Jergensen Bed Tax Collection – For the month of February 2021 collected in March 2021 was at $5M compared to the same month last year at $7.8M with a (36%) decrease. Actual February FY21 was 20% above Forecast and 21% higher than prior month. February Tax Exempt rental receipts of $2.0M, were down (48%) from prior year same month. FYTD’21 Collections were at $19.4M, lower than last fiscal year’s $30.7M by (37%) reflecting the continued pace recovery from COVID-19. Fiscal Year To Date collections at $19.4M are pacing 5.1% ahead of the revised forecast. The Rooms sold for February were 316,565 or (26%) lower than the previous year. Rooms available for February at 504,084, 2.3% higher than last year. Hotel Rooms Active in the County 18,003 exceeded our March 2020 peak of 17,602. Occupancy for February 2021 was 62.8%, down (28%) over Prior Year. Occupancy for February 2020 was 87%. Average daily rate for February was at $214.81, (19.2%) lower than previous year. The Revenue/Available Room for February was at $141.12 lower by (42%). Hotel Room Net sales FY21 Year over Year-February decreased (40%) at $69.2M. Nonhotel room sales FY21 Year over Year February increased 15% at $17.0 M. Hotel Room Net Sales FYTD21 decreased by (40%) at $260.9M. Non-Hotel Room Sales FYTD21 increased by 11% at $76.3M. FYTD 2021 Taxable Revenues Fiscal Year decreased (33%) at $337.2M. Airport activities for the month of February reporting delayed, total passenger for January 2021 was 270,553 (62%) lower than the same January 2020 and Total Estimated Seat Capacity was down (42%) lower than last year with 523,661 seats. PBI Passengers from 12 month rolling average went down (62%) to 2,645,881 over last year. Leisure & Hospitality Employment for February at 81,400 decreased (15%) over the same month in 2020. Accommodations Employment down (35%) decrease over last year at 7,600 employees. F&B was down (12%) at 54,500 employees. Arts & Entertainment employment down (14%) at 19,300 employees. B.

C. LEGISLATIVE UPDATE STATUS* Jergensen Reported that the Senate bill to divert some bed tax dollars to water mitigation projects is temporarily postponed. But we still need to work to stop this bill. D.

CHECKPOINT #12 FEBRUARY 2021 COLLECTED MARCH 2021*

Jergensen Presented the checkpoint information and graphs. Romelus Noticed that over the February 14 weekend occupancy jumped to 90% and asked why. Mostad Explained that it was Presidents’ Day weekend and that this is historically the second busiest weekend of the year. Baker We will continue to push the message that Palm Beach County is a safe place to visit due to mask mandate and social distancing messages. The business community has been very receptive to this messaging. 6.

ERM 1. Two Minute Update- Deb Drum

Drum The beaches are open, and people are coming. The Lights Out campaign for sea turtles is underway from March 1 – August 31. 4


A presentation on red lights and how turtles cannot see this color. Many hotels along the shore front are moving to the installation of these red lights in their pools and around their grounds. C.

Motion carries 6-0 with seat 5 vacant, Jim Bronstien and Jeffrey Mayers absent. 2. Two Minute Update- George Linley Linley March was a comeback month. We are bidding on the America’s baseball qualifier for the 32nd Olympiad. This would take place at the Ballpark of the Palm Beaches and Clover Park in Port St. Lucie. It will consist of eight teams from Cuba, U.S., Canada, Nicaragua, Porta Rico, Colombia, Venezuela, and the Dominican Republic. Sixteen games will be televised on ESPN with an international distribution. We are projecting between 3,000-5,000 bed nights will be generated.

A discussion took place about the high price tag of $100,000 and the short notice. With the financial setbacks associated with Covid, how can we afford it? It was explained that many events early in the year were cancelled due to Covid which freed up grant money also, the Sports Commission received PPP money and these factors has provided the funds needed. D.

DISCOVER 1. Briefing on New Campaign- The Original, The One, The Only - The Palm Beaches

Parks Gave a presentation on this new campaign and the return on investment we are seeing from it. 2.

Two Minute Update- Jorge Pesquera

Pesquera Discovered has refreshed its strategic plan with an emphasis on Equity, Diversity, and Inclusion. Discover is looking at a master plan for the destination and looking to comarket with cities in Palm Beach County which have marketing budgets. Dufresne Asked if we should not already be doing this and wondered is this would create inequity for communities without marketing budgets? He stated that it is our job to market all of Palm Beach County and we should not be taking money from municipalities for marketing. Baker First commented on the excellent presentation by Nick Parks and how the campaign highlighted diversity. She then stated that she would hate to see us dissect and separate out communities for marketing purposes. Bed tax dollars need to be spent on the whole County. The discussion was tabled for more review. E.

CULTURAL COUNCIL 1. Two Minute Update- Dave Lawrence

Lawrence Announced that the deadline for grant submissions was last Friday. May 1, the MOSAIC campaign will begin and August 11 and 12 the Cultural Council and Discover will be hosting a Diversity Summit. F.

FILM & TV 1. Preview of PBTV Art Adventures of the Palm Beaches- 1 minute Video

Elderd Gave a presentation on Art Adventures, a program which has been highlighted during a recent Facebook Watch Party. 2. Two Minute Update- Chuck Elderd Elderd Reported that productions and film permits have been picking up. Serena Williams recently filmed a commercial here and HBO Real Sports with Bryant Gumbel filmed a segment on a local golfer. G.

Anderson Business is slow and it is short-term business which the convention center is seeing. Florida Fashion Focus is coming back for the fourth time this year. Business for June, July, and August is looking up. 2.

McPhail We are promoting a Taste of the Palm Beaches to clients and bringing in local restaurants to assist with catering. 7.

The following is a summary of TDC Performance measures for the month of April 2021. This report demonstrates trends relative to owned visitor digital footprint, advertising impressions, social media engagement, and booked room nights for the Month of April.

March Hotel Performance •

Total room inventory is 1.6% higher than last year, at 18,000. The Palm Beaches ranks 6 th in room inventory growth in Florida.

The number of room nights sold in was 416,000, selling 100,000 more than February.

Room nights sold were up 57% from 2020 and down 8.5% to 2019.

The Palm Beaches has 4.1% share of room nights sold in Florida, up from 4.0% in 2020 and 3.9% in 2019

Occupancy ended the month at 74.5% up from 62.8% in February •

Occupancy grew 54.4% from 2020 and is down 13% from 2019

The Palm Beaches ranks 8th down from 7th in 2019.

The average daily rate (ADR) was $259 up from $225 in February, up 11% from a year ago and down 4.8% from 2019. •

Luxury commands a premium, +47% from 2020 and +39% from 2019

Midscale and Economy properties dropped rates 20% and 17% from 2020

RevPAR was $193, +71% from 2020 and down 18% from 2019

Room night revenue was up 74%, generating $107 million up from 50% in February and down 13% from 2019

Total listings on the shared lodging platforms was down 2.6% from 2020 and down 4.9% from 2019

Supply listing nights was down 15% from 2019

Demand was down 16% from 2019 but on par with 2020 with reduced inventory

Occupancy was 76%, up 25% from 2020

ADR was $299 up 12.7% from 2020 and up 8.7% from 2019 •

$141 (per room equivalent), up 12.3% from 2020 and 11% from 2019

Overall revenue was up 11.7% from 2020 and down 10% from 2019, generating $14.2 million.

