We appreciate your interest in running in the City of Rohnert Park’s Consolidated General Municipal Election to be held on Tuesday, November 5, 2024, to elect one City Councilmember from District 1, one City Councilmember from District 3 and one City Councilmember from District 4. This Candidate Information Guide has been prepared to make the process of running for office as simple as possible. It will assist in explaining various rules and regulations, however, it is not intended to be all-inclusive, and no one should rely solely on this Guide
As indicated on the Nomination Process Calendar provided in the Candidate’s Guidelines, the nomination period opens at 8:00 a.m. on July 15, 2024, and closes at 5:00 p.m. on August 9, 2024. If an incumbent does not file for re-election by 5:00 p.m. on August 9, 2024, the nomination period is extended to 5:00 p.m. on August 14, 2024, only for prospective candidates in the district for which an incumbent did not file. Please refer to the Nomination Process Calendar for other specific dates and deadlines. Filing your nomination papers early allows for ample review time to ensure legal requirements are met. You must schedule an appointment with the Clerk to file your nomination papers, which takes approximately 45 minutes.
Campaign laws, reporting, and Statement of Economic Interest forms can be complicated. The Candidate Information Guide includes helpful forms and resources, but you should also become familiar with the Fair Political Practices Commission (FPPC) website at www.fppc.ca.gov and use their tools available. Meeting Dates:
Second and fourth Tuesdays of each month, as well as other special meetings, as needed. Councilmembers also sit on various Boards and Commissions throughout Sonoma County and the Bay Area region, on behalf of the City of Rohnert Park
Mayor/Mayor Pro Tem: Each year in December at the Annual Reorganization Meeting, the City Council selects the Mayor and Mayor Pro Tem from among its members. The Mayor and Mayor Pro Tem are appointed to serve a one-year term. The Mayor Pro Tem acts as Mayor in the absence of the Mayor.
In order to be eligible to hold office as a member of the Council, a person must be a U.S. citizen, 18 years of age on or before Election Day, and a registered voter of the City of Rohnert Park district for which they are running at the time nomination papers are issued for their candidacy and shall continue to reside in the district for which they are elected during the term of office (Government Code § 34882, 34904, 36502)

A person is disqualified from holding any office upon conviction of designated crimes as specified in the California Constitution and laws of California (Government Code § 1021).
Section 36502 (a) - Elections Code
The Elections Official will verify with the Sonoma County Register of Voters that the Candidate is a registered voter and resides within the City of Rohnert Park District they wish to represent If, during their term of office, they move their place of residence outside or cease to be an elector of the City district they were elected to represent, their office shall immediately become vacant.
Offices to be filled: Three Council seats: One (1) Member of the City Council from District 1, One (1) Member of the City Council from District 3, and One (1) Member of the City Council from District 4.
Term of Office: Each member will represent the voters in the district in which they are elected for 4 years. The term will expire in December 2028
Benefits:
Current Salary = $484.06 per month. See Rohnert Park Municipal Code § 2.12 for more details.
Councilmembers are eligible for enrollment in City health insurance plans, deferred compensation, CalPERS, use of Sports Center, and Retirement Health Saving Account.

Rohnert Park Municipal Code 2.64 relates to City Elections and establishes the following:
2.64.010 - Municipal elections.
The general municipal election of the city of Rohnert Park shall be held on the first Tuesday after the first Monday in November of each even numbered year.

2.64.020 - Elected city officials affected by general election dates.
Those elected officials whose terms, prior to the adoption of this chapter would have expired no later than the fourth Tuesday after the date of the general municipal election which would have been held in June of even numbered years shall, instead, continue in their office until no later than the fourth Tuesday after the date of the general municipal election to be held in November of even numbered years.

Rohnert Park Municipal Code 2.65 relates to Campaign Finance Regulations: Limits the amount any person may contribute to a candidate to no more than $500 during an election cycle. Campaign funds acquired in one city election may not be used in any other future city election. Requires a third pre-election campaign statement.

Friday, August 9, 2024, at 5:00 p.m., will be the final date and time for filing any Nomination Papers; however, if an incumbent does not file for re-election by 5:00 p.m. on August 9, 2024, the nomination period is extended to 5:00 p.m. on August 14, 2024, only for prospective candidates in the district for which an incumbent did not file.

Write-In Candidates can pick up nomination documents starting Monday, September 9, 2024, at 8:00 a.m. Tuesday, October 22, 2024, at 5:00 p.m. will be the final date and time for filing any write-in nomination documents.

The City Rohnert Park does not collect a filing fee. However, candidates are required to pay the printing and translation costs of the Candidate’s Statement for any languages other than Spanish. (Please see Official Filing Requirements for additional information regarding costs)
Below is a list of forms and documents that will be provided at the time the Official Nomination Forms are issued. The list indicates which forms are optional and which are required to be filed. With the exception of Form 501, all required forms and any optional forms you decide to file, must be submitted at the same time.

