GOOD MORNING

The San Juan Daily Star, the only paper with News Service in English in Puerto Rico, publishes 7 days a week, with a Monday, Tuesday, Wednesday and Thursday edition, along with a Weekend Edition to cover Friday, Saturday and Sunday.

González Colón campaign’s ‘En La Calle’ phase is strong out of the gate, chairman says

The chairman of Resident Commissioner Jenniffer González Colón’s gubernatorial campaign, Francisco Domenech, on Monday described the beginning of the new phase of the campaign, dubbed “En La Calle con Jenniffer,” as a resounding success, saying “it was demonstrated once again that the street is with Jenniffer.”

“She is the candidate who is with the people,” Domenech said. “This weekend, Jenniffer was in direct contact with thousands of people in the east and mountain areas where she visited public housing projects, communities and businesses, among other places.”

Once the phase of collecting early voting applications was completed, the campaign of the New Progressive Party (NPP) vice president pivoted over the weekend to its next “On the Street” phase. Along with her running mate, resident commissioner candidate Elmer Román, and candidates for the legislature and mayorships, the resident commissioner was in Morovis, Orocovis, Barranquitas, Naguabo, Ceiba, Fajardo and Luquillo.

The new campaign phase will not be limited to weekends, but will also be active on weekdays in order to impact the entire island, Domenech said. The aim, he added, is to mobilize every voter in Puerto Rico who wants a change to vote for Jenniffer González for governor in the NPP primary.

“On June 2, the November elections will be decided,” Domenech emphasized.

“The moment for [incumbent governor Pedro] Pierluisi to have reconsidered and avoided a primary was last September when I privately warned them about their political non-viability for the election,” said the González Colón campaign’s political director, Ángel Cintrón. “Instead of

having done the right thing for the party and having given way to Jenniffer, as Rafael Hernández Colón, Sila Calderón and Alejandro García Padilla did in a mature PDP at the time, Pierluisi’s inner circle never told him the truth about his political weakness and kept him in this race unnecessarily. We already have the responsibility to compete to ensure that the NPP and Puerto Rico win on June 2 and November 5 with Jenniffer González and Captain Elmer Roman leading the winning ballot.”

“Today, Pierluisi’s team is making a call of total desperation, asking Jenniffer to remove herself 48 days before the primaries, because they know that we are going to win the primary event on June 2 by a landslide,” Domenech said. “A person who is sure that he will prevail is not asking for his opponent to be withdrawn. They show fear and desperation.”

The campaign’s electoral director, Aníbal Vega Borges, indicated that “the early vote, no matter who collected it, which were the volunteers of all the local candidates and volunteers of the party, those votes respond to the clamor of the people and will represent the same trend in favor of Jenniffer becoming our next governor.”

In the opposing primary camp, meanwhile, Gov. Pedro Pierluisi Urrutia’s campaign director, Edwin Mundo Ríos, revealed the statistics of early voting requests from the NPP, which registered 90,775 requests.

Mundo asserted that “the process of requesting early voting carried out by Pedro Pierluisi’s campaign demonstrates, without a doubt, that he is the candidate who has the most support and the best structure to win the primary and the general election.”

The seasoned electoral veteran announced that, of the 90,775 applications registered, as of midday Monday, with the State Election Commission (SEC), a total of 63,078 applications -- or 69.49% -- were managed and delivered by Pierluisi’s electoral and campaign team. Mundo also revealed that González Colón’s campaign team submitted a total of 16,072 applications, or 17.70%.

Another 11,625 applications -- 12.81% -- were managed by voters through the electronic platform “eRe”, email, inmates, among others.

Mundo challenged the resident commissioner’s team to accept the result with only 90,775 voters, after former Toa Baja mayor Aníbal Vega Borges, a member of González’s team, spoke about collecting early voting requests.

“This way supporters of statehood will be able to see which campaign is lying and which team is best prepared to give the NPP an electoral victory in November,” Mundo said. “If you wish, we can also award the election with early voting. Thus, we save the people money and controversies for the party in an unnecessary primary.”

Governor declares himself ‘surrendered to the Lord’

Gov. Pedro Pierluisi Urrutia announced that he has become a “born-again” Christian during the New Progressive Party Public Servants Convention over the weekend, stirring a wave of criticism over what some said was an attempt to garner voters from the religious sector.

“I have today, possibly because of the responsibility on my shoulders and the years I have, I am nowadays today surrendered to the Lord, totally surrendered to the Lord,” he said at the convention on Sunday, according to a video posted in X (formerly Twitter). “Everything that will happen in my life’s future and in your future is in the hands of the Lord. And I accept the will of God.”

Pierluisi said God has given him abilities, skills and opportunities and that he will use all of it to help Puerto Rico for four more years.

“Lord Almighty,” noted former Popular Democratic Party and now independent Rep. Luis Raúl Torres Cruz on his Twitter page about a video of the activity showing Pierluisi announcing he is a born-again Christian.

A lawyer and radio panelist, Marilú Guzmán, also criticized the governor.

“How far would he go in his political demagoguery?” she asked.

Another person on social media noted that “the most disgusting thing a person can do is use religion as a scheme to politicize and get rich.”

“To sell himself as a believer in front of those people and use it as a political platform, you have to be disgusting,” the commenter said.

Michael Corona, a pro-statehood lawyer, said that “When a left-wing democrat like Pierluisi talks about surrendering to God, what it means is that he wants them to give him the power so that the giant government apparatus that he runs can continue doing whatever it wants.”

“The difference with the communist left is that they are atheists,” Corona said. “They rule with absolute power but do not need to invoke the Creator to do so.”

La Fortaleza had not answered requests for comment as of press time. However, surveys tend to show that candidates from different religious backgrounds fare better than those who are atheists.

In the case of U.S. presidential candidates, for instance, Gallup data shows an increased willingness among members of the public to support presidential candidates from a wide range of religious backgrounds, with a small proportion of the public still unwilling to vote for an atheist, Mormon or Muslim.

Number of artists boycotting Poli/Grafica Art Exhibit grows

Close to 30 artists have withdrawn their works from the Poli/Gráfica Art Exhibit, Puerto Rico’s most important art exhibition, to protest what they perceive as censorship against one of the artists.

The boycott is to protest the Institute of Puerto Rican Culture’s (ICP by its Spanish initials) alleged censorship of Puerto Rican artist Garvin Sierra Vega, who wanted to present a work related to Puerto Rico’s debt. The ICP, in a statement, insisted it supports artistic freedom, that it was all a huge mistake, and that the exhibit’s curator, Lisa Ladner, is no longer with the event.

According to the publication En Blanco y Negro, artists Charles Juhaz-Alvarado, Yolanda Velázquez-Vélez, Antonio Martorell and Marta Pérez García, among others, have already withdrawn works.

The ICP, in a statement from Elvis Fuentes, chief curator of the Poli/Gráfica; María del Mar Caragol Rivera, director of the Studio Arts Program and ICP Director Carlos R. Ruiz Cortés, apologized and clarified.

“In recent online posts, it has transpired that curator Lisa Ladner’s communications inadvertently created the appearance of a censorship exercise against Puerto Rican artist Garvin Sierra Vega. This is a fact that we deeply regret, and therefore, we express our apology for any misunderstanding

caused,” the ICP said.

Last July, the ICP said Ladner contacted Sierra Vega about possibly participating in Poli/Gráfica with excerpts from a work about Puerto Rico’s debt and those responsible in the island’s government.

“Ladner clarified that due to her role as honorary consul of Switzerland, she had to consult with her superiors to avoid any appearance of conflict. Given this communication, Sierra Vega wrote a letter to the executive director of the Institute of Puerto Rican Culture, denouncing what he perceived as censorship and declining to participate in the exhibition,” the ICP said. “Ladner wrote to Sierra Vega on August 15 of that year, clarifying the misunderstanding and offering the responsibility for curatorial coordination be passed into the hands of the project’s chief curator, Elvis Fuentes. There was no response from the artist to this communication.”

