Cu 13 ani în urmã începea visul frumos de a avea, cu adevãrat, o revistã de specialitate dedicatã industriei de jocuri de noroc din România.

Acum acest vis s-a transformat în realitate, ºi mai mult decât atât, este stindardul industriei în lupta sa cu cei care-i vor rãul ºi în acelaºi timp standardul de profesionalism dupã care se ghideazã mulþi atunci când vine vorba de comunicare. Am demonstrat cã aceastã industrie se poate bizui pe noi atunci când are nevoie, fiind proactivi ºi foarte implicaþi în momentele în care evenimentele din viaþa noastrã au cerut-o. 2022 a fost un an foarte prolific pentru noi, un an al succeselor ºi al premierelor. Am realizat prima ediþie a singurului Târg de Joburi dedicat industriei de entertainment – JOBS IN ENTERTAINMENT (JIE). Fiind prima datã când în media s-a discutat despre domeniul nostru ca unul al distracþiei, asociindu-se clar ideea de industrie de gambling cu cea de entertainment. Mai mult decât atât, în apariþiile din presa generalistã s-a discutat despre industria noastrã ca despre una care oferã condiþii de muncã foarte bune, un mediu sãnãtos de dezvoltare personalã ºi profesionalã ºi un loc în care tehnologia se armonizeazã perfect cu dorinþa oamenilor de a oferi distracþie altor semeni de-ai lor. Casino Inside oferã cel mai bun conþinut dedicat industriei de gambling, fiind o revistã apreciatã ºi peste hotare, mulþi clienþi externi dorind sã fie prezenþi în paginile revistei noastre, pe siteurile noastre sau la evenimentele organizate de noi. De acum înainte nu putem sã nu ne mai implicãm, nu ne mai putem preface cã lucrurile nu se întâmplã ºi cã nu ne afecteazã. Solidaritatea va fi cuvântul de ordine ºi în 2023 ºi cu siguranþã multe lucruri se vor schimba în planul comunicãrii. Iar noi vom fi aici, ca sã vã fim alãturi. Pentru cã sigur anul viitor va fi un an al provocãrilor ce þin de comunicare cãtre exteriorul domeniului, vã asigurãm de tot suportul nostru.

Industria de jocuri de noroc din þara noastrã nu are prea mulþi prieteni pentru cã nu e un domeniu aducãtor de voturi. Dimpotrivã. Lumea evitã sã se asocieze cu noi pentru cã pierde la capitolul imagine. Lucrurile trebuie sã se schimbe. ªi sunt convins cã se vor schimba în timp, ºi chiar într-o perioadã scurtã de timp, pentru cã nu avem încotro... Lumea, viaþa, timpurile ne vor bãga în malaxor ºi vor încerca sã ne scoatã fãrâme. De ce? Pentru cã este lumea ignorantã ºi ipocritã, pentru cã viaþa e grea ºi are nevoie de þapi ispãºitori, buni de arãtat cu degetul pentru eºecuri, iar timpurile sunt schimbãtoare ºi poate chiar neprielnice. Ce va fi în 2023, nu ºtim, dar sã ne pregãtim de rãzboi, dacã vrem pace. Casino Inside e aici!

Thirteen years ago, the beautiful dream of having, truly, a specialized magazine dedicated to the Romanian gambling industry began.

Now this dream has become a reality, and more than that, it is the industry’s banner in its fight against those who would do it harm and at the same time the standard of professionalism that many are guided by when it comes to communication.

We have proven that this industry can rely on us when it needs us, being proactive and highly engaged at times when events in our lives have demanded it.

2022 was a very prolific year for us, a year of successes and firsts. We held the first edition of the only Job Fair dedicated to the entertainment industry - JOBS IN ENTERTAINMENT (JIE). It was the first time that our field was discussed in the media as an entertainment field, clearly associating the idea of the gambling industry with that of entertainment. Moreover, in mainstream media appearances our industry has been discussed as one that offers great working conditions, a healthy environment for personal and professional development and a place where technology is perfectly matched to people’s desire to entertain their fellow human beings.

Casino Inside offers the best content dedicated to the gambling industry and is a magazine that is appreciated abroad, with many external clients wanting to be present in our magazine’s pages, on our websites or at our events. Casino Inside is a strong pillar of the industry.

We are an inspiration to some and a benchmark of professionalism to others. We come up with good ideas and put them into practice so that the gambling industry moves forward towards maturity and empowerment. The time of apathy and ignorance is over. From now on, we can no longer stop getting involved, we can no longer pretend that things don’t happen and that they don’t affect us. Solidarity will also be the watchword in 2023 and many things will certainly change in terms of communication. And we will be here to stand by you. Because next year will certainly be a year of communication challenges for the outside world, we assure you of our full support.

The gambling industry in our country does not have many friends because it is not a field that brings in votes. On the contrary. People avoid associating with us because they lose out on image. Things need to change. And I’m convinced that they will change in time, and even in a short period of time, because we have no choice...The world, life, the times will put us in a melting pot and try to pull us apart. Why? Because the world is ignorant and hypocritical, because life is hard and needs scapegoats, good for pointing fingers for failures, and times are changeable and perhaps even unkind. Pe scurt, aceºtia vor avea: (i) obligaþia de a deþine mijloacele tehnice pentru întocmirea bazelor de date referitoare la persoanele autoexcluse ºi indezirabile în vederea obþinerii autorizaþiei de exploatare a jocurilor de noroc, (ii) obligaþia de a identifica persoanele care intrã în incinta locaþiilor în care se organizeazã jocuri de noroc ºi de a þine evidenþa, în format electronic, a datelor de identificare ale acestora, bazele de date astfel constituite arhivându-se prin grija organizatorului ºi pãstrându-se pentru un interval de minimum 5 ani de la constituire, respectiv (iii) obligaþia organizatorilor jocurilor de noroc de a întocmi, în format electronic, bazele de date referitoare la persoanele autoexcluse ºi indezirabile, bazele de date astfel constituite arhivându-se prin grija organizatorului ºi pãstrându-se pentru un interval de minimum 5 ani de la constituire.