This form is important and should be handled very carefully. It is recommended that candidates file as far in advance as possible of the deadline so that any deficiency in the papers may be found and cleared in time to qualify.
The first step to consider in completing your petition is to decide if you will personally be the circulator or if someone will circulate it for you. Remember, whoever circulates the petition must personally witness each person's signature. Also, if you have someone else circulate the petition for you, he/she must be 18 years of age or older and must complete the "Affidavit of Circulator". If the candidate chooses to personally be the circulator, the “Affidavit of Circulator” portion must be completed in the presence of the City Clerk at the time the candidate files their Nomination Paper. Do not sign it prior to that time.
The second step is to obtain the signatures. You will notice that the petition has 30 spaces for signatures. Although only 20 signatures are required, it is advisable to obtain 30. This will give you 10 extra signatures in case some of the first 20 signatures do not qualify. Signatures qualify if they are registered voters of the geographical area making up the City of Rohnert Park District in which you are qualified to run for office. Signatures and the residence address must match the information on the voter's registration card or affidavit on file at the Sonoma County Registrar of Voters Office. Please do not use ditto marks. Ensure names and addresses are written legibly. The signatures must be verified by the Sonoma County Registrar of Voters Office and if a name or address is not legible, verification may not be possible.
Section 105 Elections Code
For purposes of verifying signatures on any Nomination Paper, the Elections Official shall determine that the residence address on the petition is the same as the residence address on the affidavit of registration. If the addresses are different, the affected signature shall not be counted as valid.

The Ballot Designation Worksheet is the word or group of words that will appear on the ballot under the candidate’s name, designating the principal profession, vocation, or occupation of the candidate. It must be completed or it will not be accepted and you will not be entitled to a ballot designation. This worksheet corresponds with the Affidavit of the Nominee on the Declaration of Candidacy. The City Clerk, as Elections Official, follows the Secretary of State Ballot Designation Regulations set forth in the California Administrative Code, Chapter 7 (commencing with section 20710) and Elections Code 13107. In the event the candidate fails to file a Ballot Designation Worksheet, no designation shall appear under the candidate’s name on the ballot.
On the ballot immediately under the name of each candidate, and not separated from the name by any line, may appear, at the option of the candidate, only one of the following designations:
1.
Words designating the elective city, county, district, state, or federal office which the candidate holds at the time of filing the nomination documents to which they were elected by vote of the people.
2.
The word “incumbent” if the candidate is a candidate for the same office which they hold at the time of filing the nomination papers and was elected to that office by a vote of the people.
4.
No more than three words designating either the current principal professions, vocations, or occupations of the candidate, or the principal professions, vocations, or occupations of the candidate during the calendar year immediately preceding the filing of nomination documents.
3. The phrase “appointed incumbent” if the candidate holds an office by virtue of appointment, and the candidate is a candidate for election to the same office, or, if the candidate is a candidate for election to the same office or to some other office, the word “appointed” and the title of the office. In either instance, the candidate may not use the unmodified word “incumbent” or any words designating the office unmodified by the word “appointed.” However, the phrase “appointed incumbent” shall not be required of a candidate who seeks reelection to an office which he or she holds and to which he or she was appointed, as a nominated candidate, in lieu of an election, pursuant to Sections 5326 and 5328 of the Education Code or Section 7228, 7423, 7673, 10229, or 10515 of this code.
No election official shall accept a designation which: It would mislead the voter. 1.
It would suggest an evaluation of a candidate, such as outstanding, leading, expert, virtuous, or eminent. 2.

It abbreviates the word “retired” or places it following any word or words which it modifies.
4.
It uses a word or prefix, such as “former” or “ex-,” which means a prior status. The only exception is the use of the word “retired.”
5. It uses a word or words referring to a racial, religious, or ethnic group.
It uses the name of any political party, whether or not it has qualified for the ballot.
6. It refers to any activity prohibited by law.
7.
If, upon checking the nomination documents and the ballot designation worksheet, the elections official finds the designation to be in violation of any of the restrictions set forth in this section, the elections official shall notify the candidate by registered or certified mail return receipt requested, addressed to the mailing address provided on the candidate’s ballot designation worksheet. The candidate shall, within three days, excluding Saturday, Sunday, and state holidays, from the date he or she receives notice by registered or certified mail, or from the date the candidate receives actual notice of the violation, whichever occurs first, appear before the elections official and provide a designation that complies with this section.
In the event the candidate fails to provide an alternate designation, within the three-day period specified, a designation shall not appear after the candidate’s name.
No designation given by a candidate shall be changed by the candidate after the final date for filing Nomination Papers except as specifically requested by the election official under circumstances heretofore set forth.

