W

elcome to 2020, a new year that we know will present the rental-housing industry with it’s share of challenges as well as opportunities.

The Apartment Association of Orange County (AAOC) has proudly protected and served countless thousands of rental property owners, operators, vendors, and other industry professionals since 1961.

We have been very fortunate over these years to have had some of the best, brightest, and most-qualified individuals serve our association as members of the AAOC Board of Directors and as committee and board members at the state and national levels. Protecting private property rights and advocating on behalf of our industry has never been a job for the faint of heart, whether here locally, in Sacramento, or in Washington, D.C. The past presidents, board members, and executive directors of AAOC have

always taken a very thoughtful, measured and strategic approach as they have engaged lawmakers, government staff, advocates, and others on policy discussions of the issues that our industry holds dear. At times — and more often than not — they have also had to “take the gloves off ” in defense of our industry’s interests. It is through their leadership, dedication, and commitment to principle, that AAOC has contributed to the betterment of the rental-housing industry.

To the men and women who have dedicated themselves in a completely altruistic manner and volunteered their time and talents to fight what seemed to be losing battles, only to somehow scrape up a win, we applaud you!

The tireless efforts of the AAOC staff combined with your membership contributions help to ensure that your association can work to protect your interests while also developing strategies for the future of our industry. We know there are big changes and challenges ahead, not the least of which involves the implementation of AB 1482 and dealing with the impact of statewide rent caps and just cause evictions. We will also have the “Rental Affordability Act” to contend with on the General Election ballot in November.

This statewide ballot initiative poses an even greater threat to the California rental-housing industry than Proposition 10 did just two years ago. Our challenge is to defeat this initiative, as we did with Proposition 10, along with other destructive rental-housing policies that will undoubtedly be proposed this year.

Rest assured, AAOC will rise to the occasion and confront these challenges head-on. That’s what we do! But we are going to need your help.

AAOC is reaching out to our property owner and operator members, our Product & Service Council members, and our other industry partners to build our 2020 campaign war-chest.

Every dollar we raise this year for our political action committees will not only help us defend our industry’s interests but also help elect individuals to local and state office who share our values.

Over the many years, AAOC has benefited from the volunteer efforts of countless professionals who have helped educate and provide valuable programs and resources to our members. Many of our classes, seminars, and programs were created by our members, for our members, in service to the association.

AAOC has been a critical partner in developing generations of rental-housing professionals who are now among the best in their respective roles in our industry. We have developed homegrown talent who now take the time to give back for the benefit of the association and its current and future members.

The AAOC Education Committee, Legislative Committee, Membership Committee, and Product & Service Council Committee is comprised of volunteers who have consistently and

and talent. In turn, this has helped position AAOC as an industry leader at the forefront of many issues, as well as an association that is recognized and respected nationwide. Thank you to all who have and continue to serve and give of themselves so generously.

Additionally, I want to acknowledge our executive director, David Cordero, who was named last month by the Orange County Register as one of the 100 most influential people in Orange County.

For all that David has done for the association since returning less than a year ago — fostering new and deeper relationships in the community, providing industry leadership and representation in helping to end the county’s homelessness crisis, and starting to position AAOC for future growth, diversification in member programming and services, and an expanded presence in Orange County, we are very proud.

ew Year’s Resolutions. Many of us make them but often don’t manage to keep them.

So, if you haven’t yet made a resolution this year or you’re already looking to make a new one, might I suggest resolving to maximize your AAOC membership by attending more association meetings, classes and special events in 2020? It’s an easy resolution to keep and AAOC is offering plenty of opportunities this year. Start the year by putting these events on your calendar and you’re well on your way.

AAOC looks forward to kicking off the near year with it’s first General Membership Meeting on Tuesday, January 21 at 7 p.m. at our new meeting location — The Courtyard by Marriott in Santa Ana. In what is always a very well-attended meeting, Stephen C. As a partner in the United to End Homelessness Initiative, AAOC has been educating rental property owners and operators about how they can be part of the solution to Orange County’s homelessness crisis, by making rental units available to qualified individuals who possess federal housing vouchers but who have been unable to find vacant units within the housing authority payment standards. AAOC will be donating a portion of the proceeds from the golf classic to help the Welcome Home OC Program and United to End Homelessness Initiative in its mission to end homelessness in Orange County, in a humane and dignified way, by providing long-term housing with supportive care to those who need it the most.

