The Smokehouse Creek Wildfire

Early this year, tragedy struck the Texas Panhandle as the Smokehouse Creek Fire ravaged over 1 2 million acres of land The fire, which caused $123 million in preliminary agricultural losses, burned for nearly 3 weeks. The destruction affected more than just the land; it disrupted the livelihoods of those who rely on farming and ranching for their income. The loss of infrastructure, crops, and livestock has posed challenges as families work to rebuild their lives and restore their operations.

I had the chance to speak with Sam Craft, Associate Director of Visual and Multimedia for Texas A&M Agrilife Marketing and Communications, who was on the scene during the fire, capturing photos and communicating with the response relief teams who came to help. Craft has been a photographer for over 25 years, and has worked in journalism for over 10.

“I was there to document what was happening from the lines of Texas A&M AgriLife,” Craft told me “For me, that's showing Texas A&M AgriLife extension folks doing their part by helping the community, giving out resources, trying to get cattle, livestock in general, saved and rounded up.”

As efforts to contain the fire continued, life went on for the local community as they did their best to pick up the pieces and help each other. As the fire moved, oftentimes the Agrilife team had to travel 30 minutes to an hour to reach where the actual flames were. However, the damage was evident everywhere Craft gave me insight into what it was like in the small towns that were affected, explaining he and his team would go into little cafes for lunch and overhear conversations from the people who had lost everything.

The Disaster Assessment and Recovery (DAR) unit in The Texas AgriLife Extension was on sight during the fire as well as animal vets, volunteer firefighters, and the Texas A&M Forrest Service. Everyone sprung into action to help out the community while the firefighters battled the flames

Craft explained to me how he managed to get close to the action “You can't just roll up onto a fire and start taking pictures like that. You have to know people. You have to have the access. A lot of that is on private land.” With over a decade of experience capturing natural disasters such as this, Craft was able to maneuver the front lines while safely navigating around the firefighters, team members, and the fire itself “You have to be aware of your surroundings You have to be careful,” he said “At one point we had parked our car in the safe zone, so to speak, at one point I looked up and the truck was entirely covered in smoke and I couldn't see it and I was 20 feet from it.

“I don't think a lot of people realize how dangerous these fires really are,” he explained, “not just for the actual people and livestock, but for the people fighting those fires ”

The Smokehouse Creek Fire has been dubbed the largest wildfire in Texas history, burning roughly 1 million acres in the first 3 days. This topped the East Amarillo Complex Fire in 2006 which burned over 907,245 acres of Texas land.

“The panhandle fires were the fastest moving fires that I'd ever been around,” Craft remarked. His photos brilliantly captured the scale of the destruction, which brought awareness to the needs of the community that suffered so much loss “A lot of our images, even stuff that you ' ve seen generate more resources ‘cause you really don t know what is happening until you actually see it.“

“It was just awful,” he said to me “We just sat there in silence and just listened, you know, it's so hard.”

In the midst of the devastation, people from across the country banded together to provide aid. Trailers loaded with hay bales began pouring in, providing relief for farmers and food for the starving cattle

“You couldn't not see a giant hay trailer coming down the road, going somewhere to help somebody. It was nonstop. It really was,” Craft recalled. “The amount of support from, from everywhere and everybody was unbelievable ”

There were stations set up throughout all of the counties, as people brought in fencing supplies, food, and anything else farmers might need to save what was left of their herd. Providing relief while still actively fighting the fire was crucial The extension efforts were 24 hours a day.

“That's what was so devastating and so crazy about this fire,” Craft noted. “The magnitude of it, and the location, all of it is that, yeah, these people didn't just lose their homes, they lost their business, their source of income, their animals, their land, like it's their livelihood.”

The Smokehouse Creek Fire was contained in the middle of March, ending with approximately 12,000 cattle deaths, lost grazing values and extensive fence repair costs. According to the Texas A&M AgriLife econimists, the loss estimates were $68.7 million in ranch infrastructure, $26 million in lost long-term grazing and short-term emergency feeding, and $27 million in cattle losses. Another $1 was estimated in miscellaneous, including disposal costs for deceased animals and forced marketing losses.