The recent legislative amendments brought by Law No. 326/2022 amending and supplementing Government Emergency Ordinance No. 77/2009 on the organization and operation of games of chance impose a set of new obligations on gambling operators. In summary, gambling operators will have:

(i) the obligation to have the necessary technical means for the establishment of databases on self-excluded and undesirable persons in order to obtain the authorization to operate games of chance;

(ii) the obligation to identify the persons entering the premises where gam activities take place and to keep a record, in electronic format, of their identification data, the databases thus constituted being archived by the operator and kept for a minimum period of 5 years from their creation, and,

(iii) the obligation for organizers of games of chance to establish, in electronic format, databases relating to self-excluded and undesirable persons, the databases thus established being

archived by the operator and kept for at least 5 years after their creation.

Although we expect the methodological norms to elaborate on how such obligations should be implemented, it is important to emphasize that the implementation of such obligations must be done taking into account the applicable rules on the protection of personal data. Thus, below we captured some of the aspects that need to be addressed in this context.

What is the basis for processing this data?

The data will be processed for the fulfilment of a legal obligation incumbent on the gambling operators, which is permitted under the applicable personal data protection requirements.

What personal data can I process?

To answer this question, gambling operators must take into account the principle of data minimization, i.e., the processing of only that data that is adequate, relevant and limited to what is necessary in relation to the purposes of the processing. We do not rule out the possibility

that the legislator, by amending the methodological norms, may lay down the exact data to be reflected in the databases. However, in the absence of such indications, practices whereby more data are collected than the ones strictly necessary for identification (e.g., contact data) or whereby copies of players’ identity documents are made should be avoided.

Can I carry out the identification and registration procedures by automated means?

There is nothing to prevent the implementation of a system whereby access to the premises is based on the scanning of certain documents (e.g., identity card, driving license). However, such a system must be designed to perform only those activities strictly necessary to fulfil legal obligations – it must be able to read only the relevant data and reflect it accordingly into the database, and not to store in any way the documents subject to automated verification.

Is it necessary to inform players about this processing activity?

Even if the processing is based on a legal obligation imposed on the gambling operators, this does not affect the right of the data subject to be informed about this processing activity. Therefore, gambling operators need to update their procedures on the processing of personal data to ensure that data subjects are correctly informed about this personal data processing activity.

The legal provisions require a minimum period – 5 years. After 5 years, we consider that the controller should analyze whether these data are still necessary to be processed (there can be also other purposes for processing, such as a request for information from the National Gambling Office). If the answer is affirmative, the data can be kept further. If the answer is negative, the controller is required to anonymize or delete the information reflected in the database.

Depending on the decision of the legislator on how to implement these obligations, there may be other issues that are relevant to this discussion. In the meantime, we consider that the aspects outlined above are a good starting point for operators to ensure that the identification of individuals and the compilation of databases are carried out in full observance of the protection of personal data provisions.

Deºi este de aºteptat ca modalitatea de implementare a acestor obligaþii sã fie detaliatã în cuprinsul normelor metodologice, este important sã subliniem cã implementarea în practicã a acestor obligaþii trebuie fãcutã cu luarea în considerare a regulilor aplicabile în domeniul protecþiei datelor cu caracter personal. Unele dintre cele mai importante aspecte care vor necesita o atenþie sporitã din partea operatorilor, pentru a rãspunde noilor cerinþe legale, sunt detaliate mai jos.

Care este temeiul prelucrãrii acestor date?

Prelucrarea datelor va fi efectuatã pentru îndeplinirea unei obligaþii legale ce îi revine operatorului de jocuri de noroc, aspect de altfel permis de cerinþele aplicabile în materia protecþiei datelor cu caracter personal.

Ce date cu caracter personal pot sã prelucrez?

Pentru a rãspunde la aceastã întrebare, operatorii trebuie sã aibã în vedere principiul minimizãrii datelor, respectiv prelucrarea doar a acelor date adecvate, relevante ºi limitate la ceea ce este necesar în raport cu scopurile prelucrãrii. Nu excludem posibilitatea ca legiuitorul, prin modificarea normelor metodologice, sã stabileascã exact datele ce trebuie reflectate în bazele de date. Totuºi, în lipsa unor astfel de indicaþii, trebuie evitate practicile prin care sunt colectate mai multe date decât cele strict necesare identificãrii (de exemplu, date de contact) sau prin care sunt efectuate copii de pe actele de identitate ale jucãtorilor.

Pot sã efectuez identificarea ºi înregistrarea în baza de date prin mijloace automatizate?

