EDITOR'S LETTER Welcome to the October November edition number 88 of the Samui Phangan Real Estate Magazine. It’s been one of those amazing tropical rainy mornings on Koh Samui. Arriving at the office I’d missed the earlier deluge and watched from my desk as the skies opened. Half an hour of typical torrential rain then Samui showed us her better side and within another half an hour everything was dry and the sun was shining. With only a few scattered sand mounds on the road the wet evidence was swiftly disappearing in the suns warmth. It’s one of those things I just love about Samui, no matter how hard the storm, once it has stopped it doesn’t take long for the blue sky to put everything right again. Now the air was fresh and invigorating, it was a good start to a beautiful tropical day on Koh Samui. This edition in our “Developer in View” we take a closer look at Villa 55 in the Bophut Hills, this stunning very modern villa has 5 bedrooms and although offering amazing Hollywood views it is only a few minutes away from all the vibrant life in Bophut Fisherman’s Village and the islands attractions. With its bright colours, rich ornamentation and sweeping, multi-tiered roofs, the temple and palace architecture of Thailand is immediately identifiable. Blending influences from Indian, Khmer, Burmese and Chinese architectural styles, but has evolved to become a distinct expression of Thai culture. No visit to the country is complete without admiring the Grand Palace and Wat Phra Kaew or wandering around the ancient ruins of the former Siam capitals of Ayutthaya and Sukhothai. Each exhibits the historical evolution of Thai architecture and its contemporary incarnations today.

The History of Thai Architecture Thai Architecture

When the Sukhothai Kingdom was established by King Indraditya in 1780, its buildings were designed in shapes that were symbolically Buddhist. This continued to evolve throughout the Ayutthaya Period, with architecture regarded as one of its peak achievements and a graceful expression of Siam’s power and culture. The temple compound ruins which are visible in Ayutthaya today usually include a bot (ordination hall), a viharn (sermon hall) and a dome-shaped chedi where holy relics were housed. In temples exhibiting a Khmer influence, the chedi was replaced by an elongated prang, as seen in that of Wat Arun in Bangkok. Other structures in the temple complex included open-sided sala pavilions and quarters where monks resided. Temple columns were often shaped at the ends into lotus buds which symbolized the purity of Buddha’s thoughts, while eight stones were laid around the bot to keep away evil spirits. Roof peaks were often adorned with a curling, pointed extension known as a chofa and symbolic of the Garuda, a legendary bird which served as Vishnu’s vehicle and appears in both Buddhist and Hindu mythology. Thai palaces also included many of these same symbolic motifs, as seen in Bangkok’s Grand Palace. This complex, however, was built by successive royals over a 200-year period and although it retains some traditional elements, it also exhibits eclectic, western styles favoured by each ruler. It was originally laid out in the same manner as the Royal Palace it replaced in Ayutthaya, divided into a series of courts, walls, gates and forts. Wat Phra Kaew or the “Temple of the Emerald Buddha” is one of its more traditional buildings, designed in the late 18th century in accordance with ancient traditions which date back to the establishment of the royal chapel of Wat Mahathat in Sukhothai. In contrast is the building of Phra Thinang Chakri Maha Prasat which illustrates 19th-century European styles which reflect the preference of King Rama V and the foreign architects he employed in its construction. Other buildings in Thailand with distinctly European influences include the teak-built Vimanmek Mansion in Bangkok’s Dusit district, as well as the Italianate palace of Bang Pa-In which was built by King Chulalongkorn. Sino-Portuguese style shop houses also became popular in the 19th century throughout Thailand, with a ground floor shopfront and a second-floor living area. These narrow, two-story buildings were linked in rows and can still be seen at Thanon Thalang in Phuket and along the Chao Phraya River in Bangkok.

Thai architecture also exhibits distinct regional differences, with the northeast of the country once part of the Khmer empire. As a result, the temples of Prasat Hin Khao Phanom Rung and Prasat Khao Phra Viharn both display strong Khmer architectural elements. Others across the north have distinct Burmese influences, having been built during the occupation of what was then the Kingdom of Lanna.