“Artistic expression is a fundamental right and we recognize the importance of supporting diverse voices and perspectives within our community,” the ICP said. “La Poli/ Gráfica has always aimed to be a space where artists can freely share their creativity and ideas without fear of censorship or repression. In fact, that is one of the central themes of the exhibition we are organizing right now: Under Pressure.”

However, the ICP said, “in our efforts to uphold community guidelines and standards, there may be cases where our actions were perceived as limiting artistic freedom. This

was never our intention and we sincerely apologize for any impact this may have had on the affected artist, an artist of enormous prestige, and on his followers and colleagues.”

The ICP said it was committed to rectifying the situation and ensuring that its practices are transparent, fair and respectful of artistic expression.

Gov’t urges students to seek federal student aid grants

Gov. Pedro Pierluisi Urrutia; Chris Soto, the principal adviser of the federal Department of Education; and island Education Secretary Yanira Raíces Vega on Monday joined the White House call to urge university students and graduating seniors to complete their Free Application for Federal Student Aid (FAFSA).

“University education is key for our young people; it shapes their minds, opens doors, and paves the way for a future of prosperity and success. That is why it is essential to continue expanding and democratizing access to education for every son and daughter of our land,” Pierluisi said at an event held at José Celso Barbosa School in Puerta de Tierra. “The federal Department of Education is key to these goals, particularly with Pell Grants. This much-needed aid has been a lifeline for countless Puerto Rican students, allowing them to access quality higher education at our public and private universities and easing their financial burden. I must point out that we must celebrate the significant increase in the Pell Grant cap by the Biden-Harris Administration to $7,395, as it is an act of great social justice that will change the lives of thousands and thousands of young American citizens, including those who reside here in Puerto Rico.”

Chris Soto (seen here standing directly to Gov. Pedro Pierluisi’s left), the principal adviser of the U.S. Department of Education, said of the Free Application for Federal Student Aid: “We know it will open the doors to a college education, providing more federal aid to students. Puerto Rican students and families deserve every one of our efforts.”

During the event it was noted that the FAFSA form underwent significant changes last year to simplify the filling process and ensure that everyone who needs it can access federal assistance. Like any change, the process has had challenges, which is why guidance is essential and everyone who can help young people should do so. The federal Education Department seeks more than 650,000 additional students to fill out the FAFSA and expects that about 7.1 million students will be eligible for aid in the new 2024-2025 period. Soto, who is the principal adviser to U.S.

Education Secretary Miguel Cardona, said: “We congratulate the commitment of the governor, the Department of Education of Puerto Rico, higher education leaders, economic aid officials, and the community for joining the week of action to encourage students to complete and submit their FAFSA form.”

“The FAFSA is the top priority for the U.S. Department of Education,” he said. “We know it will open the doors to a college education, providing more federal aid to students. Puerto Rican students and families deserve every one

of our efforts.”

Raíces Vega added that “this is the first time that the Puerto Rico Department of Education has worked so closely with the federal Department of Education.”

“These collaborative ties stem from a great relationship that Governor Pierluisi has built and to which we have continued leading the agency,” she said. “For us it is extremely important that our students continue post-secondary studies and we will join forces to collaborate with them in everything they need so that they can apply for federal aid to pay for their studies.”

The federal Education Department provides various resources to assist students and their families in completing the FAFSA. They include YouTube videos and tips to clarify doubts, as well as seminars to guide them through the process. This Wednesday, April 17, at 7 p.m., the first virtual seminar, or webinar, will be held in Spanish by the federal Education Department on how to complete the FAFSA form.

“Education is the key to success for our youth, so we will always collaborate to ensure that each young person has the tools and opportunities necessary to reach their maximum potential and contribute to the future of our island,” the governor said. “I am honored to be able to join the Biden-Harris Administration and the federal Department of Education in the goal of helping our young people get ahead.”

Senator seeks $27 million for more ferry trips between Ceiba and Vieques & Culebra

Carolina District Sen. Marissa “Marissita” Jiménez Santoni is asking the Financial Oversight and Management Board for authorization for a recurring allocation of $27 million in order to increase the number of ferry trips between Ceiba and the offshore island municipalities of Vieques and Culebra.

“After holding a dialogue with the mayors of Vieques and Culebra, José ‘Junito’ Corcino and Edilberto ‘Junito’ Romero, we believe that there is a real need to increase the number of passenger and cargo trips from the Ceiba terminal in Roosevelt Roads to those two island municipalities,” Jiménez Santoni said. “To do this, an injection of funds is necessary, which is estimated at about $27 million.”

“Faced with this situation, we are sending a letter to the executive director of the Board, Robert Mujica, requesting a meeting as a matter of urgency to outline our proposals, with corroborable data, on the need to increase the number of trips to and from Vieques and Culebra daily,” the senator added. “In the case of Vieques,

there is currently an increase in the number of people leaving Ceiba every day to work there due to the construction of the new hospital, as well as other permanent works. Meanwhile, the peak summer tourist season is approaching; that’s why more travel [capacity] is needed.”

Several weeks ago, Jiménez Santoni held a meeting with the mayors of Vieques and Culebra, as well as with Transportation and Public Works Secretary Eileen Vélez Vega, officials from the Integrated Transportation Authority (ATI) and executives of HMS Ferries, a private operator that provides maritime transportation service in Puerto Rico.

“The population of Vieques, of about 8,000 inhabitants, often doubles in the summer months and even more so now with so much work being carried out, so it is necessary to increase the number of trips,” the senator said. “The $27 million amount was estimated by the ATI and the private operator (HMS Ferries) to cost a 30% increase in trips every 12 months. Our request is for the 2024-2025 fiscal year that begins on July 1 and it is tied to performance metrics, always measuring efficiency and the needs of the people.”

An estimated $27 million is needed to meet the demand for more frequent ferry service from the main island to the offshore island municipalities of Vieques and Culebra.

Jan. 6 obstruction case at Supreme Court could help Trump and many others

At first blush, the case that the Supreme Court will hear today seems technical, requiring the justices to parse a decades-old statute mainly concerned with the destruction of business records.

But the case has the potential to knock out half of the federal charges against former President Donald Trump for plotting to subvert the 2020 election, entangle hundreds of Jan. 6 prosecutions and help adjudicate the very meaning of the attack on the Capitol.

The immediate question for the justices is whether a federal law aimed primarily at white-collar crime, the Sarbanes-Oxley Act of 2002, can be used to prosecute members of the mob who stormed the Capitol on Jan. 6, 2021, including the defendant in the case, Joseph Fischer, a former Pennsylvania police officer. More than 300 people have been prosecuted under the law, which makes it a crime to obstruct an official proceeding.

The immediate purpose of the law, enacted in the wake of the collapse of Enron, fits uneasily with the prosecutions arising from the violent riot that forced a halt to the constitutionally required congressional count of electoral ballots. But its language is broad, and prosecutors say its plain terms cover Fischer’s conduct.

Trump is not involved in the case, but he could benefit from a ruling in Fischer’s favor. If the Supreme Court rules that what Fischer is accused of having done is not covered by the 2002 law, Trump will doubtless argue that the law does not apply to his actions either.

Even if he succeeds, though, he will still face two other charges not at issue in Fischer’s appeal: conspiracy to defraud the United States and conspiracy to interfere with constitutional rights.

In a separate case to be argued April 25, the court will hear arguments over whether Trump is immune from prosecution on any of the charges against him.

The question before the justices in Fischer’s case is legal, not factual. They must decide what the statute means, not what Fischer did. That will be a question for the jury, if the justices let the charge stand.

Still, the briefs filed in the case and court records set out contrasting depictions of Fischer’s conduct that seem emblematic of a political discourse grounded in alternate realities.

According to the government, Fischer sent text messages to his boss, the police chief

Rioters force their way into the Capitol in

of North Cornwall Township, Pennsylvania, about his plans for that Jan. 6. “It might get violent,” he said in one. In another, he wrote that “they should storm the capital and drag all the democrates into the street and have a mob trial.”

