A

t times it is easy to forget why we donate time or funds to charities. It is so much more than a tax write off. Yes, events are great - we enjoy them and it brings us around like-minded individuals. It is important, however, to appreciate people in need, as they come in many forms. It is with a saddened heart that we include a story this issue of a local teenager who is suffering tremendously and living life with constant pain and reminders that she is suffering an illness that will take her life prematurely, according to statistics. She does have a very humble wishlist and go fund me account and she let us include the information in her article. We also highlight two Almaden residents who selflessly raise money for others that are less fortunate and in some cases, terminally ill. It makes one realize there are so many individuals suffering who truly can not control their destiny. I am thankful we have so many caring neighbors, going the ‘extra mile’ in this community.

The College of Adaptive Arts by Shar Yorgey

he College of Adaptive Arts (CAA) is a cutting-edge model of engaging special needs adults in society who are typically regarded as having minimal skills and abilities. The CAA mission is to provide an environment where adult students with differing abilities can flourish and thrive while pushing the boundaries of their potential. CAA offers classes in the arts, health, and wellness to these adults of varying abilities. Classes are designed at appropriate difficulty levels to give them confidence in exploring areas of interest. The Executive Director, DeAnna Pursai and business partner/ Dean of Instruction, Pamela Lindsay, founded CAA in the summer of 2009. DeAnna was inspired by her sister (and best friend) Angel, who has Down syndrome. Angel’s talents are singing, performing, dancing and telling jokes. “One of my favorite stories that I love to share about Angel’s comedic gifts is the time that during her local prayer circle at church, sitting next to our mom in rural Indiana, Angel prayed out loud, ‘Dear Lord, please help my mom stop cussing!’”, said Deanna. Pamela Lindsay is a professionally-trained actress, singer and dancer. She has performed at Carnegie Hall and the Royal National Theatre in London. Pam was introduced into the world of special needs when her daughter, Valerie, was diagnosed with Asperger’s syndrome at the age of 9. Pam home schooled her daughter for 2 years, learning more about Asperger’s and autism. For her master’s degree, she researched how ‘teaching acting skills’ relates to teaching ‘social cognitive skills’ to persons on the autism spectrum. Watching how life opportunities diminished for both of their loved ones once they left high school, created a deep void of despair inside both DeAnna and Pamela. They saw so much potential in adults with special needs. They knew first-hand how gratifying it was to bring together adults with special needs through the medium of the arts. CAA’s motto is “A Lifelong Collegiate Experience Through Exposure, Education and Friendship.” Their first year they enrolled 9 students with differing abilities, where the course topic was Musical Theatre. That fall the number of adults grew to about twenty-five, and they offered classes in singing, dance, art and adaptive guitar. Today, CAA has 7 Schools within the College, plus an Education and Media Resource Library. Over seventy adults with differing abilities registered for classes this past quarter. Some register for one class; some take as many as 10 classes. Undergraduate diplomas are 60 units; graduate diplomas are 120 units. CAA is privately accredited. What is unique about CAA’s model is that it’s lifelong; once students graduate,

they are welcomed and encourage to enroll in another course of study. Over twenty-three classes are offered throughout the week in the Schools of Music, Dance, TV/Film, Art, Theatre, Communications and Health & Wellness. CAA has a cheer squad, a golf team and a Student Council. Aine, a 24 year old CAA student, has a hidden disability and was bullied all through high school. In addition, she was diagnosed with melanoma skin cancer. She became obsessed with cancer and quite depressed. Since Aine joined the College 2 years ago, she’s transformed the school into a place of positive joy with her love and exuberance by helping other students. She was just voted the new Student Body president, and her mother just reported that at their last visit with the oncologist for her clinical treatment study, Aine announced to her doctor, “I don’t have time for cancer!” CAA is a young, ambitious, privately funded start-up in Silicon Valley with hopes to find an ultimate space in society, possibly as part of the infrastructure of existing institutions of higher education as an equitable track for adults with special needs. One beautiful element of the culture is that over half of the CAA professors have special needs as well. CAA believes they are creating successful, contributing citizens through the arts. When typical folks and special folks gather and enjoy each other’s abilities in the arts, all of our human experience is more full, vibrant and alive. This approach is unique and systemic because the model taps the potential of many groups of adults with disabilities who are viewed and treated by the community as peripheral, marginal members. Their environment maximizes everyone’s talents and potential through motivating and interpersonal classroom, performance, and community experiences. By giving these adults the opportunity to gain self-esteem and confidence in their abilities through successful participation in classes and performances, they are able to positively respond in other areas of their life. Students are able to find their voice as they and their community recognize the value they can offer. Giving Back, Getting Noticed, & Making Changes Silicon Valley Cares