Nimic nu împiedicã implementarea unui sistem prin care accesul în incinta locaþiilor se face pe baza scanãrii unor anumite documente (de exemplu, carte de identitate, permis de conducere). Totuºi, un astfel de sistem trebuie conceput

astfel încât sã efectueze doar acele activitãþi strict necesare îndeplinirii obligaþiilor legale – trebuie sã fie capabil sã citeascã doar datele relevante ºi sã le transpunã în baza de date, nicidecum sã stocheze în vreun fel documentele care fac obiectul verificãrii automate.

Este necesar sã informez jucãtorii despre aceastã activitate de prelucrare? Chiar dacã prelucrarea are la bazã o obligaþie legalã impusã operatorului, acest aspect nu afecteazã dreptul persoanei vizate de a fi informatã despre aceastã activitate de prelucrare. Prin urmare, operatorii vor trebui sã îºi actualizeze procedurile privind prelucrarea datelor cu caracter personal astfel încât sã se asigure cã persoanele vizate sunt informate în mod corect în legãturã cu aceastã activitate de prelucrare de date cu caracter personal.

Cât timp trebuie sã stochez datele persoanelor în bazele de date?

Prevederile legale impun o perioadã minimã –5 ani. Ulterior trecerii unei perioade de 5 ani, considerãm cã operatorul trebuie sã analizeze dacã aceste date mai sunt necesar a fi prelucrate (existând alte scopuri pentru prelucrare, precum existenþa unei solicitãri de informaþii din partea Oficiului Naþional pentru Jocuri de Noroc). Dacã rãspunsul este afirmativ, datele pot fi pãstrate în continuare. Dacã rãspunsul este negativ, este necesar ca operatorul sã anonimizeze sau sã ºteargã informaþiile reflectate în baza de date.

În funcþie de felul în care legiuitorul decide sã detalieze modalitatea de implementare a acestor obligaþii, pot apãrea ºi alte aspecte care sã fie relevante pentru aceastã discuþie. Contribuþia se achitã lunar cãtre Fondul Cultural Naþional, pânã la data de 15 a lunii urmãtoare, pe baza declaraþiei depuse de plãtitor.

„Manifestãrile culturale de mare anvergurã ºi importanþã ce vor avea loc în urmãtorii ani”, alãturi de „efectele devastatoare ale pandemiei asupra întregului fenomen cultural” sunt justificãrile ce par a fi determinat legiuitorul român sã perceapã aceastã nouã contribuþie. Expunerea de motive reia aceleaºi argumente ºi atunci când explicã caracterul urgent al mãsurii, totodatã adãugând necesitatea existenþei unui mecanism „simplificat ºi transparent” pentru finanþarea proiectelor culturale.

Care sunt veniturile la care se referã? Dacã pentru licenþiaþii clasa 1 legislaþia jocurilor de noroc conþine o definiþie a veniturilor din jocuri de noroc ce poate servi drept bazã de calcul, ea nu se aplicã ºi licenþelor clasa a 2-a. Rãspunsul ar putea sã reiasã din normele de aplicare ce urmeazã a fi adoptate, într-un mod care sã respecte principiul nediscriminãrii subiecþilor acestei obligaþii, pentru a nu fi ameninþat caracterul constituþional al reglementãrii.

Unde sunt realizate veniturile respective? Este rezonabil sã ne aºteptãm la aplicarea procentului de 0,5% doar asupra veniturilor produse în România, dar determinarea în fapt a acestora va trebui sã þinã cont de activitatea multinaþionalã pe care jucãtorii din domeniu o au. Altfel, contribuþia ar deveni nu doar excesivã, ci ºi o potenþialã reþinere nejustificatã a unor sume importante.

Nici pagina de internet a instituþiei care va beneficia de aceste contribuþii nu este edificatoare în a detalia impactul proiectelor culturale pe care le-a finanþat în anii precedenþi sau de ce sumele deja încasate de la restul contribuabililor nu erau suficiente pentru activitatea acesteia. De fapt, promovarea sectorului cultural prin educarea populaþiei sau alocarea mai eficientã a resurselor deja existente par instrumente suficiente pentru „resuscitarea sectorului cultural, erodat de datorii, îndepãrtat de consumatori ºi ameninþat serios depericoluldeprofesionalizãrii”, iar în lipsa unor dovezi

Începând cu 3 noiembrie 2022, operatorii economici din domeniul jocurilor de noroc, inclusiv cei din mediul online, sunt obligaţi să achite lunar o contribuţie de 0,5% din veniturile realizate. Aceasta a fost introdusă prin Legea nr. 286 din 31 octombrie 2022 de modificare a Ordonanţei nr. 51 din 11 august 1998 privind îmbunătăţirea sistemului de finanţare nerambursabilă a proiectelor culturale (OG 51/1998) şi pare a avea menirea de a „resuscita” proiectele culturale afectate de consecinţele pandemiei.

Starting from 3 November 2022, economic operators in the field of gambling, including the remote side, are obliged to pay a monthly contribution of 0.5% of the revenues. This was introduced by Law no. 286 of 31 October 2022 amending Ordinance no. 51 of 11 August 1998 regarding the improvement of the system of non-reimbursable financing of cultural projects (OG 51/1998) and seems to have the purpose of “resurrecting” cultural projects affected by the consequences of the pandemic.

“The large-scale and important cultural events that will take place in the coming years”, along with the “devastating effects of the pandemic on the entire cultural field” are the justifications that seem to have led the Romanian legislator to perceive this new contribution. The statement of reasons restates the same arguments when explaining the urgent nature of the measure, at the same time adding the need for the existence of a “simplified and transparent” mechanism for financing cultural projects.

