Appeals court reaffirms strikedown of Prop 8

The U.S. Ninth Circuit Court of Appeals has turned down a request from supporters of California’s Proposition 8 to revisit their prior ruling that the measure is unconstitutional. The June 5 decision leaves in place a February decision by a three-judge panel of the court, but allows Prop 8 supporters 90 days

to appeal to the U.S. Supreme Court. Prop 8, passed by California voters in 2008, reversed a California Supreme Court decision allowing same-sex marriages and reinstated a ban on such marriages in the state. Opponents of same-sex marriage on Wednesday submitted more than 240,000 signatures, about twice as many as needed, to qualify Referendum 74 for the ballot in November. Protect Marriage Washington had until Wednesday to gather at least 120,577 signatures to force a public vote on Washington’s marriage equality law, passed earlier this year by the state legislature and signed into law by Democratic Gov. Chris Gregoire. The legislation was to have taken effect June 7, but now remains on hold until the election. The state Elections Division will test the validity of the signatures. According to David Ammons, a spokesman for the Secretary of State’s office, R-74 could be officially certified for the November ballot by the middle of next week. “By all reasonable expectations,

A federal district judge in New York has ruled that DOMA is unconstitutional because there is no “rational basis” to deprive Gay and Lesbian couples of the rights enjoyed by opposite-sex married couples. Judge Barbara Jones ruled on June 6 that Edie Windsor had been deprived of her constitutional right to equal protection because she was forced to pay estate taxes after the death of her wife, Thea Spyer. Married opposite-sex couples are able to inherit propThea Spyer (l) and Edie Windsor in 2007 erty from their spouses nal basis test, irrespective of the without paying estate taxes. Mormons showed their support for the LGBT community by marching in this year’s Utah Pride parade in Salt Lake City.

by Annalisa Millo Special to the SGN The Utah Pride Festival has seen more than 20,000 attendees each year for the past few years, and 2012 was no exception. Our parade this year boasted Dustin Lance Black, Oscar-winning screenwriter for the 2008

film Milk, as grand marshal. There were close to 120 floats, up from last year’s roughly 90. It’s no secret that Salt Lake City, Utah, is the headquarters for the Church of Jesus Christ of Latter Day Saints (LDS), also known as the Mormon Church. The incendiary 2010 documentary 8: The Mormon Proposition revealed that

the church was a significant backer of the campaign to repeal samesex marriage in California. Needless to say, this caused a good amount of turmoil and tension in our community, LDS and non-LDS, Queer and straight alike. see utah page 17