Total lodging nights sold was 517,000 up from 381,000 in February and down 10% from 2019

Total lodging room night revenue was 121.7 million up from $79.9 million last month and down 11.8% from 2019

Bed tax revenue is projected to be around $7 million

HIGHLIGHTS MOSAIC Promotion of the Cultural Council’s annual MOSAIC (Month of Shows, Art, Ideas & Culture) campaign began in mid-April, with advertising targeted to drive markets with messaging to sign up to learn about special offers coming in May. This approach significantly boosted email signups, contributing toward over 3,000 new subscribers in April. This year, MOSIAC features special offers from 16 cultural organizations throughout the county, as well as hotel deals provided by Discover The Palm Beaches. The Council worked with its PR agency to secure a regional FAM trip with writer Marisa Langford of Tampa Bay Parenting. Marisa visited the destination April 16-18, touring The Benzaiten Center, Busch Wildlife Sanctuary, Jupiter Inlet Lighthouse & Museum, Lighthouse ArtCenter, South Florida Science Center & Aquarium, and the Palm Beach Zoo. Resulting coverage from the trip is slated to publish in early May on TampaBayParenting.com. The Council’s PR agency also contracted drive-market influencers Emilie Sobel (@EmilieSobel, Miami), Dana & Matt Harvey (@homeoftheharveys, Port St. Lucie), and Alexandra Farro (@sunkissedindecember, St. Petersburg) to expand the reach of the MOSAIC campaign across social media. During the month of April, Emilie Sobel and Dana & Matt Harvey visited local cultural institutions, including Boca Museum, Loggerhead Marinelife Center, Lighthouse ArtCenter, and the South Florida Science Center & Aquarium to capture content to be posted in May, highlighting various MOSAIC offerings throughout the destination. Alexandra Farro is slated to visit May 8-9 and a full recap of results from this initiative will be available in May. Additionally, two-minute sponsored segments aired on Miami’s NBC affiliate WTVJ, and Orlando’s CBS affiliate WKMG-TV. Airing April 26-29, the segments featured the Council’s VP of Marketing sharing highlights of the MOSAIC promotion. Other promotional efforts include giveaways with both The Palm Beach Post and South Florida Sun-Sentinel ending in early May, as well as “selfie spots” located throughout Palm Beach County. These spots encourage engagement with the destination’s cultural tourism brand with not only visitors but residents as well. The largest of these is the Council’s larger-than-life “Shades of Culture,” which are located in Boca’s Sanborn Square through May.

HIGHLIGHTS OTHER PR & SOCIAL MEDIA On April 29, the Council joined the Palm Beach County Sports Commission and Discover The Palm Beaches for a press conference to announce Ballpark of the Palm Beaches as one of only two U.S. stadiums to host Olympic Baseball Qualifier events for Tokyo 2020, as well as the 16-game qualifier schedule to be played in Palm Beach County. The Council secured a brass quintet from Palm Beach Symphony to perform and Palm Beach County artist Gregory Dirr to paint live during the event.

AGENCY COLLABORATION Film & Television Commission (FTC): In April, the Cultural Council continued work with the FTC and Megastar Publishing on episode 4 of Art Adventures of The Palm Beaches, which is set to air on South Florida PBS in June. The Council is also working with the FTC on an upcoming episode of its Facebook Watch Party series highlighting MOSAIC.

The 39th Annual USA Powerlifting Florida State Open Championships took place at the Hilton Palm Beach Airport on April 10-11

The Amateur Athletic Union (AAU) Florida Gold Karate Championships took place at Boynton Beach High School and featured 300 participants on April 10-11


Our Sports Commission hosted the Extreme Kayak Fishing Tournament Exotic Bass Roundup at Lake Ida Park in Delray Beach on April 10-11


The Exotic Bass Roundup, which is an offshore sports fishing event for peacock bass, attracted 100+ anglers in its Palm Beach County debut.


Our Sports Commission partnered with USSSA Fastpitch to host Angels 4 Autism, which is a series of events located in over 30+ states, on April 10-11

Officer John Scollo Memorial Softball Tournament, which took place at Village Park in Wellington on April 10-11, is a national softball tournament for police officers, which attracted over 400 players

The Palm Beaches Spartan Spring 5K Weekend took place at Boca Raton’s Burt Aaronson South County Regional Park on April 24-25. The event brought racers from around the country to challenge themselves against a 20obstacle, 3.4- mile course. The press conference was emceed by ESPN West Palm’s Theo Dorsey and featured comments from Palm Beach County Mayor Dave Kerner, Palm Beach County Sports Commission Executive Director George Linley, MLB greats Charles Johnson and Luis Alicea, and Ballpark of the Palm Beaches General Manager Matt Slatus, among many others.

Palm Beach County to Host Olympic Qualifier for Baseball WEST PALM BEACH, Fla. -- The Palm Beach County Sports Commission and Play Treasure Coast Sports Tourism announced plans to host a WBSC Baseball Americas Qualification Event for the Games of the XXXII Olympiad Tokyo 2020 in Palm Beach County from May 31-June 5. The schedule for the qualifier was announced at a press conference at Ballpark of the Palm Beaches on Thursday, April 29. See the full schedule below. The event will be hosted at two venues – the Ballpark of the Palm Beaches in West Palm Beach and Clover Park in Port Saint Lucie. The winning nation will earn a spot in the Summer Olympics which will begin this July in Tokyo, Japan. Eight nations will compete over 16 games for one spot in the six-team Tokyo 2020 Olympic baseball tournament. The nations will be placed into two groups for the opening round. Group A will feature the United States, Dominican Republic, Puerto Rico, and Nicaragua while Group B will include Cuba, Venezuela, Canada, and Colombia. The first round is slated to begin May 31 and end June 3. After group play concludes, the top two finishers from each group will advance to the Super Round on June 5, where they will each play two games. Head-to-head contests among these teams from the opening round will carry over into the Super Round standings. When the Super Round ends June 6, the team with the best record will be declared the winner and become the fifth National Team to advance to the Tokyo Olympic baseball tournament, joining Japan, Korea, Mexico, and Israel. The second and third-place teams will qualify for the WBSC Baseball Final Qualifier, scheduled from June 16-20 in Taiwan at Taichung Intercontinental Baseball Stadium and Douliou Baseball Stadium in Douliu City.

The Ballpark of the Palm Beaches might be Palm Beach County’s newest professional baseball facility but it is no stranger to hosting world-class baseball. Two recent World Series champions, the Houston Astros (2017) and Washington Nationals (2019), call the ballpark home each year for their Major League Baseball Spring Training games. Many elite baseball events have also played at the park including the Prospect Select Wave Invitational, Baseball Canada Junior Nationals, Palm Beach Classic, and Perfect Game USA 14U Florida Showcase. Sports Tourism Leads the Way for Post-Pandemic Hotel Occupancy Boom WEST PALM BEACH, Fla. -- Sports in Palm Beach County have led the way in terms of economic recovery as hotel occupancy rates have surpassed 80% for the first time in a year. The increase comes as both professional and amateur events have brought visiting spectators and participants back to The Palm Beaches. The last time occupancy rates were at this level was on March 6, 2020, shortly before Florida’s State of Emergency was issued to restrict hotel reservations to “essential lodgers” only. Since restrictions have loosened, the Palm Beach County Sports Commission has guided numerous sports organizations through the event planning process to ensure safe returns to action.

At the professional level, staple events like the Winter Equestrian Festival, the PGA Tour's The Honda Classic, and Major League Baseball Spring Training have brought spectators from around the United States back to Palm Beach County. The Winter Equestrian Festival, a twelve-week collection of the world’s finest horse shows, set the tone for a stellar year in sports tourism with riders from around the world flocking to the Palm Beach International Equestrian Center in Wellington. The Honda Classic continued the trend of limited capacity events as the PGA Tour event returned to PGA National Resort & Spa in Palm Beach Gardens for the 15th consecutive year. The tournament featured Australia’s Matt Jones picking up his first PGA Tour victory since 2014 in front of a daily crowd of around 10,000 fans and a total of 50,000 fans over the week. MLB Spring Training has a storied history in The Palm Beaches and in 2021 added to that history. Four MLB clubs – the Miami Marlins, St. Louis Cardinals, Houston Astros, and Washington Nationals – played their pre-season games at Roger Dean Chevrolet Stadium and the Ballpark of the Palm Beaches. This spring, the clubs returned to action in front of fans for the first time since the 2020 season was cut short. MLB implemented extensive Covid-19 protocols that allowed stadiums to welcome fans back. Other events like the inaugural Delray Beach Pickleball Open, the first Association of Pickleball Professionals (APP) Tour event in Palm Beach County, and the Gauntlet of Polo, a series of three high-profile polo tournaments, among others, have also made a strong economic impact.


