Nu cred sã existe în legislaþia din lumea civilizatã o hârtie emisã de o autoritate de stat mai scumpã decât Licenþa emisã de ONJN, poate doar hârtiile de valoare emise de vreo Bancã Naþionalã, altfel „nu se existã”. Probabil cei care au fãcut o astfel de propunere, dar în mod special cei de la ONJN, care au acceptat-o, nu realizeazã ce înseamnã pentru o societate comercialã, în vremurile de astãzi sã strângã ºi sã achite suma de 9.500 euro pentru o amãrâtã de hârtie. Este paradoxal sã achiþi o astfel de sumã, pentru o coalã de hârtie în condiþiile în care toþi licenþiaþii clasa a 2-a plãtesc aceeaºi sumã pentru activitatea desfãºuratã timp de un an. Incredibil nu ?

Pe lângã aceastã ticãloºie, actul normativ nãscut peste noapte, este chior, ºchiop ºi ciung, adicã, nu respectã nici cele mai elementare reguli de tehnicã legislativã ºi nici principiile consacrate în teoria generalã a dreptului. Concret, o lege cadru, aºa cum este OUG 77/2009, pentru domeniul jocurilor de noroc, a fost modificatã printr-o Ordonanþã simplã, lucru nepermis, iar reglementarea nu are în conþinut norme tranzitorii. Cu alte cuvinte, operatorii de jocuri de noroc care nu pot achita noile taxe, nu vor putea ieºi din „joacã” decât fie în insolvenþã, ori faliment direct, fie cu bunurile confiscate.

Dacã este de înþeles nevoia statului de a colecta mai mulþi bani la buget, în aceste vremuri tulburi, nu putem sã nu observãm modul haotic de a face acest lucru, prin modificãri legislative, care par a fi fãrã noimã.

Fãrã a analiza rând cu rând modificãrile, care parcã vor sã îngenuncheze industria de gambling din România, doar comparând câteva din cifrele care ne aratã nivelul de la care s-a pornit ºi aberaþiile la care s-a ajuns, se poate observa cã, doar pentru eliberarea unei amãrâte de hârtii – licenþã – statul va încasa nici

Faptul cã modificarea legislativã nu a þinut cont de pãrerea specialiºtilor din industrie ºi a instituit, samavolnic, noi taxe, unele mai mari, altele mai mici, fãrã sã se þinã cont de principiul împãrþirii sarcinii fiscale de aºa manierã încât sã poatã fi echitabilã ºi mai ales suportabilã, va conduce în scurt timp la o contracþie a industriei, care se va materializa în încasãri mult mai mici la bugetul de stat decât ce s-a preconizat. Iniþiatorul, care pe hârtie este ONJN-ul, parcã s-a aºezat la masã ºi „din pix” a trântit o înºiruire de sume, procente ºi noi obligaþii, fãrã sã þinã cont de riscul de a dezintegra o industrie, care de-abia ieºitã din perioada pandemicã, încerca sã-ºi recapete suflul.

O altã hibã constã în modul de aplicare al noilor taxe, de la ce datã se aplicã acestea?, ce se întâmplã cu licenþele ºi autorizaþiile existente la data apariþiei modificãrilor legislative?, faptul cã nu existã o prevedere clarã care sã stipuleze cum vor fi aplicate noile norme, va da naºtere unei probleme de interpretare, aruncate în spatele ONJN, care, dupã cum se cunoaºte, în ultima perioadã de timp, numai consecventã nu este în interpretarea normelor juridice care guverneazã domeniul jocurilor de noroc din þara noastrã.

Pentru lumea normalã, este firesc sã se aplice principiul conform cãruia legea dispune doar pentru viitor, ceea ce înseamnã cã pentru autorizaþiile existente la data apariþiei noilor norme se vor achita taxele vechi (cele existente la data Deciziei emise de Comitetul de Supraveghere al ONJN). Dar ce sã vezi,

As if in competition with the disastrous economic situation, the neighbouring war and the threat of the return of the pandemic, a legislative amendment to GEO 77/2009 appeared in August, which seems to have been made to bury the gambling industry in our country. While the state’s need to collect more money for the budget in these troubled times is understandable, one cannot help but notice the chaotic way of doing so, with seemingly meaningless legislative changes.

