LÓPEZ TOSADO Y LA SOCIEDAD LEGAL DE BIENES GANANCIALES COMPUESTA POR AMBOS Y AL PÚBLICO EN GENERAL: El suscribiente es Alguacil del Tribunal de Puerto Rico, Sala de Camuy, certifico y hago constar a la parte demandada y al público en general: Que en cumplimiento de un Mandamiento que he recibido por la Secretaria de este Tribunal, venderé en pública subasta al mejor postor, en moneda del cuño legal y corriente de los Estados Unidos de América, el día 20 de abril de 2017, a las 2:00 de la tarde y según pactado se establece como tipo mínimo de la Primera Subasta la suma de $123,250.00, todo el derecho, título participación o interés que tenga la parte demandada sobre la siguiente propiedad: -- RÚSTICA: Radicada en el Barrio Capáez del término municipal de Hatillo, Puerto Rico con una cabida superficial de MIL CIENTO TREINTA Y SIETE PUNTO SIETE MIL CUARENTA Y NUEVE METROS CUADRADOS (1,137.07049 M.C.). En lindes por el Norte, con camino municipal; al Sur, con remanente de la finca principal; al Este, con Isaias Torres; y al Oeste, con Avelino López Feliciano. Dicha propiedad se encuentra inscrita al Folio ciento veinte (120, del Tomo ciento ochenta y tres (183) de Hatillo, Puerto Rico, finca número nueve mil seiscientos cuarenta y dos (9,642). Catastro número: 0280 0 0- 00 4 -3 7 -0 0 1. B De d eclararse desierta la primera subasta, se llevará a efecto una Segunda Subasta el día 27 de abril de 2017, a las 2:00 de la tarde y se establece como tipo mínimo para dicha subasta la suma de $92,437.50 equivalente a 2/3 partes de tipo mínimo establecido originalmente. De declararse desierta la segunda subasta, se llevará a cabo una Tercera Subasta el día 4 de mayo de 2017, a las 2:00 de la tarde y se establece como tipo mínimo la suma de $61,625.00, equivalente a la mitad (1/2) del tipo mínimo pactado para la primera subasta. Al adjudicarse la buena pro el pago se efecturá en efectivo, giro postal o cheque certificado a nombre del Alguacil del Tribunal de Primera Instancia de Puerto Rico. Si se declara desierta la tercera la finca se adjudicará a favor de la parte demandante por la totalidad de la cantidad adeudada, si la cantidad adeudada es igual o menor al precio establecido en la tercera subasta. Al contrario, si la cantidad adeudada es mayor que el precio establecido en la tercera subasta, el acreedor podrá continuar haciendo gestiones de cobro al deudor(es). Los autos y los documentos correspondientes al procedimiento y presente caso estarán disponi b l e s e n l a S e c r e t a r í a d el Tribunal de Primera Instancia sala de Hatillo de lunes a viernes durante horas laborables. Dicha venta se llevará a cabo para con su producto servir a la parte demandante de la Sentencia obtenida en este caso en el Tribunal de Primera Instancia de Hatillo el 4 de abril de 2016 por el Honorable Juez Juan Carlos Avilés Feliú ascendente a la suma de $123,250.00, más las costas y gastos del procedimiento. Todo licitador o licitadora acepta como suficiente la titularidad y que las cargas y gravámenes anteriores y preferentes, si los hubiera, al crédito del ejecutante continuarán subsistentes, por lo que los acepta y queda subrogado en la responsabilidad de la misma, sin destinarse a su extinción en precio de remate. Desglose de cargas y gravámenes anteriores o preferentes, nombre de sus titulares y fechas de vencimiento, según surge de Registración Registral: No existe carga anterior o preferente, según surge en la Registración Registral expedida electrónicamente el 2 de noviembre de 2016 a las 12:13 p.m. firmada por la Lcda. María v. Jiménez Maldonado. Desglose de los nombre de los acreedores que tengan inscrito o anotado sus derechos sobre los bienes hipotecados, cargas o cualquier derecho real, pero con posterioridad a la inscripción del crédito del ejecutante y del cualquier persona interesada en, o con derecho a exigir el cumplimiento de instrumentos negociables garantizados hipotecariamente, siempre y cuando surjan de la Certificación Registral, para que concurran a la subasta de así entenderlo pertinente para satisfacer sus créditos. Los titulares de los créditos hipotecarios vigentes anteriores y posteriores a la hipoteca que se está ejecutando podrán concurrir a la subasta y utilizar el monto de sus créditos o parte del monto de esos créditos, en sus respectivas ofertas. Si la oferta aceptada es por cantidad mayor a la suma del crédito suyo tendrá que satisfacer la diferencia en el mismo acto de subasta en efectivo, giro postal o cheque certificado a nombre del Algua-

Además, tendrá que satisfacer el monto de la diferencia de cualquier otro crédito posterior al que se ejecuta, pero es preferente al suyo. El exceso constituirá abono total o parcial en su propio crédito. No obstante, la propiedad a ser ejecutada se adquirirá libre de las cargas y gravámenes posteriores. Y para conocimiento de los demandados, de los acreedores posteriores, de los licitadores, partes interesadas y público en general, expido el presente Edicto de subasta para su publicación dos (2) veces por espacio de dos (2) semanas consecutivas con un intervalo de por lo menos siete (7) días entre ambas.
