Looking ahead, our teams have also been hard at work on the 2025 Iris Awards. The Iris Awards rules have been released and are now available on our website, www.irisawards.com. It’s time to start preparing your entries and planning your print journey because entries are open 1st - 29th June 2025. I personally can’t wait to see the amazing work of this years entrants.

We also want to give you a heads-up that, for the first time since 2015, there will be a small increase to entry fees — rising by $5 per entry. We understand this may be challenging for some, so to help ease the transition, we’re offering a pre-purchase entry pack: 10 entries at the 2023–2024 price, available for a limited time. And finally, I want to take a moment to acknowledge a significant change within our organisation. James Carnie, NZIPP’s longstanding lawyer and NZIPP Honorary Member, is stepping away from law. James has supported NZIPP for around 30 years, providing invaluable legal advice, helping shape our terms and conditions, and guiding both the organisation and our members through a variety of challenges. We are incredibly grateful for his unwavering support and contribution over the decades.

As we farewell James from this role, we warmly welcome our new lawyer, Anna Ryan, from Lane Neave Lawyers in Christchurch. We’re excited to begin working with Anna and look forward to the expertise and support she will bring to NZIPP and our members.

Celebrating Excellence: A Message from the Honours Council Chairperson

As Chairperson of the NZIPP Honours Council, I’m incredibly proud to reflect on the remarkable success of the 2025 Asia Pacific Photography Awards. Our volunteer team worked tirelessly to deliver a world-class event that showcased the outstanding photographic talent across our region. I want to extend my sincere thanks and admiration to everyone who played a role in making it such a success.

This year, we’ve completely rewritten the Call for Entries document to ensure the rules are clear, concise, and easier to follow. One important addition is the inclusion of the “Spirit and Intent” of the awards. This section sets the tone for the kind of work we hope to see and the values we aim to uphold. We believe this guidance will help all entrants better understand the purpose of the awards and align their submissions accordingly.

A special congratulations to Kris Anderson, our Overall Grand Champion—a truly well-deserved recognition for an exceptional body of work. The standard of entries across all categories was astonishingly high, making the judging process both challenging and inspiring. We were thrilled to host live judging of the Top 10 finalists, which offered an incredible opportunity for learning, appreciation, and celebration of photographic excellence.

I also want to take a moment to acknowledge the Honours Council itself—a dedicated team of volunteers who commit countless hours in the lead-up to and during the awards. Their professionalism, attention to detail, and passion for photography ensure the integrity and success of these events. We ask that all participants please remember this and approach any communication with kindness and patience.

If you had told me a year ago that I’d be having daily conversations with an AI, I would have raised an eyebrow. Probably both. But here I am, and truth be told, ChatGPT has become something of a quiet co-worker, a homework helper, and an unexpectedly helpful kitchen companion. I never set out to integrate AI into my life—certainly not with the kind of enthusiasm usually reserved for new gadgets or social media apps—but somehow, it just happened. And now I can’t imagine functioning quite the same without it.

At home, it all started innocently enough. My son, currently navigating his final year of school, often finds himself staring down dense assessment questions in his Year 13 subjects. They’re the kind of questions that make your eyes glaze over on the first read. One afternoon, after hearing him mutter under his breath for the fifth time, I suggested we pop the question into ChatGPT and just see what came out. Within seconds, there it was: a clear, simple explanation of what was actually being asked. Not a cheat sheet, not an answer to copy, just a breakdown of the task in language that made sense. His shoulders dropped a little, the anxiety eased, and a lightbulb went on. He started using it himself after that, checking with it to make sure he understood what the question required before he got stuck into writing.

That tiny shift changed our household. I realised that ChatGPT could offer more than just novelty responses and clever puns. I began turning to it in other parts of my day. Take cooking, for instance. I’ve got a Thermomix, and while it’s brilliant, not every recipe I find online fits its format. So, I started asking ChatGPT to convert standard recipes into Thermomix instructions. It’s a small thing, but it saves me time and takes the guesswork out of adapting. Then I went a step further and asked it to make keto-friendly versions of meals I loved. Not only did it do that, but it also came back with a whole week of keto meal ideas when I needed inspiration. I now have an ever-growing collection of AI-generated meal plans that keep dinner interesting and on track.