Secular Thai Architecture Thai Architecture Aside from its religious architecture, Thailand is noted for its traditional houses on stilts, with many built alongside rivers and canals which are prone to flooding during the rainy season. The area beneath the house is often used for storage, to keep animals such as chickens or ducks and for relaxing during the day, while the upper level is for sleeping. Both wood and bamboo are popular materials for the construction of stilt houses and they are often built simply using prefabricated wooden panels. Superstition plays an important role in the design of traditional Thai house construction, with taboos against rearranging a house once it has been built and about which plants can be placed on and around the terrace. Tradition also states that in sleeping areas the head does not point towards the west as that is the position bodies are placed prior to cremation. Traditional Thai houses are built in accordance with three ancient principles: “material preparation, construction and dwelling”. “Material preparation” refers to the trees used in the house’s construction, the soil on which it is built and how the site is prepared, while the “construction” must be done mindfully. Rituals are performed when the first column is placed in the ground at a carefully calculated time and a guardian spirit house should be constructed to keep out evil. “Dwelling” refers to the proper behavior of the occupants once inside the completed house, with it necessary to follow certain beliefs and practices in relation to the spiritual world. While these rules are being adhered to less and less in modern times, many Thais still believe in the idea of making domestic dwellings sacred and some of these rituals are being altered to suit modern lifestyles and beliefs.

When arriving into the city of Bangkok today, it’s immediately apparent that Thailand has also embraced modern architectural styles. Soaring skyscrapers, large-scale shopping malls and cutting-edge designs make up the capital’s cityscape, with many of the buildings constructed during the building boom of the 1980s and 1990s. Silom’s MahaNakhon towers to 314 meters as the city’s tallest building, while the socalled “Elephant Building” in Chatuchak has been identified as one of the 20 most iconic skyscrapers in the world in its resemblance to Thailand’s national animal. The 90-story Baiyoke Tower II is also of note, with a revolving observation deck on its 84th floor where you can take in 360-degree views across this incredible urban landscape. Despite the move towards modernization, there is also a renewed interest in the preservation of historic architecture and residences in Thailand, with some being lovingly restored into boutique hotels and museums. Cities such as Bangkok are therefore a fascinating mix of the old and new, showing influences from modern trends and technology, as well as captivating examples of Thai architectural traditions.

Sleep, perchance to dream You are going to spend a lot of time in the bedroom whether sleeping or relaxing so comfort comes before all else. That requires one thing, a comfortable bed, meaning mattress. If you are starting from scratch and on a budget spend 60% of your budget on your bed, after all, it will be the centerpiece of your bedroom and where you will spend most of your time.

This is important, so I will mention it now, decide where in the room your bed will go. If your bedroom is small you may not have a choice. Choose the widest wall as you will need side tables and make sure you have wall sockets for table lamps. Look where the light falls from your bedroom window and place your bed to the side so the light falls across the bed. If you have a fabulous view you might want to face the bed looking out. Bed linen for comfort and covers with accent colours. Texture can also play a roll. If you choose a neutral scheme a textured cover can add depth and warmth and be restful on the eyes. Cushions on the bed are an easy way to add comfort and colour to a bedroom. There are so many ways to add colour to your bedroom. Paint is the easiest. Plan your colour scheme in advance. If you have a headboard on your bed keep the walls one colour. If you do not have a headboard then you could paint the lower section of the wall a different colour that will contrast with your wall colour. Your walls will be the main colour so unless you want a statement colour choose neutral tones then you are free to splash colour elsewhere. Avoid cold floors such as marble. Wooden floors are ideal or fully carpeted. You will want to be barefoot in the bedroom for warmth and comfort. Add rugs to wooden floors and position them at the foot of the bed or if they are particularly large, partially place them under the bed. Lighting will be important, especially at night. Good reading lights are essential so make sure side table lights have the required illumination unless you are reading off a backlit tablet then they need not be bright. Use stand alone floor lamps which you can move around as needed to add depth and interest. If your bedroom is large introduce some furniture such as an accent chair in silk or velvet if you are going for a luxe boudoir look. In a large bedroom you may want a writing desk and chair but try and avoid turning your bedroom into an office during the day unless your bedroom can take it and you have nowhere else in your home to work. If you have the budget, go for flowing curtains in silk or voile to give a really light and airy feel to your bedroom. Sadly, there is no such thing as cheap curtains. Try looking for curtain fabric in an outlet where you will find end-of-line and prices to match.