The Future of Housing: When Rental Owners & Politicians Work Together (Part 3 of a 3 Part Series)

W

ith hundreds of cities and counties across America trying to deal with a dearth of housing stock, public officials at all levels are getting involved. Whether these policymakers are in the early stages of debate or actually implementing changes, rental property owners are being painted as the villains. As long as that narrative continues, the one’s with the most to lose will continue to be left on the outside of the discussion; with minimal opportunity for feedback.

Leveraging one’s policymaking knowledge and experience in the Legislature requires more than sponsoring and introducing legislation. To be effective advocates that are considered subject matter experts it is important to also assist with the implementation of a bill; regardless of whether one supported or opposed in the onset. For the final edition in our “The Future of Housing” series we are taking a look at legislation that required rental property owner’s assistance at ensuring the bill was properly implemented. Often, Legislators are first and foremost concerned with getting their bill to the Governor’s office. This means that often bills are signed into law without regarding for the nuisances and specific consequences that could materialize

once implemented. As effective advocates, it is the job of lobbyists to follow up on these newly signed laws and make sure unintended consequences do not manifest.

Working with the legislature can also ensure well-meaning laws are implemented in a way that protects the tenants. In 2010, the state implemented a law requiring carbon monoxide detectors in every rental unit.1 While a well-intentioned policy, the language did not adequately address battery operated alarms and failed to properly notice tenants or owners when a smoke alarm system is defective or no longer operational. Over the years, rental owners also noticed that the beeping caused tenants to uninstall the detector.

These life-threatening issues were corrected by the advocacy of rental owners, pushing for language that ensured tenants would actually be safe when a smoke detector was installed and operable.2 Four years after SB 1394 was passed, new language was added that required “a place on the device where the date of installation can be written, incorporate a hush feature, incorporate an end-of-life feature that provides 1 Stivers, M. notice that the device needs to be replaced, and, if battery operated, contain a non-replaceable, non-removable battery that is capable of powering the smoke alarm for a minimum of 10 years.” Fire Marshalls opposed the bill because they claimed the technology did not exist, but by making it law it forced smoke detector companies to research and develop it.3 Those policies probably saved thousands of lives, and it was due to rental owners involvement in shaping the law. The policy has also financially benefitted owners by decreasing insurance costs and protecting the property from renters with a smoking habit.4 While sometimes these policies can be intrusive, they can also allow property owners to benefit by removing 3 Id. 4 Team, Q. The policy has also financially benefitted owners by decreasing insurance costs and protecting the property from renters with a smoking habit. some of the inherent liabilities that often plague renting to tenants. These benefits are not always direct, but they nevertheless can exist. Take the example of maintained plumbing, such a policy can benefit the owner on the backend by increasing the overall property value. Or consider the need for roofing. When rental owners attempt to work within the system, they can extract positive liabilities that protect them in the long run. When many of these habitability requirements were being legislated, owners made sure to work with Legislators on the process and were able to shift some legal duties onto the tenant. Instead of simply opposing

these policies, they sought to ensure the new laws came with a proverbial carrot and stick. These “affirmative obligations” were put into place with the understanding that the owner is making large changes to provide a habitable space and that they should not be blamed if something goes awry without their knowledge. The duty to warn of damages specifically places the onus on the tenant to communicate when a repair is needed or risk becoming personally liable. While the issue may be some-

thing that has nothing to do with the tenant’s own conduct, the duty ensures that the rental owner is not forced to pay for costs once a premise goes beyond normal repair needs.8 For example, Civil Code § 1941.2 (a)(3) specifically requires the tenant “to properly use and operate all electrical, gas and plumbing fixtures and keep them as clean and sanitary as their condition permits.” This provides a safety valve for rental owners paying the upfront costs to make the property habitable while guaranteeing a tenant who misuses or abuses the premises will not be able to move on and leave the owner with the full costs.

Furthermore, security deposits have been established to make sure the tenant cannot destroy a premise and then claim they are broke.9 While the deposit does not cover everything, one can only imagine the insurance costs without such a provision!

