President’s Pen When I think of a puzzle I think of small, cohesive, interlocking pieces, working together to create a story. One part of the puzzle doesn’t elicit an image on its own, it is the array of parts in aggregation that form the whole picture. One piece of a puzzle cannot tell a narrative in the same way multiple pieces joining together can, yet just by missing one piece, the picture can never be complete. The Triangle Apartment Association reminds me of a puzzle. We are a community comprised of the Board of Directors, Co-Chairs and Committee Volunteers, TAA Staff, Vendors/Suppliers, Owner/Operators, and Independent Rental Owners. Just like a puzzle, each person that is part of our TAA Community must work together for the picture to be complete. One of my goals this year as President is to focus on continuing to build our community, and to give back to the communities that we serve outside the TAA. The TAA Community has become an integral and essential part of my identity, as I mentioned in my last President’s Pen article. This community has helped me develop in immeasurable ways, both personally and professionally. My goal for 2018 is to cultivate an environment in which every TAA member also feels they are benefitting in some way. In the multifamily industry, our job is to improve the apartment communities where we work. As we hustle through the daily grind, it is easy to forget the impact that we have on our residents’ lives. Are you an owner/ operator ensuring your residents are happy in their home by listening to their concerns, helping them find the perfect apartment, or organizing community events? It could be that at the Super Bowl party you organized this year, a resident met the love of their life! Or maybe you are a vendor/supplier that installs the carpet in an apartment home before a new family moves into it. Did you ever stop to think that this very carpet that you meticulously rolled out, may end up being the setting for their children’s first steps? Perhaps as a service team member filling work orders, you have encountered a resident pet that was less than zealous of your intrusion on their territory. Maybe you could be the individual that makes this animal not afraid of strangers anymore by offering it a treat or some affection. Believe me, these small gestures make a genuine impression and the resident will be left feeling like they are part of a community that cares. Whatever your role, you are an essential part of the puzzle that makes up your residents’ experience. You are the piece impacting our customers’ lives each day in the most personal of environments, their homes. When it comes to your TAA Community, you are surrounded by people who want to know you, to support you, and help you grow. You may be asking yourself, ‘where do I start?’. How do you find time between work and family obligations? What if your company is not able to pay for classes or events? What if you don’t

know anyone at a committee meeting you would like to attend? I recently read a quote from Elon Musk that said, “the first step is to establish that something is possible, then probability will occur.” Many of our members have already done exactly that this year; taken that first step to see what is possible within the TAA Community. 35 members took their first of seven classes to obtain the NAAEI Certified Apartment Manager (CAM) Credential in January, and five members embarked on the Certified Apartment Supplier (CAS) Credential Program. In addition, TAA was selected to host the NAA Advanced Facilitator Training in February and had fifteen members participate. And, because of their devotion to volunteering in the TAA and commitment to our community, seven members were awarded scholarships from the TAA Education Foundation for NAAEI Credential Programs and the NAA-AFT Program. This could be possible for you if you take that first step to become more involved! We have numerous fantastic events coming up in March and April, and there is something special for everyone! Are you a vendor/supplier trying to increase your client base, and want to learn how to efficiently connect with owners/operators? Then, “Inside the Multifamily Mind” is for you. For service professionals (or anyone that wants to enhance their technical skills), we have two Certified Pool Operator courses (CPO), and a CFC certification and testing course. And for those of you trying to improve your legal knowledge, “AANC Lease Review” and “Legal Issues” are perfect additions to sharpen your mind. April is also the month when we host our biggest event of the year! The 2018 Trade Show will take place on Wednesday, April 18 and will allow you to network with over 1200 owner/operator members and visit over 150 supplier member booths. This is a great opportunity to connect with vendor/supplier partners and other industry professionals that can assist in solving any challenges you may encounter. The Triangle Apartment Association is your community, and you are an essential piece of the puzzle that make us successful. I look forward to seeing how you fit into the TAA puzzle this year, and what we can accomplish together!

Legal Issues LITIGATION UPDATE: WHAT YOU SHOULD BE WARY OF AND WHY! By Brownlee Whitlow & Praet, PLLC

The residential rental community is now under as much fire and scrutiny as it has ever been. In addition to the normal complaints of a few dissatisfied residents finding their way into the State Courts there are more and more actions being brought as class actions, at both the State and Federal levels. We will take a look at a few of the more prevalent and/or more concerning types of cases we are seeing. Fair Debt Cases: What You Charge and When WHAT THIS CLAIM IS ABOUT: There are a series of claims in North Carolina presently against large multifamily community owners and managers alleging that they are improperly charging residents late and eviction related fees in violation of North Carolina laws or the Federal or State Fair Debt collection laws. Those bringing these suits are seeking to have them certified as class actions. One of these current suits has gone so far as to subpoena records from local apartment associations regarding programs taught touching on these topics and employees of defendants who have attended such programs!

