Our Mission:
The United States Swim School Association believes in the importance of life-long water safety, equipping individuals of all ages with the necessary skills and knowledge to thrive in aquatic environments. We bring together passionate people to share and inspire one another in support of better, safer swim school businesses.
For more than 35 years, the United States Swim School Association has grown to become the experts in learn to swim and we are proud to now represent all learn to swim programs, from private swim schools businesses to city aquatic departments, all have a place in the USSSA.

USSSA represents over 720 swim schools from the US and around the world, who teach over 20 million swim lessons per a year. We are a swim school business focused network of decision makers. MARKETING & EDUCATION
Water Safety Month Title Sponsor
A nationwide campaign designed to promote the importance of learning to swim. Campaign to include marketing materials for members as well as a month-long social media series on drowning prevention and encouraging the community to sign up for swim lessons and learn about other layers of protection. Sponsorship would include recognition and promotion of the sponsor on marketing materials and social media in conjunction with the campaign.
Public Service Announcement Video & Social Media Campaign
A new video will be created as a free resource for members, highlighting the importance of learning to swim as a lifelong skill and a safer activity for children to participate in. Sponsorship would include recognition and promotion of the sponsor within the video as well as social media campaign with the opportunity to cross promote.
One Conference Registration Scholarship
Give the gift of education to a swim school owner. Travel can be expensive and giving away a conference registration could be the difference in getting a swim school owner to the conference to experience all the education and networking we have to offer. OUR AGREEMENT
These United States Swim School Association General Terms (the "General Terms") are entered into as of the effective date set forth in the separate written Agreement between the United States Swim School Association, an Arizona nonprofit organization (“USSSA”) and you (the "Supplier") to which these General Terms are attached. Capitalized terms not otherwise defined in these General Terms shall have the definitions given to them in the Agreement. In the case of a conflict between the terms set forth in these General Terms and those set forth in the Agreement, the terms set forth in these General Terms shall control.
FEES. USSSA shall pay Supplier the fees specified in the Agreement (if any). Unless set forth otherwise in the Agreement, Supplier shall invoice USSSA for fees on a monthly basis and USSSA shall pay such invoice net thirty (30) days from receipt of invoice. All invoices shall be itemized and include the correct services or deliverables description, quantity, and fees. If USSSA disputes any fees, USSSA shall pay the undisputed fees when due and may, at its option, withhold the disputed amount pending resolution of the dispute. The parties shall work together in good faith to resolve any such dispute and, upon resolution, USSSA shall promptly pay any disputed fees mutually determined to be owed. Supplier will continue performance under the Agreement while the dispute resolution process occurs.
TERMINATION USSSA may terminate the Agreement for its own convenience upon written notice to Supplier. Unless other termination for breach rights are set forth otherwise in the Agreement, either party may terminate this Agreement immediately upon written notice to the other party, in the event that the other party has materially breached this Agreement and failed to cure such breach within thirty (30) days after receiving written notice thereof from the terminating party. Termination shall not limit either party from pursuing any other remedies available to it, including injunctive relief. Any terms of this Agreement which by their nature are intended to extend beyond this Agreement’s expiration or termination, will remain in effect until fulfilled and will apply to the respective successors and assignees of the parties.
TRADEMARKS During the term, USSSA hereby grants to Supplier a personal, limited, non-exclusive, non-transferable and non-sublicenseable right to use and display the USSSA trademarks solely in connection with performing the services. This license grant is conditioned upon (a) Supplier following USSSA's Brand Guide and other trademark usage requirements and (b) Supplier obtaining in each instance USSSA's prior written approval for the contemplated use.
INSURANCE. The Supplier agrees to maintain adequate insurance coverage, including general liability insurance, during the term of this Agreement. The insurance shall cover any claims or liabilities arising from the Supplier’s participation in USSSA events. The Supplier shall provide USSSA with a certificate of insurance upon request, evidencing the required coverage. The USSSA shall be named as an additional insured on the Supplier’s general liability policy. The Supplier agrees to comply with all applicable laws and regulations related to the required insurance.
WARRANTIES Supplier represents and warrants that (a) all services will be performed in a professional and workmanlike manner, by trained professionals experienced in providing such services to USSSA’s reasonable satisfaction; (b) any services or deliverables will operate, perform and/or conform to the descriptions and specifications provided by the Supplier to USSSA concerning such services or deliverables; (c) Supplier has the right, power and authority to enter into the Agreement and bind itself through the party set forth as signatory for such party; and (d) Supplier’s execution and performance of the Agreement will not violate any laws, ordinances, covenants or the provisions of any other agreements binding on Supplier, including without limitation not infringing the intellectual property rights of any third parties.
INDEMNITY Client shall indemnify, defend and hold USSSA, its officers, directors, members and affiliates (the "Indemnified Parties") harmless from any and all losses, damages, liabilities, costs and expenses, including reasonable attorneys’ fees and court costs, arising from or related to: (a) any claim, action or proceeding against the Indemnified Parties alleging that the services or deliverables, or any portion thereof, or the exercise of an Indemnified Party of its rights under the Agreement infringes, misappropriates or otherwise violates any privacy or intellectual property rights of any third party; (b) bodily injury, death or property damage arising out of or resulting from the services or deliverables; (c) negligent or willful acts or omissions of Supplier or its employees or agents; or (d) Supplier's failure to perform its obligations or breach of its warranties under the Agreement.
LIMITATION OF LIABILTY EXCEPT FOR A PARTY'S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL EITHER PARTY BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PERFORMANCE OF THEIR RESPONSIBILITIES UNDER THIS AGREEMENT, EVEN IF THE PARTY CAUSING SUCH DAMAGES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. The allocations of liability in this section represent the agreed and bargained-for understanding of the parties and the compensation for the services reflects such allocations. The limited remedies set forth in this Agreement shall apply notwithstanding the failure of their essential purpose.
GENERAL PROVISIONS. The failure of either party to enforce at any time any of the provisions hereof or exercise any right or option hereunder shall not be construed to be a waiver of the right of such party thereafter to enforce any such provisions or exercise such right or option. Any consent by any party to, or waiver of, a breach by the other, will not constitute consent to, waiver of, or excuse of any other different or subsequent breach. The Agreement may be executed in any number of counterparts and by facsimile, each of which and any copies thereof will be an original and all of which shall constitute together one and the same document. The Agreement contains the entire agreement of the parties with respect to the subject matter hereof and supersedes all previous understandings and agreements, either oral or written, between the parties with respect to said subject matter (except that any separate nondisclosure agreement between the parties shall continue in effect). The Agreement may not be altered, modified, amended, changed, rescinded or discharged in whole or in part, except by written agreement executed by both parties. No preprinted terms or other provisions contained in any purchase order (or similar document such as an order blank or copy instruction) submitted by Supplier will in any way serve to modify or add to the terms of this Agreement If any term, condition, or provision in this Agreement is found to be invalid, unlawful or unenforceable to any extent, then the meaning of said provision shall be construed, to the extent feasible, so as to render the provision enforceable.
GOVERNING LAW
This Agreement, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Arizona without giving effect to any choice or conflict of law provision or rule (whether of the State of Arizona or any other jurisdiction). Any legal suit, action, or proceeding arising out of, or related to, this Agreement shall be instituted exclusively in the federal courts of the United States or the courts of the State of Arizona, in each case located in the City of Phoenix and County of Maricopa. Supplier waives any and all objections to the exercise of jurisdiction over Supplier by such courts and to venue in such courts.