K

elly has been involved with non-profits for decades. “I feel that it is our duty to give back and I actually get so much out of it personally. I decided to start something different, something that didn’t focus on just one disease, one area, or one group of people,” shares Kelly Dippel. With Kelly’s event planning background and direct personality, she started a unique, fun, ‘no drama’ organization that brought people together and at the same time raised money for multiple organizations. Six years ago, she pitched her idea to a group of like-minded people and Silicon Valley Cares (SVC) was formed and the Broomstick Ball (BSB) came to life. The BSB is a unique Halloween costume party focusing on FUNdraising. There are NO live auctions and NO long speeches. What you can expect at the BSB is a delicious dinner, casino play, silent auction, entertainment, music and a group of guests and members that love to dance the night away. SVC just celebrated their 5th year of success. Since starting Silicon Valley Cares, the women-only membership has continued to grow to over 60 members and they keep it fun and 10 | 95120 Almaden Lifestyle Magazine

drama free. Their main focus is giving back to the community, but they also have socials, and networking amongst the members. “I love this group of women,” comments Kelly. Three years ago, SVC members added a golf tournament called the ParTee Classic and it is just that, a huge party with 18 holes of golf at Cinnabar Hills. This shotgun, best ball tournament includes lunch, dinner and (true to founder Kelly Dippel’s exciting and vibrant personality) almost every hole has a theme with costumed volunteers complimenting their theme.

Kelly’s hard work and dedication has amassed a handful of awards such as: 2011 Business Journal Women of Influence, 2014 Junior League of San Jose Certificate of Appreciation, 2014 City of San Jose Certificate of Recognition, 2014 County of Santa Clara Certificate of Commendation. Please Release Me

I

t happens all the time. You go to a go-cart track, join a gym, or sign you child up for an activity, and you are presented with a “release from liability” that you need to sign before getting started. What happens next? If you are like most people, you probably sign it without even reading it. But how binding is that document you just signed? The answer, as you might expect, is “it depends.” A release of liability is intended to prevent a lawsuit against the facility if you are injured, die or otherwise suffer physical or property damage while engaging in an activity. Generally speaking, a release will be enforceable to the extent you have assumed the risk of injuries reasonably related to (or inherent to) the activity in question. Using the go-cart example, by signing the release of liability, you are acknowledging that go-cart racing can be dangerous, and that you might crash, be crashed into, or flip the car, and that you could be injured (or even die) if one of those things occurs. By signing the release, you are also agreeing in advance not to hold the establishment responsible or financially liable for those injuries. However, not all releases are created equal. For example, what about when the injury results from something that is not a risk which is inherent to the activity? For example, suppose the reason you crashed the go-cart is because an employee at the facility negligently overinflated the tires, which in turn caused one of the tires to burst, resulting in you losing control and crashing the go-cart. A 1994 unanimous Supreme Court decision stated that “it is thoroughly unrealistic to suggest that, by engaging in a potentially dangerous activity…, an individual consents to (or agrees to excuse) a breach of duty by others that increases the risks inevitably posed by the activity…itself, even where the participating individual is aware of the possibility that such misconduct may occur.” Put another way, just because someone knows an activity is dangerous doesn’t mean they agree that the facility can abandon its duty of care. So, in those cases, does the release you signed still hold up? Determining if the release is still effective when the facility is negligent depends on other specific wording of the release. A release can only relieve a party from the consequences of its own negligence if the release does so in “clear, unambiguous, and explicit language,” meaning it is clear, to an ordinary person untrained in the law, that the document releases the facility from liability for your injuries, even those flowing from the facility’s own negligence. Given that most releases are handed to you at the moment you are about to engage in the activity (so you have no ability to negotiate the terms), any ambiguity or uncertainty in the release is construed against the drafter (i.e. the facility). Is the fact you never read it a basis to invalidate the release? Typically, claiming you never read the release is not a strong defense. If the release was presented to you along with a statement that “this is just for my insurance company” or similar language, that can certainly weaken the enforceability of the release, but you should not count on that doing the trick. Obviously, it’s always better to take the time to read the release. Know the extent to which you are releasing the facility, and realize that it may be from everything, even their own mistakes (negligence).