And then came one of those moments where you realise just how powerful this tool can be. My husband has studied monocytogenesis for over 25 years—a deep, scientific field not easily summarised. I was curious one evening and asked ChatGPT to write a basic explanation of the topic. In under a minute, it produced a concise, readable article that was accurate and impressively comprehensive. I handed it to him

with a grin. He read it, laughed, and said, “Well, that would’ve saved me a couple of decades.” It was tongue-in-cheek, of course, but the point stood: this thing wasn’t just useful. It was smart.

Naturally, once I saw what it could do in my home life, I started exploring how it might support my business. As a photographer, I wear many hats: creator, editor, marketer, administrator, problem-solver. And in all of those roles, ChatGPT has quietly become a resource I lean on.

When I’m experimenting with new editing techniques or see an image I admire online, I often find myself wondering, “How did they do that?” Sure, there are YouTube tutorials and Reddit threads, but sometimes you just want a straight answer without spending an hour scrolling. I can ask ChatGPT to analyse it—describe the colour grading, suggest the likely process, recommend Lightroom or Photoshop settings to achieve a similar look. The responses aren’t always perfect, but they’re almost always insightful. It’s like having a second set of (very informed) eyes.

Even when it comes to critique, it’s incredibly useful. I can upload one of my own photos and ask for constructive feedback. ChatGPT might comment on composition, lighting, or the emotional tone of the image. It’s not going to replace the feedback of a seasoned photographer, but it offers a starting point for self-assessment and improvement. It’s especially helpful during those quiet lulls when I’m working solo and craving a bit of perspective.

Marketing can also become easier. Writing blog posts, email campaigns, or even social media captions used to take hours. Now, I can draft ideas in ChatGPT, feed in a few prompts or keywords, and within minutes I have something to refine. It doesn’t do all the work, but it gets the wheels turning and gives me a solid framework to edit and personalise.

Another brilliant feature for photographers is its ability to help plan and organise shoots. You can use it to generate shot lists tailored to client types—weddings, branding sessions, product photography—and even location suggestions based on themes or desired moods. For those moments when you have a creative block or feel stuck in a repetitive cycle, ChatGPT has helped shake things loose with fresh ideas.

It’s also an incredible resource for drafting client communication templates. You can prompt it to generate a first draft of a client welcome pack, a model release form, or even a difficult client response email. These templates still need to be personalised and checked over for legal compliance, of course, but they save hours in the initial stages.

And then there’s the business development side. I’ve asked ChatGPT to help analyse the strengths and weaknesses of my website, suggest blog topics based on SEO strategy, and even draft press releases when I’ve launched something new. I use it as a sounding board to brainstorm ideas for promotions, pricing strategies, and customer engagement.

Some photographers might hesitate to involve AI in such a creative industry, worrying that it will erode authenticity. But I’ve found the opposite. By offloading the repetitive or administrative tasks, I’ve had more space to be creative. I’m spending more time planning creative concepts, experimenting with lighting, or curating images thoughtfully because I’m not bogged down by everything else.

Another game-changing application has been content repurposing. I might start with a long-form blog post about a recent shoot, then ask ChatGPT to repackage it as an Instagram caption, or an email newsletter paragraph. It keeps the messaging consistent while allowing me to meet different platform demands without rewriting everything from scratch.

And let’s not forget education. If I’m trying to learn a new technique or piece of gear, I can ask for an explanation that suits my current understanding—basic, intermediate, or advanced. It’s like having a tutor who’s always awake and never tired of your questions. Recently, I used it to help understand lens compression and how it impacts portrait photography in different settings. It explained the concept with analogies, diagrams, and examples until it finally clicked.

And yes, there are some very human touches you can add with its help too. I’ve written personalised thank-you notes for clients with the assistance of ChatGPT, drawing on small details from our sessions. I’ve crafted Instagram bios and business taglines, refined workshop proposals, and even written entries for award submissions.

