EDITOR'S LETTER It’s a beautiful morning on Koh Samui, rain has just stopped and there’s still that freshness in the air. Already evidence of the heavy shower is disappearing fast and apart from a few small puddles and washed sand on the road it’s hard to believe only minutes ago the heavy deluge that came down. It’s been raining quite often the last week and the recipe of strong sun in the day and heavy showers late afternoon and evening have produced an amazing sea of lush green everywhere. Even after 27 years, this summer Samui feeling is still invigorating. June and July have been quiet on our islands, but tourist arrivals are already increasing and we are all looking forward to positive months ahead. This is our 2019 August September issue which is Edition 87, not many publications in SE Asia can boost of such ongoing magazine success. Lovingly called the Samui Bible of Real Estate, the Samui Phangan Real Estate Magazine brings together absolutely everything the heart could desire in terms of living, buying, investing and renovating house and land on our islands. The stunning villas at Samujana grace our Front Cover and our Developer Profile in this issue and we take a close look at their amazing architecture by the awardwinning designer Gary Fell of GFAB Architects. Summer scrub up Get the beach house look. Every home needs a make-over now and then or a simple freshen-up. On a budget? Here are some simple tips to brighten your home with the beach house look.

fabrics such as cotton and muslin. Choose things that channel or reflect light into your home such as mirrors, glass and lightweight fabrics or simply move items of furniture that might be blocking light.

Paint is the most obvious and simple solution to freshen your home without breaking the bank. The pallet of colours to choose from is almost endless and most stores that sell paint will mix any colour or shade you choose. Neutral colours are good and will blend well whatever your existing decor, so choose these unless you want to make a bold colour statement.

Now, for those of you who want to go much further and have the extra cash, consider a bathroom makeover. A cool looking bathroom can add real value to your home and make it look like you have refurbished your entire house. I am not sure why this is, but trust me it does work.

If in doubt, always choose white. A lick of white paint on your walls does wonders and your home will look clean and fresh. Shades of grey and other colours like yellow and rose are trending. Add a splash of colour with fabrics and accessories. Don’t forget, paint is not just for walls, you can give new life to old wooden furniture with a coat of paint or varnish. If you want to go further and stay on budget, then consider a made to measure slipcover for your sofa (cheaper than having it reupholstered) and add ties, a throw or new cushion covers. Simple solutions like these will go a long way to give your home a fresh look. Freshen up further with lightweight curtain

For the beach house look, start with painting anything dark white or a pale blue or any neutral colour. If you have a built in bath try painted tongue and groove wooden slats round the bath. Replace built in wash basins and splash out on granite basins or basins that sit on your washbasin cabinet with copper taps for granite or simple stainless steel taps for other basins, but not taps that fit into a basin. No need to replace your existing bathroom cabinets just add a mirrored surface to them with simple or fancy knobs depending on your preference. If you have a wooden floor paint it white. Choose some simple wall lights.


If you need more lighting add ceiling lights...and don’t forget to finish up with some sea shells, bits of old rope, fishing nets and, seaweed if you want the new beach house look ha!

or how to best handle Heat in the Tropics Thailand is still considered a rather conservative culture when it comes to clothing especially female clothing. OK there are no harsh laws about covering face or hair but if you have some respect for the Thai culture you should consider what and where you are wearing certain clothes. Personally, I feel it is not appropriate for anyone to be bare chested or in a bikini while in a Bank or supermarket. I wouldn’t do it back home so why should it be acceptable here. How to lower body heat quickly

You can apply aloe Vera gel to your skin for a cooling effect. Either use the inside gel of a fresh plant or a pure aloe Vera gel. For added benefits, keep it in the refrigerator before application. Aloe Vera can also be consumed internally. Use 2 tablespoons of fresh aloe Vera gel per cup of water to make a drink.

Play it cool in a hat with a wide brim and sunglasses if you’ll be in direct sunlight. You can even carry a parasol or umbrella.

Buttermilk Drinking buttermilk may help to cool down your body and improve metabolism. It’s also full of probiotics (traditional buttermilk), vitamins, and minerals that will help to restore your body’s natural energy if you’re feeling drained by the heat.

You probably know how important it is to hydrate with water when you’re hot. There are lots of other ways to lower your body heat quickly as well. The following home remedies are easy and effective ways to beat the heat.

