ocal boat users can look forward to launching their vessels on their doorstep in the near future.

An application for a beach launch site is in the process of being submitted to national government for approval.

The City of Cape Town is compiling the application for a marine access point at Sonwabi Beach on Baden Powell Drive near Muizenberg.

This follows a broad consensus given by fishermen and boat users at a recent public meeting in Mitchell’s Plain.

The meeting was held to decide on a viable

and preferred location for a slipway between Mnandi and Muizenberg beaches.

Gregg Oelofse, head of environmental policy and strategy for the City of Cape Town, said a beach launch site at Sonwabi is currently the only viable solution.

Strong wave action, large swells and strong winds along the False Bay coast prevent development along this shoreline, he insisted.

“It is virtually impossible for us to maintain any slipway along this coast due to these factors,” Oelofse said.

“The wave action, swell and wind strength make it impossible to launch and land a boat here unless there is a groyne which is too costly to implement in the next 10 years.”

A groyne is a low wall built out from the coast into the sea, to prevent the repeated movement of the waves from removing parts of the land and to control erosion.

Permission to build this infrastructure can take at least two to three years, he said.

Sonwabi was chosen as a suitable site for an access point due to it being “slightly calmer and having less wave action, which also makes it safer”.

“There is also better vehicle access at this site and a launch site at this beach would be safer for all beach users,” Oelofse said.

With beaches stretching across 300km, Cape Town has the most substantial stretch of coastline in the country. However, there is limited space for harbours and slipways

due to rough seas and strong winds, he explained.

“There is a shortage of marine access points and the ones we do have are not in a great condition,” Oelofse admitted.

“We need better investments and resources to maintain what we have and we definitely need more access points because people’s livelihood depend on it.”

Miller’s Point slipway is the most popular launch site and is extensively used by commercial and recreational small boat fishermen.

“When the fish is plenty there is chaos at this site due to congestion, as it is one of the few accessible launch sites,” Oelofse added.

While commercial fishermen could use the proposed launch site at Sonwabi, the marine access point is intended for recreational usage.

A study was conducted to investigate the possibility of a launch site at Monwabisi Beach, but due to it being a small recreational facility this option was ruled out, says Howard Gold of council’s Coastal Management Unit.

beach to launch a boat at this site which causes potential conflict with swimmers,” he said.

“While this could be solved with buoys, there is likely to be a big nod of disapproval from beach users should this option be implemented.”

Oelofse said Monwabisi is a “sand and salt blasting area”.

“It is not that we do not want to invest in infrastructure at this beach, but the challenges we face there prevent us from doing so,” he explained.

Boat users who wish to use the proposed launch site at Sonwabi will be required to undergo training.

“We will facilitate this training with the NSRI. Council could also look at providing a tractor and trailer required to launch at this site,” Oelofse added.

Igshaan Carstens of the Strandfontein Boating Association requests a database be established of all boat users who will use the proposed launch site.

“This will be used to coordinate the required training,” he says.

Driver for coast development and ward councillor Danny Christians says the application is a step in the right direction.

“I will keep council accountable and ensure that in six months the application has been submitted and approved.”

City officials committed to in six months obtain permission from national government to launch at Sonwabi.

It is at this stage unclear how long thereafter construction of a slipway would commence. The parking area at Sonwabi will also have to be upgraded, adds Christians.

Duncan Gouvias (20) grew up learning about commercial and recreational fishing. Speaking at the meeting, he said people needed to consider safety first.

Ignoring the safety risks of building a slipway along the rough False Bay coast is not advised, he insisted. “No matter how much money is spent, you have to ask yourself whether your life or your catch is more important. Commercial fishing will not always be possible at the beach launch site.”

Christians says the beach launch site could only be used in favourable weather conditions.

Athol Groenewald of Rocklands questioned the possibility of a launch site at Strandfontein Beach near Broken Road.

“Why don’t you take the road away and build a launch site there?” he asked.

But this idea was shot down.

Oelofse said: “That is not a good idea due to there being a lot of wave action. The road has already collapsed because of this so building there again would be a huge mistake.”

T

he high-flyers of the criminal underworld have their days numbered, the authorities warn.