Without analyzing the changes one by one, which seem to want to bring the Romanian gambling industry on its knees, just by comparing some of the figures that show the level from which it started and the aberrations that have been reached, it can be seen that, just for the issuance of a poor piece of paper - license - the state will charge no more and no less than 9,500 euros. I don’t think there is a paper issued by a state authority in the civilized world that is more expensive than the License issued by the NGO, maybe only the valuable papers issued by a National Bank. Otherwise, ”it doesn’t exist”. Probably those who made such a proposal, but especially those at the NGO, who accepted it, do not realize what it means for a commercial company in today’s times to collect and pay the sum of 9,500 euros for a lousy piece of paper. It is paradoxical to pay such an amount for a piece of paper when all 2nd class licensees pay the same amount for work done for a year. Incredible, isn’t it?

The fact that the legislative amendment did not take into account the opinion of the industry specialists and has introduced new taxes, some higher, some lower, without taking into account the principle of sharing the tax burden in such a way that it can be fair and especially bearable, will soon lead to a contraction of the industry,

which will result in much lower revenues to the state budget than expected. The initiator, which on paper is the NGO, seems to have sat down at the table and “with one stroke of the pen” has slammed a string of amounts, percentages and new obligations, without taking into account the risk of disintegrating an industry, just out of the pandemic period, trying to regain its breath.

In addition to this mischief, the normative act, issued overnight, is lame and blind, i.e., it does not respect the most elementary rules of legislative technique nor the principles enshrined in the general theory of law. Specifically, a framework law, such as GEO 77/2009, for the field of gambling, was amended by a simple Ordinance, which is not allowed, and the regulation does not contain transitional rules. In other words, gambling operators who cannot pay the new taxes will only be able to get out of the „game” through insolvency, direct bankruptcy or confiscation of assets.

Another problem lies in the application of the new fees, from what date do they apply, what happens to existing licenses and authorizations at the time of the legislative changes, the fact that there is no clear provision stipulating how the new rules will be applied, will give rise to a problem of interpretation, attributed to NGO, which, as is known, in recent times, is not only

of applying the new fees immediately, „for all the people”, it does not matter that there are previously issued permits that are valid. This is unacceptable, for an institution such as the NGO,

the law only provides for the future, which means that the new fees will only be applied to operators who are licensed or have obtained authorizations after the date of the new rules.

It would be advisable to issue an Order of the President of the NGO, which would provide for a uniform interpretation of the legal provisions, which would not allow its own employees or those of the Court of Auditors, at the next audit in the institution, to find any misconduct, as happened in 2015 in the pharmaceutical sector

But let’s hope that can’t happen to us too.

juriºtii eminenþi ai ONJN ºi diverºi specialiºti (apãruþi peste noapte în Oficiu), au nãscocit posibilitatea de a se aplica noile taxe de îndatã, „pentru toatã suflarea”, nu conteazã cã existã autorizaþii emise anterior ºi aflate în termenul de valabilitate. Acest lucru este de neacceptat, pentru o instituþie aºa cum se vrea a fi ONJN, legea dispune doar pentru viitor, ceea ce înseamnã cã noile taxe vor fi aplicate doar operatorilor care s-au licenþiat ori au obþinut autorizaþii dupã data apariþiei noilor norme.

Recomandat ar fi apariþia unui Ordin al Preºedintelui ONJN, prin care sã se dispunã interpretarea unitarã a prevederilor legale, fapt ce nu ar permite propriilor angajaþi sau celor de la Curtea de Conturi, la viitorul control în instituþie, sã constate vreo nãzbâtie, aºa cum s-a întâmplat în anul 2015 în domeniul farma (când s-a trezit o „tãnticã” sã interpreteze o prevedere legalã – care a nãscut o situaþie prin care Casa Naþionalã de Sãnãtate are de recuperat de la toate farmaciile din România niºte sume uriaºe închipuite, iar bieþii guvernanþi, încearcã sã modifice reglementãrile de aºa manierã încât sã nu se închidã efectiv farmaciile). Dar sã sperãm cã asta nu ni se poate întâmpla ºi nouã.

