he Almaden Quicksilver trails are so beautiful this time of year. It is a treasure. I hope you enjoy the cover photography, along with the wild flower photo on this page. The season is so short that I highly recommend taking the time explore our exhilarating trails while this colorful transition is taking place. I dedicate this photo to my dear friend Robin Brown who is courageously fighting a battle against lime disease. When we hike together, (she wasn’t able to hike for a long time, so I am thankful she is able to complete the 2.5 mile trail), we discuss five things happening in our life that we are grateful for. It usually involves our family, friends, nature, and health. Her positive outlook on life is a blessing to be around. I am thankful to Robin for reminding me to stop and enjoy the colors.

Public Safety Spearheaded the effort to allocate money in the budget necessary to open the southern police substation, saving our city more than $542,000 per year. Supported the hiring of 54 Community Service Officers to carry out non-sworn duties, freeing up fully sworn officers to respond to emergencies. ALSJ Almaden Valley Home Tour Inspired by fellow Wisconsin native, Frank Lloyd Wright, the home owners along with a family architect and interior designer created this modern Prairie Craftsman home on 6 acres overlooking Almaden Valley. Large boulders protrude everywhere, remnants of the sandstone quarry that built Stanford University. The home features an open footprint with views of the valley to the south, the quarry peak to the north, and hill pastures beyond. The architecture blends inside with outside, with all exterior materials appearing prominently inside the home, including dry stacked stone, cedar siding, wood trim, and steel railings. The home fits into the hillside both aesthetically and physically, broken into 7 levels that match the contours of the site. The house exterior has Wright’s signature cantilevered roofs, pronounced eaves, and horizontal accents. The redwood barrel vaulted entry and its waterfall greet visitors into the home before a large 4-sided fireplace of maple and stone. The glass wall of the living room on the left opens to create an interior/exterior space inviting guests to the patio and its views. An array of walnut wood slats make up a sliding wall that conceals the TV. Opposite the entry is an office with a modern walnut desk, alder cabinets, and a replica of Wright’s Taliesin floor lamp. Climbing a few steps past the office takes you to the master bedroom suite, with a linear fireplace, large cedar deck, alder changing room, and spa. You may notice unique “cornerless” windows in the living room and master bedroom, including Japanese shoji screens concealed in wall pockets that slide out as window coverings. The kitchen is centered on a bold granite island, surrounded by walnut cabinets, stainless appliances, and clerestory windows on all 4 sides. A staircase of thick oak treads suspended on steel stringers leads down a half flight to the game room, featuring a modern walnut bar, Craftsman pool table, and fireplace. Continuing further downstairs leads to family bedrooms, baths, and patio. Furnishings and fixtures throughout the home blend mid-century, Craftsman, and Mission styles.

Simonds Elementary School

50th Anniversary Celebration

he 1960’s brought an explosion of growth to San Jose and the Almaden Valley. Once considered far removed and “out in the sticks” from the more populated areas of Santa Clara County, several new housing developments attracted hundreds of young families to the beautiful, rural valley of Almaden. The influx of families necessitated the building of new schools, and among them, Simonds Elementary was born. Named after WWII hero, George William Simonds, the school opened its doors in 1965 with 770 students, grade K-6. Over the years, Simonds Elementary staff, teachers and parent volunteers built a thriving, caring community focused on both academic and character growth. Teachers participate in professional development, collaborative grade-level team meetings and resourcefully integrate both Common Core standards and technology into the classroom curriculum. Their dedication and commitment earned the only 2013 National Blue Ribbon School award in San Jose Unified! Parents, in turn, enrich the elementary experience with over 18,000 volunteer hours a year. They constructed an outdoor “classroom”, held Fashion Shows and Walk-a-Thons to raise money, joined the National PTA and formed the Simonds Music and Technology Foundation in 2001. (Art Vistas, Project Cornerstone, Junior Achievement) and host yearly events (Multicultural Fair, TK/Kinder Ice Cream Social, Science Fair, Math Olympics, Geography Bee, Book Fair, Three Weeks of Giving and Carnival). It’s no wonder Simonds enrollment is highly regarded and continues to stay in the 700’s. Simonds exemplifies a dynamic learning community where students are inspired and gain a strong foundation for lifelong success. Almaden Valley Women’s Club The Almaden Valley Women’s Club Announces New Executive Board for 2016 GET INVOLVED!

his year marks 51 years of celebrating community support, networking, education, community involvement and friendships for the Almaden Valley Women’s Club. “We are emphasizing growing our service and community involvement in 2016,” says new club President Carina Johnson. “Our goal is to highlight our wonderful club to a wider group of women who want to make a change, support their community, meet new friends and enjoy having fun doing it.” The non-profit AVWC’s main fundraising event is the annual Almaden Art and Wine Festival. - and raises much needed funds for local charities. This year the festival will be held on Sunday, Sept. 11, 2016 at Lake Almaden in San Jose, CA. And Then There Were Eight...

J

ustice Antonin Scalia, who had served as an Associate Justice on the U.S. Supreme Court since 1986, passed away last month. His recent death has left uncertainty in the minds of many citizens as to whether the vacant seat should be filled prior to the next U.S. President being elected. Some argue President Obama should nominate Scalia’s replacement; others argue it is a decision rightfully belonging to the incoming president, whomever that ultimately may be. President Obama has in fact made a nomination, Merrick Garland, and it is the decision of Senate as to whether hearings will occur prior to the election of the next president. At this point, such hearings seem unlikely given the statements of the Republican-controlled Senate. So, in the meantime, what does this mean for decisions coming from the U.S. Supreme Court? The U.S. Supreme Court decides cases with one of four types of decisions: • A unanimous decision, where all sitting justices agree on the reasoning and outcome of the case; • A majority decision, where a majority (typically five justices) agree on the reasoning and outcome of the case; • A plurality decision, where a majority of the justices agree on outcome of the case, but disagree on the reasoning used to arrive at that outcome; or • A tie decision, where there are an equal number of justices in favor and opposed to the outcome of a particular decision.

Where a case is decided by a plurality of the Court, that decision applies to that particular case, but the decision does not become precedent. This means that the decision will not be used as the rule of law in deciding similar cases in the future. Before a case arrives at the U.S. Supreme Court, it has gone through several courts already. If the U.S. Supreme Court’s decision results in a tie, the lower court decision is affirmed, meaning the lower court’s decision stands. The current U.S. Supreme Court, generally recognized as being a fairly even split between liberal and conservative justices, has already reached its first tie. In a case that came to the U.S. Supreme Court from the 9th U.S. Circuit Court of Appeals, the Court deadlocked 4-4 on the decision as to whether unions who represent government employees can collect fees from workers even where those workers choose not to join the union. Had Justice Scalia still served on the Court, it is very likely the unions would have lost this case, overturning a system that has been in place for nearly 40 years; instead, with the tie, the 9th U.S. Circuit Court of Appeals decision (which allowed the collection of “fair share” fees from nonmembers) stands. Time will tell as to how much law stands based on additional 4-4 decisions. As for who Scalia would like to ultimately replace him, his own words give some guidance: “I would not like to be replaced by someone who immediately sets about undoing what I’ve tried to do for 25-26 years.” The above article is provided for informational purposes only.