Lentegeur police management are cracking down on gang and drug kingpins in their precinct, saying enough is enough.

Officers now have their eyes on Herba Road in Woodlands.

This road has been identified by police as one of the most problematic streets in this neighbourhood, as the drug trade thrives and gangsterism flourishes.

Station commander Colonel Elizabeth Hermanus says these scourges continue as the criminals are able to pay their way out of jail.

“This makes things very difficult for us. Members of the specialised gang unit, Operation Combat, are now moving into the area to assist us in arresting these criminal kingpins. We want to go for the big guys and not the users who are caught with small amounts of drugs,” Hermanus says.

There are three known criminal high-flyers plying their illicit trade in Woodlands, she confirms. “There may be more, but these are the ones we know of.”

The notorious “rooi klippe flats” are on the police’s radar.

The flats are believed to be a hive for gang activity and is linked to drug smuggling.

It is also used to hide weapons and stolen goods, residents say.

However, the men in blue are urging the community to come forward with information to help secure arrests.

“Information is treated as highly confidential. The public can give their tip-offs anonymously and we will do the rest,” Hermanus encourages.

Woodlands Community Policing Subforum chairperson Kaamillah Ismail also urges residents to join street committees, the neighbourhood watch or the local subforum.

“Stand up and say ‘Enough is enough!’ It is time for everyone to give their input and help make a difference in this community,” she says.

Hermanus encourages residents to come forward with information.

“We understand people are afraid to speak out as they fear for their lives. If you do not feel comfortable reporting crime to the police, speak to the leaders of your community safety structures who can report it to us,” she urges.

“While there is community involvement, most of the tip-offs are reported by the neighbourhood watch.”

Meanwhile, there has been a lull in house break-ins in this precinct.

However, early morning robberies are a concern to police.

Crime intelligence officer Warrant Officer Yusuf Lakay says: “Robberies happen in the morning when people are on their way to work.

The bus stops on Eisleben Road and at Clock Tower are robbery hotspots as well as at Morgenster Road, close to Eisleben.”

Commuters are to be extra vigilant ahead of making their morning commute.

ILLEGAL DUMPING: FREE WASTE SITES UNUSED

ead pets, rubble and organic waste piled up high. This is the norm in pockets of Mitchell’s Plain where illegal dumping continues to cause a stink.

Attracting rodents like rats and mice, some residents are only adding to the problem as they dump their dirt on open spaces.

Tafelsig, Beacon Valley and Eastridge have been identified as the areas with the most illegal dumping sites.

Officials are now calling on residents to report illegal dumping, as well as use the drop-off facility in Rocklands.

A new solid waste drop-off facility was opened in Spine Road, Rocklands, in 2012.

The site was intended to reduce illegal dumping in the surrounding areas, but has since its opening had little impact on the problem in and around Mitchell’s Plain, authorities say. The R6m facility accepts garden and garage waste, builders’ rubble and recyclables such as plastic, steel and glass.

The free drop-off facility is, however, underutilised, City officials say.

“The Rocklands facility is there for residents’ convenience, but people do not use it,” says ward councillor Solomon Philander.

A total of 985 illegal dumping sites were identified in Cape Town last year.

Tafelsig ward councillor Sheval Arendse says his ward is littered with dozens of illegal dumping sites. Transgressors are not being reported to the authorities, exacerbating the problem.

Arendse says: “Residents use people to clean their garden and they in turn dump.

Residents also forget to put out their wheelie bins for collection and are then forced to dump their refuse wherever they find an open space.”

‘No dumping’ signs are clearly visible at dumping hotspots, but “these are taken down and sold to scrap yards”.

Councillor Goawa Timm says illegal dumping in ward 76 is being curbed.

“Since I have volunteer community workers employed in my parks, dumping has de-

creased. However, there are still those who build or do minor alterations to their homes and dump their rubble on open spaces or in public parks,” she says.

Residents are now being encouraged to take ownership of their community.

“People need to take pride of their surroundings and report illegal dumping. Residents should also make use of the free dropoff facilities and not use residential areas to dump their rubble,” Timm urges.

Ernest Sonnenberg, Mayoral Committee member for Utility Services, says despite the strategic location of 25 drop-off facilities across the city, local government has had to set aside R274m this financial year to foot the bill for the removal of waste that is being illegally dumped.

