Text while Driving? It’s a BIG risk.
I
make my living as a business attorney, not as a criminal law attorney. That being said, I felt like the issue of texting while driving, and the catastrophic criminal penalties that can come from related accidents, were worth discussing. Driving the streets of Almaden Valley every day, I can say from personal experience that many of us have not taken the laws regarding phone use while driving to heart... but we really need to. I know that many drivers are tempted to text while driving. To be honest, I’m tempted on a daily basis. While we all know it’s a risky activity, you may be surprised at how risky it is. What’s the law? On July 1, 2008, California made it illegal for anyone over the age of 18 to use a wireless telephone while driving a motor vehicle, unless the device had “hands free” listening and talking features (i.e. Bluetooth). On January 1, 2009, it became illegal for individuals to drive a vehicle while writing, sending or reading text messages, instant messages or emails. Drivers under the age of 18 are prohibited from using a wireless device for any reason while driving a motor vehicle (California Vehicle Code section 23124). Despite the law, there is still a lot of hand-held talking and texting while driving. Almost 50% of teens admit to texting while driving and being distracted behind the wheel because of it. It’s hard to argue that anyone can talk or text while driving and not suffer from a decrease in attention, reducing the ability to watch the road and drive safely…but how much does texting while driving affect your driving skills? Studies have shown that texting while driving is even a greater risk than driving while intoxicated ! While getting caught while texting and driving can result in fines, the penalties can be much more serious than that. If you happen to accidentally kill someone while you are talking or texting while driving, you can be charged with vehicular manslaughter under California Penal Code section 192(c). In California, vehicular manslaughter is what is called a “wobbler” offense. That means that the district attorney’s office can elect to charge you with either a felony or a misdemeanor. The facts of your case and your criminal history will be used in weighing this decision. If the prosecutor believes you have acted with gross negligence, meaning you acted with reckless disregard for human life, you may be charged with a felony. If the prosecutor believes you acted with ordinary negligence, meaning you failed to exercise reasonable care to prevent foreseeable harm that could cause death, you may still be charged with a misdemeanor. Either charge can mean serious jail time.

Know what to expect 4.Don’t change jobs Understanding terms such as “agency, section 1, arbitration/ meditation, liquidated damages” and the impact of inspection repairs, to name a few, are critical when making an offer. Knowing the implications of “As-Is” can make or break your deal. You have to know what you are doing.
A new job may involve a probation period which may have to be satisfied before income from the new job can be considered for qualifying purposes. A consistent income history is best. Your income will be scrutinized repeatedly as your loan is processed. Your lender will access your credit report just before they approve your loan to close escrow. Keep it clean.
2. Don’t buy or lease an auto now 5.Don’t pack paperwork Lenders look carefully at your debt and income. Leasing a car or buying a boat as you are buying a home will negatively impact your credit score and your loan opportunity. Don’t run your credit report and don’t open a new credit card before you own your new home. Don’t consolidate your bills before talking to your lender.
3.Talk to your lender NOW
If you will be borrowing money, get a pre-approval letter. Better still, get two or three. At those discussions, you will learn about the types of loans and their rates that are available to you. In addition, you will know how much you should be spending for a home and what your monthly premiums will be. Talk to a banker AND a loan broker. They may have differing options.
When your offer is accepted, important paperwork, such as W-2s, divorce decrees and tax returns should not be packed with your household goods. You may be asked for such papers, while in escrow. Getting duplicates or retrieving them from a shipping container may take precious time and stall your closing date.
6. Make your offer competitive & smart
Be prepared. Designing an appropriate offer for the home, market and anticipated competitive offers is critical. Negotiation with the listing agent and sellers can often make the difference between getting the home you want or not. You should understand exactly what is happening and how your agent can make a difference. This is where I specialize. I have taught classes in sales negotiation. That is what I do for my clients. he Almaden Valley Women’s Club is proud to present their 38th Annual Almaden Valley Art & Wine Festival on Sunday, September 14, 2014 at the beautiful Almaden lake Park from 10:00a.m. to 6:00p.m. Free Admission includes great entertainment and access to one of the best festivals in San Jose! With something for all ages, you can enjoy the works of over 90 artists and craft persons, selections from great local wineries and breweries – served in commemorative festival glasses and fantastic food with a variety of international flavors from local schools, restaurants and food trucks in our diverse community. In our Children’s Area you will find arts and crafts and activities with special appeal to our younger patrons with delectable food as well. Throughout the day, the entertainment lineup will include performances from local entertainers, cheerleading and dance teams in addition to some of our community’s favorite professional and non-professional entertainers. This year the Almaden Valley Women’s Club will be honoring Pat Dando, former District 10 Councilmember and Co-Founder of the Almaden Valley Art & Wine Festival. Our current District 10 Councilmember, Johnny Khamis, will also be taking the stage to talk about local city projects.
Entertainment We welcome Leland High School Senior, Maddie Rose, who will open our festival by singing the National Anthem. We are excited to welcome back local band favorite, Sage, to our main entertainment stage who will be rocking the park from 3 – 6 p.m. Also entertainment from local band favorites, The Touch of Class Band and Rockin Blues Express, local singer and guitarist, Kat Lernihan, Bollywood Dancing and Shaolin Kungfu Zen Academy will take place on our main entertainment stage for your enjoyment throughout the day.
The Wines and Beers We will be offering a premium wine tent again this year with wines from Rombauer Vineyards in Napa and Leal Vineyards in Hollister. We will also be offering great wine selections from David Bruce Winery, Sycamore Creek Vineyards, Guglielmo Winery, Fortino Winery, J. Lohr Vineyards and Wines, and Martin Ranch Winery. Six varieties of beers will be poured from our large beer trailers along with the addition of handcrafted beers from Prospector’s Brewing Company.
Hungry? Sonoma Chicken Coop will be teasing our taste buds again this year with meat skewers and Amato’s Pizzeria will be serving their specialty pizza, both favorites in Almaden. There will be crab cakes, burgers, gyros and Pupusas from Sweet Delights; Mexican specialties from Tacos Al Pastor; along with ice cream, kettle corn, cupcakes, Hawaiian shaved ice, smoothies and lemonade. Gourmet food trucks featuring gourmet hot dogs and pulled pork fries by Tastee Bytes and Vietnamese street food by O Mi Ninja will be in our main parking lot.

