T

ime to close out your 2013 taxes, determine which of your New Year’s resolutions are actually working, and as always attempt to improve your lifestyle, business and personal. There have been a lot of convenient businesses in the area closing, and a few opening, so I just want to remind the neighborhood to support local businesses to keep them thriving as you don’t always realize how spoiled you are to have so many services minutes away, until they are not there anymore. The businesses represented in this magazine spend a lot of time and thought on their marketing and I feel they deserve some recognition and respect. It is a lot of work to own your own business and a huge responsibility, so hats off and luckily our advertisers are all still doing well. This time of year is traditionally a bit slow, so we decided to liven things up with a 95120 Night at Shoe Candy in Los Gatos to get some socializing and networking time and to more importantly enhance your wardrobe! I look forward to seeing you there February 27th. This past summer Karen Heverling retired as principal of Williams Elementary School. Karen is a dear friend through these past years and we all wish her the very best in her retirement which we all notice she seems to be enjoying a lot.

From my conversation with him I think the present parents and children at Williams are very fortunate to have such a wonderful addition. As we all know it takes a village to raise children and in Almaden we are that village. I have also been very fortunate to have worked in the past as the coordinator for Time-In at Bret Harte Middle School for 8 years with past principals. Karen Heverling a couple of years ago called me and asked if I had the time to start up the program at Williams. Needless to say I said yes, and met some wonderful women willing to work the program. Jen Constantino was willing to take on the program as the Coordinator for Time-In at Williams Elementary School. She is an amazing woman and I am so pleased that she is doing it. As always volunteers are needed, if you are a parent at Williams and wish to volunteer you can go to the main office at Williams and ask one of the secretaries to take your information so that they can forward it to Jen and she can contact you. It's been maybe 10 years since I worked with children at Bret Harte and I still run into students I mentored. What you give in time can never replace the satisfaction you receive when a young adult smiles at you and remembers what you did and knows that you truly cared at a time they truly needed someone to listen.

he Leland High School Booster Club will be holding its 6th annual “Denim To Diamonds” fundraising gala at the Almaden Country Club on April 26, 2014 from 6:00PM to 11:00PM. The evening includes a fun filled cocktail hour, a fabulous dinner by the ACC chef, lively dancing to music by the wonderful DJ Curtis, action-packed casino gaming tables, a new wine wall, silent and live auctions, and an exciting raffle all in a festive setting where supporters can visit with old friends or meet new ones. Please join us in supporting Leland High School. Mark your calendars today. It is really a wonderful and fun evening in our own Almaden community. California’s public school system continues to struggle to make ends meet. Without tremendous community support, extracurricular activities such as athletics would be at risk of elimination. The costs of maintaining over 40 varsity and junior varsity high school athletic programs as well as all the facilities are great. The Leland Booster Club works hard to provide funds for the high school in three different categories: annual commitments, capital improvements to the facilities and individual team requests. The Booster Club has an annual commitment of approximately $70,000 in key areas such as $26,000 for coaching stipends not paid for by SJUSD, $10,000 for the athletic trainer’s salary and supplies, $10,000 for uniforms, $8,000 for scholarships for graduating seniors awarded for athletic, academic, leadership and character excellence (Pat Tillman, Raymond Leland, Gordon Leland and Leland Character Awards), $5000 for athlete awards, and $12,000 for our new strength and conditioning coach. Capital improvements for the Leland campus always come with large price tags. Leland Booster Club tries hard to support these needs as well. Currently 08 | 95120 Almaden Lifestyle Magazine

they are working with the school district to build a trophy room, give the gym a facelift with new wall graphics and team championship banners, and adding team and individual record boards to various venues on campus all in an effort to acknowledge the successes of Leland athletes. Capital improvements in the last 5 years have included the football stadium press box renovation, new weight room equipment, main gym sound system, scoreboards and floor graphics, a scorekeeper’s table and gym chairs for team use, a trainer cart to give our athletic trainer easy access to all fields, a custodial golf cart, storage sheds throughout campus, a BBQ for the snack shack in Tillman stadium, and the building and installation of the Athletic Field Gateway (archway) located near the tennis courts. Leland Boosters continues to make efforts to support individual team needs as identified by the coaches throughout the year. Examples of these purchases in the last few years are soccer goals, field hockey goals, tennis nets, volleyball nets, swimming and diving record board, roll away cage, tarps, and protective screens for baseball, boys lacrosse helmets, a JUGS machine and replacement helmets, shoulder pads, jerseys, etc. for football, and coaching clinics for a variety of sports. Leland is very fortunate to have a dedicated and experienced coaching staff, extremely talented players, and a wonderfully supportive Almaden community. We send special thanks to our Leland Booster Club who works very hard to provide what is needed each year, but we need your help continue this tradition. I