Summer Fun Sometimes something simple can be a load of fun. Tired of the rusty iron BBQ, how about building your own super cool pit BBQ. Easy to create and great fun in your garden, your garden parties will never be the same. Making a Simple Budget Shallow Pit Barbecue 1. Luckily for this simple Barbecue pit option, you need hardly any tools. But before you start, be sure to have found a shovel, some bricks or optional mortar, a grill, a spirit level, and something that you can use to cover the pit when you are not using it. You can also use some gravel, sand, paving slabs or excess bricks. 2. Dig a hole the depth of one brick turned vertically. The first step to making a basic Barbecue pit is digging a hole (not larger than you can cover with your grill) at an appropriate and safe place in your backyard. A basic pit could be the depth of one brick turned vertically. You can make it bigger or smaller depending on your requirements, and you can use it as a smoker too, you’ll find a rectangle or square is the easiest BBQ shape to create.

3. Use bricks to secure the sides. Once you have the hole, knock in the bricks around the edges to give it a solid structure. It’s best to use some mortar to fix it in place and be sure that the bricks will not become dislodged and fall into the hole. You could even make a pit without putting bricks along the sides, but this is a good idea to make it more secure and lasting. 4. Check it is level. Lay a spirit level over the top of the pit to check that it is level. If it is too large for your spirit level, you can place a longer plank of wood over it the hole and put the spirit level on top of that. Try laying your grill over the top of the pit to check that it sits on it nicely and does not slide off to one side. 5. Use slabs and gravel for optional extra touches. You can place some slabs around the edges of the pit on the grass to give you an area to place your grill and clearly demarcate the area where the Barbecue is. This is an excellent way to make it more of a feature, and you can be creative with how you lay out it. The fire shouldn’t touch any grass, you should clear away the grass from the edges of the pit for safety fire reasons. You can also spread some gravel, or sand in the base of the pit to so you are not burning wood directly on the soil 6. Set up the grill. The grill iron is now ready to be added to your project. Now that you have your formation set up, you can lay your grill across the hole. You can add some bricks or cinder blocks around the edges to hold it in place more securely.

Re-sale Transactions

Issues for Buyers who Acquire a Re-sale Property from a Private Seller in Koh Samui or Koh Phangnan As the property market in Koh Samui and Koh Phangnan matures, more and more properties are being offered for sale by private owners who have perhaps owned a villa or apartment for a number of years and are now seeking to re-sell their property and either move up the property ladder or cash out. A number of projects have been so well received by the market that units have changed hands multiple times over a short period of time generating a profit for each successive re-seller. Such successful projects usually have unique characteristics such as location, location, location; or direct beach access, factors which cannot easily be re-created by future developers in secondary locations further from the coast. Consequently, many buyers find their ideal second home on the re-sale market. The following article looks at the key aspects of re-sale transactions and examines the key issues that buyers should consider when purchasing a property from a private seller, as opposed to a developer in Koh Samui or Koh Phangnan. Prospective buyers of re-sale properties must be aware that foreign persons are prohibited from owning freehold land in Thailand. Consequently, if the seller is a Thai national, a foreign buyer may not have the right to purchase and own the target property is the same manner as the seller. It is important, therefore, for prospective buyers to undertake comprehensive research and understand their rights and the restrictions or limitations which may apply to them in respect to the acquisition, ownership and future re-sale of real estate. A foreign national can lease land or an apartment (for a maximum term of 30 years); or can own a condominium unit providing that not more than 49% of the habitable area of the condominium building are owned by foreigners.

