Judge shoots down PSFRD referendum wording By Beth Ludwig

ome of you may remember the hoopla surrounding the wording on the ballot last November for the Pinellas Suncoast Fire and Rescue District’s tax referendum. The referendum had to do with the PSFRD wanting voter approval to use ad valorem taxes for its funding, instead of the previous flat rate that was charged to every household in the district. At the time, former PSFRD Chief Sal D’Angelo said the flat rate was no longer suffiicient to fund the District’s operations, and without an ad valorem tax, the District would have to layoff workers and possibly close a fire station. A group of residents, in particular Indian Rocks Beach Commissioner Ed Hoofnagle, objected to the wording of the referendum and urged the PSFRD to change it. Alas, the District declined. The wording remained unchanged on the ballot and the referendum was approved. Hoofnagle then opted to file a lawsuit againt the District.

BELLEAIR SHORE - Residents of Belleair Shore are truly blessed, what with their Gulffront homes and all. And now, the town has even managed to lower what was already the lowest millage rate in the county for homeowners. The town’s new millage rate for the upcoming fiscal year will be 0.6594 mills, down from 0.7294 the previous year. The town of just 111 residents was able to reduce the millage rate due to an overall increase in property values. The town’s total operating budget for the year came in at just shy of $109,000. Treasure Island still exploring options to charge Causeway tolls TREASURE ISLAND - The Treasure Island City Commission is still working on a couple of different options to

Fast forward to now, and Circuit Court Judge Jack St. Arnold recently ruled in Hoofnagle’s favor, calling the deception of the voters “intolerable.” All in all, the ballot wording made it seem as though the District was lowering the tax, when in fact it was actually creating a whole new tax for voters. Since St. Arnold’s ruling, the PSFRD decided at an emergency meeting to pass a resolution to rescind any millage rate that would fund the District. However, the District still has the option to appeal St. Arnold’s ruling. For the record, the original referendum read: “Pinellas Suncoast Fire and Rescue District is currently vested with the authority to levy an ad valorem tax of up to 3 mills subject to voter approval. Shall voters reduce the maximum millage rate to 2 mills and grant the District the authority to levy and collect the reduced Ad Valorem tax, the final rate to be set in an open budget process and not to exceed ½ mills in the first fiscal year?”

Penny For Pinellas vote is almost here: WHAT SAY YOU? By Daniel Holloway

T

he current Penny For Pinellas tax is set to expire on Dec. 31, 2019. This Nov. 7, Pinellas County voters will decide on a renewal of the sales tax for another 10 years, from 2020-2029. The Penny sales tax funds long-term, capital infrastructure projects throughout the county, with each municipality able to determine which projects take priority in that community. To help citizens make an informed decision on the Penny renewal referendum, the county launched an updated website featuring an interactive map focused on future projects proposed by the county and 24 cities. The map can be accessed by visiting www.pinellascounty.org/penny. The website also includes frequently asked questions, budget information and examples of projects supported by the Penny over the past three decades. The county’s proposed projects focus on water quality improvements, including flooding and sewer spill prevention; upgrades and maintenance to area roads, sidewalks, bridges and trails; providing a safe and secure community through new fire stations and law

enforcement vehicles, as well as other public safety projects; preserving parks, green space and environmental lands; and providing new and upgraded libraries and community centers, along with affordable housing options. According to city and county officials across the board, the timing of Hurricane Irma only served to highlight the importance of renewing the Penny for Pinellas sales tax in the upcoming Nov. 7 vote. If approved, the item on the ballot would extend the Penny For Pinellas program for another 10 years. In that timeframe, it is estimated that it would raise around $2 billion that will go directly to help fund various infrastructure projects throughout the county. Pinellas County Sheriff Bob Gualtieri and others pointed to the 2014 construction of the $81 million Pinellas County Public Safety Complex as a crucial addition to the community that was made possible with Penny funds. The complex is built to withstand a Category 5 hurricane.