Wear loose, lightly coloured clothing in natural fabrics such as cotton, linen, or silk. Semi-synthetics such as rayon and modal can also be worn to combat body heat. Scientists are developing fabrics created specially to keep you cool, such as thermal regulation fabrics. Products made with these types of fabrics are often designed for sport and outdoor activities. Cold foot bath Placing your feet in a cold foot bath cools your body and allows you to sit back and relax. Simply add cold water and ice cubes to a bucket of water. Immerse your feet and soak for up to 20 minutes. Add a few drops of peppermint essential oil for an added cooling effect. Coconut water Drinking coconut water is a delicious way to refresh and revitalize your body. The vitamins, minerals, and electrolytes in coconut water make it an effective way to rehydrate and reenergize your body when you have heat stress. Coconut water has many other benefits, too. Peppermint Peppermint is known for its cooling properties due to its high menthol content, which makes one have the sensation of feeling cooler. You can make a hot or iced peppermint tea and drink it throughout the day. While hot tea may seem to make, you feel hotter, drinking hot drinks may help you to sweat more and help to cool down your body. Hydrating foods Eat plenty of foods high in water content. Fruits such as cantaloupe, watermelon, and strawberries are good options. Try eating lots of vegetables such as celery, cucumber, and cauliflower. You can eat these foods raw in a salad. Alternatively, add a bit of ice to incorporate them into a healthy smoothie since yogurt is also a cooling food.

Try drinking a glass of cold buttermilk. Adding honey or yogurt is optional but may make the flavour more to your liking. Fenugreek Tea Sipping a cup of fenugreek tea may help to bring on a sweat, allowing you to cool off. If you don’t like the idea of drinking a hot drink, you can make the tea ahead of time and chill it in the refrigerator before drinking it. Fenugreek may also be useful in getting rid of some excess fluid and detoxifying the body. Chili Even though eating spicy food can make you feel warm, it can also help to lower your body temperature. That’s because the capsaicin in chilies sends messages to the brain to signal that your body is overheated. This causes you to sweat more than normal and brings on a cooling effect. These remedies should help to cool you down if you’re feeling the heat. If your body temperature seems to be high for an undetermined reason or you’re not cooling down after trying some of these remedies, see your doctor. This is especially important if: you have an underlying medical condition you’re over 65 years of age you’re pregnant or nursing it’s occurring in young children or babies Heat stress has the potential to turn into heat exhaustion or heat stroke if left untreated, so seek help if you or a loved one is having extreme discomfort that doesn’t ease. Key Considerations for Property Investors Who Choose to Build Their Own home in Koh Samui and Koh Phangnan.

Whilst it remains the case that the majority of property investors choose to purchase “off-plan” or newly constructed villas, apartment or condominium units in Koh Samui and Koh Phangnan, more experienced real estate investors seek to acquire a plot of land and build their own home. In choosing to go-it-alone, investors can enjoy a certain level of creative freedom in designing the new home to their specific tastes. There can also be a considerable cost saving as the investor does not need to account for sales and marketing costs and profits. In contrast, however, the risks of “going-it-alone” may be significantly higher, particular for first time developers unfamiliar with the laws of Thailand that govern property ownership and development. There is a general prohibition against foreign investors acquiring ownership of freehold land in Thailand. Accordingly, a key issue to be addressed by a foreign investor is how to acquire a legal interest in the land plot which is to be developed. Foreign persons and foreign companies are permitted to acquire the long term use of land by leasing a land plot from the freehold land owner. In accordance with the laws of Thailand, a registered lease is limited to a term of no longer than 30 years which is considerably less than in most other countries. The investor should undertake a full historical title search of the land prior to paying any sums to the owner of the target land plot. The historical title search will identify whether or not the title to the land has been correctly and legally issued and confirm that the Seller is the legal owner of the land. The search will also identify whether or not there are any mortgages registered against the land.