What I love most is that ChatGPT grows with you. The more you use it, the better your prompts become. You begin to think in collaborative terms—how can I phrase this to get the best help? What context would improve the response? That process in itself is a form of creative development.

Of course, it’s not infallible. I’ve had my fair share of “What on earth is this?” Moments when the output veered wildly off track. But in every case, a bit of tweaking, rephrasing, or asking the question from a new angle resolved it. In that way, it’s actually taught me to communicate more clearly and think more critically.

So when people ask if AI will replace humans, No, it won’t replace us. But it will stand beside us, nudging us forward, helping us see things from a new angle. And in a busy life filled with business decisions, school assignments, dinner planning, and creative pursuits, that kind of support is invaluable.

I never expected to invite AI into my home and work life. But now that it’s here, I’m not letting it go any time soon. For photographers, creatives, parents, or just the endlessly curious—this is a tool that’s only just beginning to show its potential. The future isn’t waiting around the corner anymore. It’s already here, typing alongside us.

And in case you are wondering, no I did not write this article. Using a few basic prompts into ChatGPT gave me this article. I did give chat gpt a few key pieces of information - and this is what ChatGPT provided as an article. Aside from telling ChatGPT the content I wanted (which by the way, are all things I’ve asked it to do in the past!), I used a few simple key phrases to give me this article including: I asked for a 3000 word article. I asked for ChatGPT to NOT bullet point the article (it seems to love to do this!) I asked for this to be written in NZ English (or you’ll get the American version), I asked for this to be written in the first person and as a conversation. After reading the first draft, I asked ChatGPT to re-write the content again, giving you more solutions to improve your photography.

It truly is a powerful tool. I use ChatGPT on my desktop, which is free if you sign in to use it. You’ll be able to get a number of generations a day. I have honestly tapped out the system a couple of times when I’ve asked too much - but it really is so worthwhile, and worth looking into further if you need a little help.

This work delves into the first 75 years of the NZIPP’s journey, chronicling its evolution and milestones. We will publish a snippet of NZIPP’s history in each future edition of Pro Report.

From Page 9 of Hugh Perry’s book: The First AGM

The first AGM was also held in Palmerston North on 14th of September 1939 and the minutes note another issue that would occupy the attention of the Association/Institute on and off for decades. A letter from Geoff Perry from Wellington seems to have created considerable discussion before the meeting resolved to reply that ‘owing to the youth of the Association they have not been able to come to any finality on the copyright laws of New Zealand. It is interesting to note that Geoff’s son Hugh, officiating as a Presbyterian minister and friend at the funeral of photographer Richard Poole’s on the 24th of October 2008 was told by Leanne Dalziel, at that time MP for Christchurch East and a former cabinet minister, that after attending one of Poole’s photography courses she initiated changes to the copyright legislation. Dalziel said Richard’s continued mention of the profession’s grievances during the course had spurred her into action. Copyright was certainly a long standing issue for the Institute and changes in technology and globalisation will probably insure it remains an issue.

The meeting also resolved to write to the minister of customs seeking a relaxation of import restrictions on Photo Mounts. There was a letter received from newspaper proprietors that the meeting resolved not to act on but did agree to a resolution urging members to hold out for higher reproduction fees. Mr Hurst submitted a design for a badge but the meeting held any decision over until next AGM and invited members to summit alternative designs.

Offers were elected with H. E. Gaze as patron, the president A. B. Hurst, Vice president B. Hobday, secretary/Treasurer R Keys. The committee comprised Marie Dean, Amy Harper, S. Digby, J. Swainson, J. Lewis and M. Lampe.

The notes Ken Niven extracted from the AGM not only show the organisational structure being established but a move beyond the breaking down of suspicion between members to using group action in engaging with government. The Association/ Institute also engaged with photographic wholesalers who had the power to set terms of trade to their advantage with little regard for small businesses. The size of the New Zealand market place restricted the development of a variety of support products, like the mounts, mentioned in the minutes but successive governments were naturally keen to support local industry and maintain a healthy balance of payments. To have a common voice on such issues was a logical goal for an organisation of photographers. A common policy on pricing when dealing with large purchasers of photography who based their payments on their own profitability with little regard for the viability of the photographer was also desirable. The fact that photography mostly fitted into what would normally be defined as small businesses, as this first AGM demonstrates, gave the organisation some of the characteristics of a trade union seeking better remuneration and conditions through collective action, while at the same time promoting business practise and technical and creative excellence.