Being able to capitalize on problematic legislation and maintain one’s credibility requires comprehensive knowledge of the issue and years, if not decades, of experience. As this series has demonstrated, rental owners are having a hard time having their voice taken seriously because their image is constantly attacked by the media, legislative turnover creates short-term memories, and it has been awhile since we were the advocates introducing protenant legislation. Fortunately, all these issues can be addressed by taking a concerted and thoughtful approach to our interactions with policymakers.

Big Changes for the 2020 Elections in Orange County

T

he 2020 election year will be different than any election we have seen previously in Orange County. The California Primary Election has been moved permanently to the first Tuesday in March, which will be March 3 this year. We still have the “top-two” candidate system in the Primary Election. The top two federal and state candidates who receive the most votes, regardless of political party, will be the two candidates on the ballot

going into the November 3, 2020 General Election. No longer do political parties nominate their own candidates. There is the possibility in some districts in Orange County that we could see two candidates from the same party on the November ballot.

Per State Law, all city elections have been moved to the November General Election. And with 2020 being a Presidential Election Year, we could see all sorts of surprises at the polls. These

election years have historically had a higher voter turnout than other election years and 2020 will be a much-watched election on the national level. Coupled with a higher presidential year voter turnout will be the new Orange County election system. Every registered voter in Orange County will receive an “Absentee” Vote-By-Mail Ballot in the mail. Orange County voters will have the option of either returning their ballot by mail or voting in-person at any of

the 200 Vote Centers throughout the county. There will no longer be neighborhood precinct polling places in garages, schools or churches in Orange County. The Vote Centers will be open for 11 days. That means that instead of one Election Day, there will be 11 days to vote in-person. In addition to the Vote Centers, there also will be Ballot Dropoff locations throughout Orange County.

On top of these changes, there will also be a same-day voter registration system throughout California. Eligible voters will be able to register the same day they vote at any of the Vote Centers.

All of this is very new, and nobody has a clear idea of how it will affect voter turnout or how it will affect the way the candidates will campaign for office. The traditional get-out-the-vote techniques will need to be updated for the political parties as well as the candidates in 2020.

To try to prevent vote fraud, the Vote Centers will require voters to check in electronically and their individual voter data can be viewed by the voter and the staff of the Orange County Registrar of Voters. Any discrepancies can be corrected before the voter casts his or her ballot. Worth noting is that the State of California does not allow Vote Center staff to check identification (ID) before giving a ballot to the voter. California is one of 13 states that does not require an ID to vote, while there are 17 states that require a photo ID and the remaining states require a non-photo ID before voting. In California, you need a Real ID drivers license to board a plane, but you don’t need to show any identification to vote.

AAOC will be monitoring very closely this year the issues and candidates leading up to Orange County’s state and local elections in November.

How will I know what the rent increase limitations will be with this new law?

Your apartment association will provide that information to you, making sense out of these crazy new laws is one of the many great values to your membership.

Effective January 1, 2020, annual gross rent increases will be limited to five (5) percent plus the regional Consumer Price Index (CPI) where the residential real property is located or ten (10) percent whichever is less, of the lowest gross rental rate charged for that dwelling or unit at any time during the 12 months prior to the effective date of the increase.

In determining the lowest gross rental amount, any rent discounts, incentives, concessions or credits offered by the owner and accepted by the tenant shall be excluded. CPI means the percentage change from April 1 of the prior year to April 1 of the current year in the regional CPI Index as published by the US Bureau of Labor Statistics (BLS. gov), or by the Department of Industrial Relations (DIR.ca.gov) if the regional index is unavailable on BLS.gov. [The current allowable rent increase is 5% plus the CPI of 3.3384%, a total of 8.3384% for the LA, Long Beach, Anaheim region; 7.7989% for the Riverside, San Bernardino, Ontario region; 7.2062% for the San Diego, Carlsbad region; or 8.3424% if your region is not listed on BLS.gov.]. gross rent was increased on or after March 15, 2019 but prior to January 1, 2020, the increase cannot exceed five (5) percent plus your regional CPI or 10 percent, whichever is less. If the gross rent increase exceeded the allowable amount, the gross rent effective January 1, 2020 will be calculated based on the lowest gross rental amount plus the allowable increase as of March 15, 2019.