TREASURE ISLAND - The “Veterans Day Fall Fly on TI” is slated this year for Nov. 11 and 12 on Treasure Island Beach behind the Thunderbird Beach Resort. The theme for the weekend will be “Honor America’s Veterans,” featuring red, white and blue kites, banners and flags. This free, familyoriented event will feature general kite flying, kite games, stunt kite lessons and demos as well as a chance to honor veterans by flying a kite. CLEARWATER BEACH - Dig in to one of Florida's favorite seafood delicacies at Cooters Restaurant & Bar as stone crab season begins. Phase 2 of Pass-A-Grille Way construction gets green light By Beth Ludwig

A

s months of construction on Phase 1 of the Pass-A-Grille Way project are expected to finally draw to a close sometime in November, St. Pete Beach commissioners are paving the way for the commencement of Phase 2. Commissioners recently agreed to approve a bid to the tune of $10.2 million for the next phase of the project, which will span from 19th Avenue south to First Avenue. The overall cost of this part of the project is pegged at $11.5 million, which factors in the cost for trees and other landscaping, new street lights and a connection fee payable to Duke Energy. The biggest chunk of the funding will come in the form of a $3.21 million grant from the Southwest Florida Water Management District.

A big part of this phase will be the installation of an underground pump station at First Avenue. This will allow for storm water to be pumped into Boca Ciega Bay to help avoid flooding in the future. . The contractor for this phase, Gibbs & Register Inc. will have until February 2019 to complete the work.

T

he ongoing fight against parking and traffic problems in Clearwater Beach might be getting some high-tech help in the form of elevated gondola travel. Two different proposals were recently unveiled at the Forward Pinellas Transportation Technology Forum, featuring mass transportation in the form of cable car gondolas and aerial transit using magnetic levitation. The first proposal, the cable-propelled gondolas, features technology that is already in use around the world. The 1.9-mile track would look to run between downtown Clearwater’s Coachman Park, the Clearwater Marine Aquarium and Clearwater Beach. The gondola cars would be capable of transporting up to 5,000 people per hour. Each one-way trip would take nine or 10 minutes. The cost of the

fares hasn’t been proposed yet, but it would probably offer a discount for residents. All that sounds good, but it would come with a sticker price of up to $75 million to build. If it came to fruition, this travel alternative could be up and running in less than two years. The other proposal featured new technology put forth by a company called skyTran that utilizes two-to-four passenger elevated cars that are propelled using passive magnetic levitation. This form of transportation is not currently in use yet, although there are plans for it in Abu Dhabi and Tel Aviv. This proposal comes with an estimated cost of $40 million, with individual ticket prices of $4. Members of the Clearwater City Council have been mulling the feasibilty of elevated transit for over a year.

ome prices have exceeded the all-time highs set during the peak in July of 2006. The national median price of a home is $263,800. In Florida the median price is $245,000 and in Pinellas County, it's $248,450. This can be great news for sellers, if they can find a buyer able to pay cash. Cash is important, since appraisals are required for financing. Prices have risen so fast it's difficult for appraisers to keep up. This has caused many loans to be cancelled at the last minute. Appraisers are locked in a box that forces them to use public records to substantiate their opin-

If the lowest price point stabilizes or falls, the one above it will have the same problem, and so on, up and down the ladder. ecent articles have been about the demand for homes outpacing the supply, forcing prices higher. Hurricane Irma just made it worse. Parts of the Keys were destroyed, but fortunately, reduced the storm to a category 4, while most of the state saw a 3 or less. It's too early to say that an already strong demand for homes will get even stronger. However, many homes have been damaged or destroyed. The first to receive relief will be from homes covered by insurance. Those who don't have flood insurance will have to wait on FEMA to process their claim.

Once claims are settled, finding a repair crew will be almost impossible, since the demand will far exceed the available labor. Florida, like Houston, will see many shysters arrive to take advantage of desperate homeowners. Make sure you and those you know are not hoodwinked. Since 2008, my partner Rebekah, and I have advised investors in the purchase of over 2,000 properties that were either repaired and rented or sold at a profit.