Prosecutors say videos showed Fischer yelling “Charge!” before pushing through the crowd and entering the Capitol around 3:24 p.m. Jan. 6. He used a vulgar term to berate police officers, prosecutors said, and crashed into a line of them. He was, the government’s brief said, “forcibly removed about four minutes after entering.”

Fischer’s lawyers, by contrast, stressed that he had attended the rally on the Ellipse but was not part of the initial assault.

“When the crowd breached the Capitol, Mr. Fischer was in Maryland, not Washington, D.C.,” his lawyers wrote in their brief. “He returned after Congress had recessed.” (“Recessed” is not the first word that comes to mind to describe lawmakers fleeing from a violent mob.)

“His earlier Facebook posts about violence, when read in context, refer to his belief that antifa planned to disrupt the rally,” they continued. He had yelled “Charge!” in “obvious jest,” they added.

Video evidence shows, his lawyers wrote, that Fischer “did not ‘run’ toward the police line or crash into it; he was knocked to the

ground (as was an officer) by the crowd surge.”

“Finally,” they added, “he was not ‘forcibly removed’; he walked out on his own.”

Those starkly different accounts are echoed on a larger scale in supporting briefs that focus on the nature and meaning of Jan. 6, reflecting efforts by Trump and his supporters to rewrite history and reframe the attack as a legitimate political protest.

Republican lawmakers allied with Trump, including Sen. Tom Cotton, R-Ark., and Rep. Jim Jordan, R-Ohio, said in one brief that “the Department of Justice and D.C. juries have readily attributed immorality to the genuine belief of many Jan. 6 defendants that there was fraud during the 2020 presidential election.”

Protests are part of the fabric of political life, they wrote, adding that the prosecutors’ interpretation of the statute would have applied to a peaceful rally led by the Rev. Martin Luther King Jr.

“Advocacy groups throughout history have organized trips to Washington timed to congressional or executive consideration of favored items,” the brief said, going on to quote from a magazine article. “Most famously, the 1963 civil rights ‘March on Washington’ ‘was designed to force President Kennedy to support the Civil Rights Act’ then pending in Congress.”

The brief discussed other protests, too, including the disruption of the Supreme Court confirmation hearing of Justice Brett Kava-

naugh, praising the Trump administration’s restraint.

The Biden administration, in its brief, drew several distinctions. The law, it said, “covers acts that hinder a proceeding — not acts, like lobbying or peaceful protest, that are not readily characterized as rising to the level of obstruction or that independently enjoy protection under the First Amendment.”

The brief added that the law only applied to conduct directed at a specific proceeding and required proof that the defendant had acted corruptly.

Critics of Trump’s — including J. Michael Luttig, a conservative former appeals court judge, and John Danforth, a former Republican senator from Missouri — countered that the comparisons pressed by Cotton and Jordan were profoundly misplaced.

“There is simply no historical comparison between the consequences of criminal acts in opposition to the election of a new president — as illustrated by both our Civil War and the Jan. 6, 2021, invasion — and the ‘what about’ examples discussed in the Cotton-Jordan brief,” they wrote in a brief. “Indeed, no one was physically hurt” as part of “any of those examples.”

“And none of those examples,” they added, “threatened something remotely as fundamental to our constitutional system as the peaceful transfer of executive power.”

Can a Christian community close the beach on Sunday mornings?

Along the Atlantic coast, about 60 miles south of Manhattan, is a beach town that defies the rowdy image of the Jersey Shore.

In Ocean Grove, where the beach has been controlled by a conservative Christian nonprofit for more than 150 years, no alcohol is sold. The Christian flag, a white banner with a red cross, flies beneath an American flag near the beach. Two wooden crosses stand in the sand. A massive pier in the shape of a cross was unveiled last year.

And perhaps most notably, in Ocean Grove, where the welcome sign calls the community “God’s Square Mile,” the beach is closed before noon on Sundays.

This week, a New Jersey court will wrestle with the beach closure and whether the Ocean Grove Camp Meeting Association, which owns the property, has the right to impose religiously motivated restrictions on the public.

The issue has roiled the close-knit community since last summer, and in October the state’s Department of Environmental Protection ordered the Christian nonprofit to stop blocking Sunday beach access or risk fines up to $25,000 a day. The association has appealed the order.

This week, a New Jersey court will wrestle with the beach closure and whether the Ocean Grove Camp Meeting Association, which owns the property, has the right to impose religiously motivated restrictions on the public. (Hannah Yoon/The New York Times)

“Part of the magic of this town is that you can’t do anything you want,” said Sarah Izzo, owner of a craft gift shop on Main Avenue called Serenity by the Sea. “You have to stay within the rules.”

She added, “Other beaches are party towns. This is a different vibe.”

Ocean Grove was established in 1869 as a Methodist camp meeting that served as a summer haven for Christians. More than 150 years later, its rows of Victorian homes include a mix of religious and nonreligious residents of about 3,000 people.

The association, which has its own governing board, maintains control of the land, staffs the beach with lifeguards, and sometimes hosts Christian services in its beachfront pavilion and baptisms on the beach, which is less than a mile long.

The community has been visited by several U.S. presidents and famous Christian leaders, including evangelist Billy Graham and Christian hymn writer Fanny Crosby. Sunday worship is held in the Great Auditorium, a historic wooden hall that seats about 7,000 people. Surrounding the auditorium is a large tent community, where families come in the summer to live in canvas tents connected to side-by-side cabins.

On a recent Sunday in her three-story home near the beach, Kristin Tito was scrolling through Facebook debates over the beach issue while eating clam chowder. She said some residents, like herself, are not religious but love the history and the traditions of Ocean Grove.

businesses instead of the beach.

“Regardless of one’s beliefs, spending the morning hours in an unhurried morning stroll on a less crowded boardwalk has emotional, spiritual and bodily health benefits,” Connelly wrote. The president of the association declined to comment on the case.

This is not the first time the state has intervened in Ocean Grove’s operations. The unincorporated community once had its own police force, enforcing blue laws that banned practices like driving, bicycling, swimming and hanging clothes outdoors on Sunday. However, the New Jersey Supreme Court in 1979 ruled that Ocean Grove’s government was unconstitutional, saying it violated the First Amendment, which “precludes a state from ceding governmental powers to a religious organization.” Ocean Grove’s municipal power, including its police force, was transferred from the association to Neptune Township, which has a population of about 28,000.

Tito, whose family has been coming to Ocean Grove since the 1930s, moved there in 1997 and appreciates the community’s quirks.

“I’d love to go to the beach on Sunday morning, but I also love that it’s quieter on Sunday,” Tito said. “I would probably burst into flames if I walked into a church, but I would feel sad if they lost their traditions.”

The association has owned land in Ocean Grove since the state granted its charter in 1870. The organization purchased 11 acres of beachfront for $50 and then purchased an additional 266 acres for $40,000 in 1875, according to documents submitted for the area’s inclusion on the National Register of Historic Places.

State officials decided last year that by blocking the beach on Sundays, the association violated the Coastal Area Facilities Review Act, a law based on the “public-trust doctrine,” which gives the government rights to natural resources for the public good.

In its request for a hearing, an attorney for the association argued that the state’s order is an unconstitutional infringement on the association’s religious beliefs and practices. The association’s Sunday beach closure is part of its mission to build and maintain a beautiful seaside community to serve as a place for meditation, reflection and renewal, the attorney, Michael J. Connelly, wrote.

The association argued that it also had secular arguments for beach closure, including giving lifeguards time off, reducing traffic and noise, and allowing visitors to frequent local

And the association has gone to court before over the public’s access to its spaces. In 2007, two lesbian couples were denied after they asked to have their civil union ceremonies in its boardwalk pavilion. After a state judge ruled that the association had violated the state’s law against discrimination, it stopped allowing the general public to use the pavilion for weddings.