Although the rental rate may adjust downward on January 1, 2020, the owner is not required to return or credit the tenant for the excess that was due prior to January 1, 2020. If gross rent was increased between March 15, 2019 but prior to January 1, 2020, in an amount less than the allowable increase, rent may be increased within 12 months of March 15, 2019 up to the allowable amount.

What is a Just Cause eviction? And what is the difference between At Fault Just Cause, and No Fault Just Cause?

After a tenant has resided in the rental unit for one year, or two years if any additional adults are added, unless exempt, terminations of tenancies require “Just Cause.” There are two types of Just Cause, 1) At Fault Just Cause, and 2) No Fault Just Cause.

What should I be doing now to prepare for the new law?

If you have issued a notice of change of terms increasing the rent that resulted or will result in a new rental rate as of January 1, 2020 that exceeds the allowable percentage increase as stated above, then you should provide notice to your residents that effective January 1, 2020, the new rental rate will be reduced to the maximum allowable rental rate. (i.e. if your rent on March 15, 2019 was $1,000.00 and you increased it since to $1,250.00, your maximum allowable rental rate on January 1, 2020 would be $1,083.38, if your property is in the LA, Long Beach, Anaheim region). Dear Maintenance Men:

I have an opportunity to buy a small power snake for cleaning out kitchen and bathroom drains. At the rate my tenants block their drains, it should pay for itself in no time! Is this a good idea? Dale

Dear Dale,

We understand that almost any reason is a good reason to buy a power tool!

However, most bathroom and kitchen drains can be cleared with a three-foot hand snake. The tub or shower will typically have a hair stoppage just past the tub shoe and the bathroom sink will have a toothpaste and hair stoppage in the trap before the wall. The kitchen sink will typically be stopped on the garbage disposal side because of improper usage of the disposer. If both sides of the kitchen sink are blocked, then it may be necessary to use the power snake.

Power snakes can be very dangerous.

Most operate with a ¼ to ½ horse motor, which packs quite a punch, especially if your finger or arm gets caught! If you buy a power snake, we highly recommend that you get some training on your machine. Power drain cleaning is very much an “art” when done well.

Knowing the difference between hitting and clearing the stoppage and when the snake is snagged, comes with experience. A broken snake cable in your drain system will be far more expensive than simply calling an experienced plumber when needed. Another

thought is most kitchen stoppages are caused by grease. Your snake will only temporarily clear the stoppage. Getting a company to “Hydro-Jet” your drains once a year may help cure your chronic grease stoppages. We recommend doing a mainline drain maintenance just before the holidays each year.

Dear Maintenance Men:

I have a parking area at my building with concrete bumper stoppers. The problem is that when the cars touch the stopper, they move. How do I attach them to the parking lot? Bill

Dear Bill,

If you have an asphalt parking lot, it is quite easy. Most concrete bumper stoppers have two holes that go through from top to bottom. These holes are just the right size to fit a piece of half inch rebar rod. Pick up two, 12-to-18 inch pieces of rebar for each stopper.

Place the rebar through the holes in the stopper and then use a sledgehammer to pound the rebar into the asphalt.

If your parking area is concrete, use a hammer drill, with a ½ inch concrete bit, to drill a hole in the concrete. Use your existing parking bumper as a guide. Either drill down through the holes in the bumper stop to the concrete below or use powdered chalk, poured down through the bumper stop’s holes, to mark the concrete. Then drill all the way through the concrete until you hit dirt. Hammer your rebar into the bumper and concrete. If the fit is loose,

pour some concrete into the parking lot holes and then insert the rods.

Dear Maintenance Men,

I’m about to start a rehab project in one of my units. Can you give me some tips on drywall repairs? The previous residents were very hard on the walls and I want to learn how to do the repairs. Thanks. Benjamin

Dear Benjamin:

If there are holes in the drywall, you can use mesh drywall patches (available at any hardware store) and drywall mud to do the rough repair. If the holes are larger than six inches in diameter, cut the damaged area out. Cut out enough material to reach a stud on either side of the repair. Typically, a square hole is best. Cut a new piece of drywall and nail or screw it into place using the exposed stud on either side.