As part of the land title investigations, it is important to establish whether or not the land has full legal rights of access both on foot and by vehicle. Any access restrictions to commercial vehicles will make any construction on the land impossible. It is important to also consider access to the electricity grid, water supply and drainage. Access to such utilities across adjacent land must be agreed in advance of payment. Legal rights of access such as servitudes can be registered in favour of the land. Careful consideration must be given to the zoning and environmental restrictions which apply to the land. Building regulations vary significantly depending upon the distance of the land from the shoreline restricting the height, size and number of storeys of the building. Other regulations restrict the type of buildings and the use of the land and the development of land over a certain gradient. The building and zoning regulations may have a significant impact upon the design of the building and may significantly curtail any grandiose plans for the land. The land lease agreement must be carefully drafted so as not to impose any condition upon the investor requiring the investor to seek the landlord’s permission or approval of construction plans prior to commencing construction of the building. This is common in transactions where the landlord is retaining adjacent land and is seeking to exercise control over what is built on the land which it is leasing or selling. All construction contracts must be vetted before the construction contract is signed and monies released to the builder. The specific requirements of a construction contract are detailed and beyond the scope of this article, however, from a general perspective, the construction contract should set out in detail the materials to be used in the construction of the building and the builder should be required to provide a contractual guarantee against defects which might arise during construction of the building. Many investors seriously underestimate construction costs and consequently it is important for the investor to make detailed calculations of the proposed costs of construction prior to acquiring the land and bear in mind that the costs of materials and labour will increase over time. In summary, foreign investors should take time to understand precisely what is involved in developing a property in Thailand, in particular, the laws which govern the ownership and use of land by foreigners. It is important to seek legal advice at each stage of the process in order to ensure that the investor remains in control of the project from the acquisition of the land through to the completion of construction and the registration of legal ownership of the building. Bare Land Finance, Kai Faak When travelling around the islands of Thailand and in particular our sun drenched palm shores of Koh Samui with neighbouring islands Koh Phangan & Koh Tao, one can’t help but notice the natural landscape offers some exquisite views either around the inland jungles & waterfalls or, over the turquoise colour and coral shorelines. The land upon which our paradise sits, bears fruit (and coconuts) for many and often sees ownership changes with infrastructure and development on the top, moved around. Land in Thailand, has several grades of security with ownership and the most secure, being labeled with a full “chanote” status. This usually means a plot of land has been fully verified, sized and plotted on official government ordinance and is fully registered at a local land office with a specific owner and valuation assigned. Other lesser secure land ownership is used though usually is a case of long term owners having the approximate boundaries laid out and never having fully upgraded to verify & log at the land office to make sure no disputes over ownership. i.e. Until is registered as a chanote, there might be others willing to “claim” ownership over the plot or boundaries. There have even been occasional claims over existing forestry and national park land around the Kingdom which sometimes make national headline news. For the purpose of this article when discussing finance, we shall focus on full chanote status land only as lenders often prefer to lend on this only as reduces the chances of lending money on a plot which might not have been the true owner in the first place.

The classic way to finance land from an international standard is typically a Mortgage Finance registration, where the name on the back of the chanote remains in the owners name and a debt/mortgage is registered alongside. A lender will than typically hold onto the original chanote until after the mortgage has been fully repaid and then, a return trip to the government local land office is needed to deregister the mortgage and remove the debt from the back of the title deed. If during the term of the mortgage, a lender sees the loan in default and against their mortgage contract, signed by the borrower, the lender has a right to enforce the mortgage and occasionally may result in the foreclosure of the property. The lender might put the property up for sale/auction and look to sell for enough to pay off the mortgage. At this point, a lender might not be concerned about obtaining the best sale price to make profit and rather, might be concerned only to sell for enough to pay off the loan and any legal fees/expenses incurred. If for example the mortgage was only registered at 50% of the property valuation, than the borrower might be better to ensure the mortgage does not go into default and try to sell the property themselves a bargain, if they foresee longer term repayment difficulties. Nonetheless, it is likely to be a lengthy legal process to go through any default foreclosure. A mortgage registration is an official legal way to borrow. The second way to borrow unique to Thailand and again, officially recognised here with a government local land office registration, is called a Kai Faak. Most notably, the major difference & shift here to that of a mortgage is that a kai faak no longer remains in


the owners/borrowers name and is transferred to the lender from day one. In a way, by making a kai faak registration, a would be borrower is selling the chanote to a lender with a right to buy back after a specified term. Let’s again take the same 50% loan to value as used in the first mortgage case above, a borrower sells the chanote to the lender for 50% of the valuation with a right to buy back at the end of term. Typical terms for kai faak are 1 year renewable, up to 3 years, so 2 times renewal for 3 year loan term and with all interest and fees paid upfront & deducted from the loan so no monthly installments. Borrow today and see you in 12 months to pay back the loan so to speak. If after 12 months the borrower does not have enough to pay back a lender, the kai faak goes into default and a lender doesn’t need to go through much legal process (in comparison to mortgage) since they already own the chanote. To summarise, the lender just successfully bought a chanote for 50% of its true value….a bargain. One may ask why on earth would an owner of an extensive plot of land worth multiples of a million baht consider to “sell” a chanote to a lender for just 50% of the valuation when a mortgage registration is more secure for the borrower… Mostly the borrowers who use kai faak fall into one or more of the following categories. • Owner needs fast cash for short term liquidity issues • Owner requires cash to invest in elsewhere offering higher returns than a loan interest rate • Owner has poor credit history • Owner has low regular income or little paperwork to show as evidence of affordability to obtain mortgage. Generally with a land plot chanote, proceeds from a loan are used for development or investment elsewhere. Take for instance a developer who has several plots of land ready in line to build a series of projects. A traditional bank mortgage might require extensive projections/forecasts and long term history of income to support a mortgage request along with multiple background checks on each and every borrower within a company (if under company ownership) or individual. Weeks or even months can go by back and forward between a bank and borrower which might end up with no loan at all. A developer knows that money can be made from the sales of condo units or villas etc. which they intend to build and only needs money to inject for building a showroom and spend on marketing, events, exposure etc. By simply offering a plot of land (not connected to the project itself), fast and easy cash can be made available to the developer in a short space of time to get things moving whilst longer term, plans are put in place to repay the kai faak and possibly obtain a mortgage once cash flow starts to roll in. Fast cash and no monthly installments are attractive to a development looking to minimise expenses early on with a project.

