Budgets raise concerns

It's that time of year again when the municipalities have announced their budgets and residents should prepare for price increases.

The Overstrand Municipality's Final Budget, Final Integrated Development Plan (IDP) Review and amendment, as well as the Final Disaster Management Plan for 2025-'26 was approved by council on 29 May, and will be in effect from 1 July.

In his first budget speech for Overstrand, Executive Mayor Archie Klaas highlighted the difficult financial climate globally, nationally and locally.

He added that many households are struggling to afford municipal services, which adds pressure to the municipality's ability to deliver services effectively. "Despite this, the key priorities must remain job creation and local economic growth," he said.

He furhter noted that after the tabling of the draft budget at the end of March, it led to 164 public submissions from the community. All comments were considered for the final budget. The major concerns raised included tariff affordability, baboon management, management of informal settlements and indigent relief. "It is important to note

that municipal cost drivers differ from the basket of goods and services used to determine CPI. For example, employee costs, a major budget component of 29,9% of the total budget, has seen an increase of 7,5% having increased through national bargaining agreements, and bulk electricity purchases (26% of operating costs) have increased by 11,32%."

According to him the current baboon management programme has been extended until January 2026. "A review, in consultation with Cape Nature, will include a public participation process before any final decisions are made."

The low income households can breathe a sigh of relief. "The indigent support programme provides free basic services - including 70kWh electricity, 10 k l water, 7 k l sewerage, and monthly refuse removal - to low-income households earning up to four times the old-age Sassa grant. To further support vulnerable residents, the residential property value ceiling for rates relief will increase from R300 000 to R350 000. This means homes valued up to R350 000 won't pay property rates. Additional residential rebates and indigent services remain in place."

Gordy, our own navy seal

The highly socialised Southern elephant seal, affectionately nicknamed “Gordy”, continues to captivate Capetonians and social media users alike with his series of unexpected land excursions.

After famously bringing traffic to a halt in Gordon's Bay last Tuesday 27 May, Gordy made a subsequent appearance in Simon's Town just days later and has since found a secure and monitored resting spot at the Naval Base.

Gordy, a sub-adult Southern elephant seal, first shot to global fame last week when he was spotted leisurely wandering the streets of Gordon's Bay.

This initial land outing sparked a significant nine-hour rescue operation involving multiple agencies, who eventually guided him safely back to the ocean at Kogel Bay. His journey continued with a sighting at Kalk Bay the very next day before he once again ventured into the open water.

However, Gordy appears to have developed a discernible fondness for dry land. The Cape of Good Hope SPCA confirmed his latest re-emergence, reassuring anxious followers with the update: "Gordy’s back – but he’s safe! Our favourite blubbery visitor has hauled out again. This time at the Naval Base

in Simon’s Town."

Belinda Abraham, communications manager at the SPCA, confirmed this week that Gordy remains under their watchful eye in Simon's Town, stating, "We're still monitoring him."

Adding another layer to Gordy's unfolding story, Meredith Thornton of Marine Dynamics, who manages a marine volunteer programme, suggests that this charismatic elephant seal's adventures began even earlier. "From the behaviour and photos it seems to be the same one that came ashore in Hermanus on Sunday 25 May," she revealed.

Gordy's escapades have become a

viral sensation, with businesses even cashing in on his celebrity. Security service Fidelity ADT joined the “Gordy fan club” with a meme depicting their officers keeping watch near the seal, captioned “Keeping you safe on SA’s wild streets”. An ice cream company humorously featured Gordy enjoying an ice cream as part of his "bucket list", while numerous other trendy memes, including one portraying him as a "Navy Seal", continue to circulate widely online.

Sperm whale at Struisbaai

Struisbaai residents and nature lovers were shocked on hearing of the adult sperm whale stranded in the surf zone in front of Langezandt Fisherman’s Village in Struisbaai on 27 May.

Don Marx, a whale observer knowledgeable about the various species, particularly those off the Southern Cape and False Bay coast, commented on Facebook: “When first light broke this morning my dad and mom went to check on the whale, but it had sadly died. They sent me some photos of this truly incredible creature of the deep.

We don’t encounter many sperm whales off the coast of South Africa; I saw a pod of four once, off the canyon at Cape Point.”

According to Marx sperm whales are the largest-toothed whale, males reaching up to 18 m and weighing up to 57 tons.

They have been recorded diving more than 3 000 m for more than 60 minutes.

“They possess the most asymmetrical skull of any mammal and have the most

powerful echolocation sonar of any animal. The spermaceti organ, located just inside their forehead, contains a waxy liquid called spermaceti, which is thought to be involved in buoyancy control and echolocation. The spermaceti oil was the reason they were almost hunted into extinction.”