Fãrã sã se þinã cont de scumpirile la energie ºi gaz, care astãzi au ajuns sã fie la un nivel insuportabil, în domeniul jocurilor de noroc acestea au devenit o altã mare grijã a operatorilor, deoarece sumele plãtite sunt consistente ºi au dat peste cap bugetele companiilor rivalizând cu cheltuielile uriaºe pentru chirii, taxe de licenþã ºi autorizaþii, taxe ºi impozite pentru angajaþi, legiuitorului nu îi pasã de aceastã industrie, ºi menþine excepþiile de la acordarea diverselor înlesniri, ajutoare sau cum le-o spune acestora, cãtre industria de jocuri de noroc de la noi. Domnul Pocora vã va rãspunde la întrebãri ºi va încerca sã lãmureascã mare parte din neclaritãþile pe care le aveþi în legãturã cu partea legislativã, de reglementare ºi control a instituþiei.

În 2 Noiembrie 2022 a fost adoptat ºi publicat în Monitorul Oficial proiectul de lege pentru modificarea OUG 77/2009 privind organizarea si exploatarea jocurilor de noroc, modificãri prin care operatorii de jocuri de noroc sunt obligaþi sã þinã evidenþa electronicã a tuturor persoanelor care intrã în locaþiile unde sunt organizate jocuri de noroc, precum ºi de a arhiva bazele de date electronice ale persoanelor autoexcluse ºi indezirabile ºi de a le pãstra timp de cel puþin 5 ani de la înfiinþare. Aceste modificãri vor avea un impact considerabil asupra organizatorilor de jocuri de noroc din România.

Ne asigurãm cã avem în stoc un fond de piese alese cel mai frecvent de cãtre clienþi, astfel încât sã minimizãm timpul de aºteptare pentru livrarea comenzii. Ce aºteptãri aveþi de la piaþa româneascã de gambling, cum credeþi cã va evolua industria noastrã în viitor?

Urmãrim în permanenþã schimbãrile care au loc pe piaþa româneascã pentru a putea rãspunde aºteptãrilor clienþilor noºtri. ªtim cã reglementãrile legale ºi cerinþele tehnice evolueazã foarte mult. Suntem prezenþi pe piaþa româneascã de ani de zile, ne prezentãm produsele la expoziþii ºi avem mulþi prieteni ºi clienþi în aceastã þarã. Sperãm cã schimbãrile care au loc în industria pariurilor ºi a jocurilor de noroc ne vor permite sã ne dezvoltãm în continuare ºi sã creºtem vânzãrile în aceastã regiune. În ceea ce ne priveºte, vã putem asigura cã depunem toate eforturile pentru a satisface aºteptãrile clienþilor noºtri ºi pentru a ne îmbunãtãþi constant produsele.

Tell us which product is the best-selling product in the GAMESERVICE portfolio?

Due to the fact that the market is changing and betting companies have an increasing share in it, at the moment terminals are definitely more often chosen by customers.

What are the advantages of GAMESERVICE products compared to competitors? Price? Quality? Reliability? Service?

The GAMESERVICE cabinets are distinguished by a unique design and the highest quality mechanically polished stainless steel. The company focuses on modern solutions for the construction and construction of terminals. All enclosures can be made according to the customer’s specifications so that they meet the expectations as much as possible.

We have a modern production line, thanks to which we provide flexibility and speed of implementation. What is a customer’s lead time for receiving products since an order was placed?

It is difficult to clearly define the time needed to complete the order. It depends on the specifications of the device, the availability of selected parts. Covid had a major impact on the supply market. The availability of parts has decreased and delivery times have lengthened. We make sure that we have a pool of parts most frequently chosen by customers in stock so as to minimize the waiting time for the delivery of the order.