It is imperative that a prospective buyer does not simply rely upon the representations made by the seller with regards to the target property. Buyers should beware that they buy at their own risk and should therefore undertake detailed and independent investigations into all aspects of the property prior to paying any portion of the purchase price to the seller. The scope of such investigations will depend upon the precise nature of the property but all investigations should include: A title investigation to establish that the Seller is the legal owner of the property and that the title to the property has been legally issued in accordance with the laws of Thailand and has full legal rights of access; An investigation to establish whether or not the property has been built in accordance with local building and environmental regulations; A structural survey to ensure the structural integrity of the property and to ascertain whether or not any major repairs are required; The physical testing of the facilities at the property such as the swimming pool pump and filter and air conditioning units to ensure that they are in full working order. Any defects, inconsistencies or concerns which are revealed by such investigations should be put to the seller in writing and the seller should provide further written information or documentation to satisfy the concerns of the prospective buyer. Where appropriate, such information and documentation should be independently verified. It may be appropriate in certain circumstances for the seller to provide contractual assurances with regards to certain matters or offer a reduction in the purchase price to reflect the cost of corrective actions to be undertaken at the cost of the buyer after acquiring the property. A prospective buyer may discover that the seller does not own the interest in the property in their own name but through the ownership of shares in a limited company which owns an interest in the property. Such transactions will involve the sale of the shares in the company to the buyer thereby transferring control of the property through ownership of shares. In share transactions, in addition to the above investigations, the buyer should also carry out detailed investigations into the company to ensure (amongst other matters) that the company is correctly formed and validly exists, has paid its taxes, has no outstanding liabilities and is the legal owner of the interest in property. In circumstances which involve the sale of shares in a limited Thai company by a foreign buyer, enquiries must be undertaken to ensure that the company will comply with Thai laws once the foreign buyer has acquired his/her shares. Foreign buyers must be aware that Thai law prohibits the control of freehold land by foreign individuals and foreign companies and restricts the number of shares in a limited Thai Company which can be legally owned by foreigners. The seller and buyer should negotiate a detailed sale and purchase agreement with regards to the sale of the property, or Share Transfer Agreement if the transaction relates to the sale of shares, setting out the respective obligations of the parties. The sale and purchase agreement should set out clearly the main terms of the agreement between the seller and buyer including the purchase price, payment terms, completion date and the consequences of a breach of the agreement by either party. Any specific terms and conditions agreed verbally between the seller and buyer, should be clearly set out in the sale and purchase agreement with clear consequences for failure to comply with the obligations. This article sets out some of the main issues which should be consider by prospective buyers who are seeking to acquire a re-sale property in Koh Samui of Koh Phangnan. Altcoin Cryptocurrency Investments Satoshi Nakamoto’s cryptocurrency invention Bitcoin, throughout 2018 has been going on a run. Starting this year January 1st around USD 3,700 for 1 whole coin, it made steady growth against fiat currencies (USD, GBP, AUD etc.) to a point where is now sitting at around USD 10,200. A respectable 275% up, from the beginning of year or, around 30% a month! Whilst trading against fiat currencies an investor would have made sizeable profit margins of which are hard to find in any other asset class worldwide, on the other hand, if one was trading in the Altcoin market to try and make Bitcoin gains, one might not have been, so fortunate. To put things into perspective, at the start of the 2019, Bitcoin Dominance, which is a measure of how the total crypto market cap of all coins is measured, Bitcoin was at around 54%. It grew steadily to just over 73% and is now sitting at 69%. This means 69% of the total market is presently in Bitcoin. The lowest point of Bitcoin Dominance ever, was actually a year before when dipped down to just over 35% in January 2018, which meant 65% of the crypto market were in Altcoins. The last time Bitcoin was at this area of dominance level was mid 2017 just before the final run that year where Bitcoin hit new all-time highs against fiat followed by the Altcoin markets going into the well phrased Alt-Season. Alt-Season in essence, loosely meaning that you could purchase any old Altcoin paired against Bitcoin and make massive gains, everything generally “mooned” both in dollar value and Bitcoin value.

Looking at the Bitcoin Dominance chart, one could make a case that the leading cryptocurrency has been following a parabola growth curve since January 2018 and now, has just dropped down out of the curve which may possibly indicate a drop in dominance imminent. What a drop in dominance means is that people are selling Bitcoin for something else and in this case, it could mean Altcoins which means every other cryptocurrency other, than Bitcoin. IF people start selling Bitcoin for Altcoins the total market cap for Altcoins would therefore increase along with the pair against Bitcoin which means one can increase the amount of Bitcoin one has, by trading into an Altcoin and selling back to Bitcoin in the future. Let’s take for example the 3rd most popular Altcoin by market cap XRP, or otherwise known as Ripple. It is stated to be “An independent digital asset that is native to the Ripple Consensus Ledger. With proven governance and the fastest transaction confirmation of its kind, XRP is said to be the most efficient settlement option for financial institutions and liquidity providers seeking global reach, accessibility and fast settlement finality for interbank flows.” In essence, they want big money financial institutions & banks using it and could be deemed they are making decent progress. If for example one used Bitcoin to purchase XRP January 1st 2019, one would have paid around 9479 Satoshi’s (a division of Bitcoin) for it. Today, one would pay only 2900 Satoshi’s which is at around 70% discount to the January price! In other words, as an Altcoin trader, during 2018 one would have lost 70%