After completing the rough drywall repairs, comes the finish work. Use wallboard joint compound and joint tape on all seams, nail or screw holes, and corners. Joint compound can be found at any hardware store and comes in ready mixed quart, gallon, and fivegallon buckets. Plan on applying three coats of compound material letting it dry between coats. When doing repairs to joints or cracks, be sure to use wallboard tape to reinforce the joint. The tape comes in paper or fiberglass and will ensure the joint will not crack in Maintenance Men — continued on page 22

Immediately press the joint tape into the compound and use a four-inch taping knife to smooth out the tape and let dry. Again, using your 10" knife, apply another layer of joint compound over the tape and let dry. Finally, apply the finish layer of compound and let dry.

Use sandpaper or a wet sanding sponge

and sand the joint until it is smooth.

After all is dry, texture to match the surrounding walls.

California’s ‘Housing Crisis Act of 2019’—Will It Streamline Housing Development and Provide More Certainty?

W

hy it matters: SB 330, signed into law on October 9, 2019, and effective January 1, 2020, substantially limits the ability of municipalities to disapprove housing projects, condition housing projects to reduce density, or levy excessive standards on housing projects that raise costs and extend the permitting process. This is part of a continuing effort by the Legislature to encourage housing development in California by limiting a local agency’s discretion where proposed projects are already consistent with General Plan and zoning standards.

Facts: SB 330 inserts and amends several different sections of the California Government Code to streamline housing development for projects that meet specified criteria. (See Govt. Code sections 65589.5, 65905.5, 65913.10, 65940, 65941.1, 65943, 65950, 66300, 66301.)

These new and amended statutes limit a local agency’s ability to disapprove housing projects or otherwise condition housing projects in a manner that reduces density or makes housing infeasible. Different restrictions apply to projects proposing affordable units than market rate units; but in both cases, agencies must make very narrow written findings in order to disapprove a project that is consistent with General Plan and zoning standards. SB 330 also limits the number of hearings and meetings that a local agency can hold in connection with certain housing development projects, and it shortens permissible timelines within which an

agency must take action on a housing development application.

Specifically, the streamlining provisions of SB 330 include: • Where a proposed housing project complies with the applicable objective General Plan and zoning standards, local agencies may hold no more than five public meetings or hearings in connection with the project’s approval (Govt. Code § 65905.5(a)).

• Local agencies must determine whether the site of a proposed housing development project is a historic site at the time the application is deemed complete, and this determination must remain valid during the pendency of the project (Govt. Code § 65913.10(a)).

• Local agencies may not disapprove a proposed housing development project when the project complies with applicable General Plan, zoning and subdivision standards, unless the agency can find that the project would have a specific, adverse impact on the public health or safety and there is no feasible method to mitigate or avoid that impact without disapproval (Govt.

Code § 65589.5(j)(1)).

• Local agencies must approve or disapprove housing development projects within 90 days from the date of certification of the project’s environmental impact report, and

within 60 days for certain affordable housing projects (Govt. Code § 65950(a)).

SB 330 also sets up a “preliminary application” process. Under this new and mandatory process, when a developer submits a preliminary application that includes a finite and set list of contents, the local policies, ordinances and standards applicable to the project are frozen in place. A development can only be held to those requirements in effect at the time the preliminary application is deemed complete, and, under the new statutory scheme, agencies have very limited discretion to deny a preliminary application’s completeness.

The new legislation not only limits a local agency’s ability to disapprove certain qualifying housing projects, but also severely limits a municipality’s ability to redesignate land where housing is currently a permitted use.

Specifically, where housing is currently an allowable use, SB 330 prohibits cities and counties from changing the General Plan, specific plan or zoning designation in a manner that either reduces the allowable residential density or prohibits residential use altogether. The only exception is where the local agency concurrently amends the designation or standards applicable to property elsewhere in the jurisdiction to replace any lost housing capacity.

permit residential use, the local agency would be prohibited from approving that redesignation unless it concurrently amends its General Plan or zoning code to allow residential use, or increase the permitted residential density, elsewhere in the jurisdiction.

Tenant Protection Act of 2019—Just Cause Eviction and Rent Control [AB 1482]

The new law will apply to all California residential real property, except: • The new law does not apply to residential real property that is subject to a local ordinance requiring just cause for termination adopted on or before September 1, 2019, or to residential real property subject to a local ordinance requiring just cause for termination adopted or amended after September 1, 2019 that is more protective than these provisions.