f you’ve had an idea for an invention and thought about filing a patent, you need to be aware of some very important changes to U.S. patent law – these changes, which became effective in March 2013, are very significant. Following previous strategies as to when to file a patent can result in the loss of your ability to ever patent your invention (so be careful about relying on what your friends think they know about patents). Until March 2013, an inventor had two aspects of patent law that allowed a slower approach to securing patent rights. First, U.S. patent law operated on a “first-to-invent” basis, meaning that even if you filed your patent application after someone else filed on the same invention, your application could still prevail provided you could prove you invented the claimed invention first. Second, the law allowed an inventor to place the invention in the public for up to one year before being required to file a patent application, effectively giving the inventor one year to test the waters before putting money into a patent application. These two concepts are now inapplicable. On March 16, 2013, the “first-inventor-to-file” provisions went into effect. Under 35 U.S.C. § 102(a)(2), an applicant is not entitled to a patent if the claimed invention was described in a U.S. patent or in a published U.S. patent application which names another inventor and has an effective filing date preceding the effective filing date of the claimed invention. In simple terms, this means that the inventor who files first wins. In contrast to the prior law, it no longer matters if you invented the claimed invention first. This first-to-file criteria places the U.S. patent law in line with that of many other countries in the world, generally rewarding the first person who files. Also, the ability to test out demand for the invention in the marketplace is now restricted. Under 35 U.S.C.§102(a)(1), an applicant is not entitled to a patent if the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. The bottom line: if you reveal it to the public before you file a patent application, you will lose your right to patent it. What does all of this mean? Inventors need to move more quickly than ever in order to establish some level of patent protection over their inventions. This means getting a patent application on file as soon as possible. When in doubt, you can file a provisional application. A provisional application is a patent application, but a form of application that has less burdensome requirements than a non-provisional application. It is cheaper and faster than a full-fledged patent application, and can buy you some time to test the market and craft language for your non-provisional application. However, even though it is faster and cheaper, a provisional application still establishes an official United States patent application filing date for the invention and permits you to use the term “Patent Pending” in connection with the invention. After filing a provisional application, you must file the non-provisional application within the following 12 months. While the language in provisional patents can be very general or very specific, best practice would be to describe the invention in as much detail as possible, so there is no dispute later as to the scope of your invention. While you can file patent applications on your own, this is an area where a “do-it-yourself” approach can lead to disastrous results if you have no experience doing so. Seek the advice of a patent attorney, who can guide you through a patent filing strategy that helps you protect your invention while managing your costs. You all agree the family needs help caring for a family member, in order to keep everyone functioning positively and not ‘dropping balls’ with work, health, kids, or friends and family obligations. The next step is to determine what level of assistance is best. Sometimes it is obvious or because of a major setback, there is no choice, but other times it is not so clear and requires a group discussion. Start with baby steps of relief in these cases. If a full-time or even a part-time care-taker is required, some individuals welcome it and say, “finally” as a care-provider can help them get out more to family functions, friend excursions, etc. However occasionally, there can be resistance to someone entering your relative’s “personal space.” If that’s the case and it is perfectly normal btw, here are tips to overcome resistance. Approaching a loved one about the possibility of homecare is a touchy subject wrought with emotion that forces loved ones to confront their own age-related shortcomings. Broach the subject with sensitivity and care. Your loved ones must feel their opinions are being considered if their mental capabilities are up to the task. Some tips for you to consider when discussing homecare options: • Focus on your loved one during discussions and keep him or her involved. • Voice your opinions using “I” statements. • Define a clear topic for each discussion. • Be assertive but respectful. • Keep in mind it may take time & multiple conversations for a consensus. • Don’t blame others or use “You” statements. • Don’t try to accomplish too much in one discussion. Consider a family meeting to discuss your concerns, involving everyone the decision might affect directly. The decision ultimately belongs to your loved one, and he or she should be a central part of every discussion. Family meetings should be supportive, and everyone who takes part must treat the loved one who needs assistance and his or her opinion with the utmost respect. When meeting with resistance, don’t push or make anyone uncomfortable. Resistance requires more assertiveness on your part, but make sure to communicate that you care about them and are concerned about their well-being. While your concerns might be significant, listen to your loved one’s concerns as well. If you’re planning a family meeting, meet with the rest of the family beforehand so you can align your thoughts and concerns. Following the initial discussion, it can help to gently suggest an appointment with a physician (or geriatric psychologist) for a thorough evaluation. A professional evaluation might be the deciding factor for them. Eventually, most elderly people realize they can’t care for themselves as well as they used to be able to. Seeing a doctor and getting a professional opinion could make the decision easier. Keep all discussions positive. If they have the mental capacity to make the decision on their own, then they must do so. It is your responsibility to demonstrate your concern first and foremost, not to make decisions for them.

