Family files lawsuit against Sully Truck Wash By Jamee A. Pierson Newton Daily News

Adoptions, donations low as St. Nick’s Christmas Club works to support Jasper County families Newton Daily News The St. Nicks Christmas Club volunteers are seeking additional community support as adoptions and donations are down for the first time in the groups 26-year history. Club Treasurer Lisa McKinney said more than 160 children remain to be adopted from the group’s “adoption” book and funds are running low. “We have 167 children from 61 families that have yet to be adopted,” McKinney said. “The group has taken on many of the large families with four or more children, but donations are extremely low and we do not know how we will pay for the remaining families and the food boxes which cost $7,500 annually. We need support to make sure 650

children in Jasper County receive Christmas this year.” To ensure all 220 Jasper County families who registered for the program in 2014 are served, the group is asking for support either through adoptions or by making a cash donation. Those wishing to adopt a family can do so by visiting the Newton Daily News from 8 a.m. to 4:30 p.m. Monday through Friday. The book will be available through Friday. “Adopting a family is a lot of fun,” said McKinney, who has been involved with the group for nearly a decade. “It is a great way to share the true meaning of Christmas with your children or grandchildren by letting them help shop and give to a child who may not have presents under their tree Christmas morn-

ing.” Each child adopted receives a new outfit, socks, underwear and a toy, and each family receives a box of food including hamburger, hams, potatoes, cereal, vegetables and other staples to help them through the holidays. For those wanting to help but unable to shop for a family, cash donations can be mailed to St. Nick’s Christmas Club, PO Box 162, Newton, Iowa 50208. Those seeking a tax-deductible receipt can make the check payable to Jasper Community Foundation and earmark the funds to St. Nick’s. To help raise funds the Club also established an online fundraising site that accepts debit and credit card donations. To

A lawsuit was filed by the family of a man who died while working at the Sully Truck Wash last January. The Sully Truck Wash and Brent Vander Molen are being sued by the family of Willie Mercer. The lawsuit includes negligence against the truck wash, gross negligence against Vander Molen and damages. Mercer was one of three men found unconscious inside a tanker trailer Jan. 21, 2014. He died and two others were hospitalized when they were overcome by fumes. “Willie’s death and the damage it has caused his family could have been prevented if Sully Truck Wash would have simply just followed the OSHA requirements. Instead they completely ignored the confined

space requirements which resulted in Willie’s death,” Corey J. L. Walker, attorney for the family said. The truck wash, 10683 Highway F62 E. in Sully, previously faced four serious violations from the Occupational Safety and Health Bureau (OSHA) for this incident including: • Not evaluating the workplace to determine if any spaces were permit-required confined spaces • Not informing exposed employees, by posting danger signs or by any other equally effective means of the existence and location of and the danger posed by the permit spaces. • Not having the employer develop and implement a written permit space entry program that complied with code. City approves agreement with Hubbell for Maytag buildings By Jamee A. Pierson Newton Daily News The Newton City Council has approved a preliminary development agreement with Hubbell Realty Company for a $7 million apartment project at two former Maytag buildings. The agreement is subject to the tax credit approval Hubbell hopes to receive from the state.

Hubbell aims to renovate the property, located at 403 W. Fourth St. N., commonly known as Maytag buildings 1 and 2. The city committed $250,000 in TIF grant money to the project upon completion of construction during a special meeting last week. It would also provide 11 years of TIF District payments of $30,000

per year, which would mostly come from the new tax value crated by the project. The net total amount the city would pay is $478,000, which is comparable to the other two downtown housing projects the city is involved in. Kris Saddoris, vice president of development for Hubbell, said APPROVAL | 3A