Many events that the Palm Beach County Sports Commission has helped to return are youth and amateur sports events. Amateur sports create a massive economic impact by boosting hotel occupancy rates with participants, spectators, and staff. Events like the Tim Rand Invite, a premier gymnastics meet featuring hundreds of athletes performing at the Palm Beach County Convention Center, and the Palm Beach Challenge, a month-long baseball festival featuring amateur and collegiate teams from the U.S. and Puerto Rico, have led the efforts to bolster sports travel. Other notable events bringing visitors to Palm Beach County include USA Powerlifting's Florida State Open Championships, East End Volleyball’s Sunshine Series, the Next Level Greats South Florida 7-on-7 football tournament, and the Angels 4 Autism fastpitch softball tournament. Beyond current events, the Palm Beach County Sports Commission is steadfast in its efforts to work with more owners and organizers to continue the positive uptick in travel to Palm Beach County. The summer months will be full of premier events like the First Responder Games which are set to take place this June at multiple venues across The Palm Beaches. During the two-week stretch, the games will feature over 3,000 first responders competing in nearly 30 different sports. Many of the participants are expected to be traveling from outside of the county.


Spartan Race Returns to Palm Beach County WEST PALM BEACH, Fla. -- The Palm Beach County Sports Commission is partnering with Spartan Race, Inc. to once again host the Palm Beaches Spartan Sprint 5K Weekend on April 24-25 at Burt Aaronson South County Regional Park in Boca Raton. Approximately 6,500 participants from across the United States are expected to compete in the event. The race weekend will feature two days of Spartan’s signature “sprint” races, which includes 20 obstacles over the 3.1-mile course. The sprint is the shortest distance race offered by Spartan, but it is the most popular among both new and returning competitors. The sprint race includes numerous obstacles – including fire jumps, tall walls, monkey bars, and rope climbs – presenting challenges for even the most experienced competitors.

Racers can enter one of three divisions: elite, age group, and open. For the most competitive racers, there is the elite division, which will be the first group to take the course. Racers can also compete by age group (14-17, 18-24, 25-29, 30-34, 35-39, 4044, 45-49, 50-54, 55-59, 60+), or they can enter the open division which is geared toward recreational and novice racers. Race organizers have implemented extensive changes in the event from previous years to ensure the safety of its participants. While the event is projected to host 3,500 racers on Saturday and 3,000 on Sunday, no more than 1,000 racers will be on the course at any time. Waves of 50-150 racers will be released in 15-minute intervals beginning at 7:30 a.m. on both Saturday and Sunday with the last group departing at 4:30 p.m. and 2 p.m., respectively.


The host venue for the event, Burt Aaronson South County Regional Park, has been home to the race since 2019 when the Palm Beach County Sports Commission won a bid to bring the event to Boca Raton. The facility is one of the most versatile sports venues in Palm Beach County. This comprehensive gem, owned and operated by Palm Beach County Parks and Recreation, includes four lighted baseball fields of varying dimensions, four lighted softball fields, five lighted multipurpose fields, 12 lighted racquetball courts, 19 tennis courts, and five volleyball courts. The park also is home to the lush Osprey Point Golf Course, a 27-hole layout of three nine-hole courses that consistently ranks in the top 50 public golf courses in America. Water skiers enjoy the thrill of making waves at the on-site Water Ski Training Center, where up-and-coming and accomplished skiers hone their skills. “We are excited to once again host this world-class event in The Palm Beaches,” said John Smith, president of the Palm Beach County Sports Commission. “Burt Aaronson South County Regional Park is one the most versatile venues in Palm Beach County and with its champion level cross country course, it is the perfect place for this exciting test of strength and endurance. Palm Beach County Sports Commission Lands Three NAIA Postseason Events WEST PALM BEACH, Fla. -- The Palm Beach County Sports Commission and Keiser University announced that they have won bids to host three National Association of Intercollegiate Athletics (NAIA) championship events on the campus of Keiser University in West Palm Beach. The events are the NAIA Football Championship Series on April 17 and April 24, the NAIA Volleyball Championship opening round on April 17, and the NAIA Men's Soccer Championship opening round April 22-24. The NAIA Football Championship series kicked off the festivities at Keiser Football Field with the No. 4 Seahawks defeating the No. 15 Arizona Christian Firestorm 63-21. The massive victory marked the school’s first-ever postseason win in just their second appearance. The team amassed a program-record 546 total yards in the win and will look to keep the offense flowing against the No. 8 Reinhardt Eagles at home on April 24.

The winning ways continued for Keiser as the No. 11 women’s volleyball team hosted the school’s first-ever postseason match at the Student Life Center. The Seahawks are now 36-0 after beating the Mobile Rams three sets to zero, marking the Seahawks' 29th shutout of the season. The team will now prepare for the next playoff round as they will travel to the NAIA Final Site in Sioux Center, Iowa to take on the No. 23 Indiana University Kokomo Cougars. Dating back to the fall, the Seahawks have now won an impressive 54 straight sets. Coming off a 2-1 win over Mobile, the No. 2 Keiser men’s soccer team looks to keep its momentum going as they are set to be one of 10 hosts for opening round action in the NAIA Men’s Soccer Championship. Each of the opening round sites will feature four teams. Play will be from April 22-24 and will have a single day of rest between the first game and the championship. The winner of each will advance to the final site in Columbia County, Ga. beginning on May 4.


The Palm Beach County Sports Commission worked in partnership with Keiser University to submit the bids. The winning bids mark the addition of several postseason events to a growing list of NAIA events that have been played in Palm Beach County. The NAIA Women's Soccer Championship opening round (2019), the NAIA Men's Soccer Championship (2014-2017), and the NAIA Women's Golf Championship (2017-2018) have all been held in Palm Beach County. “Keiser University’s sports teams have been well-represented in the NAIA postseason for many years, and we could not be more thrilled that these teams can now compete right here in Palm Beach County as they pursue championships,” said George Linley, executive director of the Palm Beach County Sports Commission.


Play at the Plate Brings Fantasy Camp World Series to Palm Beach County WEST PALM BEACH, Fla. -- Play at the Plate, in partnership with the Palm Beach County Sports Commission, will bring the Fantasy Camp World Series to Palm Beach County from April 15-18. This championship event will take place at Santaluces Athletic Complex and the Ballpark of the Palm Beaches. The round-robin tournament will feature over one hundred players that have previously attended a fantasy camp hosted by a Major League Baseball team. The six teams will represent the St. Louis Cardinals, Minnesota Twins, Milwaukee Brewers, and Colorado Rockies. In addition to playing at Santaluces Athletic Complex, each team will have the chance to feel like a professional with games taking place inside the Ballpark of the Palm Beaches’ main stadium.

The return of Play at the Plate to the county adds to the company’s remarkable 17-year run of hosting events in The Palm Beaches. The Palm Beach Classic, another adult baseball event, also brings some of the nation’s best adult baseball players to Palm Beach County. The Fantasy Camp World Series marks the organization’s return to the area after pandemic-related restrictions halted sports events.


The Santaluces Athletic Complex, owned and operated by Palm Beach County Parks and Recreation, contains four lighted fields with professional dimensions. It also offers two professional batting cage tunnels, a covered seating area, and a convenient concession area. Prominent events and tournaments such as USA Baseball and the Perfect Game WWBA Championship have all called Santaluces their reliable home. It also houses a bicycle path, a fishing pier, and an aquatic complex with an eight-lane, 60-by-75-foot pool fit for diving and swimming competitions.

