News Holmes Beach officials weed through Bert Harris claims Scott Lancaster
I
n 1995, the state of Florida enacted the Bert J. Harris, Jr., Private Property Rights Protection Act, which provides a specific process for landowners to seek monetary relief when their property is unfairly affected by government action. In Holmes Beach, residents started filing claims with the city after a September 2015 ordinance reduced the occupancy limit to six people per unit. So far, 19 property owners have filed claims amounting to around $5 million in financial losses. Under the Florida statute, cities have 150 days to respond to each claim with a written settlement offer. After that time, the claimants could opt to take the issue to court, and that’s just what the owner of a duplex located at 306 Clark Dr. did. The property owner is 306 Clark LLC, which lists as managers Keith Carter, Claire Daley and Emma Stringer, all of Holmes Beach. The LLC filed suit against the city in November 2016, claiming a loss in market value of $84,600. 306 Clark LLC recently submitted a
In Brief Colony developer tries to ease residents’ concerns LONGBOAT KEY - At a recent meeting to discuss plans for the Colony Beach & Tennis Resort, Unicorp National Developments President Chuck Whittall tried to assuage residents’ concerns about a number of possible impacts on the community by his proposed redevelopment project, most importantly, traffic. Whittal said Unicorp intends to fund road improvements in high-traffic areas that should help offset any increase in traffic that his development might bring. He said they are also planning on offering a free trolley and airport shuttle service to cut down on cars on the road. Also, citing concerns about height
settlement offer to the city, requesting the city’s approval to build an additional bedroom and bathroom on each side of the duplex. The city had previously approved up to three bedrooms and three bathrooms on each side of the property. 306 Clark Dr.
The city turned down the settlement offer, so the case continues to wind its way through the legal system. The owner of 626 Key Royale Dr. also opted to follow through with a lawsuit against the city, with a claim amount of $319,479. That case went to trial in December 2016 and is currently awaiting the judge’s decision. To date, the biggest single claim filed in Holmes Beach is $730,000 for the property located at 214 54 St., A and B.
By Scott Lancaster and density, Whittall said his firm would be flexible and respect the wants of the community in determining the final plans for the property. As of now, the plans call for 180 residential units and 237 hotel units. Voters will be asked to approve or deny the proposed development in a referendum on March 14.

T
he cat is definitely out of the bag. TripAdvisor recently announced its 2017 Travelers’ Choice Awards and Siesta Beach snagged the title of the best beach in the United States, reclaiming the number one ranking it also held in 2015. The state of Florida scored the most beaches listed in the top 10, with seven beaches making the grade. Florida also claims 10 of the top 25 U.S. beaches on TripAdvisor’s list. Hawaii had the second-most shout-outs, with seven of that state’s beaches making the top 25. TripAdvisor has been releasing the travelers’ choice rankings for five years. In that time, Siesta Beach has never been listed below number three. TripAdvisor bases its rankings on reviews posted to the website by travel-

ers. According to TripAdvisor, Siesta Beach is a “pristine beach that never seems to end. Photographer's dream. A place in the sun that warrants returning again and again.” Visitors and locals alike call Siesta’s world-famous fine, white quartz sand, that never seems to get hot, a major draw for the area, as well as the calm water that looks like the Caribbean. And unlike many other beach areas, Siesta Beach is praised for its ample parking and easy access. In the travel site’s worldwide top 25 beach rankings, Siesta Beach came in at number five, the only U.S. beach to make the cut. According to the list, the number one beach in the world is Brazil’s Baia do Sancho, although we in Sarasota County know better.

fter years of back-and-forth and multiple lawsuits, members of the Siesta Key Association and officials from the city of Sarasota continue to do battle over the proposed dredging of Big Pass in order to use the sand to replenish a mile-and-a-half stretch of beach on Lido Key. Big Pass has never been dredged before, so Siesta Key residents are concerned that any alteration of the natural flow of sand and water will negatively impact Siesta’s shoreline and world-famous, number one ranked beach, thus impacting tourism and home values, among other things. To ease residents’ concerns, the city of Sarasota is pondering the notion of taking out a $2.5 million insurance policy that would be used to migitate any possible negative effects the proposed

The SKA has asked the county to intervene, saying that a part of the dredge area is in the county’s jurisdiction, so the dredging can’t move forward without the county’s consent. So far, county officials have opted to stay out of it, letting the city and the SKA duke it out on their own.

ollowing the implementation of water taxi services in Clearwater, St. Petersburg, Madeira Beach and Tampa, Sarasota city commissioners voted unanimously to allow a proposal by Captain Sherman Baldwin, of Paradise Boat Tours, to move forward. Baldwin’s idea is to operate a ferry service between downtown Sarasota and the Bridge Street Photo provided Pier in Bradenton Beach, where Paradise Boat Tours currently operates on-demand water taxi service, similar to local dolphin and nature tours along the Uber, that would utilize smaller boats to ferry passengers to various waterfront Intracoastal. Longboat real estate listing is a budget buster

LONGBOAT KEY - A new Longboat Key real estate listing is expected to be coming on the market this month, but it’s not for the faint of heart or light of wallet. The six bedroom beachfront mansion boasts over 19,000 square feet of living space spread out over three stories, on 1.2 acres of land. It is located within the gates of the Longboat Key Club in Regent Court. The home will be listed at $26.5 million, setting a new record asking price for Sarasota, Manatee and Charlotte counties.
ANNA MARIA - The city of Anna Maria is in the process of ranking the three proposals it received from engineering firms that want to be the one to restore and repair the city’s 105year-old pier. None of the proposal included cost estimates; the city will choose the best candidate based on experience and other factors.