To qualify the new contribution as a symbol of legislative predictability and transparency seems an ambitious undertaking.

Which revenues should be considered? If for class 1 licensees the gambling legislation contains a definition of gambling revenues that can serve as a basis for calculation, this does not apply to class 2 licensees. The answer could result from the secondary legislation that is to be adopted, but it should be done in a way that respects the principle of non-discrimination of the payers, in order to avoid threatening the constitutional character of the regulation.

Where are the revenues made? It is reasonable to expect the application of the 0.5% only on revenues produced in Romania, but their actual determination will have to take into account the multinational activity of the players in the gambling field. Otherwise, the contribution would become not only excessive, but also a potential unjustified withholding of significant amounts.

Is the regulation transparent? The general reference to the cultural projects that will be organised at a national level creates the appearance of a beneficial regulation, but in reality, the statement of reasons omits to mention the exact manner in which the contributions of economic operators in the field of gambling will lead to changes in the status quo. Even the website of the institution that will benefit from these contributions is not clear in detailing the impact of the cultural projects it has previously financed or the reasons why the amounts already collected from the rest of the payers were insufficient for its activity. In fact, the promotion of the cultural sector by educating the population or the more efficient allocation of already existing resources seem to be sufficient tools for “reviving the cultural sector, eroded by debts, distant from consumers and seriously threatened by the danger of lack of professionals”, and in the absence of specific evidence regarding the need for additional funds, the new contribution seems rather excessive.

Nevertheless, it is not clear how gambling operators were chosen as the subjects of this contribution in comparison with other sectors of economic life. Such a justification would have been welcome, as in its absence we could only conclude that the choice was a subjective one rather than based on objective criteria, with the potential to achieve the goal declared by the law.

Totuºi, nu la acest sens se referã reglementãrile constituþionale atunci când stabilesc cã legea trebuie sã fie previzibilã, transparentã ºi nediscriminatorie. Pentru verificarea îndeplinirii condiþiilor de constituþionalitate, operatorii au dreptul de a apela la instanþele judecãtoreºti competente, prin atacarea titlului executoriu în baza cãruia contribuþia va fi perceputã. În cursul procesului civil, operatorul are dreptul sã punã la îndoialã conformitatea contribuþiei cu legea fundamentalã, prin ridicarea excepþiei de neconstituþionalitate. Pânã atunci, sperãm ca normele metodologice sã clarifice mai multe dintre neclaritãþile noii reglementãri, iar sãrbãtorile de iarnã sã nu aducã ºi alte „cadouri” unor instituþii publice sau administraþii prin taxarea suplimentarã a domeniului jocurilor de noroc.

Is the regulation predictable? If we take into account the history of taxes, contributions and other amounts collected from gambling operators, we can only answer in the affirmative: only in the last months they have changed several times both in terms of the amount and in terms of the method of payment and the final beneficiary. The changes by which gambling operators began to “support” the Olympic and Paralympic Committee (aren’t these under “cultural projects”?) and licence fees have increased are still warm, while the level of taxation of players remains a constantly debated topic.

However, this is not what the constitutional regulations refer to when they establish that the law must be predictable, transparent, and non-discriminatory. In order to verify the fulfilment of the constitutionality conditions, the economic operators have the right to address the competent courts, by challenging the writ of execution on the basis of which the contribution will be charged. During the civil proceedings, the operators have the right to question the compliance of the contribution with the fundamental law, by raising the objection of unconstitutionality. Until then, we hope that the secondary legislation will clarify more of the ambiguities raised by the new regulation and, respectively, that the winter holidays will not bring additional “gifts” to public institutions or administrations by further taxation of the gambling sector.

OPOZIȚIA PARLAMENTARĂ A TERMINAT CU TOATE PROBLEMELE ȘI S-A APUCAT DE REGLEMENTAREA JOCURILOR DE NOROC

Deunăzi, am fost invitat la o emisiune TV, în care am dezbătut câteva dintre aspectele controversate care au impactat industria de jocuri de noroc în ultima perioadă de timp. Numai bine, că am scăpat de o reglementare care propunea impozitarea câştigurilor de la jocurile de noroc cu 40% pentru ce depăşeşte 1.000 lei, când, pe firmament şi-a făcut apariţia următorul anunţ:

sã poatã fi restricþionat total accesul minorilor”. Se considera loc de joacã pentru copii orice spaþiu închis sau în aer liber, destinat utilizãrii de cãtre copii. Iniþiatorii au solicitat dezbaterea iniþiativei în procedurã de urgenþã. Senatul este prima camera sesizatã.

Fãrã doar ºi poate, iniþiatorii, opoziþia parlamentarã, ca cum s-ar zice, a terminat cu toate trebile curente ºi a trecut la reglementarea jocurilor de noroc din þara noastrã. Modificarea propusã, are la prima vedere doar un singur scop – scoaterea jocurilor de noroc tradiþionale din localitate. Se vede treaba cã, reprezentanþii opoziþiei nu au fost ºi nu sunt la fel de vehemenþi cu marile lanþuri de magazine care au nãpãdit oraºele României (nu pe la margine aºa cum sunt permise în oraºele europene), cu lipsa locurilor

de parcare, cu poluarea uriaºã, cu faptul cã orãºenii nu au apã caldã ºi cãldurã, cu lipsa medicamentelor din farmacii ºi spitale ºi cu câte ºi mai câte. Iniþiativa legislativã, nu þine cont de câteva aspecte, respectiv faptul cã la acest moment existã o prevedere legalã care nu permite funcþionarea locaþiilor specializate decât cu îndeplinirea condiþiilor prevãzute de articolul care se doreºte a fi modificat. De ce 300 m? de ce nu 500 m? sau 2 km? Cum se va mãsura ? de la colþul clãdirii? din centrul acesteia? cine va face mãsurãtoarea? ONJN, se va specializa ºi pe cadastru ºi topo? Sunt o mulþime de întrebãri, la care aºteptãm cu interes un rãspuns din partea iniþiatorilor.

