A little about myself and South Texas Realty LLC. I have been in real estate for 16 years. The majority of my business is in the Floresville area including residential, farm & ranch and commercial. I am the owner/broker of South Texas Realty LLC. We have a team of 16 agents and 2 broker associates that span all over South Texas such as Rockport, George West and New Braunfels.

Although you have probably heard of title companies and title insurance, you may not fully understand the role of the title company or how best to work with the title company in a real estate purchase or sale.
Contract Signed by Buyer and Seller – When the contract for purchase and sale has been signed by both buyer and seller, the real estate agent, or one of the par6es if no agent is involved, submits the contract and earnest money check to the 6tle company.
Title Company Receipt – The 6tle company issues a receipt and sends a copy of the contract and the check to each party. The 6tle company will typically include his/her contact informa6on and the GF number. The GF number (for guaranty file) is used to iden6fy the file and should be used whenever you communicate with the closer. The process of seCng up a working file for the transac6on is oDen called “opening 6tle” and is the first step in the 6tle company’s work to close the sale and issue a policy.
Closer – The closer communicates with the buyer, seller, and the lender. They will also request a survey if one is required, requests tax statements, gathers the required documents, prepares a seJlement statement and conducts the closing.
Title Insurance Commitment – Soon aDer the 6tle company opens 6tle, they will conduct a 6tle search and will issue a 6tle insurance commitment that is sent to both buyer and seller. It is extremely important for the buyer to carefully review the 6tle commitment because the commitment will disclose any defects in 6tle. For instance, it will show if there are any easements, deed restric6ons or liens on the property and whether there are other people who have an interest in the property. Typically, if the buyer objects to any entry on the commitment, they must state the objec6on within a certain period of 6me. If the buyer doesn’t 6mely object, the defect is waived. It is essen6al that the buyer act promptly to review the commitment and raise any objec6ons they may have.
Closing Documents – Typically, the closing documents, which include the seJlement statement, the deed and all loan documents, are not prepared un6l immediately before the closing. It is very important that you review all closing documents before the closing. Don’t expect to get copies of the documents a week before closing, but do ask to receive them by at least the day before closing.
SeBlement Statement – Review the seJlement statement in detail to be sure you get all the credits you are en6tled to. Check the addi6on. Check to make sure taxes are properly allocated. If you are the buyer, review the deed to make sure you name is correct and the property descrip6on is correct. Review the loan documents and all of the other closing documents in the same way you would review any contract. Pay aJen6on to the details and be sure you understand what you will be asked to sign.
Take Your Time – The closing will typically take place at the 6tle company offices. The closing agent will present one document at a 6me for signature. If there is anything you do not understand or if any of the documents have changed since you reviewed them, ask for clarifica6on. Take your 6me. You may even want to schedule your closing for early or mid-month because oDen the end of the month is the busiest for closers.
Disbursement – Remember that the 6tle company does not represent the buyer or seller, but rather acts as an escrow agent, holding the earnest money and documents in escrow un6l it is required to disburse the funds according to the terms of the contract. For instance, under some sale contracts the earnest money will be
disbursed to the buyer if (1) buyer terminates the contract at any 6me during the op6on period or (2) if the contract is subject to lender financing and the buyer is unable to get the financing described in the contract or (3) if the contract is dependent on seller making certain repairs and seller fails to do so or (4) if seller otherwise defaults on the contract. The earnest money will be disbursed to the seller if (1) buyer terminates the contract aDer the op6on period and the termina6on is not excused by the terms of the contract or (2) otherwise defaults on the contract. If neither buyer nor seller requests disbursement of the earnest money prior to closing, it will be disbursed at closing according to the terms of the contract, usually as a credit to the buyer.