Should the public continue to dump illegally, the City will spend more than R250m of ratepayer’s money on cleaning up. “A service provider has since been appointed to inform communities of their nearest drop-off facility and landfill sites as well as the services that these sites offer,” he says.

These facilities accept recyclables in a convenient, mixed format with the only request being that residents and businesses separate glass from the other recyclables to avoid contamination, Sonnenberg explains.

“This promotes waste separation at the source and ultimately diverts it from the City’s landfill sites. However, despite the location of drop-offs within a 7km radius of all the city’s residents, many communities remain unaware of these sites and the services they render,” he says.

There is no excuse for dumping waste illegally, Sonnenberg adds. “We have 25 dropoff facilities where residents and businesses can dispose of materials ranging from electronic waste to recyclables to builders’ rubble – on any day of the week. This service is free for vehicles with a carrying capacity of 1.5 tons and three loads a day is allowed.”

S

anitation is so bad a pupil likely caught Hepatitis A from the school toilets.

Jason Singh (6), who attends Harvester Primary School in Westridge, was hospitalised after contracting the viral liver disease.

The little boy spent four days at Red Cross Hospital where he was treated for Hepatitis A. While he has recovered, he is still unable to go to school.

“If he contracts the disease again, the symptoms could be more severe and he may end up suffering from renal failure,” says his father Michael Singh.

Clean toilets and good hygiene is essential at schools, he stresses.

“Health inspectors visited my home to check whether he could have picked up the virus there, but there were no signs or evidence to suggest that is the case. The only other place he could have picked up the virus is at school.”

The Grade 1 pupil has already lost out on nearly a month of class time.

“I am very unhappy as this could have easily been avoided had the school maintained a good level of hygiene and sanitation in the toilets,” the parent fumes.

Jason suffered in pain with an enlarged and infected liver.

“He then developed jaundice and couldn’t eat. The virus is highly contagious and he had to be isolated.”

Provincial education officials confirm that new toilets are now being installed at the school.

A delighted Singh hopes poor sanitation will now be a thing of the past.

“I am very happy about this, but believe the problem should never have escalated to this level. The toilets were disgustingly dirty. The stench was so bad you could smell it from outside the toilets,” he says.

According to the World Health Organisation, Hepatitis A is a viral liver disease that can cause mild to severe illness.

The Hepatitis A virus is transmitted through ingestion of contaminated food and water, or through direct contact with an infected person.

The disease is associated with a lack of safe water and poor sanitation.

Improved sanitation and the Hepatitis A vaccine are the most effective ways to combat the disease.

Provincial education department spokesperson Paddy Attwell says new toilets are being installed at the school.

The expected date of completion is yet to

be confirmed.

A health inspection was conducted at the primary school, Attwell says.

“The health inspector gave the school a clean bill of health, except for the flushing mechanisms on two toilets that were faulty, and a storeroom that was being used as a smoking room.”

When asked what the department’s plan of action is to deal with poor sanitation at schools, Attwell replied that the department allocates funding to schools for day-to-day maintenance, including cleaning, in terms of national norms and standards.

“Schools may also submit requests for emergency repairs. In the longer term, the department plans for routine maintenance, according to a priority list.

“Circuit teams check the cleanliness of toilets as a matter of routine,” he adds.

The principal of Harvester Primary School declined to comment.

tand-up comedy production Proudly Afrisnaaks showcasing four top local funny men will take to the stage at the Baxter Theatre.

For one week only, those in search of a good laugh can enjoy comedy at its finest.

Produced by Mitchell’s Plain resident Moeniel Jacobs, the show will be staged in the Golden Arrow Studio from Monday 2 June until Saturday 7 June at 20:15. A matinee show will run the Saturday at 14:30.

Following the show’s success at the Suidooosterfees earlier this year and the 2013 Klein Karoo National Arts Festival, the group of four comedians are set to take to

the stage with their special brand of South African humour. The proudly local stand-up comedy show will feature Piet Potgieter, Francois van As and Dugald Pieterse.