of their Bitcoin value by selling to buy XRP at the start of this year. IF one assumes logically that IF Bitcoin dominance declines OR IF we follow a similar path to 2017 when Bitcoin was last at these Dominance levels, selling Bitcoin for Altcoins may now start to increase which in theory means selling Bitcoin now for an Altcoin might mean, you could increase the amount of Bitcoin value you could possibly have. i.e. Buy XRP now and if it goes back up to where it was at the start of the year, one would more than triple, the amount of Bitcoin one can have (assuming remember to sell to Bitcoin when it happens of course without, “wanting more”). There is of course no crystal ball with investments and certainly, investments can easily go down, just as much as they can go up. Imagine selling Bitcoin today to purchase XRP & than in 12 months’ time, XRP continues to go down another 70%.....or more! The chart for XRP against Bitcoin may however seem attractive for gains in Bitcoin…IF looking at the popular and largely used trading MACD indicator, which just started to turn up.

Aside from XRP, there are multiple Altcoins all with similar charts lately which may suggest possible good entry points to sell Bitcoin and hope for possible Bitcoin gains. There are many useful tools and charting websites to keep track of favourite Altcoins and sometimes in order to boost confidence in your own decision making process, it is worth to “paper trade” initially, which means simply writing down what you think will happen and watching from the sidelines to see if it does happen. This way one doesn’t actually use any hard earned fiat or crypto to invest and rather first, checks to see if their thoughts play out as anticipated! It is also worth to consider whether you would like to be an “investor” or a “trader”. Investors can purchase in at

a price and leave for longer term. i.e. 1-5 years or more. Short term price fluctuations or drops are irrelevant since one prefers to average into an investment at relatively low costs when comparing against todays charts. A trader on the other hand generally wishes to buy and sell more frequently even down to just minutes and will often sell at small losses if feels could make greater gains on another breakout chart and present losses could easily be recouped. To summarise if, or when, “Alt-season” does happen, if we see similar returns to what we have seen in the past, 10x,20x or even 30x and more, are not uncommon returns on a Bitcoin paired Altcoin investment. Bitcoin offers a global alternative to traditional banking and outdated financial systems. An industry has grown out of the Crypto markets and for just small “investments/ acorns”, a tree could grow or in some cases, a national reserve forest! Passive cooling To be the least bit usable and comfortable every house or office in Samui will need some sort of cooling for as good as the whole year. This comes in one form, large unsightly and expensive to run air conditioners. But with a little thought on the design you can build or modify your building to achieve comfort through passive (nonmechanical) cooling. As well as improving the quality of life inside it will make a large difference with your utility bill. Air movement Air movement is the most important element of passive cooling. It cools people by increasing evaporation and requires both breeze capture and fans for back-up in still conditions. It also cools buildings by carrying heat out of the building as warmed air and replacing it with cooler external air. Moving air also carries heat to mechanical cooling systems where it is removed by heat pumps and recirculated. This requires well-designed openings (windows, doors and vents) and unrestricted breeze paths. Cool breezes Where the climate provides cooling breezes, maximising their flow through a home when cooling is required is an essential component of passive design. Unlike cool night air, these breezes tend to occur in the late afternoon or early evening when cooling requirements usually peak. Coastal breezes are usually from an onshore direction. In mountainous or hilly areas, cool breezes often flow down slopes and valleys in late evening and early morning, as

heat radiating to clear night skies cools the land mass and creates cool air currents. Evaporative cooling As water evaporates it draws large amounts of heat from surrounding air. Evaporation is therefore an effective passive cooling method. Pools, ponds and water features immediately outside windows or in courtyards can pre-cool air entering the house. Carefully located water features can create convective breezes. The surface area of water exposed to moving air is also important. Fountains, mist sprays and waterfalls can increase evaporation rates. Convective air movement The rule of convection: warm air rises and cool air falls. Stack ventilation, or convective air movement, relies on the increased buoyancy of warm air which rises to escape the building through high level outlets, drawing in lower level cool night air or cooler daytime air from shaded external areas or evaporative cooling ponds and fountains. Solar chimneys Solar chimneys enhance stack ventilation by providing additional height and well-designed air passages that increase the air pressure differential. Warmed by solar radiation, chimneys heat the rising air and increase the difference in temperature between incoming and outflowing air.


