With a pivotal presidential election looming on the horizon, the intensity is only set to amplify in the coming months, offering ample fodder for debate. While it might be tempting to tune out or sidestep key issues, there’s a pressing need, now more than ever, to stay informed and engaged, especially in the Realtor® community. It cannot be overstated, but the adage “If real estate is your career, policy is your business,” has never been more crucial than it is today. Advocating for Our Industry: Highlights from the NAR Legislative Meetings

Our color remains purple when it comes to politics, as we focus on the issues that impact the housing market, affordability, personal property rights, and a clean environment. I want to extend my heartfelt thanks to all the participants who joined us in Washington, D.C., for the National Association of Realtors® Legislative Meetings. It was a packed event featuring discussions about the buzz on Capitol Hill, alongside numerous roundtables and meetings centered around what is crucial for our industry.

Our key priorities were conveyed to our representatives Greg Steube, Rick Scott, Marco Rubio, and Vern Buchanan. Real estate represents 16% of the U.S. GDP, supports 2.8 million jobs, and generates $50 billion in tax revenue nationwide, and it’s important to us as the voice of that industry to walk the walk and meet faceto-face with these lawmakers to discuss our priorities. We discussed issues surrounding the industry, such as affordability and the lack of available housing.

Notably, we emphasized the need to increase the cap on capital gains taxes, currently set at $500,000 per couple, a limit that has not been increased in several years. A bright spot of our meetings was when one of our representatives agreed to cosponsor this increase during our meeting immediately after FPC Bill Furst stressed the importance of it. We also focused on maintaining Realtors® as independent contractors, preserving 1031 exchanges, and ensuring veterans can continue to purchase homes in our ever-changing environment.

The Realtor® Voice makes a difference, and we were well represented by the attendees from our Realtor® Association of Sarasota and Manatee. Making new connections, revisiting old ones, and collaborating with other Realtors® across the country are what make our industry unique and stronger. Once again, I would like to thank all who attended and represented our Association. However, there is still much more work to be done. It is crucial to stay informed about Realtor® priorities and let your voice be heard when it comes to protecting our industry and the people we serve. •

Our elected officials make important decisions relating to zoning codes and regulations, property tax rates, infrastructure changes, and several other crucial factors that affect the way real estate professionals carry out their day-to-day business. Those politicians are also the ones who hear from their constituents about a number of different policy issues including matters that have a real impact on the value of their property.

WHY ADVOCACY?

A Realtor® advocate means having your voice heard on issues that are important to you – and staying

informed on those issues is key. You can’t promote and protect your rights if you aren’t aware that they are in danger of being infringed upon. The RASM Government Affairs Department interfaces with all local government entities on behalf of RASM members. We proactively monitor local legislation and regulatory policy for the impact it may have on private property rights and the ability to freely buy, sell, and lease property. But we also rely on the volunteer efforts of our members to join us in the fight to protect and maintain these rights.

“Advocacy is the linchpin in safeguarding our profession, championing the interests of our clients, and ensuring the vitality of Florida’s real estate sector,” said Max Brandow, RASM Vice President of Advocacy and Member Programs. “Without a robust advocacy presence in Tallahassee and Washington D.C., nonRealtor® friendly conversations can overshadow ours, leading to detrimental policies that hamper our livelihoods and erode our bottom line. Yet, advocating for your interests alone behind closed doors often yields little progress. It’s RPAC’s efforts that grant access to the decision-makers who shape our future.”

WHAT IS THE REALTOR® PARTY?

The REALTOR® Party is a powerful alliance of Realtors® working together to advance public policies and candidates that build strong communities, protect property interests and promote a vibrant business environment. RASM, along with Florida REALTORS® and the National Association of REALTORS® (NAR), works for our members by advocating for local, state, and federal policy initiatives.

PUBLIC POLICY

On local advocacy issues, RASM has adopted a Public Policy Guide when determining priorities for Manatee County and Sarasota County. We also follow state and national priorities as they pertain to our area. The RASM Public Policy Guide was created to collectively group RASM’s prime objectives as the local voice for real estate in our two-county area. The guide outlines the Association’s position under the following categories:

LOCAL ELECTIONS

RASM provides a variety of resources to help you stay informed about local elections, including voter guides and election links.

WHO DOES RASM ENDORSE AND WHY?

