“No smoke is a joke” goes to court By Sue Warren

Y

ou can spray it. You can vape it. You can eat it. But you can’t actually smoke medical marijuana. In the latest drama surrounding the state’s Amendment 2, well-known Florida attorney, John Morgan, who spearheaded the passage of the amendment, brought his case challenging a ban of smokable marijuana to court, calling it “no smoke is a joke.” Morgan claims that when people approved Amendment 2 in the November 2016 election, they knew what they wanted and what they were voting for, and that includes marijuana that can be smoked. However, state lawmakers disagree, saying that the harmful effects of smoking outweigh the medical benefits. Amendment 2 mentions smoking only one time, saying medical marijuana can’t be smoked in public. Proponents

say that gives users the green light to smoke in private, and law experts agree that voters were aware that smoking medical marijuana was a likely outcome of their approval of the amendment. Even Jon Mills, the author of Amendment 2, agrees. “There’s no question that the definition of marijuana in this constitutional provision includes smokable marijuana,” said Mills. Whatever the outcome of this lawsuit, there are likely to be lengthy appeals by the losing side. Amendment 2 went in to effect on Jan. 3, 2017. It allows physicians to certify patients as eligible to receive medical marijuana as treatment for certain debilitating diseases, such as cancer, epilepsy, HIV, AIDS, ALS, Parkinson's disease and other comparably debilitating medical conditions.

Pinellas County to hire more school officers PINELLAS COUNTY - Per the requirements of the Marjory Stoneman Douglas High School Public Safety Act, which was signed into law by Gov. Rick Scott in March, the Pinellas County School Board recently agreed to hire a total of 82 additional school police officers and security guards before the 2018-19 school year starts on Aug. 13. The act requires a “safe-school officer” at each school in the state; safeschool officers must be sworn law enforcement officers.

Just when you thought it was OK to drive on Ulmerton Road.... By Jason Coffman

o you remember where you were on Jan. 30, 2012, a day that will live in infamy: the day construction began on Ulmerton Road? How could we forget the $23 million project that involved the widening of a 2.28-mile stretch of the roadway in Largo? We all celebrated when the project was finally completed last year, after five long years of inconvenience. But deep down, we knew it wouldn’t last. It turns out there’s a problem with the infrastructure of the new construction having to do with the sewer lines, and this means a section of the road needs to be torn up so the pipes underneath can be repaired. The portion in question is around the Tall Pines Drive intersection. It will involve repairing a dip in the sewer lines, as well as 12 improperly-installed manholes, plus relocating another manhole and replacing the Tall Pines Drive sanitary sewer stub-out. The City of Largo recently reached a settlement agreement with the insur-

CLEARWATER - The Clearwater Solid Waste/Recycling Department recognizes the detrimental effect disposable plastics can have on beaches and marine life. Not only is plastic waste unsightly for a relaxing stroll on the beach, but the Environmental Protection Agency has found plastic to be responsible for the death of roughly 100,000 marine mammals and 1 million sea birds every year. Plastic straws are a large contributor to this plastic problem—as Americans use roughly 500 million plastic straws every single day. These plastic straws use a large amount of energy to make, are not recyclable and do not biodegrade. In an effort to reduce the effect of plastic straws on the environment, the

The problems with the installation were discovered during the course of another project, the Lake Avenue sanitary sewer extension project. City officials have not said when the repairs will begin, but it should be within the next month.

By Sue Warren Solid Waste/Recycling Department has created a voluntary Strawless Summer Challenge for city restaurants, bars and cafés. For a three-month period from June 1 to Aug. 31, businesses can participate by abstaining from giving plastic straws out unless requested by customers. Participating businesses will be spotlighted on the department’s website and city social media efforts. Businesses that successfully complete the Strawless Summer Challenge will receive a certificate of achievement and a photo spotlight on the department’s website for one year. The Strawless Summer Challenge will kick off June 1. Despite trepidation, Clearwater City Council thinking about moving on up.

T

he City of Clearwater has been moving fairly quickly on its possible plan to relocate the 45 employees who currently work at city hall to temporary digs downtown. The idea is to then demolish the current city hall building, located at 112 S. Osceola Ave., so the property can be marketed and sold to a developer sooner rather than later, as part of the city’s $55 million Imagine Clearwater redevelopment plan. The demolition and redevelopment of city hall was supposed to be one of the

final pieces of the Imagine Clearwter puzzle, something that wouldn’t start for at least three years. But with the current building in need of costly repairs and renovations, the idea of moving city hall ahead of schedule was floated as a way to save money and jumpstart the Imagine Clearwater plans at the same time. At the behest of council members last month, City Manager Bill Horne and Assistant City Manager Micah Maxwell narrowed the search for possible temporary city hall locations to three choices, but their recommendation to the city

council was a floor at One Clearwater Tower, located at 600 Cleveland St., which would afford city employees over 13,000 square feet of usable space. Mayor George Cretekos was again opposed to the idea, especially when faced with the prospect of moving city hall to an ordinary office building. He had stated last month that he would rather stay put and follow the original vision of the plan.