Windows and shading

Roof space

Windows and shading are the most critical elements in passive cooling. They are the main source of heat gain, via direct radiation and conduction, and of cooling, via cross, stack and fan-drawn ventilation, cool breeze access and night purging.

Well-ventilated roof spaces (and other non-habitable spaces) play a critical role in passive cooling by providing a buffer zone between internal and external spaces in the most difficult area to shade, the roof.

Low sun angles through east and west-facing windows increase heat gain, while South-facing windows transmit less heat in summer because the higher angles of incidence reflect more radiation.

Ventilators can reduce the temperature differential across ceiling insulation, increasing its effectiveness by as much as 100%. The use of foil insulation and light coloured roofing limits radiant heat flow into the roof space.

Adapting lifestyle

Design to maximise beneficial cooling breezes by providing multiple flow paths and minimising potential barriers; single depth rooms are ideal.

Applicable in all climates, especially hot humid and hot dry, ‘adapting lifestyle’ means adopting living, sleeping, cooking and activity patterns that respond to and work with the climate rather than using mechanical cooling to fight against it.

Because breezes come from many directions and can be deflected or diverted, orientation to breeze direction is less important than the actual design of windows and openings to collect and direct breezes within and through the home. Wind doesn’t blow through a building — it is sucked towards areas of lower air pressure. To draw the breeze through, use larger openings on the leeward (low pressure or downwind) side of the house and smaller openings on the breeze or windward (high pressure or upwind) side. Openings near the centre of the high-pressure zone are more effective because pressure is highest near the centre of the windward wall and diminishes toward the edges as the wind finds other ways to move around the building. Consider installing a louvre window above doors to let breezes pass through the building while maintaining privacy and security. Consider placing similar panels above head height in internal walls to allow crossventilation to move the hottest air. Position windows (vertically and horizontally) to direct airflow to the area where occupants spend most time (e.g. dining table, lounge or bed). Use fins to direct airflow. Design and locate planting, fences and outbuildings to funnel breezes into and through the building, filter stronger winds and exclude adverse hot winds. Insulation Insulation is critical to passive cooling — particularly to the roof and floor. Windows are often left open to take advantage of natural cooling and walls are easily shaded; roofs, however, are difficult to shade, and floors are a source of constant heat gain through conduction and convection, with only limited cooling contribution to offset it. Use multiple layers of reflective foil insulation in the roof instead of bulk insulation to reduce radiant daytime heat gains while maximising night-time heat loss through conduction and convection. This is known as the one-way insulation valve. Reflective foil insulation is less affected by condensation and is highly suited to cooling climate applications as it reflects unwanted heat out while not re-radiating it in.

Acclimatisation is a significant factor in achieving thermal comfort. Most people living in tropical climates choose to do so. They like the climate and know how to live comfortably within its extremes by adopting appropriate living patterns to maximise the outdoor lifestyle opportunities it offers. Sleeping comfort at night during the hottest and most humid periods is a significant issue for many people living in tropical climates. Sleeping comfort generally should be a high priority when choosing, designing or building a home. Different members of a household have different thermal comfort thresholds. Children often adapt to climate changes more easily than adults do and are soon much more likely to be less reliant on air conditioners. Understanding the sleeping comfort requirements of each member of the household can lead to better design, positioning or allocation of bedrooms — and increased thermal comfort for all with less dependence on air conditioning. Live outside when time of day and seasonal conditions are suitable — particularly in the evenings. Radiation by the body to cool night skies is an effective cooling mechanism, especially in the early evening when daytime heat loads have not been allowed to escape from the interior of the house. Cooking outside can reduce heat loads inside and be a beautifully fun and interesting design concept in a Thai built house. Those looking for the international flair locate barbeques under cover near the kitchen, with good access either by servery or screened door. Shaded barbecue and outdoor eating areas (insect screened where required) facilitate outdoor living and increased comfort. With just a little bit of thought on passive cooling in your home design phase you will not only be making your home more usable and fun but save significantly on your electric bills.

