he holiday season brings so much joy to most, and at this time it is important to think about the things in life you’re thankful for. We celebrated Thanksgiving last month, but keep thinking positively. Because of our holiday traditions (as well as television, advertising and radio) there is a big focus in the community on family, friends, goodwill, love and peace this time of year. With the holidays also comes obligations, commitments, gift purchasing, charity support, high expectations, sometimes painful memories, and pressure. Remember to slow down and not stress. Focus on the important things in life and don’t forget your health. Avoid worrying yourself into a frenzy if you forget a couple details. Stay peaceful. The community mourned a child recently, but also gained a newly joined family. It is part of our circle. I continue to be amazed at the support provided for all within Almaden. Soar with the Eagles! What do Sam Walton (Founder of Walmart), John Tesh, Ross Perot, President Gerald Ford and Astronaut Neil Armstrong have in common? They all earned the highest honor bestowed on a Boy Scout: The Eagle Scout. To become an Eagle Scout, the candidate must obtain the rank of Life Scout, live by the principles of the scouting oath and have recommendations from community members, complete 21 merit badges, have been in leadership positions within the troop, complete a community service project, attend a unit leader conference, and finally pass a board of review. All this must be completed before their 18th birthday. Josh McMillan, a sophomore at Leland High School, just completed his Eagle Scout project this summer. Josh has been scouting for most of his life starting as a Cub Scout. “For me, (the best part about scouting is) making new friends- meeting people I otherwise would not have met.” Scouting has provided Josh the opportunity to fish and camp and “get away from suburbia”. His project started with a goal to set up students for success. He wanted to share the opportunities he has enjoyed growing up in the Almaden Valley and set a goal of providing 20 backpacks to deserving students through The Family Giving Tree. (www.familygivingtree.org). To meet his goal, Josh planned a garage sale to raise funds. He used a community website to spread the word and received not only support through donations but also, thanks to community suggestions, expanded his event to include a recycling drive and bake sale. Josh did not just exceed his goal of 20 backpacks....he doubled it! Reece Hunter also just completed his Eagle Scout Project. At the age of 14, he is younger than your average Eagle Scout and comes from a long line

of Eagle Scouts. His project also focused on helping students with their school needs. Reece organized a school supply drive for Sacred Heart Charities. He worked with Sacred Heart Charities. (www.sacredheartcs.org) His two older brothers, Dylan (20) and Sklar (17) have completed their Eagle Scout; Skyler will be awarded his along with Reece sometime before Christmas. When asked what the best part of scouting was, Reece expressed his love of the outdoor activities and life-long friendships he has made. Three Eagle Scouts in one family is impressive, however, their father, Steve, is also an Eagle Scout. Steve has seven brothers; six of whom are also Eagle Scouts. His father and grandfather were also Eagle Scouts and also received the highest honors given to scouting adults: The Silver Beaver. Steve’s Grandfather, Howard W. Hunter was just the second Eagle Scout in the state of Idaho. “We love scouting because it is fun, but I also support it because of the values it upholds, which helps young boys to become responsible, contributing adults.” said Steve Hunter. There are currently 6 more Eagle Scout candidates working to complete their projects in the Almaden area troop 221 alone. They will join the likes of numerous governors, successful businessmen, Josh McMillan and Reece, Dylan, and Skyler Hunter and will make great contributions to our community!

lanning on hosting a party this holiday season? Whether a “social host” or an attendee, you should be aware of social host liability laws. Many states have social host liability laws which impose liability on the host when a guest is injured or causes injury while they are intoxicated, just as so-called “dram shop” laws in some states hold bars and alcohol retailers liable for injuries or deaths related to the actions of severely intoxicated patrons. California’s social host law, specifically in California’s Civil Code section 1714, is more limited. Specifically, it states “no social host who furnishes alcoholic beverages to any person may be held legally accountable for damages suffered by that person, or for injury to the person or property of, or death of, any third person, resulting from the consumption of those beverages.” The Golden State’s more restricted view of liability comes from a belief that the furnishing of alcohol is not the cause of any injuries resulting from intoxication, but rather the consumption is the proximate cause of those injuries. In other words, in California, everyone is responsible for his or her own actions while drinking, and those who cause or suffer injuries as a result of their intoxication have no one to blame but themselves. Of course, as with many laws, there are exceptions. For example, in California, an adult who knowingly furnishes alcohol to a minor may be found responsible if the furnishing of the alcohol is found to be the proximate cause of an injury or death. While you may not go to jail for serving alcohol (or allowing it to be served) to minors, social host liability related to intoxicated minors can still be significant. Medical bills and property damage can be expensive, and that liability may not be covered by your homeowner’s insurance policy. Liability can come in many forms. In a recent California case involving a 20 year old host, the intoxicated guest (also 20 years old) drove drunk and killed another teenager. The drunk driver is now serving 14 years for manslaughter. The parents of the deceased teenager sued the host of the party, and a lower court found the social host law did not apply since the host was a minor. However, the California Supreme Court later held that since the host charged a $3-$5 cover charge, the host was operating a “pop-up nightclub” and should be held to the same standards as a bar or nightclub.