Another big point of the kai faak is that it doesn’t require credit bureau checks etc. since a lender is not looking at the ability to repay the loan as remember when they enter a kai faak to begin, they are “buying” the land chanote at maximum 50% it’s value. A lender might rather spend time to consider do they really want the land chanote on their books, could they make money developing the land plot themselves if the loan falls into default etc. If the land chanote is prime beachfront or, with direct main road connections and offers great development opportunities, than the land is likely to be easy to finance kai faak, as a lender (investor) might love to take over the plot. ​​

On the basis a lender would love to take over good land chanote/s, many offer a decent fast & efficient decision making process and require minimal items to get a preliminary idea whether worth pursuing. Simply email a copy of chanote, google map link to the location and perimeter along with some recent photos and this is usually enough to gauge an idea of what might be made available. i.e. Land in a particular area and of a particular shape and size might fetch THB “X” Sq.w./ Sq.m. Lenders usually have a ball park figure they are prepared to lend on a particular location hence a desk based analysis can take place before the need to meet up and discuss supporting documents for the loan etc. Sending a lender a loan email with projections and forecasts for the next millennium are of little concern to a lender who is considering the “buy” a plot under kai faak terms. They just need to know size, shape, location and can almost decide from this. At MBK Guarantee Co., ltd, kai faak terms are typically 12% interest per annum (deducted up front in advance) with a 1.5% lender fee. All property transfer fees are payable by the borrower and all other fees & expenses incurred are deducted from the loan amount. The only “cost” before knowing a loan is approved, tends to be a valuation fee for a full independent appraisal of the plot and a minor inspection fee for the team to visit. Generally valuation fees and inspection trips are avoided IF there is no point to propose for approval in the first place as is outside of lender criteria. Hence the desire for google map, chanote and photos early on to pre-evaluate before spending too much time for both borrower and lender. Hot House Designs Keeping a house cool Most builders know that house designs need to be climatespecific. In Thailand heating costs are basically nonexistent, I can even remember trying to explain to some locals why we would need to have central heating in houses. So in this issue we are going to look into why homes in Asia should be designed to reject exterior heat. So what are the most important factors governing hotclimate design? • Air leaks not only increase a home’s sensible cooling load; by introducing humid exterior air, they also increase a home’s latent cooling load, making the air conditioner work harder to wring moisture out of the air. Tight houses are much easier than leaky houses to keep cool and dry. • While cold-climate designers have to worry about heat escaping from the envelope in all directions, the heat-gain concerns of hot-climate designers are overwhelmingly dominated by just three major factors: windows, ceilings, and internal gains. On summer afternoons, one large west-facing window with the wrong type of glazing can make a huge difference in a home’s heat gain.

Best-practice measures •

• Orient the house with the long axis east-west.

• Shade is good. Roofs should have wide overhangs, ideally 1m wide or wider. Storms like to grab onto roof overhangs, though, so be sure to secure roof trusses or rafters to top plates with adequate storm clips. Since a hipped roof can shade all four sides of a house, hipped roofs are preferable to gable roofs.

• Most windows should face north or south. Because they are harder to shade, east- and west-facing windows contribute much more to overheating than north- or south-facing windows; so east- and west-facing windows should be minimized. • Every effort should be made to shade every window. Windows can be recessed into thick walls or protected by projecting architectural elements. On the east and west elevations, it’s often best to protect any windows with a wide porch. • It is critical for a home’s air conditioner and all ductwork to be within the home’s thermal envelope. One way to do this is to “cathedralize” the attic by spraying closed-cell foam insulation against the underside of the roof sheathing. Of course, duct seams should always be carefully sealed; slightly oversized ducts are better than undersized ducts. • Ceilings or roofs should be insulated to at least R-30. • If the house has an unconditioned attic, specify radiant-barrier roof sheathing. • Use highly reflective roofing — ideally, white metal roofing or white concrete tile roofing. • If the house has concrete-block walls, install the insulation on the exterior, not the interior. • Specify windows with a solar heat-gain coefficient (SHGC) below 0.32; if possible, aim for 0.28 or 0.29. • The home’s thermal envelope should be carefully air sealed. • While high internal loads — that is, waste heat from lights and appliances — benefit cold-climate houses in winter, such loads hurt the performance of hot-climate houses in summer. So in Thailand, it’s particularly important to install CFLs or LEDs rather than incandescent bulbs and to specify the most efficient available appliances, including refrigerators and televisions. • Ceramic tile floors are best. Avoid carpeting. Although many of these suggested measures may seem obvious, they are widely ignored. Taking just a little bit of time and effort in your house planning will firstly reduce your energy consumption and therefore your bills drastically and make living in a cool home much more inviting.

