EDITOR'S LETTER

Nearly 15 years ago I was sitting at my desk in Bangrak, Koh Samui, pondering what should I write for the Editors Note on the magazine’s maiden edition. Back then the Real Estate boom was just starting on our islands and I had very little problem selling out the original magazine to all the new agents, developers and related agencies. The magazine went from strength to strength and very soon was lovingly named the Samui Bible of Real Estate. We had entered the market just at the right time and readers appreciated being able to find all the tips and advice on obtaining land and house in Thailand. Basically, if you were interested in real estate on Koh Samui or Koh Phangan then you’d find what you were looking for inside our covers. Very soon the magazine peaked at 328 pages, now that is impressive publishing for anywhere in the world. Now 15 years later the Samui Phangan Real Estate Magazine is still going strong and I’m very happy to say that I am now back in the driving seat as Editor. I’ve been away for a while working on some other projects but it’s a great feeling this morning being back in my seat. It was also 18 years ago that Phil J Brook came to our island and then 14 years ago that he started his Samui Snake and Wildlife Rescue, we feature Phil in our Green Scene and show a little of the great work he has been doing on our island. This edition we take a closer look at Villa Velks in our Developer in View, an absolutely stunning residence with those amazing Samui sea views. We have our Legal team explaining a little about Estate Planning and our expert on Property Finance Stuart M Foulkes picks up that Crypto Currency subject. Think about your space and do not attempt to squeeze a large piece into any nook and cranny. Everything needs breathing space, even the smallest piece.

Be careful not to get carried away and buy everything that catches your eye especially if it is cheap. Best to go for quality over quantity. Just as you carefully chose your furniture apply the same principle to your accessories.

Combine colour and texture. If your room is neutral, think of adding a splash of colour. Hydroponics Nutrients The definition of hydroponics — the growing of plants, using mineral nutrients, without soil. But the real value of nutrients in the hydroponic system is better defined by using the phrase, “using only fully available nutrient minerals.” For example, the highly important element phosphorus may be present in soils, but it is often locked, or “fixed” to soil particles so tightly, that it is often not properly available for absorption by the plant’s root system. In the case of Nitrogen (N), if microbial colonies that are required to convert organic forms of nitrogen to plant available inorganic forms are absent or limited in size, the availability, type and concentration of this important element can be limited. In hydroponic systems, growers can control not only the type and concentration of nutrients but also their availability. Nutrients are added directly to the plant root system. This results in significant energy savings since the plant does not have to use its energy to support photosynthesis and other reactions and processes required to build extensive root systems required by plants grown in soils. This energy savings often results in improved whole plant growth, development and yield compared to soil grown systems. Root systems of hydroponic plants are also routinely healthier and more efficient and root systems of plants grown in soils.

Organic Hydroponics There is a long-standing debate as to whether soilless hydroponic systems can ever be completely organic. For the most part, this debate is the result of disputed ideas about what organics really means. Even in the commercial horticultural world, things are not clear-cut when it comes to what is and what isn’t considered organic. Traditional hydroponic nutrients are made from fertilizers such as calcium nitrate, potassium nitrate, monopotassium phosphate, iron chelate and many others that, when dissolved into water, dissociate into ions ready for immediate uptake by plants. This is what allows for such rapid and balanced plant growth.

While the reasoning behind whether hydroponics is organic is still under debate, hobby growers need not bother with the large-scale logic. Instead, they should decide what organics means to them and follow techniques to fulfil their own ideas. For some growers, producing organic and natural crops from an indoor garden simply means avoiding the use of toxic chemicals such as synthetic pesticides, fungicides and sterilization agents. These types of growers choose to focus more on natural approaches while fully embracing hydroponic methods. For others, growing organically means incorporating the use of organic nutrients combined with beneficial microbial populations like the methods used by soil-based organic producers. Unfortunately, it’s not just a simple case of switching from traditional, fertilizersalt-based nutrients to organic ones since many early hydroponic systems were never designed to be used with organic compounds and many growers have run into huge problems and ruining crops when trying this. Replacing highly effective and carefully calculated fertilizer salts with organic nutrient sources is not easy. Manufacturers of hydroponic fertilizer products go to great lengths to get the ideal parts per million of each nutrient ion in their products, so plants grow as fast and balanced as possible. With organic nutrient sources, it’s impossible to be so precise, so mineral deficiencies within organic hydroponic systems are often an issue. Also, organic nutrients contain a great deal of carbon, which non-organic nutrient products do not provide. This carbon is an ideal source of food for microbes in the nutrient solution and root zone, feeding both beneficial and pathogenic fungi and bacteria. If unwanted microbes begin feeding on the carbon from organic nutrient sources, things can get a little toxic, creating slimy nutrient solutions, anaerobic root conditions, diseases and even plant die back. To avoid these problems, organic growers just starting out should begin slowly and with systems known to have a better success rate.