Apoi, trebuie avut în vedere faptul cã o astfel de prevedere impacteazã ºi activitatea Loteriei Naþionale care deþine 1.000 de locaþii proprii unde îºi desfãºoarã activitatea ºi încã 1.000 de locaþii ale mandatarilor loteriei. Problema care se pune este cã Loteria deþine spaþiile proprii de mulþi ani (de pe vremea lui Ceauºescu), ºi cã odatã cu evoluþia

Propunerea legislativã pentru modificarea Ordonanþei de urgenþã a Guvernului nr. 77/2009 privind organizarea ºi exploatarea jocurilor de noroc (B760/2022), a fost înregistratã la Senat pentru dezbatere în data de 22 noiembrie 2022, fiind iniþiatã de mai mulþi parlamentari USR, printre care ºi Dan Barna, Silviu Dehelean, Seidler Cristian, Ungureanu Emanuel Dumitru, Wiener Adrian. Se propune astfel modificarea art. 15, alin. (2) litera c) din OUG 77/2009, în sensul în care, pentru obþinerea autorizaþiei de exploatare a jocurilor de noroc, operatorii economici trebuie sã facã dovada cp: „spaþiul propus nu este situat în incinta sau în proximitatea de 300 de metri a unui aºezãmânt de învãþãmânt, inclusiv campusurile aferente acestuia, unor locuri dejoacã pentru copii, unor aºezãminte de culturã, sãnãtate, cu caracter social, de culte religioase ºi altele asemenea sau în perimetrul delimitat destinat acestora; se interzice desfãºurarea de jocuri de noroc în spaþii care datoritã amplasãrii ar conduce la obstrucþionarea traficului sau la limitarea liberului acces cãtre alte locaþii de interes (intrãri în imobile, pasaje pietonale, staþii ale mijloacelor de transport în comun etc.); în mod excepþional se admite organizarea de jocuri de noroc în cinematografe, sãli de spectacole, sãli de sport, case de culturã ºi altele de acest fel, cu condiþia sã fie asigurate cumulativ urmãtoarele condiþii: acces separat pentru jucãtori, sã nu fie deranjate în vreun fel celelalte activitãþi ºi

Recently, I was a guest on a TV show where I discussed some of the controversial issues that have impacted the gambling industry in recent times. It’s a good thing that we got rid of a regulation that proposed to tax gambling winnings at 40% for what exceeds 1,000 lei, when the following announcement appeared on the skyline:

The legislative proposal to amend Government Emergency Ordinance no.77/2009 on the organization and operation of gambling (B760/2022), was registered at the Senate for debate on 22 November 2022, being initiated by several USR MPs, including Dan Barna, Silviu Dehelean, Seidler Cristian, Ungureanu Emanuel Dumitru, Wiener Adrian. It is therefore proposed to amend Article 15, paragraph (2), letter c) of GEO 77/2009, in the sense that, in order to obtain the authorization to operate games of chance, economic operators must prove their capital: „the proposed space is not located within 300 meters of an educational establishment, including its campuses, children’s playgrounds, cultural, health, social, religious and other similar establishments, or within the perimeter of the area designated for them; it is forbidden to conduct gambling in places which, due to their location, would obstruct traffic or limit free access to other places of interest (entrances to buildings, pedestrian walkways, public transport stops, etc.); exceptionally, gambling is allowed in cinemas, concert halls, sports halls, houses of culture and other similar buildings, provided that the following conditions are met: separate access for players, so that other activities are not disturbed in any way and that access for minors can be totally restricted”. A children’s playground is any enclosed or open-air space intended for use by children. The initiators have requested an urgent debate on the initiative. The Senate is the first chamber to be consulted. Undoubtedly, the initiators, the parliamentary opposition, as they say, finished with all the current business and moved on to regulating gambling in our country. The proposed amendment, at first glance, has only one purpose - to remove traditional gambling from towns and villages. It is obvious that the opposition represen-

tatives have not been and are not as vehement about the big chain stores that have invaded Romania’s cities (not on the outskirts as they are allowed in European cities), the lack of parking spaces, the huge pollution, the fact that the citizens have no hot water and heat, the lack of medicines in pharmacies and hospitals and so on. The legislative initiative does not take into account several aspects, namely the fact that at the moment there is a legal provision which does not allow the operation of specialised premises unless the conditions laid down in the article to be amended are met. Why 300 m? why not 500 m? or 2 km? How will it be measured? from the corner of the building? from the center of the building? who will take the measurement? ONJN, will it also specialize in cadastre and topography? There are a lot of questions, to which we look forward to an answer from the initiators. Then, it should be borne in mind that such a provision also impacts the activity of the National Lottery, which has 1,000 of its own locations where it operates and another 1,000 locations of lottery trustees. The problem is that the Lottery has had its own premises for many years (since Ceauºescu’s time), and with the evolution of the cities, all kinds of locations such as schools, churches and the like have certainly appeared within 300 meters. Do the initiators take this into

Another problem they didn’t take into account refers to the fact that the legislation obliges the ONJN to authorize only certain categories of specialized locations (casinos, of which there are about 3 in Bucharest, and poker clubs, which are very few throughout the country). Do the initiators have any idea how many people the ONJN would need to employ to make licensing trips around the country. Perhaps it would also be

what will happen to the workforce that will be made redundant? Have the initiators answered all these questions? Or they have just proposed, as is their habit, to close down the traditional gambling industry without putting anything in place and thus create a huge deficit in the State Budget (over a billion euros), and to force loans to cover the huge hole they will cause with this stupid initiative.