When Shane Martins bought a home in Ocean Grove in 2019, he appreciated that Ocean Grove had a relatively large gay population. Martins said he followed the beach rules when he first moved there because he respected the long-standing tradition. He grew frustrated, though, by the Christian cross imagery on Ocean Grove’s beach passes, which he believed violated the First Amendment. When the beach is open, anyone above age 11 is expected to display the pass, which costs $95 per adult for the 2024 summer season, so they can show badge checkers at the boardwalk entry points.

The cross-shaped pier that opened last year was the last straw for Martins, and he co-founded a group Neptune United, which has been fighting the association’s beach rules. He and dozens of other people last summer protested by gathering on the beach Sunday mornings.

The association has long avoided paying taxes on its beach by dedicating it to the public in 1989 through the state’s Green Acres Program. Martins believes the association is in violation of the program because it says beach owners cannot restrict the public’s right of access unless it is necessary for maintenance or to preserve natural resources.

“If the camp wants the beach to be private, I am happy for them to be private,” Martins said. “Then they have to pay taxes on it. You can’t have your cake and eat it too.”

US stocks slide as treasury yields rise, middle east tensions simmer

Wall Street wavered, U.S. Treasury yields rose and the Japanese yen hit a 34-year trough on Monday as solid data and a calmer Middle East after Iran’s weekend attacks on Israel helped revive investor risk appetite.

The three major U.S. stock indexes pared initial gains and the Nasdaq turned slightly negative after Friday’s steep sell-off, while the yen fell to its lowest level since 1990, reviving intervention fears.

U.S. retail sales data for March blew past analyst expectations, the latest evidence in the case for the resilience of the American consumer.

“The retail sales number was a good bit better than expected and the consumer’s showing signs of being strong,” said Thomas Martin, Senior Portfolio Manager at GLOBALT in Atlanta.

“You’re seeing a back-up in yields, which is probably being driven by the continuing strength of the consumer and reverberations from the inflation report last week,” Martin added.

On the geopolitical front, Iran’s missile and drone attack against Israel over the weekend caused minimal damage, and calls for restraint regarding Israel’s response appeared to be calming helping tensions in the region.

“Iran’s attack was tit for that, but it didn’t work and now it’s over,” Thomas said. “That puts markets on a better footing; you see that in oil, and the volatility index is off.”

“There’s willingness to take risks that’s being reflected in the stocks.”

The Dow Jones Industrial Average rose 106.19 points, or 0.28%, to 38,089.43, the S&P 500 gained 9.88 points, or 0.19%, to 5,133.29 and the Nasdaq Composite dropped 3.13 points, or 0.02%, to 16,171.97.

European shares gained ground as tensions in the Middle East abated, boosted by surging shares in Temenos after a committee formed by the software company called damaging claims by Hindenburg Research, who shorted the stock, “inaccurate and misleading.”

The pan-European STOXX 600 index rose 0.20% and MSCI’s gauge of stocks across the globe shed 0.07%.

Emerging market stocks lost 1.03%. MSCI’s broadest index of Asia-Pacific shares outside Japan closed 1.02% lower, while Japan’s Nikkei lost 0.74%.

Yields for 10-year U.S. Treasuries rose, hitting their highest level since November in the wake of the Retail Sales report.

Benchmark 10-year notes last fell 33/32 in price to yield 4.6343%, from 4.499% late on Friday.

The 30-year bond last fell 63/32 in price to yield 4.7323%, from 4.603% late on Friday.

Iran’s strike on Israel creates military uncertainty, diplomatic opportunity

The enormous salvo of Iranian weapons fired at Israel this weekend turned the countries’ long-running shadow war into a direct confrontation, raising fears that the countries’ old paradigm of trading carefully measured blows had been replaced by something more overt, violent and risky.

But by Monday, Israel had yet to respond to the Iranian assault. Rather than preparing the public for a showdown with its archrival, the government signaled a return to relative normalcy, lifting restrictions on large gatherings and allowing schools to reopen.

Some right-wing Israeli politicians, dismayed by the lack of an immediate response, have argued that Israel needs to strike back forcefully — and soon — or risk losing its deterrence. Other more centrist officials have argued that Israel should instead bide its time before responding and capitalize on the support it has received from allies and regional actors, who are otherwise angry about Israel’s war in the Gaza Strip.

Any forceful Israeli response would risk angering President Joe Biden, who has pressed Israel to de-escalate and whose military support Israel would need in the event of a major confrontation. Israel has drawn the president’s criticism for dragging out the war in Gaza, and Prime Minister Benjamin Netanyahu of Israel must weigh the perceived benefits of retaliation against the risk of further displeasing Biden, along with the potential cost — both human and financial — of fighting two wars at the same time.

An Israeli official briefed on Cabinet discussions who requested anonymity to discuss security matters said that as of Monday several options were being considered, ranging from diplomacy to an imminent strike, but gave no further details.

In short, the next steps in the conflict remain uncertain.

The nature of Israel’s response, analysts said, could increase or decrease the possibility of a regional war. And it could improve or strain Israel’s ties with Arab nations that share an antipathy for Iran but have been critical of the war in Gaza.

It’s also possible Israel and Iran simply return to well-established norms of their shadow war — with Israel assassinating individuals, Iran’s proxies firing volleys at Israel and both sides trading cyberattacks.

“It’s too early to tell,” said Dana Stroul, who until recently was a senior Pentagon official with responsibility for the Middle East. “From an Israeli security perspective, it’s hard to see how they can let it stand,” Stroul said. “The question is: What does that look like, and how can a clear line and signal be sent to Iran while avoiding World War III in the Middle East?”

If the trajectory of the coming days remains frustratingly opaque, the events of the past 48 hours have brought some new clarity to the conflict.

Sunday’s strike, in which Iran sent hundreds of exploding drones and missiles — primarily from its own soil toward Israeli territory for the first time — were in retaliation for Israel’s killing of seven Iranian officials in Syria this month.

In military terms, the Iranian strikes signaled its willingness to confront Israel directly rather that through the use of regional proxies such as Hezbollah in Lebanon, thereby upending Israel’s assumptions about Iran’s threshold for risk.

In diplomatic terms, Iran’s strikes and Israel’s robust defense of them, in coordination with Western and Arab partners, has helped shift international attention away from Israel’s war in Gaza, where the reported death toll of more than 33,000 has prompted accusations, strongly denied by Israel, of genocide.

At a time when Israel’s closest allies had become increasingly critical of the Israeli military’s conduct in Gaza, Iran’s attacks prompted those partners to work closely with the same Israeli air force that has carried out devastating strikes in Gaza.

“You can see that not just among the Arabs but also among the western Europeans, Israel’s diplomatic standing is somewhat improved because it was a victim of Iranian aggression, not an aggressor,” said Itamar Rabinovich, a former Israeli ambassador to Washington. “By being ‘the victim,’ it improves your position.”

Analysts said that it remained unclear how Israel’s defenses would function without the several days of warnings that Iran gave before its weekend attacks, which allowed Israel and its allies crucial time to prepare. And while Iran has said that any future Israeli “mistake” would be met with a “considerably more severe” response, that threat also remains untested and was vague enough to leave room to maneuver.

Should Israel fire back at Iran in a way that would drag the region into war, the goodwill Israel has recently accrued with its allies could quickly vanish, analysts said.

For Iran’s leaders, the strikes, which caused limited damage and critically injured one child, were nevertheless a domestic and diplomatic victory because of the way they allowed Iran to present itself as standing up to Israel.

Domestically, Iran’s leaders have had to face accusations that they had been too passive after previous attacks by Israel on Iranian officials. Analysts said the salvo also reassured Iran’s allies and proxies in countries such as Lebanon and Yemen that Iran was willing to bear the risk of attacking Israel from its own territory. And, they said, it allowed Iran to show up rival Middle Eastern leaders, who have publicly criticized Israel often while working quietly with its government.

