I’ll Buy That Home! If….

B

uying or selling a home can sometimes hinge on the stars aligning. Often, those requirements take the form of “contingency” clauses within the real estate purchase agreement. Contingency clauses are quite common, and protect one of the parties from harm in the event a certain circumstance or event occurs (or doesn’t occur). The basic idea of a contingency clause is to give you the ability to terminate the agreement in the event certain expectations are not met. These “escape clauses” are negotiated between the parties and can be for either party’s benefit. Contingency clauses can take many forms, and cover many topics, but a few of the most common are: • The financing contingency: This allows the buyer a period of time to secure a loan or other financing with which to meet the terms of purchase; • The prior sale contingency: When the buyer must first sell another property (usually their existing home) before they can purchase the seller’s property; • The home inspection contingency: States the property must first pass a home inspection, and be free of structural problems, material defects, defective appliances, etc.; • The intended use contingency: Requested when the buyer will only buy the property if a zoning variance or permit can be obtained allowing the intended use of the property (such as use as a home office, multifamily residence, or business use). • The attorney contingency: States the contract is contingent upon review and approval by the party’s attorney. • The homeowners association contingency: States the contract is contingent upon receipt and approval of the homeowners association’s documents and rules • The appraisal contingency: Requires that the property appraise at or above the price stated in the contract… besides confirming it is a fair deal for both parties, this is also important as financing may not be possible if the contract price exceeds the appraisal price. • The deal specific contingency: There may be a particular issue for that property, such as a requirement that a well pass certain water testing, soil reports meet certain thresholds, etc. Standard realtor contracts may contain some contingency clauses, but it is obviously always important that you make sure you include clauses to cover all your specific concerns. But as a buyer, keep in mind that the seller ultimately decides whether to accept the contract with one or more contingency clauses. The seller’s decision to do so typically rests not only on the nature of the contingency itself, but also on the market demand for the property. The hotter the property, the less likely it is the seller will accept contingencies. Zero contingencies? Beware of doing a deal without contingencies. An agent advising you to make the deal with a “no contingency” offer might not be acting in your best interest. You could be left with undiscovered property issues (and significant costs) after the deal is done and your agent has walked off with his or her commission. What happens if the contingency is not met? In some cases, the contract is cancelled. In other cases, it is renegotiated. The above article is provided for informational purposes only. Six Things You Must Know Before Selling Your Home 1. 2. 3. Successful sellers have a realistic idea of what their home is worth. A detailed analysis comparing your home to others of equal size and amenities that have recently sold in your area must be compared with those currently on the market.

To maximize the best price possible from the sale of your home, a professional designer should be brought in, at no cost to you, to insure your home is as dramatically beautiful as possible.

Look for a pinpoint comparative analysis of those homes covering: • How do their exteriors and interiors compare • Landscaping quality • Location can affect price dramatically • What schools do they attend? What are the API Scores? • Age of home • Size of the home and property • Special attributes, not readily visible • Neighborhood comparison • Dollars per square foot • Did they sell at list price? Higher? Lower? • How long were they on the market • What is the current real estate market situation

Knowing the condition of your home is critical. Repairs may or may not be needed. A qualified Realtor can advise about your options. California licensed inspectors offer the insight required to negotiate the best deal possible. Not truly understanding the condition of a home can be costly and time consuming.

Your Realtor should give you a simple but comprehensive, integrated report that prepares you for the sale of your home. Photos, maps and all the details of the compared homes will focus on what your home is really worth. An online internet calculator cannot do this job!

Should repairs be needed, your Realtor must be able to provide appropriate licensed experts in every field including roofing, painting, heating, air conditioning, flooring, general construction, swimming pool, landscaping, chimney and pest control. An experienced Realtor can also tell you what profit you will make from this work and, most importantly when not to do the work at all! Preparing your home for sale can be profitable for you.

Selling your home is a major effort that requires a Realtor. Timeline calendars detailing every step and when they occur should be given to you. Complementary checklists covering your utilities, change of address and a comprehensive packing/ moving guide, as well as assistance with packing and storage, if needed, should be offered to make your part simple and easy.