The Department of Forestry, Fishery and the Environment (DFFE) confirmed: “On 27 May DFFE officials visited the site to meet with municipal representatives and witness the situation first-hand. “By this time the whale carcass had begun decomposing, making further sampling impossible. However, not all is lost, stakeholders were able to collect valuable scientific data while the specimen was still fresh.”

The National Strandings Network has recommended that the skeleton be preserved as reference material for researchers, scholars and the public. “Coordination is now underway among the DFFE, South African National Parks and Agulhas

National Park to make this possible,” the DFFE stated. Experts say sperm-whale strandings in SA are rare, given “they are deep-water whales”, the last in August 2018 at Swartvlei Beach, near Sedgefield, when a dead 16,37 m sperm whale washed ashore.

Lt.kol. Malcolm Pojie, ’n provinsiale polisiewoordvoerder, het bevestig die verdagtes, wat onderskeidelik 35 en 39 jaar oud is, is die afgelope Woensdag (28 Mei) in ’n veiligheidskompleks in Paarl vasgetrek.

“Die voortdurende stryd teen bendegeweld in die Wes-Kaap het vrugte afgewerp toe lede van die teenbendeeenheid en speurders twee mans opgespoor en in verband met die driedubbele moord op 11 Mei in Hawston – wat die lewe van drie vermeende bendelede geëis het – in hegtenis geneem het,” het Pojie gesê.

Drie mans – Uwellin “Pork” Salies, Vittorio Julies en ’n derde, wat slegs as Royston geïdentifiseer is – is in die aanval op Moedersdag, toe verskeie gewapende mans uit ’n wit BMW met CEM-nommerplate gespring en skote op hulle afgevuur het, noodlottig gewond. Salies en Julies is op die toneel dood

verklaar terwyl die derde slagoffer later die aand in die hospitaal aan sy wonde beswyk het.

Die teenbende-eenheid en speurders het verlede week inligting oor waar die verdagtes moontlik skuil, opgevolg.

Dit het hulle na die kompleks in Paarl gelei, waar hulle die geïdentifiseerde perseel takties benader en die verdagtes in hegtenis geneem het.

Volgens Pojie het die polisie tydens die optrede ook beslag gelê op ’n AK47geweer en agt patrone sowel as drie 9 mm-pistole waarvan die reeksnommers afgevyl was, sowel as ander ammunisie.

“Die vuurwapens sal vir ballistiese toetse gestuur word om te bepaal of dit gebruik is om misdaad te pleeg,” het Pojie bygevoeg.

Die Wes-Kaapse polisiekommissaris, lt.genl. Thembisile Patekile, het die beamptes vir hul toewyding bedank om gemeenskappe in die provinsie te beskerm deur misdadigers aan te keer.

Die verdagtes het die afgelope Vrydag (30 Mei) op aanklagte wat met die onwettige besit van vuurwapans en ammunisie verband hou, in die Paarl-landdroshof verskyn.

Die saak is tot Vrydag 6 Junie uitgestel en die verdagtes word aangehou.

“Afhangend van die ballistiese toetse se uitslae kan moontlik nog aanklagte bygevoeg word,” het Pojie gesê.

Napier murder: Suspect arrested while behind bars

A suspect who had already been behind bars was arrested and charged with a 78year old man's murder in his house two weeks ago.

Police have confirmed that the 31-yearold suspect was behind bars for an unrelated matter when he was charged with the house robbery and murder that took place in Plein Street, Napier on Sunday 4 May.

"The suspect was arrested and formally charged on Tuesday 20 May," the police reported in a statement.

The suspect made his first appearance in connection with the house robbery and murder in the Bredasdorp Magistrates' Court on Thursday 22 May. The case was postponed.

The quiet rural community was left stunned when news of Beyers de Wet Theron's senseless murder became known. The elderly man's body was found with severe head injuries and a post mortem was conducted to determine the exact cause of death.

The Landscape History and Heritage of Southern Africa (Ilasa) paid tribute to Beyers on it's Facebook page stating, "It is with deep regret that we pass on the sad and tragic news that Beyers de Wet Theron passed away on 4 May 2025 following a break-in and robbery at his home in Napier, Western Cape.

"Beyers was an academic and an intellectual and held two master’s degrees

in the field of Landscape Architecture. Since the 1980's he lectured in this discipline at the Cape Technikon and later at the Cape Peninsula University of Technology until he retired in 2012. He was an amazing plant enthusiast and inspired many of his students to broaden their plant knowledge. He was highly thought of by his colleagues at these institutions and was willing to help wherever possible."