Although many people were able to save their cattle, keeping them alive and healthy remains a daily challenge. Farmers and ranchers continue to benefit from the donations and volunteers that aided them 6 months ago, and people are still sending resources to help. However there are still many challenges to overcome. Post-fire conditions continue to impact the ability of livestock to graze, and even hay brought in from other regions must be tested so that farmers know whether or not it needs to be supplemented with additional feed. While plants and grass are beginning to grow back, most trees are still charred with no signs of regrowth. Although it will take years for the land to fully recover, there is hope.

The Smokehouse Creek Fire has tested the resilience of Texas and its people like never before. In the face of staggering losses and ongoing challenges, the spirit of

Texans shines brightly. From the initial devastation to the ongoing recovery, the community has come together with unmatched strength and fortitude. This united effort underscores the profound grit and resolve that define Texas. Though the scars of the fire will take time to heal, the strength of Texas and its people remains an enduring beacon of hope and recovery.

What are land easements?

When it comes to owning land, there are many details and legal aspects that are often misunderstood or overlooked. Easements, for example, are a crucial component of property law that significantly impact land use and development. In essence, an easement grants an individual or entity legal access to a property they do not own. Easements can influence how you access your property, where you can build, and even the property’s overall value.

Common easements include ones for power, water, pipelines, utilities, and access each allowing others to use part of your property for specific purposes. While power and water easements are generally less contentious since they provide essential utilities that benefit the landowner, access easements can be more complex and often lead to disputes. In Texas, where privacy and property rights are highly valued, easements frequently become a source of legal conflict, with many land-related lawsuits stemming from such disputes.

Deeded vs. Prescriptive Easements

Most easements are deeded and recorded, providing the safest form of legal protection. However, prescriptive easements are also commonly found and many landowners may not know they exist in some cases. A prescriptive easement grants a person the legal right to use another's property, based on open and continuous use over time. For instance, if a landowner with 50 acres sells the back 25 acres, they might allow the new owner to use a path or road through the front 25 acres to access the back land preventing it from being landlocked. Even if the front property

hands multiple times, as long as the prescriptive easement is recognized by each new owner, the back acreage owner may be able to continue using the road to access their property. Prescriptive easements, while effective, do not offer a permanent and binding solution and banks and lenders will not recognize them.

Title and Surveys

When purchasing a property, identifying existing easements is very important. The first step is to open up a title with a title company, which will research the property and identify any easements or setbacks that may impact it. Any easement filed off record will be listed in Schedule B of the title commitment. These are referred to as exceptions from coverage, meaning a title company will not insure anything pertaining to those exception since they are aware of their presence. Additionally, obtaining a land title survey is essential. A surveyor will map out the property, its improvements, and boundaries, and then cross-reference with Schedule B to illustrate or list any relevant easements. This is important because Schedule B may identify exceptions that are not relevant to the actual property you are purchasing, but the survey will precisely define which easements directly affect your property, by listing them on the survey and referencing the recorded document that contains the information about the easement

It’s important to look at Schedule B to understand the specifics of any easements on your property. How long does the easement last? Who has the power to use the easement? How wide is the easement? Is it a blanket easement? Each of these factors can impact the way your land is utilized.

Defined vs. Blanket Easements

Easements can vary widely, and understanding their reach is key. They generally fall into two main categories: defined and blanket. Defined easements are limited to a specific, surveyed area, but blanket

easements are far broader, extending across the entirety of a property. This distinction becomes particularly important when dealing with smaller properties. For instance, a blanket easement on a 5acre lot can largely impact how you use the entire property, as it covers every inch of the land, unlike a defined easement that affects only a limited area.

Platted Easements vs. Easements Created by Separate Instruments

Additionally, easements can be either platted or created through separate legal documents. While easements established through separate instruments can potentially be released if the holder agrees, modifying or removing a platted easement involves a complex and costly replatting process since it may effect an entire subdivision.