SECOND-HAND GOODS APPLICATIONS: RESIDENTS URGED TO SUBMIT OBJECTIONS OR WAIT ANOTHER FIVE YEARS

A

police clampdown on illegal secondhand traders is gaining momentum.

Residents have until 16:00 tomorrow (Friday 30 May) to submit an objection against second-hand dealers plying their trade in Mitchell’s Plain.

The police’s Second-Hand Goods Control Unit and station commander Brigadier Johan Brand is responsible for the issuing of the licences for trading in previouslyowned goods.

Police will only issue a trading licence if they are satisfied the applicant is a person of good character and that his or her premises are suitable for trading.

However, should any reasonable objections be submitted against the business owner, police will think twice before issuing a licence. With 38 known second-hand traders in Mitchell’s Plain, police are yet to receive any objections.

Licences are expected to be issued in July, Brand confirms.

“There are 38 second-hand traders who are waiting for their licensing application to be approved. Many of them are not happy that this process has been delayed several times as we have allowed neighbours extra time to submit their objections,” he says.

“The issuing of the licence must be done in consultation with the community.”

Should you wish to submit an objection, you will be required to collect the relevant forms from the police station.

“People must object now as the licences are valid for five years. If they do not object, the awaiting applications will be approved.

The objections must be valid and detailed,” Brand adds.

Second-hand traders include tyre shops, scrap yards and other small businesses specialising in buying and or selling previously-owned goods. The Second-Hand Goods Act regulates the business of dealers in second-hand goods and pawn brokers in order to combat trade in stolen goods, to promote ethical standards in the second-hand goods trade and to provide for matters connected therewith, explains Brand.

The act allows traders to operate between 08:00 and 17:00.

A second-hand tyre dealer says the few bad apples are making it difficult for them to earn a living. “There are many tyre dealers who are given a bad name by those who do not stick to the law. Because of this we, the good ones, suffer,” he insists.

Gaironesa Freeman lives behind a tyre shop in Westridge. She has for years been trying to have the second-hand business closed down (“Get in on the Act, People’s Post, 17 September). However, much to her dismay, the owner of the shop on Eisleben Road is now trading with a licence.

“We objected, yet nothing came of it. I hope the new process will help and make it easier to have licences denied due to residents’ objections. The tyre shop behind us, while operating with a licence, does not adhere to the stipulated operating hours and work well into the night,” she seethes.

The tyre shop owner was previously operating without a licence. He was previously arrested and has had his machinery and tyres confiscated. “Police are not acting in our best interest as nothing gets done when we report illegal businesses,” says Freeman’s husband, Riedwaan Carstens.

ith fresh ideas, a group of UWC students are helping to combat bullying as well as promote healthy eating and good personal hygiene.

The fourth-year Occupational Therapy students have been at Parkhurst Primary School for the last seven weeks as part of their vocational training.

Staff at the Westridge school have welcomed the young adults into their corridors as they partner to address some of the biggest challenges facing the school.

Bullying Bullying, a global challenge that schools have to deal with, is being tackled at this Westridge school. Armed with knowledge, kindness and understanding the young Parkhurst Primary pupils are being taught how to effectively deal with those relentless playground bullies.

UWC student Nicolle Petersen says in talking to the principal, it was established bullying was a challenge for this school.

“On agreeing that bullying is a universal problem, we set out to establish an anti-bullying campaign. Called the Ark (Act of Random Kindness) campaign, it teaches children how to better engage with each other,” Petersen explains.

Student Maliekah Jonkers says from this a “Perfect Prefect System” was born. “We equip prefects with the necessary skills to address bullying. By getting them involved we ensure the programme is sustainable after we leave.”

Healthy eating As a health promoting school, Parkhurst Primary pupils are not allowed any refined sugars during school hours.

Lynita Koen, also a fourth-year Occupa-

tional Therapy student at UWC, says teachers noticed a considerable drop in pupils’ attention span after intervals.

Deputy principal Daphne Capitou says: “After first interval it would always be a struggle to get the children to focus. So we got rid of the tuck shop and no longer allow people to sell luxuries at the school gates,” she says. “Not only are the children able to concentrate for longer, but we also do not have a litter problem as a result of promoting healthy eating.”

Children are required to bring a sandwich, yoghurt and a fruit for lunch.