Iran wants “to take the mantle of the protector of the Muslim world,” said Narges Bajoghli, an Iran expert at the Johns Hopkins School of Advanced International Studies in Washington. “They’re basically flexing their muscles for regional audiences and simultaneously showing the weakness of

Arab leaders in the region,” she said. “Arab nations have not confronted Israel in this direct way that Iran has.”

The opposite was true: At least one Arab country, Jordan, was directly involved in repelling the Iranian strikes, and others are thought to have quietly assisted Israel either through sharing intelligence or sending data gathered from missile-detecting sensors.

Jordan, Israel’s eastern neighbor, has a large Palestinian population and has regularly criticized the war in Gaza. But it still acknowledged that Iranian targets had been “dealt with” in Jordanian airspace and that its military would repel similar attacks in the future.

The announcement was a reminder of how, before the Israel-Hamas war, shared fears of Iran had begun to smooth Israel’s diplomatic integration within the Middle East as well as allow greater military coordination between Israel and some Arab countries, including arms deals and joint training exercises.

For some Israeli analysts, this is why Iran’s attack could yet help Israel’s acceptance in the Middle East, even as its reputation plummets because of Gaza.

“The full details of how Sunni Arab regimes helped protect Israel, without doubt saving Israeli lives from Iranian missiles and drones, may not be known for a while. But this is a historic shift,” wrote Anshel Pfeffer, an Israeli commentator, in a column for Haaretz, a left-leaning newspaper. “Arab cooperation against the Iranian attack proves that the trend in the region is still toward an Arab-American-Israeli alliance against Iran and its proxies.”

In particular, some hope it may give fresh momentum to U.S.-led efforts to seal diplomatic ties for the first time between Israel and Saudi Arabia, which seemed close to success before the war in Gaza.

But the chances of such a deal remain remote while the war in Gaza endures and Israel’s right-wing government shuns any discussion about creating a Palestinian state after the fighting ends — a key Saudi demand.

With Iran’s strikes, Arab countries fear an expanding conflict

Arab countries, from the United Arab Emirates and Oman to Jordan and Egypt, have tried for months to tamp down the conflict between Israel and Hamas, especially after it widened to include armed groups backed by Iran and embedded deep within the Arab world. Some of them, like the Houthis, threaten Arab governments as well.

But the Iranian drone and missile attack on Israel over the weekend, which put the entire region on alert, made the new reality unavoidable: Unlike past Israeli-Palestinian conflicts, and even those involving Israel and Lebanon or Syria, this one keeps expanding.

“Part of why these wars were contained was that they were not a direct confrontation between Israel and Iran,” said Randa Slim, a senior fellow at the Washington-based Middle East Institute. “But now we are entering this era where a direct confrontation between Israel and Iran — that could drag the region into the conflict and that could drag the U.S. in — now that prospect of a regional war is going to be on the table all the time.”

For the moment, the only countervailing force is the desire of both the United States and its longtime foe Iran to avoid a widening of the conflict, said Joost Hiltermann, the International Crisis Group’s program director for the Middle East and North Africa.

“I am heartened by the fact that the only ones who want a war are Israel and Hamas,” he said. “The Iranians are still talking to the Americans,” he said, referring to messages sent in recent days between the two by intermediaries including Switzerland and Oman.

The Iranian message, said Hiltermann, made clear they were looking to demonstrate their power, not expand the war. “They said, ‘There is going to be an attack, but we are going to keep it limited.’”

Still, for citizens of Arab countries, many of whom watched scores of drones and missiles streaking across their skies Saturday, professions of desire to avoid a wider war are a slender thread on which to hang their future. Dismay over the attack was evident in many public comments, and in private ones, too, though others celebrated it.

Officials and analysts in the region were divided over whether Iran’s attack would spur countries with long-standing ties to the United States to push for still more engagement — and security guarantees — from Washington or to distance themselves in an effort to keep themselves safe from being attacked by Iran themselves.

Most urged de-escalation in the strongest

Iranian demonstrators show support during an anti-Israeli gathering at Palestine Square in Tehran, Sunday, April 14, 2024, after Iran retaliated directly against Israel for the killings of its senior generals in Damascus, Syria, with an onslaught of more than 300 drones and missiles. terms. The only exceptions in the Arab world were northern Yemen, whose de facto Houthi government is close to Iran, and Lebanon, home to Hezbollah, the armed group backed by the Iranians.

Oman said that it was crucial to reach an immediate cease-fire in the war between Israel and Hamas that has been raging for the past half year in the Gaza Strip. Kuwait “stressed the necessity of addressing root causes” of the region’s conflicts.

And Saudi Arabia, which has tried to cultivate relatively warm ties with Iran since the two countries reestablished diplomatic relations last year, said it was “extremely concerned” about the dangerous implications of the military escalation in the region. A statement from its Foreign Ministry asked everyone involved “to exercise maximum restraint and to protect the region and its people from the dangers of war.”

Even before the Hamas-led attack on Israel that set off the war in Gaza on Oct. 7, Arab countries had been adjusting their geopolitical relationships. Their concern was that they might no longer be able to count on a U.S. government increasingly focused on Asia as Iranian-backed armed groups became increasingly active.

Arab leaders’ discomfort only increased with the Israeli assault in Gaza, which the United States defended but their own citizens found abhorrent, said Renad Mansour, a

Hamas attack.

It is unclear whether the conflict between Israel and Iran will strain further the relatively new ties between Israel and some Arab states. Since the war in Gaza began, those relations have cooled, but it seems none of the Arab governments that recently forged ties with Israel are ready to abandon them entirely.

Two of the countries that signed the Abraham Accords normalizing relations with Israel in 2020 — the United Arab Emirates and Bahrain — have in some cases halted business deals or distanced themselves publicly from that country since the war in Gaza began. And Saudi Arabia, which had been exploring the possibility of diplomatic normalization with Israel, has insisted that any deal would require creating an “irreversible” pathway to a Palestinian state, an unlikely prospect in the current Israeli political climate.

That distancing is likely to continue, analysts say, but so far none have cut off relations with Israel or, in Saudi Arabia’s case, completely ruled them out.

senior research fellow at Chatham House’s Middle East and North Africa program.

For Saudi Arabia, this meant forging a diplomatic relationship with Iran, despite their deeply held antagonisms and attacks carried out with Iranian missiles on Saudi infrastructure as recently as 2019. Saudi Arabia’s approach to Iran was facilitated by China, which has recently worked to expand its influence in the region. Many Arab countries have turned to China in pursuit of business and diplomatic ties.

Then the war in Gaza began, dragging the Gulf states, along with Egypt and Jordan, more directly into the dynamics of a conflict they have wanted desperately to avoid.

Now, Jordan has found itself shooting down Iranian missiles — and then being accused of defending Israel. The Israeli military assault on Gaza, often accused of being indiscriminate, has killed more than 30,000 Palestinians, more than twothirds of them women and children. Some 1,200 people were killed in Israel in the

One reason Saudi Arabia has remained open to a future relationship with Israel is that now more than ever, the Saudis are hoping for a security guarantee from the United States in the event of an attack by Iran, said Yasmine Farouk, a nonresident scholar at the Carnegie Endowment for International Peace, a Washington research group.

“What the Western countries under U.S. leadership have done to protect Israel yesterday is exactly what Saudi Arabia wants for itself,” Farouk said.

parliament or a high-rise apartment house, causing massive casualties.

In other words, we are talking about an escalation without precedent in the long-running, tightly contained, shadow war between Iran and Israel that had almost exclusively been limited to targeted Israeli strikes against Iran’s Revolutionary Guard units in Lebanon and Syria — where they have no business being in the first place — and Iran retaliating by having its Lebanese proxy militia, Hezbollah, fire rockets at Israel. We’ve also seen Iran smuggling arms and explosives from Syria into Jordan, the Gaza Strip and the West Bank to be used to kill Israelis and destabilize Jordan — and the Mossad assassinating a nuclear scientist inside Iran.

of Iran” and not go on the offensive against Iran. Message to the world from Tehran: We were just sending a little warning shot; nothing to worry about here; let’s move on.