For your reference, the relevant provisions of Elections Code section 13107 are reproduced below:
(a) With the exception of candidates for Justice of the State Supreme Court or court of appeal, immediately under the name of each candidate, and not separated from the name by any line, unless the designation made by the candidate pursuant to Section 8002.5 must be listed immediately below the name of the candidate pursuant to Section 13105, and in that case immediately under the designation, may appear at the option of the candidate only one of the following designations:
(1) Words designating the elective city, county, district, state, or federal office which the candidate holds at the time of filing the nomination documents to which the candidate was elected by vote of the people.
(2) The word “incumbent” if the candidate is a candidate for the same office which the candidate holds at the time of filing the nomination papers, and was elected to that office by a vote of the people. A candidate shall not use the word “incumbent” if the candidate was elected to their office in an at -large election and is a candidate in a district-based election.
(3) No more than three words designating either the current principal professions, vocations, or occupations of the candidate, or the principal professions, vocations, or occupations of the candidate during the calendar year immediately preceding the filing of nomination documents.
(4) The phrase “appointed incumbent” if the candidate holds an office by virtue of appointment, and the candidate is a candidate for election to the same office, or, if the candidate is a candidate for election to the same office or to some other office, the word “appointed” and the title of the office. In either instance, the candidate may not use the unmodified word “incumbent” or any words designating the office unmodified by the word “appointed.” However, the phrase “appointed incumbent” shall not be required of a candidate who seeks reelection to an office which the candidate holds and to which the candidate was appointed, as a nominated candidate, in lieu of an election, pursuant to Sections 5326 and 5328 of the Education Code or Section 7228, 7423, 7673, 10229, or 10515 of this code.
(b) (1) Except as specified in paragraph (2), for candidates for judicial office, immediately under the name of each candidate, and not separated from the name by any line, only one of the following designations may appear at the option of the candidate:
(A) Words designating the city, county, district, state, or federal office held by the candidate at the time of filing the nomination documents.
(B) The word “incumbent” if the candidate is a candidate for the same office that the candidate holds at the time of filing the nomination papers.
(C) No more than three words designating either the current principal professions, vocations, or occupations of the candidate, or the principal professions, vocations, or occupations of the candidate during the calendar year immediately preceding the filing of nomination documents.
(2) For a candidate for judicial office who is an active member of the State Bar employed by a city, county, district, state, or by the United States, the designation shall appear as one of the following:
(A) Words designating the actual job title, as defined by statute, charter, or other governing instrument.
(B) One of the following ballot designations: “Attorney,” “Attorney at Law,” “Lawyer,” or “Counselor at Law.” The designations “Attorney” and “Lawyer” may be used in combination with one other current principal profession, vocation, or occupation of the candidate, or the principal profession, vocation, or occupation of the candidat e during the calendar year immediately preceding the filing of nomination documents.
(3) A designation made pursuant to subparagraph (A) of paragraph (1) or paragraph (2) shall also contain relevant qualifiers, as follows:
(A) If the candidate is an official or employee of a city, the name of the city shall appear preceded by the words “City of.”
(B) If the candidate is an official or employee of a county, the name of the county shall appear preceded by the words “County of.”
(C) If the candidate is an official or employee of a city and county, the name of the city and county shall appear preceded by the words “City and County.”
(D) If the candidate performs quasi-judicial functions for a governmental agency, the full name of the agency shall be included.
(c) A candidate for superior court judge who is an active member of the State Bar and practices law as one of the candidate’s principal professions shall use one of the following ballot designations as the candidate’s ballot designation: “Attorney,” “Attorney at Law,” “Lawyer,” or “Counselor at Law.” The designations “Attorney” and “Lawyer” may be used in combination with one other current principal profession, vocation, or occupation of the candidate, or the principal profession, vocation, or occupation of the candidate during the calendar year immediately preceding the filing of nomination documents.
(d) For purposes of this section, all California geographical names shall be considered to be one word. Hyphenated words that appear in any generally available standard reference dictionary, published in the United States at any time within the 10 calendar years immediately preceding the election for which the words are counted, including a generally available standard reference dictionary published online, shall be considered as one word. Each part of all other hyphenated words shall be counted as a separate word.
(e) The Secretary of State and any other elections official shall not accept a designation of which any of the following would be true:

(1) It would mislead the voter.
(2) It would suggest an evaluation of a candidate, such as outstanding, leading, expert, virtuous, or eminent.
(3) It abbreviates the word “retired” or places it following any word or words which it modifies.
(4) It uses a word or prefix, such as “former” or “ex-,” which means a prior status. The only exception is the use of the word “retired.”
(5) It uses the name of any political party, whether or not it has qualified for the ballot.
(6) It uses a word or words referring to a racial, religious, or ethnic group.
(7) It refers to any activity prohibited by law.
(f) If, upon checking the nomination documents and the ballot designation worksheet described in Section 13107.3, the elections official finds the designation to be in violation of any of the restrictions set forth in this section, the elections official shall notify the candidate by registered or certified mail return receipt requested, addressed to the mailing address provided on the candidate’s ballot designation worksheet.
(1) The candidate shall, within three days, excluding Saturday, Sunday, and state holidays, from the date the candidate receives notice by registered or certified mail, or from the date the candidate receives actual notice of the violation, whichever occurs first, appear before the elections official or, in the case of the Secretary of State, notify the Secretary of State by telephone, and provide a designation that complies with subdivision (a) or (b).
(2) If a candidate fails to provide a designation that complies with subdivision (a) or (b) within the three- day period specified in paragraph (1), a designation shall not appear after the candidate’s name.
(g) A designation given by a candidate shall not be changed by the candidate after the final date for filing nomination documents, except as specifically requested by the elections official as specified in subdivision (f) or as provided in subdivision (h). The elections official shall maintain a copy of the ballot designation worksheet for each candidate that appears on the ballot in the county for the same period of time as applied to nomination documents pursuant to Section 17100.
(h) The designation shall remain the same for all purposes of both primary and general elections, unless the candidate, at least 98 days before the general election, requests in writing a different designation which the candidate is entitled to use at the time of the request.
(i) In all cases, the words so used shall be printed in a manner consistent with the space requirements of Sections 13207 and 13211.
(j) If a foreign language translation of a candidate’s designation is required under the federal Voting Rights Act of 1965 (52 U.S.C. Sec. 10101 et seq.), as amended, to appear on the ballot in addition to the English language version, it shall be as short as possible, as consistent as is practicable with this section, and shall employ abbreviations and initials wherever possible in order to avoid undue length.
For your reference, Elections Code section 13107.3 is reproduced below:
(a) A candidate who submits a ballot designation pursuant to subdivision (a) of Section 13107 shall file a ballot designation worksheet that supports the use of that ballot designation by the candidate, in a format prescribed by the Secretary of State.
(b) The ballot designation worksheet shall be filed with the elections official at the same time that the candidate files his or her declaration of candidacy.
(c) In the event that a candidate fails to file a ballot designation worksheet in accordance with subdivision (a), no designation shall appear under the candidate’s name on the ballot.
For your reference, Elections Code section 13107.5 is reproduced below:
(a) A candidate’s ballot designation as “community volunteer” shall constitute a valid principal vocation or occupation for purposes of subdivision (a) of Section 13107, if not otherwise in violation of any of the restrictions set forth in that section, and subject to the following conditions:
(1) A candidate’s community volunteer activities constitute his or her principal profession, vocation, or occupation.
(2) A candidate is not engaged concurrently in another principal profession, vocation, or occupation.
(3) A candidate may not use the designation of “community volunteer” in combination with any other principal profession, vocation, or occupation designation.
(b) The Secretary of State shall by regulation define what constitutes a community volunteer for purposes of this section.