• Housing accommodations in a non-profit hospital, religious facility, extended care, elderly or adult residential facility as defined.

• Housing that has been issued a certificate of occupancy within the last 15 years.

I. Just Cause Eviction

After a tenant has resided in the rental unit for one year, or two years if any additional adults are added, unless exempt, terminations of tenancies require “Just Cause.” There are two types of Just Cause, 1) At Fault Just Cause, and 2) No Fault Just Cause.

At Fault Just Cause includes the following: • Default in the payment of rent, or a breach of a material term of the lease, after being issued a notice to correct the violation if the breach is curable. A three-day notice to terminate the tenancy may then be served; • Maintaining, committing or permitting a nuisance; • Committing waste; • Refusal to execute a written extension or renewal of a lease that terminated on or after January 1, 2020 for an additional term of similar duration with similar provisions; • Criminal activity on the rental property, including the common areas; • Criminal activity or threat on or off the property directed at the owner or the owner’s agent; • Assigning or subletting the premises in violation of the lease; Eviction — continued on page 30

Eviction — continued from 28 • Tenant’s refusal to allow entry to the premises as authorized by law; • Using the premises for an unlawful purpose as described by law; • Employee, agent or licensee’s failure to vacate the premises following termination of employment; • Tenant’s failure to vacate the premises after tenant’s delivery of notice of the tenant’s intention to vacate the premises.

Relocation Assistance: When terminating based on At Fault Just Cause, the tenant is not entitled to receive relocation assistance.

No Fault Just Cause includes the following: • Intent to occupy the premises by the owner or certain defined relatives. [provided lease entered on or after

July 1, 2020 includes specific language];

II. Rent Control

• Withdrawal of the property from the rental market; • Government Agency or Court Order, or local ordinance requiring the property to be vacated (relocation assistance not required if Order issued due to tenant fault) • Owner intends to demolish or “substantially remodel” (as defined) the rental property.

Relocation Assistance: When terminating based on No Fault Just Cause, the tenant is entitled to receive the equivalent of one (1) month’s rent through either a direct payment or a waiver of the last month’s rent. Note: The tenant is not entitled to retain the relocation assistance if the tenant fails to timely move out. The owner can recover these damages in an unlawful detainer complaint.

Effective January 1, 2020, annual gross rent increases will be limited to five (5) percent plus the regional Consumer Price Index (CPI) where the residential real property is located or ten (10) percent whichever is less, of the lowest gross rental rate charged for that dwelling or unit at any time during the 12 months prior to the effective date of the increase. In determining the lowest gross rental amount, any rent discounts, incentives, concessions or credits offered by the owner and accepted by the tenant shall be excluded.

CPI means the percentage change from April 1 of the prior year to April 1 of the current year in the regional CPI Index as published by the US Bureau of Labor Statistics (BLS.gov), or by the Department of Industrial Relations (DIR.ca.gov) if the regional index is unavailable on BLS.gov. Eviction — continued from 30 CPI of 3.3384%, a total of 8.3384% for the LA, Long Beach, Anaheim region; 7.7989% for the Riverside, San Bernardino, Ontario region; 7.2062% for the San Diego, Carlsbad region; or 8.3424% if your region is not listed on BLS.gov.].

If gross rent was increased on or after March 15, 2019 but prior to January 1, 2020, the increase cannot exceed five (5)percent plus your regional CPI or 10

percent, whichever is less. If the gross rent increase exceeded the allowable amount, the gross rent effective January 1, 2020 will be calculated based on the lowest gross rental amount plus the allowable increaseasof March 15, 2019.

Although the rental rate may adjust downward on January 1, 2020, the owner is not required to return or credit the tenant for the excess that was due prior to January 1, 2020.

If gross rent was increased between March 15, 2019 but prior to January 1,

2020, in an amount less than the allowable increase, rent may be increased within 12 months of March 15, 2019 up to the allowable amount.

Additional Information:

Vacancy Decontrol (Costa Hawkins) is unaffected. Upon the unit becoming vacant, either after eviction or voluntary move out, the rent can be adjusted to market without restrictions. AB 1482 does not change existinglaw.

