The Biltmore Group offering free holiday light decorating service INDIAN ROCKS BEACH - The Biltmore Group, a full-service, residential luxury real estate brokerage company that currently has offices in Indian Rocks Beach and Countryside, recently announced that they will be offering their services in hanging exterior Christmas lights for the elderly in our community for free this holiday season. The Biltmore Group will decorate using the homeowner’s lights or can provide lights if the homeowner doesn’t have any. State beach access law prompts local lawsuit Residents claim town beach ordinance is not valid. By Sandra Nickless

A

lawsuit was recently filed against the Town of Redington Beach by residents Pamela Greacen and Arthur Buser Jr. as a result of the passage of House Bill 631: Possession of Real Property, the so-called “Beach Law” that went into effect July 1, and immediately created questions about who owns the beach throughout the state of Florida. HB 631 prevents local governments from passing ordinances that would guarantee public access to privately owned beaches without first jumping through a ton of hoops, unless that local government already had such an ordinance on the books prior to Jan. 1, 2016. According to town attorney, Jay Daigneault, Redington Beach did have just such an ordinance, but still made a

recommendation to the town commission to pass “an even more detailed customary use ordinance,” just to make extra sure HB 631 wouldn’t apply to the town. The town adopted a new ordinance to that effect in June. It reiterates the “customary use” of the dry sand on the beach for public use, even on private property. However, in their lawsuit, Greacen and Buser state that the town did not have a customary-use ordinance in

effect prior to Jan. 1, 2016 and because of that, they claim the June ordinance is not valid and that their private property, located at 16120 Gulf Blvd., has been illegally seized. In response to concerns and confusion stemming from HB 631, Gov. Rick Scott signed an executive order directing all 67 counties in the state to protect public beach access and ordering the FDEP to “do everything in their power to advocate to keep our beaches open and public.”

John’s Pass hotel project inching forward

A hotel in the heart of John’s Pass Village jumped another hurdle on the way to becoming a reality.

T

he Madeira Beach City Commission recently decided to support a proposed hotel project that will be located on a vacant piece of land at the back of John’s Pass Village between 129th Avenue and Boardwalk Place. The land is currently being used as a parking lot. The plans, as previously presented by architect Jack Bodziak, include a sixstory hotel building offering 78 rental rooms, a rooftop pool with water slides, retail shops and a three-story parking garage with 297 parking spaces, about half of which could be used by the public to help with the ongoing scarcity of parking options in the area. Bodziak’s project hit a hiccup when he originally presented the idea to com-

missioners in August due to Fisherman’s Alley, a 16-foot wide cityowned alley that runs through the middle of the proposed site of the hotel. Long story short, the hotel’s parking garage will be built on both sides of the alley and connected at the third story with an enclosed pedestrian bridge. The alley itself will be paved and widened to 24 feet, with plenty of accessibility for garbage trucks and other large vehicles to travel on. Bodziak also agreed to reach a mutually agreeable way to compensate the city with a portion of the parking revenue, whether it’s a flat payment made to the city or a percentage of the revenue over time. Although he knows there will be a lot

of back-and-forth with the city as the project moves forward, Bodziak has said he was particularly careful to design the project well within the city’s height and density limitations. “We have gone to quite an extent to make this as viable as possible for the

commission,” Bodziak said. “A hotel has always been lacking in John’s Pass Village. Now we can get it done.” The project is expected to cost between $25-$30 million. The plans for the hotel will now be reviewed by the city’s Planning Board.

learwater Beach resident Pit Gills has pitched a request to the Clearwater City Council to allow the installation of a helicopter pad at his residence, located at the north end of Clearwater Beach at 1160 Mandalay Point Rd. To sweeten the pot a little, Gills has offered to let the city use his landing pad in emergency situations. While Gills’ property is located in a residential neighborhood, it is unique in that it is surrounded on two sides by water, the Gulf of Mexico and the Intracoastal Waterway. There are neighboring homes on the other sides of the property, but Gills informed councilmembers that the owner of the property nearest the proposed location of the helipad is only in residence about three weeks a year. If approved, the

The Clearwater City Council requested that Gills first receive approval from the Federal Aviation Agency and then bring the matter back to the city council for further discussion. If approved, the city would have to draft a very specific new citywide code.

Rick Scott recently announced that the Florida Department of Environmental Protection (DEP) committed an additional $3 million to Pinellas County through DEP’s red tide emergency funding, bringing the total for Pinellas County to $6.3 million. In addition to this funding, Gov. Scott is allocating another $3 million to DEP’s red tide emergency funding to ensure other communities have access to the resources they need to combat the impacts of this naturallyoccurring phenomenon. This grant funding is in addition to $765,000 that Gov. Scott recently allocated to fund additional Florida Fish and Wildlife Conservation Commission scientists and field and laboratory equipment to support efforts to mitigate the impacts of naturally-occurring red tide. he media reports 1,000 people a day move to Florida. The actual number is closer to 257,000 a year, or just over 1,000 per weekday. or two or three months prior to a presidential election, real estate sales slow to a crawl. It’s simply a reaction to not knowing what’s coming next. A few weeks back, activity slowed during a mid-term election. Most unusual, but so is Mueller, Kavanaugh and the Democrats saying they will start impeachment proceedings if they win the house. On a positive note, employment is under 4 percent and the lowest ever for minorities and women. GDP has exceeded 4 percent for a quarter. Money is returning from overseas and being invested in the U.S. Salaries are running 2.8 percent ahead of a year ago. Over four million are off food stamps, and there is a boom in small business startups. A strong economy causes interest rates

to rise as the demand for money heats up. Canada, Mexico and South Korea have agreed to new tariffs. The U.K., EU and Japan are making concessions while the squeeze is being felt by China. Things are looking good, but!!! Assume you were under 40. Your peers have seen two Iraq wars, a real estate bubble and 3.5 percent mortgage rates. As parents and grandparents, we recognize 6 percent as a historic norm for mortgages. Young people have never experienced rates at this level. The under-30 group has committed to home ownership at a higher rate than ever before, with women leading the way. They are only one Iraq war short of the 40year-old crowd. I believe the stock market and hous-

ing will be in a flux until the election. If the Dems win the House and Nancy Pelosi wins Speaker, things will settle quickly. If the Dems win and someone else is Speaker and impeachment efforts start, all bets are off. Being an optimist, I assume cooler heads will prevail and all will return to normal a few days after the election. However, if impeachment starts, you will see a country divided, and the future is anybody's guess.