Banyan Tree Plants Seeds of Knowledge Resort’s internships lead to three scholarships for local students to attend university KOH SAMUI, Thailand (August 8, 2019) — Lots of luxury hotels give back to their local communities these days, and none more so than Banyan Tree Samui. The Thai resort has been awarded a “Gold Certification” by EarthCheck, the world’s leading scientific watchdog for the hospitality industry, making it the first and only hotel in Thailand to be recognized for its environmental policies at such a level. Among the Koh Samui resort’s CSR (corporate social responsibility) programs are tree-planting, a plasticsfree initiative, wastewater recycling, and a coral regeneration project, whereby broken corals are revived and re-attached to the reefs that curl around the resort. In 2013, Banyan Tree Samui introduced a “Seedling Mentorship” project available to some of the less privileged children on the island, which was traditionally a coconut farming and fishing community. Recently, three of those children graduated high school and, with the aid of Banyan Tree scholarships, have now moved on to university. Phuthiporn Kunlabut, nicknamed Bass, is one of those lucky students. She said, “My family was so proud of me during my internship at Banyan Tree Samui. I learned a lot from my experiences at the pastry kitchen – baking, dessert making, food preparation and decoration. After that, I did a stint with the housekeeping department, where I learned to handle guests’ queries. I also got to join the florist team.” Bass is now studying Food and Nutrition at Rajamangala University on the mainland in Songhkla, while her fellow “seedling” Thayaporn Songkong has begun her first year at the Faculty of Law at Suratthani Rajabhat University. The resort’s Seedling Mentorship program is part of a wider initiative by the Banyan Tree Global Foundation.

The Rennaissance of

Cigars

In the previous article about cigars, we looked at how the country of origin influence the cigars, and as with wine, coffee, cocoa and other artisinal products, the country and its climate has a quite significant influence. But the seed has as great an influence on the cigar, as the grape varietal has on wine. Also, the size of the cigar affects the flavours, just like wine in a Magnum bottle will differ from the normal 75 cl wine. In this article, we’ll scratch the surface of this subject: The seed, the wrapper colour and the vitola.


There is some debate as to how much influence the wrapper (the outermost layer of tobacco) has on taste, ranging from being merely for aesthaetics and up to accounting for as much as half of the taste profile. It is the view of this author that wrappers do matter, but rather than alter the taste profile significantly, the wrappers are used to accentuate certain tastes of the filler and binder leaves, or to bring out particular top notes desirable to the overall taste experience. Thus, a Maduro wrapper can be used to accentuate an already chocolaty taste of the filler, or to add a touch of sweetness to an otherwise strong and heady cigar. Some assume, that the darker the wrapper, the stronger the cigar – this isn’t already true. You can theoretically have immensely strong tobacco wrapped in a Claro wrapper, or mellow tobacco wrapped in a Maduro wrapper. One sure rule of thumb, though, is that the lighter the wrapper, the less the wrapper itself is able to influence the overall taste profile of the cigar, simply because of the fermentation process: As taste and sugar content is closely related to the fermentation time of the cigar, and the fermentatino time of a Double Claro can be as little as three days, it will lend virtually no sweetness to the cigar, but rather driness or earthy notes. Conversely, a Maduro wrapper can have been fermenting for several years drawing out massive amounts of sweetness lending the final cigar notes of chocolate, maple, honey or sugar. You will also often find that the lighter wrappers are finer and more finicky (and more prone to tearing), whereas Oscuro wrappers are often almost somewhat thich, sturdy or rustique looking. Each wrapper has its purpose, and at the end, it all boils down to taste – which wrapper you prefer is entirely up to you, time, place and occasion, and ultimately your taste buds.

In this age where “artisinal” is the buzz word for all things good, nothing can be more true to the word than cigar production. More than 100 steps, almost all by hand, go into the production of a good cigar!


Vitolas The Nub is a relatively new size created by Oliva for their “Nub” line. At 4 x 60, it is theoretically a shortened Toro Gordo providing about 75 minutes of smoking. The Rothschild is one of the original Cuban sizes - usually, it is 4 1/2 inches with a ring gauge between 44 to 49. A short 45 minute smoke.

The Robusto is probably the most common size - just about 5 inches in length and 50–54 in ring gauge. The cigar will give you a little over an hour of puffing. The Perfecto is considered to be one of the hardest shapes to roll, and they often sell at a premium compared to their “normal shaped” siblings.

The Toro has become very popular in the last decade; they are usually about 6 inches in length and between 50 – 54 in ring gauge, giving you 1.5 hours of smoke. The

Toro Gordo, or “Fat Bull” has a ring gauge of 60, often lending a more mellow smoke and 15 minutes more of smoking time.

