wo new, separate lawsuits were filed in Pinellas County’s 6th Judicial Circuit Court last month, with the common goal of getting the courts to overturn a Madeira Beach ordinance that allows the Madeira Beach Town Center project to move forward. Madeira Beach City Commissioners officially approved the project, which covers the area from 150th Avenue and part of Madeira Way to Gulf Boulevard, after developer Bill Karns voluntarily downsized his plans, which encompasses hotels, condominiums, retail space, restaurants and green space, and that made his proposal more palatable to some, but clearly, not everyone. The first lawsuit, Linda C. Hein and Sam Baker vs. City of Madeira Beach, was filed by Treasure Island attorney Ken Weiss on March 16. The suit contends that the city’s rezoning of the land for the project does not jive with the city’s comprehensive plan. It also claims the city did not comply with its PD zoning procedure by not requiring a complete application and failing to review the plans, among other items. The second lawsuit, William Gay vs. City of Madeira Beach, was filed by St. Petersburg attorney Tim Weber. This suit also claims that the city erred in not requiring a complete application and says the commissioners’ approval of the project was “not supported by competent, substantial evidence to meet the requirements of a site plan or the design criteria required to be reviewed by the Board of (city) Commissioners.” The sizable real estate project, one that city officials and the project’s developer envision as the “gateway” to the city, has divided the community, with many residents firmly opposed, citing traffic and other concerns. Both lawsuits also seek payment of the plaintiffs’ attorney fees.

fter months of anticipation, Pinellas County commissioners recently agreed to do away with the county’s so-called Blue Law, which regulated the hours that restaurants and other establishments can serve alcoholic beverages. The previous code requirement stipulated that all business entities, both public and private, must not serve alcohol from 3:00 a.m.
Pinellas County business establishments are now able to sell alcohol after 8 a.m. on Sundays.

The new code amendment sets the times at 3:00 a.m. to 8:00 a.m. seven days a week, countywide. Most municipalities were in favor of the uniformity of the change, but the amendment does allow for individual municipalities to set more restictive hours if they wish. Blue laws were originally enacted to curb various activities on Sundays for religious reasons.

PETE BEACH - The 277-room Loews Don CeSar Hotel, the historic property known as “The Pink Lady,” along with its sister property, Beach House Suites, recently sold to an affiliate of investment giant Host Hotels & Resorts for the combined price of a whopping $202.6 million. The sales prices were recorded at $151.8 million for the Don CeSar and $50.8 million for the Beach House Suites. The Sirata Beach Resort, also in St. Pete Beach, recently changed hands, as well, along with Treasure Island’s Sands Motel.

tate officials are expected to get down to the nitty-gritty in the coming weeks to discuss a $50 million plan to help provide funding for beach renourishment and protection projects throughout the state. The state had previously budgeted $30 for the cause, but last year’s Tropical Storm Colin and Hurricane Hermine caused widespread erosion on Florida’s number one asset: our wide, sandy beaches. State leaders have said they recognize the value in keeping the beaches up to snuff as a visible investment that more than pays for itself in the form of tourism dollars. Several beaches in Pinellas County would be in line to receive the additional funding. Among them are Indian Rocks Beach, which saw significant erosion after last year’s storms, as well
as Sand Key Beach, Upham Beach and other parts of St. Pete Beach and Treasure Island. If approved by the House and the Senate, as it is expected to be, local governments will receive the state funds by mid-summer. In addition to the state funds, Pinellas beaches can also expect to divvy up $10 million a year from the county for renourishment projects.

Hallelujah! Parking garage opens in Clearwater Beach
Pass-A-Grille road construction finally enters Phase 2
CLEARWATER BEACH - A dedication ceremony recently marked the auspicious opening of a new parking garage in Clearwater Beach: the Pelican Walk Parking Garage. The new public garage offers 702 parking spaces for $2 an hour or $20 a day. The parking garage also offers monthly parking passes, which city officials hope will provide a solution for Clearwater Beach employees who have to drive to work every day and then battle to find parking. The new parking garage is located on Poinsettia Avenue in North Beach.
PASS-A-GRILLE - The seemingly never-ending Pass-A-Grille road construction project that has beleaguered residents, visitors and business owners for months has finally entered into its second phase. This part of the project will stretch from 19th Avenue to the southern tip of the island. The city of St. Pete Beach entered into an agreement with the Southwest Florida Water Management District, where SWFWMD will cough up about half of the phase’s $6.246 price tag. City officials now expect Phase 1 of the project to be complete by July.

Old Florida Waterfront Charm with a Unique Flair WATERFRONT RESTAURANT
As we all know, good things come to those who wait. Or as I have always said, success is earned, not given. This is truly the story of two people who have paid their dues and have now taken their years of experience to step onto center stage with the Mad Beach Fish House in Madeira Beach. Allow me to introduce these two very accomplished, major players. Amy Powell is the owner of Mad Beach Fish House and runs not just the front of the house but the entire operation. After serving over 15 years in numerous roles with Starbucks, Amy was asked to move to another high-profile market for the coffee empire. After much thought, it was at that moment Amy knew the time was now to surround herself with water and beautiful Florida sunshine and she purchased the Mad Beach Fish House. Powell wanted to embark on making the Fish House all it could be, focusing on the customers and great food, keeping the great things and adding some new members to the team. Change is not overnight; it takes time and commitment. It was time to create magic and work with the amazing wildlife around her. Insert Chef Louis Scaramuzzi, who grew up in Key West. Unlike Powell's corporate background, Scaramuzzi's story starts on the sands of Key West. Opening and operating Great Events Catering, a premier catering business, from 1997 to 2008, allowed Chef Lou to hone his artistic culinary skills, serving former presidents and prominent customers visiting Key West. Building on his reputation, Scaramuzzi later established Muzzi, Inc, a consulting company that owned and operated Sailfish Club and the Conch Shack, two very respected establishments.

Fast forward to years later and Lou relocated to the Tampa Bay area, consulting for a couple of years for local restaurants. As they say, fate would have it that Powell and Scaramuzzi would meet and both agree they each have served a pivotal role in the current success of Mad Beach Fish House. "I can't cook like Louie but I love the customers and the magic that comes with a well-run operation," said Powell. "With our passion, drive and integrity, we want to make sure every customer feels as though they are a guest in our own home," said Scaramuzzi, who shared that he and Amy look for the highest quality of fresh local seafood. "We want to serve the best and be the best we can be," he said. Powell and Scaramuzzi agree that taking care of the tourist trade is important, but it's absolutely critical to take care of the locals who live on the beaches year round. "We want to be different while being the best," said Chef Lou, noting that the daily specials depend on what's the freshest seafood currently on the market. "We want to do things that are unusual or that you would not expect from a fish house like us." Creating homemade jams, such as yellow pepper jams, and cilantro oils are only a couple of ways that Chef Lou likes to jazz things up and add a flair you will not find anywhere else on the beach. There is nothing the team of Powell and Scaramuzzi won't do to separate themselves from the other restaurants in the area to make Mad Beach Fish House the best of the best. Mad Beach Fish House also offers breakfast starting at 9:00 a.m. on Saturday and Sunday to go along with a $4 Bloody Mary bar.