Julie’s Graceful Struggle with Cystic Fibrosis

W

hy is it that tragic occurrences happen to the most beautiful people inside and out? One of our dearly loved Almaden neighbors, 19 year old Julie Phillips, has been living day to day with immense amounts of treatments and medication to fight for her life. In the month of May alone, Julie shares, “I will take 560 enzymes and 250 vitamins. I will do 62 puffs of Advair, 124 puffs of Xopenex and 15 sinus rinses. I will spend 1,860 minutes doing breathing treatments; that’s 182 vials of medicine and 62 vest treatments.” Julie’s home nurse will come once this month to flush her port in her chest so she does not get any clots or infections. This struggle is due to a genetic disorder by the name of Cystic Fibrosis. According to researchers from cff.org, 70,000 people worldwide have this defective gene, but only 30,000 U.S. citizens have it---that is less than the population of San Jose, CA. The month of May, however, reflects an estimate of the past 228 months of Julie’s life. Julie has been fighting this battle to the best of her ability, but sometimes these treatments and ingesting hundreds of pills are still not enough as she finds herself being admitted to the hospital for a minimum of two weeks due to bacteria finding its way into her lungs or a drop in lung function. According to the Mayo Clinic staff, cystic fibrosis is an inherited disorder affiliated mainly with the digestive system and lungs. This disorder is life threatening as cystic fibrosis affects cells generating mucus, sweat and digestive fluids. CF turns an individual’s ordinary fluids from fine and slippery to thick and sticky, leading to blocking passages typically located in the lungs and pancreas. Because of constant treatments and repetitive hospital visits, Julie struggles to have the opportunity to travel. She has learned to fully appreciate the little things in life for she would rather be enjoying her day than being stuck in a

hospital room with little or nothing to do. Despite fighting a battle every day, Julie strives to live a normal life. Many individuals can understand the costly expenses after a hospital trip, but medical bills spanning over a lifetime can quickly consume someone’s budget. Finances have become even more difficult to keep on top of than before. Julie, with great support from friends and family, has been able to keep up with her treatments, but struggles to live a “normal” life like as it is difficult to afford things such as healthy food options to sustain her health from stores like Whole Foods and Stanford Shopping Mall food. Julie was hospitalized recently in the month of November (and December) 2014 for a whole month being left with hospital food and occasional home-cooked meals brought by her mother and friends. It is difficult to get Julie the meals due to the costly commute to Stanford and back not to mention buying so many pricey meals. There was a time where Julie’s best friend Hailey came to visit Julie, and when they ordered food, Hailey said, “once when we ordered pork chops from the hospital room service menu, they were not only cold when they got to Julie’s room, but when you poked the pork chop with your finger it was hard and rubber like.” This was one of the first reasons Julie created a GOFUNDME account. Julie wanted to be able to at least enjoy her meals while undergoing isolation in her hospital room, not being able to leave due to a life-threat of exposure to external bacteria in the hospital. Plus, being stuck in a hospital room for such a long period of time can be uneventful and tough; having some extra cash to meet some of Julie’s needs is extremely helpful when money is tight. Julie loves traveling, but often times, cystic fibrosis seems to get in the way of the possibility to go places making it difficult to successfully seek