One reason Iran supports the Hamas war and prefers that Israel remain stuck in Gaza and occupying the West Bank is that it keeps the world and many Americans focused on Israeli actions — rather than on the brutal crackdown against democracy protesters in Iran and on Iran’s imperialist influence in the region, where it uses proxies to control the politics of Lebanon, Syria, Iraq and Yemen and uses those countries as military bases to attack Israel.

It would be easy to be dazzled by the way Israeli, American and other allied militaries shot down virtually every Iranian drone, cruise missile and ballistic missile launched at Israel on Saturday and conclude that Iran had made its point — retaliating for Israel allegedly killing a top Iranian commander operating against Israel from Syria — and now we can call it a day.

That would be a dangerous misreading of what just happened and a huge geopolitical mistake by the West and the world at large.

There now needs to be a massive, sustained, global initiative to isolate Iran — not only to deter it from trying such an adventure again but also to give reason to Israel not to automatically retaliate militarily. That would be a grievous error, too. Iran has a regional network, and Israel needs a regional alliance, along with the U.S., to deter it over the long run.

So there must be a major diplomatic and economic consequences for Iran, with countries like China finally stepping up: When Tehran fired all those drones and missiles, it could not know that virtually all of them would be intercepted. Some were shot down over Jerusalem. A missile could have hit Al-Aqsa Mosque, one of Islam’s holiest shrines. (You can see pictures online of Iranian rockets being intercepted in the skies right over the mosque.) Another could have hit the Israeli

Israel has never launched such a massive missile strike directly at Iran, and Iran had never done so to Israel, either, before this. Indeed, no country had attacked Israel directly since Saddam Hussein’s Iraq did with Scud missiles 33 years ago. Without a U.S.-led global initiative to impose sanctions on Iran and further isolate it on the world stage, Iran’s behavior would be tacitly normalized, in which case Israel will most likely retaliate in kind, and we’re on our way to a major Middle East war and $250-a-barrel oil.

“The alternative to a wider full-scale regional war, which we don’t want and Israel doesn’t want, cannot be a return to the status quo ante,” said Nader Mousavizadeh, founder and CEO of geopolitical consulting firm Macro Advisory Partners and a senior adviser to Kofi Annan when he was the U.N. secretary-general. A global effort to isolate Iran, Mousavizadeh added, “is the best way to separate the regime from its people, reassure Israel and Israelis of their security and remove the need for further regional military escalation, which would be a gift to Iran and its proxies.»

It is also the best way to ensure that Prime Minister Benjamin Netanyahu of Israel does not drag the United States into a regional war to shore up his own crumbling political base.

It is impossible to exaggerate the political-military implications of what just happened. Shortly after the missile strike, President Ebrahim Raisi of Iran issued a statement declaring that the Revolutionary Guard had “taught a lesson to the Zionist enemy.” It sure did, but it may not be the one Raisi thinks.

No one should think Iran is just a paper tiger. Tehran can still unleash thousands of shorter-range rockets against Israel through Hezbollah — and because some of these rockets have precision guidance, they could do significant damage to Israel’s infrastructure. Iran has bigger missiles in its arsenal, as well.

Still, what happened Saturday is ultimately a significant boost for what I call the Inclusion Network in the Middle East (more open, connected countries like Jordan, Saudi Arabia, Bahrain, the United Arab Emirates, Egypt and Israel and the NATO allies) and a real setback for the Resistance Network (the closed and autocratic systems represented by Iran, Hamas, Hezbollah, the Houthis and Iran’s Shiite militias in Iraq) and Russia. The sound within Iran and the Resistance Network on Sunday morning is that sound you hear from your car’s GPS after a wrong turn: “Recalculating, recalculating, recalculating.”

Iran just unwittingly revealed to the whole world that Iran’s government is so penetrated by Western espionage agencies (because so many Iranians hate their own government) that President Joe Biden was able to predict almost the exact hour of attack over a day in advance, and it showed the whole world that Israel and its Western allies have far superior antimissile capabilities than Iran has missile capabilities.

That may explain why Raisi, after his boast about teaching Israel a lesson, asked (pleaded?) that the U.S. and all other “supporters of the occupying regime … appreciate this responsible and proportionate action by the Islamic Republic

Indigenous artists are the heart of the Venice Biennale

Before visitors step into any gallery at the 2024 Venice Biennale, opening April 20, Indigenous artists will have made their presence known.

A collective of painters from the Brazilian Amazon, MAHKU (Movimento dos Artistas Huni Kuin), will cover the facade of

the central exhibition hall with an intricate mural. Inuuteq Storch, the first Greenlandic and Inuk artist to represent Denmark at the festival, will erect a “Kalaallit Nunaat” sign (or “Greenland”) above the pavilion’s entrance. (Greenland has been a self-governing country within the Danish Realm since 1979. )

The Brazil Pavilion nearby has been renamed the Hãhãwpuá Pavilion — one of many terms that Indigenous people use to describe the territory that, after colonization, became Brazil. “There is a very political aspect to the Indigenous presence in an artistic space like the Venice Biennale,” said Denilson Baniwa, the Hãhãwpuá Pavilion’s co-curator. “Our aim is to rewrite history and add a new chapter to art history.”

Beyond the U.S. Pavilion, featuring the art of Jeffrey Gibson, the Venice Biennale offers a taste of works by Indigenous, First Nations and Native artists around the globe. Here are some highlights.

Indigenous artists are at the heart of “Foreigners Everywhere,” the Venice Biennale’s central exhibition. As Brazilian curator Adriano Pedrosa, artistic director of this year’s Biennale, sees it, the Indigenous artist is “frequently treated as a foreigner in his or her own land.” The first gallery at the Arsenale, Venice’s former shipyard complex, will host a monumental installation by the Mataaho Collective, four Maori women known for large-scale fiber sculptures. The 331-artist lineup also includes Native American artists Kay WalkingStick and Emmi Whitehorse; Brazilian Yanomani artists Joseca Mokahesi and André Taniki; Indigenous Australian artists Marlene Gilson and Naminapu Maymuru-White; and Maori artists Sandy Adsett and Selwyn Wilson, considered a founder of Maori Modernism, who died in 2002.

Archie Moore, of Queensland, spent more than four years piecing together his family tree, which now stretches back centuries and encompasses 3,484 people. The story of his ancestors — Bigambul and Kamilaroi on his mother’s side, British and Scottish on his father’s — is the subject of his show at the Australia Pavilion, which he describes as a “holographic map of identity.” Moore, best known for re-creating his childhood home as an art installation, is the second First Nations artist to represent Australia at the Biennale (after Tracey Moffatt in 2017). With this project, he said, “I am bringing past family members into the present and the future where they can be viewed more humanely.”

Brazil/Hãhãwpuá Pavilion

The centerpiece of this exhibition is a mantle, or feathered cape, created by artist and activist Glicéria Tupinambá with the help of her community in southern Bahia. Only a dozen mantles survive from the colonial period — and, until recently, all were in European museums. (Denmark’s National Museum announced plans to return one to Brazil last year.) Glicéria hadn’t seen a mantle in person until a Paris visit in 2018. She realized her ancestors employed the same stitching technique to create the cape that the Tupinambá now use to create fishing nets. Glicéria’s contemporary mantle will be paired with a video installation by Olinda Tupinambá and a work by Ziel Karapotó made from fishing nets and replicas of ballistic projectiles. The project by Glicéria, who was jailed in Brazil in 2010 for several months with her 2-month-old baby after speaking out about police brutality,

has an explicitly political bent: It includes letters Glicéria wrote to six European museums requesting the return of mantles in their collections.

