I’ve been contacted by another agent who claims to have buyers for my house and says he has someone desperate to view. What should I do?

A

This is a regular occurrence when other agents do not have many instructions of their own and the first question that comes to mind is why? Is it because they have not proven themselves with a good track record in selling property in the past to win the instruction in the first place? This is called ‘touting’.

The main issue here is that when someone appoints an agent to sell their house on their behalf, and that agent is openly marketing it, they have won the trust of the client and have been given the mandate and as such the vendor is responsible for the selling agent’s fee.

The other agent will clearly know this – otherwise how will they know the property is for sale in the first place? – and rather than contact the main agent to see if they will share their fee, will contact the vendor in the hope they can earn the whole fee themselves, thus putting the vendor at risk of being potentially liable to pay two sets of fees.

The best thing for the vendor to do is politely point the second agent in the direction of the first agent and let them come to an arrangement over fees. If the second agent persists, just remember that as the vendor you have no obligation to let them in, and that their calls could amount to becoming a nuisance. This may be reported to the Information Commissioner, who may take action against them.

marketview The FTSE has rallied recently but most people I speak to have lost confidence in the stock market, reports property finder Robert Bailey.

It had five years of little growth and it has proven to be very volatile. I think people simply feel more comfortable with tangible assets now. Although property markets can rise and fall, as well, investors have some degree of control. A down at heel property can be renovated to attract a better tenant. Investors can make informed decisions on which property to purchase based on future infrastructure plans or migration patterns.

With stocks and shares, however, investors have less control over the companies in which they invest. Many people are not just concerned for their own investment portfolios but about how they invest for their children.

Junior ISAs were launched a couple of years ago and by almost any measure have been a disappointment. They may be a tax-free means of saving for a child’s future but what is the point if there is little return on investment?

Perhaps it is no surprise that parents are now looking to buy a property for their children instead. For years we have heard of parents buying a student property when their children set off for university, or gave them a deposit when it came time for them to buy their first home. More recently, though, I have had parents who have looked to buy their children a flat or house before they have even entered nursery.

The parents’ reasoning is that property is only going to increase in value over the next couple of decades and if they invest in property now, not only will the rental returns ensure they can give their children a mortgagefree property when they reach adulthood, but they can also avoid all sorts of countless inheritance tax issues.

As even the current generation of young professionals is being called ‘generation rent’, I think it is highly unlikely that today’s youth stand a realistic chance of getting onto the housing ladder without some form of parental assistance. University graduates finish with crippling levels of debt then face months or even years of unpaid work experience before finally gaining a permanent position with a pitiful starting salary. Even if they can afford their own home, chances are it will be in what can only euphemistically be called an ‘up-and-coming area’.

You do not have to be a maths genius to figure out that putting down a deposit on a flat at 2013 property price levels is going to be a damn sight cheaper than giving a child a deposit on a house in 2035. It can also help families on a more practical level, too. One family who has done this really did not relish the prospect of sharing their home with a live-in nanny so have simply installed her in their ‘son’s flat’. When their son is a little older, it will be let on the open market.

I do not have children myself but if I did, I would definitely be following my clients’ lead. Property trumps a Junior ISA any day.

Buyers are drawn in by the vast green open spaces, pretty garden squares and attractive houses. SHOPS Shopping in Kensington is varied.

Kensington Church Street has a wealth of beautiful antique shops and unusual boutiques, whereas Kensington High Street has most of the well-known chain stores. Additionally, the famous Whole Foods Market is a great attraction, selling everything from regional cheeses to handmade chocolates.

TOP STREETS Kensington Court, with its beautiful redbrick period architecture, is one of my favourite addresses for apartments, along with other streets such as the cherry-tree-lined Palace Gardens Terrace or Sheffield Terrace and Gloucester Walk, which share a wonderfully secret communal garden.

Here, the best apartments are now achieving circa £2000 per square foot.

Campden Hill Square, where Savills are selling a beautiful house for £6.95 million with private front and rear gardens, also has fantastic communal gardens, and being on the side of a hill it has excellent views as well. Properties in Cottesmore Court also tend to sell well. We are about to launch a seventh floor apartment here

that has views from the Royal Albert Hall to Battersea Power Station, and even all the way over to The Shard.