Feeding scheme The school’s feeding scheme is available to children who do not bring packed lunches.

A name change is now on the cards for this facility to destigmatise the children who make use of the feeding scheme.

A notice by the school principal is made over the intercom for those who get a hearty meal from the feeding scheme.

Capitou says action is being taken to ensure all children are seen as equal.

“We want to do away with the notice for this reason. There is the perception that on-

ly poor children who do not have [lunches] use the feeding scheme, but this is not the case,” she says.

“Instead we want it to be a place where everyone can go to enjoy a meal.”

Petersen says “Ma’s Kitchen” may be a more appropriate name.

“Your ma’s kitchen is usually a place all children love to be in as that is where they are served delicious treats and food,” she says.

Hygiene With a lack of liquid soap at the school, UWC student Sibulele Yantolo is teaching pupils to make their own.

The toilet hygiene project, which she is spearheading, teaches children to get creative.

“A health-promoting school focuses on not only healthy eating, but personal hygiene,” she says. “We encouraged the children to bring leftover bars of soap which we will use to make the liquid soap. This is something new and sustainable as many people throw out the last little bits of soap.”

Grade 6 pupils will be facilitating this so the project can continue even after the students have left.

Motorist hijacked by hitchhiker Motorists are cautioned against giving lifts to strangers.

The warning comes after a Mitchell’s Plain man was allegedly robbed by a hitchhiker on Sunday evening.

Police spokesperson Constable Zandile Marashula says the incident occurred at 20:40 in Charlie Street, Beacon Valley.

etal theft in Tafelsig is raising the ire of residents and council officials.

Drain cover theft is on the rise in this neighbourhood, as thieves are said to be selling the metal goods at local scrap yards.

Authorities are now calling on the public to report metal thieves and scrap dealers suspected of buying stolen items.

Tafelsig ward councillor Sheval Arendse confiscated five stolen drain covers from pedestrians while driving along Paulsberg and Cascade streets.

The drain covers were stolen last Wednesday night, he says.

“As soon as people report stolen drain covers, they are replaced within a reasonable time to avoid people falling into the uncovered drains,” Arendse adds.

In a bid to curb drain cover theft, residents are patrolling at night.

“The community is advised to report all addresses of scrap yards in their street.

Most of the stolen scrap metal is taken to new and hidden scrap yards,” he says.

The City of Cape Town’s Metal Theft Unit visits scrap yards regularly to ensure stolen goods are not exchanging hands.

Ernest Sonnenberg, Mayoral Committee member for Utility Services, says the City works in conjunction with police to monitor scrap yards. These businesses are required to comply with the regulations of the

Second-Hand Goods Act, he says.

But residents believe this is not happening often enough. Community worker Sulyman Stellenboom says Mitchell’s Plain bucket shops (a small-scale scrap yard) are being overlooked by the authorities.

“Many of the local scrap dealers would be out of business if council and the police clamped down on the illicit trade of buying and selling stolen goods,” he says.

Drain cover theft is experienced across the city. The problem is, however, more prevalent in Mitchell’s Plain and Elsies River, Sonnenberg says.

Arendse says thieves are getting smart.

“They will steal the drain covers tonight.

Dig a hole on an open field and hide the stolen goods there. They will return the next day to dig it up and then sell it to the scrap yard,” he says.

Stellenboom, a Tafelsig resident, says improved law enforcement is needed to address the problem. “All scrap yards in residential areas need to be closed. They are open around the clock and accept stolen goods,” he says.

“My bicycle was stolen out of my yard.

The next morning I visited the local scrap yard and found my bicycle there.”

Drug users know going to the local scrap dealer means instant cash. “These bucket shops knowingly accept marked council goods. They are a part of the problem,” Stellenboom stresses.

Fuss over the Foreshore

T

he Foreshore is earmarked for revamp costing over R1.6bn. This is to be completed by 2016. By 2020, another revamp worth billions will again take place.

Among the biggest changes will be the expansion of the Cape Town International Convention Centre – to the tune of R832m.

A R500m renewal of the Standard Bank building is also underway.

ZUKISWA NQOLOBE thinks the Foreshore is beautiful enough. “They need to get more staff for the public clinics and they need to build hospitals in the townships instead of wasting the money.”