The Samui Elephant Sanctuary Symbols of strength and wisdom, the elephant is believed to be sacred and incredibly valuable in many cultures, especially Thailand. In this way you would have thought that these majestic animals are to be preserved and taken care of rather than exploited. Sadly, and again I say this as especially in Thailand it is exactly that what we have done. How many of us have come to Thailand and excitedly looked forward to some elephant trekking or a ride on one of these beautiful creatures. But can we really excuse this with our innocence as behind the scenes these splendid animals were beaten into submission and forced to walk on red hot tarmac roads and act out unnatural circus acts. But luckily things are changing and especially with social media people all over the world are starting to realize what has been happening and promoting sanctuaries taking in abused neglected and exploited elephants both here in Thailand and abroad. It is through these incredible organizations working to raise public awareness, conserve the elephants’ native habitat, and ensuring the elephants in their care are safe for the remainder of their lives, that we can begin to hope for the future of the species. In the wild, elephants are migratory, walking miles each day. They form intricate family structures and grieve for their dead in a more-than-instinctive way. They show humour and express compassion. The Elephant Sanctuary’s mission is to give elephants the freedom they deserve. Elephant riding or trekking in Thailand is easy to do. What’s not so simple is finding a reputable place that cares about and protects its elephants. Therefore, we are so thankful that the Samui Elephant Sanctuary has opened to provide captive elephants with individualized care, the companionship of a herd, and the opportunity to live out their lives in a safe haven dedicated to their well-being, and to raise public awareness of the complex needs of elephants in captivity, and the crisis facing elephants in the wild.

It is an unforgettably beautiful experience observing these creatures in their own swimming pool, showing affection to one another and naturally being an elephant at ease in his own Samui elephant sanctuary. We spoke with Wittaya Salangam at the Samui Elephant Sanctuary who explained “we treat our elephants with the dignity and respect they deserve, we do not allow riding or any type of performance, we want our guests to see elephants being elephants. We work with our herd through positive reinforcement through food and we turn our backs on the traditional use of the bull hook and cruel training techniques. Our tours focus on observation of the elephants’ natural behaviour and as such we do not allow guest to join the elephants in the mud pit or swimming pool. Our tours follow a very relaxed program which starts with an introduction to our work, then we feed the herd, guests are then invited to walk in the sanctuary and feed our elephants then we watch the elephants as they make their own decisions about what they would like to do each day. Our tours are very much guided by the herd itself!” Wittaya Salangam further elaborated about some of the elephants, while Sri Nin was working in the logging industry she was blinded in her left eye. This was caused after her previous mahout, appallingly, used a sling shot on her, as she didn’t obey his commands. Kham San has a large hole in her right ear caused by the mahout as a vicious method of control. Nong Pech was used for street begging, where every day she would have to go on the busy sizzling hot streets to beg for food from tourists. From a very young age Moloair was abused so that she would perform in the circus in the south of Thailand. The horrific injury to her trunk, one of the elephants most sensitive organs is still clearly visible. Save Elephant Foundation is a Thai non–profit organization dedicated to providing care and assistance to Thailand’s captive elephant population through a multifaceted approach involving local community outreach, rescue and rehabilitation

programs, and educational ecotourism operations. Each of their flagship projects is aimed at accomplishing that mission, as well as working towards these goals: •

to expand self-sustaining eco-tourism operations that benefit local communities and ecosystems

to better incorporate our efforts into local communities and to ensure their benefit through our continuing operation

to become a leader in the field of Asian elephant research through academic outreach and education programs

to create practical, positive reinforcementbased elephant training and rehabilitation programs

There are two tours each day at the Elephant sanctuary, the first is 9am to 12pm, and the second is 2pm to 5pm. These tours include the transport to the sanctuary, a professionally guided tour, drinking water, lunch and yes lots of bananas to feed the elephants. Entrance to the tour is 3,000 Baht, which when you realize that elephants eat 10% of their own body weight each day and what is would cost just for the care of these beautiful creatures is very reasonable. The Rennaissance of