Such a regulation must have behind it some studies to analyze, to evaluate what the benefits are, what the state and society have to gain and

oraºelor, cu siguranþã au apãrut la mai puþin de 300 de metri tot felul de locaþii tip ºcoalã, bisericã ºi alte asemenea. Au în vedere aceste aspecte iniþiatorii? Sau au de gând sã punã pe butuci afacerea din care statul român încaseazã direct la buget sume considerabile...?

O altã problemã pe care nu au avut-o în vedere se referã la faptul cã legislaþia obligã ONJN sã autorizeze doar anumite categorii de locaþii specializate (cazinourile care mai sunt vreo 3 în Bucureºti ºi cluburile de poker, care ºi acestea mai sunt pe degetele de la o mânã în toatã þara). Au idee iniþiatorii câte persoane ar trebui sã angajeze ONJN-ul pentru a face deplasãri pentru autorizare în toatã þara. Poate cã ar fi bine sã se consulte ºi cu cei care gestioneazã acest domeniu pentru a se dumirii cu privire la specificul acestei activitãþi.

Ce se întâmplã cu locaþiile care existã, pentru care s-au semnat contracte pentru perioade lungi de timp, pentru care se achitã taxe ºi impozite la bugetele locale, ºi care peste noapte probabil cã vor dispãrea dacã o astfel de iniþiativã legislativã ar trece de Parlamentul Naþional. Poate iniþiatorii doresc ca în centrele marilor oraºe sã-ºi facã apariþia spaþii comerciale goale sau în care se comercializeazã sãrãcia (acele magazine care vând orice produs cu 10 lei), cum vor compensa sumele de bani care nu vor mai fi încasate de bugetele locale ºi mai ales ce se va întâmpla cu forþa de muncã care va fi disponibilizatã? Au oare rãspuns la toate aceste întrebãri iniþiatorii? Sau doar ºi-au propus, aºa cum le este obiceiul, sã închidã industria de jocuri de noroc tradiþionale fãrã sã punã nimic în loc ºi astfel sã creeze la Bugetul de Stat un deficit imens (peste un miliard de euro), ºi sã forþeze împrumuturi pentru acoperirea uriaºei gãuri pe care o vor provoca cu aceastã iniþiativã nãstrujnicã. O astfel de reglementare, trebuie sã aibã în spate oarece studii care sã analizeze, sã cântãreascã care sunt beneficiile, ce are de câºtigat statul ºi societatea ºi ce pierderi ar putea fi, ori la modul la care este formulatã, cu siguranþã nu existã nici un fel de fundamentare, ci doar o motivare populistã, care sã mai strângã ceva capital electoral pe fondul unei nemulþumiri ale unei pãrþi din societate. Considerãm cã modificãrile din august sunt îndeajuns de dure, iar efectele acestora nu vor întârzia sã aparã (firme care îºi vor înceta activitatea, angajaþi trimiºi în ºomaj etc.) ºi implicit dispariþia a numeroase locaþii specializate, aºa cã iniþiativa legislativã este tardivã ºi fãrã rost.

Evenimentele Casino Inside 2022 au reprezentat dovada clară că industria jocurilor de noroc din România poate fi solidară! Mai mult decât atât, reprezentanţii industriei noastre încep să se maturizeze şi să înţeleagă că nu mai putem sta decuplaţi de problemele sociale ce ni se imput a fi relaţionate cu activitatea noastră, precum dependenţa. Am discutat şi ce anume ne pregătesc politicienii anul viitor. Am vorbit de fiscalitate şi autoreglementare, şi, în general, de cele mai arzătoare probleme ale industriei, dar seara, la Gală, ne-am şi distrat şi am premiat pe cei mai buni din industrie. Iată derularea evenimentelor:

Evenimentul nostru de business a avut anul acesta un moderator nou în persoana domnului Profesor Dr. Avocat Marius Cezar Pantea. Domnia sa s-a achitat cu brio de sarcinile de moderator ºi a reuºit, folosindu-se de experienþa proprie, foarte bogatã în domeniu, ºi de pregãtirea profesionalã de excepþie, sã conducã dezbaterile în mod armonios ºi eficient.

Prima intervenþie a venit din partea reprezentantului ONJN, domnul Mihãiþã Ruiu, director al Direcþiei Generale de Autorizare în cadrul Oficiului Naþional pentru Jocuri de Noroc. Acesta a prezentat auditoriului o serie de date statistice interesante, pãcat cã nu au fost oferite publicului în cadrul unei prezentãri pentru a putea fi reþinute mai uºor, dar poate data viitoare Oficiul va face un minim efort pentru a avea ºi o prezentare, aºa cum avea în trecut la evenimentele gãzduite de noi.