MICHELLE PARENT believes the resources should be used on people who need it. “We have a beautiful Foreshore already and it should stay that way, They should donate it to the Aids research.”

NEEL CHADEE thinks there are plenty of other projects which need money. “The Foreshore is modern enough. The City needs to focus on poverty and stop using taxes to please the tourists.”

CAN-do offer to recycle trash Creativity could turn unsightly and unhealthy litter into an opportunity for schools to win.

The annual Collect-a-Can CAN Craze Competition gives schools the opportunity to win their share of R60 000, while also encouraging pupils to be more eco-conscious.

Pupils are challenged to build the most creative structures from 300 or more used cans in the Collect-a-Can CAN Craze Competition which kicks off on Sunday 1 June.

The competition teaches pupils that trash can be a valuable resource to be re-used in artwork and then recycled.

The cans used in these structures need to be collected by the participants; after which they will be recovered by Collect-a-Can and processed for recycling.

This process encourages pupils to be more eco-conscious and demonstrates the environmental and monetary benefits of collecting and recycling cans.

Collect-a-Can public relations and marketing manager Zimasa Velaphi, says: “We are encouraging pupils to think outside the can and to realise there is more to used cans than trash; cans represent opportunity.”

Submit photographs of the structures with a completed entry form which is available at Collect-a-Can branches. The winning structure will receive R30 000, the second place winner will receive R20 000 and R10 000 for third place winner.

rowing concerns about traders subletting their kiosks has some Town Centre vendors demanding council take ac-

tion.

With a waiting list for people wanting to trade at the informal shopping precinct, some say it is unfair for traders to rent out their space.

Kulsum Baker, chairperson of the Mitchell’s Plain Hawker’s Forum, says there are three kiosks which are not being used by the original lessee.

“One of the traders who rents the kiosk from council has never operated in that space since we opened here,” she claims.

“There are between 18 and 25 historical traders who are still waiting for kiosks.

These people put their names on a list, but then we have traders who just rent out their trading space to other people.”

Council confirms there is a waiting list for traders wishing to operate from stands at the shopping precinct.

It is understood the kiosks are being sublet for thousands of rands.

Baker says stall holders pay council anything from R80 to R327 a month to trade at the shopping zone.

“Before you know it all the trading spaces will be illegally leased to other people and then it will be too late for council to take action,” she stresses.

Baker is concerned that facility managers are not addressing the problem.

“I have informed several officials about the matter, but everyone says it is not in their job description to address the problem.”

Trader Jasmine Harris says some of those

plying their trade on the square in the shopping precinct wish to operate from a kiosk.

“But these are limited which makes it even more of a problem when people just rent out their kiosks,” she believes.

Council needs to intervene, Harris stresses.

“Traders need to comply with the regulations they agreed to when entering into a lease agreement with the City,” she says.

“If they are found to be in contravention of the lease, action must be taken against them,” she says.

According to City of Cape Town policies, traders are not allowed to rent out their kiosks.

The permit agreement states that “only the registered trader is allowed to trade/display goods from within the boundaries of this trading stand. Should the registered trader or his/her assistant not comply with any of the rules/conditions contained herein the permit will be revoked and the trader will be required to vacate the trading stand and remove the trading equipment”.

Johan van der Merwe, the City’s Mayoral Committee member for Economic, Environmental and Spatial Planning, says: “The City’s Informal Trading Bylaw prescribes the options to be considered when transferring trading permits and sets out very strict conditions.”

After it has been proven that an informal trader has transgressed the City’s bylaw or condition of the permit or lease agreement, the City would reserve its rights to withdraw and cancel the agreement, van der Merwe adds.

“The department has already sought legal opinion on the matter and is working closely with other relevant departments to put mechanisms in place to deal with this.”

LEGAL ACTION: CALL TO HALT DAGGA-RELATED CASES

D6 – plot developments NICOLE MCCAIN @nickymccain After the release of land for almost 300 houses in the District Six restitution process, claimant organisations are calling for the Cape Peninsula University of Technology to release more property.

