Fireworks - Yes in County; No in Leon City Limits As former Governor Terry Branstad was quoted as saying when he signed a new fireworks bill on May 9 that now legalizes the sale and use of consumer –grade fireworks in Iowa, “Let the Fireworks Begin.” The Bill that Branstad signed, does however, allow for counties and cities to opt out. That is what the City of Leon has decided to do, but not the Board of Supervisors. The Leon City Council discussed the new Fireworks legislation that has been passed by the State of Iowa during the May 18 City Council Meeting and voted to not change the current City Code which concerns the area within the city limits. It is as follows: 2.1-1.0304 (2) Regulations. It shall be unlawful for any person to offer for sale, expose for sale, sell at retail, or use or explode any fireworks; provided the city may, upon application in writing, grant a permit for the display of fireworks by a city agency, fair associations, amusement parks and other ...organizations or groups of individuals approved by city authorities when such fireworks display will be handled by a competent operator. No permit shall be granted hereunder unless the operator or sponsoring organization has filed with the city evidence of insurance. 2.1-1.0304(3) Exceptions.
This shall not be construed to prohibit any resident, dealer, manufacturer or jobber from selling such fireworks as are not herein prohibited; or the sale of any kind of fireworks provided the same are to be shipped out of state; or the sale or use of blank cartridges for a show or theater, or for signal purposes in athletic sports or by railroads, trucks, for signal purposes, or by a recognized military organization; and provided further that nothing in this section shall apply to any substance or composition prepared and sold for medicinal or fumigation purposes. However, the Board of Supervisors met Monday, June 12 and decided to go along with the State of Iowa to okay fireworks. Meaning that fireworks are legal to sell or use between certain times of the year which includes June 1 to July 8 and December 10 to January 3 in the outlying areas of the County. It was not known by press time what the City of Lamoni has decided or any of the other incorporated areas of the county. Also in the Board’s discussion, was what to do in the event a burn ban is placed on the County. The Board and County Attorney Lisa Jeanes are working on language for this exception that will be included in the County Ordinance.