E

very day, we residents of the South Bay see a striking landmark in the mountains above us – a white rectangular tower atop Mount Umunhum, and we know we are home when we see it. More than a landmark, the Tower is the most visible, and last remnant of an important chapter of our local history. Unfortunately that landmark and the history it represents is endangered. A group of local volunteers hope to save it. At 3,486 feet elevation, Mt. Umunhum is the fourth tallest peak in the Santa Cruz Mountains. But from much of the South Bay it appears much more prominent than that statistic would suggest. The eye is drawn to an enigmatic white “cube” at its peak. During the Cold War, Mt. Umunhum was the site of the Almaden Air Force Station. The Station defended the Bay Area from invasion by air during the Cold War; from 1958 to 1980 its powerful radar could see far out to sea, and its airmen could scramble fighters to investigate any unidentified planes that were detected. On watch 24 hours a day, the Station’s blanket of protection kept the Bay Area from harm. Without that air defense, Bay Area history would have been very different; many of the high-tech businesses that formed the foundation of Silicon Valley would not have set up shop here. Indeed, many of those companies worked for the Air Force, building parts used in the radar and computer technology atop Mt. Umunhum. Built in 1960, the tower was the base for the station’s long range search radar antenna. The five story tall concrete building housed the personnel and electronics to operate the radar; the 85.5 ton antenna on top spun every 10-12 seconds, searching the skies for incoming airborne threats. From the valley floor, only the Radar Tower is visible. But in reality the mountaintop contained an entire small town. The airmen and their families lived on Mt. Umunhum – children, too. The Air Force Station had barracks, 18 | 95120 Almaden Lifestyle Magazine

apartments, a PX, even a bowling alley – all the comforts of home. For the military families stationed there, it WAS home. As technology advanced, and satellites and missiles became more sophisticated, ground-based radars became less important. Eventually Mt. Umunhum was no longer needed for our nation’s safety. The Air Force Station closed in 1980; the radar antenna was taken down, leaving the Tower and the rest of the Station behind. Today Mt. Umunhum is owned by the Mid-Peninsula Regional Open Space District, or “Mid-Pen”. They are in the process of converting the Air Force Station into Open Space, and have plans in place to open Mt. Umunhum to the public for the first time. However, the Radar Tower is not part of their plans. As a matter of policy, Mid-Pen does not spend money on historic preservation, just on Open Space. Their preference, then, is to tear the Radar Tower down. At a series of rancorous public meetings in 2012, the South Bay community informed Mid-Pen’s Board that this was not acceptable. However, through a quirk of local politics, the people who see the Tower every day – mostly in San Jose – are not part of the Mid-Pen district; they pay no taxes to the District and have no representation in its decision making process. In October 2012, Mid-Pen’s announced their decision: If by 2017 “the community” can raise the $1.2 million needed to repair and restore the Radar Tower, it will be saved. If not, it will be demolished. A number of vocal activists were present that night. “Several of us who wanted to save the tower exchanged ideas and phone numbers in the audience that night,” said Sam Drake. “A few days later I filed paperwork with the State to form the Umunhum Conservancy, a non-profit dedicated

Umunhum. The goal of the Conservancy is to raise the funds necessary to preserve the Radar Tower. “In our first year we focused on getting the paperwork done so we could accept donations, and on getting the word out to the community. The reaction we’ve been getting from the community is great! At our first public event at the Almaden Art & Wine Festival, people were lined up to talk to us about Mt. Umunhum and how they can help with our efforts,” said Basim Jaber, Umunhum Conservancy Board Director who has researched and provides prestentations on the station history. After one year the Conservancy is about 15% of the way towards the goal. “We need to raise another $1 million by 2017. To save our local landmark and history we need help from everyone in our community” said Kitty Monahan, the Conservancy’s Secretary. “Today all of the structures of the Almaden Air Force Station are gone, other than the Radar Tower”, said Drake. “Together we can preserve our local historical landmark for future generations.”