ƒ Every election cycle, RASM screens and endorses candidates for elections that have the most impact on our members’ day-to-day business, and the industry. This is typically State Senate, State House, County Commission, and City Commission races.

ƒ RASM does this because as a professional trade association, it is our job to protect and advance the industry politically.

ƒ The importance of identifying Realtor®-friendly candidates during the election cycle cannot be overstated. Just one elected official who does not understand or does not support our issues could be the difference between the state or local municipality implementing a sales tax on your commissions, which saves members on average $2,300 annually. We also endorse Realtor®-friendly candidates to advance a healthy and thriving market.

RASM’S LEGISLATIVE WINS

The last few years, the RASM Advocacy Department, along with the Public Policy Committee, has been very focused on reforming and modernizing the laws and zoning codes in municipalities to see industry-wide shifts in our local market.

ƒ With the passage of the Sarasota City Comprehensive Land Use Plan, and the subsequent zoning text amendments, the city is heading towards transformational change, not only in the downtown market, but also along the corridors. This new plan paves the way for mixed use, walkable developments along major corridors like 301, 41, Fruitville. This is beneficial for both our Commercial and Residential Realtors® because more units will come on line in our market, neighborhoods will see much needed capital investment, and it also helps address a major issue we fight for: affordable housing. Not only will housing supply increase, which leads to downward pressure on the skyrocketing housing costs for young and first-time home buyers, but in the plan, developers are also given incentives to allocate certain percentage of units in their projects specifically for individuals at or below the median incomes in town.

ƒ In the City of Bradenton, the Public Policy Committee led by Chair Barry Grooms, lobbied the City Council to implement a plan downtown which has the chance to take Bradenton to new heights. The plan involved moving the current City Hall property to a new parcel which would allow a state-of-the-art mixed-use development to come to one of the most important areas of downtown, the riverfront. This project will have a ripple effect not only for downtown merchants and the downtown commercial properties, but also the adjacent and downtown edge residential neighborhoods. RASM is very bullish on the City of Bradenton, the elected leaders we have in the City and Manatee County are visionary when it comes to investing in the area, and the best is yet to come if we continue electing Realtor®-friendly candidates.

RASM KEY PRIORITIES

RASM supports the legislative priorities highlighted by Florida REALTORS® and NAR. In addition, we follow RASM’s Public Policy Guide when determining priorities for Manatee County and Sarasota County while following State and National priorities as they pertain to our area. RASM’s specific key priorities include:

ƒ Protecting private property rights for owners to utilize their property freely, such as for vacation rentals.

ƒ Minimum to no fees for essential Realtor® activities like using open house and for sale/rent signage.

ƒ Preserving and protecting our local environment, which attracts so many of our members’ clients to the area.

ƒ Making sure our school districts continue to outperform other districts throughout the state.

ƒ Improving the local economy and business climate so our members can thrive.

ƒ Increasing the housing stock and fighting for affordable housing measures.

STILL MORE WORK TO DO

Even with all the positive changes we’ve been a part of, the work is not done when it comes to housing affordability. Cities and states throughout the country have been biting around the edge of the issue for years, but in the end the only way we’ll get the requisite amount of supply now and into the future is major permanent zoning changes. This means everything from allowing property owners by right to build ADU’s, upzoning parcels to allow more units/acre, providing incentives for builders to construct affordable housing in their projects, etc.

We also need to make sure we have a diverse array of commercial properties and uses. While residential units are essential and needed for Sarasota and Manatee to have a thriving economy that isn’t solely reliant on seasonal tourism, we must have areas in the region to place mixes of different commercial uses.

SUPPORT RASM’S ADVOCACY EFFORTS

RASM Major Investors are industry professionals whose goal is to promote homeownership for all and to protect Realtors® from burdensome regulations. Major Investors are eligible to participate in the RPAC Recognition Program, with specific benefits and accolades that acknowledge their support of RPAC. There is a minimum annual investment of $1,000. To become an investor, click here

There is a direct link from Realtor®-friendly candidates that RPAC helped get elected, to bad legislation prevented via “no” votes by those same elected officials, and vice versa. Like the Sarasota City Comp Plan, and the City of Bradenton Downtown revitalization, all those efforts wouldn’t have had the requisite number of votes, if Realtor®-friendly candidates weren’t elected. Also, the work is never done. All the progress we made in the City of Sarasota is at risk in this election cycle. We have candidates running against our Realtor®-friendly incumbents in the City of Sarasota that are on record vowing to undo progress made by the current Commission.