Domnul Ruiu a dorit o discuþie liberã cu cei din salã ºi întrebãrile nu au contenit sã aparã, rezultând un dialog interesant ºi util, motivul pentru care ne-am întâlnit. Dialogul ar fi continuat ore bune dacã nu am fi avut ºi alþi speakeri în program.

Alexandru Rîlea, International Sales Manager Synot Games, a avut prima prezentare venitã din partea partenerilor noºtri ºi a expus o serie de informaþii despre produsele ºi serviciile companiei dedicate atât sectorului online, cât ºi landbased.

În continuare, Gabriel Biriº, avocat de renume ºi expert în fiscalitate la Biriº Goran SPARL, a prezentat modificãrile fiscale în gambling ºi impactul lor în activitatea de zi cu zi a companiilor din domeniu. Temele expuse au suscitat un viu interes ºi au animat ºi mai mult dialogul din salã, multe companii fiind interesate de modul în care reputatul specialist ºi profesionist al domeniului fiscal, fost Secretar de Stat în Ministerul de Finanþe, vede lucrurile mai ales dupã suprataxarea din aceastã varã. Robert Stancu, Sales Manager CT Gaming România, a abordat în prezentarea sa sistemul de management al cazinourilor de la CT Gaming ºi importanþa în managementul mijloacelor de joc.

O apariþie surprizã la RPG10 a constituit-o prezenþa doamnelor avocat Cosmina Simion ºi Ana-Maria Baciu de la SCA Simion Baciu în calitate de speakeri. Lucru datorat faptului cã doamna Odeta Nestor nu a mai putut onora invitaþia noastrã de a participa la eveniment din motive întemeiate. Doamnele avocat au abordat tema nenumãratelor modificãri legislative ce s-au succedat cu repeziciune în acest an, mai cu seamã în lunile Iulie ºi Noiembrie, dar ºi proiectele de acte normative care aºteaptã sã fie dezbãtute curând în Parlamentul României ºi care, cel mai probabil, în 2023 vor lovi puternic industria noastrã de profil.

Oana Sebe, sales manager IGT România, a oferit o prezentare a noutãþilor venite din partea companiei americane producãtoare de echipamente de joc, unul din liderii mondiali în domeniu.

The Casino Inside 2022 events were clear proof that the Romanian gaming industry can stand together! Moreover, the representatives of our industry are starting to grow up and understand that we can no longer stay detached from the social issues that are perceived to be related to our activity, such as addiction. We also discussed what politicians are preparing for us next year. We talked about taxation and self-regulation, and in general the most burning issues for the industry, but in the evening at the Gala we also had fun and rewarded the best in the industry. Here’s how it all went down:

The 10th edition of the ReUnion of Gambling Professionals

The Gambling Professionals’ Reunion had an audience of 125 people from 60 companies (operators, machine manufacturers, service providers, PR companies, law firms, professional and employer associations, etc.).

Our business event had a new moderator this year in the person of Professor Dr. Lawyer Marius Cezar Pantea. He has successfully performed his moderator duties and, using his own extensive experience in the field and his exceptional professional training, has managed to conduct the debates harmoniously and efficiently.

The first intervention came from the representative of the ONJN, Mr. Mihãiþã Ruiu, Director of the General Directorate of Authorization within the National Gambling Office. He presented to the audience a series of interesting statistical data, a pity that they were not given to the public in a presentation so that they could be remembered more easily, but perhaps next time the Office will make a minimum effort to have a presentation, as it had in the past at events hosted by us.

Mr. Ruiu wanted a free discussion with the audience and the questions did not stop coming, resulting in an interesting and useful dialogue, which is why we met. The dialogue would have gone on for hours had we not had other speakers on the programme.

Alexandru Rîlea, International Sales Manager of Synot Games, had the first presentation from our partners and presented a series of information about the company’s products and services dedicated to both the online and landbased sectors.

One of the best speeches in recent years heard at our events was that of the President of ROMSLOT - Slot Organisers Association, Mr. Sorin Georgescu, who openly discussed in front of the audience the fact that the industry needs to start, step by step and company by company, a selfregulation process that includes aspects related to advertising (often too aggressive) and especially the way we are perceived by the authorities and society. He gave a moving speech that warned us all about what could happen to us next year if we don’t pull our act together. n perioada 14-18 Noiembrie, am avut ocazia sã participãm pentru prima datã la târgul SIGMA din Malta. Caesars se asociazã cu agenþia de divertisment Roc Nation, fondatã de Jay-Z, pentru licitaþia unui cazinou din Times Square, New York.

Într-un anunþ fãcut de curând, compania a informat cã Roc Nation se va alia cu SL Green ºi Caesars Entertainment, în calitate de partener de divertisment, pentru o „nouã facilitate de jocuri de noroc de ultimã generaþie la 1515 Broadway în Times Square”.

Caesars a anunþat în octombrie cã intenþioneazã sã deschidã un cazinou în Times Square, depunând o cerere pentru una dintre cele trei licenþe disponibile în prezent în New York. Cel puþin cinci grupuri ºi-au fãcut cunoscute planurile de a concura pentru obþinerea unei licenþe, dar detaliile vor depinde de cerinþele Comisiei de Jocuri de Noroc din statul New York, aºteptate înainte de 6 ianuarie. SL Green declarase anterior cã va opta pentru un cazinou de tip boutique în spaþiul modernizat al teatrului din Times Square, fãrã a face comentarii cu privire la suprafaþa totalã dedicatã jocurilor de noroc, menþionând totuºi cã nu plãnuieºte sã deschidã un cazinou în stil Las Vegas, potrivit rapoartelor. Caesars is partnering with Jay-Z founded entertainment agency Roc Nation in its bid for a casino in Times Square, New York.

