Court: Township Trustees could face subpoena over gravel pit by Raymond Tucker Cordani rtc@thegrasslaketimes.com

Grass Lake Charter Township trustees could face subpoenas relative to the latest legal challenge regarding the gravel pit on Norvell Road. As recently as this past week, Circuit Judge John McBain granted the Friends of Grass Lake Township, a group that opposes the construction project undertaking by L&L, the ability to subpoena sitting board trustees. L&L Development is an offshoot of Lester Brothers, Inc. that is based in Jackson.

Among the sitting trustees, includes subpoenaing former trustee John Lesinski. Lesinski resigned from the Township board in 2017.

“We may have to have a point where I want everyone of those township trustees in court, under oath, understanding the penalty of perjury, McBain, said. The judge added: “I would like to hear the testimony of the trustee that resigned,” meaning Lesinski. Court records indicates that the company that wants to mine and then develop the property faces contempt of court proceedings for performing preliminary construction work despite having had its permit revoked by the judge earlier this year.

As recently as the 12th of July, McBain denied a motion asking that the judge recuse himself from the case. Attorneys representing L&L have claimed that there is an appearance of impropriety from McBain. The July 12th meeting initiated the process of demonstrating cause for contempt of court. Since the special use permit was overturned, McBain had ordered that “absolutely no mining activity,” could continue.

Rick Murphy, who serves as In the beginning, members of the president for the Friends of Grass Friends of Grass Lake Township Lake Township, said that “it’s sued in 2017, seeking to overturn another hurdle. In April, McBain overturned the Another meeting in the Jackson special use permit because the Court is scheduled to be held on planning commission violated a August 19. township ordinance, according to the court. L&L filed an appeal of the decision and the Township trustees voted to support the appeal that same month. The case remains open in the Michigan Court of Appeals.

Crash of the

Wingfoot Air Express Dirigible

July 21, 1919 The Wingfoot Air Express crashes into the Illinois Trust and Savings Building in Chicago Page 3

The Type FD dirigible, owned by the Goodyear Tire and Rubber Company, was transporting people from Grant Park to the White City amusement park. One crew member, two passengers, and ten bank employees were killed in

what is the worst dirigible disaster in United States history. The craft caught fire at about 4:55pm while cruising at an altitude of 1,200 ft (370 m)

over the Chicago Loop. When it became clear the dirigible was lost, the pilot, Jack Boettner, and chief mechanic, Harry Wacker, used parachutes to jump to safety. A second mechanic, Henry Weaver, died when his parachute caught fire. Another passenger, Earl H. Davenport, a publicity agent for the White City Amusement Park, jumped from the dirigible, but his parachute got tangled in the rigging and he hung fifty feet below the burning craft; he was killed when the airship crashed. A fifth person who parachuted from the dirigible, Chicago Daily News photographer Milton Norton, broke both legs and later died at a hospital. At the Illinois Trust & Savings Bank building at the northeast corner of LaSalle Street and Jackson Boulevard, 150 employees were closing up after the day's business in and around the main banking hall, which was illuminated by a large skylight. The remains of the Wingfoot struck the bank's skylight directly and flaming debris fell through to

the banking hall below. The result was ten employees killed, and 27 banking staff reported injured. Local Ad 100 Years Ago Astonishment Will Grip the Women! Committee Passes WalbergBacked Legislation to Combat Illegal Robocalls, Promote Energy Cybersecurity Washington, D.C.—The House Energy and Commerce Committee yesterday passed two bipartisan bills co-sponsored by Congressman Tim Walberg (MI-07), advancing the legislation to the House floor for further consideration. H.R. 3375, the Stopping Bad Robocalls Act, takes a comprehensive approach to empowering consumers and cracking down on illegal robocallers. The bipartisan bill includes a provision Walberg helped author to address onering scams, an increasingly common robocall scheme that tricks consumers into paying huge hidden fees on return phone calls. “Robocalls have metastasized from an unwelcomed annoyance to a malicious attempt to prey on unsuspecting citizens,” said Walberg. “With the Stopping Bad Robocalls Act, the days of illegal robocalls are numbered. I am pleased to have worked on this legislation in a bipartisan way—including efforts to combat the costly one-ring scam—and I look forward to getting it across the finish line on the House floor.” The Energy and Commerce Committee also voted to advance another Walbergbacked bill, H.R. 362, the Energy Emergency Leadership Act. Introduced with Rep. Bobby Rush (D-IL), this bipartisan bill recognizes the important mission of bolstering our cybersecurity at the Department of Energy to more effectively respond to these growing threats to energy security.

“I am proud to see the Energy Emergency Leadership Act get approved today with unanimous support,” said Walberg. “We can’t take any chances with the security and integrity of our energy infrastructure, and this bipartisan legislation will better equip the Department of Energy to ward off constant cyberattacks against the grid.” Walberg, Cooper Introduce Bipartisan Bill to Increase Transparency and Accountability in Federal Spending Washington, D.C. – U.S. Representatives Tim Walberg (R-MI) and Jim Cooper (DTN) yesterday introduced H.R. 3830, the Taxpayers Right-To-Know Act, bipartisan legislation to provide the American people with a better understanding of how their tax dollars are spent. The Taxpayers Right-To-Know Act will require the Office of Management and Budget to publish online an inventory of each agency’s federal programs, and provide a description of the program as well as identify information about the program’s performance and costs. U.S. Senators James Lankford (R-OK) and Maggie Hassan (D-NH) introduced companion legislation in the Senate. “All too often taxpayer dollars go down a black hole at agencies across the federal government,” said Rep. Walberg. “Every dime that Michigan taxpayers send to Washington should be accounted for in a transparent way. Having this information at our fingertips provides an opportunity to evaluate and streamline programs, eliminate waste, and improve outcomes.” “We can always do better,” Rep. Cooper said. “The public needs access to information. I’ve always said sunshine is the best disinfectant.”

LARA Revokes Registration of Sherwood Funeral Home and Cremation Services LLC Raymond Tucker Cordani rtc@thegrasslaketimes.com

The state of Michigan has revoked a registration from the Sherwood Funeral Home and Cremation Services that allowed the Grass Lake Business to accept money for prepaid funerals. The Sherwood funeral home’s registration to accept money for prepaid funerals has been revoked for three years. Owner Christopher Sherwood said that the funeral home will remain open. Sherwood said that the closing was due to “a compliance issue, a difficult situation.” In 2018 the Michigan Department of Licensing Regulatory Affairs (LARA) investigated the Grass Lake funeral home for its practices relative to monies received for prepaid funeral goods and services, LARA said. The Regulatory found that the Sherwood Funeral home had not been depositing money with an authorized escrow agent, as mandated by the state, officials said.

the state. LARA’s Corporations, Securities and Commercial Licensing Bureau issued the final order and the stipulation regarding the funeral home on Norvell Road. Violations of the Prepaid Funeral and Cemetery Sales Act are punishable as a misdemeanor or a felony. Lara officials said that Sherwood wouldn’t be subject to criminal charges so long as all stipulations are followed. It is unclear how Sherwood will remain open during the three year revocation.

According to LARA, the funeral home hadn’t deposited more than $72,000 from 18 prepaid funeral contracts with an authorized escrow agent, the state agency said. The Funeral home has 60 days to remove all references to prepaid contracts in its advertising and website, per the stipulations from