WHAT’S THAT LOOK LIKE?

In the City of Sarasota, you’re likely to see building moratoriums in the city, or roadblocks in front of any new projects which will chill investment into the city, and inevitably lead to higher construction and development costs, which are always passed on to the consumer. That means no more, or a drastic cut, in the number of new units in the area. Less units to buy and sell per RASM member and their clients.

If some of these candidates get elected it could mean your clients who invest in vacation rentals may look elsewhere in the state because the opponent candidates are on the record advocating that the city will lean into more taxes, more inspections, more fees for vacation rental owners.

Opponent candidates have also lamented the amount of For Sale/Rent signs in the city; imagine if the city charged RASM members per day/week just to put a for sale or for rent sign in a clients’ yards? Do you think that could have an impact on your bottom line?

In Manatee County it’s the same story. We have candidates running against adding parking spaces to the island beaches. Imagine showing potential clients Anna Maria, Holmes Beach, and Bradenton Beach only for them to realize the island communities, by design, only provided enough parking for residents of those islands?

At the state level, every year someone tries to implement a sales tax on your commissions, but because we have a strong Realtor®-caucus and Realtor®-friendly candidates we’ve been able to prevent that from happening. We have been able to secure record number of state dollars for housing assistance programs, environmental funding, etc. These are all part of our state priorities, and those priorities are easily attainable if we have Realtor®-friendly candidates elected. And RPAC helps them get elected.

GREAT AMERICAN REALTOR® DAYS (GARD)

The Great American Realtor® Days (GARD) is an annual event hosted by Florida REALTORS® that gives you the opportunity to travel to Tallahassee and shake hands and meet face-to-face with lawmakers before they weigh decisions that will impact how you do business. Attendees can make sure our elected leaders have the right information before voting on legislation that could hurt your bottom line, threaten the growth of your business, or make it harder for Floridians to buy their dream homes or sell their properties.

“Every year we have members attend GARD for the first time, and I always hear, ‘Wow, I had no clue the importance of the work we are doing at the State Capital.’ When you’re in those meetings with lawmakers and you see the respect they have for our industry and members, and their willingness to reach out and get the Realtor® perspective on issues, it highlights the impact our members have had on state legislation throughout the years. We must be willing to use our collective voice, or someone else will beat us to it,” said Brandow. •

Realtor’s® Purchase of Property Listed with the Firm

By: National Association of REALTORS® Interpretations of the Code of Ethics Agreement Case 1-21: (Adopted May, 1989 as Case #7-25. Transferred to Article 1 November, 1994. Revised November, 2001.)

Mr. and Mrs. A visited Realtor® B’s office and explained they had owned a four-bedroom ranch house nearby for thirty years but since their children were grown and Mr. A was retiring, they wanted to sell their home and tour the country in their motor home.

Realtor® B and Mr. and Mrs. A entered into an exclusive listing agreement. Realtor® B conducted an open house, advertised in the local paper, and took other steps to actively promote the sale.

Four weeks after the property went on the market, Realtor® B received a call from Realtor® Z, a broker affiliated with the same firm who worked out of the firm’s principal office downtown. Realtor® Z explained that she had seen information regarding Mr. and Mrs. A’s home in the MLS and was interested in the property as an investment. She indicated she was sending an offer to purchase to Realtor® B through the firm’s inter-office mail.

When Realtor® B met with Mr. and Mrs. A to present Realtor® Z’s offer, he carefully explained and presented a written disclosure that Realtor® Z was a member of the same firm although he was not personally acquainted with her. Mr. and Mrs. A, being satisfied with the terms and conditions of the purchase offer, signed it and several weeks later the sale closed and a commission was paid to Realtor® B.

Several weeks later, Realtor® B received a letter from Attorney T, representing Mr. and Mrs. A. Attorney T’s letter indicated that since a member of Realtor® B’s firm had purchased the property, in Attorney T’s opinion, Realtor® B was not entitled to a commission. The letter went on to demand that REALTOR® B refund the commission that had been paid by Mr. and Mrs. A.

Realtor® B politely, but firmly, refused to refund the commission.

Mr. and Mrs. A filed a complaint with the Board of REALTORS® alleging that Realtor® B’s refusal to refund the commission constituted a violation of Article 1 of the Code of Ethics.

