Activists ‘must vacate’ KAYLYNNE BANTOM KAYLYNNE.BANTOM@MEDIA24.COM
W
hen the clock strikes noon on Thursday 8 October, seven people that have been occupying a luxury Camps Bay mansion illegally for the past two weeks, must vacate the premises. If they refuse, the sheriff of the court and the police will step in to evict them. If the group adheres to this order, no costs will be ordered against them. This according to an order that was handed down in the Western Cape High Court on Friday 2 October. The group, who refers to themselves as collective queer Feminists are members of the #WeSeeYou Movement. They appeared in court after they refused to leave the property which forced property management company, Turnkey365 to take
legal action. The activists booked the upmarket holiday home two weeks ago paying about R15 000 for a weekend stay. But on Monday 21 September they informed the company via email that they had no plans of leaving, staging a stay-in, and did not plan to for their extra stay. According to the group, their action is meant to highlight the plight of housing and land issues as well as the lack of safe spaces for queer people in the city. The sit-in was an action they planned well in advance admitted Kelly-Eve Koopman, a spokesperson for the group. The group did not have legal representation and presented themselves. They told the court that if they vacate the property three of them would be homeless. According to reports the City of Cape Town has indicated that accommodation would be provided for the three. Malusi Booi, Mayco member for human
settlements, confirmed that the City has been approached by the court to see if there is emergency accommodation available. He adds that normally, the City responds with filing a housing report if the court involves them, after assessments are made of the respondents’ personal circumstances. He says however there was insufficient time for this process to commence and be finalised, hence no formal assessment process was instituted and there is no formal obligation on the City to provide assistance. “To date, we have not received the completed questionnaires from the respondents which will enable the City to determine whether the respondents qualify for emergency accommodation or not, should this be determined by the court.” Gaby van Wyk, managing director for the company, said in a statement they are pleased that the rule of law and property rights have been upheld. “The actions of the
#WeSeeYou collective to illegally hijack a home have caused incalculable damage, pain and suffering. Much-needed confidence in the market has been lost, livelihoods have been placed at risk, and there has been a loss of income.” She adds that their actions have caused the company great financial loss. “This, at a time when we and many others in the tourism industry are desperately trying to recover from the financial devastation of Covid-19.” Koopman says as a collective of queer feminists, they proved how much of an anomaly they are to the system. “We entered a court without any legal representation. The reality of the many that we stand in solidarity with, became our lived reality. The fact that many like us do not have access to private legal representation nor subsidized representation proves why actions such as ours becomes necessary.” .