There are a few different approaches to obtaining and using organic nutrient sources in a hydroponic system. It can be difficult to get a balanced and suitably high ratio of all the essential minerals from organic sources alone, so experimentation with different products is helpful. There is a range of liquid organic nutrient concentrates on the market, as well as some fertilizer salts that are considered organic and naturally occurring to help boost growth where required. The plants never must starve or wait for nutrient ions to become available. However, calcium nitrate and many others used in traditional hydroponic systems are not considered organic, but synthetic or manmade, and are not part of an organic system. Generally, sulphate trace elements, such as iron sulphate, copper sulphate, zinc sulphate, manganese sulphate and magnesium sulphate (Epsom salt), are allowed under organic production, so these can be used to help round out any deficiencies that may occur with organic nutrients. An organic base product (often a concentrated fish emulsion base or similar) blended with an organic liquid calcium is a good place to start. An organic nitrogen product may be required later on. Growers should aim to use products that have been designed for soilless systems wherever possible. The main difficulty with running organic systems is obtaining sufficient amounts of nitrogen and calcium, which are required in large amounts by plants. Organic systems rely on microbes in the root zone to convert organic compounds into plant-available nitrogen sources and sometimes this process does not occur fast enough for uptake. Calcium is difficult to obtain rapidly from organic nutrients as it relies on the breaking down of calcium-containing materials such as limestone. Growers who have hard water sources containing naturally occurring calcium have a major advantage in this case because this form of calcium is readily available for plant uptake. It is possible to make an organic nutrient solution completely from raw materials rather than relying on commercially bottled products. While liquid bio-digesters that turn raw organic materials into usable plant nutrients have been used by some growers, the more reliable method for smaller systems is vermiculture (worm farming). Vermiculture is a highly efficient way of processing high-mineral raw materials, such as manures, limestone, blood and bone, fish meal, seaweed meal, guano and others, into usable, mineralized hydroponic nutrient solutions that also provide the benefits of a diverse population of beneficial microbes. The successful use of vermiculture to process organic fertilizers relies on two things. First, the vermicast must be processed to completion and then extracted into water for use in a hydroponic system. The extract or liquid draining from the vermicast system should not be used as a nutrient solution until the vermicast itself has been fully processed. Many worm juices on the market are highly diluted and often not balanced enough to use as a stand-alone nutrient solution. Second, the quality of the raw materials going into the vermicast system will determine how balanced the final nutrient will be. High-mineral sources, such as fish, blood and bone meal are often dried and ground into products, while food scraps, weeds

and vegetation contain only low levels of minerals and will not make a nutrient solution concentrated enough for most hydroponic systems. One of the main problems with organic nutrients is concentration. Most organic liquid products are not as concentrated as standard, salt-based fertilizer formulations, so plants may become weak, stretched and more prone to disease. Growers need to be aware of what underfed plants look like and boost nutrient concentrations as soon as these conditions are detected. Nutrient additives and boosters, such as humic and fulvic acid, are a good addition to organic systems as they help facilitate nutrient uptake and are generally considered organic.