Cigars

T

here has been a rennaissance in cigar smoking over the past decade, and in our series of articles on this refound epicurean lifestyle, we provide the reader (that is YOU) with enough knowledge to hopefully embark on this new hobby with some tools and guidelines to make it an enjoyable experience. This time, we are going to cover the most common countries that produce cigars – for much like with coffee and wine, the “terroir” – i.e. the conditions of the soil – has a major impact on the taste and quality of the cigar. Also, a tropical climate is neceessary for the ideal growing conditions for cigars, and hence you will find most growers in the tropics. Cubans used to be THE cigars to smoke, and anyone worth their salt would state with utter conviction that they would only smoke Cubans. After the Cuban revolution, and actually also as a direct result of the revolution, many other Latin American countries have made solid inroads to the cigar market. Cuban cigar producers were nationalised, and many, if not most, of the major cigar families decided to flee the countries in the years following the revolution. Many fled to Florida and started rolling companies providing cigars for the mass market with imported tobaccos from the neighbouring countries, or they travelled to countries with a soil ideal for cigar production. Thus, many of the old cigar producing families started all over from scratch in Nicaragua, Honduras and the Dominican Republic, and a handfull decided to lend their expertise to farmers in Mexico, Venezuela and other countries in the region. And the flip-side of the coin (for the Cubans) was that they had lost almost all of the brains behind the major pre-revolution brands.

With the outflow of expertise and knowledge, the Cuban cigar production suffered – many farmers and rollers remained, but the pride and dedication to the impeccable cigar suffered. Add to that the woes of the American embargo and lack of industry, and the desparation of the Cuban government to get some kind of “hard currency” into the country, and they comitted the inevitable error: they started over-farming the land. Cigars are much like wine – the quality of the final product is closely related to the farming of the grapes and tobacco. The soil (or terroir, as it would be called in the world of wine) is immensely important. The nutrients in the ground and the composition of the soil influence the cigar. Also, it is important to let the ground rest every 3 or 4 years; if the farmer keeps harvesting year after year, which the cash-strapped Cubans did, the quality will suffer. In addition, several improvements in farming techniques, equipment and pest control that have been embraced by the other cigar producing countries have eluded the Cubans. Finally, being desperate for money, quality control has suffered, lowering the quality even more.

Cohibas are some of the most expensive cigars in the world, and are the considered to be the original “gold-standard” for cigars.


Fast-forward to this century, and the Cubans have all but eroded their advantage and status among true cigar afficionados as “the Rolls-Royce of cigars” (much like the car producer in the late 80s and early 90s), and they will rather put down their hard-earned cash on a box of Honduran cigars instead of a box of Cubans of dubious quality. It is the experience of this writer, that with even the best of Cubans, say Cohiba and Bolivar, you will have a handfull of cigars that are rolled either too tight, too lose, wrappers aren’t spotless or there may be soft spots in the cigars giving an uneven burn. Issues that are much less prevalent in cigars from Nicaragua, Honduras or the Dominican Republic at even a quarter of the price. Therefore, as much as it pains me, I would recommend the up-and-coming cigar connoisseur to give the Cubans a pass unless (s)he has a fortune to spend. In-fact, all sales go through the state-owned Habanos S.A., and they divide the cigars meticulously into three quality tiers: Those for sale in Cuba and Spain; Europe (2nd tier) and the 3rd tier which is sold to the rest of the world, Thailand included. So sadly, when you buy your Cohiba for a veritable fortune, it comes from the lowest quality tier. And NO, that box that your acquaintance happened to buy cheap from the Cohiba roller in the bar in Havana when vacationing in Cuba is counterfeit! It is most probably made with the discarded parts of the leaves that didn’t cut it for “real” tobacco production. You may just as well just burn your money instead and save you the grief. Cohiba, Bolivar, Montechristo, Partagas and all of the other big-name brands employ a number of counterfeit measures such as holograms, special stickers and so on to prevent counterfeit cigars. Besides, a cash-stripped country wouldn’t sell ANY cigars out the back door, so all production is under constant control and surveiilance to prevent just that. Finally you wouldn’t expect to buy an actual Chanel bag in Patpong, would you?

