Reluctantly, but necessarily, I replaced my "smart phone". Phone upgrades are always touted to be easy and seamless. The same was said about the trucking industry transforming from paper logs to ELDs. When a new, or well-maintained piece of equipment isn't working properly, it is usually "operator-error". I've learned to slow down, re-think what I am doing, and the equipment WILL work properly. Anyway, after a steep learning curve and many frustrating cuss words, I finally began to understand and use with ease the ELD device and my new phone. I learned that not only can I make good use of devices; they actually make conducting my business easier! I can interact with customers and the office in a more timely manner. My customers want easy, fast access to me as we set up the next loads. It is important that you know that our esteemed leader, Myron Rau was recognized and honored by the South Dakota Department of Transportation Hall of Honor for his life-long contributions to improving the integrity of our state's infrastructure, and improving safety for everyone on our highways. Myron is a wellrespected lobbyist in Pierre and Washington DC as he works tirelessly to advance YOUR interests...yet another perk of belonging to SDTA. A reminder that the Annual Pheasant Hunt is Thursday, November 12, leaving the ClubHouse Hotel at 9:00 AM, (register as soon as possible), and that the Fall Board of Directors meeting, which is open to all members, is scheduled for Friday, November 13, 10:00 AM at the ClubHouse Hotel (RedRossa restaurant) in Pierre, SD. This is my personal invitation to attend, learn, contribute and profit from the meeting. Learning constantly about improving the bottom line is a huge dividend as a member of SDTA. Remember and honor our veterans every day, but especially on November 11. Respect what their sacrifices have purchased for us, by voting on November 3. Exercise your right to vote in person or absentee, but take the time and effort to VOTE! Stay well, stay safe, and "Keep between the ditches"!

Myron Rau Inducted into South Dakota Transportation Hall of Honor

Sioux Falls - October 8, 2020

The purpose of the Transportation Hall of Honor is to to recognize those persons who hade made a lasting, valuable, and/or unique contribution to South Dakota’s air, highway, public transit, or rail transportation systems. Items to be considered are technological innovations, political activity, legislative accomplishments, creativity, time, cost savings efforts, and economic impact. “Myron has dedicated his entire professional career to making our highway and transportation systems in South Dakota safer” wrote the Department of Public Safety Cabinet Secretary Craig Price. It is that reputation that shows why Myron Rau is well deserving of this recognition.

Myron was raised on a farm near Java, SD. He would go onto graduate from South Dakota State University. In 1975, Myron joined the South Dakota Highway Patrol as a state trooper. His first duty station was in Huron. Throughout his career he worked his way through the ranks to Captain of the Motor Carrier Division in 1992 before retiring from the Highway Patrol in 2001. After retiring from his Highway Patrol position, Myron started working for the SD Trucking Association and South Dakota Auto Dealers Association and is still in that position today. In his early years as a Motor Carrier Sergeant, he dedicated his time and effort into protecting the infrastructure of the state. Myron realized roads and bridges were on the South Dakota’s biggest investments, so protecting them from unnecessary damage became a priority to him. He made sure commercial vehicle had their registration and taxes paid for the larger than normal use of the highways. In 1994, Myron tried to convince the Legislature it was time to adopt federal regulations to help govern the safety of commercial vehicles. The legislature declined, but he most definitely made an impact because in 1995, again with encourContinued on page 17

Myron has been a tireless advocate for the trucking industry for almost 20 years as the President of South Dakota Trucking Association by continuing the partnerships he’d established years before. Knowing that working with industry stakeholders is the most effective way to solve problems and create opportunity, it was these partnerships that were key to success in South Dakota. His partners in safety know he advocates for the solution, not the advantage.

He is trusted by the partners, legislators, and government agencies alike. He is known in the trucking industry and legislature as the go to guy for transportation issues. He is someone who has all interests at heart - a tell-it-like-it-is advocate for doing the right thing. Myron’s lifetime of work has built a foundation that will last for generations. That is why he was inducted into the Transportation Hall of Honor. It was a night to celebrate his lasting contribution to South Dakota’s transportation system.

FMCSA Schedules Listening Session on Broker Transparency October 9, 2020 • by HDT Staff

The Federal Motor Carrier Safety Administration has scheduled a virtual listening session to get input Owner-Operator groups believe freight brokers should be required to share more information with motor carriers about transactions.

THE SESSION WILL BE HELD ON WED., OCT. 28, 1:00-2:30 P.M. EASTERN TIME.

FMCSA would like to hear from members of the public on their views on the regulation of property carrier brokers in general, and on three pending petitions concerning specific property carrier broker regulation issues. After receiving petitions from owner-operator groups to amend certain requirements for property carrier brokers, FMCSA published a notice in the Federal Register on Aug. 19 requesting public comment on the petitions. The Owner-Operator Independent Drivers Association requested that FMCSA require property carrier brokers to provide an electronic copy of each transaction record automatically within 48 hours after the contractual service has been completed, and explicitly prohibit brokers from including any provision in their contracts that requires a motor carrier to waive its rights to access the transaction records. The Small Business in Transportation Coalition requests that FMCSA prohibit brokers from coercing or otherwise requiring parties to brokers’ transactions to waive their right to review the record of the transaction as a condition for doing business. SBTC also wants FMCSA to ban broker contracts from including a stipulation or clause exempting the broker from having to comply with the transparency requirement. This meeting does not pertain to broker or freight forwarder minimum financial responsibility matters. The session will be held via videoconference and will be accessible to the public for its entirety. The session will be held via videoconference only, with registration required at www.fmcsa. dot.gov in advance of the meeting. FMCSA encourages early registration. The virtual session will allow members of the public to make brief statements to the panel. If all interested participants have had an opportunity to comment, the session may conclude early.