RESTAURANTS While Kensington offers a huge variety of restaurants, bars and pubs, my personal favourite continues to be Kitchen W8 on Abingdon Road, which has one Michelin Star and serves French and European food. Other favourites continue to be Launceston Place, the long-standing exclusive restaurant, and the Churchill Arms, perhaps the most famous and atmospheric pub in Kensington.

LEISURE If you are a keen runner, Kensington Gardens is a fantastic space.

There is the Round Pond and Princess Diana Memorial Fountain and Playground, complete with Pirate Ship! We also have the Royal Albert Hall, showcasing everything from ballet and opera to Cirque du Soleil and John McEnroe at the annual Seniors Tennis Tournament. Also nearby is the famous Electric Cinema on Portobello Road.

SCHOOLS Kensington has an excellent choice of prep and secondary schools.

Some of the most popular are Thomases and Hawksdown House, as well as Wetherbys and Pembridge Hall in Pembridge Square.

TRANSPORT The tube from Kensington High Street provides a fast service to both the City and West End, while there is also quick and easy access onto the M3 and M4 for those looking to get out of town on the weekends.

With the press making wild allegations about the London property market, it is hard for those outside the industry to know where the market stands at the moment.

The Chelsea and Knightsbridge market has seen change over the last 18 months.

The beginning of 2012 was somewhat of a bull market where, with stock in short supply and motivated buyers, there was competitive bidding on many properties.

The introduction of stamp duty changes and the Annual Tax on Enveloped Dwellings (the annual charge levied against properties owned by non-natural persons) announced in the spring and autumn last year brought a cloud of hesitancy to the market with transaction levels dropping steeply.

However, that cloud is now lightening in colour and the market is showing resilience. A strong start to 2013 from domestic buyers, coupled with ongoing financial instability elsewhere in the world, means money is coming into London every day. What better asset to buy than bricks and mortar?

With good properties still in relatively short supply, prices are being pushed up, as are rents. However, vendors beware – if you are thinking of putting your property on the market, accurate pricing is key.

Buyers are generally very educated and understand the market, meaning overpriced properties are sitting around with little interest.

The asking price of a property can be used as an effective tool to guide buyers and generate viewings rather than discourage, resulting in competitive bidding that often exceeds expectations.

The mood of the market in recent months has been one of more focus - a prime example being a flat Maskells have just agreed the sale of in South Kensington. The property was priced to attract a high level of viewings, which we duly did. After nine offers in a short space of time, the flat is under offer to a cash buyer wanting to exchange in five days.

Two comparable properties in the same area could vary greatly in price due to the impact of a sunny garden, according to a new Marsh & Parsons’ study.

“We advise clients with south or west-facing gardens, roof terraces or on garden squares to launch their properties during warmer months, because outside space adds real value to their property,” argues Lulu Egerton from Strutt & Parker.

If a homeowner can do anything to spruce up a space - whether it’s flowers in pots or mowing a lawn – it all helps. “First impressions are important, and creating a peaceful and attractive outdoor area that looks easy to maintain will without doubt help a sale,” she adds.

George Franks at Douglas & Gordon notes that, regardless of size, outdoor spaces are crucial as they provide additional summer living space and become the ‘second sitting room’.

“We’re increasingly seeing well designed outdoor areas with innovative design features such as automatic watering systems and solar-powered lighting,” he explains.

And if there’s space, male buyers like the idea of having a shed to be used as a small home office, or a place where they can escape, Franks points out.

Don’t over-complicate things, advises Nicholas Spencer at Henry & James’s Chelsea Green office.

“You might be a gardening god, but chances are your purchaser won’t be. So keep it simple, green and clean.”

In a small garden, consider decking, paving or even high-quality artificial grass. “A small patch of real grass can look like a Glastonbury mud pit,” Spencer explains.

He also recommends bamboos and creepers to extend your garden up and over walls. And garden mirrors and trelliswork break up bare walls.

Yet whatever you do, don’t install Buddha heads.

“They are the new gnomes,” warns Spencer.

Tips for sellers • Upkeep of a garden can be seen as a bind, so present it as low-maintenance.

• Aim for box hedges and planters, rather than trees or borders – they look smart and can be replaced easily, if necessary.

• Irrigation systems allow plants to be watered automatically and don’t require the owner to be there.

• Mirrors and lights work particularly well in courtyards and smaller gardens where they can be made into a feature. And they require virtually no maintenance.