EC and pH Levels Electrical conductivity (EC) and pH control is also different in organic hydroponic systems. Many organic nutrients don’t conduct electricity, so EC readings may not be a true indication of the concentration of an organic solution. A garden’s pH levels also tend to run higher in a healthy, organic system than many growers are used to maintaining in standard hydroponics. Since pH-lowering acids commonly used in hydroponics such as nitric and phosphoric acids are not organic, pH is best left to stabilize on its own. Some organic nutrient products naturally have a high pH, so growers should try to select those that have a more suitable pH range for use in soilless systems.

Estate Planning for Second Home Owners in Koh Samui and Koh Phangnan

Many foreign residents may have already have put their affairs in order “back home” by making a will in relation to assets in their home country before re-locating to paradise, however, a surprising number of foreign residents neglect to declare a will in relation to their assets located in Thailand; often wrongly assuming that the will in their home country will automatically cover their assets in Thailand. The existence of a will can help to ensure that the assets of the deceased are distributed in accordance with their wishes and avoid leaving the surviving relatives with the burden of lengthy, expensive and costly court proceedings on the other side of the world. This article examines wills in Thailand and how they can assist foreign residents in estate planning. The first issue to be determined by a person seeking to make a will is what (national) laws govern the transfer of the individual’s assets in the event of death. The answer depends upon the nature of the assets which form the estate. The devolution of immoveable property such as condominiums and villas is governed by the laws of the country in which the immoveable property is located. Conversely, the transfer of movable property such as jewellery and furniture is governed by the laws of the country in

which the deceased was domiciled at the time of death. It is important to recognise that if an individual owns an interest in real estate through ownership of shares in a limited company, the asset which will form the subject matter of the will are the shares in the limited company and not the real estate assets themselves. Shares in limited companies are deemed to be moveable property and not immoveable property. A Thai will is strongly recommended if an interest in property and buildings located in Thailand form part of the estate. A Thai will relating to moveable property is also prudent estate planning, particularly if the moveable property in question is shares in a limited company which owns an interest in real estate. Investors who have acquired an interest in real estate in Thailand through the acquisition of shares in an offshore company such as a British Virgin Island Business Corporation (BVI) should consider a will to be drafted in accordance with the laws of the jurisdiction in which the offshore corporation is legally registered. Therefore it is advisable to consult a lawyer from the jurisdiction in which offshore company is registered to prepare the will.


A Thai will must meet a number of specific requirements set out in the Civil and Commercial Code of Thailand for the will to be valid. Thai law sets out three general categories of valid wills, as follows: (1) A will made by way of a declaration to a public official in the presence of at least two witnesses; (2) A fully handwritten will signed and dated by the individual declaring the will; or (3) A written will signed and dated by the person declaring the will in the presence of at least two witnesses; It is important for investors with a leasehold interest in property to be aware that a lease agreement is generally terminated upon the death of the leaseholder and any unexpired term of the lease may not transfer to the heirs of the leaseholder unless there is a suitable succession clause contained in the lease agreement allowing the succession of the leasehold right to the heirs. The terms of the will should be comprehensive and should cover all of the person’s assets to ensure that the person is not partially intestate at the time of death. It is important that a “second” will covering assets in Thailand does not conflict with or revoke the terms of the “main” will in the person’s home jurisdiction. The will should be updated intermittently as the assets forming the subject matter of the will change over time. If there is no Thai will, the assets of the deceased must be distributed to the “Statutory Heirs” in accordance with Article 1629 of the Civil and Commercial Code. The surviving spouse of the deceased is entitled to half of the estate, thereafter the assets are distributed to six classes of statutory heir in the following order of priority (1) descendents; (2) parents; (3) brothers and sisters of full blood; (4) brothers and sisters of half blood; (56) grandmothers and grandfathers; (6) uncles and aunts. If there are no living relatives, and no Thai will the estate will succeed to the state. It is important for retirees and other foreign residents to consider estate planning issues and make provision for the succession of their assets in the event of death. A professionally prepared, valid and enforceable will can provide retirees and foreign residents with assurance that their affairs are in order and that their loved ones will not be unnecessarily burdened with stressful and lengthy court proceedings and costs in the event of death. Bitcoin is Back?