Lawmakers Weigh Options on Legislating in Pandemic Joe Sneve - Sioux Falls Argus Leader

A team of South Dakota officials are looking at options for keeping the 2021 Legislative Session on track while also balancing safety concerns during the ongoing coronavirus pandemic. State lawmakers make up a fraction of the hundreds who come through the doors at the capitol building each day during the annual legislative session. Lawmakers met using the hybrid of in-person and remote interactions during a special session earlier this week, but it’s unclear if those remote options will work during the full session. “To keep all those working and operating in a functioning way through the pandemic is going to take a lot of mental horsepower for staff and legislative leadership,” said Reed Holwegner, director of the South Dakota Legislative Research Council, which provides administrative support for the Legislature. A subcommittee of the Legislature’s Executive Board in August began working to find options to keep the state’s legislative body functioning during the upcoming session. They expect to have a final decision by year’s end. The subcommittee is looking at three methods of conducting business when session begins January 12: • Require legislators to be in Pierre to conduct business face-to-face; • have the entire Legislature use internet and telephone technology to attend committee meetings and proceedings on the chamber floors; • or a hybrid that allows some lawmakers to stay home and others to be in Pierre. So far, when legislators have had to convene during the pandemic, remote attendance has been an option for legislators. On Veto Day in late March, just weeks into the pandemic, nearly all legislators attended using remote technology, casting votes through their computers. And though more legislators were physically present for Monday’s special session to consider $13 billion in COVID-19 spending, dozens again participated from locations outside of the capitol building. House Speaker Steven Haugaard, R-Sioux Falls, said if there’s no vaccine yet available by the time final decisions need to be made, he anticipates his fellow members of the executive board will create an attendance policy that legislators be present at the Capitol but able to attend meetings remotely while sitting in breakout and committee rooms throughout the building. “We’re taking those measures to be safe. It might be that we’ll build in an option for remote attendance. But we could probably do that on site,” he said. Right now, though, that’s not really an option. The capitol building has undergone many renovations and upgrade projects since being built in 1910, but not all rooms where legislators meet are accessible with technology to allow remote voting. That’s why Holwegner and his team at the LRC are in the midst of an estimated $350,000 project to bring the necessary wiring and connectivity to nearly all of them and improve the voting systems used in the chambers of the Senate and House. Those dollars are expected to be reimbursed with federal CARES Act funds. But requiring all legislators to converge on the capitol building during session - regardless of where they’re at while attending meetings - might not be the safest way to go, said Sen. Minority Leader Troy Reinert, D-Mission. “We’re still in the middle of a pandemic, and we’ve already buried one of the legislators that we served (Continued on page 25)

with,” he said, referring to the death of Huron legislator Bob Glanzer, one of the first South Dakotans to die from COVID-19. “It’d probably be a good idea to allow remote access.” Masks likely won’t be mandatory inside the capitol. Democrats support such a policy, but GOP leadership in South Dakota has thus far shown no appetite for requiring masks or face covering. Still, Haugaard said it will be important for legislators and anyone else at the capitol this winter to be respectful of those around them. And in some instances, that means wearing a mask, he said. “There’s been a push from the staff in particular that there be distancing and masks and those kinds of things,” he said. “We’re taking those measures to be safe.” Lawmakers noted that the pandemic situation could look a lot different by the time session arrives, whether that’s a drop off in spread or general concern. And if a vaccine is made available and determined to be effective, the work being done by the Executive Board might be all for naught. “If there’s a vaccine, then I’m not sure anyone has a good reason not to show up,” Haugaard said. “We really do need to get back to business where we are able to interact with one another directly.” Reprinted from

Jimmy Henrichsen

February 06, 1942 - October 14, 2020 Jimmy passed away on October 14, 2020 in Rapid City, South Dakota, he was born on February 6, 1942 in New Underwood, South Dakota to Harry and Vivian (Johnson) Henrichsen. He is survived by his wife Linda K Henrichsen of Rapid City, South Dakota and two pets Zoe and Abby, son Leith Little of Grand Junction, Colorado, granddaughter Harley Najera of Craig, Colorado, two great granddaughters Mia and Aliyah, and daughter Danielle Little of Estacada, Oregon. He is survived by siblings, sister Jeani Withington of Hilo, Hawaii, brothers John Henrichsen (Sue Henrichsen) of Rapid City and Jerry Henrichsen (Vicki Henrichsen) of Hermosa, sister-in law Anita Henrichsen and sixteen nieces and nephews and great nieces and nephews. He was preceded in death by Harry and Vivian Henrichsen, his brother Fay Henrichsen and brother-in-law Dick Withington. Jimmy lived in Rapid City and graduated from Rapid City High School in 1961. Met his wife in Denver, Colorado and married in Rapid City on March 15, 1986. As esteemed resident of Rapid City, he leaves behind his logging family and will be well missed in the Black Hills. Jimmy was a quiet, calm, gentle soul with a work ethic of an ox. He enjoyed nature and found peace within the hills; he always said “not a bad office”. He loved watching the sunrise and will be remembered daily by many not only family but many friends. He had a love for “old school ways” and never really understood the new ways of being, which was a charming quality he carried with him through life. His hobby was spending hours tinkering on his truck and visiting with his friends. He was a member of both the South Dakota Trucking Association (SDTA) and (received in 2018 recognition of 55 years of dedicated service) and The Black Hills Log Haulers Association. The family has decided on a celebration of life next summer in 2021, date to be announced.