Danish Pavilion

This year’s Danish Pavilion represents many firsts. It is the first time a Greenlandic artist has represented Denmark and the first time the country’s presentation has been dedicated entirely to photography. At 35, Inuk artist Inuuteq Storch is the youngest ever to take over the hallowed space. Visitors will encounter a kaleidoscope of images, including snapshots of Storch’s friends smoking and driving around his hometown, Sisimiut; a slideshow of his vast family photo archive; and formal portraits taken by John Moller, a Greenlandic photographer who died in 1935. Although Greenland has been photographed extensively since the mid-1800s, Storch noted that it has rarely been captured by its own people. “My works serve as my artistic means to subtly and intricately modify the prevailing perception of my country,” he said in a statement.

Timor-Leste Pavilion

Asia’s youngest nation, Timor-Leste, will make its Venice Biennale debut with an installation by Maria Madeira. Born in the village of Gleno, Madeira was airlifted to Portugal after Indonesia invaded Timor-Leste in 1975. She spent seven years in a refugee camp outside Lisbon before her family resettled in Perth, Australia. (Timor-Leste celebrates the 25th anniversary of its independence from Indonesia this year.) Madeira’s installation — made from materials including the textile tais and betel nut, an ancient stimulant that grows on native palm trees — is conceived as a tribute to the resilience of Timorese women. During the Biennale’s opening week, Madeira will perform live, kissing the exhibition’s walls to leave lipstick marks behind and singing a traditional mourning song in the Indigenous language Tetun.

A swimming dinosaur? Maybe not, study says

Spinosaurus was one of the largest carnivorous dinosaurs, and it ate fish. That much paleontologists agree on.

But did it just wade into rivers and snatch them out of the water like a grizzly bear? Or did it dive after its prey like a penguin or a sea lion?

This has become a question of prickly contention among dinosaur experts.

One group is convinced that Spinosaurus was a rarity among dinosaurs: one that stuck its head underwater and swam beneath the surface. Others say no way.

In an undated image provided by Daniel Navarro, an artist’s rendering of spinosaurus standing in water and eating fish. A new paper challenges the idea that the large, carnivorous dinosaur dived after prey rather than wading and plucking it out of the water.

The latest salvo, published last month in the journal PLOS One, comes from the Spinosauruscouldn’t-swim contingent to counter a pro-swimming paper published a couple of years ago. The earlier work, published in the journal Nature, claimed that in general, animals that spend much of their time in the water, like penguins, have denser bones that provide ballast and make it easier to dive. Spinosaurus also had dense bones, and therefore was most likely a swimmer, the Nature paper concluded.

“It’s totally misapplied here,” Myhrvold said. “Unfortunately, when you have something that involves lots of dense statistics, most paleontologists’ eyes glaze over.”

many aquatic animals with bones less dense than many land animals and vice versa. “If the two distributions are close together, you can’t get a valid conclusion or at least one that has any statistical strength,” he said.

He gives an example: In humans, men are generally heavier than women, but not every man is heavier than every woman. Thus, if someone told you that a person weighs 135 pounds, you could not reliably deduce whether that person is male or female.

Ibrahim, who is in Morocco conducting additional studies, said further findings would make an even more convincing case that Spinosaurus was aquatic.

He also dismissed Myhrvold’s biomechanical arguments for why Spinosaurus could not swim, saying much is still unknown. He compared Myhrvold’s findings to paleontologists who argued that Tyrannosaurs must have been scavengers because they could not run fast enough to catch small, quick prey. But Tyrannosaurs did not have to be fast to pull down a big, slowmoving Triceratops.

But that bone density analysis was “statistically absurd,” said Nathan Myhrvold, a former chief technology officer at Microsoft and an amateur paleontologist who led the new research with Paul Sereno, a paleontologist at the University of Chicago.

Myhrvold and Sereno have also argued that the ungainly body shape of Spinosaurus would have made it a poor swimmer, if it could swim at all. The weight distribution of the dinosaur would have made it top-heavy and unstable, Myhrvold said.

“It’s obvious as to why it can’t swim,” he said.

The giant sail on its back would make it difficult for a swimming Spinosaurus to stay upright, Myhrvold said. “If it tips even the slightest amount, it’ll keep tipping.”

In other words, Spinosaurus would capsize and struggle to pull its sail out of the water.

In this dispute, there are points of agreement. Spinosaurus was perhaps longer and heavier than Tyrannosaurus rex. It lived about 95 million years ago in what is now the Western Sahara but was then a lush environment with deep rivers. It was also an odd-looking dinosaur, with elongated vertebrae forming a huge sail on its back.

There has been a burst of interest in Spinosaurus in the past decade after a new fossil was uncovered in Morocco by Nizar Ibrahim, who was also an author of the earlier bone density study and is now a senior lecturer at the University of Portsmouth in England. The only other fossil was found by Ernst Stromer, a German paleontologist, in 1915, and destroyed in an aerial bombing of Munich in 1944.

In the latest study, Myhrvold and colleagues argue that the paleontologists who made the bone density claims employed a sophisticated statistical technique without understanding its limitations.

Myhrvold is not a traditional academic. Since departing Microsoft in 1999, he is perhaps best known for leading the development of the encyclopedic Modernist Cuisine cookbooks. But he has stirred up esoteric statistical scuffles before, criticizing findings about the growth rate of dinosaurs and claiming that a NASA trove of asteroid data is flawed and unreliable.

Earlier work by other researchers had found that diving mammals tended to possess denser bones than mammals that stayed on land. But other mammals also have dense bones for other reasons. Elephants, for one, need stronger bones to support their weight.

In 2022, researchers led by Matteo Fabbri, now a postdoctoral researcher at the University of Chicago, argued in their paper that bone density was a reliable predictor of whether an animal lived in the water or on land for a much broader swath of creatures, including extinct species.

“We thought, Oh, is this just mammals, and or is this also reptiles?” Fabbri said in an interview. “And if this is true, can we infer ecology in extinct animals, including weird-looking dinosaurs like Spinosaurus?”

Fabbri said the analysis showed that “very high bone density is correlated with the probability of going underwater.”

Spinosaurus and a Baryonyx, a relative of Spinosaurus, did dive, while another related dinosaur, Suchomimus, did not go underwater, the team of scientists concluded.

However, Myhrvold argues that bone density does not neatly divide into two groups. There are

Similarly, the prehistoric African rivers were filled with giant, slow-moving fish, Ibrahim said. Spinosaurus would not have had to be a proficient swimmer to catch them.

“I can’t reveal too much,” he said. “But we have new material. We have several very exciting ongoing projects.”

Butler Blue IV, the official mascot of Butler University, is cuddled by his handler, Evan Krauss, in Greenwood, Ind., on Jan. 22, 2020. Physical touch can buoy well-being and lessen pain, depression and anxiety, according to a large new analysis of published research released on Monday, April 8, 2024, in the journal Nature Human Behaviour. (Luke Sharrett/The New York Times)

in the journal Nature Human Behaviour.

Researchers from Germany and the Netherlands systematically reviewed years of research on touch, strokes, hugs and rubs. They also combined data from 137 studies, which included nearly 13,000 adults, children and infants. Each study compared individuals who had been physically touched in some way over the course of an experiment — or had touched an object like a fuzzy stuffed toy — to similar individuals who had not.

For example, one study showed that daily 20-minute gentle massages for six weeks in older people with dementia decreased aggressiveness and reduced the levels of a stress marker in the blood. Another found that massages boosted the mood of breast cancer patients. One study even showed that healthy young adults who caressed a robotic baby seal were happier, and felt less pain from a mild heat stimulus, than those who read an article about an astronomer.

Positive effects were particularly noticeable in premature babies, who “massively improve” with skin-to-skin contact, said Frédéric Michon, a researcher at the Netherlands Institute for Neuroscience and one of the study’s authors.

“There have been a lot of claims that touch is good, touch is healthy, touch is something that we all need,” said Rebecca Boehme, a neuroscientist at Linkoping University in Sweden, who reviewed the study for the journal. “But actually, nobody had looked at it from this broad, bird’s eye perspective.”