Mortgage Finance to Invest Crypto?… Back in August 2017, we published in our Samui Phangan Magazine, a first article on Bitcoin (BTC) investments using Thai property & condominium as collateral, to raise mortgage finance equity release and then, invest those Baht cash proceeds into Bitcoin along with various other crypto currencies including Ethereum (ETH). The prices referenced back than were $2,331 (BTC) & $199 (ETH). If you were one of several who acted on that article and successfully sold those Crypto investments at the all-time highs, congratulations, almost $20,000 for BTC and over $1,300 for ETH was not a bad profit. What then followed around 19th December 2017 is what we now look back on as the start of the bear market and long crypto winter! Winter was coming…… and it did so in style! The crypto bear market went all the way down to around $3,100 BTC & $81 ETH reaching lowest levels around 15th December 2018. Almost 1 year since the peak in 2017. Moving forward and as 2019 began, many Twitter crypto enthusiasts started to call this the longest bear market in the history of BTC, with many calling for further lows and “shorting” the market was a common thing.

Logarithmic MACD scale, one might tend to lean into positive sentiment going forward as per one of @Davthewave’s charts below. Assuming MACD indicators rise as they have in the past, one might expect the price to increase also.

Another popular Twitter handle (@100trillionUSD) regularly updates with reference to the next Bitcoin halving event ** which will take place estimated around May 2020. The account which goes by the name PlanB, uses previous block reward events & stock-to-flow models to estimate the next jump in BTC price.

It is now 7th May 2019 (time of writing) and current prices according to the popular crypto index site CoinMarketcap, stand at $5,924 for BTC and $176 for ETH. The “hopium” on social media is increasing and market sentiment is becoming positive. Does this mean we are now in the start of a new bull market and will we reach new ATH’s? Nobody really knows the answer to future investment growth projections of the crypto market, unless of course you are John McAfee, who famously put his manhood on the line saying BTC will reach $1,000,000 by the end of 2020 or else... We can however research various indicators and analysis to come up with best “guesses” and forecasts. One popular Twitter handle (@ davthewave /ChristopherColumbus on Trading View) suggested it might technically, not have been a bear market to begin with and was merely a minor correction to a longer term bull market *. Using the

A BTC Halving event is where the number of generated BTC rewards per block will be halved (divided by 2). The number of BTC found per block thus, will become scarcer and this halving reward ensures that BTC total supply will reach 21 million. On the basis that around May 2020, it is estimated there is a new block reward halving for Bitcoin, it might therefore be a good time to look up a reference to ”supply and demand” and how it might affect prices.


Whilst 2018 will definitely go down as a tough Bear Market with many coins gaining some decent cliff diving experience with regard price, some real infrastructure and product developments went the opposite way. For those who believe a future will consist of Crypto as part of daily life, short term (1 year) price fluctuations are only minor details, the long term (5 Years +) real & practical use cases take precedence. SNAKE IN THE HOUSE Enter Phil the Snakeman

Samui Snake and Wildlife Rescue Snakes are legless, carnivorous reptiles. Evolution has made them formidable hunters, slithering their way through various terrain, agilely scaling their way up trees or even gracefully diving the depths of the ocean; these reptiles have certainly mastered the art of motion, sans limbs. But sadly, due to ignorance and lack of information, snakes create much fear amongst the general population, sadly this is extremely prevalent in Thailand where wrongly all snakes are seen as poisonous and dangerous. Brainwashed, many of us would surely get struck by fear just by the sight of a snake, especially if this is in the normal safety of our own homes. Their unblinking eyes, persistently flickering forked tongue, long limbless body and their fluidic slither may leave some of us awestruck and fascinated, whereas the many are drenched in cold sweat. No other animal could invoke such deep emotions of revere and fear, the way snakes do! 24-hour removal and relocation of snakes and wildlife 18 years ago, Phil originally from Stoke on Trent came to Samui and it was 14 years ago that he took the plunge and started his Snake and Wildlife Rescue Centre. He very soon realized that most of the community had no understanding of which snakes were dangerous but preferred to tarnish all with the same brush and sadly this would mean death for the snake. It is here especially in Asian that the general public needs to be educated that most snakes are not dangerous. Rather snakes play a major role in the