(a) In order to facilitate review of a candidate's proposed ballot designation by the Secretary of State pursuant to Elections Code § 13107, the candidate shall submit, at the time of filing his or her proposed ballot designation on the Declaration of Candidacy, a completed Ballot Designation Worksheet on a form provided by the Secretary of State.
(b) All Ballot Designation Worksheets filed with the Office of the Secretary of State or the county elections officials pursuant to this section shall be public records and shall be available for inspection and copying at the public counter of the Elections Division of the Office of the Secretary of State, Fifth Floor, 1500 11th Street, Sacramento, California 95814, or at the office of the applicable county elections official.
(c) The Secretary of State shall provide a master copy or copies of the Ballot Designation Worksheet to all elections officials responsible for providing and accepting the nomination documents for candidates in elections for offices certified by the Secretary of State. The Ballot Designation Worksheet shall request that the candidate proposing the ballot designation provide the following information:
(1) The candidate's name, home, business and mailing addresses, telephone numbers, e- mail address, if available, and fax number;
(2) A designation of the office for which the candidate is seeking election;
(3) The name, home, business and mailing addresses, telephone numbers, e- mail address, if available, and fax number of the attorney representing the candidate or for any other person to be contacted in the event the Secretary of State requires further information regarding the proposed ballot designation;
(4) The proposed ballot designation submitted by the candidate;
(5) The candidate may submit one or more proposed alternate ballot designations ranked in order of the candidate's preference;
(6) A brief statement identifying the factual basis upon which the candidate claims the proposed ballot designation and each proposed alternate ballot designation, including the following:
(A) If the candidate holds elected office and is submitting his or her proposed ballot designation pursuant to Elections Code § 13107, subdivisions (a)(1) or (a)(2), the candidate shall indicate the elective office he or she currently occupies and may attach a copy of his or her Certificate of Election;
(B) If the candidate is a judicial officer and is submitting his or her proposed ballot designation pursuant to Elections Code § 13107, subdivisions (a)(1) or (a)(2), the candidate shall indicate the elective office he or she currently holds and may attach either (A) a copy of his or her Certificate of Election or (B) a copy of his or her commission or certificate of appointment, issued at the time the candidate was appointed to the judicial office which he or she currently occupies;
(C) If the candidate submits a ballot designation pursuant to Elections Code § 13107, subdivision (a)(3), the candidate shall indicate:
(i) The title of the position or positions which he or she claims supports the proposed ballot designation;
(ii) The dates during which the candidate held such position;
(iii) A description of the work he or she performs in the position;
(iv) The name of the candidate's business or employer;
(v) The name and telephone number of a person or persons who could verify such information; and
(vi) A statement that the professions, vocations or occupations relied upon to support the proposed ballot designation constitute the primary, main or leading professions, vocations or occupations of the candidate, in accordance with the definition of the term “principal” as set forth at § 20714, subdivision (b).
(D) If the candidate submits a ballot designation pursuant to Elections Code § 13107, subdivision (a)(4), the candidate shall indicate the date on which he or she was appointed to the office for which he or she is an appointed incumbent.
(d) The candidate may attach or append any supporting documents or other exhibits to his or her Ballot Designation Worksheet which he or she believes support his or her proposed ballot designation. Such attached documents or other exhibits shall be deemed to be incorporated by reference as part of the candidate's Ballot Designation Worksheet and shall be considered as such by the Secretary of State.
(e) If a candidate requests a change of his or her ballot designation pursuant to Elections Code § 13107(e), that request shall be accompanied by a Ballot Designation Worksheet.