Currency call No wonder London prices are rising, says Duncan Farmer prices and interest rates, is fraught with danger but the consensus among analysts and economists is that low interest rates will still be with us at least until 2016, which in turn will help domestic buyers with only the poor pound in their pocket.

The European Central Bank has recently cut its rate to 0.5 per cent in line with the Bank of England, and the money markets also point to low rates.

Swap rates – the level at which banks lend to each other – have remained remarkably unmoved by recent fears of inflation, triple-dip recessions and conflicting growth figures. A year ago five-year swaps were at 1.49 per cent and today stand at 1.06 per cent; two-year swaps at 1.68 per cent against 0.59 per cent today; and one-year swaps at 1.31 per cent compared with 0.59 per cent now.

Those figures all show that interest rates are unlikely to rise, and there seems to be general agreement that if they do climb, that will not happen until 2016 or 2017, and even then the rise will be just one quarter of a percentage point. Although the Bank of England’s Monetary Policy Committee, which sets interest rates, regularly discusses a cut and even a move to negative rates, this is unlikely to happen.

Lenders are also putting their money where their mouth is, and both Clydesdale Bank and Hinckley & Rugby Building Society have tempting five-year fixed rates at 2.89 and 3.35 per cent respectively.

Since their fall in 2008, average house prices in London have risen by 17 per cent, but in the five years since then the value of sterling has fallen so much against most currencies that, for example, anyone buying a house today with US dollars is paying seven per cent less than in 2008.

Buyers with euros, yen, Swiss francs and Chinese yuan are enjoying similar discounts in real terms, so it is no wonder that the capital’s market is continuing to boom and prices are rising. Knight Frank, which carried out the currency research, forecasts that London property values will continue to climb and that five years from now they will be another 26 per cent higher than they are today.

The rise in world stock markets is also giving wealthy investors food for thought.

Not only is the FTSE 100 approaching levels last seen at the peak of the dotcom boom, but the Dow is surging too and, at the time of writing and in spite of recent sharp falls, the Nikkei is more than 40 per cent higher than it was last autumn.

That is good news for anyone with money in the markets and for anyone working in the City, and may well be why a YouGov poll reported that confident buyers in the Square Mile believe prices will rise faster in their borough than in Hammersmith & Fulham, Richmond and Kingston. Only inhabitants of the old favourites of Kensington & Chelsea and Westminster were more optimistic.

Forecasting anything, let alone property

Healthy appetite The latest Nationwide House Price Index shows that in May average property values climbed another 0.4 per cent.

Brian Murphy, head of lending at Mortgage Advice Bureau, says the introduction of the Government’s Funding for Lending and Help to Buy schemes has helped boost demand, but adds that good mortgage deals are also doing their bit to help would-be buyers.

“Another increase in house prices during May adds up to a positive outlook for the market as property prices reach their highest level since July 2011,” he says. “Buyer confidence is being fed by some of the best fixed rates seen since 2007, which are helping to satisfy the growing appetite for a great mortgage deal.”

Lenders loosen up The mortgage war has been well documented, with rates falling to all-time lows, but rather than continue to undercut each other and slash their margins further, some lenders are now starting to loosen criteria, which is welcome news for borrowers, particularly the selfemployed.

Since the downturn, contractors have found it difficult to get a mortgage with lenders preferring employed borrowers to those who are selfemployed. But this month two lenders changed their policy, says Mark Harris of SPF Private Clients.

“The Halifax will now offer its standard mortgage range to contractors other than those working

in IT, as long as they have been contracting for a year and earn more than £500 per day, or £75,000 per annum,” he says. “Meanwhile, Clydesdale has added engineering to its list of acceptable contractors, subject to a minimum income of £75,000, and lowered the minimum income for banking contractors to the same level.”

All banks are beginning to loosen their criteria in an attempt to increase their lending volumes.

This is great news for borrowers such as contractors who have often struggled to get a mortgage in the past few years because they did not meet lenders’ standard criteria.

It’s good to talk if you’re on an interest-only mortgage

Borrowers with buy-to-let mortgages have been told not bury their head in the sand, but to talk to lenders about how they plan to repay their loan when it comes to an end.

Interest-only mortgages have long been popular with wealthy housebuyers who have shares and other investments, and who regularly earn large bonuses, but they have come under fire in recent years and most mainstream lenders have pulled out of the market.