WHAT YOU CAN DO: Review all policies regarding fees charged to residents, particularly those involving late fees, court fees, and attorney’s fees thoroughly to make sure they are legally compliant. Next we recommend that you review all notices used by all communities to make sure the notices you are sending are in line with your policies. You should also make sure that all of your employees understand your policies so that any communications about these fees to the residents by the employees onsite are correct. Finally you should make sure someone is monitoring changes in the laws which may include regular attendance at Legal Issues Seminars. Disability Cases: Drive-By ADA Claims WHAT THIS CLAIM IS ABOUT: These claims often result from a “tester” who visits a multifamily community for the express purpose of finding violations of the Americans with Disabilities Act (ADA) or the Fair Housing Act (FHA) having to do with design of common amenities or rental homes. Usually a demand letter will be sent threatening a lawsuit under the ADA or FHA the ApartMentor | March/April 2018 6

and seeking a quick cash settlement. The groups threatening these lawsuits generally do not seek to have anything done to address the alleged claim. Essentially the motivation is purely financial, and the ADA and/or FHA as currently written allows a financial recovery for these types of groups without a true showing of injury by the person bringing the suit, or a refusal by the community owner to remedy the violation. WHAT YOU CAN DO: The first step is to review your property for any accessibility issues. The majority of the residential rental industry seeks to be in compliance under the ADA and FHA and certainly do not wish to have anyone injured in any way by their failure to comply. By and large as these claims are rooted in federal law (the ADA and FHA), they need to be addressed at a federal level. The National Apartment Association (NAA) and National Multifamily Housing Counsel (NMHC) support legislation introduced in Congress to stem the growing trend of ADA compliance complaints dubbed “drive by” lawsuits. This legislation strives


to address what should be the primary concern under the ADA; compliance – fixing design issues and increasing access for people with disabilities. Specifically, this legislation ensures that business owners receive proper notice of alleged compliance problems and provides an opportunity to cure an alleged ADA deficiency prior to the initiation of a lawsuit. This would eliminate the incentive for complaints motivated purely by financial gain. The current legislation is in the House of Representatives and is known as “H.R. 620-ADA Education and Reform Act of 2017”. You can support this legislation through taking part in the NAA Capital Conference (now known as Advocate) in March, contacting your local federal legislators and requesting that they support this bill, and donating to the TAA or NAA PACs! Fair Housing Disparate Impact: Criminal Screening WHAT THIS CLAIM IS ABOUT: On December 12, 2017 the Equal Rights Center filed a lawsuit in Washington, DC Federal District Court against a national multifamily property management company alleging that it violated the Fair Housing Act because it’s criminal screening process had a disparate impact on African Americans and Latinos. The claims in this suit are largely based on a Department of Housing and Urban Development (HUD) guidance and a finding in favor of the Equal Rights Center could have the

effect of causing the HUD guidance to be viewed as supported by law, rather than just the opinion of HUD as stated above. These claims are possible because in the Summer of 2015 the U.S. Supreme Court found that a legal theory called disparate impact could in certain circumstances be applied under FHA claims. Having a “disparate impact” refers to a policy that has a greater negative effect on a protected group then on non-protected groups without justification. Accordingly, resident screening criteria that are not discriminatory on their face (i.e. we will not rent to people of a certain national origin) but tends to screen out any protected groups could be a violation of the Fair Housing Act if they are unjustified. In April of 2016 the (HUD) released a guidance stating that using criminal arrests or convictions as part of a resident screening process could have a disparate impact against certain protected classes and thus create a fair housing violation. HUD went on to suggest in the guidance a very limited use and set of policies regarding criminal screening that would not be considered to have a disparate impact. The guidance issues by HUD is not the law but merely HUDs interpretation of the law. WHAT YOU CAN DO: The first thing you can do is to make sure that you are using a reputable and knowledgeable tenant screening service, if you are using such a service. Also,