Creating your own actions is an excellent way to save time in processing the same repretitive tasks on images in Photoshop. You can even run an action within an action - and with the click of a button, your images have been processed without having to use the same manual process over and over again. This is my technique for creating my own actions.

Step 1: Open Photoshop & Prepare Your File

Open Adobe Photoshop.

Open or create a file that you want to use for recording the action.

Step 3: Create a New Action Set (Optional)

In the Actions panel, click the folder icon at the bottom (“Create new set”) to group related actions together.

Name your set (e.g., “My Editing Actions”) and click OK.

Step 2: Open the Actions Panel

Go to Window > Actions, or press Alt + F9 (Windows) / Option + F9 (Mac).

The Actions panel will appear.

Step 4: Create a New Action

Click the plus icon (“Create new action”).

Name your action (e.g., “Black and White Action”).

Choose the action set to save it in.

Click Record – Photoshop is now recording your actions.

Step 5: Perform the Steps You Want to Record

Now do whatever edits or tasks you want the action to automate. For example, this is my standard black and white conversion, which I can turn into an action:

Black and White Action: Go to Reset Swatches (D key on mac). Make black your foreground coour and white your background colour).

Go to Adjustments > Gradient Map

Change the dropdown ”method” to your preferred style. I like to use classic.

Every step you make here is is being recorded.

This is what my panel looks like when I’m recording:

Step 6: Stop Recording

When you’re done, click the square Stop button at the bottom of the Actions panel.

Step 7: Test Your Action

Open a new image. Select your action in the Actions panel. Click the Play button to apply the action.

Tips:

Some steps in your action may require you to have a flattened image before starting - so you can include flatten image as your first step if this is needed.

If you make a mistake, stop recording and delete the faulty step. You can double-click any recorded step to adjust its settings.

Save even more time by automating batches, or running scripts. How to Automate a Batch:

1. Go to File > Automate > Batch

2. Choose your action set. In this case, our set was called My Editing Actions.

3. Choose your action. In this example, the action was called Black and White Action.

4. Under “Source” Choose what files you’d like to run the action on. I like to open all my files frst and do the individual tweaks, then apply the action to all opened images. You can however select all files in a folder outside of photoshop and run the action without opening them all first.

5. Under “Destination” choose what you’d like to do with the files once the action has been completed. You can choose between none (will run the action but not close the image), Save and close ( I do not use this option.) or folder (select a folder destination and the fles will be saved to that folder).

6. Hit the OK button. Your action will be applied to all images.

I find this particularly helpful when I have multiple images requiring the same edit. As an example, I always edit my images in colour first, and then run all images through my black and white conversion action so I have both options to show clients. By setting up the action, and then running as an automation, I can process 100 images in all of two minutes.

How to run a script:

I sometimes use this option instead of automating a batch. I usually use this option when I want to save and close my images, I find it much faster and easier.

1. Go to File > Scripts > Image Processor

2. Select your images to process. Again, I usually use opened files.

3. Select where you’d like to save your images to. When I use the script processor, I’m always saving to a folder within my client folder that is specific to the action I’m using.

4. Choose how you want to save your file. If I’m not finished with my edits, I’ll save these as a tiff or psd file. If it is completed for a client (eg. when they are social media resized images) I’ll save them as jpeg.

5. Tick the run action button, choose your set, then your action, and click “run”. All images are processed behind the scenes. This is a very quick method to speed up your workflow!

The mindset & strategy for success with Johl Dunn AWARDS & CONFERENCE

It is about this time of year photographers that enter the awards start moving their attention towards what they will enter, should they enter, do they have time, anxiety about the feedback they will get etc. You also might find yourself working out if you should go to the conference, are the speakers relevant to you, will you get enough out of it and the cost etc.

Sound familiar? I want to come at this from a mindset point of view, having been to countless conferences, entered awards myself as a photographer and coached countless clients who have entered over the years, I think I have a unique perspective on this.