Realtor® B, in his response, agreed with the facts as stated in Mr. and Mrs. A’s complaint but indicated that he had faithfully represented the best interests of Mr. and Mrs. A and had no obligation to refund the commission.

The Grievance Committee concluded that the matter should be referred to a Hearing Panel of the Board’s Professional Standards Committee.

At the hearing, Mr. and Mrs. A repeated the facts as set forth in their written complaint and, in response to Realtor® B’s cross-examination, acknowledged that Realtor® Z had not influenced their decision to list the property with Realtor® B or their decision as to the asking price. They also agreed that Realtor® B had carefully disclosed that Realtor® Z was a member of the same firm; and that Realtor® B had represented their best interests throughout the transaction. Their only disagreement with Realtor® B, they stated, was that since their home had been purchased by a member of Realtor® B’s firm, they should not have been obligated to pay a commission and Realtor® B’s refusal to refund the commission violated Article 1.

The Hearing Panel concluded that Realtor® B had promoted Mr. and Mrs. A’s interests; and had carefully disclosed that Realtor® Z was a member of the same firm; and that Realtor® B’s refusal to refund commission did not constitute a violation of Article 1. •

FinCEN Reporting Requirements

The Financial Crimes Enforcement Network (FinCEN) is primarily responsible for safeguarding the financial system of the U.S. FinCEN enforces and oversees laws to combat money laundering, terrorism, and related crimes. This article outlines two reporting requirements, The Currency Transaction Report (CTR) and The Corporate Transparency Act (CTA).

I. THE CURRENCY TRANSACTION REPORT

FinCEN’s Geographic Targeting Order (GTO) extends to incorporate 8 more Florida counties, including our surrounding area of Sarasota and Manatee County. This GTO requires closing companies to file a CTR if all 6 elements apply to the transaction. These elements are: (1) The purchased property is residential. This includes single-family homes, individual condominium units, and cooperatives primarily designed to be occupied by one to four families, (2) The property is located in Miami-Dade, Broward, or Palm Beach County and is purchased on or after October 22, 2023, or is located in Hillsborough, Pasco, Pinellas, Manatee, Sarasota, Charlotte, Lee, and Collier County and is purchased on or after November 21, 2023, (3) The purchase price of the property is $300,000 or greater, (4) The buyer is a legal business entity. For purposes of the CTR, a business entity is a corporation, LLC, similar entity, or foreign entity registered to do business in the U.S. However, a business entity with common stock listed on a securities exchange regulated by the SEC, or a self-regulatory organization that is registered with the SEC, or an entity that is solely owned by such a business is not considered a legal business entity that must complete this report, (5) The property is purchased without a bank loan and without another source of external financing given by a financial institution that is under the duty to sustain an antimoney laundering program and the obligation to report any suspicious transactions under FinCEN regulations, (6) Any portion of the transaction, including the earnest money deposit, is paid for by wire, money order, cash, virtual currency, cashier’s check, traveler’s check, business check or personal check. Therefore, if a transaction meets the criteria outlined above, the closing company must file a CTR within 15 calendar days of the transaction’s completion with FinCEN’s BSA E-Filing System. Failure to oblige may result in both civil and criminal penalties.

II. THE CORPORATE TRANSPARENCY ACT

The CTA is a federal law designed to detect and prevent money laundering and other illegal activities conducted through business entities. The CTA requires reporting companies to submit a report known as the Beneficial Ownership Information Report (BOIR) to FinCEN that discloses each beneficial owner and company applicant. From these reports, an aggregate database will be created to identify and isolate shell companies that have been used to conduct illegal activities.

For purposes of the BOIR, a reporting company is virtually every corporation, limited liability company, limited partnership, and other business entities created/registered in the US, except entities that are already registered with, licensed by, or regulated with a federal government agency. The entities exempt from this requirement can be found in CFR 1010.380(c)(2). Entities in existence before January 1, 2024, have until January 1, 2025, to file the BOIR. Entities formed on January 1, 2024, and after, have 90 days from the date of formation to file this report.

The reporting company must disclose each beneficial owner, that is any individual who owns or controls 25% or more of the ownership interest of the company or any individual who exercises substantial control over the company. The CTA’s definitions of beneficial owner and substantial control can be found in 31 CFR 1010.380(d). The reporting company must also disclose the company applicant, which is the individual who directly files the formation document of a U.S. reporting company or who directly files the registration document in the US for a foreign reporting company.