Ultimately, the city council instructed Horne to negotiate a lease proposal with One Clearwater Tower’s management for council members to review and take it from there. A city-wide referendum will be required before anything can be built on the current city hall site, but that doesn’t prevent the city from entertaining proposals and setting the plan in motion.

County, city asking residents for input on planning By Jason Coffman

esidents are invited to provide input as Pinellas County revises its Comprehensive Plan, to be known as Plan Pinellas. Citizens have been able to learn about the new Plan Pinellas guiding principles and offer their feedback through a series of open houses. The last of three open houses will be held at the SPC Clearwater Campus, located at 2465 Drew St., in Room ES 102/104 on Wednesday, June 27, from 6:30-8:30 p.m. In addition to the open houses, residents have been asked to participate in an online survey to express their thoughts about the county’s future. The survey can be found at www.opentownhall.com/portals/255/Issue_5868. The Comprehensive Plan acts as the guide by which a community’s development and preservation decisions are made, covering a wide range of topics, such as land use, mobility and public services; all intended to improve the quality of life for residents and visitors. The Plan Pinellas update process will address the changing conditions and needs in the county, with a resulting format that is user-friendly for county departments and citizens. The introductory “Vision Element” of the Comprehensive Plan will define the county’s future and describe the guiding principles that will focus the plan’s

The city of Clearwater is also reaching out to gather input about Drew Street as part of the Drew Street Complete Street Concept Design. The city is asking people who use Drew Street regularly, including vehicle drivers, bus riders, walkers and bicyclists, to fill out a survey online at www. myclearwater.com/CompleteStreets. In 2017, Forward Pinellas awarded the city of Clearwater a grant for the Drew Street Complete Streets Concept Design. Complete Streets means streets that are safe for all modes of transportation, including people who drive all types of vehicles, take public transport, walk and bike. The city is now developing its first Drew Street Complete Street Concept Design from North Osceola Avenue to U.S. Highway 19. The city’s primary goals for the Drew Street Complete Streets Concept Design are to enhance safety, comfort and function for all users, especially pedestrians and bicyclists, and to encourage economic revitalization and reinvestment along Drew Street and within the surrounding neighborhoods. Clearwater has also started implementing the Complete Streets concept citywide.

In Brief Dredging of Clearwater Pass nearly complete

CLEARWATER - The maintenance dredging of Clearwater Pass to the Beach Marina Basin and parts of Clearwater Harbor that began at the beginning of May is nearly complete. The U.S. Army Corps of Engineers was authorized to dredge approximately 60,000 cubic yards of material from the channel. This will bring the channel depth to 10 feet and 150 feet wide at its entrance. The channel will then narrow to 8 feet wide by 100 feet deep as you move away from the

uring the first quarter, our market has remained strong, with high demand, rising prices, and low inventory. Over the past year, sales in our market show the following pattern: • Closed sales were down 9.9% • Active listings are down 10.5% • Median sales price was up 10.7% • Percent of homes purchased for cash was down 7% • New listings are up 3.5% • New pending sales down 4.1%

unless the seller's price comes down, the buyer puts up more money or a combination of the two. For the remainder of this year, home prices will increase as fast as appraisers can justify it. I'm estimating 5-6% for houses that are financed. Cash buyers are often willing to pay a little more, so 6-8% is possible. This is a conservative forecast, unless some unexpected event in the world causes investments to come to a standstill. What does this mean? New construction listed for sale is up, but overall, inventory is down. New construction is running into some resistance as the number of listings is going up faster than sales, and we are seeing price reductions. However, overall sales are down 9.9% due to the number of available listings being down 10.5%, which translates into more buyers than sellers, explaining the 10.7% increase in sales price. Cash sales are down 7%, which means a higher percentage of homes are financed. Appraisers must use sold properties to establish value for the lender. When prices are increasing almost 1% a month, the contract price is often higher than the appraiser can justify. The bank won't lend

hy do some properties sell in a few days while others seem to stay on the market forever? All too often, agents recommend a value based solely on the square footage price which similar sized homes have sold for. The priceper-square-foot only matters when properties of similar condition and updates are used. To start the evaluation process, you must determine who will be buying the property. Move-in-ready homes with updated or new features sell to upper middle-class buyers or well-todo buyers. Move-in-ready homes that are original but well maintained will go to first time home buyers or seniors, who had harvest gold baths in their first homes. Homes that require remodeling go to investors, which come in two vari-

eties. One group repairs to rent, which means less expensive but acceptable updates. The other group repairs to sell at a profit. This group does a total rehab on kitchens and baths and anything else necessary to attract a buyer. They seek to earn a profit and cover repairs and carrying costs, along with the cost to resell. Sellers set the list price, but most rely heavily on the agents to give them reliable guidance. If the agent is overly optimistic to gain the listing, everybody loses. Days on the market tell the world nobody else was willing to buy this property; therefore, you may have a hard time selling it in the future. When a house sits, the type of buyer can change, resulting in a much lower price than would have been possible if priced correctly from the beginning.