I have put this into 5 points or perspectives to consider when entering awards or thinking of coming to the conference.

Plan it out.

If you are entering give yourself a runway of 3-6mths and time block in when you are going to shoot, retouch, print and mount your entries. Reverse engineer the process; what I mean by this is start with the end in mind. Let’s say you want to enter 8 prints, start with having a date at least 3-4wks before the final deadline that you will have these ready to do then work backwards on the steps and time needed to do this. From here just time block in your calendar the first few steps and priorities it. A mistake I have seen with photographers I have coached is they get so consumed with it in the month leading up because they haven’t planned that their business takes a back seat and really suffers. Your business is your primary focus, and this is secondary so plan it out and time block it in for success.

Praise the action not the result.

Awards is all about self-improvement, gaining valuable feedback and utilising this moving forward in your craft. We tend to get so caught up in the result, what the judges say and our scores that it overshadows the whole point of the process.

The mindset to go in with is praising the action (entering the awards) and celebrate that and let go of the result. The scores and feedback you get is totally out of your hands and when we try and control and predict that which we can’t it causes stress and anxiety. This way no matter the result you have won.

Don’t take it personally.

This is a hard one as we are so personally invested in our art and what we create for awards that any feedback that we don’t like we take as a personal slight on us. Judging is subjective and a lot

of times you results are predicated on who is judging the images, what stage they come out and a whole lot of variables that are totally out of your control.

The judges sacrifice and put it a lot of time to give honest feedback on what they see and it’s just their point of view at that time so don’t take it personally.

Sit with the comments and try and see it as a neutral observer and use the feedback to improve and grow even if you don’t agree with it.

Your only competition is you.

The best competition you have is the previous versions of yourself so in reality you are only competing with yourself. Are you better than you were yesterday or last year, are you growing and improving, did you learn from feedback and improve. If the answer is yes, then that is all that matters.

Where the investment actually is in conference

There isn’t a cost to go to conference only an investment in time and money. I can tell you from being to numerous national and international conferences over 20yrs that I will go regardless of the speakers and content. Why? Because it is irrelevant to a large degree. I have sat in on speakers that upon first reflection had no relevance to me or what I thought I needed but I walked away with some inspiration, or a couple of small gems that made big differences once implemented into my business and life.

But where the real value lies are in the breaks, the parties, and the discussions with other photographers over a beer at night or a coffee in the morning. This is the priceless bonus of conferences, it’s the connections you make and the information and tips you get.

Being a business owner can be a lonely place at times but when you form a community around you and connections to lean on it can be an invaluable tool. I can honestly say that the NZIPP conference is at the top of my list every year because of the people, and I will travel over the ditch every year to see all those friends, past clients, and new connections I will inevitably make.

Simon Cartwright is an NZIPP Accredited Professional Photographer and NZIPP Associate of Photography, based in the Hawkes Bay region of New Zealand.

Simon Cartwright has spent over a decade honing his craft and building a business that reflects his creative roots, technical skill, and pragmatic approach to life behind the lens.

Working under the fitting name Simon Cartwright Photography, Simon has carved out a solid reputation as a specialist in commercial and event photography—capturing everything from high-end awards nights to large-scale music and sporting events. His photography is polished yet unpretentious, purposeful yet emotionally resonant.

But Simon’s journey wasn’t paved with glossy marketing or overnight success. Instead, it began—as many meaningful journeys do—with a spark of curiosity and a strong sense of encouragement.

“It sounds a little cliché, but I was always encouraged creatively,” Simon reflects. “From early on, I found photography gave me a way to express myself, and that creative calling just never left.”

Tracy Kennedy is our Accreditation Team Leader and is an NZIPP Accredited Professional Photographer and Master of Photography with Distinction. Tracy specialises in Wedding Photography and is based in the Waikato region of New Zealand.

Photography is a beautiful blend of art and science. While the creative side often takes centre stage, for example the NZIPP IRIS awards, mastering the technical aspects is just as crucial for professional photographers - which is where NZIPP Accreditation comes in.