Elections Code Section 13311 makes the Candidate’s Statement confidential until the close of nominations. The purpose of confidentiality is to prevent candidates from writing what amounts to a rebuttal. Pursuant to Elections Code 13313, Candidate Statements of Qualifications will be available for public examination for a period of 10 (ten) calendar days immediately following the close of the nomination period.

Each candidate for elective office in any local agency, city, county or dist rict may prepare a statement for mailing with County Voter Information Guides on a form provided by the Registrar of Voters. The statement may include the name, age and occupation of the candidate and a brief description of no more than 200 words (unless increased to 400 words by the governing body), written in the first person (i.e. , “I am running…” not “She is running…” or “Jane Doe is running…”) of the candidate’s own education and qualifications. The statement shall n ot include the party preference of the candidate, nor membership or activity in partisan political organizations. The statement shall be filed in the office of the el ections official when the candidate’s nomination papers are returned for filing i f it is for a primary election or for an e lection for offices for which there is no primary. The statement shall be filed in the office of the elections official no later than the 88 th day before the election if it is for an election for which nomination papers are not required to be filed. Once filed, a statement may not be changed; however, the statement may be withdrawn during the period for filing nomination papers and until 5 p.m. of the next working day after the close of the nomination period.
In addition to the restrictions set forth above, any candidate’s statement submitt ed pursuant to Section 13307 shall be limited to a recitation of the candidate’s own personal background and qualifications , and shall not in any way make reference to other candidates for that office or to another candidate’s qualifications, character, or activities. The elections official shall not cause to be printed or circulated any sta tement which the elections official determines is not so limited or which includes any such references.
Before the nominating period opens, the local agency for that election shall determine whether a charge shall be levied against that candidate for the candidate’s statement sent to each voter. Your name, age and occupation are not included in the word count. If you leave your age or occupation blank, it will not be printed (we will not contact you to determine whether this was intentional). Your occupation is not subject to the same restrictions that apply to your ballot designation ; however, reason must apply and occupations exceeding one line will be shortened. Statements are printed in BLOCK PARAGRAPH STYLE with spacing between paragraphs (no indentations). Words in all capitals, indentations, italics, underlines, stars, dots, etc., are prohibited. Lists and enumerations will be wrapped as a single paragraph. Multiple single sentence paragraphs that do n ot fit in the space allotted will be wrapped. This office will not be responsible for the accurate printing of any statement which must be reconfigured to comply with thes e guidelines Although we prefer that the statement be submitted on our for m, we do accept statements that are typewritten (or computer generated) and attached to our form. Statements of Qualifications are optional an d, unless otherwise determined by the governing body, are printed at the expense of the candidate. Candidates who are required to prepay the estimated costs will either be billed for the additional costs or refunded any over payment following the election. Estimated costs for Statements of Qualifications are based o n the printer's price list, set -up fees and the number of registered voters within the jurisdiction. Estimates are for statements not exceeding 200 words. Final costs will be determined by the number of candidate statements, including English and Spanish that are submitted for an individual office. If the number of candidate statements submitted is not evenly divisible by two, and the statement cannot be printed with any others, the run charges and set up fees are increased. These charges are prorated among the candidates for a particular contest. Candidates are required to submit a check with “not to exceed” the highest possible cost for 1, written under the amount line, (Elections Code §13307(c)). All checks will be held until after the final deadline to withdraw a candidate statement.

In the case of a committee making an independent expenditure, as defined in Section 82031 of the Government Code, the Secretary of State shall provide a blank form and a copy of this chapter to the individual filing, in accordance with Title 9 (commencing with Section 81000) of the Government Code, an initial campaign statement on behalf of the committee.

Candidate Intention Statement (Form 501) must be filed before you solicit or receive any contributions or before you make expenditures from personal funds on behalf of your candidacy, and is not necessarily filed at same time as nomination papers.

Every elected official and public employee who makes or influences governmental decisions is required to submit a Statement of Economic Interest, also known as the Form 700. The Form 700 provides transparency and ensures accountability in two ways:
It provides necessary information to the public about an official’s personal financial interests to ensure that officials are making decisions in the best interest of the public and not enhancing their personal finances.
It serves as a reminder to the public official of potential conflicts of interest so the official can abstain from making or participating in governmental decisions that are deemed conflicts of interest.
When you file your Nomination Paper, you will be required to complete a Form 700. All Forms 700’s for any city office are filed with the City Clerk and are forwarded to the Fair Political Practices Commission in accordance with Political Reform Act of 1974.