If the BOIR reporting obligations are violated, the reporting company, its senior officers, and the individual who willfully files a fraudulent BOIR may be subject to both civil and criminal penalties. •

PUTT-PUTT PALOOZA

On May 16, the Young Professionals Network (YPN) hosted their annual Putt-Putt Palooza fundraiser at Evie’s on Bee Ridge. This mini golf tournament was quite a success! Also at the event was a putting

contest and a 50/50 raffle, which helped raise funds at the event. We’re excited to announce that over $3,300 was raised, thanks to RASM members and business partners. 50% of the proceeds benefit SPARCC, a Safe Place and Rape Crisis Center, and the other 50% will benefit the RRCF.

April 2024 Real Estate Market Report: Trends in Sarasota and Manatee Counties

The REALTOR®

Association of Sarasota and Manatee (RASM) today released its monthly market report detailing the real estate trends for April 2024.

The data reveals a significant shift in the market dynamics of both counties, marked by rising inventory levels, extended time on the market, and varying price trends.

KEY TRENDS IN APRIL 2024:

ƒ Inventory Surge: The increase in active listings for both single-family homes and condos suggests a growing supply, which could lead to more competitive pricing and longer times on the market.

ƒ Sales Activity: Despite the higher inventory, closed sales for both single-family homes and condos have risen, indicating sustained buyer interest.

ƒ Market Shift: The substantial increase in the median time to contract and sale times indicates a market shift towards longer selling periods, likely due to the increased inventory and possibly more selective buyers.

Inventory continues to be a topic of discussion in April 2024. In Sarasota County, inventory increased year-over-year by 81.2 percent to 3,305 for singlefamily homes and 91 percent to 2,124 for condos. In Manatee County, inventory increased by 60 percent to 2,450 for single-family homes and 92.4 percent to 1,512 for condos.

“The significant rise in inventory across both counties is a clear indication of a shifting market dynamic. Buyers now have more options to choose from, which is reflected in the extended time properties are staying on the market,” said Tony Barrett, 2024 RASM President and Broker/Owner of Barrett Realty.

In April, the months’ supply of inventory (MSI) for single-family homes decreased from one month ago from 5.3 months to 5.1 months in Sarasota County and

from 4.1 months to 3.9 months in Manatee County. For townhomes and condos, the MSI decreased from 6.8 months to 6.7 months in Sarasota County and from 6.4 months to 6.3 months in Manatee County.

There was a total of 1,496 closed sales for singlefamily homes in Sarasota and Manatee, a 6.2 percent increase from the same time last year. Closed sales for condos increased by 10.6 percent to 707 sales across both counties.

“It’s encouraging to see closed sales increase, even with the higher inventory levels. This indicates that buyers are still actively engaging with the market, taking advantage of the increased options available to them,” added Barrett.

The median time to contract in Sarasota County is 40 days for single-family homes and 48 days for condos, a year-over-year increase of 90.5 percent and 118.2 percent respectively. In Manatee County, the median time to contract increased by 57.1 percent to 44 days for single-family homes and by 63 percent to 44 days for townhomes and condos.

The median sales price for single-family homes in Sarasota County increased year-over-year by 3.8 percent to $540,000 and remained steady at $399,000 for townhomes and condos. In Manatee County, condo prices decreased by 7.5 percent to $352,420, and single-family home prices decreased by 7 percent to $530,000.

Thank you to everyone who attended the RASM YPN Annual Fundraiser of Putt-Putt Palooza! It was a great turnout, and we had so much fun playing mini golf, networking, and raising funds for our local charities.

BENEFITING LOCAL CHARITIES

We’re excited to announce that over $3,300 was raised. 50% of the proceeds will benefit SPARCC, a Safe Place and Rape Crisis Center, and the other 50% will benefit the RRCF, RASM REALTORS® Charitable Foundation. SPARCC is a dedicated organization committed to supporting survivors of domestic violence and sexual assault. We were happy to support their mission, which revolves around providing essential resources, counseling, and shelter to those in need. RRCF is the 501c3 charitable arm of RASM, providing funding for individuals and not-for-profit organizations in the Sarasota and Manatee region that enhance the quality of life in the community.

This mini golf tournament also featured a putting contest and a 50/50 raffle, which helped raise funds at the event. Tony Moore, with Gulfside Mortgage, won the raffle and donated his winnings back to the charities for a total of $642!