It is not uncommon to hear people say “I only smoke Cubans”, and all the way up to the Cuban revolution the very best cigars in the world DID come from Cuba. Today, however, Nicaragua, Honduras, the Dominican Republic and even Brazil and Venezuela produce cigars that surpass most of the Cuban cigars. samui phangan real estate

Seven countries dominate the world of cigars, of which Cuba and Nicaragua vie for the position of being the biggest producer with about 150 million hand-rolled cigars each. Honduras and the Dominican Republic come next, and finally Ecuador, Brazil and Mexico are all producing some fine sticks that are relatively easy to get your hands on. Other countries make cigars as well, for instance Costa Rica, Venezuela and Indonesia (Sumatra). In this article, we’ll concentrate on the “big three” from the new world as you would be hard-pressed to find cigars from the other countries in Thailand or in Asia in general. There are commonly two “schools” of taste: The Nicaraguan taste, which is hearty, bold and to some overpowering and un-delicate. And then there’s the non-Nicaraguan taste, which is delicate and refined, but to some is seen as bland and underwhelming. To this author, what you feel like smoking depends on day, weather, time of day, mood and so on, and I have Nicaraguan as well as non-Nicaraguans in my humidor. Besides, the taste-profiles of the countries are merely broad guidelines, much like it would be with wine. You can just as easily find a delicate Nicaraguan (Perdomo Champagne comes to mind) as well as a in-your-face non-Nicaraguan (CAO Brazlia would be a good example). At the end of the day, the type of tobacco and how it is grown has just as much, if not more, influence on taste.

In this age where “artisinal” is the buzz word for all things good, nothing can be more true to the word than cigar production. More than 100 steps, almost all by hand, go into the production of a good cigar!

Nicaragua is now a major cigar country, now surpassing the Cuban production in numbers, and they produce some of the greatest cigars in the world. The Nicaraguan cigars are commonly known as being more full-bodied than their siblings from Honduras and the Dominican Republic, and some can even be seen as overpowering to the uninitiated or “virgin” cigar smoker. Much in the same way that some of the meatiest and most full-bodied wines like Amarone and Barolo. That doesn’t mean, however, that all cigars are peppery power houses. Perdomo have strong as well as delicate cigars, as does My Father’s Cigars, whereas the CAIN cigars from Oliva have gained quite a following for their “in-your-face” style.

Nicaragua has become eponymous with good cigars, to the point where even Davidoff launched a “Nicaraguan” line about 5 years ago.

Olicva, through their experimental blender Studio Tabac, surprised the Cigar world with the NUB, and carved out an entirely new niche.


Today, there are several Nicaraguan blenders who are widely recognized as producers of some of the finest cigars in the world. To mind comes Perdomo, who started out as a relatively small boutique blender and has now become a major force to be reckoned with. Their cigars are relatively smooth and creamy and always of impeccable rolling quality. One to try is definitely the Lot 23 and the 10th Year Anniversary Champagne. Another very famous Nicaraguan brand is Oliva, who caused a bit of stir when they launched their NUB line – a cigar a mere 4” inches long, where the flavour is supposed to be uniform from start to finish.

Honduras is another major player on the cigar market as of today. Unlike the Nicaraguan cigars, the Hondurans are known for being more subtle and delicate with a finer taste profile. The Honduran cigars are more suitable for new cigar smokers, although here there is not a rule without exceptions: you can find strong, meaty cigars in Honduras too. Most notable Honduran cigar company is probably Gran Habano, although other producers such as Gurkha and CAO also have quite a following for their exquisite and delectable cigars.

This deviated from the usual philosophy of having destinct 1st, 2nd and 3rd parts of the cigar with somewhat different taste. Oliva’s normal sticks, of which the Oliva V Melanio won the highly coveted “Cigar of the Year” award some years ago, are of the classic style with distinct thirds.

The Persian King by Gran Habano is a personal favourite of this author: Big, subtle, floral and with awesome taste – but it can be a bit hard to get in Thailand. But if you find, by a box of 50 – you won’t regret it!

Perdomo has also made an Ultra-­Premium stogie named after Nick Perdomo’s Father, Don De Silvio. These sticks are rare as well as pricy.

A third Nicaraguan cigar maker of great renown is Pàdron: premium cigars that are virtually never on sale. But their Maduros are basically what all other Maduro Cigars aspire to be! Hard to find in Bangkok, but well worth it!

Dominican Republic is the fourth of the major cigar producing countries, and like Honduras they are known for a wider range of flavours with fewer peppery notes than Nicaragua. One of the very best cigars in the world, the Arturo Fuente Opus X hails from the Dominican Republic. Also, Piñar del Rio (PDR) has a wide selection of cigars from the most delicate and intricate to veritable power houses like the PDR AFR-75. Finally, Gurkha also produce some of their very best cigars in Honduras, notably the Gurkha Ghost and the Gurkha Cellar Reserve. I mentioned at the beginning of the article that other countries, such as Mexica, Costa Rica, Brazil and Venezuela produce quite good cigars. Noteworthy are especially the CAO Brazilian and the CAO

Gurkhas are known for their unique packaging, and sometimes at the cost of the cigar. The Gurkha Ghost, however, is a master­piece: Creamy and bold at the same time and well worth the money!