Children’s Area Don’t miss out on our Children’s Area. Kids of all ages are sure to have hours of fun with the ever popular Quad Bungee Jump, the Rock Wall and many great inflatables. Bouncy Boxing and the Giant Rock Slide are sure to deliver a good laugh. And…of course there will be a bouncy house and obstacle course for the little ones. There will be face painting, t-shirt painting and carnival games as well as entertainment on the Children’s Entertainment Stage.

Hospital Readmissions; Post Discharge Care Strategies The various news media have been covering the costs of Hospital Readmissions, and how hospitals will be graded on their success in reducing such outcomes. The suggested penalties as laid out by the Centers for Medicare and Medicaid Services (CMS) will affect both the hospitals’ and physicians’ bottom line. The CMS defines readmissions as hospitalizations that occur within 30 days of discharge. And with Medicare payments reported by one estimate as being in the $17 billion per year range, it’s no wonder hospitals and families should be looking at how to reduce readmissions. But placing the entire blame, as it were, on the hospitals isn’t fair. Individual patients should be made accountable for their lack of participation in reducing the likelihood of being readmitted. The truth is, not all readmissions are preventable, but high readmission rates are indicative of poor coordination of post discharge care. I want to speak to how a family may become more involved towards reducing the likelihood of having someone you love being readmitted. A recent report from Gallup identified the best practices that could be adopted by hospitals in reducing readmission rates. Let’s focus on what parts of these best practices the patient’s family can get more involved with. The four points made by Gallup follow (please note I list behind each point a suggestion as to who should take the lead): 1. Involve the patient’s social network, family and friends. – Patient / Hospital 2. Use an effective discharge process. – Hospital / Patient 3. Get to know your patients – Hospital / Patient 4. Build the right discharge team – Hospital /Patient* * family should take a big part in this process, arranging in home care should part of plan. Number one and four really should have the patient and their family’s involvement. You know your network of family and friends. And they can help the patient find the additional resources that exist. Most important is asking the questions of the hospital regarding post discharge care; how best can we insure the patient will have a safe and full recovery, what’s really needed? The length of recuperation depends on what caused your hospital stay. A minor or major surgical procedure, broken bone from a fall (say your hip), a stroke. Each comes with the requisite post discharge care plan sometimes inclusive of some form of Physical or Occupational therapy. Recuperation can take anywhere from one week to six weeks. I typically tell clients to ask their physicians what’s the best plan in order to help in lining up necessary resources. Resources such as family, Home Health Agencies, Non-Medical Home Care agencies. Bringing these various care components together, then discussing each individual organization’s part in helping the patient get maximum care towards recovery. In the end, your designing and putting a plan into action whereby reducing the likelihood of your patient’s readmission is lowered and getting them the best recovery is increased. And that is the point after all.