The Financial Conduct Authority, the regulator that replaced the Financial Services Authority, is now working with the Council of Mortgage Lenders to ensure that borrowers do not come to the end of their loan without the means to clear the capital they owe. Some estimates say there are 1.7 million borrowers at risk with an average shortfall of £72,000.

More worryingly, one in ten borrowers has no plan to repay their loan. The problem for many interest-only borrowers is that switching to a repayment loan is usually expensive, so lenders are being urged to find ways to cushion the blow.

Mutual attraction Leading estate agents are to launch a new property portal, the first to be run by agents. The new company, Agents’ Mutual, has hired PrimeLocation founder Ian Springett to draft the business plan and drive the creation of the new site.

“Our site will be the first portal fully owned by agents, since the sale of PrimeLocation, and it will become a serious competitor to the sites already in existence,” said Ian Springett.

“The site will not be driven by the need to maximise financial returns to shareholders – which has driven up listing fees for agents and consumers on some other sites – but will instead create the best high-quality property search service,” he said.

“We believe there is a lack of choice in the market, and we know agents are very keen to see an alternative to the current property portals. The Agents’ Mutual site will not only offer a better quality of listings, but the ongoing costs will be limited to agents.”

Founding members of the new venture include Chesterton Humberts, Douglas & Gordon, Glentree Estates, Knight Frank, Savills, and Strutt & Parker, whose offices total 240 across the UK. Agents’ Mutual is currently asking for expressions of interest from agents who would like to sign up to the new service. The name of the property portal itself has yet to be decided.

North Wharf goes forth A new development scheme for North Wharf Gardens in Paddington has been given the go-ahead by Westminster City Council.

With a construction value of £70 million, the mixed-use scheme for Amwaj Property will deliver 150 residential apartments – including affordable housing – as well as retail, business, social and community space and improved public realm.

The application is the first part of a wider masterplan

by Assael Architecture for the former North Westminster Community School site covering 1.48 hectares in Paddington, Westminster. Site 1 will start on site later this year, with completion due in 2015.

Another decade of high demand Demand for housing in London will outstrip supply by 48 per cent over the coming decade, according to research by Knight Frank.

Despite a substantial increase in new residential development activity in many areas of London, analysis of the planning and construction pipeline confirms that supply will still fail to keep up with demand between now and 2022.

Household growth in London is expected to be much greater than previously anticipated, according to recent DCLG data. Knight Frank’s ‘London Calling – London Residential Development Report 2013’ is said to be the first report to take account of these upward revisions.

Gráinne Gilmore, Knight Frank head of UK Residential Research, said: “There is widespread recognition of the housing shortage in the capital, with the mayor pushing hard to encourage higher levels of development.”

Wind of change Wind Sculpture, a new work by British-Nigerian artist Yinka Shonibare MBE, pictured, is due to be installed as part of the new Howick Place development in Victoria.

The sculpture will echo the sails from his Fourth Plinth commission in Trafalgar Square, Nelson’s Ship in a Bottle, now on permanent display outside the National Maritime Museum, Greenwich.

Homes with pools make a big splash in summer When the sun shines and the weather is warm, homeowners with a pool are the envy of their neighbours. But when the skies are grey, outside pools in particular can be viewed with caution by potential buyers concerned about the upkeep and running costs.

So in the current housing (and meteorological) climate, what appeal does a pool hold? “A pool is rarely a specific request from buyers but definitely a bonus, especially if the house is centred around the pool, it is contemporary and has openings onto terraces or gardens,” said Clive Moon, head of Savills Wimbledon.

“An indoor pool, which can be used all year round, will have particular appeal. It can provide constant amusement for your children and their friends during school holidays, and will suit those with a thirst for exercise who want to keep fit without leaving home.

Indoor pools also add a feeling of exclusivity, and at the very top end of the market, buyers have come to expect a pool as standard,” he said.

“If they are poorly maintained or the water is discoloured, external pools can have limited appeal and buyers may assume there is a significant cost implication for updating. However, modern units with efficient boilers are much cheaper to run.

“It’s hard to imagine on a grey day, but when we do get a hot summer, al fresco dining around an outdoor pool takes on a different perspective entirely. Providing it is dressed accordingly with flood lighting, a clean, well-kept pool can be enough to entice any buyer.”

Rock star status Best known for medics and professionals, the Marylebone district was once the place to spot celebs only if they were topping up their Botox. But now, says interior designer Linda Plant, the area is a playground for rock stars and actors.