you should become familiar with the HUD guidance, its full title is Office of Gen. Counsel Guidance on Application of FHA Standards to the Use of Criminal Records by Providers of Housing and Real Estate-Related Transactions. As it is HUD’s opinion at this time you may not need to follow it line by line but consider some of the larger principals in the guidance and whether your tenant screening practices are defensible if you were sued (i.e. could you point to any data that justifies your policies, rather than just anecdotes or opinions). If the lawsuit mentioned above is successful, especially if it is successful on appeal, that will cement the guidance as the “law of the land” and it will be given greater weight by the courts going forward. The Final Takeaway: Pay attention to the legal updates as they come out from NAA, TAA, and any other residential rental industry organizations in which you take part. If your policies have not been reviewed recently, it is probably time for a thorough review, either internally or by outside counsel. 2018 Membership Dinner Meeting TAA hosted its Annual Membership Dinner Meeting and Board of Directors Installation on February 22 at the Embassy Suites by Hilton Raleigh Durham Research Triangle Hotel. The event, originally scheduled for January 18, was rescheduled due to a snow storm. Despite the delay, the meeting proved to be a great start to the year with over 325 members and guests present. A Networking Hour provided everyone the opportunity to re-connect and visit before the dinner and program. Andy Meador, Outgoing TAA President and Vice President, Director of Capital Projects with McDowell Properties, LLC, welcomed everyone and provided general remarks before inviting Julie Chu Zhang, TAA 2016 President and Regional Manager with Ginkgo Residential, LLC, to join him on stage. The two recognized our 2018 Business Partners while providing each company with a plaque of appreciation. Education Committee Co-Chairs Paula Kotarakos, Beech Lake Apartments and Kathy Woodard, Capital Creek at Heritage Apartments, recognized three individuals who successfully completed the National Apartment Association Education Institute (NAAEI) Certified Apartment Portfolio Supervisor (CAPS) and Certified Apartment Supplier (CAS) credential programs. Recognized were Derek Tarrant, Greystar, and April Vasta, Blue Ridge Companies, Inc., who received their CAPS credential and Hubert King, Economy Exterminators, who received his CAS credential. Cliff Webster, Jr., TAA 2013 President, welcomed and installed the New Lease on Life and Triangle Apartment Association Education Foundation (TAAEF) Board of Directors. Andy Meador then recognized the 2017 Committee Co-Chairs and the exiting 2017 Board of Directors. Tamara Hayes, RealPage, Inc. and TAA 2008 President, shared a few words of introduction and then Andy Meador administered the Oath of Office to TAA’s President Claire Michael, Regional Vice President with Fairfield Residential, LLC. The TAA 2018 Officers and Board of Directors were then installed. The evening’s Featured Speaker, Major MJ Hegar, was welcomed to the stage by April Vasta, TAA Vice President and Regional Manager with Blue Ridge Companies, Inc. Major Hegar, a Purple Heart-decorated pilot and best-selling author of Shoot Like a Girl, spoke to the group on the topic of “Be the Change.” A special thank you to Major Hegar for sharing her very inspirational story. All in attendance were able to take home a copy of the book, which is soon to be a major motion picture. Immediately following the program, Major Hegar talked with attendees and signed copies of her book. Thank you to our 2018 Business Partners for their support and to all who joined us for a very special evening.

Cary News Hundreds of people in western Cary are pushing back against plans for a 2,000-seat charter school, citing concerns about traffic and arguing that the area already has plenty of public schools. Cardinal Charter Academy West Campus wants to open in 2019 on Yates Store Road near the border of Wake and Chatham counties. An online petition opposing the school has more than 500 signatures, and neighbors are pleading with Cary leaders to intervene. The undeveloped lot on the west side of Yates Store Road, directly across from Weldon Ridge Boulevard and roughly 2 miles west of Green Level Church Road, was marked for school use in Cary’s 2004 development plan. This is before the Town Council because the school is proposing to swap some of the school’s land for some adjacent residentially-zoned land. Town Council voted unanimously for rezoning approximately 19 acres off White Oak Church Road. The 19 acres is split into two different sections, with a maximum of 60 multi-family homes in the top section and a maximum of 30 townhomes in the bottom, rectangular section.

Improvements to the Cary Parkway and High House Road intersection, which previously had to be canceled due to a lack of bids, will now move forward, with utilities relocated and mapped, and town staff has described it as ‘a better time of the year for construction’. These improvements would add a right-turn lane to each part of the intersection and a left-turn lane to three parts of the intersection, as well as a variety of aesthetic updates. The project would cost $2.73 million. Town Council approved the bid unanimously. Town Council unanimously approved the rezoning of a 0.19 acre parcel in Downtown Cary for five townhomes. The case was more about the long term goal for the redevelopment of Downtown in accordance with the Cary Community Plan rather than five townhomes. Many residents did not feel that the transitions were appropriate for the use against their existing older single story homes.

Chapel Hill News Town leaders and NCDOT officials are discussing one of the town’s biggest projects: redesigning U.S. Highway 15-501. The four-lane, highly-traveled road serves as a gateway into town. Town Manager Roger Stancil emphasizes officials are only brainstorming ideas and are years away from breaking any ground.

The need comes as the area grows. A Wegman’s grocery store, a new UNC Healthcare office park, and the Durham-Orange Light Rail are just some of the projects along this route that are in the works.

Morrisville News The Morrisville Parkway Extension and Interchange project hit an important milestone by receiving bids that are both in line with the engineer’s estimate and within budget. This is particularly good news since Morrisville Parkway is one of the area’s biggest transportation investments, with significance to the town and the region. It is also particularly good news as we may have turned the corner on

the recent trend of escalating costs on bids. Morrisville Parkway will provide the Town with another interchange on NC-540. Cary has been the lead agency through the right-of-way and utility relocation phases. As the project moves into the construction phase, NCDOT will be taking the lead. NCDOT anticipates the project being open to traffic in time for Christmas of 2019.