The Appraisal – A real estate appraiser is a professional who specializes in es6ma6ng the value of property. Es6mates of value, known as appraisals are typically made when property is bought, sold, condemned, insured or mortgaged. An appraisal may also be performed in a pending divorce ac6on and when partnerships are terminated. A lender will almost always require an appraisal to insure the value of the property is sufficient collateral for the loan. The appraisal is ordered by the lender and even though the borrower pays for the appraisal, the lender is the party that owns it. The appraiser works for the lender and not the borrower. Most appraisals for residen6al real estate are completed using the markets data approach where comparable proper6es are used to determine value.

Note: It’s worthwhile to note that many major problems found in homes are oDen caused by deferred maintenance of another item in the home. Let’s use defec6ve siding as an example: The defec6ve siding was allowing moisture and rain to seep in behind the siding. This caused damage to the sheathing paper and fungal rot to the wood framing members under the siding. If the defec6ve siding had been replaced sooner, there may not have been further damage to the structure. The buyer has three op6ons in response to a structural inspec6on:

Loan Underwri6ng – ADer the informa6on on a loan applica6on has been verified, the value of the property has been confirmed and the 6tle search has been completed, the loan is now ready to be underwriJen. The underwriter will review all of the informa6on, analyze the creditworthiness of the borrower and render a decision on whether to grant the loan. The major func6on of the underwriter is to assess the risk of the borrower.
Title Insurance Commitment
– On most real estate transac6ons, 6tle insurance is purchased. There are two types of policies:
• €Homeowner’s Policy (protects the homeowner)
• €Lender’s Policy (protects the lender)
The premium for 6tle insurance is a one-6me, non-reoccurring fee. The 6tle policy will be subject to certain exclusion and excep6ons. Prior to issuing the insurance, the 6tle company will conduct a search of the public records to determine the excep6ons to coverage, such as any liens or restric6ons that would affect ownership of the property.
For example:
The seller failed to pay the property taxes and the county placed a tax lien against the property. The property could be seized and sold to pay off the seller’s back taxes. If a buyer were to purchase the property without knowing about the unpaid taxes, the buyer may find themselves at risk of having to pay the back taxes or losing the property.
Prior to the closing of a real estate transac6on, the 6tle company specifies all outstanding liens so that the buyer can require the seller to sa6sfy the liens prior to closing.
The 6tle company will issue a commitment for 6tle insurance that will indicate:
• €The par6es to be insured and the amounts of coverage
• €The current owners of the property
• €The legal descrip6on of the property
• €Any requirements that must be met for the insurance to be issued
• €All excep6ons to coverage, including recorded items affec6ng the property, such as mortgages, easements, building and use restric6ons and liens
The commitment for 6tle insurance is not the actual policy, but it guarantees that a policy will be issued if the condi6ons that are specified in the commitment are met. In almost all real estate transac6ons, separate 6tle policies will be purchased for the lender and the buyer.
The buyer typically purchases the policy for the lender and the seller typically purchases the policy for the buyer.
Here’s an example of where there could be issues during an escrow period because of a =tle:
A preliminary 6tle report on a par6cular property indicated there were three owners of the property. The purchase and sale agreement was only signed by two owners. Many years ago, the third owner had relinquished her ownership of the property to the other two. She did not, however, sign or record a quit claim deed, though she was willing to do so. The two owners will either need to get a quit claim deed from her or have her sign the purchase and sale agreement. This may cause delays in the closing date.
Recording – ADer all of the documents have been signed in escrow by both of the par6es, the closing agent will ensure that the loan is ready to fund. The deed of trust is sent from escrow to the county recorder to get recorded. The buyer legally owns the property when the loan has funded and recording numbers are made available.
The purpose of recording the deed is to put the public on construc6ve no6ce about the informa6on contained in the document.

The recording established priority of the deed and also establishes ownership.
If there was a delay in geCng the deed to the recorder’s office before it closed, the deed would have to be recorded the next day. The recording of the deed shows proof of the transfer of the sale and the buyer may have to wait un6l the next day to start moving into their new property.
