A three-judge panel of the 1st U.S. Circuit Court of Appeals ruled on May 31 that Section 3 of DOMA is unconstitutional. The decision in Gill v. Office of Personnel Management was unanimous, and sustains a previous ruling in the case by federal District Judge Joseph Tauro. The 1st Circuit stayed its ruling pending a U.S. Supreme Court decision in the case, meaning the plaintiffs cannot receive the economic benefits denied by DOMA unless and until the high court rules in their favor. Section 3 of DOMA codifies the definition of marriage as only between a man and a woman for federal purposes. The ruling does not affect other sections of DOMA, including the reciprocity provision, which says states are not required to recognize legal same-sex marriages performed in other jurisdictions.

by Shaun Knittel SGN Associate Editor Opponents of marriage equality announced May 30 they have reached the number of signatures needed to qualify a proposed referendum – Referendum 74 – seeking to overturn a new law legalizing same-sex marriage in Washington State. In addition, the group said they could turn in the signatures to the Secretary of State’s office as early as Monday. Joseph Backholm, with Preserve Marriage Washington, said that the campaign has at least 150,000 signatures on hand. Backers of R-74 need to turn in 120,577 valid voter signatures by June 6 to qualify for the ballot. The Secretary of State’s office recommends that campaigns submit at least 150,000 signatures, to provide a cushion for invalid or duplicate signatures. “We feel that it’s going to be adequate to get it on the ballot,” Backholm told The Seattle Times. “We’re quite confident of that.” According to Backholm, the 150,000 signatures gathered thus