The Ballpark of the Palm Beaches is the Spring Training home to the 2019 World Series champions the Washington Nationals and 2017 World Series champions the Houston Astros. Designed with an elegant wrap-around concourse and inviting sightlines, the 160-acre complex features a fan-friendly 7,700-capacity stadium as its centerpiece, along with six practice fields per team. A total of 13 MLB fields and five 120-by-80-yard multipurpose athletic fields are covered in beautiful Bermuda grass and cater to soccer, lacrosse, football, rugby, and more. Among the eclectic events that have been hosted at the Ballpark are Battlepark Mixed Martial Arts, SoFlo Turkey Shootout in lacrosse, Baseball Canada Junior Nationals, the Perfect Game USA 14U Florida Showcase, The Palm Beach Cup in soccer, Sunshine Games Ultimate Frisbee, the Collegiate League of the Palm Beaches and Prospect Select Baseball.


Extreme Kayak Fishing Set for Inaugural Delray Beach Tournament WEST PALM BEACH, Fla. -- Just as day breaks at Delray Beach's Lake Ida Park on Saturday, April 10, anglers in the Exotic Bass Roundup will push off in their kayaks in search of peacock bass and clown knifefish. The inaugural event organized by Extreme Kayak Fishing, in partnership with the Palm Beach County Sports Commission, marks the sport of kayak fishing’s return to The Palm Beaches after the Covid-19 pandemic halted sporting events.

The competitors will return to Lake Ida Park at 2 p.m. where the awards ceremony will take place. The tournament is a catch-and-release event meaning that all bass and knifefish will be measured shortly before being returned to the water. Nearly $5,000 in cash prizes is on the line in addition to merchandise and apparel prizes. Before the event, a kick-off party will be held at Duffy’s in Delray Beach on Thursday, April 8. The event is expected to continue a strong uptick in sports tourism in Palm Beach County with over 100 anglers set to participate. Sports tourism has led the way in Palm Beach County in terms of economic recovery. International events like the PGA Tour’s The Honda Classic and Equestrian Sport Production’s Winter Equestrian Festival have been a great benefit for The Palm Beaches after the pandemic but smaller, amateur events have also returned in droves. The same day the kayakers will take off in Delray Beach, two other events will provide further tourism relief; the Angels for Autism softball tournament and the USA Powerlifting Florida State Open Championships will take place in West Palm Beach. “The Palm Beach County Sports Commission is thrilled to welcome the Extreme Kayak Fishing team to Palm Beach County for what will be a thrilling day of competitive fishing. This event says so much about what makes sports in The Palm Beaches so great by utilizing a naturally occurring area to bring an emerging sport to our shores,” said George Linley, executive director of the Palm Beach County Sports Commission. Lake Ida Park is a sprawling 190-acre park in Delray Beach operated and maintained by the Palm Beach County Parks and Recreation Department. In FY 21, the Palm Beach County Sports Commission (PBCSC) is deploying an aggressive sales and sports development effort to grow the number of sports tourisms generating events taking place in The Palm Beaches. The PBCSC continues to cultivate relationships with event owners, as well as identify, solicit, secure and retain sports events to grow room night actualization. Below is a recap of sports development efforts that have taken place during the month of April in FY 21.

A primary mechanism for event solicitation is through the Event Bid and Development process. To recognize potential bid opportunities, the PBCSC will be at the forefront of the industry and engage with event owners. Bid submission is a highly effective tool to recruit sporting events. Association of Pickleball Professionals (APP) Tour - Delray Beach Pickleball Open

APP Tour The Palm Beach County Sports Commission hosted its first national pickleball event at the Delray Beach Tennis Center from March 18-21, 2021. The Palm Beach County Sports Commission supported Foster Events Group, which is based in Delray Beach, in organizing the inaugural Association of Pickleball Professionals (APP) Tour event in The Palm Beaches. The Delray Beach Pickleball Open was created once the APP Tour awarded one of its 17 pickleball tournaments to Palm Beach County. The APP Tour is the first USA Pickleball sanctioned professional circuit with 17 events scheduled in the United States and Europe. The Delray Beach Pickleball Open represents the second stop on the APP Tour, in 2021. The Delray Beach Pickleball Open featured professional athletes competing for prize money and amateur athletes vying for a championship. The event included men, women, and mixed divisions with singles and doubles competitions. Delray Beach Tennis Center The Delray Beach Tennis Center is one of the premier venues for racquet sports in Florida. The Delray Beach Tennis Center consists of 14 clay tennis courts, 6 hard tennis courts, and an 8,200seat stadium located in the heart of Delray Beach, FL, just to the west of the world-famous downtown area on Atlantic Avenue. This venue was transformed into a dynamic setting for pickleball. The layout at the Delray Beach Tennis Center allowed for 27 pickleball courts. Three pickleball courts were designated as show courts, which featured matchups that were televised on CBS Sports Network. Tourism Impact The Delray Beach Pickleball Open represents a huge victory for the Palm Beach County Sports Commission. This is one of the few national events to take place in The Palm Beaches, after the Covid-19 pandemic’s onset. This APP Tour event consisted of 810 athletes, 700 traveling spectators and 48 referees. The athletes traveled from 37 U.S. states and 6 foreign nations (Israel, France Germany, Mexico, Peru, and Canada).


The Delray Pickleball Open generated 1,342 hotel room nights. This number was confirmed by Destinations International (DI) Sports Event Calculator and DI’s Overnight Room Demand Analysis (ORDA). The DI Sports Event Calculator revealed 1,342 room nights while ORDA disclosed 1,368 room nights. Furthermore, room nights were tracked directly at five (5) hotels in Delray Beach (Fairfield Inn, Residence Inn, Hyatt Place, Courtyard Marriott, and the Opal Grand Oceanfront Resort). The total economic impact equaled $1,017,432, which was reported by the DI Sports Event Calculator. Below is a summary of participation and tourism impacts: •

The Delray Beach Pickleball Open delivered immense media benefits to Palm Beach County. The APP Tour event was televised on CBS Sports Network. A digital broadcast was also shown on the APP (Association of Pickleball Professionals) TV, Youtube, and Facebook live. The television and digital broadcast were shown in mor than 40 countries.



39th Annual USA Powerlifting Florida State Open Championships

The Palm Beach County Sports Commission (PBCSC) supported USA Powerlifting Florida to host the 39th Annual USA Powerlifting Florida State Open Championships at the Hilton Palm Beach Airport on April 10-11th, 2021. This event included both male and female adult and youth competitors from across the state of Florida. These athletes competed in various weight classes, including 94.75Ibs to 185Ibs+ for women and 116.75Ibs to 264.50Ibs for men, in the disciplines of bench press, deadlift, push-pull and powerlifting. The event featured over 100 participants and coaches, as well as numerous additional spectators. In total, 111 room nights were generated from the 39th Annual USA Powerlifting Florida State Open Championships. The partnership with USA Powerlifting Florida is very important to maintain, as they can be our host organization for more prestigious events like the World University Games and the Men’s & Women’s Nationals. The Event Director was Robert Keller. Robert is not only the State Chairman for USA Powerlifting Florida, but he is also a certified referee for the International Powerlifting Federation, a Championship Director of over 30 USA Powerlifting National Championships, the Interim Technical Officer of USA Powerlifting, and the Secretary General for the International Powerlifting Federation. The Palm Beach County Sports Commission committed $1,000 of business development funds for the purpose of hosting this event at the Hilton Palm Beach Airport.

THE HONDA CLASSIC RECAP & EVENT DEVELOPMENT SUMMARY The Honda Classic is one of the most impactful sports events that takes place in The Palm Beaches. As the only PGA TOUR event taking place in South Florida, The Honda Classic continues to bring Palm Beach County economic benefits, global impressions, and excellence. The Honda Classic returned to PGA National Resort & Spa and its renowned Champion Course for the 15th straight year. This event took place on March 15-21 and was organized with limitations due to the Covid-19 pandemic. With the primary focus on the health and well-being for all involved with the tournament and the local community, attendance was confined to 10,000 per day and 50,000 in total. The Honda Classic’s attendance in 2021 represents a dramatic decline from the 206,834 spectators that enjoyed 2020 tournament. However, this event represents a huge victory for sports event recovery in The Palm Beaches. The Honda Classic delivered the largest single day attendances compared to any sports event that has taken place in The Palm Beaches, since the onset of Covid-19. The Honda Classic presented a re-imagined footprint, which allowed the event to take place in an immensely responsible manner while creating significant tourism impacts and positive media for our local community.