The Department of Rural Development and Land Reform is currently completing phase three of a housing project in District Six. Premier Helen Zille recently announced that land to build 280 new homes is being released by the university as part of the land restitution process in District Six. However, District Six Working Committee chairperson Shahied Ajam says the donation is not sufficient.

Ajam would like to see 150ha of land given to claimants as restitution. He says the former District Six was made up of 150ha, but only around 40ha have been made available for land claims.

“Over 70% of the former District Six area is lost land. While we are grateful that the university is giving off a piece of its land for the third phase, we want more land released. The university occupies almost 50% of the land in District Six and that land must be returned to the people,” he says.

Ajam has called for all privately-owned property to be given over to restitution, including the university property.

Hundreds of people forcibly removed under the Group Areas Act are expected to lodge restitution claims after the National Assembly recently passed the Restitution of Land Right Amendment Bill.

The Bill prescribes changes to the Restitution of Land Rights Act no 22 of 1994, and calls for the reopening of lodgement of land claims for a period of five years.

The new deadline for lodgement of claims set out in the Bill is 30 June 2019.

The Bill will now be referred to the National Council of Provinces and, if passed, will go to the president for approval.

ass action in front of the Cape Town High Court by the Dagga Party has called for the judiciary to postpone all dagga-related cases, as the party challenges the drug’s ban.

A number of cases have been paused over the past year as the State is called upon to justify the legislation banning the drug, says party leader Jeremy Acton. He believes a precedent has been set and a temporary stay must now be offered across the county until the cases which challenge the constitutionality of dagga prohibition are finalised.

The application does not seek to prevent arrests by the police, Acton says, as the dagga laws must still be changed.

“This will grant ordinary people equal rights to those who have been given the right to stay their prosecutions, thus citizens’ rights are upheld. It will instantly reduce the massive costs of prosecutions in the courts, but may – if the prohibition is not overturned – lead to a backlog which may have to be caught up with later,” he says.

Jacques Sibomana, spokesperson for the National Institute for Crime Prevention and the Reintegration of Offenders is concerned the national stay could cause a backlog at courts.

“It will affect the court roll. People will be kept in limbo, not knowing whether or not the prosecution will continue. Some cases may fall

row, prosecutors nationwide could instruct the police to only concentrate on cultivation, and larger quantities, but to confiscate smaller amounts without charging the person. That would minimise harms for the ordinary user,” he says. “This should maintain a balanced legal situation while the future of dagga is considered in the courts.”

Sibomana suggests a different approach to dagga-related cases.

“We do not believe in sending people to jail, and giving them a criminal record for these lifestyle transgressions, is effective. One needs behaviour change programmes, non-custodial responses and programme interventions which concentrates on awareness, education, and behaviour change therapies,” he says.

Acton hopes the stay will herald a change in the legislation.

“I do not foresee any harm to society arising from the granting of the order, but I do see a lessening of harms and costs to society in the immediate and long term, which arise from the prohibition, and which are substantial. Prosecution for cannabis is more damaging to anyone than the cannabis itself.”

The stay will impact on police officers, Sibomana warns.

“Police will become very demoralised as there will be no logical conclusion to their hard work and consequently they will start ignoring these transgressions,” he frets.

However, Acton says the police would have to continue arrests under their constitutional mandate.

Beacon Hill remain undefeated

eacon Hill High opened up a lead at the top of the Mr Price High School’s League table on Saturday after sealing their fourth win in five games.

The Beacon Valley side went into the fixture at the top of the standings, tied on points with then second-placed Portlands, and leading on goal difference alone.

Both sides were expected to continue their run of victories, but Portlands slipped up – losing 2-1 to Westridge.

Beacon Hill took advantage, sealing a 1-0 victory over Rocklands. It sees them lead the log on 13 points, three points ahead of cur-

rent second-placed side Tafelsig.

They remain the only undefeated side in the competition, while Portlands have slipped to third due to their loss.

Tafelsig pulled off one of the biggest results of the weekend to secure second place, beating off-form defending champions Mondale High 3-2.

Cedar High currently hold fourth on the table, level on points with Tafelsig and Portlands, but trailing on goal difference.

Cedar stayed in touch with the league leaders thanks to a 2-1 win over Cloetesville High, another of the tournaments expected title contenders currently struggling with form. Glendale hold fifth on the table after securing their third win of the season

against Spine Road.

