility. 5. Adaptability is having an easy flexibility to deal effectively with different types of customers and situations. As your customer base becomes more diverse, adaptability is crucial. Aging populations, language and cultural differences and related factors are challenges to providing excellent service, but people who are adaptors are accepting and tolerant. Their mind-set is evidenced by their ability to adapt and to respond and react positively. With the service mentality trait of adaptability, you’ll assist all of your customers respectfully and effectively.

6. Balance requires the capacity to be successful at satisfying the customer, while taking into account the resources and needs of your organization. Going too far either way puts you out of balance. Customers must feel they have been heard and treated fairly. The company needs employees to operate within guidelines and practices. A secret to having balance is knowing that you can acknowledge the feelings of the

customer, even if you disagree with the facts presented by them. Acknowledgement does not mean agreement, so acknowledge the feelings, move on to the facts, and address the issues. 7. Resiliency means having the ability to bounce back quickly from adversity. Resiliency allows a representative to remain calm in adverse situations or recover Service Mentality — continued on page 44