Overview: The Honda Classic consists of 144 pro golfers competing over 72 holes. Golfers are vying for a total purse of more than $6.8 million. The Honda Classic has become known throughout the golf world as offering one of the premier fan experiences in sports, being named the Most Fan-First event of 2019 by the PGA TOUR. The Honda Classic relocated to PGA National and its Champion Course in 2007. Television viewership: The Honda Classic is televised nationally on the Golf Channel and NBC. Over 21 million total viewers watched the televised broadcast of The Honda Classic in 2020. Palm Beach County is showcased worldwide as The Honda Classic is internationally distributed to 270 countries. The Palm Beach County Sports Commission will present the television ratings and viewership numbers for the 2021 event, once the data is collected. Charitable Contribution: The Honda Classic awarded a record-shattering $5.35 million to 103 South Florida philanthropic organizations in 2020, the 14th consecutive year that the PGA TOUR event has been able to increase its impact on the lives of local children and their families. Economic and Tourism Impact: The Honda Classic’s economic impact and room night production are being calculated. Previously, The Honda Classic generated 10,000+ hotel room nights and over $40 million in total economic impact. The restrictions created due to the Covid-19 pandemic will significantly lessen the economic impact and room night generation created from this event in 2021. Sports Development Growth The Palm Beach County Sports Commission utilizes The Honda Classic and its various hospitality platforms as a sales effort. This prestigious event provides the Sports Commission a unique opportunity to host clients, both current and future, at one of the most recognizable events on the PGA TOUR. SSOF SETS SIGHTS ON EXTRAORDINARY AWARD SHOW The 26th Annual Palm Beaches Student Showcase of Films (SSOF) Award Show promises to be unlike any other in its illustrious 26 years of celebrating student success! The largest student film competition and award show in Florida will announce the finalists and winners on an all-new SSOF Award Show broadcast to air this month. The SSOF team is unveiling bits of information each day as they build suspense to show time, such as appearances by Vanilla Ice, Zack Gottsagen (The Peanut Butter Falcon) and Hector David Jr. (The Power Rangers) mixed in among other big names! “The pandemic quickly forced us in a different direction last year,” said Michelle Hillery, Executive Producer for SSOF. “However, this year we had the time to plan something entirely different and Vanilla Ice Gottsagen David Jr. exciting. It’s going to be amazing!” The theme for this year’s celebration is all about “making the ordinary, extraordinary!” While everyone may be stuck at home and unable to walk the red carpet, that won’t stop SSOF from bringing the red carpet to all those talented Florida students, their family, instructors, and friends. “The team really embraced this special broadcast for 2021,” continued Hillery, “even as we plan on returning to the live stage at the Keith C. and Elaine Johnson Wold Performing Arts Center at Lynn University in 2022.”