Linda is a big fan of the area and has sold her Regent’s Park property to focus exclusively on Marylebone. She runs high-end interior design company Homerun Services, and has designed the homes of A-list Hollywood elite and international royalty, but apartments at Devonshire Place hold a special place in her heart due to the unique nature of the building and its interiors.

“Byron lived in the area and Paul McCartney wrote Yesterday nearby,” says Linda. “Obviously now Madonna lives just up the road, but this space has some fabulously austere buildings that are being snapped up by artists and musicians.”

Royal Pembridge Royal princes William and Harry were both educated behind the red doors of Wetherby School. The press photographed them in their distinctive grey and red uniforms on the school steps with their mother, Princess Diana.

Founded in 1951 in Wetherby Place by Mr and Mrs Gerald Russell, the pre-preparatory school moved to its present site in Pembridge Square, Notting Hill, in 1971 and uses the square’s central gardens for supervised playtimes. Other illustrious former pupils include composer Sir Andrew Lloyd Webber and actor Hugh Grant.

Pembridge Square itself was developed by builders William and Francis Radford between 1856 and 1864 in their trademark style of resplendent stucco-fronted Italianate villas.

Today the gardens remain under the watchful eye of the Pembridge Association. Opened after his demise, a sealed letter written to the association in 1976 by garden trustee William Irving instructed: “The garden should continue to be maintained as an ornamental oasis for the relaxation of authorised users, considered now to be more important than ever having regard to the increasing speed, noise and stress of London life.”

Cobbled Pembridge Mews nearby, on the other side of Pembridge Road and Pembridge Villas, was the work of builder William Cullingford from 1848 to 1851. Comments on New Zealand Real Estate market...

The New Zealand Real Estate market has gone through some remarkable changes over the past 12 months.

In over 30 years of real estate practice I have never seen such a diverse residential market place.

As a real estate agent, consultant, commentator and active auctioneer I have the opportunity to witness the various dynamics as I assist my clients through the market changes.

The following factors have made a real impact as supply and demand issues show up.

1. We have historically low mortgage rates, with some one-year fixed rates below 5%.

2. The national median price rose 7% in the year ending 30th April 2013 and sales numbers in April this year were up 25% on a year ago.

3. Internal migration for employment and commerce to Auckland, where there is a distinct shortage of houses, resulting in a rise in the median price over the last year of 13%.

4. The shortage of homes in Christchurch, as the result of the recent major earthquake, seeing a rapid rise in the median price by 10% in the year ending 30th April 2013.

5. Now there is further demand as migration to Christchurch increases because of the opportunities offered as the “re-build” gains momentum.

There has been a reluctance in Auckland to open more land for residential areas outside the current metropolitan area and this has caused land values within the current boundaries to rise as demand has risen. Now there is a serious shortage of existing and new dwellings.

This has created a dynamic market where now nearly 40% of all residential sales are conducted by auction, with often very competitive bidding.

This rapid increase in the major metropolitan areas has seen some homeowners “cashing up” and moving to provincial centres where homes are much more affordable. This new trend is now starting to impact on the values in these areas too, though at a much lower level than Auckland and Christchurch.

Lettings Lowdown Special report by Nicky Chambers, associate director of Douglas & Gordon Chelsea Lettings Demand for rental properties in prime central London has at last begun to rise, and with summer approaching too this is good news at last for landlords.

Tenants have certainly had the upper hand recently: a great selection of properties to choose from, combined with many nervous landlords, has caused some rents to fall. There is still an oversupply of one and two-bedroom flats so these landlords will still have to be flexible with pricing and meeting tenants requests.

It is more important than ever to ensure that your properties are well presented and to ‘look after’ your tenants, or make sure you have a good managing agent.

Properties that are ‘dressed’ consistently achieve the higher rents, and we advise making this investment at the start as it has saved many of our landlords from lengthy voids.

Rents at the higher end of the market are holding their own. Despite the reduction in corporate tenants and budgets being squeezed, many tenants are renewing their leases and there seems to be a healthy match between supply and demand.

On the other hand, outside prime central London there is great demand for both flats and houses, with most of these being let after just one or two viewings, which is leading to a lack of supply in some areas.

It has definitely been a market of two halves, but hopefully with the renewed energy in prime central London, landlords here should start to feel more positive.