Bottom line: The social host liability law is broad, but not always a shield to liability. The best options are obvious: do not to serve alcohol to minors, and to not continue to serve alcohol to intoxicated guests. Despite how obvious the options are, it’s not unusual to hear about parents desperate to be the “cool parents” serving alcohol to underage guests. It’s also not unusual for a host to be unaware that an adult guest has had too much to drink, particularly when they are busy with hosting duties and, quite possibly, somewhat intoxicated themselves. Statistically, over 30% of motor vehicle traffic fatalities are related to alcohol impaired drivers that’s an average of more than one fatality every hour. Keep your guests from being one of those, regardless of who ultimately might be at fault under the law! The above article is provided for informational purposes only. Assistance League of San Jose

Upcoming Events-

A

ssistance League of San Jose members will continue fulfilling their local community services throughout the Holiday season, as well as, have some social events to reward their hard work. Their busy schedule will also include fundraising activities to help support the variety of programs they perform. The annual festive holiday luncheon will be held on December 11, 2014 at the lovely Cinnabar Hills Golf Club. The members will be entertained and will be able to buy raffle tickets for the many beautiful items being raffled. On December 15, 2014 ALSJ members will operate a “Holiday Shop” at Family Supportive Housing. The Shop allows children from the housing unit to “buy” gifts for Christmas for their parents and for parents to “buy” gifts for their children. The gifts are all donated by ALSJ and various other organizations in the county. The children at Family Supportive Housing will also be treated to an enrichment program on January 10, 2015 hosted by ALSJ members. At the January 15th ALSJ general meeting a “baby shower” will be given. It is a way for the members to collect layettes, clothing, blankets and other items needed for the neonatal unit at Valley Medical Center. Beginning in January a number of fundraising events will take place that will hopefully augment the funds needed to accomplish all the community programs. There will be a “Dining for Dollars” day at California Pizza Kitchen on Wednesday, January 21, 2015. On that day 20% of all the sales for lunches, dinners and take-outs purchased by ALSJ members and the community who present flyers will go to ALSJ. Also in January the Direct Mail Campaign will get underway. This campaign is a major fundraiser for the organization. The ALSJ membership submits names and addresses of family members and friends who support the programs preformed by ALSJ. ALSJ then solicits donations from the names on the lists via the mail. ALSJ finds that there are many people who want to support such organizations as ALSJ, but do not know how to go about doing so. The Direct Mail Campaign affords individuals and corporations an opportunity to offer their support in the form of monetary donations. The theme for this year’s campaign is “Local Money for Local Causes”. ALSJ welcomes donations in any amount. Donations can be made out to Assistance League San Jose and mailed to P.O. Box 20174, San Jose, CA 95160. The second major fundraiser, Floral Fantasy, will take place at the Cinnabar Hills Golf Club on April 23, 2015. Floral Fantasy is an elegant and delicious brunch followed by a demonstration of flower arrangements by Kren Rasmussen, the owner and operator of Bloomster’s Florist. Kren is well known for his magnificent, unique and custom made flower arrangements. The arrangements are then raffled off to those attending. May 2, 2002 ­­– October 20, 2014 “My son Adrian was my first born, my pride and joy. He filled my heart with love from the moment I held him in my arms. From the time he was little boy he had the most gentle heart. Whenever we were at home he’d always be the first to ask me if I needed help around the house, he’d always offer to help me with the younger kids, with homework, or picking the house up, he never talked back or gave me attitude. He was so kind. Every time I turned around he’d be there with a smile on his face, or trying to scare me. He made me laugh. He was such a good boy, so gentle. He never gave me any problems, he was always respectful. Every time I hear a Bruno Mars song I cry, he walked around our house singing all Bruno Mars song. He was the kind of kid would walk up behind you give you the biggest bear hug that he could and quietly walk away without a word just a huge smile on his face. With Adrian being gone I’ve felt such a pain that I cannot begin to describe, my days are not the same, I don’t know that they will ever be, a huge piece of me went with him that day but as I reflect on the impact that Adrian had on so many I am overwhelmed. The love and the out pour that we have felt as a family from the community thru all of this has been amazing. The schools, the churches, the community as a whole my family and I are so grateful for all of the love and kind words that have been shared and the stories and memories that we continue to hear about Adrian, we truly cannot thank you enough.”

“As I close my eyes, I easily remember seeing Adrian’s kind, calm face on August 13th. On that first day of school, he quietly walked into my classroom and my life. Like clockwork, I saw Adrian’s quiet, shining smile bob through my classroom door every day at 12 o’clock noon just in time for lunch. He’s so shy, I thought. Boy, did I speak too soon. I witnessed Adrian’s love for others and his dedication to his friends – he was constantly trying to scare me or get my goat so I would scold him, and then he would just flash his sweet smile at me. “Hey,” he would call out to his classmates, “I have an idea!” and a mischievous, funloving look would come across his face – and sure enough, Adrian would lead a pack of sugar-fueled sixth graders in mission to scare, surprise, or shock their easily-spooked Language Arts teacher. When I remember Adrian, I remember a fun-loving, teddy-bear-of-a-kid with a heart of gold. The boy who was fiercely proud of his Native American heritage, the boy who softly, confidently sang Train’s “Hey Soul Sister” in a beautiful voice, the boy who cherished fishing and the outdoors…this boy was special. We all miss Adrian in room D-6, but he has left us something so beautiful and meaningful - it is the reminder that we all must honor and love each other as we move through life. Since Adrian’s passing, the transformation of my students has been bittersweet: they reach out to recognize and support each other, they encourage one another, they have grace for one another. This love was who Adrian was. I am grateful that I was able to get to know him.”