State and local candidates and officeholders who intend to raise or spend campaign funds must file with the City Clerk a Form 501 (Candidate Intention) before soliciting or receiving any contributions (including loans) or making expenditures from personal funds. If you do not plan to raise or spend any money, including personal funds, you do not need to file this form. Please refer to the Campaign Disclosure Manual 2 for instructions on completing the form.
Form 410 must be filed by all candidates and "recipient committees" who have received $2,000 or more in contributions (including the candidate's personal funds) during a calendar year
The Form 410 must be filed with the Secretary of State include a payment of $50 made payable to the Secretary of State within 10 days of receiving $2,000 in contributions The Secretary of State will issue an identification number to the committee The identification number is to be included on all campaign disclosure forms If any of the information on a Statement of Organization changes, the committee must file an amendment to the Statement within 10 days of the change Please refer to the Campaign Disclosure Manual 2 for instructions on completing the form.
There are special requirements for committees which qualify (i.e., receive $2,000) during the 90 days prior to an election in which the committee would otherwise be required to file pre election statements and for committees, which must amend certain information contained on a Statement of Organization during the 90 days before an election.
If any of the information on a Statement of Organization changes, the committee must file an amendment within 10 days of the change. Please see Form 410 for special requirements during the 16-day period prior to the election.
CANDIDATE CAMPAIGN STATEMENT - SHORT FORM AND SUPPLEMENT (FORM 470)

Form 497 24-hour Contribution Report provides immediate reporting of contribution received or made near or on the election date. Form 497 must be filed if a committee receives or makes contributions that total in the aggregate of $1,000 or more.
A late contribution includes contributions or loans from a candidate to their campaign committee during the late contribution period.
Note: Rohnert Park Municipal Code limits the amount any person may contribute to a candidate to no more than $500 during an election cycle.
A Late Contribution Report must be sent via telegram, mailgram, guaranteed overnight delivery service, fax, or personal delivery. Regular mail may not be used. The Report must be filed within 24 hours of the time the contribution was made. The recipient must also file a Report within 24 hours of receiving the late contribution. The Report must be filed at the City Clerk's Office, 130 Avram, Rohnert Park, California.

2.65.010 - Purpose.
The city council seeks to reduce the actual and perceived influence of contributions on elected officials by limiting the amount of campaign contributions for candidates and to further the goal of an informed electorate by supplementing the campaign disclosure requirements and related regulations set forth in the Political Reform Act of 1974.

2.65.020 - Definitions.
"Candidate" means any individual who is a candidate for an elected city office in a city election.
"City election" means any general election, special election or recall election.
"Election cycle" means the applicable period as set forth in Section 2.65.060 of this chapter.
"Person" means an individual, committee, proprietorship, firm, partnership, joint venture, syndicate, business trust, company, corporation, limited liability company, association and any other organization or group of persons acting in concert.
"Political Reform Act of 1974" means California Government Code section 81000 et seq., as amended from time to time.
"Recall election cycle" means the applicable period as set forth in Section 2.65.060.
Unless expressly defined in this chapter, or the contrary is stated or clearly appears from the context, words and phrases in this chapter shall have the same definition and meaning as when they are used in the Political Reform Act of 1974, as that Act may be amended from time to time.

2.65.030 - Contribution limitations—General.
A. No person shall make to any candidate or candidate-controlled committee, and no such candidate or candidate-controlled committee shall accept from any person, a contribution or contributions totaling more than five hundred dollars in an elective city office election cycle.
B. The contribution limitations set forth in subsection (A) of this section shall also apply to any committee that collects contributions for the purpose of making expenditures in support of or opposition to the recall of an elective city officer, and to contributions received by such elective city officer, during a recall election cycle.
C. The provisions of this section shall not apply to a candidate's contribution of his or her personal funds, community property funds, or domestic partnership funds to his or her own campaign committee.
D. A contribution shall not be considered to be received if it is not negotiated, deposited or utilized and, in addition, is returned to the donor within fourteen days of receipt.
E. The five hundred dollar limitation established by this section shall be reviewed by the city council in January of every fourth year commencing in 2010 to determine whether such limitation shall remain the same or be increased or decreased. Any amendment of the limitation must be done by ordinance and shall be preceded by at least one public hearing.

2.65.040 - Contribution limitations—Aggregation of contributions.
The contributions of any person whose contributions are directed and controlled by another person shall be aggregated with those of the controlling person for purposes of the contribution limits. With respect to family contributions, contributions by a husband and wife or by domestic partners shall be treated as separate contributions and shall not be aggregated. Contributions by children under eighteen years of age shall be treated as contributions by their parent(s), custodian(s), or guardian(s) and shall be attributed proportionately to each parent, custodian or guardian.

2.65.050 - Multiple campaign committees.
A. A candidate in a city election shall have no more than one candidate-controlled committee and such controlled committee shall have only one bank account out of which all qualified campaign and officeholder expenses related to that office shall be made.
B. This section does not prevent a candidate in a city election from establishing another candidate-controlled committee solely for the purpose of running for a state, federal, county or other elective office, or for opposing his or her recall.

2.65.060 - Election cycles.
A. General and Special Election Cycles. For the purposes of this chapter and with regards to campaigns for elective city offices, contributions to a candidate shall be deemed election contributions if such contributions are made at any time between the date that the candidate assumed office following the previous election and extending to the close of the third business day prior to the subsequent election date for that office seat.
B. Recall Election Cycle. For the purposes of this chapter and with regards to recall elections, contributions shall be deemed to have been made during a recall election cycle if they are made at any time after a committee has been formed pursuant to the provisions of the Political Reform Act of 1974 in support of a recall election, or after the clerk of the city of Rohnert Park has approved a recall petition for circulation and gathering of signatures, whichever occurs first. A recall election cycle shall end whenever any of the following events occur:
The recall proponent fails to return signed petitions to the clerk of the city of Rohnert Park within the time limits prescribed by the California Elections Code;
1. All committees formed in support of the recall have been terminated pursuant to the provisions of the Political Reform Act of 1974; or
3.
2. Ten days after a recall election has been held.