Your Realtor should make the selling process as simple and fast as possible; getting you the highest price the market will bear. Negotiation, going that extra step, might get you another fifteen thousand dollars. Your Realtor must be able to do that. This is what I do for my clients. Let’s discuss your particular situation.

“Best of Homecare 2014”— Visiting Angels San Jose When a business or enterprise is focused on delivering the best, most exceptional care that it can for its customers, there are certain measures than can be used to determine if they’re achieving their goal. People in general are familiar with Angie’s List for contractors, the Better Business Bureau’s Ratings for businesses in general and then there is Michelin for restaurants. For the home health care agency there’s The Home Care Pulse’s “Best of Homecare” award. In order to receive this prized distinction from Home Care Pulse, an in-home care agency needs to rank within the top 25 percent of all home care providers throughout the United States. I

remember the call. It was my Mom. The results of the biopsy were back and we were facing cancer. That was 15 years ago. Surgery was followed by 10 weeks of radiation but the news was good: it had been caught early and it had not traveled to her lymph nodes. My Mom was a survivor...and my dad, my brothers, sister-in-law, husband and I had become caregivers. We didn’t face cancer alone and neither should anyone. Every year we come together just like 5,200 other communities across the country and celebrate those individuals who are winning the fight and those who have offered comfort and support. The American Cancer Society Relay For Life movement is the world’s largest support group for survivors and their caregivers. Anyone who has heard those words, “You have cancer,” is invited to be a guest of honor at Relay For Life of Almaden May 17th, 9AM at Castillero Middle School. Whether you are a caregiver or a survivor, getting involved in Relay For Life can introduce you to others who are facing the same challenges, and provide opportunities for learning, sharing, and friendship. (Not to mention that it is a whole lot of fun!!!) With our change of venue this year, Relay For Life of Almaden is offering more activities and entertainment than ever including midnight movies, lawn yahtzee, a putt-putt course, and climbing wall! Announcing Relay Idol! A singing contest open to all ages. The winner gets to sing the national anthem at the San Jose Giants game on June 14th! (for an audition- email penny.fraley@ yahoo.com) Opening ceremonies this year features a brand new event: a butterfly release. According to an Indian legend, butterflies are amazing secret-keepers. You can tell them your secrets and they will never tell but they will carry your messages of love and comfort upon their wings. “It’s such a beautiful sight seeing the butterflies flutter away honoring those 18 | 95120 Almaden Lifestyle Magazine

who have battled cancer.” said Paul Gardner who, along with his wife, Charmaine, are the creative force behind this unique tribute. You can sponsor a butterfly in honor or in memory of someone for only $20. The luminaria ceremony will be held at 9PM on Saturday evening- the sight of 1,000 lit bags lining the track is breath-taking. A beautiful moment to stop, honor and remember. “It’s my favorite part of Relay,” said Jennifer Caselli, long-time Relay participant. “ We have lit a bag honoring my Mom every year since her diagnosis.” All funds raised go directly to the American Cancer Society to fund amazing programs in our community including: Road to Recovery (rides to treatment for cancer patients), Look Good, Feel Better (free makeover tips for cancer patients dealing with the physical changes brought on by treatment), Hope Lodge (free lodging for cancer patients and a caregiver near treatment), and many free counseling services including: Man to Man (prostate cancer). ALL of these services are free. Fighting cancer is hardfinding help shouldn’t be! Inspired by her husband’s battle with cancer, Deborah Caldwell has started a monthly meet-up for all caregivers. The second Monday of every month at The Country Inn at 9:30am. “It’s a safe, quiet place where caregivers can gather and talk and share,” said Deborah. It is open to all so come down for a cup of coffee served with support and friendship. Relay For Life of Almaden is teaming up with the San Jose Giants this year to honor the strength and courage of cancer survivors and their caregivers. Pack the Park with Purple on June 14th at San Jose Municipal Stadium. Tickets are only $5 with all proceeds going to fight cancer. Can’t make the game?
