by Shaun Knittel SGN Associate Editor A three-judge panel of the 9th U.S. Circuit Court of Appeals in San Francisco refused September 29 to decide the constitutionality of the U.S. military’s nowrepealed “Don’t Ask, Don’t Tell” policy, saying the issue has been resolved since Americans can now enlist and serve in the armed forces without regard to sexual orientation. The court dismissed a Southern California trial judge’s year-old ruling that the policy was unconstitutional. The Log Cabin Republicans, a Gay rights advocacy group, filed the lawsuit in 2004 challenging DADT. The group’s lawyer, Dan Woods, said he would ask the full 9th Circuit to review the panel’s decision. The group recently argued that the lower court ruling, which also barred enforcement of DADT, should remain in effect despite this month’s repeal because future adsee dadt page 20

Walmart adds gender identity to Hate crime targets Gay its non-discrimination protections couple in West Seattle The HRC announced on September 28 that Walmart, the country’s largest private-sector employer, has added gender identity and expression to its employment nondiscrimination policies. Walmart spokesperson Phillip Keene told the Windy City Times that the changes went into effect “several weeks ago.” “We’ve had a strong anti-discrimination policy for a long time,” Keene added. Walmart’s non-discrimination policies already included sexual orientation. “What matters in the workplace is how you do your job, not your gender identity or sexual orientation,” HRC President Joe Solmonese said in a statement. “As the nation’s largest private employer, Walmart shows that doing the right thing is also good for business. We urge them to continue to move forward by ensuring all of their LGBT employees receive equal benefits.” Walmart employees, who recently formed an organization called Walmart Home Office, Bentonville, Arkansas

Damage to Lyle Evans’ car with the rock and note found at the scene

“God Hates Fags! Get the fuck out of our neighborhood,” the note said. The note was wrapped around a rock, and the rock was thrown through the back window of Lyle Evans’ car as it sat in his driveway. Evans and his partner, Chris Ilovar, live in a normally quiet residential area of West Seattle. “The Junction is six blocks see walmart page 20 away up the hill,” Ilovar told SGN.