2.65.070 - Use of surplus funds for future city elections.
Campaign funds acquired in one city election may not be used in any other future city election.

2.65.080 - Disclosure requirement.
A. Each candidate or candidate-controlled committee in a city election shall provide detailed itemization, as defined in the California Political Reform Act of 1974, for all contributions received in a cumulative amount of one hundred dollars or more.
B. Each candidate or candidate-controlled committee in a city election shall file a third pre-election Campaign Disclosure Statement (Government Form 460 or any successor form thereto), as provided by the California Fair Political Practices Commission, for the period from the end of the period covered by the second pre-election statement to 11:59 p.m. on the third business day immediately preceding election day (normally Thursday). Such statement shall be filed with the clerk of the city of Rohnert Park by 5:00 p.m. on the second business day immediately preceding election day (normally Friday).

2.65.090 - Disclosure of occupation and employer.
No campaign contribution required to be reported by the Political Reform Act of 1974 (cumulative or otherwise) shall be deposited into a campaign bank account of a candidate or of a candidate-controlled committee, unless the disclosure information required by the Political Reform Act of 1974, including the name, address, occupation and employer of the contributor, or, if self-employed, name of business, is on file in the records of the recipient of the contribution. This information is to be reported on each campaign statement required to be filed by the Political Reform Act of 1974.

2.65.100 - Disclosure of cumulative contributions.
Cumulative contributions for each contributor of one hundred dollars or more in an election cycle shall be itemized and reported on each campaign statement required to be filed by the Political Reform Act of 1974.

2.65.110 - Penalties.
A. Criminal Penalties. Any person who knowingly or willfully violates any provision of this chapter shall be guilty of a misdemeanor. In addition to other penalties provided by law, the penalty upon conviction of such person shall be by a fine in accordance with Government Code Section 91000.
B. Civil Penalties. Any person who intentionally or negligently violates any of the reporting requirements of this chapter may be sued in a civil action in accordance with Government Code Sections 91004 and following.
C. Cumulative Remedies. The foregoing remedies shall be deemed non-exclusive, cumulative and in addition to any other remedy the city of Rohnert Park may have at law or in equity. (Ord. 750 § 1 (part), 2005)

Political signs are a traditional means of expressing a candidate's philosophy or position. As a candidate for City Council, your interest in reducing litter and preventing aesthetic blight is appreciated. Rohnert Park Zoning Code 17.27.050 regulates political signs to prevent an undue concentration of signs and clutter throughout the City and avoid an embarrassing situation from occurring to you or members of your campaign staff.

Campaign signs are not permitted on any public property or within any public right-ofway.
Campaign signs placed upon privately owned property must receive consent of the owner or occupant.
Campaign signs must be removed within ten (10) days after the day of the election. The person placing the sign, owner, or occupant of the premises upon which the sign is placed are each responsible for the removal of sign.

The Political Reform Act specifies that a candidate or committee who sends a mass mailing (200 or more identical or nearly identical pieces of mail in a calendar month) must identify itself on the mailer.
The Election Code 16 requires that city and county clerks or election officials provide a copy of Government Code Section 84305 to each candidate, or their agent, at the time that a declaration of candidacy is filed. A copy of Section 84305 is included on the following pages and a hard copy will be included with your nomination papers.

84305.(a) (1) Except as provided in subdivision (b), a candidate, candidate controlled committee established for an elective office for the controlling candidate, or political party committee shall not send a mass mailing unless the name, street address, and city of the candidate or committee are shown on the outside of each piece of mail in the mass mailing and on at least one of the inserts included within each piece of mail of the mailing in no less than 6-point type that is in a color or print that contrasts with the background so as to be easily legible.A post office box may be stated in lieu of a street address if the candidate’s, candidate controlled committee established for an elective office for the controlling candidate’s, or political party committee’s address is a matter of public record with the Secretary of State.
(2) Except as provided in subdivision (b), a committee, other than a candidate controlled committee established for an elective office for the controlling candidate or a political party committee, shall not send a mass mailing that is not required to include a disclosure pursuant to Section 84504.2 unless the name, street address, and city of the committee is shown on the outside of each piece of mail in the mass mailing and on at least one of the inserts included within each piece of mail of the mailing in no less than 6-point type that is in a color or print that contrasts with the background so as to be easily legible.A post office box may be stated in lieu of a street address if the committee’s address is a matter of public record with the Secretary of State.
(b) If the sender of the mass mailing is a single candidate or committee, the name, street address, and city of the candidate or committee need only be shown on the outside of each piece of mail.
(c) (1) A candidate, candidate controlled committee established for an elective office for the controlling candidate, or political party committee shall not send a mass electronic mailing unless the name of the candidate or committee is shown in the electronic mailing preceded by the words “Paid for by” in at least the same size font as a majority of the text in the electronic mailing.
(2) A committee, other than a candidate controlled committee established for an elective office for the controlling candidate or a political party committee, shall not send a mass electronic mailing that is not required to include a disclosure pursuant to Section 84502 or 84504.3 unless the name of the committee is shown in the electronic mailing preceded by the words “Paid for by” in at least the same size font as a majority of the text in the electronic mailing.
(d) If the sender of a mass mailing is a controlled committee, the name of the person controlling the committee shall be included in addition to the information required by subdivision (a) or (c).
(e) For purposes of this section, the following terms have the following meanings:
(1) “Mass electronic mailing” means sending more than 200 substantially similar pieces of electronic mail within a calendar month. “Mass electronic mailing” does not include a communication that was solicited by the recipient, including, but not limited to, acknowledgments for contributions or information that the recipient communicated to the organization.
(2) “Sender” means the candidate, candidate controlled committee established for an elective office for the controlling candidate, or political party committee who pays for the largest portion of expenditures attributable to the designing, printing, and posting of the mailing which are reportable pursuant to Sections 84200 to 84216.5, inclusive.
(3) To “pay for” a share of the cost of a mass mailing means to make, to promise to make, or to incur an obligation to make, any payment: (A) to any person for the design, printing, postage, materials, or other costs of the mailing, including salaries, fees, or commissions, or (B) as a fee or other consideration for an endorsement or, in the case of a ballot measure, support or opposition, in the mailing.
(f) This section does not apply to a mass mailing or mass electronic mailing that is paid for by an independent expenditure.