OLYMPIC QUALIFIERS IN PBC An eight-team baseball tournament is coming to The Palm Beaches to determine who gets a spot at the summer Olympic games in Tokyo. Known as The Baseball Americas Qualifier, the event is taking place May 31 - June 5 and features national teams from Canada, Colombia, Cuba, Dominica Republic, Puerto Rico, Venezuela, and the United States. Organized by the World Baseball Softball Confederation (WBSC), a series of games will be played at the Ballpark of The Palm Beaches, spring training home of the Houston Astros and the Washington Nationals, and broadcast to viewers worldwide. GLOBAL STORY, GLOBAL RATINGS Premiering on Apple TV+ in more than 100 countries, The Year Earth Changed is a timely documentary special that takes a new approach to the global lockdown due to COVID-19 and the uplifting stories that have come out of it. Voiced by David Attenborough, Sea Turtle in Juno Beach the documentary showcases how changes in human behavior can bring about more harmonious ways for humans and wildlife to coexist. One of the main segments covers how COVID shutdowns and openings impacted Juno Beach loggerhead sea turtle nesting success. Working with the Loggerhead Marinelife Center, the production team was able to capture amazing nighttime footage of nesting sea turtles. FOCUS ON FILM US POLO ON CBS The U.S. Open Polo Championship® is considered the most prestigious polo tournament in the country, and will air on May 9 at 2pm on CBS. The championship will re-air on CBSSN on May 15 at 8pm. The highly anticipated matchup is being sponsored by The Palm Beaches, the official marketing organization of Palm Beach County. The Gauntlet of Polo is "the sport's most challenging tournament series" and has a $1 million prize purse. It takes place on the U.S. Polo Assn. Field and surrounding fields at the International Polo Club Palm Beach in Wellington from February 17 - April 18. There are nine teams who compete in these global tournaments. FLORIDA’S GREAT OUTDOORS VISIT FLORIDA (VF), the state's official tourism marketing corporation, serves as Florida's official source for travel planning to visitors across the globe. A recent travel video series produced by AAA – The Auto Club Lankford on Peanut Island Group in partnership with VF explored outdoor activities throughout four regions in Florida. EXPERIENCE THE YOUTHQUAKE Positive Motion Pictures, a family -friendly film studio based out of Palm Beach County is following up the success of their recent production, American Prom with a new feature titled Youthquake. UNDER ARMOUR TEAMS UP IN PBG “Do they know you by name? Study your tape? Flinch hearing your number?” The latest commercial release from Under Armour for their team sports apparel and equipment was filmed in Palm Beach County, in collaboration with a local high school football team out of Palm Beach Gardens who knows just how to intimidate their competition. The commercial is shot through the point of view of the player as he takes on practices and workouts culminating in the big game. The Palm Beaches TV continues its campaign targeting visitors who are within driving distance. The Palm Beaches TV Facebook Watch Party, which launched in June 2020, airs every Tuesday at noon. Each episode, designed to be 10-15 minutes in length, utilizes existing content from the original 40 hours of programming currently streaming on the channel. Help invite visitors back to The Palm Beaches by tuning in, sharing the content or engaging in the watch party. The Palm Beaches TV is also looking forward to adding five new original episodes to the channel this fall. FOCUS ON FILM POLITICAL SATIRE ON THE STREETS TBS’ Emmy Award-winning political satire series Full Frontal with Samantha Bee paid a visit to Palm Beach and West Palm Beach for a post-election temperature check on the neighbors of 45th US President Donald Trump, who has made Mar-ALago his primary residence. Political leanings aside, Worth Avenue, Clematis Street and Rosemary Square offered standout, sunny backdrops to set the scene for the areas where correspondent Allana Harkin interviewed local residents man-on -the-street style. Samantha Bee was a correspondent herself on Comedy Central’s The Daily Show with Jon Stewart before branching out on her own to start the popular Full Frontal late night series, which attracts over half a million viewers on average per airing. PBAU STUDENT SEEKS SERENITY Facing a deadline to complete a commissioned painting, a man is inspired by visions of his late wife to create a fresh new piece of artwork. Titled White Serenity, a new short film comes from Palm Beach Atlantic University student Jerahmeel James, who is about to complete his B.A. in Cinema Arts. Working with his talented Students on Location classmates and peers, Jerahmeel filmed at various locations across The Palm Beaches including Jupiter Beach Park, Ocean Cay Park, Okeeheelee Park and various private residences. “Looking ahead, it is my intention to produce my first feature film in 2022, which is set, and will be shot in Palm Beach County. 51 STROKES TO SUCCESS Barstool Sports’ Caleb Pressley recently moved from New York City to Boca Raton, where he has set off on an ambitious journey to become a professional golfer. Realizing it could Pressley at Southwinds take a decade to achieve such a lofty goal, Pressley is documenting his path in 51 Strokes, a web series of videos and podcasts. The 51 Strokes title comes from Pressley’s handicap at the start of his burgeoning career. KO-MAR CAPTURES THEATRE When the Palm Beach Opera decided to present their first-ever outdoor festival featuring six live performances with more than 30 entertainers, they wanted to capture the event on film. West Palm Beach-based Ko-Mar Productions brought in six cameras and a crew to capture the magic at South Florida Fairgrounds’ iThink Financial Amphitheatre. The outdoor festival offered the chance to enjoy the performance projected on a massive 12foot LED screen in a socially distanced audience. “Working within the parameters of the pandemic, local perforPalm Beach Opera mances have been able to move forward utilizing video and streaming. FOCUS ON FILM FLASHBACK FEATURE: PARKER Parker, a 2013 action thriller directed by Academy Award winner Taylor Hackford, reached a new digital audience after its recent run on Netflix’s Top 10 popular programs. Starring Jason Statham and Jennifer Lopez, the title character Parker (Statham) heads for vengeance against criminals set to score $50M worth of jewelry from an auction. The production required coordination with local agencies and included fire trucks, helicopters, and marine units. Filming locations included West Palm Beach, South Ocean Boulevard, Boca Raton Resort and Club and Worth Avenue. During the shoot, the Southern Boulevard, Royal Park, and Flagler Memorial bridges were closed to assist with production. LOCATION SPOTLIGHT JUPITER FARMS Known to locals as simply “The Farms,” Jupiter Farms is an area surrounded by natural lands and made famous by Burt Reynolds who purchased Al Capone’s hideout and turned it into a multiuse property in the 80’s. Besides film and television projects, the Burt Reynolds Ranch hosted many films, commercials and community events. While much has changed in Palm Beach County, Jupiter Farms has been able to hold on to their rural and rustic roots. Equestrian, hiking and biking trails as well as undisturbed forested areas provide excellent birdwatching opportunities. The Ocean-to-Lake-Trail passes through Riverbend Park in Jupiter and other protected lands that the County has procured for use and enjoyment by the public. Sections of the trail were featured in a PBS project titled Hidden Wild that showcases a group of students experiencing the wild areas in PBC for the first time in their lives. EDUCATION CORNER SPOTLIGHT ON G-STAR G-Star High School of the Arts in Palm Springs was recently featured in the latest issue of Venue Magazine, a contemporary art and luxury magazine. The article, featured in Issue 44, focuses G-Star School of the Arts on elevating education at the intersection of art and technology. Greg Hauptner, G-Star’s Founder, believes “the antiquated system of teaching doesn’t apply in the augmented age.” G-Star requires productions renting out space to have students work on their projects. The after-school program allows G-Star’s students to work as interns on live sets, gaining hands-on, real-world experience. Over the years, students have worked on several major projects. Currently, there are twelve feature films playing on Netflix, Disney Channel, and Amazon Prime that were shot at the GStar Studios and/or on location. The projects include: Parker, This Is It, Critical Thinking, The Prince and The Pauper, Ned Venture, Dream Factory, Bart Got A Room, Boynton Beach Club, Finding Joy, Hiding Victoria and USS Seaviper. Every movie had G-Star students acting or working on the sets. The 84,000 square foot facility, featuring the 25,500 square foot G-Star Motion Picture Studio facility, is set on three-acres and includes a 17,000 square foot warehouse for shooting and set construction. Production Activity Report For March 2021 Variance Explanations Percentage change variances of ± 10% in performance statistics are explained in this section. Historical Context (COVID-19): Please refer to the March - December 2020 Production Activity Reports for a full timeline of the pandemic’s impact on Palm Beach County’s production industry. As of March 2021, production data is comparable in most categories to 2019, showing signs of stability in the recovery of the entertainment production industry. 1. Production Days: A 17% increase in Production Days is due primarily to the impact of the COVID-19 pandemic starting in mid-March 2020, when a massive social distancing effort effectively shut down production sets across the country, including Florida where Governor DeSantis enacted a temporary Stay At Home order for non-essential businesses. The total production days for March 2021 aligns with that of March 2019, showing that the Palm Beach County production industry has adjusted and progressed substantially from the hardships and obstacles presented in 2020. 2. Total Productions: A 19% increase in Total Productions is also due primarily to the impact of the COVID-19 pandemic in 2020, which led to a significant decrease in production beginning in mid-March last year. Total Productions have experienced steady growth since October 2020, when the number of COVID cases in Palm Beach County began to wane and the production industry became more experienced and accustomed to the “new normal” set procedures for health and safety. Additionally, the Tourism Branded Content Sponsorship Program had several programs go back into production starting in March 2021, including Art Adventures of The Palm Beaches, Birding Adventures of The Palm Beaches, Washington Spirit Soccer Team and A Wild Connection. 3. Total Leads: A 34% increase in Total Leads is due to the FTC staff actively generating and pursuing leads for new business, as well as cultivating relationships with returning clients. While major production epicenters like California and New York were undergoing continuous shutdowns to slow the spread of COVID-19 in January and February 2021, Florida remained open for business. Additionally, unpredictable (and at frequently harrowing) weather patterns across the country made Florida’s year-round warm climate an appealing and secure option for production in the winter months. 4. Lead Responses: A 34% increase in Lead Responses goes hand-in-hand with the increase in Total Leads (as described above). Leads are handled carefully, providing specific resource information tailored to each project to include a customized Locations Package, if applicable. 5. Lead Conversions: A 24% increase in Lead Conversions is due to the FTC’s expert knowledge of the region to recommend ideal locations for various production needs. With a larger number of leads this month, the FTC was able to successfully assist a large percentage of those leads into business in Palm Beach County. Conversions this month included a picturesque beach for a dating show setting, a remote natural location for an independent feature, and unique outdoor attractions for a tourism web series. 4.E.

April 2021 Project Status Report Department of Environmental Resources Management Tarpon Cove: The acquisition of beneficially reusable sand generated from the Town of Palm Beach Marina dredging project continues. In the last year, Tarpon Cove has received 58,000 cubic yards of sand with an estimated 32,000 cubic yards remaining. The next phase is anticipated to provide enough material to construct two new mangrove islands in the northern area of the project. The County is soliciting competitive bids for a marine contractor to finish placing rock around the existing islands. For the third year in a row, a pair of American Oystercatchers have been observed nesting on the islands.

TARPON COVE

Earth Day Events at Currie & Bryant Park: In late April, volunteers at a County-organized cleanup event at Currie Park removed 840 pounds of trash from the mangrove planters along the shoreline. A second volunteer event organized by Visit the Palm Beaches, with the assistance of Palm Beach County, Palm Beach Ecotourism Association, and the Beach Bucket Foundation, attracted 65 volunteers who removed nearly 600 pounds of trash from the shorelines of Bryant Park, Snook Islands and Jewell Cove from land and by kayak. CURRIE PARK CLEANUP

Lake Worth Lagoon Management Plan: The draft version is open for public review until May 20th, 2021. This is the fourth iteration of the Lake Worth Lagoon Management Plan since initial adoption in 1998. The first and second updates were finalized in 2008 and 2013, respectively. The current plan focuses on a watershed-based management approach, since the health of the Lagoon is inextricably linked to the activities and inputs received from its expansive watershed. We look forward to your comments on the Plan, in specific the Action Plans, as they identify the management priorities for the Lagoon and the strategies identified to accomplish these. Lake Worth Lagoon Initiative Legislative Funding Request: The 2022 Legislative Funding Request application period is open from May 1st through July 31st, 2021. Municipalities and special taxing districts located along the Lagoon and throughout its watershed are encouraged to submit shovel ready projects such as environmental restoration, septic-to-sewer conversions, and stormwater system improvements aimed at improving the water quality and habitats of the Lagoon. Oystercatcher Nesting: Nesting season has begun for American Oystercatchers in the Lake Worth Lagoon. So far, two chicks have been spotted at the Grassy Flats Restoration Project and one at the Bryant Park Restoration Project. Actively nesting pairs have also been observed at the Tarpon Cove and Snook Islands Restoration Projects. This is the 15th consecutive year of successful nesting and fledging of oystercatchers at restored sites in the Lagoon. PHOTO BY GAEL SILVERBLATT

Insecticide Field Trials: ERM staff collaborated with UF/IFAS and ADAPCO to conduct field trials of two different insecticide products against local populations of Culex quinquefasciatus mosquitoes. Caged mosquitoes were placed in a six by three grid downwind of a spray path. Truck mounted equipment was used to apply the two products. Mosquitoes were transferred to clean cages and mortality was logged at timed intervals. Results of this testing are used to support operational mosquito control in Florida and the ongoing resistance testing ERM has been conducting.