Accreditation is submitting a portfolio of 15 images ( or 2 weddings ) to our Accreditation panel of 5 who evaluate the technical side of your photography portfolio.

Technical mastery is the foundation of professional photography. By balancing these skills with creativity, you can capture images that resonate with your audience and stand out in a competitive field.

In professional photography success hinges on a delicate balance between technical mastery and the ability to connect with clients.

From straight horizons, and objects coming out of heads, to correctly cropping an image, ensuring skin tones look good, the correct lighting, and even using the right gear and posing are all aspects of paying attention to the details in your image whilst shooting. Attention to details is very important. The care you take whilst taking the image, can save you lots of time in the long run. Eg;

• Horizon lines, trees coming out of heads, cropping of limbs, posing, background issues, bright spots in the image, posing of hands, wrinkles in clothes, clothes not sitting properly, jewelry sitting well.

• Straight horizons are fundamental to create a visually balanced image. Crooked horizons affect the composition and can look amateurish. Backgrounds are also important, take the moment to have a look and see if there is anything distracting, or highlights that need removing.

• Skin tones are the cornerstone of portrait photography. The ability to render natural and flattering tones can make or break an image.

This includes making sure your white balance is correct, is it too warm, too cold, is there depth in the shadows - the highlights not blown… also using post processing techniques help with magenta or green skin tones with hue and saturation, and retaining texture in the skin so it looks natural rather than plastic

Using the right gear, lens choice, the right settings, over exposure under exposure, where is the focus of the image - all of these

things are taken into consideration by the panel…. It shows you know what you are doing when you take an image.

Connection with clients is just as important as the more technical aspects. A relaxed and trusting subject will yield more natural and genuine images. This can be as simple as building comfort with non intimidating poses, engaging in conversation to put the client at ease and using positive reinforcement and compliments to guide the clients into poses. This boosts confidence within the client and you will get more natural images.

Lighting is important, both natural and artificial. Knowing how to manipulate both plays a big part in the success of your image.

Post Processing is an enhancement tool that will let you produce your best work.

Making sure images are straightened and level.

Cropping is used to refine the composition.

Being consistent. Create a cohesive editing style to create and maintain your brand identity. Making sure that your submission is cohesive, the editing is consistent and similar in your portfolio.

The panel get your submission a few days before meeting, so they have time to sit, to look in depth at each image and pick it apart - they are looking for that attention to detail, the mastery of technical skills, and the level of connectivity you have with your clients in the images presented.

It is a lot to think about when choosing your images to submit, but we also hope that it provides a valuable insight into the way you take your client photos, and think about those little things that end up being big things at times.

Embrace continual learning and experimentation to refine your craft and deliver exceptional results.

Prepping Image Files for Print Awards: the Details Matter

When preparing files for print awards, attention to detail is everything. What might pass unnoticed on screen can become glaringly obvious once committed to paper. Over-editing is a common culprit—what looks punchy on a backlit monitor can end up looking overcooked in print. Oversaturated colours, excessive sharpening, and crunchy contrast rarely translate well to ink, especially under the scrutiny of experienced judges.

Dust spots are another silent saboteur. They’re often missed when working digitally, especially on images taken with a longer exposure — but they stand out immediately in print. A handy trick to catch them early is to add a Levels adjustment layer and push the sliders hard in both

directions. This exaggerates tonal extremes and brings hidden dust spots to the surface. Once you’ve cleaned up your base image, simply delete the Levels layer.

Paper choice can elevate or undermine even the strongest image. With so many papers available, it’s worth thinking about the lighting conditions in the judging room, and how closely the image will be scrutinised. Texture, finish, and coating can all affect how tonal range and detail are perceived — and can even amplify the emotional impact of an image. If printing your own entries, take the time to test and choose the paper that works with your image.

Some considerations when choosing papers are:

- Colour temperature, all papers have slightly different colour temperatures, often a subtly warmer toned paper will be better for portraiture or newborn images

- Texture. Heavily textured paper can make skin look terrible, but when used for a minimalist landscape can add just enough interested to hold the eye in the frame long enough to increase the impact of the scene

- Sheen. High gloss and metallic papers can be great for impact and especially effective for images that have water or glossy elements in them.