The organisation went on to say that Beyers would be remembered for his "service to education and the promotion of the landscape profession" before he moved to Napier upon his retirement in order to enjoy a life in the countryside.

No foot to stand on: ‘Voetstoots’ and the costs

In terms of our law of contract, sellers are generally not liable for latent defects in goods sold “voetstoots”, unless they intentionally conceal defects or misrepresent the condition of the goods. This principle was recently reiterated in the case of Meiring v RC Auto and Others (4048/2024) [2025] ZAFSHC 31.

The case centred on a second-hand vehicle sold to the applicant and falsely described as “accident-free” with a “full-service record.” On discovering the vehicle had extensive latent defects and had been involved in a prior collision the purchaser sought to cancel the sale and reclaim his payment on the grounds of misrepresentation.

In making its finding the court considered the difference between a latent defect and a misrepresentation on the part of the seller. It clarified that a latent defect is a hidden flaw not easily observable during an inspection, and which impairs the utility of the item for its intended purpose. A seller is typically shielded from liability under a “voetstoots” clause unless they knew of the defect and deliberately withheld the information or acted fraudulently.

A misrepresentation, on the other hand, is when a seller falsely represents that goods are free of defects or intentionally conceals critical flaws to get the buyer to make the purchase. In such an event the buyer may be able to rely on this misrepresentation to cancel the sale.

The court, accordingly, found in favour of

the purchaser, noting that the representation that the vehicle was accident-free was material, false and intended to induce the purchaser, and that the seller had knowingly misrepresented the condition of the vehicle. The court ordered that the purchaser was entitled to cancel the oral contract of sale and claim restitution based upon the misrepresentation.

The takeaway from this case is that a ‘voetstoots’ clause cannot be used as a shield for fraudulent behaviour and that honesty is critical when selling goods, particularly as concealing known defects or providing false information not only undermines the trust in commerce but can expose one to legal consequences.

A 31-year old man has been charged with house robbery and murder after Beyers Theron’s body was discovered in his Napier home on 4 May.

The approved budget for the 2025-'26 Medium Term Revenue and Expenditure Framework (MTREF), provides for tariffs increases for the respective municipal services ranging between 6% and 10%, the details as follows: Property Rates (9,7%), water (6,2%), sewerage (6%), refuse removal (6%), electricity (approx. 9,96%) and sundry tariffs (6% unless otherwise stated).

Towards the end Mayor Klaas confirmed that the Care projects allocation of R50 000 per councillor will continue.

Theewaterskloof Municipality

With Theewaterskloof Municipality regularly in the news for misappropriation and fraud by officials, the mayor, Lincon de Bruyn, said they remain steadfast in their mission to restore financial stability, improve service delivery, and uphold good governance.

"When we presented the draft budget in March, we were honest about the challenges facing this municipality. I am pleased to confirm that we have fulfilled our obligations as laid out in the draft budget presentation," he said.

The following tariff increases are approved: Property Rates (7%), water (8%), sewerage (5%), refuse removal (5%) and electricity (11,32%).

According to him the hike in electricity is lower than the initial draft figure and aligned with Nersa's approved

cost-of-supply study.

He said he is happy to announce that the municipality is on the path to recovery.

“That recovery is real. And it is already visible in the financial discipline we are rebuilding and the service delivery focus we are restoring. But we are under no illusion - we will need all hands on deck to make a success of this budget and turnaround strategy. It demands united efforts from both the administration and the political leadership. And I am proud to say that significant strides have already been made. We are investing in infrastructure, reprioritising capital projects, containing costs, and focusing on core service delivery areas - water, sanitation, refuse removal, and electricity," De Bruyn said.

Cape Agulhas Municipality

Cape Agulhas Municipality convened its Council meeting on 30 May and adopted the 2025-’26 Integrated Development Plan (IDP), alongside a R578 million annual budget. “This budget is credible and sustainable. It prioritises service delivery while safeguarding our financial stability,” said the mayor Raymond Ross.

The following tariff increases are approved: Property Rates (4,4%), water (6,5%), sewerage (6,5%), refuse removal (11%) and electricity (11,32%).

Kidbrooke Wellness Hub opened

The long wait is over, and after years of planning the retirement village Kidbrooke Place officially opened the doors of its Wellness Hub on Friday (30 May).

The vision of its trustees, of a centre that offers an holistic approach to wellness for people in their retirement years, was shared with guests at the event. Guests, including newly-elected Mayor Archie Klaas and Deputy Mayor Elnora Gillion, as well as the Speaker of the Overberg District Municipality Lindile Ntsabo, were accorded red-carpet treatment with welcome drinks.

