Supreme Court Overturns Whitmer Emergency Powers; No Change in Recommendations for Dental Offices On Friday, October 2, the Michigan Supreme Court ruled that Gov. Gretchen Whitmer lacked the constitutional authority to extend the COVID-19 state of emergency or issue executive orders related to the state of emergency without approval by the Michigan Legislature. In response, Whitmer and the Michigan Department of Health and Human Services Director, Robert Gordon, filed a motion with the Michigan Supreme Court requesting it clarify that the October 2 ruling does not take effect until Friday, October 30. The court’s ruling does not affect requirements of or the liability that may be imposed by failures to follow state and federal laws (such as OSHA, MIOSHA) and CDC and other agency guidance.

What does this mean for dental offices? There should be no change in the way you practice as a result of this ruling. You and your staff should continue to follow all applicable CDC and OSHA guidelines as well as the ADA Return to Work Interim Guidance Toolkit and the MDA Addendum to the ADA Return to Work Interim Guidance Toolkit.