out her goal. In eighth grade, for instance, her middle school, Los Gatos Christian, offered a New York and Washington D.C. trip that she was not able to attend. Most kids in her grade were given the personal choice to attend or not, but Julie’s choice was taken away as she could not partake with her fellow classmates due to a physical cause. Julie was diagnosed with a deadly bacteria in her lungs and had to have an I.V. stuck in her arm for two weeks to treat it. As she was here in California resting with her I.V. and taking care of her treatments, Julie missed out on what was said to be “one of the most memorable trips of a lifetime” with her classmates. More recently, Julie’s family traveled to Disneyland over winter break, but she was hospitalized for a month, and due to the isolation inconvenience, she was not able to make the trip. Even short trips to cheer on the San Francisco Giants or digging her toes in the sand at Santa Cruz are events she loves, yet are sometimes not possible for her to enjoy due to spontaneous hospital admissions. One of Julie’s huge goals is to be able to travel more throughout the world even though traveling is easier said than done due to cystic fibrosis. Being required to wear a mask in the airport and on multiple hour plane rides and having to lug around heavy medical equipment becomes difficult when traveling. In January 2014, the organization, Make A Wish, was able to send Julie, her mom and her 15 year old sister, Lynsey, to New York--she was finally able to live out her eighth grade trip without having to worry about costs and I.V. antibiotics! She dreams to not stop there with her travels, but to continue on to visiting New York again, Seattle and further to Italy, New Zealand and Alaska. She finds all these places astonishing and wishes to explore new cities. Julie is very passionate and appreciative of new experiences when she is given the opportunity to get out of the area. Throughout these hardships, Julie has learned to appreciate life to the fullest. As the positive and inspirational young woman she is, Julie not only takes her relationships with friends and family very seriously, but has grown to appreciate all the support gained from her loved ones such as her family, friends and even strangers. Julie has known Hailey ever since birth and finds herself blessed to have found an individual that has never left her side. Hailey believes her “favorite thing about Julie is whenever you see Julie enter the room, she is a bright light. Everyone knows there is something special about her”. Not only has Julie touched Hailey’s life, but she has touched all those around her; specifically others with cystic fibrosis. Although Julie is not able to meet others face-to-face with CF because they could share bacteria with each other, they have grown close relationships through meeting over social media. It is helpful to be able to reach out to others going through similar steps and support each other during the process. As I asked Julie how she has gotten through all of her many rough patches with cystic fibrosis, she told me her relationship with Jesus has been a huge part of her positive outlook on life. At the end of the day, it is her relationship with Christ who brings joy into difficult circumstances. Encouraging others and telling others about the abundant life, constant joy and never-ending hope found in Jesus has always been Julie’s passion. She will be transferring to California Baptist University this fall to begin her major in Christian Studies in hopes to become a well-known blogger and motivational speaker. By transferring to a private university and moving to a different city, she will not only be surrounding herself in an environment in which she loves, but she will further be able to check graduating college off on her bucket list! Before I knew about Julie Phillip’s sickness, she had already been an idol of mine since the first day I met her freshman year of Leland High School. She has the warmest heart and attempts to make everyone feel welcomed. Her humble personality can make anyone feel safe and comfortable around her. Once I learned about Julie’s sickness, she was not only an idol but a hero. In celebration of Cystic Fibrosis month, Julie approached me not only to write this article about her and her battle against CF, but to write it raising awareness for the other 70,000 individuals living with this life-threatening disorder. Because it is very rare, not many individuals have heard of this sickness let alone had an understanding of what these individuals have to go through every day just to stay alive. With a smile on her face, Julie continues to encourage others through social media, reminding people to not take life for