Despite being only 230km2 Koh Samui is one of the world’s top holiday destinations, pulling in tourists from across the globe... so popular in fact that people often don’t want to leave! The beautiful beaches, laidback lifestyle and plentiful amenities are just a few of the attractions that inspire people to pick up house and relocate to this idyllic island. Whether you are considering a permanent move or a holiday home, Koh Samui has plenty of exciting real estate opportunities to be snapped up. Attracting 1million+ visitors annually, Koh Samui is unique in that it appeals to a large variety of tourists including young back-packers, families, couples and high-end luxury travelers - as such the island takes on multiple personalities providing a considerable offering of accommodation, entertainment, shopping and dining. Chaweng, Bophut and Lamai also have busy shopping high-streets; Bophut in particular boasts an eclectic mix of boutique and luxury stores, most prominently in the newly built and stylish ‘The Wharf’ Shopping area. Known internationally for its comprehensive list of fine dining experiences and involvement of top class chefs, Samui is the first stop for many foodies exploring Thailand. The island hosts a plethora of 5 star dining establishments boasting top-class wine selections, artfully created dishes and opulent surroundings. Fortunately, not all eating experiences need pull so heavily on the purse strings, Samui offers a range to suit all budgets from boutique bistro’s, casual dining and, not forgetting, the impressive selection of local Thai restaurants offering a more affordable eating experience. Long-standing sophisticated beach clubs like Beach Republic and Nikki Beach serve top class food and beverages in chic poolside surroundings. For a livelier scene the bustling Chaweng high street, with it’s all-night bars and clubs attracts flocks of young travelers every night and regularly hosts international DJs and performers. Bophut’s small cobbled streets brimming with boutique bars and beachside restaurants is the perfect retreat for laid back, upmarket cocktail sipping. Lamai lies somewhere in between the two, appealing to both families and young people in search of a slightly less intense night out. Lipa Noi is favoured for romantic getaways, offering a secluded, yet still well catered option. Finally, displaying a delightful ramshackle charm, Nathon is a glimpse into a more authentic Thai residential experience away from the tourist route. For families moving to Koh Samui there is a wide choice of well-established nurseries and schools. International School Samui (ISS), Oonrack, Panyadee the British International Scool or Lamai International School provide reliable, internationally accredited education of high standard mostly following the English National Curriculum. There are a growing range of clubs and weekend activities available around the island to keep everyone in the family busy, including sporting clubs such as: football, dance, ju jitsu and horse riding and also more relaxed family days out at Coco Splash or Pink Elephant amusement park. Koh Samui is now easily very accessible both from within and outside Thailand; flights arrive and depart direct to Bangkok, Phuket, Pattaya, Singapore, Hong Kong and Kuala Lumpur and there are also two ferry piers serving the mainland. With this ease of access and so much on offer, Koh Samui has now become as much a place to live as it is a place to visit. With regard to real estate on Koh Samui, traditionally development on the island has been more abundant on the Northern and Eastern coasts mostly due to the proximity of busier towns, golf courses and of course the airport. These areas are significantly lucrative in terms of rental potential, and currently the most secure in terms of resale, as most tourists and buyers are still focusing on this part of the island. However, over the past few years the west coast has seen accelerated development, including a number of luxury hotels and resorts, so would certainly present an exciting opportunity for purchasers. Buddhist Monks realised Koh Phangan's tranquillity and spiritual importance and subsequently settled in Wat Phu Khao Noi just outside of the main town of Thong Sala as one of the first temples on the island. Within an area of approximately 167km2 with over 70% being unspoilt mountainous and tropical forest many more temples are nestled coherently within the islands natural flora and fauna offering a feast for the eyes of all visitors. Koh Phangan being relatively undiscovered and undeveloped still has the postcard perfect secluded deserted beach coves awaiting discovery via the traditional mode of transport, the long tail boat or for the more intrepid explorer by hike. You truly feel that you are the first to leave a footprint! In that vein Koh Phangan's beauty is emerging as an attractive destination for weddings and events. Due to Koh Phangan's granite structure, there are several small mountains where it's possible to trek/hike. The highest being Khao Raa at over 600m above sea level taking 2-3 hours to realise the summit. There is a bounty of wildlife from monkeys, wild boar, exotic reptiles to stunning birds of paradise not forgetting the spectacular coral reefs that envelop the plentiful bays where the amazing underwater world is accessible for snorkelers and divers equally.

LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain

RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.

SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.

SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.

LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)

STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area.

STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey

building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.

STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.

STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.

In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