AB 1482 sunsets (is no longer effective) as of January 1, 2030.

Eviction — continued from 32 of the Civil Code and is not subject to the just cause requirements of Section 1946.2 of the Civil Code. This property meets the requirements of Sections 1947.12(d)(5) and 1946.2(e)(8) of the Civil Code and the owner is not any of the following: (1) a real estate investment trust as defined by Section 856 of the Internal Revenue Code; (2) a corporation; or (3) a limited liability company in which at least one member is a corporation.”

“California law limits the amount of your rent can be increased. See Section 1947.12 of the Civil Code for more information. California law also provides that after all of the tenants have continuously and lawfully occupied the property for 12 months or more or at least one of the tenants has continuously and lawfully occupied the property for 24 months or more, a landlord must

The statutory language should be in 12-point font in notices and lease agreement documents.

Conclusion

This legislation will not create a single additional housing unit here in California. It will do absolutely nothing to increase the housing supply in California. AB 1482 is poorly drafted, confusing, vague and ambiguous, mis-references statutes, and is overly complicated. In short, a tenant lawyer’s dream. It will certainly be applied inconsistently by the courts, and will empower and enable tenant activists with another tool to burden and abuse housing providers.

Housing Providers are not the problem. We don’t need any more interference as we struggle with our many existing challenges in providing housing to the residents of California.

Legislation is reactive. Our legislators

respond to angry letters and phone calls from constituents by crafting legislation, some good, most not. Let’s not give our legislators any reason to ‘help’ us further. Knee jerk termination notices or maximum allowable rent increases are not the appropriate response.

Thorough Tenant Screening is critical, get to know your prospective residents, before they become your problems.

Actively manage, use current association tenancy forms, update regularly as required, improve your documentation of activity during the tenancy. AB 1482 provides certain challenges and hurdles and will change how we do business however it also provides opportunities that did not exist previously. Don’t panic, we’ll be just fine.

New Year’s Considerations for Orange County Apartment Values

W

ill 2020 bring yet another year of generous returns to OC apartment investors?

Apartment owners have been on quite a run in the post ‘08–‘09 Great Recession era. After the traction restoring years of 2010 through 2012 where markets stabilized, it’s essentially been pedal to the metal for multifamily values since.

However, we enter 2020 with some serious concerns: • Cap rates are off their lows; • Gross rent multipliers are off their highs; • Statewide rent control legislation (AB 1482) is in full effect; • There is ongoing talk of a “split roll” for property taxes that could, at some point, mean that apartments would lose Proposition 13 protections against property tax increases;

What say cap rates?

OC experienced a 4.49 cap rate in Q3 2019 on 5+ unit apartments sales per CoStar’s findings (see adjacent chart).

Now, by historical standards, a 4.49 county average cap rate for apartment buildings is indicative of strong value.

For context, ten years ago in Q3 2009, the OC cap rate was 6.93 cap. Remember, higher cap rates decrease income property values, while lower cap rates increase values.

Thus, the ten year 244 basis point decline in cap rate — 6.93 then, 4.49 now — explains how $5 million apartment

buildings in 2009 have become $10 million buildings in the current market environment, and $750k 4-plexes ten years ago are fetching $1.6 million today (and even more in coastal areas).

But, here’s the somewhat sobering note: cap rates have gone higher in third quarter 2019 at 4.49 compared to Q3 2018 (4.04) and Q3 2017 (4.20). Again, a rising cap rate means decreasing value for a property’s NOI.

Gross Rent Multiplier message

Many rental housing investors use GRM as a value metric (among others) to quickly size up property value. Orange County’s GRM was 15.10 in Q3 2019.

Again, comparing to ten years ago — the GRM was 11.15 in Q3 2009 — today’s 15.10 GRM is a huge upgrade to apartment values.

But a red flag may need to be recognized here in that all four quarters of 2018 had GRMs of 16.11 or higher, while the first three quarters of 2019 reflect a much lower average GRM of about 14.84, perhaps suggesting to some that OC apartment values may have crested in 2018.