In a recently announcement, the company informed that Roc Nation would be joining as an entertainment partner, alongside SL Green and Caesars Entertainment for a ‘new, state-of-the-art gaming facility at 1515 Broadway in Times Square’.

Caesars had announced in October that it planned a casino in Times Square, submitting an application for one of three licenses currently up for grabs in downstate New York.

At least five groups have made their plans to compete for a license known, but details will depend on New York State Gaming Commission proposal requests, expected before January 6th.

SL Green had previously stated that it would be opting for a boutique casino in the revamped theater space in Times Square, not commenting on overall gaming space, but noting it was not planning a Las Vegas-style casino, according to reports.

But it has been met with opposition over the plan, with arguments of increased crime and changes to the character of Broadway.

The group says the new project will ‘not only provide billions in tax revenue to New York City and State, it will also accelerate New York’s economic recovery through strategic partnerships with area businesses utilizing its industry-leading loyalty program Caesars Rewards’.

The group claims the development could stimulate over seven million more new visits to Times Square annually, and 600,000 new overnight hotel bookings, alongside $166 million in new retail spend and $65 million in new annual Broadway ticket sales.

Sands China reînnoiește acordul de marcă înregistrată cu LVS pentru 377 milioane de dolari americani

Sands China Ltd., cu sediul în Macao, a anunþat cã ºi-a reînnoit acordul de licenþiere a mãrcii cu investitorul sãu mamã, Las Vegas Sands (LVS), pentru o perioadã de 3 ani, începând din ianuarie 2023. Acordul prevede ca LVS sã acorde Sands China o licenþã pentru a continua sã foloseascã mãrcile LVS la un preþ de 377 de milioane de dolari americani. Acordul este programat sã dureze de la 1 ianuarie 2023 pânã la 31 decembrie 2025. În conformitate cu termenii noului Acord internaþional de licenþã pentru mãrci comerciale, plãþile anuale efectuate de Sands China sunt calculate pe baza unui procent din veniturile din jocuri de noroc (GGR) ºi din alte activitãþi decât jocurile de noroc ale Sands China, iar plata totalã este de 377 de milioane de dolari americani, plafonatã la 114 milioane de dolari americani pentru 2023, 125 de milioane de dolari americani pentru 2024 ºi 138 de milioane de dolari americani pentru 2025. Macau-based Sands China Ltd has announced that it has renewed its brand licensing agreement with its parent investor, Las Vegas Sands (LVS), for a period of 3 years, starting from January 2023. The agreement includes LVS granting Sands China a license to continue to use the LVS trademarks at a price of US $377 million.

The agreement is scheduled to last from January 1, 2023 to December 31, 2025.

Under the terms of the new International Trademark License Agreement, annual payments from Sands China are calculated based on a percentage of Sands China’s gaming (GGR) and non-gaming revenues and the total payment is 377 million US dollars, capped at 114 million US dollars for 2023, 125 million US dollars for 2024 and 138 million US dollars for 2025. This new agreement comes after the end of the current Second Trademark Sub-License Agreement, which will be no longer valid from December 31, 2022. In addition to Sands China, a number of its subsidiaries such as Venetian Cotai Ltd., the current Macau license holder Venetian Macau Ltd., Venetian Orient Ltd. and Cotai Strip Lot 2 Apart Hotel (Macau) Ltd., responsible for the management of the apartment-hotel tower at The Plaza Macao, will gain access to the LVS brands.

În octombrie s-au înregistrat încasãri de 1,28 miliarde de dolari, cu cel puþin douã recorduri doborâte în acest proces. În timpul ºi dupã marea recesiune, dar înainte de criza sanitarã mondialã, Macao a fost Mecca mondialã a jocurilor de noroc, care a stabilit în mod constant noi recorduri, în timp ce destinaþia favoritã iniþialã a jocurilor de noroc, Las Vegas, a înregistrat pierderi considerabile. The US state of Nevada has posted its 20th month in a row with revenues exceeding a billion dollars. October saw a take of $1.28b with at least two broken records in the process. During and after the great recession but prior to the world health emergency, Macau was the world’s gambling mecca that consistently set new records while the original favorite gambling destination, Las Vegas, struggled. The Strip s-a liniºtit oarecum de când s-a apropiat de aceste recorduri, cu puþin peste o jumãtate de procent de la o lunã la alta, dar cu peste 30% mai mare decât cifrele de dinainte de pandemie, corespunzãtoare lunii octombrie 2019.

Slots were the biggest money maker with monthly revenue of $877.3m for October, up more than 10% over last year’s October numbers.

Table game numbers dropped slightly year on year with blackjack largely outstripping baccarat and craps.

Sports betting revenues were up nearly 18% with mobile (app) sports bets accounting for nearly half the action at $27.4m of the total of $56.9m total take. A good part of the sports revenue came from the new football season that started in September.

Downtown casinos took in more money in October than any month in history with gross gaming revenues of $90.4m, a 19% increase and beating the previous record of $86.4m that was set in March 2022. The Downtown take has increased by 6.1% so far this year.

The Strip cooled a bit from approaching records with a little over one-half of a one percent increase month to month but still more than 30% higher than pre-pandemic numbers for October 2019.