DANCING LADY ORCHID

MOSQUITO CAGES

Million Orchid Project: ERM staff are partnering with FAU Pine Jog to pollinate the dancing lady orchids (Tolumnia bahamensis) that were planted at Lantana Scrub and Jupiter Ridge Natural Areas. These orchids were planted as part of the Million Orchid Project and are a state listed endangered species. The pollination process is simple but requires precision, as both the flower and the pollinia (pollen packets) are tiny. The orchid is naturally pollinated by a species of bee found only in Florida and the Bahamas; the males of the species mistake orchid flowers within their territories for rival insects and attack them, transferring pollinia between flowers in the process.

by Mat Forrest Destinations Florida Government Affairs 2021 Legislative Session Summary The 2021 General Session concluded on Friday afternoon. In total, 3,140 Bills and PCBs were filed for consideration during the 5 pre-Session committee weeks and 60 days of the actual Session. From that, 275 or roughly 8.8% passed both chambers and await approval from the Governor. A summary of relevant DMO legislation is below but I’m happy to report that legislation that expanded the use of TDT’s did not pass the Senate. Enjoy the brief victory because it faced little to no opposition in the House so I anticipate it will be back again next Session, which is months, not a year, away. Legislation TDT Expansion… Failed Legislation that would have significantly impacted TDT and CDT’s passed the House but was never considered by the Senate. The language was contained in a standalone bill, HB 1429, and also added to the House “Tax Package”, HB 7061, which is an omnibus bill for various tax issues. The Senate removed that section during final negotiations on the bill before passage. HB 1429 and SB 2008 - Tourist And Convention Development Taxes by Rep. Avila (R, Hialeah) and Sen. Diaz (R, Hialeah Gardens) would have expanded the allowed uses of TDTs authorized in 125.0104 F.S. and the Convention Development Taxes authorized in 212.0305 F.S. to allow counites to “Finance flood mitigation projects or improvements” with the funds. As filed, the bills also required a referendum to renew both taxes every 5 years however the House sponsor amended his bill to remove that requirement during the second committee reference. As passed by the House, the bill would still expand the uses to allow flood mitigation projects. tourist taxes by a resolution of the board thus leaving only a referendum as an option. Specifically, the bill said: 125.0104, Florida Statutes, are amended to read: (3) TAXABLE PRIVILEGES; EXEMPTIONS; LEVY; RATE.— d) In addition to any 1-percent or 2-percent tax imposed under paragraph (c) the governing board of the county may levy, impose, and set an additional 1 percent of each dollar above the tax rate set under paragraph (c) by the extraordinary vote of the governing board for the purposes set forth in subsection (5) or by ordinance subject to referendum approval by the registered electors within the county or subcounty special district, in accordance with subsection (6). No county shall levy, impose, and set the tax authorized under this paragraph unless the county has imposed the 1-percent or 2-percent tax authorized under paragraph (c) for a minimum of 3 years prior to the effective date of the levy and imposition of the tax authorized by this paragraph. Revenues raised by the additional tax authorized under this paragraph may shall not be used for debt service on or refinancing of existing facilities as specified in subparagraph (5)(a)1. unless approved in a referendum election by a majority of the electors voting in such election in the county or the subcounty special taxing district by a resolution adopted by an extraordinary majority of the total membership of the governing board of the county. If the 1-percent or 2-percent tax authorized in paragraph (c) is levied within a subcounty special taxing district, the additional tax authorized in this paragraph shall only be levied therein. The provisions of paragraphs (4)(a)-(d) shall not apply to the adoption of the additional tax authorized in this paragraph. The effective date of the levy and imposition of the tax authorized under this paragraph shall be the first day of the second month following approval of the ordinance by referendum, as set forth in subsection (6), or the first day of any subsequent month as may be specified in the ordinance the governing board or the first day of any subsequent month as may be specified in the ordinance. A certified copy of such ordinance shall be furnished by the county to the Department of Revenue within 10 days after approval of such ordinance. The bill made similar changes to the CDT in 212.0305. The issue of expanding the use for flood mitigation projects was universally lauded by the House. It unanimously passed its first two committees and passed the full House by a vote of 114 to 2 with only Rep. Brown (D, Orange) and Rep. Sirois (R, Brevard) in opposition. The Senate bill was placed on an agenda but never heard.

As I said at the start of this summary, I anticipate this legislation will be back again next Session in one form or another. If this issue is important to your DMO I highly recommend you visit early and often with your delegation members, especially House members, to educate them on your position. Legislation for the 2022 Session will likely start being filed in just 5 or 6 months.

Public Records Exemptions… Failed/Passed This important legislation officially passed the Senate but the House had a different take on it, along with most of the Open Government Sunset Review (OGSR) bills. SB 7020 - OGSR/County Tourism Promotion/Florida Tourism Industry Marketing Corporation was a committee bill, sponsored by the Commerce and Tourism committee which is chaired by Sen. Hooper (R, Clearwater). It was a simple bill that deleted the existing statutory sunset date of the exemption. A trade secret, as defined in s. 812.081, held by a county tourism promotion agency is exempt from s. 119.07(1) and s. 24(a), Art. I of the State Constitution. This subparagraph is subject to the Open Government Sunset Review Act in accordance

with s. 119.15 and shall stand repealed on October 2, 2021, unless reviewed and saved from repeal through reenactment by the Legislature. It passed the Senate without any issues, along with several other OGSR bills, but the House did not hear them. Instead, the House passed HB 1055 relating to Public Records / Trade Secrets by Rep. Gregory (R, Manatee, Sarasota). The House bill summary explains the issue this way: “Florida law contains a variety of provisions that make trade secret information exempt or confidential and exempt from public record requirements. Some exemptions only protect trade secrets, while others protect “proprietary business information” and define that term to specifically include trade secrets. Some exemptions also provide a specific process that an agency must use when protecting trade secret information under the exemption. A majority of these exemptions rely on one of two different statutory definitions. Some of the exemptions define the term in accordance with the Uniform Trade Secrets Act, and some define the term in accordance with Florida’s Criminal Statutes. The bill creates a public record exemption for trade secrets held by an agency that would apply to those agencies that do not have an agency specific public record exemption for trade secrets. The bill defines the term “trade secret” to have the same meaning as the definition currently codified in the Uniform Trade Secrets Act.” This bill, if approved by the Governor, is effective immediately. Destinations Florida is reviewing the legislation to see how it covers DMO’s around the State and we will provide more information at the Marketing Summit later this month. VISIT FLORIDA… Failed The Legislation that would have repealed VISIT FLORIDA’s sunset date failed to get any traction in the House this Session and did not move. In 2020, the statutory date that required VISIT FLORIDA to “sunset” was extended from October 1, 2020 to October 1, 2023. This year’s legislation would remove the Sunset date completely. SB 778 relating to Florida Tourism Marketing by Sen. Hooper (R, Palm Harbor) It also added an important budget policy change to the agency. It states VISIT FLORIDA “May carry forward any unexpended state appropriations into succeeding fiscal years.” The Senate bill initially moved well, easily passing 2 of 3 committee references. However, the identical legislation in the House, HB 675 relating to Tourism