Political component

On the legislative front, statewide rent control is now a fact of life in California, which obliges investors to add that element into the bundle of factors they assess in determining an apartment’s value. But, because AB 1482 establishes the annual rent increase maximum at five percentage January 2020

points over regional CPI (per the adjacent chart, Q3 2019 OC CPI was 3%), an annual county rent cap in the range of 8% appears to apply for the moment (the cap will change periodically with adjustments in CPI).

In reality, an 8% rent cap is NOT particularly intimidating and thus will likely have minimal impact on value on properties where rents are already at or near market levels.

The possibility of a split tax roll negatively impacting rental housing statewide evokes worries, particularly to longtime owners with assessed values well below current market. However, though the split roll has been talked about for years, there’s nothing really tangible to assess yet and it’s not being factored into apartment cash flow pro formas or apartment appraisals at present. Therefore, it is not thought to be having any true influence on current sales negotiations.

The upshot

I just don’t see that any of the matters reviewed above add up to enough to meaningfully disturb apartment values.

There is simply no compelling evidence of any signficant threat to OC multifamily cash flows. And cash flow is ultimately what counts. Sure, if interest rates were to spike that would cut into real estate values, but virtually no one is forecasting that eventuality at this juncture.

Tim Gorman Reappointed to AAOC Board of Directors

T

he Apartment Association of Orange County (AAOC) is pleased to announce the reappointment of Tim Gorman (W.R. Gorman & Associates) to the AAOC Board of Directors. The board voted unanimously on the reappointment at its November meeting and Gorman was officially seated in December. He served previously on the board of directors from 2013–2017. Gorman is a second-generation board member, following in the footsteps of his father,

Gorman has been married to his wife, Janette, for more than twenty years and

is the father of two daughters. When not working, he can be found on the softball field coaching his youngest daughter’s travel softball team. His eldest daughter is a high school junior who is now busy looking into colleges.

Survive and Thrive with the New Rent Cap Norm

W

elcome to a new era in apartment ownership. Rent control is now a statewide reality. This is the new norm under which we, as owners and investors, must learn to operate and continue to thrive.

To provide some insights and answer questions, early in November WR Gorman & Associates teamed up with the AAOC to host a Rent Control Forum. As the panel of experts concurred, while the adoption of AB 1482

allows for a reasonable increase in rents; the bill was somewhat vaguely written and future legislation will almost certainly introduce tighter constraints.

Throughout the discussion of how various provisions of the new law work and what is required — the top-ofmind concern among owners was “What should I do now?”

To me, the answer is clear. Now — more than ever before — owners need to fully understand how their properties are

Comparing your current rents to market rates is a key component in this process.

Most owners can easily tell you the rents charged at their properties.

However, knowing market rates and what comparable rents they might be able to achieve is a far more challenging process, especially in today’s new norm.

Raising rents can be accomplished either by getting current tenants to pay more or by re-setting the rental rate when filling a vacancy.

Some owners look at today’s rent caps and conclude that they can apply the maximum increase with their existing tenants and all will be okay. This strategy might work in some instances, but in other situations it could spell disaster.

Before simply proceeding with the new status quo, you need to first inventory the condition of your units, particularly in terms of deferred maintenance and improvements needed to attract tenants who will pay market rents.

Once you know what needs to be done and the costs involved, you can compare your current rental income (adjusted by any anticipated capital outlay) to what you might earn if your rents were at market.

If you are only slightly under market rates, increasing your rents per the maximum allowable caps might actually drive out quality tenants.

Conversely, if your units are renting at rates that are significantly under market, you may never be able to raise rents quickly enough to reach market. In that case, you might consider paying the current relocation costs and initiating an eviction.

This brings us to the second means of getting rents to market rates — i.e. re-setting the unit rent rate upon filling a vacancy. Once again, you need to do a cost/benefit analysis. Along with the standard make-ready costs and any required safety repairs, you need to look at what improvements may be needed to attract tenants willing and able to pay the rates you want to charge.

Even if some level of capital expen

ditures is required, it might make sense to spend the money now and secure top rents with the knowledge that you will be able to maximize your rental income moving forward over the course of the next five to ten years. You have to do the math to decide what is right for you and your property.

Certainly, the new norm is a gamechanger—but the rental ownership game is one that can still be won. In future articles, I will explore other key action items. All are somewhat intertwined,

yet each facet is equally important. The bottom line is that the time to act is now to protect your investment.