eco system. They render an excellent pest control services by controlling the rodent population. Rats not only spread diseases like leptospirosis but also consume a substantial amount of rice grains that the Thai’s are storing for daily consumption. Hence, they help us by plugging the revenue leakage caused due to crop destruction. They are super biological pest controllers that we have. Also, by feeding on other animals like amphibians, birds and reptiles, snakes play a role in maintaining the balance of an eco-system. Phil runs his Samui Snake and Wildlife Rescue Centre from home. All wildlife rescued is released, none being kept at his home. All are released back to the wild unless too badly injured or a captive abused animal then they go to his official sponsors the Wildlife Friends Foundation in Tha Yang, Phetchaburi wildlife sanctuary run by Dutch activist Edwin Wiek. These are Phil’s official sponsors, giving much of assistance out of Petchaburi. Phil’s Rescue centre is entirely funded by donations, kept busy with snake and wildlife rescues almost each and every day, Phil has “no time for a day job” Just a brief look on his webpage or especially the WFFT.ORG shows how important Phil’s service is. This is the twelfth dam to be completed following the launch of this initiative in January 2014. “OZO for H²O by OZO Chaweng Samui” is one of OZO’s CSR projects which aims to conserve Samui’s water resources by constructing and maintaining check dams. The check dam enables water collection during rainfall, to help regulate water flow, increase the level of underground water and reduce soil erosion to benefit the local community.

Cigar smoking has seen a renaissance over the past decade or so. While smoking in general has declined sharply in most countries, cigars have seen something of a revival. Tobacconists, which had become relics of our grandparents’ time suddenly came back to life as luxurious temples of “the finer things in life”.

In an age of sometimes religious anti-smoking sentiment, how is it that cigar smoking is defying the trend and is able to transition from its grandfatherly image and gaining more popularity than ever before, appealing to a young, hip and successful crowd?

Fast-forward to 2019, and you’ll see that not only are the old, local tobacconists alive, but they are thriving. They may not see a crowd like, say, a magazine store, but there will be a lively crowd of people from all walks of life: grandfathers in their 70s, blue-collar workers in

exchanging tips on what to try out next. And this scene is being played out in New York, Miami, Paris, London – and now also in Bangkok. Until a decade ago, Bangkok didn’t really have dedicated cigar bars. Instead, you would have had to navigate through the business travellers and wealthy tourists cluttering the lobby of the Mandarin Oriental or a handful of similar hotels where mere mortals hardly dare enter. And the meagre cigar selection would have been relegated to a little shop in a remote corner of the hotel; now, you will find a brightly lit and inviting cigar shop with a nice selection and knowledgeable staff. Today, any up-scale hotel in Bangkok worth its salt sports a decent cigar selection at its outdoor cocktail bar, and about a dozen dedicated cigar bars have entered the arena in the past couple of years. Cohiba Atmosphere on Ruam­rudee (with a little independent cigar shop almost directly opposite), Whisgars on Sukhumvit 23 (don’t let the taxi driver drop you off in front of soi Cowboy - the finer things in life wait a little further down the soi), Duke in the Gaysorn building, Cigar One on Wireless Road, Black Amber Society on Thonglor, Character at the Compass Skyview Hotel and still more are joining the scene. Cigars have become part of an epicurean lifestyle, much like fine wine, single malts, craft beer and exclusive coffee. And unlike cigarette smoking, it doesn’t have quite the same negative health impact. But, as with any other vice, everything is to be enjoyed in moderation, whether it is food, spirits or cigars. Besides, Wagyu steaks taste better when you don’t eat them every day but instead save them for special occasions – and the same goes for cigars. Going into a cigar bar can be rather daunting for the cigar virgin, so in the coming months we will give you a bunch of tips and tricks – sort of a “Cigars-101” – so that you will be well-equipped with knowledge about cigar producing countries, tobaccos, sizes, colours, tastes and so on, before you embark on this exciting hobby. LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain

RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.

SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.

SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.

LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)

STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area.

STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey

building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.

STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.

STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.

In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