Glendale out-scored their opponents by three goals to two. The victory leaves them with nine points in total.

Lentegeur High hold sixth place on the table with eight points, after sealing a 3-1 win over Belgravia, while Mondale and Cloetesville are sixth and seventh respectively.

Princeton High picked up their first win of the season in style on Saturday, netting four goals and conceding none to beat Strandfontein High.

The victory sees them in ninth place on six points. Level on points, but trailing on goal difference, in 10th place is Westridge High.

The victory over Mondale was Westridge’s first this season, after three draws and a loss.

Belgravia High are 11th after their loss, while Aloe High hold 12th place after a 2-2 draw with Oval North. Both sides have five points each but are separated by goal difference.

Strandfontein and Spine Road are 13th and 14th, with four and three points respectively.

Rocklands also hold three points in 15th on the table, while Oval North are still rooted to the bottom of the table on two points despite their draw.

Derby time in Southern League LIAM MOSES @LiamCPT Masiphumelele RFC extended their lead at the top of the Western Province Club Rugby Southern League by trouncing Richmond Rangers away from home last Saturday.

The Noordhoek side went into the fixture with a perfect record, claiming five points in all four of their previous fixtures.

Masi kicked off the season with a 25-11 win over Lagunya, thrashed Thistles 47-0, drubbed Bishop Lavis 64-5 and pummelled Peninsula 49-5, before brushing aside Richmond Rangers 42-3 at the weekend.

The run of impressive victories leaves Masi on 25 points, three points ahead of second-placed Young Wesleys, with a game in hand. The Pumas will undoubtedly continue tearing apart all challengers, starting with Young Brothers who visit the Noordhoek Sports Field on Saturday 31 May. Brothers, who have won three of their six games and occupy fifth place on the table, are unlikely to pick up points.

Meanwhile, Retreat RFC will play their second regional derby in as many weeks when they visit Lakeside to face Peninsula RFC on Saturday.

Retreat have had an inconsistent season so far, losing four matches and win-

ning two. The season started with a 17-3 loss to Young Wesleys, a narrow 8-6 loss to Lagunya followed and then a 26-23 defeat to Thistles.

Retreat stopped the rot by beating Bishop Lavis 26-5, but then slumped to a 15-8 loss to Rocklands, before thumping Grassy Park’s Titans RFC 32-6 last Saturday.

Peninsula have fared slightly better, losing two games and winning three.

They opened the season with a 31-7 loss to Rocklands, but responded to beat Titans 18-8 in their next fixture, thrash Richmond Rangers 43-5 in the next and scrape past Young Brothers 18-23.

But their run of wins came to a crashing halt against Masi and a crushing 45-7 loss to Young Wesleys followed in the next game.

However, form will have little impact on the derby, which features one of the fiercest rivalries in the Cape.

Titans will also be in action on Saturday, hosting fourth-placed Lagunya.

They lost their opening game to Peninsula, beat Richmond Rangers 36-8 and sneaked past Young Brothers 18-15.

They suffered heavy losses in their next three fixtures, with a 45-15 loss to Young Wesleys coming between the defeats to Masi and Retreat. Lagunya will feel confident of leaving Rooikrans Sports Complex with a five-point victory.

V All matches will kick-off at 16:00 on Saturday.

ape Town’s best under-17 sides have a shot at both regional and national glory as the Engen Knockout Challenge goes nationwide this year.

The Cape tournament is hosted by Santos FC. People’s Post is the tournament’s print media sponsor.

As in previous years, five regional events will take place in Port Elizabeth, Bloemfontein, Durban, Gauteng and Cape Town with an extensive qualifying phase leading up to a top quality tournament over one weekend.

Hanover Park FC finished ninth and Green Point Salesians finished 10th overall.

Ajax will be desperate to hang to the Knockout Challenge trophy and earn a chance to prove themselves to be South Africa’s best.

The draw for the Cape Town Engen Knockout Challenge finals will take place at Athlone Stadium on Tuesday 22 July.

The tournament itself will run from Friday 1 to Sunday 3 August at the William Herbert Sports Complex in Wynberg.