The analysis revealed some interesting and sometimes mysterious patterns. Among adults, sick

people showed greater mental health benefits from touch than healthy people did. Who was doing the touching — a familiar person or a health care worker — didn’t matter. But the source of the touch did matter to newborns.

“One very intriguing finding that needs further support is that newborn babies benefit more from their parents’ touch than from a stranger’s touch,” said Ville Harjunen, a researcher at the University of Helsinki in Finland, who also reviewed the study for the journal. Babies’ preference for their parents could be related to smell, he speculated, or to the differences in the way parents hold them.

Women seem to benefit more from touch than men, which may be a cultural effect, Michon said. The frequency of the touch also mattered: A massage once every two years isn’t going to do much.

Several studies included in the review looked at what happened during the height of the COVID pandemic, when people were isolated and had less physical contact with others. “They found correlations during COVID times between touch deprivation and health aspects like depression and anxiety,” Michon said.

Touching the head appears to have more of a beneficial effect than touching the torso, some studies found. Michon couldn’t explain that finding, but thought it could have to do with the greater number of nerve endings on the face and scalp.

Another mystery: Studies of people in South America tended to show stronger health benefits of touch than did those studies that looked at people in North America or Europe. Michon said that culture may somehow play a role. But Boehme said the studies showing the differences between countries were too small to be definitive. “I think the mechanism behind this is biological,” she said. “I think that’s hardwired and will be the same for all of us.”

In 2023, Jeeva Sankar, a pediatrics researcher at All India Institute of Medical Sciences, and a colleague published a rigorous review of skin-to-skin care for newborns. The analysis concluded that touch therapy for preterm or low-birth-weight infants should start as soon as possible and last eight hours or more, a recommendation that the World Health Organization adopted. Sankar said the new review was important because touch is often neglected in modern medical care, but it was too broad. He would have liked it to focus more on how various forms of touch could be integrated in medical care.

Michon stressed that the types of touch considered in these studies were positive experiences to which the volunteers agreed. “If someone doesn’t feel a touch as being pleasant, it’s likely going to stress them out,” he said.

Tommy John surgery at 50: More ubiquitous than ever but continuing to evolve

In baseball, the words “Tommy John surgery” are uttered every day. And with a rash of injuries sidelining stars in the MLB, we are hearing the phrase more than ever.

The number of injuries to pitchers’ ulnar collateral ligaments keeps rising, an epidemic swallowing the sport and leading to changes in the surgical landscape. But it is no longer as simple as a pitcher tearing his ligament, going under the knife and returning a little more than a year later.

Now, there are pitchers undergoing second, or even third, operations, known as revisions, with slightly different techniques and recovery times at play. And many players are gravitating toward a newer option: the internal brace procedure.

One thing is clear: Tommy John surgery is going to continue to be an important part of baseball.

What is Tommy John surgery?

The ulnar collateral ligament is on the inside of the elbow, attaching the upper bone of the arm, the humerus, to a forearm bone, the ulna. When pitchers injure the UCL, they may sometimes choose a conservative treatment plan, often consisting of rest and plasma-rich platelet injections. In many cases, this is simply delaying the inevitable.

“We often try it because there’s really nothing to lose with it,” said Eric Bowman, an orthopedic surgeon and the head team physician for Vanderbilt University and the Class AAA Nashville Sounds. “There’s very little downside to it. It has growth factors, and we hope that it provides a healing stimulus. But at least the data we currently have doesn’t really point to it being a huge boost for conservative treatment.”

Especially in the cases of substantive tears to the ligament, a full reconstruction is often required. The procedure we now know as Tommy John surgery originated in 1974, when Frank Jobe, an orthopedic surgeon, performed the procedure on pitcher Tommy John. The surgery involves replacing the existing UCL with a graft usually harvested from a hamstring tendon, the Palmaris tendon in the forearm or a tendon from a cadaver. Surgeons attach the new tendon by drilling holes in the humerus and the ulna. The graft is then threaded through the two holes and secured by sutures, buttons or screws.

Why has ‘T.J.’ become so common?

At the major league level, there were 275 pitchers who had Tommy John surgery last season, up from 190 in 2016.

But surgeons in the industry indicate that the largest increases in UCL injuries are at the youth level. Tommy John surgery was once nearly unheard of for high school players. Now, it is becoming common. As far back as 2015, one study indicated that 56.8% of the procedures were performed on the 15-19 age group.

“I think it’s playing year-round,” said Brian Schulz, team physician for the Los Angeles Angels. “I think it’s early sport specialization, not taking time off and playing other sports. I think there’s a lot of kids that understand that velocity is a very important factor if they want to be a pitcher, and they’re doing weightedball programs and velocity-enhancement programs at a young age. You’re putting a lot of stress on the inner elbow doing that.”

How does Tommy John surgery affect performance?

Previously viewed as a last-chance operation, Tommy John in the 21st century no longer has such a negative stigma. But the idea

that all pitchers return as harder-throwing superhumans comes with misconceptions.

“Probably 10 years ago, people were coming in and almost wanting it electively for their kids because they thought it would make them throw harder, which is crazy,” said Josh Dines, an orthopedic surgeon at the Hospital for Special Surgery who has worked with the New York Mets and the Los Angeles Dodgers. “It’s like assault and battery on your kid.”

Although the rate of athletes returning to play is high, the rate of players returning to the same level of play was “less frequent and took longer, with 67% to 87% of MLB pitchers returning in about 15 months,” according to a 2020 study. Plenty of pitchers have returned from Tommy John to have successful careers, but the road back can come with bumps. In 2022, Justin Verlander became the first pitcher to win the Cy Young Award in his first season back from a UCL reconstruction. John Smoltz is the only pitcher to have had Tommy John surgery and be elected to the Hall of Fame.

Conversely, the 2020 study showed pitchers who had UCL reconstructions had ERAs and WHIPs “equal or better” than controls, but it also found that fastball use and velocity tended to decrease slightly after surgery. Overall, there is little clinical data to suggest Tommy John directly correlates with enhanced long-term performance.

How does a UCL revision differ from a reconstruction?

Not long ago, there was a common belief that a Tommy John procedure would all but guarantee a healthy UCL for at least 10 years. That belief, Schulz said, was never based on clinical data.

If a pitcher has Tommy John surgery at 17 and continues pitching at a high level, it could be natural for a pitcher to need another procedure by 27. There is also anecdotal concern that increases in velocity and force applied to the UCL could be shortening the life span of the Tommy John procedure.

If a player requires a revision, the clinical term for a second (or third) Tommy John surgery, the procedure often differs from the first.

“The procedure itself is a little bit more complex,” Bowman said, “because you’re having to work around scar tissue. When you’re going in and it’s sort of a pristine environment, you can put things exactly where you want it, and the tissue overall might look fairly normal. When you go in on a revision situation, there’s scar tissue, there is already tunnels and hardware in place. Sometimes, you have to navigate that.”

While initial Tommy John procedures across all levels come with a return-to-sport rate of close to 90%, the data is murkier when it comes to UCL revisions. Return-to-play rates hover at about 75%, Bowman said, but return to previous performance level is closer to 55%.

Is the internal brace a revolution?

In recent years, a new surgical technique has become increasingly popular. It’s called the internal brace, where an athlete’s existing UCL is reinforced with a tapelike suture that is anchored into the humerus and ulna. The internal brace can serve as a Tommy John alternative for athletes who have not completely torn their UCL. MLB players such as Lucas Giolito and infielder Trevor Story are among those who have recently had the internal brace procedure, but it is more common for amateur players, Bowman said.

Athletes can typically return to throwing in about six months after an internal brace procedure. Many major league pitchers, however, may not be good candidates for the surgery.

“The problem when you get toward the majors level is the tissue isn’t as good, so you have to replace the tissue,” Bowman said. “Just putting the internal brace in there or the suture, it can help relieve some of the stress, but the bad tissue just isn’t going to heal very reliably, so that’s when you have to put the graft in.”