- Matt papers can add a velvety richness or softer emotional impact to an image

Don’t be tricked into thinking that a Matt paper will be more forgiving to a softer/out of focused image – if you are trying hide that softness a matt paper will only make it look worse. If the image isn’t sharp where you feel it should be, perhaps it’s better to reshoot it to get the focus bang on before submitting it into the awards.

If you are working with a print house, ask if they have printed Iris awards before. Talk to them about paper options and ask for their recommendations. A printer that has experience with awards printing will be a gold mine of information based on the work they have done with other photographers over the years so they can be a beneficial educational resource. You can also learn a lot from printing rough test prints at home on plain paper with your desktop printer.

There is a lot that can be learned from printing your images as part of your workflow, it can also help you identify flaws in your shooting and/or editing techniques, which will result in helping you become a better photographer.

Business and Photography Questions and Answers with Richard Linton

Richard Linton is an NZIPP Accredited Professional Photographer and NZIPP Life Member, based in Christchurch, New Zealand. Richard has been a photographer for over 20 years and runs a successful photography business. He has a wealth of knowledge in technical aspects of photography, including camera gear, lighting, and business practice.

QUESTION:

Can you include a copyrighted building or artwork in your photos?

I’ve heard of from several photographers and I’ve even personally experienced security at a large public facility (that’s you Te Pae, the Christchurch Convention Centre) come out and inform photographers that they cannot photograph the building for commercial use (even though the photographs are made from a public place).

When pressed the particular guard I spoke to talked about the building being subject to copyright which was owned by the architect. I politely rejected their understanding of copyright law, let them know that due to not having a spare $475 million, I had no intention to build a clone (which would infringe copyright), and that my act of making photographs was not infringing any law. In a bit of a Karen moment I suggested that the police would be able to enforce any laws being broken if they wished to call them. I had work to do and continued making photos. I was confident that the only law being broken was as a result of the low riding pants the guard was wearing.

I’ve heard other photographers discussing a similar matter of whether the incorporation of artworks such as sculptures or murals in their images breaches copyright.

In some countries the term ‘fair use’ is often mentioned. The New Zealand Copyright Act 1994 does not include a general fair use exception to copyright infringement, but instead provides various specific exceptions to infringement and relevant to this matter is section 73...

73 Representation of certain artistic works on public display

(1) This section applies to the following works:

(a) Buildings:

(b) Works (being sculptures, models for buildings, or works of artistic craftsmanship) that are permanently situated in a public place or in premises open to the public.

And the section goes on to say ‘Copyright in a work to which this section applies is not in fringed by copying the work by making a photograph or film of it’

Buildings and sculptures are clearly fair game to photograph and while it open to interpretation, I believe a reasonable person would consider a mural on the side of a building to be a ‘work of artistic craftsmanship’

There is a New Zealand case that tested this law in 2007, Radford v Hallenstein Bros Limited.

John Radford was a sculptor who had three of his large architectural works located in a public park in Auckland. Hallenstein’s commissioned and sold, as part of a range of garments made in China, t-shirts that included on them a photograph of two of the three architectural sculptures. Mr Radford objected to this and bought a claim in the District Court alleging copyright infringement, importation into New Zealand of copies of his sculptures (i.e. the t-shirts) knowing or having reason to believe that they infringed copyright and breach of his moral rights. The court determined that Hallenstein’s had not breached any copyright. Mr Radford appealed to the High Court and they upheld the lower courts finding. Hallenstein’s was off the hook so to speak.

In this case it was clear that the graphic (a photo of an artwork installation) helped Hallenstein’s sell shirts, but the courts concluded that under s73 of the Copyright Act no infringement occurred.

What I take from this, is as a photographer if you include a building or artwork on permanent public display in your images, you should be well protected from any claims that you have infringed someone else’s copyright.

That said, I personally do believe that where a public artwork is used in a blatant reproduction e.g. making calendars or greeting cards that are essentially a copy of the original artwork rather than an element in an entirely new/derivative work, artists may have a right to feel somewhat aggrieved, there is an interesting story on this here...