"We are here to celebrate the opening of our new Wellness Hub at Kidbrooke Place,” said trustee Mariette Skinner of The Hudd Trust, “a space in vision, build and now brought to life. This is the beginning of a new chapter for the community.”

Adventure and natural beauty await mountain bikers at one of the Western Cape’s most picturesque challenges as the De Hoop Vlei MTB Experience returns to the stunning De Hoop Nature Reserve from 13-15 June.

The two-day stage race offers riders a unique opportunity to traverse one of South Africa’s most beautiful nature reserves while tackling challenging terrain designed to test technical skills and endurance.

Stage 1 will challenge competitors with the legendary Flatrock section and the notorious Dennis the Menace climb, known for separating casual riders from serious competitors.

Stage 2 takes participants through the breathtaking landscapes of Potberg and Vaalkraans before culminating with the spectacular Koppie Alleen coastline route.

Overstrand Whale Boxing Club in Zwelihle has once again proved its mettle at an international boxing tournament where Simamkele Damesi, one of the club's star boxers, won a bronze medal.

Another feather in OWBC's cap is the fact that the club's founder and head coach, Mzi Damesi, served as Team South Africa’s head coach for this important event that took place from 22-27 May in Luanda, Angola.

The international boxing tournament was held at the pavilion of the Sports Citadel and was part of Angola’s 50 Years of Democracy celebrations. Eighty boxers from seven African countries participated in the tournament.

Although it was his first stint as head coach of the national boxing team, Mzi was rewarded for his efforts and coaching skills when five of the six boxers who represented South Africa at the international tournament won bronze.

“Thank you to the South African National Boxing Organisation for placing their trust in me and giving me the opportunity to coach the national team for this event in Angola. I must say a special word of thanks to EMS Foundation because if it weren’t

for their support, my boxers and I would never have been able to attend the national championships where we could show off our skills and be noticed,” Mzi stated.

That boxing runs deep in the blood of the Damesi family, is clear. Simamkele’s older brother Siphamandla is a four-time national gold winner who has represented South Africa at the Brics Sports Games in Kazan, Russia in 2024. Simamkele and Siphamandla are Mzi’s nephews.

Simamkele, who is currently the national champion in the 67kg division, was the only boxer from the Western Cape to be included in the team that also included two boxers from the Eastern Cape, one from Mpumalanga, one from Limpopo and one from Gauteng.

These boxers’ performance, said Mzi, will be finely scrutinised at upcoming tournaments to determine whether they will qualify for the Olympics qualifying team.

“I believe Simamkele can qualify if he receives the necessary support that will enable him to train to the best of his abilities and participate in all the tournaments and training camps,” Mzi stated. “That is why we are pleading with local businesses and individuals to come forward as sponsors for

coordinator Marius van Rensburg. “Riders will be pushed to their limits while surrounded by some of the most stunning scenery the Western Cape has to offer.”

The event is more than just a race, it offers participants a complete weekend experience.

Participants will enjoy all meals catered by the renowned De Hoop Collection from Friday evening through Monday morning.

The weekend kicks off with a wine tasting welcome on Friday night and concludes with a traditional boma braai on Sunday evening, allowing riders to relax and share stories before returning home on Monday.

Additional amenities include two sport therapy sessions provided by EPT Recovery, an event T-shirt, bike washing and mini-service facilities after each stage, strategically placed waterpoints along the routes, and full medical support.

Overstrand Whale Boxing has a state of the art gym that was built and equipped with the financial backing of EMS Foundation and other generous donors. But this gym isn’t only home to the boxers, it is also used by various organisations to host events.

“We are extremely grateful to EMS Foundation for this building that serves to bring communities together. Atlantics Rugby Club practises at our gym every Wednesday, Spairo Art Foundation uses it on Tuesday afternoons, the Hermanus Spiritual Gospel Group from Zwelihle has their practise sessions there and on Sundays church services are held in our hall,” Mzi explained.

He added that because OWBC is a non-profit organisation they invite everyone to join the club to get fit and learn some boxing skills free of charge. “It is open to everyone, boys and girls. Younger

“It is open to everyone from all genders and races, but we want to extend a special invitation to young girls so that they can learn self-defence skills. This is very important to us because gender-based violence is a big problem in our communities,” Mzi stated.

In honour of Youth Month, OWBC will host a special boxing tournament at the gym on 21 June. Clubs from Grabouw, Villiersdorp, Stellenbosch and other areas will also be competing at this event that will kick off at 10:00. Tickets to the tournament cost R40 for adults and R10 for children.