Section 18370, 18371 - Elections Code
No person, on Election Day, or at any time that a voter may be casting a ballot, shall, within 100 feet of a polling place or an elections official’s office:
a) Circulate an initiative, referendum, recall, or nomination petition or any other petition.
b) Solicit a vote or speak to a voter on the subject of marking his or her ballot.
c) Place a sign relating to voters’ qualifications or speak to a voter on the subject of his or her qualifications except as provided in Section 14240.
d) Do any electioneering.
As used in this section, “100 feet of a polling place or an elections official’s office” means a distance 100 feet from the room or rooms in which voters are signing the roster and casting ballots.
Any person who violates any of the provisions of this section is guilty of a misdemeanor.

The Secretary of State will conduct a random alphabetical drawing on August 15, 2024 to determine the order in which qualified candidates’ name shall appear on the ballot for election held on November 5, 2024 The resulting order of letters constitutes the "randomized alphabet" to be used for determining the order of candidates' names on the ballot

1. When do the newly-elected Councilmembers take office?
The oath of office is tentatively scheduled to be administered by the City Clerk at the City Council Reorganization Meeting on December 10, 2024.
2. Where are election results available?
Official election results will begin being posted online shortly after 8:00 p.m. on Election Night and posted on the Sonoma County Registrar of Voters (ROV) website https://sonomacounty.ca.gov/
3. When will the official results of the election be received and certified?
The Sonoma County Registrar of Voters will commence canvassing and certify the results of the election no later than December 5, 2024. The City Clerk is tentatively scheduled to present the results at the December 10, 2024, City Council Reorganization Meeting.
4. How does Rohnert Park government work?
Rohnert Park follows a Council/Manager form of local government, with a Council elected by the people and charged with the basic responsibility for governing the community and a City Manager appointed by the Council to manage the City organization.
5. What is the difference between the City Council and City Manager?
Rohnert Park is a California municipal corporation. The City Council is the community’s legislative body and is similar to the Board of Directors of a private or public corporation. The Council provides direction on business matters, sets policy, adopts the annual budget, and hires/evaluates the performance of the City Manager. The City Manager serves as the City Council’s chief advisor, prepares the budget, oversees staff, and acts to carry out City Council programs. Because the City Council is the legislative body, its members are the community’s elected decision makers. The City Manager is hired to serve at the pleasure of the City Council as its full-time executive whose job is to administer staff, projects, and programs on behalf of the City Council.
6. What does the Mayor do?
The Mayor represents the City at community functions, maintains liaison with other governmental agencies, and serves as the presiding officer at City Council meetings. The City Councilmember who will serve as Mayor is selected each year by the City Council. The City Council also selects a Mayor Pro Tem to act for the Mayor when not available.
7. What are City Council/City Manager Policies?
The City Council retains the sole power of being the policy making and legislative body for the City. However, both the City Council and City Manager have responsibility for initiating consideration of new policies. The City Manager routinely prepares policy alternatives and recommendations for consideration by the City Council. The City Council may adopt, reject, or modify the recommendations. The City Manager is bound by whatever action the City Council takes and is responsible for implementation of City Council-approved policies.
8. Who appoints city officials?
The City Council is responsible for appointing the City Manager and City Attorney. The City Manager, serving as the City’s Executive Officer, is responsible for appointing all other employees.
9. What does the City Manager do?
The City Manager exercises general supervision and provides direction to the city staff. The Leadership Team (Directors) report to the City Manager. The Council interacts with the administration of the City through the City Manager
10. Who handles the City Council Meeting Agenda?
The City Council generally meets twice a month on Tuesdays to consider and act on City business The agenda is coordinated via the City Clerk Department under the direction of the City Manager with items submitted from the City Council through the City Manager, City Manager, City Attorney, and City Departments
11. Who appoints the City Commission, Committee, and Board Members?
The City Council appoints members of official City Boards, Committees, and Commissions
12. Who prepares the City Budget?