Marketing Entities by Rep. Plasencia (R, Titusville) was never heard. As it became obvious that the House was not going to move the issue the Senate dropped it as well. VISIT FLORIDA BUDGET… $75 million I’m happy to report that not only did the Legislature allocate $50 million for VISIT FLORIDA but they also allocated an additional $25 million from the Federal Coronavirus State Fiscal Recovery Fund. Line 2251 SPECIAL CATEGORIES GRANTS AND AIDS - VISIT FLORIDA FROM STATE ECONOMIC ENHANCEMENT AND DEVELOPMENT TRUST FUND . . . . . . . . . . 29,000,000 FROM TOURISM PROMOTIONAL TRUST FUND . . . . . . 21,000,000 SECTION 152. Contingent upon the Department of Financial Services receiving and depositing into the General Revenue Fund any amount from the state’s allocation from the federal Coronavirus State Fiscal Recovery Fund (Public Law 117-2), the following nonrecurring appropriations from the General Revenue Fund are authorized for the 2020-2021 fiscal year for the purpose of responding to the negative economic impacts of the COVID-19 public health emergency: FLORIDA TOURISM INDUSTRY MARKETING CORPORATION (VISIT FLORIDA) The nonrecurring sum of $25,000,000 is appropriated from the General Revenue Fund to the Department of Economic Opportunity to contract with the Florida Tourism Industry Marketing Corporation to conduct activities that support and fund Florida’s tourism industry and its recovery from COVID-19 through promotion and marketing activities, services, functions, and programs. The last step in the Budget process is when the Governor reviews, vetoes projects, and signs the budget into law. This can take several weeks or even months after Session. The new budget is not technically required until July 1, 2021. Vacation Rentals… Failed Despite initially starting out strong with legislation moving in both Chambers, vacation rental legislation quickly stalled in the House and eventually also failed to make it to the Senate floor. As filed, SB522 and HB0219 - relating to Vacation Rentals by Sen. Diaz (R, Hialeah Gardens) and Rep. Fischer (R, Jacksonville) preempted to the State the ability to regulate short term rentals but after an amendment to the Senate bill, it only preempted the local regulation of platforms. The bill still established a new criteria under the Division of Hotels and Restaurants within the Department of Business and Professional Regulation to issue licenses, but another amendment adopted in the Senate would include funds to hire three staff at DBPR and two at FDLE to assist with the new regulations. It still required the license numbers to be clearly displayed to the public inside the establishment and when they advertise. The legislation, and all proposed amendments, always maintained the current “Grandfather” clause that is in Statute; whereby the proposed prohibitions would not apply to local ordinances in place on or before June 1, 2011. With the changes to the Senate bill, local governments would have maintained all the options that they currently have such as the ability to require inspections. The bill did redefine “advertising platform” as an entity, rather than pertaining solely to individuals. A notable change to the bill this year is that it required the platforms to collect and remit all taxes including the TDT. In the past, the issue of who collected and remitted the taxes, the platform or property owner, was very controversial. The House bill stated: (2) (b) If a guest uses a payment system on or through an advertising platform, as defined in s. 509.013, to pay for the rental of a vacation rental located in this state, the advertising platform must collect and remit all taxes imposed under s. 205.044 and chapters 125 and 212 on the total rental amount charged by the owner or operator for the use of the vacation rental under ss. 125.0104 and 205.044 and this section. In order to facilitate the remittance of such taxes, the department and jurisdictions that require such taxes to be remitted must allow advertising platforms to register, collect, and remit such taxes.

Also of note to the tourism industry, there were provisions in both bills that required various licensing numbers to be displayed in advertisements and what information shall be provided to the State for property compliance: Section 5. Effective January 1, 2022, section 509.243, Florida Statutes, is created to read: 509.243 Advertising platforms.— (1)(a) An advertising platform must require that a person who places an advertisement for the rental of a vacation rental: (1) (a) 1. Include in the advertisement the vacation rental license number and the applicable Florida sales tax registration and tourist development tax account numbers under which such taxes must be paid before the advertisement may be listed; and (1) (a) 2. Attest to the best of their knowledge that the license number for the vacation rental property and the applicable tax numbers are current, valid, and accurately stated in the advertisement (1)(b) An advertising platform must display the vacation rental license number and applicable Florida sales tax registration and tourist development tax numbers. The advertising platform must verify that the vacation rental license number provided by the owner or operator is valid and applies to the subject vacation rental before publishing the advertisement on its platform and again at the end of each calendar quarter that the advertisement remains on its platform. (1)(c) The division shall maintain vacation rental license information in a readily accessible electronic format that is sufficient to facilitate prompt compliance with the requirements of this subsection by an advertising platform or a person placing an advertisement on an advertising platform for transient rental of a vacation rental. (2) An advertising platform must provide to the division on a quarterly basis, by file transfer protocol or electronic data exchange file, a list of all vacation rentals located in this state that are advertised on its platform, along with the following information for each vacation rental: (a) The uniform resource locator for the Internet address of the vacation rental advertisement. (b) Unless otherwise stated in the vacation rental advertisement at the Internet address provided pursuant to paragraph (a), the physical address of the vacation rental, including any unit designation, the vacation rental license number provided by the owner or operator, and the applicable

Florida sales tax registration and tourist development tax account numbers under which taxes will be remitted for the rentals commenced through the advertisement. (3) An advertising platform must remove from public view an advertisement or listing from its online application, software, website, or system within 15 business days after being notified by the division in writing that the subject advertisement or listing for the rental of a vacation rental located in this state fails to display a valid license number issued by the division. (4) If the division has probable cause to believe that a person not licensed by the division has violated this chapter or any rule adopted pursuant to this chapter, the division may issue and deliver to such person a notice to cease and desist from the violation. The issuance of a notice to cease and desist does not constitute agency action for which a hearing under ss. 120.569 and 120.57 may be sought. For the purpose of enforcing a cease and desist notice, the division may file a proceeding in the name of the state seeking the issuance of an injunction or a writ of mandamus against any person who violates any provision of the notice. If the department is required to seek enforcement of the notice for a penalty pursuant to s. 120.569, it is entitled to collect its attorney fees and costs, together with any cost of collection. These are the most notable provisions for the tourism industry, but I highly recommend you have your legal team review the entire legislation. While the legislation did not pass this year, the overall issue remains active. The balance of individual property rights, home rule authority, commercial vs. residential uses, and lastly how existing State regulations on hotels intersects with a growing vacation renal industry will keep this issue alive for future Sessions. I anticipate legislation next Session will again try to navigate this complicated issue. Big Tech Boycott… Failed In response to the social media platforms that banned President Trump and related accounts, two bills were filed that, if passed, would have significantly impacted advertising and marketing options. SB 810 and HB 439 Prohibited Governmental Transactions Involving Certain Companies and Products by Sen. Gruters (R, Sarasota) and Rep. Fine (R, Palm Bay) were short bills with broad impact. In summary they stated: 2) An agency or local governmental entity may not purchase, or enter into or renew a contract for the purchase or provision of, any good or service made, sold, or provided by Facebook, Inc.; Twitter, Inc.; Amazon.com, Inc.; Apple, Inc.; or Alphabet, Inc.

Obviously, if passed and signed by the Governor, they would have had a dramatic impact on DMO’s as well as many other aspects of State and Local government. We spoke early with both sponsors and I’m happy to report the bills were never heard. What’s Next?

The 2022 Regular Session dates are “early” and convene on Tuesday, January 11, 2022 and conclude on March 11, 2022. I took a quick look at the calendar and, if my math is correct, we are 3 days past the end of the 2021 Session but only 252 days before the official start of the 2022 Session. And that doesn’t even count the Committee weeks that will likely take place in September, October, November, & December. It should also be noted, that unlike the start of the 2021 Session, when the legislators return to Tallahassee this Fall, their offices, their Committees, and their roles are unlikely to change. So not only will it start soon, but you can bet legislation will also move quicker than it did for this Session. Please stay engaged with your Delegation this Summer. Strive to personally know each of them and educate them on the issues that are important to the Tourism industry. The 2021 Session is over. Advocacy for the 2022 Session starts today. ###