What are your expectations from the Romanian gambling market, how do you think our industry will evolve in the future?

We are constantly following the changes taking place on the Romanian market in order to be able to meet the expectations of our clients. We know that legal regulations and technical requirements are evolving a lot. We have been on the Romanian market for years, we present our products at fairs and we have many friends and customers in this country. We hope that the changes taking place in the betting and gambling industries will allow us to further develop and increase sales in this region. For our part, we can assure you that we make every effort to meet the expectations of our customers and constantly improve our products.

Pe parcursul trimestrului, s-au depus eforturi pentru dezvoltarea în continuare a unor soluþii tehnologice automatizate pentru a detecta ºi a interacþiona cu clienþii supuºi riscului. În încercarea de a îmbunãtãþi parteneriatele strategice pentru a încuraja intervenþia timpurie, Kindred Group a încheiat o nouã colaborare cu EPIC Risk Management.

During the quarter, efforts have been placed on further developing automated technological solutions to detect and engage with customers at risk. Looking to enhance strategic partnerships to propel early intervention, Kindred Group has entered a new collaboration with EPIC Risk Management.

In the third quarter of 2022, Kindred Group plc’s (Kindred) share of revenue from harmful gambling was 3.8 (3.3) per cent and the improvement effect after interventions decreased slightly to 82.6 per cent. During the past three quarters, the number has fluctuated between 3.3 and now 3.8 per cent. Focus continues to be on improving internal processes and utilising technological capacity to automate interventions and thereby improve close to real time capability to further engage with the customer at an earlier stage. Reaching the ambition by the end of the fourth quarter next year is challenging, however Kindred remains fully dedicated on achieving its ambition of zero per cent revenue from high-risk customers. The Group has identified four critical areas to keep working on:

1. Shortening the time from detection to intervention as it is proven that raising awareness to customers early on is an effective way to stay in control

Qatar plănuiește să asigure securitatea la Cupa Mondială 2022 alături de parteneri din 13 țări

Pentru o ediþie a Cupei Mondiale lipsitã de neplãceri, Qatar este aºteptatã sã asigure securitatea competiþiei prin intermediul a zeci de mii de ofiþeri/agenþi. Þara gazdã a semnat numeroase acorduri de cooperare în domeniul securitãþii cu mai multe þãri. Mai mult de 1,2 milioane de fani sunt aºteptaþi sã viziteze Qatarul în timpul competiþiei, care se va desfãºura între 20 noiembrie ºi 18 decembrie. Forþele de securitate din Qatar, împreunã cu parteneri din 13 þãri, au desfãºurat un exerciþiu de securitate de cinci zile în întreaga þarã. Potrivit comitetului de securitate al turneului, exerciþiile, denumite Watan (care se traduce în arabã prin naþiune), au implicat 32.000 de membri ai personalului de securitate guvernamental ºi 17.000 din sectorul privat de securitate. In August, Pakistan agreed to send troops to Qatar to provide security during the tournament. The troops landed in Doha earlier this month. Also that month, the French parliament approved the deployment of about 220 security personnel to the Gulf state for the tournament. The deployment will ensure the security of fans, including French nationals.

In May, the United Kingdom’s Ministry of Defence said it will support Doha delivering a “safe” and “secure” World Cup. The ministry said it will back Qatar with military capabilities to counter “terrorism” and other threats to the football games. The support will include maritime security support from the Royal Navy, advanced venue search training, operational planning and command and control support, and further specialist advice, the ministry said.

Qatar also has an agreement in place with the United States Department of Defense to cooperate on “technical arrangements” during the tournament.

“The technical arrangements aim to identify and put in place the responsibilities related to cooperation between the two sides, and the US armed forces’ contribution to providing support the FIFA 2022 World Cup event,” Qatar’s defence ministry said in a statement earlier this month.

The United Arab Emirates-based The National reported earlier this year that former Jordanian soldiers were also being offered roles at the World Cup. As the World Cup approaches, increased security-related activities are being witnessed on the streets of Qatar. A central command centre has been set up to monitor security camera footage from all eight World Cup stadiums.