lmaden neighborhoods were caught off guard as they experienced spikes in burglaries during December of last year and into January of this year. December saw 56 burglaries and January experienced a 48% increase when the area was hit by 83 burglaries. Burglaries usually increase during the holidays because residents are busy preparing for the holidays and are oftentimes on vacation, but this spike was unusual. Residents noticed the activity and shared information with one another on Nextdoor.com and called Councilmember Johnny Khamis in January to report that an unusual spike was taking place. The councilmember asked his staff to organize a meeting so that residents could get up-to-date information from the police department along with crime prevention tips. He also called for a meeting with Chief Larry Esquivel of the San Jose Police Department (SJPD) to find out what the police department was doing to address the increase in burglaries. Chief Esquivel assured Councilmember Khamis that his police staff were moving resources into the neighborhood to address the spike in order to restore Almaden to one of the safest places in San Jose. The Community Safety Meeting occurred on February 11th, and Councilmember Khamis’ office partnered with a resident who had started her own effort to hold a community safety meeting to put on the event. The resident who helped organize the meeting had, herself, been a victim of burglary, on New Year’s Eve. Over 1,000 residents attended the meeting at Bret Harte Middle School. Chief Esquivel introduced his command staff and proceeded to clarify the facts connected with the burglary spike in Almaden. The chief shared that burglaries had increased 48% in January, for example. The good news that resulted after the chief implemented his plan of action was that burglaries dropped 57.8% in February and an additional 25.7% in March. The chief’s plan included burglary suppression cars on overtime who focus on patrolling the neighborhoods in marked police cars, truancy abatement cars that patrol the neighborhoods looking for school-aged youth who are supposed to be attending school, and crime prevention efforts - organizing neighborhoods into Neighborhood Watch groups. Councilmember Khamis also credits the residents for being vigilant and by utilizing networking tools, such as Nextdoor.com and Facebook, and video cameras to raise awareness and collect evidence which helped the police to catch numerous suspects. All of these efforts helped to drive the burglars out of Almaden. Residents who attended the Community Safety Meeting had asked questions regarding Realignment (AB 109) and Proposition 47 (Prop 47). These state legislature-instituted and voter-approved initiatives changed the law and resulted in 44,000 State prisoners being moved to our county jail systems. Prop 47 changed the classification of some felonies to misdemeanors and ultimately led to the early release of nonviolent prisoners into the community. Given the need for clarification to these changes in state law, Councilmember Khamis asked Senator Beall and Assemblymembers Low and Stone to present information to the public regarding these changes. On April 18th a Public Safety Forum took place at Westgate Church – South Hills Campus where the legislators participated in a panel discussion to present the facts associated with Realignment and Propositions 47 and 32. Derek’s Story - California Coast Classic

When asked what other efforts are being pursued by the city to drive down crime rates, Councilmember Khamis talked about the hiring of an additional 22 Community Service Officers for the next fiscal year, plus four supervisory CSOs. CSOs are not peace officers, but are very effective in handling duties that do not require a full peace officer. They can take reports and gather evidence for burglaries – commercial and residential, vehicle thefts - initial report and/or recovery, petty theft, grand theft, vandalism, non-injury traffic collisions, missing persons and road hazards. They can also direct and control crowds and traffic at accidents or special events including setting up cone and/or road flare patterns. The city is currently budgeted for 1,109 police officers and the department currently stands at 900 duty-ready sworn staff. The City Council has authorized the police chief to hold three police academies per year and they also approved a camera registry which the police have implemented to give residents a way to easily submit evidence to combat burglars. The SJPD is actively recruiting for new officers and new academy cadets. Councilmember Khamis stated that he is, “very encouraged that, after two years without anyone sitting down at the table to negotiate, the City now has a negotiating partner in the police union (SJPOA).” He also noted that he is “optimistic that with both parties sitting down at the table together, we can work to bridge our differences so that we can regrow the number of police officers that are on the job in San Jose.”

For me the California Coast Classic was to be a “once in a lifetime event.” I had for many years wanted to ride my bicycle down the coast of California – and combating Arthritis seemed like a good cause. So it was that I signed on to participate in the Arthritis Foundation’s 13th annual California Coast Classic. It proved to be such a fantastic event that I later signed up for a second year – and the experience was just as good, if not better. However, midway through the ride, I had firmly decided that, for me, this was it. The time it took me to raise funds, train, and participate in the ride itself was significant. Two years was enough. But then two things happened: First was an appeal made mid-tour by the mother of a 16-year-old girl who had Juvenile Arthritis. Her daughter had already had both hips replaced. Mom commended us riders for our dedication – and urged us to come back again – to continue our commitment to the cause. And then I met Jerry Davis, a man about my own age. Like me, he was riding for the cause. But for Jerry, it was personal: Jerry is the grandfather of a young boy named Carter (which also happens to be the name of our family dog). I couldn’t quit. Rev.