Torpedos have a tapered end (hence the name) and are usually Robustos or Toros with about an additional 1/2 inch for the tip.

The torpedo shape is more difficult to roll and hence torpedos are often a tad more expensive than their normal counterparts.

The Lonsdale is one of the original Cuban sizes – it is essentially a shortened and slimmer Churchill. Some prefer them as the wrapper can lend more taste to

the cigar due to the higher wrapper to filler-ratio. The panatella is an even slimmer version (ring gauge of less than 40) often favoured by women.

The eponymous Churchill is the cigar of all self-respecting statesmen and dictators across the world. 7 – 7 1/2 inches in length and usually about 50–52 ring gauge. The cigar

has a good balance between wrapper and filler, and will easily give you almost two hours of stately puffing time.

Vitola is cigar-speak for “shape and size”, and the most famous vitola is undoubtedly the Churchill, the long and relatively slim cigar, made famous by the British Prime Minister who supposedly started his day by lighting a cigar and pouring himself a glass of whisky before getting out of bed in the morning (as perfectly shown by Gary Oldman in “Darkest Hour”). The length of the cigar is measured in inches, and the Ring Gauge, or diameter is measured in 1/64 parts of an inch. The Inch, from E. P. Carillo (Dominican Republic) in its original vitola, is 6 1/8 x 64, or a little over an inch long (16 cm) and an inch in diameter. This size is usually named “Toro Gordo” (Big Bull). There are a number of other vitolas than those described to the left, and some cigar makers play with the sizes so that some cigar makers would call, say, a 5 1/2 x 50 either a Robusto or a Toro; unlike wine bottles, there are no strict naming rules to adhere to. Often, the size is decided by the master blender to get the exaxt right taste out of the cigar, and if that entails lengthening the Robusto by 1/8 of an inch, so be it. Cuban cigars are often slimmer than their non-Cuban counterparts, and instead of the Robusto, the most common Cuban size would be the Corona with a 42 ring gauge, and between 5 - 6 inches in length (Petit Corona, Corona and Corona Grande). To meet demand from the world market, they have recently introduced the Corona Gordo with a ring gauge of 46. And for those who wish to truly emulate Fidel Castro, there is the Double Corona at 7 5/8 x 49 and the Gran Corona (often called the Presidente) at a whopping 9 x 49 ...

The advantage to the big-ring craze is that you can get some really good deals on the sizes that have suddenly fallen out of fashion – look for Coronas and Robustos as they may often benefit from discounts as the vendors are clearing shelf space for those big-ring cigars. The downside is that if you fall in love with that particular Petit Corona, it may very well be discontinued, and you would have to look for a new favourite cigar. And if you find that your taste leans towards Toro Gordos, then Coronas will probably not appeal to your taste buds. Ath the end of the day, Cigars is much like any other epicurean hobby: Taste varies, and it is all up to you to find your preference. Furthermore, don’t be surprised if your taste changes over time and place. Personally, I have gone through 5 different “favourite cigars” already, and which one I prefer depends on time of day, what I have eaten, the weather and the alignment of the stars. My personal Top-7 (in no particular order) is this: Aging Room 356ii Toro CAO MX2 Toro Gran Habano Persian King Gurkha 15 Year Cellar Reserve My Father Le Bijou 1922 Grand Robusto PDR AFR-75 Perdomo Lot 23 Natural Toro And thus I shall leave you until the next article on cigars and where to enjoy them, with a tip from a fellow cigar connoisseur and friend of mine: Never light your cigar with a Zippo, and remember to suck, blow, and don’t swallow!

As ludicrous as these sizes may seem, the non-Cubans have added girth to the cigars making them thicker and thicker. Starting with E. P. Carillo’s “The INCH” at 6 1/8 x 64 less than a decade ago, now virtually all major cigar brands offer 60+ ring gauges. As these sizes are virtually “off-the-charts”, many have come to dub them BFCs aka. Big Fucking Cigars ... Cigars that size require a lot of time to puff through, so Oliva created the Nub as a shortened big-ring alternative to these big cigars for those who have the standard 75 minutes for a smoke, but like the big ring gauge. Within an area of approximately 167km2 with over 70% being unspoilt mountainous and tropical forest many more temples are nestled coherently within the islands natural flora and fauna offering a feast for the eyes of all visitors. LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain

RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.

SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.

SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.

LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)

STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area.

STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.

STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.

STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.

In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
